Blagojevich appeal prediction, Reduced sentence or Obama pardon, 6 Seventh Circuit Appeals Court sessions before Nov 4, Obama protection continues, Obama Rezko ties, Blagojevich fall guy

Why did Patrick Fitzgerald and the US Justice Department wait until December 2008 to arrest Rod Blagojevich?”…Citizen Wells

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

“There is enough corruption in Illinois so that all it takes is someone who is serious about finding it to uncover it. If a U.S. attorney is not finding corruption in Illinois, they’re not seriously looking for it.”…Northwestern Law Professor James Lindgren

The administration of Rod Blagojevich came under FBI scrutiny beginning in late 2003.

Yet, with all the harm Blagojevich et al were doing to the citizens of Illinois, he was not arrested until just after the 2008 election.

His arrest and the timing of his prosecution were clearly coordinated to have the least impact on Barack Obama.

That protection of Obama continues.

The 2010 election cycle has passed.

The 2012 election cycle has passed.

The 2014 election cycle is about to pass.

We have 6 sessions of the US Court of Appeals Seventh Circuit left before the November 4, 2014 elections.

If the decision comes before the election, I predict that Blagojevich will get a reduced sentence.

If not, it is entirely possible that Obama will pardon Blagojevich.

I believe that they have a deal.

Blagojevich “prosecution” history.

From Citizen Wells December 13, 2013.

The Rod Blagojevich appeal hearing is scheduled for today, Friday the 13th of December, 2013, in the US Court of Appeals Seventh Circuit.

This is part of a 10 year saga of investigations, prosecutions and perpetual delays.

Blagojevich, who was the presumptive presidential candidate, not Obama, in early 2006, should have been prosecuted before Tony Rezko, with stronger ties with Obama, and most definitely before the 2008 election.

Remember, the Blagojevich Administration was being investigated by the feds at least by late 2003 when the chicanery of Obama buddies Tony Rezko and Stuart Levine was being monitored by wiretap.

Attorney Len Goodman has made some strong arguments for a retrial or new sentencing hearing. Do not be surprised at the outcome.

I personally believe that the fix was in by 2006 and this is why Blagojevich was arrested after the 2008 election.

From Citizen Wells July 16, 2013.

“Lawyers for Rod Blagojevich filed an appeal Monday challenging the imprisoned former Illinois governor’s corruption conviction and stiff, 14-year prison term.

The lengthy filing with the 7th U.S. Circuit Court of Appeals in Chicago comes more than two years after the Chicago Democrat’s retrial and 16 months after he entered a federal prison in Colorado.”

From Citizen Wells November 13, 2013.

“Prosecutors have filed a response to Rod Blagojevich’s corruption conviction appeal. The 169-page government filing submitted late Tuesday urges the 7th U.S. Circuit Court of Appeals to reject the imprisoned former governor’s request for a new trial. Defense lawyers filed the appeal on the Illinois Democrat’s behalf in July. It asks the Chicago-based appellate court to toss his convictions or at least reduce his 14-year prison sentence.”

From Citizen Wells March 7, 2013.

Still wondering about the continued delay in the prosecution of Rod Blagojevich, specifically the lengthy delay in his appeal?

Here is one of the reasons.

From Chicago Business March 6, 2013.

“Blagojevich attorney hopes three’s a charm”

“Will three be a charm for Chicago attorney Len Goodman?

He’s on a winning streak that he’s hoping will carry over to his next case — defending former Illinois Gov. Rod Blagojevich.”

“The next big case on the criminal defense attorney’s plate is the appeal of Mr. Blagojevich, who is in prison in Colorado following his conviction on corruption charges.

“Right now, I’m just trying to get through 10,000 pages of trial transcripts,” says Mr. Goodman, who is the nephew of Chicago financier Lester Crown.

The case likely will go before the 7th Circuit Court of Appeals later this year.”

Of course there are other reasons why the appeal of Blagojevich has dragged on so long.

From Citizen Wells January 30, 2013.

“Here is the rest of the story.

Patrick Fitzgerald and the US Justice Department aggressively prosecuted George Ryan.

Patrick Fitzgerald and the US Justice Department, despite the fact that they began wiretaps in late 2003 and had in depth knowledge of corruption in the Rod Blagojevich Administration by 2005 at the latest, delayed the arrest of Blagojevich until after the 2008 election. The production of transcripts required for the Blagojevich appeal were delayed for over half a year by the US Justice Department in 2012, once again delaying the appeal until after the 2012 election.

From Citizen Wells  May 27, 2012.

“Fitzgerald aggressively prosecuted Republican ex Governot of Illinois, George Ryan and unjustly went after Scooter Libby and Karl Rove. Fitzgerald waited until after the 2008 elections to arrest Governor Rod Blagojevich despite the fact that he had details of corruption in the Blagojevich Administration at least by late 2003.

Is Patrick Fitzgerald a pawn, an idiot or corrupt?

From an FBI wiretap:

“You know, Axelrod and Obama’s people, you know, clearly turned, you know, got the Chicago media to make Rezko all about me.”

Late 2003.

Earliest documented awareness by FBI and Patrick Fitzgerald of corruption in Blagojevich admin. Pamela Meyer Davis agreed to secretly record conversations involving state health planning board with an FBI wire.

December 31, 2003 NY Times.

“Mr. Fitzgerald announced that he was prosecuting former Gov. George Ryan, a Republican, in a scandal that had been swirling around long before Mr. Fitzgerald got here and that many people thought would never touch the most powerful politicians in Illinois. But there Mr. Fitzgerald was, a week before Christmas, ticking off the details of a 91-page indictment against Mr. Ryan, seemingly from memory.

That, even Mr. Fitzgerald’s former opponents in the courtroom say, is classic Fitzgerald: dogged, dispassionate and endlessly prepared.”

April 8 – May 21, 2004 (Rezko Trial March 12, 2008; 11:11 a.m.)

“FBI Special Agent Daniel Cain, the primary case agent on the investigation into Levine and Rezko, is on the stand now in testimony that is laying the foundation for entering the wiretaps into evidence.

Cain said the investigation, dubbed Operation Board Games by the federal agents, began in December 2003 and was prompted by information gleaned from an informant whom he did not identify. That witness, he said, took part in meetings with two other individuals who were in contact with Levine by phone at his home.

Cain said Levine had three phone lines in his North Shore home. Federal agents recorded conversations on those lines April 8-May 21, 2004. Those dates span the time when Levine, Rezko and others allegedly were working to rig the hospital board vote on a Mercy Health System hospital proposal for Crystal Lake and other kickback schemes prosecutors claim they were engaged in.”

February 24, 2011.

“December 7, 2011.

Rod Blagojevich sentenced to 14 years.

Colin Powell, who has continued to endorse Barack Obama, knew that Scooter Libby and Karl Rove were innocent in the Valerie Plame leak. Yet Powell did not share his knowledge with the Bush Administration and thus allowed Patrick Fitzgerald to continue to investigate and prosecute Libby and Rove.

Why did Colin Powell allow Patrick Fitzgerald to be pulled away from the Blagojevich prosecution?

From Citizen Wells October 26, 2012.

“FOX Chicago News has learned that Rod Blagojevich’s appeal is still having trouble getting off the ground, because of delays in producing transcripts from his two trials.

For the second time in the last four months, Lauren Kaeseberg, one of the attorney’s handling Rod Blagojevich’s appeal, has been threatened with disciplinary action because she still hasn’t provided a complete copy of the Blagojevichtrial transcripts to the appellate court.

The appellate court won’t set a briefing schedule to get the appeal moving until the transcripts are available.

As FOX Chicago reported exclusively in August, the court reporter responsible for producing the 16,000 pages of transcripts took a leave of absence for five and a half months after Blagojevich was convicted. So, the appellate court agreed to wait until September 28th for the transcripts.

But, now in October, they’re still not completed. On Monday, the court issued an order, warning Kaeseberg again that she could face monetary or disciplinary sanctions. She responded Tuesday with an explanation, saying transcripts are still missing because they were under seal, or were handled by a different court reporter and she hopes to have them soon.”

“ The court reporter, trial judge James Zagel and the appeals court all have a responsibility to produce transcripts needed for an appeal in a timely manner.”

Citizen Wells for years has been questioning the delayed prosecution of Rod Blagojevich with the obvious intent of protecting Obama.

Today we present a new question that will be explored further soon.

“Why wasn’t Rod Blagojevich, the Governor of Illinois, wiretapped at least by 2005 when it was known in 2003 that there was widespread corruption in his administration?”

Obama just as guilty as Blagojevich, Justice Dept protecting Obama, Obama Rezko ties

The Citizen Wells blog and CitizenWells.com are committed to presenting the truth about Rod Blagojevich and Chicago corruption involving Barack Obama, et al. Twice, before the 2008 elections and now, before the 2010 elections, legal actions against Blagojevich have been delayed. It is apparent that the US Justice Department is protecting Obama. We will not let Obama escape being tainted by his strong ties to Chicago corruption.

From Citizen Wells April 3, 2010

Obama lied about his involvement with Tony Rezko

“February 10, 2008 Sun-Times.

During his March 14, 2008 interview, the Times told Obama, Thomas is an FBI mole and he “recently told us that he saw you coming and going from Rezko’s office a lot.”

“And three other sources told us that you and Rezko spoke on the phone daily.”

“Rod Blagojevich Indictment press release, APRIL 2, 2009.

“The Solicitation of Ali Ata
In late 2002, Ali Ata, a businessman who previously pleaded guilty and is cooperating, and who was solicited by Rezko to make political contributions to Blagojevich, brought a $25,000 check to Rezko’s offices, where Ata met with Blagojevich. Blagojevich asked Rezko if Rezko had talked to Ata about positions in the administration, and Rezko said that he had. In July 2003, after discussions with Rezko about possible state appointments, Ata gave Rezko another $25,000 check payable to Blagojevich’s campaign. Ata then had a conversation with Blagojevich at a fundraising event in which Blagojevich indicated that he was aware Ata recently had made another substantial contribution to his campaign, and told Ata that he understood Ata would be joining his administration.

Ata replied that he was considering taking a position, and Blagojevich said that it had better be a job where Ata could make some money. Blagojevich ultimately appointed Ata as the executive director of the Illinois Finance Authority.””

““Ata made a $5,000 donation to Obama less than a month earlier on June 30, 2003. Ata is also an investor in Riverside Park. Almost without fail, the people identified in the Board Games cases as investors in Riverside Park contributed to Obama’s US senate campaign.””

Blagojevich trial, Obama Rezko ties, Black Panther case dismissal

Will the Rod Blagojevich trial end sooner than projected?

Will Tony Rezko or Stuart Levine be called as witnesses?

Will the focus of the Blagojevich trial continue to be on the senate seat?

We know this:

  • By the time Rezko was convicted in June 2008, the feds had enough to indict Blagojevich.
  • The US Justice Dept. waited until December 2008, after the election to arrest Blagojevich.
  • Federal prosecutor Patrick Fitzgerald was given a supervisory assignment by Obama early in 2009.
  • The following statement, damning for both Blagojevich and Obama, was included in the Criminal Complaint and not in the final Indictment. “At the relevant time period, the Planning Board consisted of nine individuals.”
  • Judge James Zagel has referred to Rezko as a bad witness.
  • The trial may end in the next 2 weeks instead of lasting the projected 3 to 4 months.
  • Attorney J. Christian Adams resigned from the US Justice Dept. after the case against the New Black Panther party was dismissed.
  • Civil rights attorney Bartle Bull has critized the US Justice Dept. and referred to Obama as a “Hustler.”

Is the US Justice Dept. corrupt?

I put the third of three videos I have produced about Blagojevich wiretaps on YouTube this morning.

The following comment was posted soon after.

“I’m from Chicago and here there has been wall to wall coverage of Blago’s remarks, but NO WHERE ELSE!
Between Sestak and THIS and ignoring our Constitution etc, Obama should be getting IMPEACHED right now.
If it were BUSH, that would already be happening!”

Last night I had a conversation with a friend of mine who I have not talked to in a while. He is retired from the Greensboro News & Record. I asked if he had been following the Blagojevich trial. His response was that there wasn’t much going on and he did not recall reading anything in the News & Record. I commenced to inform him of the wiretaps and I let the mainstream media have it. The News & record and other newspapers in NC and across the nation have suffered from a decline in readership. This is another example of why this has happened.

A few moments ago I did an internet search.
“blagojevich wiretaps obama”

On the first page a Citizen News article showed up in the middle and 2 video links above. One was ABC News and one was one of three Citizen Wells videos.

The ABC video showed up as:

“Blago Drops F-Bombs in Wire Tap Tapes”

http://abcnews.go.com/Politics/video/blagojevich-wire-tap-tapes-in-corruption-trial-10989034

Compare this heading and video to the three Citizen Wells videos on YouTube. They have access to the same information that I do.

I have more videos and reports in the works. The information in the wiretaps released thus far is enough to remove Obama from office.

Blagojevich trial, Obama and Rezko, Blagojevich defense subpoena

Here is a small but important exerpt from the Blagojevich defense motion to subpoena  Barack Obama for the Blagojevich trial, set to begin June 3, 2010.

“22. However, the defense has a good faith belief that Mr. Rezko, President Obama’s former friend, fund-raiser, and neighbor told the FBI and the United States Attorneys a different story about President Obama. In a recent in camera proceeding, the government tendered a three paragraph letter indicating that Rezko “has stated in interviews with the government that he engaged in election law violations by personally contributing a large sum of cash to the campaign of a public official who is not Rod Blagojevich. … Further, the public official denies being aware of cash contributions to his campaign by Rezko or others and denies having conversations with Rezko related to cash contributions. … Rezko has also stated in interviews with the government that he believed he transmitted a quid pro quo offer from a lobbyist to the public official, whereby the lobbyist would hold a fundraiser for the official in exchange for favorable official action, but that the public official rejected the offer. The public official denies any such conversation. In addition, Rezko has stated to the government that he and the public official had certain conversations about gaming legislation and administration, which the public official denies having had.”10

10 The defense has a good faith belief that this public official is Barack Obama. See, “Obama on Rezko deal: It was a mistake”, Dave McKinney, Chris Fusco, and Mark Brown, Chicago Sun Times, November 5, 2006. Senator Barack Obama was asked: “Did Rezko or his companies ever solicit your support on any matter involving state or federal government? Did Al Johnson, who was trying to get a casino license along with Tony Rezko, or Rezko himself ever discuss casino matters with you?” Senator Obama answered: “No, I have never been asked to do anything to advance his business interest. In 1999, when I was a State Senator, I opposed legislation to bring a casino to Rosemont and allow casino gambling at docked riverboats which news reports said Al Johnson and Tony
Rezko were interested in being part of. I never discussed a casino license with either of them. I was a vocal opponent of the legislation.” Obama’s involvement with Tony Rezko and this legislation coincides with the three paragraph summary the government has provided to the defense referenced above.”

The following is from a Chicago SunTimes article dated November 5, 2006. It contains the usual Obama lies and misrepresentations.

“Obama on Rezko deal: It was a mistake”

“U.S. Sen. Barack Obama expressed regret late Friday for his 2005 land purchase from now-indicted political fundraiser Antoin “Tony” Rezko in a deal that enlarged the senator’s yard.
“I consider this a mistake on my part and I regret it,” Obama told the Chicago Sun-Times in an exclusive and revealing question-and-answer exchange about the transaction.
In June 2005, Obama and Rezko purchased adjoining parcels in Kenwood. The state’s junior senator paid $1.65 million for a Georgian revival mansion, while Rezko paid $625,000 for the adjacent, undeveloped lot. Both closed on their properties on the same day.”

“The transaction occurred at a time when it was widely known Tony Rezko was under investigation by U.S. Attorney Patrick Fitzgerald and as other Illinois politicians befriended by Rezko distanced themselves from him.
In the Sun-Times interview, Obama acknowledged approaching Rezko about the two properties being up for sale and that Rezko developed an immediate interest. Obama did not explain why he reached out to Rezko given the developer’s growing problems.
Last month, Rezko was indicted for his role in an alleged pay-to-play scheme designed to fatten Gov. Blagojevich’s political fund. Rezko also was accused of bilking a creditor.”

“”It was simply not good enough that I paid above the appraised value for the strip of land that he sold me. It was a mistake to have been engaged with him at all in this or any other personal business dealing that would allow him, or anyone else, to believe that he had done me a favor,” the senator said.
The land deal came up in a court hearing Friday that delved into Rezko’s finances. Obama said he has not been approached by federal prosecutors about the transaction nor has plans to go to them about it.
Obama and Rezko have been friends since 1990, and Obama said the Wilmette businessman raised as much as $60,000 for him during his political career. After Rezko’s indictment, Obama donated $11,500 to charity–a total that represents what Rezko contributed to the senator’s federal campaign fund.
After the controversy surfaced on Wednesday, the Sun-Times presented Obama’s office with a lengthy set of questions about the land deal, Obama’s relationship with Rezko and the story’s impact on a potential 2008 bid for the White House.”

“Q: Senator, when did you first meet Tony Rezko? How did you become friends? How often would you meet with him, and when did you last speak with him?

A: I have probably had lunch with Rezko once or twice a year and our spouses may have gotten together on two to four occasions in the time that I have known him. I last spoke with Tony Rezko more than six months ago.”

“Q: Did you approach Rezko or his wife about the property, or did they approach you?
A: To the best of my recollection, I told him about the property, and he developed an interest, knowing both the location and, as I recall, the developer who had previously purchased it.”

“Q: How do you explain the fact your family purchased your home the same day as Rita Rezko bought the property adjacent to yours? Was this a coordinated purchase?

A: The sellers required the closing of both properties at the same time. As they were moving out of town, they wished to conclude the sale of both properties simultaneously. The lot was purchased first; with the purchase of the house on the adjacent lot, the closings could proceed and did, on the same day, pursuant to the condition set by the sellers.”

“Q: Why is it that you were able to buy your parcel for $300,000 less than the asking price, and Rita Rezko paid full price? Who negotiated this end of the deal? Did whoever negotiated it have any contact with Rita and Tony Rezko or their Realtor or lawyer?

A: Our agent negotiated only with the seller’s agent. As we understood it, the house had been listed for some time, for months, and our offer was one of two and, as we understood it, it was the best offer. The original listed price was too high for the market at the time, and we understood that the sellers, who were anxious to move, were prepared to sell the house for what they paid for it, which is what they did.
We were not involved in the Rezko negotiation of the price for the adjacent lot. It was our understanding that the owners had received, from another buyer, an offer for $625,000 and that therefore the Rezkos could not have offered or purchased that lot for less.”

“Q: Does it display a lack of judgment on your part to be engaging in real estate deals with Tony Rezko at a point his connections to state government had been reported to be under federal investigation?

A: I’ve always held myself to the highest ethical standards. During the ten years I have been in public office, I believe I have met those standards and I know that is what people expect of me. I have also understood the importance of appearances.
With respect to the purchase of my home, I am confident that everything was handled ethically and above board.
But I regret that while I tried to pay close attention to the specific requirements of ethical conduct, I misgauged the appearance presented by my purchase of the additional land from Mr. Rezko. It was simply not good enough that I paid above the appraised value for the strip of land that he sold me. It was a mistake to have been engaged with him at all in this or any other personal business dealing that would allow him, or anyone else, to believe that he had done me a favor. For that reason, I consider this a mistake on my part and I regret it.”

“Q: Why did you not publicly disclose the transaction after Rezko got indicted?

A: At the time, it didn’t strike me as relevant. I did however donate campaign contributions from Rezko to charity.”

“Q: Did Rezko or his companies ever solicit your support on any matter involving state or federal government? Did Al Johnson, who was trying to get a casino license along with Tony Rezko, or Rezko himself ever discuss casino matters with you?

A: No, I have never been asked to do anything to advance his business interests. In 1999, when I was a State Senator, I opposed legislation to bring a casino to Rosemont and allow casino gambling at docked riverboats which news reports said Al Johnson and Tony Rezko were interested in being part of. I never discussed a casino license with either of them. I was a vocal opponent of the legislation. (http://www.ilga.gov/legislation/votehistory/srollcalls91/pdf/910SB1017_05251999_001000C.PDF)”

“Q: Did Rezko ever discuss with you his dealings with Stuart Levine, Christopher Kelly or William Cellini or the role he was playing in shaping Gov. Blagojevich’s administration?

A: No.”

“Q: Did Rezko have an appraisal performed for the 10-foot strip?

A: I had an appraisal conducted by Howard B. Richter & Associates on November 21, 2005.”

“Q: Was there a negotiation? Did he have an asking price, or did he just say, whatever you think is fair?

A: I proposed to pay on the basis of proportionality. Since the strip composed one-sixth of the entire lot, I would pay one-sixth of the purchase price of the lot. I offered this to Mr. Rezko and he accepted it.”

“Q: How many fundraisers has Mr. Rezko hosted for you? Were these all in his home? How much would you estimate he has raised for your campaigns?

A: He hosted one event at his home in 2003 for my U.S. Senate campaign. He participated as a member of a host committee for several other events. My best estimate was that he raised somewhere between $50,000 and $60,000.”

Kenneth J Conner whistleblower lawsuit

Obama, Rezko real estate deal, rest of the story

Many have forgotten about the lawsuit initiated by Kenneth J Conner on October 16, 2008. I have not. Conner is the whistleblower who was fired from Mutual Bank for raising questions about the Rezko real estate transactions. His lawsuit is still alive. Mutual Bank has gone under but the FDIC is still listed as a defendant.

Kenneth J Conner worked for Mutual bank from August 3, 2000 until he was dismissed October 23, 2007. Conner is a graduate of Benedictine University with a Bachelor of Business Administration in Management degree with the honor of “Management Major of the Year” in May, 1999. Conner later earned a Master’s Degree in Finance from Benedictine University in May , 2005.

Here are some interesting exerpts.

“9.  In June, 2005, Mutual Bank President and CEO Amrish Mahajan and other Mutual Bank olfficers approved a loan to Rita Malki Rezko (Rita Rezko) which was guaranteed by Antonin Rezko so that Rita Rezko could purchase a 9,090 square foot vacant parcel of real estate at 5050 S. Greenwood Avenue, Chicago. As part of the Mutual Bank loan underwriting process, Mutual Bank obtained a real estate appraisal from Adams Valuation Corporation (Adams Appraisal) which purported to provide an opinion of value of the subject 5050 S. Greenwood real estate (the collateral for the Rezko loan) at $ 68.76 per square foot. A copy of the Adams Appraisal is attached as Exhibit C. In June, 2005, Rita Rezko closed on the purchase of the 5050 S. Greenwood property at a purchase price of $ 625,000.00 along with the loan from Mutual Bank in the amount of $ 500,000.00 with Mutual bank obtaining a first mortgage lien position on the Greenwood vacant parcel.”

“10.  On or about January 4, 2006, Rita Rezko entered into an agreement with Senator Barack and Michelle Obama (Obamas) to sell a ten-foot strip of the 5050 S. Greenwood property to the Obamas. A copy of the Obama/Rita Rezko contract is attached as Exhibit D. As a result of that transaction, the Rezkos requested that Mutual Bank release it’s first collateral position to the ten-foot strip parcel transferred to the Obamas. In that same general time frame, Richard Barth, Mutual Bank Senior VP of construction lending and James Murphy, Mutual Bank Senior VP Internal Auditor/Risk Manager, requested that Conner perform an appraisal review of the Adams Appraisal attached hereto as Exhibit C.”

“11.  In late 2005 or early 2006, Conner performed an appraisal review of the Adams Appraisal (Exhibit C) per the directive of Richard Barth and James Murphy. Conner prepared a written Appraisal Review report (ARR) opining that the Adams Appraisal overvalued the Greenwood lot by a minimum of $ 125,000.00 and that a reasonable and fair valuation for Mutual Banks’s underwriting purposes should be no greater than $ 500,000.00 for the entire 5050 S. Greenwood parcel as originally purchased by Rita Rezko. In that same general time frame an appraisal was performed for the 5050 S. Greenwood property by Howard B. Richter, MAI which valued the 5050 S. Greenwood property at $ 54.00 per square foot but then discounted the ten-foot strip being transferred by Rita Rezko to the Obamas by fifty percent, as the ten-foot strip was unbuildable standing alone…The valuation by the Richter Appraisal for the 5050 S. Greenwood lot was substantially to Conner’s ARR valuation.”

“12.  Conner notified Richard Barth and James Murphy orally of his ARR findings and Conner’s ARR was filed in the “Rezko 5050 Greenwood” loan file at Mutual Bank.”

“13.  In addition to Conner’s ARR stating that the Adams Appraisal overvalued the 5050 S. Greenwood property, Conner had reported on other occasions that Adams Valuation Corporation had overvalued real estate subject to Mutual Bank loan underwriting valuation.”

“14.  On or about October 19, 2006, Mutual Bank received a Grand Jury Subpoena (GJS) requiring Mutual Bank to produce the Rezko 5050 Greenwood loan file, as well as a Rita Rezko Riverside District Development LLC checking account and loan file. Electronic mail (email) communications about the subpoena were circulated to Mutual Bank officers and attorneys, including Amrish Mahajan, James Murphy and Conner. A copy of an October 19, 2006 email string pertaining to the Rezko GJS is attached as Exhibit F. On information and belief, Conner’s ARR was removed from the Rezko 5050 Greenwood loan file prior to the submission of that file pursuant to the GJS, and in it’s place Mutual bank submitted an appraisal checklist which was purportedly dated “06/15/05″ from Senior VP James P. Murphy (Murphy Checklist). A copy of the Murphy Checklist is attached as Exhibit G.”

“16.  In 2007, Conner observed that his ARR of the 5050 S. Greenwood property was not in the Rezko 5050 Greenwood loan file and in it’s place was the Murphy Checklist purportedly dated “06/15/2005.”…On June 18, 2007, Conner sent an email to James Murphy which provides, in part, “I spent time trying to track down work of mine that should be in a particular high profile loan file, though it is not–having been replaced by a checklist.””

“17.  In October, 2007, Conner had various communications with Mutual Bank’s Human Resources Department representative, Lana Schlabach. In an email communication of October 15, 2007, Conner directly referenced “Resentment over my mentioned discovery of the removal/replacement of an appraisal review that I conducted. That appraisal review contained substantial observations and suggestions. The transaction and parties involved were high profile in the media.I am under the impression that the FBI has since looked at the file.””

“18.  On October 23, 2007, eight days after Conner’s October 15, 2007 email to Schlabach attached as Exhibit J, Mutual Bank terminated Conner’s employment for pretextual reasons.”

Blagojevich trial, Update, Tony Rezko, Obama subpoena, Obama Rezko ties

Where is Tony Rezko, convicted crime buddy of Blagojevich and Obama?

From the Washington Examiner.

“Where in the world is Tony Rezko?”

“Why is Antoin “Tony” Rezko under lock and key at an undisclosed location, like some sort of CIA-renditioned al Qaeda operative? And why hasn’t he been sentenced yet?

As the June 3 corruption trial of former Illinois Governor Rod Blagojevich for allegedly trying to sell Obama’s former Illinois Senate seat approaches, the whereabouts of the former Blago and Obama fundraiser is literally a state secret.

The Chicago Sun-Times reported that Rezko was moved from Chicago’s downtown Metropolitan Correctional Center on December 16th, even though it’s right across the street from the federal courthouse where Blago will be tried.

Rezko’s not listed on the federal Bureau of Prisons’ inmate locator, either.

“Nobody knows where he is,” a source in Chicago told The Examiner.

The other big question: Why hasn’t Rezko been sentenced yet? It’s been almost two years since the Chicago restaurant and real estate developer was convicted on bribery, fraud and money laundering charges.

After months of unexplained delays, Rezko’s January 6th sentencing date was canceled again – this time indefinitely – by U.S. District Court Judge Amy St. Eve, a former Whitewater prosecutor. Reporters were initially told that Rezko was cooperating with prosecutors, but he apparently stopped talking and demanded to be sentenced as soon as possible. That request was obviously denied.”

From the recent motion to subpoena Barack Obama from the Blagojevich defense team we know this.

“22. However, the defense has a good faith belief that Mr. Rezko, President Obama’s
former friend, fund-raiser, and neighbor told the FBI and the United States Attorneys
a different story about President Obama. In a recent in camera proceeding, the
government tendered a three paragraph letter indicating that Rezko “has stated
in interviews with the government that he engaged in election law violations by
personally contributing a large sum of cash to the campaign of a public official
who is not Rod Blagojevich. … Further, the public official denies being aware of
cash contributions to his campaign by Rezko or others and denies having
conversations with Rezko related to cash contributions. … Rezko has also stated
in interviews with the government that he believed he transmitted a quid pro quo
offer from a lobbyist to the public official, whereby the lobbyist would hold a
fundraiser for the official in exchange for favorable official action, but that the
public official rejected the offer. The public official denies any such
conversation. In addition, Rezko has stated to the government that he and the
public official had certain conversations about gaming legislation and
administration, which the public official denies having had.”10

10 The defense has a good faith belief that this public official is Barack Obama. See, “Obama on Rezko deal: It
was a mistake”, Dave McKinney, Chris Fusco, and Mark Brown, Chicago Sun Times, November 5, 2006. Senator
Barack Obama was asked: “Did Rezko or his companies ever solicit your support on any matter involving state or
federal government? Did Al Johnson, who was trying to get a casino license along with Tony Rezko, or Rezko
himself ever discuss casino matters with you?” Senator Obama answered: “No, I have never been asked to do
anything to advance his business interest. In 1999, when I was a State Senator, I opposed legislation to bring a
casino to Rosemont and allow casino gambling at docked riverboats which news reports said Al Johnson and Tony
Rezko were interested in being part of. I never discussed a casino license with either of them. I was a vocal
opponent of the legislation.” Obama’s involvement with Tony Rezko and this legislation coincides with the
three paragraph summary the government has provided to the defense referenced above.”

Apparently Tony Rezko is talking. And don’t forget, there are plenty more of Blagojevich’s and Obama’s cronies who may talk to get a lighter sentence. Stuart Levine has talked plenty already.

Barack Obama

Arrest

Part 2

I was going over some notes, preparing to put up the next article explaining in detail why Barack Obama should have already been arrested when I came across some old articles that I had saved. The articles were so compelling on their own that I decided to present them as standalone evidence that Obama and Blagojevich should have been indicted and arrested by mid 2008. This leaves several glaring questions.

Why did Patrick Fitzgerald and the US Dept of Justice wait until after the election to arrest Blagojevich? The excuse of waiting for the US Senate seat to be sold was a diversion. There was plenty of evidence against Blagojevich. The amount of evidence placed before the public was sufficient and Fitzgerald has much more.

If you arrest Blagojevich, you have to arrest Obama. Obama was just as steeped in Chicago and IL corruption.

Perhaps that was the reason for focusing on the selling of the IL senate seat.

However, if you examine the complaint and subsequent indictment of Blagojevich, you will see the same references to corruption that ensnares Obama.

And now Obama has picked Fitzgerald to be the Interim chairman of the Attorney General’s Advisory Committee of U.S. Attorneys.

What does that mean?
What is also significant about the following articles is that they came from the Main Stream Media. However, prescious little of this was revealed on television.

From the LA Times blog, Top of the Ticket, April 7, 2008:

“Ticket Special Report: Obama and Rezko, the early years”

“The trial of Antoin “Tony” Rezko, one-time patron to Sen. Barack Obama and Illinois Gov. Rod Blagojevich, has turned lurid.

Under cross-examination by Rezko attorney Joseph Duffy, star prosecution witness Stuart Levine, a Chicago-area lawyer, is admitting to conspiracy, extortion, bribery, fraud and other bad acts while he “served” at the Illinois public school teachers pension fund board.

At Duffy’s urging, Levine is detailing 30 years of drug usage including sordid day-long binges with other men at a Chicago inn called the Purple Hotel. Rezko’s attorney Duffy is wondering whether all that cocaine, crystal meth and other drug use has perhaps fogged Levine’s memory.

That aside, much of the trial’s focus is on money — much of it given in the form of campaign money in the careers of Obama and Blagojevich.

It’s an unfolding, seemingly local political story that’s fascinating in its revealing details about the subterranean world of business, financial and family connections in Illinois and Chicago politics that helped take a virtually unknown black Chicago attorney, nurtured him politically and financially and turned him into….

the polished candidate who today thrills crowds of thousands across the country with his eloquence.

Obama currently leads in delegates for the Democratic nomination for president.

This tale is long by Ticket standards. We’ll do this rarely. But for those interested in delving into details it provides important background about the early political connections of a little-known newcomer to the national political scene.

This story concerns two men, neither of whom face any legal charges today. They are two of Illinois’ top Democratic politicians — Gov. Blagojevich, who’s been mentioned often in court, and Sen. Obama, who’s received only passing mentions. They’re entwined in the Rezko saga, particularly through the bounteous campaign money he raised for them both.

Get used to that name. Rezko’s currently in a long-running Chicago trial on federal extortion and bribery charges. Few campaign donors were more responsible than Rezko for the rise of Blagojevich (Blah-goy-ah-vitch) and Obama. Both politicians came to rely on him for political and personal advice — and lots of campaign money.

Their intimate relationship is coming into focus through Rezko, a Syrian-born businessman who made his money in real estate and restaurant franchises and now sits daily in the federal courtroom of U.S. District Judge Amy St. Eve. The trial’s daily events are covered in this Tribune Rezko court blog.

So far, Blagojevich, reelected in 2006, is more deeply enmeshed in the scandal than Obama, who’s not been implicated in any wrongdoing.

But all three operated in the murky world of Illinois Democratic politics, where money, family relationships and long business associations provide the invisible glue of the local political world.

Witnesses in Rezko’s trial have testified that Rezko recommended friends and associates for government jobs and posts on Illinois state boards when Blagojevich took office in 2003, and some of those friends were generous donors to Blagojevich.

An early trial exhibit from prosecutors was a spreadsheet. Prepared by an FBI agent , the spreadsheet identifies Rezko-related donors who supplied $1.43 million between 2001 and 2004 to Blagojevich, who was first elected governor in 2002.

Using Federal Election Commission and Illinois state records, The Times’ Dan Morain compared donors on the FBI spreadsheet to Obama’s contributors. Guess what.

Sen. Obama received $222,000 during the same 2001-2004 period from Rezko-related Blagojevich donors.

And Obama received at least another $32,000 from them for this presidential run — although Rezko, indicted in 2006, has not been involved in Obama’s current campaign.

Those Obama-Blagojevich donors include Rezko himself, along with his family members, employees and associates of his various business enterprises. There’s also the head of a major Chicago investment firm that received Illinois public teachers’ pension money to invest.”

From the Chicago SunTimes April 23, 2007:
“Obama and his Rezko ties
DAY ONE OF TWO”
“For more than five weeks during the brutal winter of 1997, tenants shivered without heat in a government-subsidized apartment building on Chicago’s South Side.

It was just four years after the landlords — Antoin “Tony” Rezko and his partner Daniel Mahru — had rehabbed the 31-unit building in Englewood with a loan from Chicago taxpayers.

Rezko and Mahru couldn’t find money to get the heat back on.

But their company, Rezmar Corp., did come up with $1,000 to give to the political campaign fund of Barack Obama, the newly elected state senator whose district included the unheated building.

Obama has been friends with Rezko for 17 years. Rezko has been a political patron to Obama and many others, helping to raise millions of dollars for them through his own contributions and by hosting fund-raisers in his home.

Obama, who has worked as a lawyer and a legislator to improve living conditions for the poor, took campaign donations from Rezko even as Rezko’s low-income housing empire was collapsing, leaving many African-American families in buildings riddled with problems — including squalid living conditions, vacant apartments, lack of heat, squatters and drug dealers.

The building in Englewood was one of 30 Rezmar rehabbed in a series of troubled deals largely financed by taxpayers.

Every project ran into financial difficulty. More than half went into foreclosure, a Chicago Sun-Times investigation has found.

“Their buildings were falling apart,” said a former city official. “They just didn’t pay attention to the condition of these buildings.”

Eleven of Rezko’s buildings were in Obama’s state Senate district.

Obama, now a U.S. senator running for president, has come under fire over his friendship with Rezko, who was charged last fall with demanding kickbacks on state business deals under Gov. Blagojevich.”

“Rezko and Mahru had no construction experience when they created Rezmar in 1989 to rehabilitate apartments for the poor under the Daley administration. Between 1989 and 1998, Rezmar made deals to rehab 30 buildings, a total of 1,025 apartments. The last 15 buildings involved Davis Miner Barnhill & Galland during Obama’s time with the firm.

Rezko and Mahru also managed the buildings, which were supposed to provide homes for poor people for 30 years. Every one of the projects ran into trouble:”

•                         Seventeen buildings — many beset with code violations, including a lack of heat — ended up in foreclosure.

•                         Six buildings are currently boarded up.

•                         Hundreds of the apartments are vacant, in need of major repairs.

•                         Taxpayers have been stuck with millions in unpaid loans.

•                         At least a dozen times, the city of Chicago sued Rezmar for failure to heat buildings.”
“Obama works on Rezmar deals

Obama spent the next eight years serving in the Illinois Senate and continued to work for the Davis law firm.  Through its partnerships, Rezmar remained a client of the firm, according to ethics statements Obama filed while a state senator.”
“But Obama did legal work on real estate deals while at Davis’ firm, according to biographical information he submitted to the Sun-Times in 1998. Obama specialized “in civil rights litigation, real estate financing, acquisition, construction and/or redevelopment of low-and moderate income housing,” according to his “biographical sketch.”

And he did legal work on Rezko’s deals, according to an e-mail his presidential campaign staff sent the Sun-Times on Feb. 16, in response to earlier inquiries. The staff didn’t specify which Rezmar projects Obama worked on, or his role. But it drew a distinction between working for Rezko and working on projects involving his company.”
