First, let me express my thanks to Attorney General Medina Mora and Secretary of Government Gomez Mont for making this conference possible.

This is my first trip to another country as Attorney General.   I wanted to come to Mexico to deliver a single message: We stand shoulder-to-shoulder with you in this fight against the narcotics cartels.  The United States shares responsibility for this problem and we will take responsibility by joining our Mexican counterparts in every step of this fight.

And, together, we will win – thanks in large part to the courage of my Mexican colleagues here today, who are on the front lines every day, and with whom I am proud to collaborate.

The topic that has been addressed over the past two days could not be more important – the development of an arms trafficking prosecution and enforcement strategy on both sides of the border.

I would like to thank the Mexican and U.S. experts who have worked so hard on this issue.  On our side, Secretary Napolitano and I are committed to putting the resources in place to increase our attack on arms trafficking into Mexico.

Last week, our administration launched a major new effort to break the backs of the cartels.  My department is committing 100 new ATF personnel to the Southwest border in the next 100 days to supplement our ongoing Project Gunrunner, DEA is adding 16 new positions on the border, as well as mobile enforcement teams, and the FBI is creating a new intelligence group focusing on kidnapping and extortion.  DHS is making similar commitments, as Secretary Napolitano will detail.

But as today’s conference has emphasized, the problem of arms trafficking will not be stopped at the border alone.  Rather, as our experts emphasized, this is a problem that must be met as part of a comprehensive attack against the cartels – an attack in depth, on both sides of the border, that focuses on the leadership and assets of the cartel.  This is the type of full-bore, prosecution-driven approach that the U.S. Department of Justice took to dismantle La Cosa Nostra – once the most powerful organized crime group operating in the United States.
With partners like those we have here today, I am confident that together, we will defeat these narcotics cartels in exactly the same way.  I am proud to stand with you, and to join you in this fight.  Thank you again for inviting me here.”

“The Justice Department is trying to protect its political appointees from the Fast and Furious scandal by concealing an internal “smoking gun” report and other documents that acknowledge the role top officials played in the program that allowed firearms to flow illegally into Mexico, according to the head of the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Kenneth E. Melson, the ATF’s acting director, also told congressional investigators this month that the affidavits prepared to obtain wiretaps used in the ill-fated operation were inconsistent with Justice Department officials’ public statements about the program. Justice Department officials advised him not to raise his concerns with Congress about “institutional problems” with the Fast and Furious operation, Melson said.
“It was very frustrating to all of us,” Melson told congressional investigators in a private meeting over the Fourth of July holiday, “and it appears thoroughly to us that the department is really trying to figure out a way to push the information away from their political appointees at the department.”

Not only was the department slow to react, Melson said, but Justice Department officials indicated they did not want him to cooperate with Congress.”

They spoke to reporters and answered questions about plans to send about 500 more agents and equipment to the nation’s southwestern border and Mexico to fight Mexican drug cartels and keep violence from spilling over into the United States. Secretary Napolitano said officials were still considering whether to deploy the National Guard to the Arizona and Texas borders with Mexico, which the governors had requested. She also acknowledged that greater efforts were needed within the U.S. to combat the drug trade.”

It has been more than 18 months since our son, Brian Terry, was shot and killed by a Mexican drug cartel armed by a failed U.S. Department of Justice “gunwalking” operation known as “Fast and Furious.”

The pain that Brian’s death has caused our family is indescribable. No matter what words we use in this letter to you, we will never be able to justly convey how much suffering we have endured. We still grieve every day, and we are resigned to the fact that the agony of his death will stick with us for the rest of our lives. Not because he didn’t achieve his dreams . . . not because he didn’t live his life to the fullest . . . and not because he didn’t leave anything behind that we couldn’t celebrate or remember.

Our family will be forever grief-stricken because Brian didn’t have to die.

We wish we could take solace knowing that Brian died doing what he loved to do. After all, it was his childhood dream to make a career in law enforcement and become a federal agent.

As a youngster, Brian was inspired by his Uncle Bob, a Michigan police offer who would give Brian tours of the police station and share stories of what it was like to be a police officer. From then on, Brian believed he was destined for a career in law enforcement. He joined the Marine Corps after high school and served four years in Naples, Italy before becoming a police officer in Lincoln Park, Michigan – just like his uncle. But Brian’s ultimate dream was to become a federal agent, and so he applied to the United States Border Patrol.

In 2007, he attended the Border Patrol Academy in El Paso, Texas, graduating as president of his class before being assigned to the Naco station near Bisbee, Arizona, only a few miles from the U.S.-Mexican border.

Brian accomplished exactly what he wanted to. But all of what he had worked for – and all our family had come to adore and love – was taken away so abruptly . . . so needlessly.

On December 14, 2010, Brian was conducting operations as a member of the Border Patrol Tactical Unit in Nogales, Arizona. He and his team encountered five Mexican drug cartel bandits in the “Peck Well” area near Rio Rico, Arizona. Not knowing the bandits were carrying the latest military grade assault weapons provided by the Justice Department as part of Operation Fast and Furious, there was an exchange of gunfire and Brian was shot in the lower back.

He died on December 15, 2010.

Before then, our family was expecting Brian to return home for Christmas. What we were not expecting was that he would return home in a flag-draped casket. All because of an ill-conceived government gun trafficking investigation gone horribly awry.

The Justice Department’s “gunwalking” operation called for American gun dealers to sell weapons to “straw purchasers” tied to Mexican drug cartels between 2009-2011. The intention was to track the guns as they were sold to Mexican drug lords, which would theoretically lead to the arrests and dismantling of the cartels.

But that’s not what happened. It turned out that there was no actual plan to track the movement of the guns as they were “walked” into Mexico.

As a result, one of our four children and as many as 200 Mexican citizens were killed with weapons connected to the operation.

Still, hundreds of guns sold as part of Operation Fast and Furious remain unrecovered, putting more brave law enforcement personnel along the border – like our son – at unnecessary risk.

Even though our son fell in the line of duty more than 18 months ago, we still don’t have answers that explain why he had to die.

Unfortunately for our family and the families of others who have been injured or killed with these weapons, our son’s death has ballooned into a national controversy. Currently, the House Oversight Committee is moving forward with contempt proceedings against Eric Holder, the U.S. Attorney General and head of the Justice Department, for failing to comply with a congressional subpoena requesting all of his communications regarding Operation Fast and Furious. Our hope is that the Justice Department is not withholding information that could expose those who are responsible for our son’s death.

It has been nearly eight months since Mr. Holder was served his subpoena, and we know little more now than we did then. We think our family and Brian’s memory deserve better.

So even though this government investigation drags on and prolongs our family’s suffering, we are taking action.

We have established the Brian Terry Foundation not just to preserve Brian’s memory and honor his service to our country, but to also help families of other U.S. Border Patrol Agents who have been killed or injured by providing ongoing emotional and financial support, establish educational scholarships, recognize the heroic efforts of current Border Patrol Agents, and raise public awareness of the flawed Fast and Furious investigation. It is also our personal mission to guarantee that any mistakes made by the Justice Department are never made again.

Because of Operation Fast and Furious, some of the most dangerous criminal organizations in North America have been strengthened, and now our Border Patrol Agents are in the gravest danger of their lives.

So please, we urge you – not just for our son, but for all U.S. Border Patrol Agents who came before him and who will come after him – to join our cause and give as generously as you can. We have to make sure that nothing like Fast and Furious ever happens again, and without grassroots support from folks like yourself, our mission fails. This failed government operation cost our son his life, but that doesn’t have to stop us from saving the life of someone else’s son.

Democrat who conducted polygraph indicted for campaign fraud”

“Last week, Robert Braddock Jr. – the Democratic Party operative who taped the lie detector test administered to Sinclair in February 2008 – was indicted in an unrelated matter by federal authorities and charged with conspiring to conceal campaign donations.

Braddock’s polygraph concluded Sinclair was lying.

But Sinclair continues to insist the charges in his book against Obama are true and that he has been a victim of a White House-organized campaign to discredit him.

Amazon claims

As WND reported, U.S. District Court Judge Richard J. Leon dismissed a libel case against Sinclair for Sinclair’s claim that top Obama adviser David Axelrod paid $750,000 to rig the results of the polygraph test.

Leon ruled in his Feb. 28 opinion dismissing the case that the plaintiffs, Daniel Parisi and his Internet porn site Whitehouse.com Inc., failed to show Sinclair had published any knowingly false statements. The judge concluded Sinclair had taken appropriate steps to verify information before publishing it.

Parisi filed March 30 jointly with Sinclair a “Stipulation and Order of Voluntary Dismissal,” which effectively ended Parisi’s claims against Sinclair.

Parisi, however, decided to appeal Leon’s March 31 order dismissing the libel case against Amazon.com.

“The issue before this Court is narrow and straightforward: Must an online bookseller stop selling a book based on mere allegations that its content is defamatory?” the lawyers for Amazon.com wrote in a brief filed with the U.S. Circuit Court of Appeals for the District of Columbia May 17. “The answer is no, particularly where, as here, a separate unchallenged ruling of the District Court determined the book was not defamatory.”

Noting that Leon’s opinion had established a standard of “actual malice” in the case, the Amazon.com lawyers argued that the case against the online bookseller could not be sustained because it could not be proved that Sinclair’s book was false or that Sinclair had written the book in reckless disregard of whether it was false or not – a definition of “actual malice” set in the famous 1964 Supreme Court case, New York Times Co. v. Sullivan.

“I believe Amazon attorneys prepared a very strong and correct brief,” Sinclair told WND. “And I agree with Amazon’s reference that the Parisi brief appears to be more for the purpose of further publishing vicious attacks against me personally than it is to challenge the legal findings of the District Court in their March 31, 2012, dismissal of Parisi claims as they relate to Appellee/Defendant Amazon.com Inc.”

The U.S. Circuit Court of Appeals for the D.C. Circuit has scheduled Parisi’s appeal against Amazon.com for oral argument on Sept. 20 at 9:30 a.m.

Sinclair told WND he plans to be present for the oral arguments.

Lie detector

Meanwhile, the campaign for U.S. House of Representatives conducted by Connecticut Speaker of the House Chris Donovan was rocked last week with the arrest of his campaign finance director, Robert Braddock Jr.

Braddock recorded the Sinclair lie detector test in his capacity as the director of business development for the website Whitehouse.com.

According to an affidavit FBI Special Agent William B. Aldenberg filed last week in federal court in Connecticut, Braddock arranged for Donovan’s campaign to accept “conduit contributions” from individuals, “the purpose of which was to conceal the fact that the individuals actually financing the payments had an interest in legislation which was expected to and did come before the Connecticut General Assembly during the 2012 legislative session.”

Specifically, Braddock solicited campaign contributions from “roll-your-own,” or RYO, smoke shop owners who sought to defeat a proposed Connecticut law that would have imposed on them a tobacco manufacturers’ designation requiring a substantial licensing fee and tax increase.

Aldenberg’s affidavit detailed a series of recorded calls and meetings with undercover FBI officers in which Braddock arranged at least two payments of $10,000 to Donovan’s campaign. The payments consisted of four $2,500 checks in one instance and three checks amounting to $10,000 in the second. The contributions were made in the names of “conduit contributors,” or payments made by one person in the name of another.

The scheme was designed to hide the fact that the RKO smoke shop owners were making the campaign contributions in exchange for Donovan’s agreement to kill the revenue measure.

The affidavit recommended Braddock be indicted for conspiring to unlawfully conceal campaign contributions in violation of federal statutes.

Braddock was fired by the Donovan campaign after his arrest.

According to Courant.com, Donovan temporarily relinquished some of his duties as speaker of the Connecticut House of Representatives in the wake of Braddock’s arrest but has not abandoned his congressional bid.

The tax measure effectively died May 9, when the Connecticut legislative session ended without either chamber calling for a vote.

In reporting the incident, the Connecticut Post described Braddock as “a hired gun from North Carolina who over a short career has raised millions for several campaigns” and “is known as a savvy, cool-under-pressure operative,” who once worked “for an adult entertainment website.”

The Connecticut Post further reported that Donovan’s campaign had been selected from a pool of prospective candidates recommended by the Democratic Congressional Campaign Committee.

Sinclair noted on his website that Braddock, since his indictment, has scrubbed from his social networking Web postings his prior links to Brook Colangelo, chief information officer at the executive office of President Obama and the CIO of the Democratic National Committee from 2007 to 2009.”

One of the strongest reasons for covering the Larry Sinclair allegations and subsequent stories here was because the Obama camp executed a well orchestrated attempt to keep this information from the American people. The mainstream media was part of this effort.

“”Politico isn’t reprinting Sinclair’s allegations because they are unsubstantiated.” So wrote Ben Smith of Politico on June 18, 2008.

Those were the days!

Smith was referring to Larry Sinclair, who had enraged the Obama faithful by renting space at the National Press Club, there to share his allegations of a drug-fueled sex tryst with Barack Obama in 1999.

Smith, however, was not at all shy about sharing what he knew about Larry Sinclair. Indeed, by the end of the Politico article, the reader knew more about Sinclair, all of it unsavory and most of it likely true, than he did about Obama.

That much said, when Sinclair made his own case at the National Press Club – unfiltered by attorneys and unaccompanied by Gloria Allred – he did so in exquisite and oddly believable detail.

Sinclair claimed to have fellated Obama twice during their two-day encounter, but he said it as matter-of-factly if he had shaken his hand or slapped his back.

The accusation Sinclair had come to make had to do not with sex but with drugs. According to Sinclair, he and the then-state senator shared a few lines of cocaine before Obama procured some crack for the two to smoke. As Sinclair related, Obama’s claim that he had not done drugs since college was a lie.

When the Obama camp first became aware of Sinclair’s accusations in 2007, an Obama liaison, “Mr. Young,” reportedly contacted Sinclair to tease out the story.

Through numerous calls and text messages, Young let it be known that he himself was intimately involved with Obama. After some back and forth, at least according to Sinclair, Young finally told Sinclair that Obama did not intend to be any more forthcoming about his drug use.

Allegedly, Sinclair and Young last communicated in early December 2007. A few weeks later, according to the police report, Donald Young, the openly gay choirmaster of Obama’s church, was found dead at his “residence” of “multiple gunshot wounds.”

According to an earlier police report, on Nov. 17, 2007, Larry Bland, another allegedly gay member of the Trinity United Church, was also found dead in his “home” of “multiple gunshot wounds.”

At the press conference, Sinclair made no accusations. He simply shared the phone numbers he had for Young and Obama and asked the reporters to check their records against his own during the relevant time periods. They seemed disinclined.

In the Q & A, the first reporter asked why Sinclair had not come forward in 1999. To the reporter, this failure apparently undermined Sinclair’s “credibility.”

Sinclair chuckled, as he should have, at the question’s absurdity. What sense would it have made for him to rat out a lowly state senator on a drug and sex escapade he himself had initiated?

Sinclair had come forward in 2007 and done his first YouTube video in January 2008. At the time, Hillary Clinton would have been the obvious beneficiary. That did not stop the second reporter from asking whether Sinclair was being funded by the Republican Party. Sinclair laughed this one off, too.

Despite his best efforts and an occasional piece in the Globe, Sinclair’s story reached its high water mark on that bizarre June day at the National Press Club.

His name remains as foreign to Obama fans as Juanita Broaddrick was to Bill Clinton’s. The Democrats who rush to the Internet each day to find new allegations about Herman Cain sleep safely knowing that their man has nothing to fear from an inquiring media.”

“Unlike Cain, Obama has not had a single charge leveled against him by a woman. For Obama fans concerned about re-election, this is a mixed blessing.

“Cosby never got the girl on ‘I Spy,'” Obama laments in his 1995 memoir “Dreams from My Father,” but in his own retelling, he does not do much better.

Although Obama spent 13 years on the mainland as a single man, on only one occasion in “Dreams” does Obama make any reference to his love life.

In a brief recounting, he tells his half-sister Auma that in addition to a white woman he had loved and lost, “There are several black ladies out there who’ve broken my heart just as good.”

The problem is that Obama shares with the reader not a word about any of the black ladies, and not one of them has come forward on her own.

The white woman in question presents a different set of problems. In terms of height, hair color, eye color, parentage, and highly specific place of origin – namely a large country estate with a lake in the middle – she is a dead ringer for Bill Ayers’s lost love, the late Weatherwoman, Diana Oughton.

RUSH: Cheryl, the Upper East Side of Manhattan, great to have you on the EIB Network.  Hi.

CALLER:  Hi, Rush.  It’s an honor to speak with you.

RUSH:  Thank you very much.  Great to have you with us.

CALLER:  Listen, I’m a black conservative, and I just want to make one thing abundantly clear: The media can attempt to paint you any way they want to, but there are no bigger racists in this country than white Democratic liberals.  They are and they will forever be the biggest racists in this nation because they seek to determine how black people should think and who black people should support, and the reason for their contempt against Herman Cain is that he has simply said, “I’m an independent thinker.  I don’t need to stay on the Democratic plantation in order to succeed.”

RUSH:  It really is… Folks, it is no more complicated than that.  She’s exactly right, and because of that he represents a great threat to them.

CALLER:  But let me give you an example of how Cain would have been treated if he had been a good and docile Negro and stayed on the Democratic plantation. 

Jesse Jackson, presently, has pending against him in Cook County court in Illinois a sexual harassment lawsuit filed against him by one Mr. Tommy Bennett, a former male PUSH employee who had sued Jesse Jackson and the push organization for sexual discrimination and Jackson specifically for sexual harassment.

RUSH:  Yeah.

CALLER:  There has not been one story about this on Politico. Not one.

RUSH:  Why do you think that is?

CALLER:  Excuse me?

RUSH:  Why do you think that is?

CALLER: (chuckles) Please, Rush.  As I said, Jesse Jackson has remained on the plantation.

RUSH:  Exactly right.

CALLER:  So of course he gets special treatment.

CALLER:  Yep, that’s exactly right.

RUSH:  But I have to make one more point.  The other example of how there is a distinct difference in treatment is that during the 2008 campaign, Mr. Obama was accused of a sex and drug-related incident by a man, a Mr. Larry Sinclair.  To this day — (static flare)

RUSH:  Did we lose hear?

CALLER:  — the press has reported it.  Now, it could be well, you know, it’s not substantiated. (static) We don’t have facts.  Well, there’s no substantiation. (static)

RUSH:  She’s having problem on a cell.  But I remember the Larry Sinclair thing, and what I remember about it was that the media told us this guy was an absolute weird nutcase, insane lunatic; should have been in asylum or some such thing. Remember that?  That was how the accuser was characterized.  I remember that.  Larry Sinclair.  I’m gonna have to Google the name or have one of my vast array of researchers (ahem) Google the name and remind me who Larry Sinclair was.  But I remember that the media set out to destroy this guy.

CALLER: (silence)

RUSH: Darn it, we’ve lost her out there! She was on a cell phone calling from the Upper East Side of Manhattan.  She’s right — and, by the way, the plantation she’s talking about, the liberal plantation — and there are many black conservatives who, of course, abandoned the liberal black plantation, don’t want any part of it. It’s not just they’ve attacked it because they are considered a threat; it is a form of punishment as well.  They go after Herman Cain not just because he represents a threat; he shows other blacks what you can accomplish independently from the Democrat Party and the Jesse Jacksons and all of the prescriptions — liberal affirmative action and all that — but there’s also a punishment, because the message by going after Herman Cain, the message is to other blacks, “You stay right where you are or this will happen to you.  You stay on this side of the aisle or we try to destroy you, too.”

(interruption) Yeah, Larry Sinclair had a shady background, convicted felon, reportedly crimes for forgery, bad checks, theft by check; but he did level an accusation against Obama, and it was never treated with any seriousness or sincerity.  That’s a good get.  I had forgotten that.  This is… (interruption)

Oh, The Politico did?  Okay, here it is.  June 18th, 2008. (singing) Summertime and the livin’ is easy.  My favorite version of Summertime is by Billy Stewart.  Yeah, I think 1964, 1965.  Mike, see if we’ve got that in the system. What’s the name of our system? I keep forgetting. (interruption) Yeah, the Proffit System. (Two F’s in there, folks. We’re not talking about money here.)  My all-time favorite version of Summertime.  Anyway, this is Obama, or Politico reporting on that story in June of 2008.

“Obama Accuser Has Long Rap Sheet — Larry Sinclair is wanted in Colorado, but you can catch him today at the National Press Club.  Sinclair is familiar to political junkies and reporters as the source of outlandish allegations about Senator Barack Obama, tales that began with sex and drugs and moved on to murder.  The Duluth, Minn., resident is the sort of figure who appears at the margins of every presidential campaign, and both Presidents George W. Bush and Bill Clinton had their own obscure accusers with dramatic allegations. But as the old media ignores him, Sinclair has taken full advantage of the Internet, and a video in which he makes his claims that have been viewed more than 900,000 times on YouTube.

(Hardy-har-har.)  “Sinclair’s biography, though, may get in the way of that pitch: Public records and court filings reveal that he has a 27-year criminal record, with a specialty in crimes involving deceit.” So that’s how they handled the Obama accuser at The Politico in June of 2008.  Did you find a version of the song, by the way? (interruption) It’s being loaded now.  We’ve got everything in the Proffit System! Gosh, when I was a deejay I wish it was this easy.  We never had the records.  Never had ’em.

I remember at my first job I’d volunteering out to the local store and buy the records.  The owner was too cheap.  Record companies didn’t service small little Podunk radio stations like the one I worked at.

“Imprissoned border agent Jesus Diaz.

As the Blaze recently reported, Jesus Diaz, a former U.S. border
agent, is serving a two-year prison sentence after being accused of
using excessive force in handcuffing a juvenile drug smuggler back in
2008. Diaz’s detention, which has come under fire from many who
believe that he isn’t guilty of the violence charges waged against
him, has become a hot-button issue.

This morning, Glenn Beck interviewed Diaz’s wife, Diana, on his radio
show to get the entire story, and by the end he was visibly
frustrated.

But before delving into the video of their exchange, let’s review some
brief background information on the case.

Diaz, who is now imprisoned and separated from his wife and six
children, was found guilty of inflicting pain on a known 16-year-old
Mexican drug smuggler in an effort to obtain more information about
where marijuana was being hidden. Authorities also claim that the
former agent kicked the teen and dropped him face-first on the ground.

But these accounts and the charges associated with them have come
under fire (GOP presidential candidate Michele Bachmann has said she
would work toward Diaz’s release). The Examiner has more about the
confusion surrounding the case:

According to the Law Enforcement Officers Advocates Council, the
government’s case is based on false testimony that is contradicted by
the facts. This includes the charge that Agent Diaz was physically
abusive to the then minor “MBE” as noted by court documents and
transcripts that Diaz allegedly put his knee on his back and pulled
back on his handcuffs.
“However, given the time of day during the incident, October 16, 2008
at about 2 a.m. and lack of lighting it would be impossible to have
actually seen much if anything. The agent who stood next to Mr. Diaz,
Marco Ramos testified that he did not see anything that was claimed to
have taken place,” Andy Ramirez, president of LEOAC explained.

A web site has been setup to advocate for Diaz’s release.

In the beginning of his discussion with Diana, Beck said, “I’m sorry
for what this government is doing to you…your family and your
husband.” Diana went on to explain what seems like a tragic story of
justice gone awry.

The Mexican government had apparently filed a complaint following the
incident, which the U.S. government then acted on. In the end, the
16-year-old avoided detention and was apparently sent back to his
homeland. Even more bizarrely, Diana claims that the young man was
brought back to America to testify (with immunity) against her
husband.”

extremely weak charge, claiming Agent Diaz violated the civil rights
of an illegal alien doper under the color of law. Sutton and his
successor under the Obama Administration then put the full weight of

“In what appears to be yet another case of the Mexican Government
orchestrating a fake crime against one of their drug smuggling
criminals hauling dope into the U.S., Border Patrol Agent Jesus Diaz,
a 7-year Border Patrol veteran, was convicted in Federal Court on
February 24 of one count of excessive force (under color of law) and 5
counts of lying to Internal Affairs.  He is facing a maximum of 35
years in prison when he is sentenced in November.  Meanwhile, he’s
been in jail since the verdict nearly two months ago.  He’s in
solitary confinement 23 hours per day for his safety. So far, the
judge has refused to allow bond while Diaz awaits sentencing.”

DEL RIO SECTOR CUSTOMS AND BORDER PATROL AGENT INDICTED
FOR ALLEGEDLY ASSAULTING A 15 YEAR OLD

United States Attorney John E. Murphy announced that 31-year–old U.S. Customs and Border Patrol Agent Jesus E. Diaz, Jr., stands charged by federal grand jury indictment with deprivation of rights under color of law.
The indictment, returned this week by a federal grand jury sitting in Del Rio, alleges that on October 16, 2008, Diaz assaulted a 15 year old depriving him of his constitutional right to be free from the use of unreasonable force by one acting under color of law.
Upon conviction, Diaz faces up to ten years in federal prison and a maximum $250,000 fine.
An indictment is merely a charge and should not be considered as evidence of guilt. The defendant is presumed innocent until proven guilty in a court of law.
This case was investigated by U.S. Immigration and Customs Enforcement – Office of Internal Affairs and the Office of Professional Responsibility. Assistant United States Attorney Kelly Blackburn is prosecuting the matter for the Government.”

I tried to obtain more information on this case yesterday. Here is what I know thus far, aside from articles on the web.

A. From the press release: “Diaz assaulted a 15 year old depriving him of his constitutional right to be free from the use of unreasonable force by one acting under color of law.”

  1. Illegals aliens do not have constitutional rights.
  2. The Deprivation of Rights Under Color of Law, Title 18, U.S.C., Section 242, states: “This law further prohibits a person acting under color of law,
    statute, ordinance, regulation or custom to willfully subject or cause
    to be subjected any person to different punishments, pains, or
    penalties, than those prescribed for punishment of citizens on account
    of such person being an alien or by reason of his/her color or race.”    Alien refers to a person visiting from another country legally or legally here on some kind of visa. This is not intended to protect someone in violation of the law.

B. Aside from the press release, I could find no other reference to the Jesus Diaz prosecution. Contrast this to the  Compean and Ramos Prosecution.

This alone was not a red flag for me but when you couple this information with Obama’s known association with criminals, with racists and hate mongers and his failure to provide his records while in the Illinois Senate, there is a legitimate need to get straight answers from Obama.”

Next are the questions asked and responses from Obama. I know that many people have read this, but it is worth repeating:
“Q: It is kind of unknown where some of the records from your time in Springfield are located. Where is that stuff, what do you have?
“We had one district director. I had one staff person, so, you know, we didn’t have some elaborate sort of system. I didn’t at my disposal millions of dollars and potentially multiple staff people to conduct an archive. Now keep in mind, it is apples and oranges. First of all, I’m not the one who has made this an issue. We saw during the debate, Senator Clinton was asked about it and the suggestion was somehow they’ve done all they could. And my simple point was, I don’t think there is some smoking gun in these archives or something, or some damning evidence.”

“The following is from Lynn Sweet of the Chicago Sun-Times on November 11, 2007:
“On Friday, Lynn Sweet of the Chicago Sun-Times reported that she had asked Obama at a news conference: “Do your state senate papers still exist? If they do, just where are they? And would you ever intend to make them public to be responsive to some requests?”
Sweet wrote that he replied: “Nobody has requested specific documents.”
But the Chicago Tribune has reported that it “requested documents from his time in Springfield and never received a response.””

Prosecutors have taken a turn from the track of the day’s testimony and are asking political fixer and prosecution star witness Stuart Levine again about his drug use, the first time they have done so since early in his testimony.
Levine has said he used a number of drugs in the 1980s and into 2004, including cocaine and crystal methamphetamine.
He said he would make cash withdrawals, give that money to five male friends and use drugs with them during hotel parties. Those parties took place in Springfield and Lincolnwood at a place Levine said he and his friends came to call “the Purple Hotel.””

One of defense attorney Joseph Duffy’s first stabs at tripping up star prosecution witness Stuart Levine involved an attempt to raise doubt about his state of mind the very first time he met Antoin “Tony” Rezko.
Levine had testified earlier that the two were introduced at a dinner party on Nov. 2, 2002, just days before the election that brought Gov. Rod Blagojevich to power. It was at that dinner that Levine testified he learned that Rezko had been blocking a real estate deal on which Levine had been seeking a sizeable kickback.
But Duffy produced a Levine credit card receipt showing a $761.87 transaction dated that day at a Lincolnwood hotel where Levine often went for all-day drug binges.”

Before Stuart Levine’s testimony ended for the day, he was walked through his decision to cooperate with prosecutors in their corruption case against Antoin “Tony” Rezko.
Rezko’s defense attorney Joseph Duffy wanted to explore Levine’s motivation and first asked about a conversation Levine had with his business partner Robert Weinstein after FBI agents had come to Levine’s home to confront him in May 2004.
Levine’s phone was still tapped, and he was recorded telling Weinstein that agents had visited him. But Levine said he did not remember telling his partner that agents had mentioned Rezko was a target of an investigation.
“The government’s looking for a big fish, and it’s Tony Rezko,” Duffy quoted Levine as saying on the tape, which was not played in court.
Duffy then took Levine through the time leading up to his eventual indictment in the Rosalind Franklin University School of Medicine and Science kickback case a year later, in May 2005.
Levine still had not agreed to cooperate, and Levine told Duffy that he did not believe the government was aware of the “secret part of his life,” meaning his drug abuse and hotel parties with male friends.”

More tales of the Purple Hotel kicked off this morning’s session of the Antoin “Tony” Rezko corruption trial.
On Thursday, Rezko’s lawyer Joseph Duffy grilled prosecution star witness Stuart Levine about a $761 transaction on his credit card statement for Saturday, Nov. 2, 2002, at the garish purple-painted Lincolnwood hotel that at the time was part of the Radisson chain. Levine has testified that he and a regular group of “drug buddies” often went to the hotel for daylong binges of crystal meth, cocaine, animal tranquilizers and other drugs.
The significance of that date is that it was the same that Rezko and Levine first met. The occasion was a dinner party, and during the chitchat Levine has said the two men came to realize they had been on opposite sides of a shady real estate deal.
As Duffy tries to chip away at Levine’s credibility, the lawyer used the credit-card statement to suggest that Levine’s memory of that first meeting was suspect because he showed up at the party after leaving a drug binge.
Levine acknowledged that the charge on his credit card was likely legitimate, but repeatedly insisted that he did not remember being at the hotel on that day and considered it unlikely. Credit-card transactions are not always recorded on the same day a charge is actually made.
This morning, Duffy questioned Levine about more charges he incurred at the Radisson. On Saturday, Oct. 26, exactly one week before the dinner party, Levine’s credit-card statement reflected a $1,077 charge at the Radisson, and exactly a week before that there was another $1021 charge there.
Duffy appears to be trying to suggest that Levine had a regular Saturday thing at the Radisson with his drug buddies. In earlier testimony, Levine said the group would get together and party once or twice a month at the Lincolnwood hotel, and always on weekdays. Levine said he tried to hide his secret drug life from his family and wanted to be home and clear-headed on the weekends.”

“A comment was just posted on this blog. I recognize the poster from this blog and others I have posted on. Delenn has stated in the past that she was a chef and restaurant owner in Chicago and heard many rumors about Obama. Below is her comment about the Rezko trial, names being withheld and under reporting of the trial:

“Living in the Chicago area and being the “victim” of Chicago news media, I noticed early on in the Rezko trial that U.S. District Judge Amy St. Eve quashed mention of politicians’ names except for a chosen few… so we have “Politician A,” “Poltician B,” and on and on down the alphabet. Judge St. Eve also ruled to keep jurors’ identities secret… which more than anything attests to the known potential for violence coming from those associated with Rezko, Levine, and likely from the political machines involved. And Judge St. Eve would not allow Levine to name names as to the identities of those present at the all-male parties involving drug use — parties attended by some of the city’s and state’s political powers-that-be as well as by those wanting favors. There was a “leak” months ago that Politician A is Governor Rod Blagojovich… but oddly no further identifying leaks materialized. Blagojovich has been candid in the past about his interest in running for US president — I think the “leak” was a way to shut him down, and frankly I believe that he was shut down to open the way for Obama’s candidacy, if not in 2008, then in 2012. I don’t know how coverage of this trial has been played elsewhere, but here it’s been curiously underplayed — odd indeed, considering the Chicago news media’s normal tendency to over-cover any major stories based in the area. I’ve suspected since early on in the trial that the under-coverage, and possibly even some of the court’s rulings regarding testimony, have been connected to Obama’s candidacy. For the Blagojevich trial to be legitimate, for the charges in the indictment to be substantiated, Stuart Levine will take the stand, just as he did in the Tony Rezko trial. The question is, will Levine be restricted from naming politicians?

Will Obama’s name be mentioned with regularity in the Blagojevich trial, just as Blagojevich’s name was mentioned during the Rezko trial?

I spoke to Larry Sinclair last night. He reminded me that the deadline for his receiving contributions for the Florida district 24 congressional election filing fee is April 19, 2010. He also wanted everyone to know that without the filing fee, there will be no running for Congress in November. Larry is receiving coverage from some of the big MSM players now. Larry Sinclair has done as much as anyone to expose the truth about Barack Obama. He has been doing so for well over 2 years.
