Remarks as prepared for delivery.
First, let me express my thanks to Attorney General Medina Mora and Secretary of Government Gomez Mont for making this conference possible.

This is my first trip to another country as Attorney General.   I wanted to come to Mexico to deliver a single message: We stand shoulder-to-shoulder with you in this fight against the narcotics cartels.  The United States shares responsibility for this problem and we will take responsibility by joining our Mexican counterparts in every step of this fight.

And, together, we will win – thanks in large part to the courage of my Mexican colleagues here today, who are on the front lines every day, and with whom I am proud to collaborate.

The topic that has been addressed over the past two days could not be more important – the development of an arms trafficking prosecution and enforcement strategy on both sides of the border.

Last week, our administration launched a major new effort to break the backs of the cartels.  My department is committing 100 new ATF personnel to the Southwest border in the next 100 days to supplement our ongoing Project Gunrunner, DEA is adding 16 new positions on the border, as well as mobile enforcement teams, and the FBI is creating a new intelligence group focusing on kidnapping and extortion.  DHS is making similar commitments, as Secretary Napolitano will detail.

But as today’s conference has emphasized, the problem of arms trafficking will not be stopped at the border alone.  Rather, as our experts emphasized, this is a problem that must be met as part of a comprehensive attack against the cartels – an attack in depth, on both sides of the border, that focuses on the leadership and assets of the cartel.  This is the type of full-bore, prosecution-driven approach that the U.S. Department of Justice took to dismantle La Cosa Nostra – once the most powerful organized crime group operating in the United States.
With partners like those we have here today, I am confident that together, we will defeat these narcotics cartels in exactly the same way.  I am proud to stand with you, and to join you in this fight.  Thank you again for inviting me here.”

“The Justice Department is trying to protect its political appointees from the Fast and Furious scandal by concealing an internal “smoking gun” report and other documents that acknowledge the role top officials played in the program that allowed firearms to flow illegally into Mexico, according to the head of the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Kenneth E. Melson, the ATF’s acting director, also told congressional investigators this month that the affidavits prepared to obtain wiretaps used in the ill-fated operation were inconsistent with Justice Department officials’ public statements about the program. Justice Department officials advised him not to raise his concerns with Congress about “institutional problems” with the Fast and Furious operation, Melson said.
“It was very frustrating to all of us,” Melson told congressional investigators in a private meeting over the Fourth of July holiday, “and it appears thoroughly to us that the department is really trying to figure out a way to push the information away from their political appointees at the department.”

Not only was the department slow to react, Melson said, but Justice Department officials indicated they did not want him to cooperate with Congress.”

It has been more than 18 months since our son, Brian Terry, was shot and killed by a Mexican drug cartel armed by a failed U.S. Department of Justice “gunwalking” operation known as “Fast and Furious.”

The pain that Brian’s death has caused our family is indescribable. No matter what words we use in this letter to you, we will never be able to justly convey how much suffering we have endured. We still grieve every day, and we are resigned to the fact that the agony of his death will stick with us for the rest of our lives. Not because he didn’t achieve his dreams . . . not because he didn’t live his life to the fullest . . . and not because he didn’t leave anything behind that we couldn’t celebrate or remember.

Our family will be forever grief-stricken because Brian didn’t have to die.

We wish we could take solace knowing that Brian died doing what he loved to do. After all, it was his childhood dream to make a career in law enforcement and become a federal agent.

As a youngster, Brian was inspired by his Uncle Bob, a Michigan police offer who would give Brian tours of the police station and share stories of what it was like to be a police officer. From then on, Brian believed he was destined for a career in law enforcement. He joined the Marine Corps after high school and served four years in Naples, Italy before becoming a police officer in Lincoln Park, Michigan – just like his uncle. But Brian’s ultimate dream was to become a federal agent, and so he applied to the United States Border Patrol.

In 2007, he attended the Border Patrol Academy in El Paso, Texas, graduating as president of his class before being assigned to the Naco station near Bisbee, Arizona, only a few miles from the U.S.-Mexican border.

Brian accomplished exactly what he wanted to. But all of what he had worked for – and all our family had come to adore and love – was taken away so abruptly . . . so needlessly.

On December 14, 2010, Brian was conducting operations as a member of the Border Patrol Tactical Unit in Nogales, Arizona. He and his team encountered five Mexican drug cartel bandits in the “Peck Well” area near Rio Rico, Arizona. Not knowing the bandits were carrying the latest military grade assault weapons provided by the Justice Department as part of Operation Fast and Furious, there was an exchange of gunfire and Brian was shot in the lower back.

He died on December 15, 2010.

Before then, our family was expecting Brian to return home for Christmas. What we were not expecting was that he would return home in a flag-draped casket. All because of an ill-conceived government gun trafficking investigation gone horribly awry.

The Justice Department’s “gunwalking” operation called for American gun dealers to sell weapons to “straw purchasers” tied to Mexican drug cartels between 2009-2011. The intention was to track the guns as they were sold to Mexican drug lords, which would theoretically lead to the arrests and dismantling of the cartels.

But that’s not what happened. It turned out that there was no actual plan to track the movement of the guns as they were “walked” into Mexico.

As a result, one of our four children and as many as 200 Mexican citizens were killed with weapons connected to the operation.

Still, hundreds of guns sold as part of Operation Fast and Furious remain unrecovered, putting more brave law enforcement personnel along the border – like our son – at unnecessary risk.

Even though our son fell in the line of duty more than 18 months ago, we still don’t have answers that explain why he had to die.

Unfortunately for our family and the families of others who have been injured or killed with these weapons, our son’s death has ballooned into a national controversy. Currently, the House Oversight Committee is moving forward with contempt proceedings against Eric Holder, the U.S. Attorney General and head of the Justice Department, for failing to comply with a congressional subpoena requesting all of his communications regarding Operation Fast and Furious. Our hope is that the Justice Department is not withholding information that could expose those who are responsible for our son’s death.

It has been nearly eight months since Mr. Holder was served his subpoena, and we know little more now than we did then. We think our family and Brian’s memory deserve better.

So even though this government investigation drags on and prolongs our family’s suffering, we are taking action.

We have established the Brian Terry Foundation not just to preserve Brian’s memory and honor his service to our country, but to also help families of other U.S. Border Patrol Agents who have been killed or injured by providing ongoing emotional and financial support, establish educational scholarships, recognize the heroic efforts of current Border Patrol Agents, and raise public awareness of the flawed Fast and Furious investigation. It is also our personal mission to guarantee that any mistakes made by the Justice Department are never made again.

Because of Operation Fast and Furious, some of the most dangerous criminal organizations in North America have been strengthened, and now our Border Patrol Agents are in the gravest danger of their lives.

So please, we urge you – not just for our son, but for all U.S. Border Patrol Agents who came before him and who will come after him – to join our cause and give as generously as you can. We have to make sure that nothing like Fast and Furious ever happens again, and without grassroots support from folks like yourself, our mission fails. This failed government operation cost our son his life, but that doesn’t have to stop us from saving the life of someone else’s son.

  1. Brian Terry was issued a “bean bag gun” to defend himself and his comrads, the Mexican drug cartels were issued ak-47s and other assault weapons to kill Brian…Both issued by the United States Government.

  2. Bessie, you are 100% correct…I remember reading about the bean bags and was totally disgusted. It is the same as the ROE enacted by Obama re: the military.

    Obama’s intention of destroying this great Nation is so in-your-face and no one can see it….

    Can you imagine how many OTM’S (other than Mexicans) have entered our unprotected southern border armed and ready for disaster?

In addition you only need to watch the FACIAL GRIMACES that occupy her face while she is speaking. These grimaces are a CLEAR SIGN of a mental disorder. Then you only need to observe the contortions that her hands go through while she walks. This is an unconscious thing,and her hands turn into virtual hooks as she walks. Again another clear indication of a mental disorder. Lastly you only need to observe closely the facial EXPRESSIONS including the eye movements while she is speaking to realise that she is NOT NORMAL. In conclusion I see a personj who has a severe mental disorder holding an office of large responsibility. I personally think that she should NEVER HAVE BEEN ALLOWED to hold such responsibility. I believe that her mental processes are NOT capable of rendering sound judgement. I believe that she is in dire need of PSYCHIATRIC help.

  10. I believe the key issues on F&F are the whislteblowers. These were seasoned ATF agents that knew what the heck was going on. One would think that at least one of them was also involved in Wide Receiver and understood the frightening differences. Even the gun shop owners were leery of selling the weapons.

    The whistleblowers knew this was an insane operation and came forward once their suspicions sadly proved to be true.

    Its interesting that we have a POTUS who appoints czars who are unconfirmed and unaccountable and who meets more with the POTUS than any cabinet head. Its also interesting that Obama has seen to the firing of 3 Inspector Generals whenever they start getting close to corruption. And that there are many Inspector General positions still vacant.

    We have had whistleblowers at the EPA, and the Justice Dep’t. as well.(J.Christian Adams who resigned from Justice so he could safely be a whistleblower regarding the racial bias and voter rights hearings) We have also had people who during congressional hearings, mislead, outright lie or take the 5th. We have had experts in the field of energy force the Dept of Interior to change his misleading statement on the Gulf drilling moratorium. We even had a Military General who testified during the LightSquared congressional hearings that he was pressured by the WH to change his testimony. There were admitted kickbacks and backdoor dealings during the Obamacare legislation.

    Good Lord, the MSM has failed miserably as the 4th estate. It doesnt take a genius to start connecting the dots. Illinois political corruption and thugery has taken a firm seat at 1600 Pennsylvania Avenue and it will rot the very essence of our government. They might have thought it was possible to use their ugly tactics in Washington, but it looks like this web of deceit and corruption is starting to unravel……No one is ABOVE the law, let the investigations begin.

    I listened to Marco Rubio today on the Dennis Miller radio show. I discovered a remarkably intense young man, whose responses to Dennis’s questions was excellent. How he responded is quite important in seeing into the very soul of Marco. While he has probably gone as far as he legally can in American government, I would suspect that had any other circumstances prevailed which would have brought him to earth AFTER his parents naturalisation, we would have a very fine presidential candidate at hand. Unfortunately he is NOT a NBC.

    If you have ever carried a rifle in the defense of our country here is a question for you. As an infantryman would you rather go up against an enemy possessing weapons made by his own country ,or would you rather go up against American made weapons in the hands of people who will use that weapon to kill you if he can.. While there really isn’t much difference in the weaponry, there is a HELL of a lot of difference in the people who are pointing these weapons at you. The defineable difference on the battlefield comes with the INTELLIGENT USE of the weaponry at hand. If the enemy has a desire ONLY to kill you but doesn’t possess the needed thorough knowledge of the limitations of the weapon in his hands,or tactics, it is very possible that he will make a mistake which will allow you to take him out. It is only a matter of being watchful,and applying fighting tactical skills that you should possess from your training, along with the INTELLIGENT use of your own weapon. While it is doubtful that the drug cartel murderers will possess a well honed tactical skill, you must NEVER underestimate the fighting skills of your enemy. These people holding American made,and technologically advanced weaponry makes them extremely dangerous people. Numbskulls like Holder, Soetoro,and Napolitano, SAY OUTRIGHT that they have allowed such weaponry to be in the hands of YOUR ENEMY so that they can TRACK THE WEAPONS. Such a statement from Napolitano is the MOST INSANE reasoning that I have EVER heard………but what the hell do you expect from NUMBSKULLS who have NEVER carried a rifle themselves in the defense of their country. And with regard to tracking the weapons what the hell TRACKING do you gain when the weapons are being fired at you. Only a MENTAL DERELICT would think in such terms.     “That brings us to the foolishness of this particular assertion of [executive] privilege. Few in the media were paying attention to this scandal, which means that most voters still have no idea that the US government allowed thousands of untracked guns to be sold to drug cartels, and that those guns are responsible for hundreds of murders in Mexico and the deaths of two American law-enforcement officers … so far. By asserting executive privilege, Obama has assured that the media will be taking a much closer look at the scandal, and that’s bad news for Democrats:

    “I think it is a winner for the Republicans,” Brooks said. “It’s funny — it hasn’t really registered with the country yet, what the government has done. When — if — it gets out: ‘Wait, they were sending guns to Mexico?’ — I think it’s such a thing that will startle people. I think it’s a clear winner for the Republicans. And what the Obama administration wants to do with this executive privilege: get it lost in the court system, push it past the election, and then hopefully it will go away.”

    Could that strategy work? Almost certainly not.
    While some media outlets yawned at the bodies piling up from Operation Fast and Furious, they’ll have to report on a President that’s hiding documents relating to it through executive privilege. That will force them to explain the scandal from the beginning sooner or later, and as Brooks says, most people will say, “We were doing what?”

Napolitano puts me in mind of the NINCOMPOOP GOVERNOR of LOUISIANNA whose behavior early into and during Katrina (resulting from her DRUG and ALCOHOL FOGGED MIND,) was totally lacking at a time when she was NEEDED MOST. The same VACANT LOOK is USUALLY ON NAPOLITANO’S FACE,AS WELL. Recently Napolitano was being asked a question (on camera) by a newsperson, and the camera operator put her face close up,and squarely in the middle of the picture………once again…….there was the same TOTALLY STONED,and/or DRUNK appearance.     “The days of media silence came to an end yesterday. Holder had tried to avert a vote on contempt of Congress charges for failing to turn over thousands of documents subpoenaed by the Oversight Committee. When a meeting with Oversight chair Darrell Issa failed, Holder asked President Obama to claim executive privilege to protect the documents. The White House asserted the privilege, and opened up a hornet’s nest for Obama, Holder, and everyone who has already testified in the case – and that is due to the nature of executive privilege itself.

    Executive privilege exists in American law as recognition of the nature of separate and equal branches of government. Congress and the executive have checks and balances against each others’ power, but neither is accountable to the other in a hierarchical sense. Courts have upheld claims of executive privilege as Presidents answer to voters rather than Congress, and are therefore entitled to have confidential advice and consultations on policy.

    However, the same courts have only upheld it narrowly – and limited to the offices of President and Vice President. The most famous case originated in theWatergate scandal, where Richard Nixon’s claim of executive privilege got shot down by the Supreme Court. In US v Nixon (1974), the court ruled that claims of executive privilege on consultations with the President could not survive the need to investigate crimes, and forced Nixon to turn over to the court tapes made in the White House of conversations relating to the Watergate break-in. Nixon resigned from office shortly afterward.

    Claims of executive privilege are always controversial, even when they succeed. When George W. Bush dismissed several US Attorneys, political appointees who serve at the pleasure of a President, Congress demanded testimony from White House aides Karl Rove, Harriet Miers, and Sarah Taylor as to the motivation behind the dismissals.     “Then-Senator Barack Obama criticized the Bush claim of executive privilege at the time, decrying “tendency on the part of this administration to — to try to hide behind executive privilege every time there’s something a little shaky that’s taking place.” Rove never complied with the subpoena, but the press covered the conflict in great detail.

    This shows the trap into which Obama has fallen. Attorneys General do not get executive privilege on their own; federal agencies do answer to Congress as part of their oversight capacity, and Holder has to comply with lawful subpoenas. In order to claim executive privilege, Holder and the White House have to claim that the documents in question – consisting of tens of thousands of pages – relate directly to consultations and advice Obama engaged in during the course of his job as President.

    However, the White House has consistently claimed never to have known about Operation Fast and Furious until its exposure with the death of Border Patrol agent Brian Terry. Holder and other officials at the Department of Justice and the ATF have made the same claim while testifying to Congress. In order to make executive privilege stick and keep the documents out of the hands of Congress, the entire Obama administration will have to make the opposite claim, and tell a court that the documents can’t be released because they relate directly to actions taken by Obama himself. A Congressional Research Service analysis from 2008 makes the need for presidential involvement in a claim of executive privilege quite clear, quoting from US v Espy, a Clinton-era case:

    “Not every person who plays a role in the development of presidential advice, no matter how remote and removed from the President, can qualify for the privilege. In particular, the privilege should not extend to staff outside the White House in executive branch agencies. Instead, the privilege should apply only to communications authored or solicited and received by those members of an immediate White House advisor’s staff who have broad and significant responsibility for investigation and formulating the advice to be given the President on the particular matter to which the communications relate. Only communications at that level are close enough to the President to be revelatory of his deliberations or to pose a risk to the candor of his advisers.”

    Therefore, the Obama administration can’t claim executive privilege for actions that don’t involve the President, or his immediate staff in advising the President. The claim of privilege appears a tacit admission that previous claims that Obama and his White House staff were unaware of Operation Fast and Furious and uninvolved in it were false. That opens up potential criminal charges for anyone who testified differently under oath for perjury and obstruction of justice – the end results of most executive-branch scandals, most famously in Watergate.

    Even that might not be enough. In the case involving the US Attorneys, there was no evidence that laws had been broken, since Presidents can dismiss political appointees at will. In Operation Fast and Furious, two American law-enforcement agents have been murdered with guns that the ATF allowed to flow over the border, violating the law and official procedure – not to mention hundreds dead in Mexico for the same reason. Under the precedent set in US v Nixon, a court would almost certainly find that a Congressional investigation into potential criminal activity would trump a claim of executive privilege, especially after the apparent misrepresentation of White House involvement in the operation.

    By asserting executive privilege, the Obama administration has made it clear that they fear the exposure of ATF and Department of Justice documentation, and that Obama himself has some connection to the papers. The question that arises has more than a whiff of Watergate to it: what did the President know, and when did he know it? Thanks to the claim of executive privilege, the media will no longer be able to ignore the deadly outcomes of Operation Fast and Furious, and the timing of this scandal could ensure that Obama won’t have the ability to call on executive privilege after January.”

    “During a trip through Colorado in December of last year, President Obama spoke of his intention to implement his economic policies with or without the approval of Congress. Said Obama, “And where Congress is not willing to act, we’re going to go ahead and do it ourselves.” It now appears that such a mindset applies not only to economic matters but to the distribution of foreign aid as well–in particular, foreign military aid for the Muslim Brotherhood, who now hold the reigns in Egypt.

    Congress has restricted and, in fact, halted military aid to Egypt until and “unless the State Department certifies that Egypt is making progress on basic freedoms and human rights.” After all, Christians and other practitioners of non-Islamic religions have had a tough go of it there. And of course, many Egyptian officials harbor such hatred toward the U.S. that one of the candidates for the Egyptian presidency has openly referred to America as the “infidel country” in media interviews.

    Nevertheless, the news breaking now is that Secretary of State Hillary Clinton will soon announce that President Obama will “resume funding for Egypt’s military, despite Congressional restrictions and objections from human rights and democracy advocates.”

    Even Sen. Patrick J. Leahy (D-VT), a man with whom I’ve never agreed on anything, sees the foolishness of this endeavor: “I believe [sending the aid] would be a mistake. The new [restrictions were] intended to put the United States squarely on the side of the Egyptian people who seek a civilian government that respects fundamental freedoms and the rule of law, and to clearly define the terms of our future relations with the Egyptian military.”

    Who knows; perhaps the Obama administration can also circumvent Congress and give the Iranians some nuclear materials or give Hamas some advanced weaponry? I know both ideas sound crazy, but they’re no crazier than giving $1.5 billion in military aid to the Muslim Brotherhood.”
