The spectre of voting machine failure and voter fraud still lingers over the NY District 23 election between Doug Hoffman and Bill Owens.

The Gouverneur Times is reporting today, November 23, 2009.

“Ghost in the Machine”

“John Conklin, Communications Director for the New York State Board of Elections issued a statement Friday evening alleging that an article published by our on-line newspaper, The Gouverneur Times, was factually incorrect. This statement was reported Friday in the Watertown Daily Times.

Mr. Conklin’s rebuke is a very misleading press release issued on the behalf of the NY SBoE.”

“Below is a brief review of the November 3rd, 2009 elections…

In Lewis, Schuyler and Seneca Counties, ImageCast ballot scanners failed.

In Broome County, hand counts revealed the ImageCast ballot scanners in five voting districts had miscounted votes. In some cases the machines rejected valid ballots.

In Cayuga County, again ImageCast ballot scanners crashed. Some rejected valid ballots that other machines accepted.

In Fulton County, ImageCast ballot scanners were impounded after it was found they were not working properly.

In Steuben County, the ImageCast ballot scanner in the first ward malfunctioned.

In Oneida County, at the Vernon polling place, none of the three ImageCast optical scanners would operate.

In Jefferson County, inspectors from four districts claim that “human error” resulted in their “mistakenly” entering 0 votes for Hoffman in several districts, resulting in Owens leading Jefferson County on election night though a recanvas of the computer counts showed that Hoffman was actually leading.

In St. Lawrence County, machines in Louisville, Waddington, Claire, and Rossie “broke” early in the voting process on Election Day.  Republican Commissioner Deborah Pahler said that the machines kept “freezing up… like Windows does all the time”. Frank Hoar, an attorney for the Democratic Party, initially ordered the impound of malfunctioning machines but released the order on Nov. 5th so that Bill Owens could be sworn in to Congress in time to vote on the House Health bill on November 7th.

Jude Seymour, a reporter for the Watertown Daily Times, declared the Gouverneur Times story on the ‘virus’ issue a ‘Hoax’. He referred  to a prior article he had authored on the 13th of November, where he quotes Anna E. Svizzero, the state’s Elections Operation Director in her claims that the state’s pilot program “was very successful.”

The State elections on November 3rd, using the Sequoia/Dominion ImageCast machines were a ‘pilot program’.

Mr.Lipari states that the corrective action applied was modification of the configuration file; but according to a technician for Dominion, the owners of the ImageCast system, “the insertion of a line of code, into the source code of the machines” was the corrective action taken.

Regarding what was done to correct the ‘memory’ problem just days immediately prior to the elections; pursuant to State Election Law 7-202.2, “When any change is made in the operation or material of any feature or component of any machine or system which has been approved pursuant to the provisions of this section, such machine or system must be submitted for re-examination and re-approval pursuant to the provisions of subdivision one of this section”

Subdivision one states that… “The state board of elections shall cause the machine or system to be examined and a report of the examination to be made and filed in the office of the state board. Such examination shall include a determination as to whether the machine or system meets the requirements of section 7-202 of this title and a thorough review and testing of any electronic or computerized features of the machine or system…. Any form of voting machine or system not so approved, cannot be used in any election.”

“Given the now known number of machine failures that occurred on election day, due in part to the ‘known bug’ in the software, it is apparent that a thorough review and testing of the ImageCast machines utilized throughout the 23rd congressional district and other districts throughout the State of New York was not accomplished according to the explicit requirements of New York State Election Law.”

We in the 23rd were the subject of a ‘beta test, pilot program’, in the midst of a very important election. There were many problems as a result of this ‘test’. The integrity, credibility and voter confidence in this election is severely challenged as a result. A manual hand count needs to be accomplished in order to assure the voters that the Sequoia/Dominion ImageCast machines worked and worked accurately. Not doing so will forever taint the results of this ‘beta test’ election as well as future elections.

It is not a matter of who won or who lost… it is a matter of our constitutional right to a fair, open and honest election process without vendors protecting their interests (Sequoia), or a State covering their collective <actions>… at the expense of the voting process itself.

 “Nathan Barker of The Gouverner Times has reported a series of facts which seemingly support Dough Hoffman’s allegations that there was massive Election fraud in the special election for the NY-23 House seat:

1. The software used in the voting machines is made by a company controlled by the Venezuelan dictator, Chavez;

2. A virus was found in the machines used in one district, only days before the election;

3. Other districts were not informed of the existence of the virus;

4. The voting machines lack security for introduction of multiple ballots at a time,

5. And election officials lack expertise to determine whether the company’s fix of the problems was done in a manner which returned the voting machines’ capacity to tally impartially election-night results.”

I have been getting warnings about these voting machines, software and the ties to Chavez and Venezuela for at least a year.

We must demand an investigation.

We already knew there were election night irregularities in the New York District 23 congressional race between Doug Hoffman and Bill Owens and that Nancy Pelosi prematurely certified Owens as the winner. Now we find out that some of the voting machines had computer viruses.

“VIRUS in the VOTING MACHINES: Tainted Results in NY-23”

“GOUVERNEUR, NY – The computerized voting machines used by many voters in the 23rd district had a computer virus – tainting the results, not just from those machines known to have been infected, but casting doubt on the accuracy of counts retrieved from any of the machines.

Cathleen Rogers, the Democratic Elections Commissioner in Hamilton County stated that they discovered a problem with their voting machines the week prior to the election and that the “virus” was fixed by a Technical Support representative from Dominion, the manufacturer.  The Dominion/Sequoia Voting Systems representative “reprogrammed” their machines in time for them to use in the Nov. 3rd Special Election. None of the machines (from the same manufacturer) used in the other counties within the 23rd district were looked at nor were they recertified after the “reprogramming” that occurred in Hamilton County.

Republican Commissioner Judith Peck refused to speculate on whether the code that governs the counts could have been tampered with.  She indicated that “as far as I know, the machine in question was not functioning properly and was repaired” by the technician.

Commissioners in other counties have stated that they were not made aware of the virus issue in Hamilton County.  In Jefferson County, inspectors from four districts claim that “human error” resulted in their “mistakenly” entering 0 votes for Hoffman in several districts, resulting in Owens leading Jefferson County on election night though the recanvas of the computer counts now show that Hoffman is leading.  Jefferson County has not conducted a manual paper ballot recount. 

 

 

 St. Lawrence County, machines in Louisville, Waddington, Claire, and Rossie “broke” early in the voting process on election day.  Republican Commissioner Deborah Pahler said that the machines kept “freezing up… like Windows does all the time,” and that they experienced several paper jams as well.  The voted ballots that could not be scanned were placed in an Emergency Lock Box and re-scanned later at the St. Lawrence County Board of Elections.  Election officials in St. Lawrence County were given no advance knowledge of a potential virus in the system.

At least one County official thus far has raised concern that it’s possible that ALL of the machines used in the NY-23 election had the ‘virus’ but only a few malfunctioned as a result.  The counts from any district that used the ImageCast machines are suspect due to “the virus” discovered in Hamilton County, last-minute “reprogramming” by Dominion workers, and security flaws in the systems themselves.  A manual paper-ballot recount of the vote could resolve computer vote accuracy questions.”

Doug Hoffman, Acorn voter fraud, Democrats and unions tampered with votes, New York 23rd Congressional District, Nancy Pelosi, Votes not certified

It does not take a rocket scientist to question the validity of the vote counts and procedural handling of the New York 23rd Congressional District race between Doug Hoffman and Bill Owens. Nancy Pelosi conveniently certified Owens as the winner and then Owens voted for the House version of the Health Care Bill.

Now Hoffman is accusing ACORN, the Democrats and unions of tampering with the vote counts.

“Hoffman: ACORN, unions, Dems tampered with NY-23 election”

“With his prospect of winning the 23rd Congressional District race now almost zero, Conservative Party candidate Douglas L. Hoffman suggested Wednesday in a letter that “ACORN, the unions and the Democratic Party” “tampered” with results to deny him victory.

Mr. Hoffman provided no evidence to support his claims, but asked fellow conservatives to send donations his way to “ensure every vote is counted.”

Jerry O. Eaton, Jefferson County Republican elections commissioner, called Mr. Hoffman’s assertion “absolutely false.”

“No one has touched those ballots or has access to those ballots except board of elections staff – and in a bipartisan manner,” he said.

Mr. Hoffman trails Rep. William L. Owens, D-Plattsburgh, by 2,832 votes after 42.6 percent of absentee ballots districtwide were reported Wednesday. Officials are expected to count the 4,262 ballots remaining by Monday.

Mr. Hoffman told conservatives he was “forced to concede” on election night after learning he trailed by 5,335 votes and that he “barely won” his “stronghold in Oswego County.”

Oswego County did not have full results on election night because of what William W. Scriber, a Democratic elections commissioner there, called a “perfect storm” of problems. He said the elections board had assigned staffers to take results for specific districts, but the phone system redirected poll workers’ calls to the wrong people.

Mr. Scriber said the board decided to close its public reporting system early – with nine districts still unreported – as a safeguard.”

“Mr. Hoffman lead Oswego County by 500 votes when elections officials stopped taking results. When elections officials recanvassed the machine vote, the candidate’s lead was upgraded to 1,748.

Mr. Hoffman said the “phone system foul-up” and “inspectors who read numbers incorrectly when phoning in results” “sounds like a tactic right from the ACORN playbook.””

John Charlton, of The Post & Email, has just reported on election night irregularities in the Doug Hoffman, Bill Owens contest in NY-23. Is Doug Hoffman the winner?

“Looks Like Bill Owens’ Campaign orchestrated Election Fraud in NY-23”

“IMPOUNDMENT ORDER SOUGHT BY OWENS’ CAMPAIGN ENABLED HIS HOUSE APPOINTMENT”

“Even before a single vote was cast in the special election in the New York State 23rd Congressional District, the Times Union and Associated Press were reporting warning signs that might mar the credibility of the vote count.”

“But Tuesday’s vote will also mark one of the first large-scale uses of the state’s new digital devices, part of the long-awaited move from decades-old mechanical lever voting technology.

Of the 11 counties in the 23rd, seven will be using paper ballot/optical scanning voting systems rather than the lever machines, said John Conklin, spokesman for the state Board of Elections. Two counties will combine old and new systems, while another two — Clinton and Essex — are keeping lever machines.”

“Election-Night Irregularities

In the unofficial tally of votes in Madison County — published by the TCOT report — Hoffman received no votes in precincts in the towns of Fenner, Hamilton, Sullivan.  In Fenner and Sullivan, it appears that Hoffman’s votes were given to Scozzafava. It is not know whether these precincts were using the old lever-balloting systems or the new electronic scanning systems.  It should be noted that even in the electronic scanning systems, it is very easy to perpetrate voter fraud by tampering with the machinery or submitting duplicate ballots.

Impoundment Order sought by Owens’ Campaign used to his advantage

Nathan Barker of the Gouverneur Times reported just 50 minutes ago, that it was Bill Owens’ campaign which sought to have the voting machines impounded on Nov. 2nd, out of allegations of possible voter fraud, thus establishing cause and giving reasonable motive why Nancy Pelosi should not have seated Owens in the House.

The Owens’ campaign obtained an impound order, and kept the results under lock and key, until Hoffman conceded the race.  Only then did the Owens campaign release the impound order and allow the alleged initial vote count to support his claim to be victor. Nathan Barker writes:”

“Indeed, Nathan Barker of the Gouveneur Times just reported in a second article, 10 minutes ago, that this impounding order and the effect of preventing the U.S. House clerk knowing the actual election results on the day of the election, until such time as Hoffman conceded:

The Clerk of the House of Representatives requested results of the election from the NYS Board of Elections.  The NY Board of Elections could not release those results while the vote was impounded but after Mr. Hoffman’s concession of the election, based on erroneous information Hoffman had received with regard to the vote count, the Owens’ Campaign released their impound order.  This put the Board of Elections in a position where they could report the vote count to the Clerk of the House, although they emphasized that the results were unofficial and that they could not certify the result.”

“Hoffman’s Chance of Winning

Jude Seymour of the Watertown Daily Times, reported early this morning, also, that Hoffman does have a mathematical chance of winning, though it will be very difficult:

At the low point of her support during her active campaign, a Siena Research Institute poll released the day Ms. Scozzafava suspended her run suggested she had support from 20 percent of voters. If Ms. Scozzafava takes 20 percent of the absentee vote, Mr. Owens will need just 1,282 votes, or 18 percent, to hold off Mr. Hoffman.

The gap between Mr. Owens and Mr. Hoffman has shrunk by 2,159 since election night, after Oswego and Jefferson elections commissioners discovered human error had led to inaccurate reporting of results.”

Did Nancy Pelosi and the Democrats steal the NY congressional seat?

 Barack Obama gained the Democratic nomination with voter fraud and strong arm tactics during the primaries and caucuses along with Nancy Pelosi’s help during the convention. Obama has strong longtime ties to ACORN, masters of corruption and voter fraud. With the focus on voter fraud in 2008 that continues on into 2009, Nancy Pelosi and her corrupt cronies have achieved another level of corruption and voter fraud.
Nancy Pelosi ramroded through an unpopular, socialist Health Care Bill last weekend by a margin of 2 votes.  Bill Owens apparent victory made a difference in the vote. Did Owens win the NY-23 election?

“It looks increasingly that House Speaker Nancy Pelosi, in her zeal to get the Health Care Federalization Bill passed, may have sworn in an unelected candidate for the NY-23 Congressional District, in violation of the U.S. Constitution and New York State laws.

As a matter of fact, the Secretary of State of New York has not certified the election, in which Dough Hoffman and Bill Owens vied in a special election, nearly head to head, after Scozzafava retired in humiliation, having lost the support of conservatives in her district.”
“It turns out that Pelosi’s swearing-in of Owens had the political effect of garnering the addition Republican vote, of Cao, in the vote for the Health Care Bill, which passed narrowly, 220-215.  The election fraud therefore puts in doubt the legitimacy of that vote also.”

“Recanvassing shows NY-23 race tightens even as Rep. Bill Owens is sworn into House seat”

“Conservative Doug Hoffman conceded the race in the 23rd Congressional District last week after receiving two pieces of grim news for his campaign: He was down 5,335 votes with 93 percent of the vote counted on election night, and he had barely won his stronghold in Oswego County.

As it turns out, neither was true.

But Hoffman’s concession — based on snafus in Oswego County and elsewhere that left his vote undercounted — set off a chain of events that echoed all the way to Washington, D.C., and helped secure passage of a historic health care reform bill.

Democratic Rep. Bill Owens was quickly sworn into office on Friday, a day before the rare weekend vote in the House of Representatives. His support sealed his party’s narrow victory on the health care legislation.

Now a recanvassing in the 11-county district shows that Owens’ lead has narrowed to 3,026 votes over Hoffman, 66,698 to 63,672, according to the latest unofficial results from the state Board of Elections.

In Oswego County, where Hoffman was reported to lead by only 500 votes with 93 percent of the vote counted election night, inspectors found Hoffman actually won by 1,748 votes — 12,748 to 11,000.

The new vote totals mean the race will be decided by absentee ballots, of which about 10,200 were distributed, said John Conklin, communications director for the state Board of Elections.

Under a new law in New York that extended deadlines, military and overseas ballots received by this coming Monday (and postmarked by Nov. 2) will be counted. Standard absentee ballots had to be returned this past Monday.

Conklin said the state sent a letter to the House Clerk last week explaining that no winner had been determined in the 23rd District, and therefore the state had not certified the election. But the letter noted that Owens still led by about 3,000 votes, and that the special election was not contested — two factors that legally allowed House Speaker Nancy Pelosi to swear in Owens on Friday.

“We sent a letter to the clerk laying out the totals,” Conklin said. “The key is that Hoffman conceded, which means the race is not contested. However, all ballots will be counted, and if the result changes, Owens will have to be removed.”

Before Owens was sworn in Friday, Rep. John Garamendi, a Democrat who won a special election in California, was sworn in Thursday. The two gave Pelosi the votes she needed to reach a majority of 218 and pass the historic health care reform legislation in the House.”

“Ryan said an important factor in the decision to concede was the unexpected — and erroneous — close vote in Oswego County, where polls had Hoffman with a double digit percentage point lead heading into Election Day.

“That’s the thing that threw us off,” Ryan said.

Oswego County elections officials blame the mistakes on “chaos” in their call-in center that included a phone system foul-up and inspectors who read numbers incorrectly when phoning in results. Of 245 races in the county — not including the congressional and court races — 84 had incorrect totals reported election night.

In the congressional race, more votes were cast in Oswego County than any other in the 11-county district.”

“Jerry Eaton, the Republican elections commissioner for Jefferson County, said inspectors found a problem in four districts where Hoffman’s vote total was mistakenly entered as zero.

“Hoffman definitely gained votes where he didn’t have them,” Eaton said.”

“Ryan said the absentee ballots are likely to favor Hoffman because most were likely mailed before Republican Dede Scozzafava suspended her campaign three days before the election.

“For Doug to win, we needed a three-way race,” Ryan said, adding that the campaign’s internal polls showed Hoffman would win with all three candidates.

“Given the majority of these ballots are from a three-way race, we think the ballots are going to break Doug’s way,” Ryan said.”

Election 2009, November 3, 2009, Voters reject Obama agenda and Democratic Congress, Virginia rout, NJ rejects Obama, No more Obama

“Now this is not the end. It is not even the beginning of the end. But it is, perhaps, the end of the beginning.”…Winston Churchill

My fellow Americans, we have achieved a milestone. We can partially rejoice. As Winston Churchill stated, this is not the end but perhaps we have turned a corner and with cautious optimism, we can try to stop the Democratic Congress and Obama from ramming an unpopular and ruinous Health Care Bill down our throats. And regardless of how the Health Care agenda plays out, we must dramatically change the composition and attitude of Congress next year in the 2010 elections. 

We have achieved great victories in Virginia, New Jersey and New York City. The victory in VA was a rout. The victory in New Jersey was a slap in the face to Obama, who had campaigned for Governor Corzine three times in the past several months. This is a clear signal to Obama and the Democrat controlled Congress that Americans want change all right. Change from Obama’s socialist agenda.

We must continue to support the efforts of Minnesota Representative Michele Bachmann and others to confront Nancy Pelosi and Congress to demand no government Health Care. All of our efforts and hopes hinge on contacting our congressmen and holding them accountable. That means in the next several days, leading up to the elections in 2010 and henceforth.

Don’t back down.

John Fund of the Wall Street Journal has written an article dated November 2, 2009, about the potential for widespread voter fraud today, Tuesday, November 3, 2009.

 

“Chris Christie’s Next Case: Who Stole My Election?
Absentee voter fraud may play a significant role in New Jersey’s gubernatorial election.”
“The race for governor in New Jersey is so close in final polls that it may well end up in a recount — the 1981 election did and was decided by less than 1,800 votes. If there is a recount, you can bet disputes about absentee ballots will loom large. Moreover, if serious allegations of fraud emerge, you can also expect less-than-vigorous investigation by the Obama Justice Department — which showed just how seriously it takes such allegations when it walked away from an open-and-shut voter intimidation case against the New Black Panther Party in Philadelphia earlier this year.

Plenty of reasons exist for suspecting absentee fraud may play a significant role in tomorrow’s Garden State contests. Groups associated with Acorn in neighboring Pennsylvania and New York appear to have moved into the state. An independent candidate for mayor in Camden has already leveled charges that voter fraud is occurring in his city. Meanwhile, the Democratic Party in New Jersey is taking advantage of a new loosely written vote-by-mail law to pressure county clerks not to vigorously use signature checks to evaluate the authenticity of absentee ballots, the only verification procedure allowed.

The state has received a flood of 180,000 absentee ballot requests. On some 3,000 forms the signature doesn’t match the one on file with county clerks. Yet citing concerns that voters would be disenfranchised, Democratic Party lawyer Paul Josephson wrote New Jersey’s secretary of state asking her “to instruct County Clerks not to deny applications on the basis of signature comparison alone.” Mr. Josephson maintained that county clerks “may be overworked and are likely not trained in handwriting analysis” and insisted that voters with suspect applications should be allowed to cast provisional ballots. Those ballots, of course, would then provide a pool of votes that would be subject to litigation in any recount, with the occupant of New Jersey’s highest office determined by Florida 2000-style scrutiny of ballot applications.”
“Elsewhere, an investigation is being conducted into a report that people wearing Acorn T-shirts entered an East Orange hospital near Newark carrying blank absentee ballots and left with completed ballots. New Jersey law allows anyone to pick up an absentee ballot for someone else — these are called messenger ballots.

After repeated election-related scandals, Acorn has become toxic for many candidates who once relied on the group. But Acorn’s longtime allies, the Service Employee International Union and New York’s Working Families Party, have both moved into New Jersey. Peter Colavito, Acorn’s former political director in New York and a board member of the Working Families Party, is now the political director of SEIU Local 32BJ, which is heavily involved in New Jersey’s election. Nationally, the SEIU is a political powerhouse with White House visitor’s logs showing that Andrew Stern, its national head, visited 22 times in the first six months of the Obama White House — more than any other person. “Andrew Stern practically lives at the White House,” notes Politico.com.”
“Nor is in-person fraud at the polls unknown in New Jersey. In 2007, a former Hoboken zoning board president noticed a group of men outside a polling place being given index cards by two people. One of the loiterers later tried to vote in the name of a voter who had moved out of the area. When challenged by the former zoning board president, he ran out of the building and was caught. He later admitted to police he was part of a group from a homeless shelter who had been paid $10 each to vote using the names of other people.”

Citizen Wells vote, Tuesday, November 3, 2009, Voted against Obama agenda, Voted against modern day Democrat party, Against corruption, For US Constitution

I just returned from voting in NC, Tuesday, November 3, 2009.

I voted against the Obama agenda and the modern day Democrat Party.

I voted for upholding the US Constitution and rule of law.

I do not care for either party.

I voted a straight ticket.

I prefer to not vote a straight ticket.

However, this is an emergency.

I do not comprehend how an intelligent, well informed, concerned American voter can support the modern day Democrat Party.

Voting for Republican candidates was the lesser of evils.

However, going forward, all elected officials will be held more accountable.

I, and the rest of the American public, have had it with politically motivated, self serving politicians of all affiliations.

Let’s get by this emergency over the next year, vote out the jackasses in 2010, let all running for office know that we are watching them and expect them to act more like statesmen and less like politicians and return this country to a Constitutional Republic with liberty and justice for all.

We watched voter fraud and voter intimidation occur repeatedly during the primaries, caucuses and general election in 2008. The Governor’s race in NJ is close between Jon Corzine and Chris Christie and Obama is making his third campaign visit for Corzine on Monday. No one will be surprised to find out that controversies are already arising about possible voting irregularities.

“Democrats Ask New Jersey Secretary of State to Ignore Mismatched Signatures on Absentee-Ballot Requests

This year, New Jersey’s registered voters can request a mail-in ballot for any reason. (Before 2005, voters needed to provide a reason for why they needed an absentee ballot.) The state received about 150,000 absentee-ballot applications this year.

On about 2,300 of those applications so far, the signature on the request form does not match the signature on the voter’s registration forms with the state.

In a development that is depressingly predictable, the New Jersey Democratic party is asking the state to provide provisional ballots for all these voters. Those ballots could, presumably, be used to overcome any narrow lead by Republican Chris Christie over Democrat Jon Corzine on Election Day.”
“Could some of these cases be an election official misjudging the natural deviation in two handwriting samples from the same person? Certainly, and that’s why the current system has clerks reaching out to rejected voters (presuming they actually exist) to sort out the discrepancy. But Democrats want to short-circuit the established methods of sorting out the problem, and in fact to ban rejections based on signature mismatches entirely.

Paul P. Josephson, a lawyer representing the New Jersey Democratic State Committee, wrote to Secretary of State Nina Mitchell Wells, asking her to “instruct County Clerks not to deny (vote by mail) applications on the basis of signature comparison alone.””
“The fears of absentee-ballot fraud in New Jersey is not theoretical or far-fetched. Earlier this year, Atlantic City councilman Marty Small and 13 people who worked on his unsuccessful mayoral campaign “were indicted on charges they conspired to commit election fraud during the June Democratic primary through a variety of schemes involving messenger absentee ballots, state Attorney General Anne Milgram announced in Trenton.” One of those workers has already pled guilty. Five workers were indicted on similar charges in Essex County in August.

Suspicious minds see the letter as an attempt to create a pool of emergency votes to be used if Christie holds a small lead on Election Night. The Secretary of State has not yet responded to the Democrats’ request.”
