Joseph Cari sentenced, Blagojevich Rezko Obama Biden ties, Cari pressured by Stuart Levine, John Harris and Alonzo Monk await sentencing

“Why did the Illinois Senate Health & Human Services Committee, with Obama as chairman, create and push Bill 1332, “Illinois Health Facilities Planning Act,” early in 2003, which reduced the number of members on the Board from 15 to 9, just prior to rigging by Tony Rezko and Rod Blagojevich?”…Citizen Wells

“There is enough corruption in Illinois so that all it takes is someone who is serious about finding it to uncover it. If a U.S. attorney is not finding corruption in Illinois, they’re not seriously looking for it.”…Northwestern Law Professor James Lindgren

From the Chicago Tribune August 9, 2011.

“A federal judge chose not to send a cooperating witness in the prosecution of Rod Blagojevich to prison for his role in trying to shake down an asset management firm, sentencing the former fundraiser on Tuesday to three years of probation.

Joseph Cari, 58, is one of the first notable figures to be sentenced of those who took plea deals and testified against the impeached Illinois governor. Blagojevich’s former chiefs of staff John Harris and Alonzo Monk are among those still awaiting sentencing.

Cari, who pleaded guilty to attempted extortion, told Judge Amy St. Eve just before she sentenced him that he took full responsibility for his actions and was sorry.

“I will live with the shame and pain for the rest of my life,” he said.

A former finance chairman of the Democratic National Committee, Cari described to jurors at Blagojevich’s first corruption trial how the then-governor boasted to him in 2003 about how governors could pressure companies desperate for state business for campaign cash.

Prosecutors decided not to call Cari as part of their streamlined case at the retrial this year, where Blagojevich was convicted of counts including trying to sell or trade President Barack Obama’s vacated U.S. Senate seat for a high-paying job or campaign donations. Blagojevich is slated to be sentenced Oct. 6.

As part of Cari’s probation, St. Eve said he must remain on home confinement for the first nine months, though he will be able to leave to go to work or even to travel abroad on business. The maximum prison sentence for extortion is 20 years.”

“At Blagojevich’s first trial, Cari told jurors that the governor’s advisers dangled the possibility that he could get law business and other fees from the state if he put his fundraising contacts to work for a possible Blagojevich run for the White House.

Cari said he eventually bowed to pressure from Stuart Levine, a Blagojevich campaign contributor and influential member of the board that governed a multibillion-dollar fund that pays the pensions of Illinois teachers not in Chicago. Levine wanted Cari to call the Virginia-based asset management firm and warn them they would lose an $80 million allocation from the fund if they didn’t hire a consultant they had never met. Cari said that when the head of the management firm asked why, he had a simple answer: “That’s the way they do it in Illinois.””

From Citizen Wells August 26, 2008.

“Just when you thought it couldn’t get any better. Just when you thought the height of lies, deception and corruption had been achieved. Along comes another tie to Tony Rezko and crime and corruption in Chicago and Illinois. We have a balanced ticket in Obama and Biden. They both have ties to Tony Rezko and Joseph Cari.”

“Vice-presidential candidate Sen. Joseph Biden, D-Del. (left), has been advised since 1984 by Joseph Cari (right), the Chicago lawyer and onetime mega-fundraiser who has been tied to the Antoin “Tony” Rezko patronage scandal.”

“Chicago lawyer and onetime mega-fundraiser Joseph Cari has advised Biden and his campaigns on and off since 1984, serving in posts as varied as a Senate adviser on crime to the Midwest Political Director for Biden’s aborted 1987 presidential bid. In 2005 Cari helped arrange private meetings for Biden with potential supporters, as the senator explored another run for the White House. He has also worked to raise money for Biden . “

“Cari admitted that in 2004 he helped a Rezko associate by making calls in what turned out to be a kickback scheme. The deal was an offshoot of a complex corruption scheme wrought by Antoin “Tony” Rezko , whose ties to Obama have vexed the White House hopeful . Cari has maintained he did not know the details of that scheme or any other.”

Obama and Blagojevich ties to Rezko Chicago corruption, Why Justice Dept has been covering for Obama

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

Before I continue on with my case against the US Justice Department in their ongoing efforts to protect Obama, here is an article from the LA Times, April 7, 2008. American public, you were warned.

“Under cross-examination by Rezko attorney Joseph Duffy, star prosecution witness Stuart Levine, a Chicago-area lawyer, is admitting to conspiracy, extortion, bribery, fraud and other bad acts while he “served” at the Illinois public school teachers pension fund board.

At Duffy’s urging, Levine is detailing 30 years of drug usage including sordid day-long binges with other men at a Chicago inn called the Purple Hotel. Rezko’s attorney Duffy is wondering whether all that cocaine, crystal meth and other drug use has perhaps fogged Levine’s memory.

That aside, much of the trial’s focus is on money — much of it given in the form of campaign money in the careers of Obama and Blagojevich.

It’s an unfolding, seemingly local political story that’s fascinating in its revealing details about the subterranean world of business, financial and family connections in Illinois and Chicago politics that helped take a virtually unknown black Chicago attorney, nurtured him politically and financially and turned him into…. the polished candidate who today thrills crowds of thousands across the country with his eloquence.

Obama currently leads in delegates for the Democratic nomination for president.

This tale is long by Ticket standards. We’ll do this rarely. But for those interested in delving into details it provides important background about the early political connections of a little-known newcomer to the national political scene.

This story concerns two men, neither of whom face any legal charges today. They are two of Illinois’ top Democratic politicians — Gov. Blagojevich, who’s been mentioned often in court, and Sen. Obama, who’s received only passing mentions. They’re entwined in the Rezko saga, particularly through the bounteous campaign money he raised for them both.

Get used to that name. Rezko’s currently in a long-running Chicago trial on federal extortion and bribery charges. Few campaign donors were more responsible than Rezko for the rise of Blagojevich (Blah-goy-ah-vitch) and Obama. Both politicians came to rely on him for political and personal advice — and lots of campaign money.
Their intimate relationship is coming into focus through Rezko, a Syrian-born businessman who made his money in real estate and restaurant franchises and now sits daily in the federal courtroom of U.S. District Judge Amy St. Eve. The trial’s daily events are covered in this Tribune Rezko court blog.

So far, Blagojevich, reelected in 2006, is more deeply enmeshed in the scandal than Obama, who’s not been implicated in any wrongdoing.

But all three operated in the murky world of Illinois Democratic politics, where money, family relationships and long business associations provide the invisible glue of the local political world.

Witnesses in Rezko’s trial have testified that Rezko recommended friends and associates for government jobs and posts on Illinois state boards when Blagojevich took office in 2003, and some of those friends were generous donors to Blagojevich.

An early trial exhibit from prosecutors was a spreadsheet. Prepared by an FBI agent , the spreadsheet identifies Rezko-related donors who supplied $1.43 million between 2001 and 2004 to Blagojevich, who was first elected governor in 2002.

Using Federal Election Commission and Illinois state records, The Times’ Dan Morain compared donors on the FBI spreadsheet to Obama’s contributors. Guess what.

Sen. Obama received $222,000 during the same 2001-2004 period from Rezko-related Blagojevich donors.

And Obama received at least another $32,000 from them for this presidential run — although Rezko, indicted in 2006, has not been involved in Obama’s current campaign.

Those Obama-Blagojevich donors include Rezko himself, along with his family members, employees and associates of his various business enterprises. There’s also the head of a major Chicago investment firm that received Illinois public teachers’ pension money to invest.

Jay Stewart, of the nonprofit government watchdog Better Government Assn. in Chicago, called the overlapping list of donors a “who’s who of the inner circle” of Democratic politics in the Land of Lincoln.

“Did they come from the same general political environment?” Stewart said of Blagojevich and Obama. “Yes. They’re Chicago pols. They both knew Tony Rezko. Tony Rezko raised money.”

In his presidential race, Obama increasingly has relied on small donations delivered via the Internet from more than a million individuals. But when he started in Illinois politics, Stewart noted, “if you wanted money, you needed to ask the big boys.”

Rezko was a big boy. He was, for instance, a link between Obama and Santa Monica developer Jay Wilton of Wilton Partners. On July 16, 2003, Wilton gave $5,000 to Obama’s first U.S. Senate run. A few days later, Wilton gave $50,000 to Blagojevich, Illinois state records show.
Unlike the federal system, Illinois state campaign finance law permits donors to give as much as they want to state candidates. So, in Illinois they do.”

This commenter was paying attention.

“this TOP OF THE TICKET Special Report on Obama & Rezko & illinois gov blagojevich is a topnotch reportage. it’s an expose, in a great way, on obama’s hidden character.

how in Christ’s name was obama able to stand–for quite a time–a drug addict like rezko, and an opportunist of a poltician like blagojevich without batting an eyelash, or, worse, without experiencing any qualm of conscience?

the answer is very obvious: obama is a “user” himself who, in his machiavellian politics, will take in anybody, just anybody, who can help him (obama) advance his political career, and push his selfish agenda.

if obama “operated” this way in the “murky world of illinois politics,” as your writer put it, then what could you expect of him to be, what do you think he’s doing now in his bid to win the democratic presidential nomination?

what’s clear by now is that obama has pulled everybody’s legs so successfully that no one, not even the reputedly “perceptive” PRESS, has noticed it. it’s pretty obvious he’s been deadpanning his posture as a self-proclaimed “agent of change.”

given this damning expose by the LOS ANGELES TIMES TOP OF THE TICKET Section, IT BEHOOVES OBAMA TO RESIGN, IN A JIFFY, HIS SENATE POST & QUIT THE DEMOCRATIC PRESIDENTIAL NOMINATING CONTEST NOW–IF ONLY FOR DELICADEZA (but really for more serious reasons). in like manner, it is incumbent upon blagojevich to resign as illinois gov.

the great american people deserve no less, even as they should demand of obama–who touts himself as a presidential candidate of impeccable character–the strictest code of conduct as a politician.

obama has been throughly vetted–and has been found wanting. it’s time for him (obama) to cut, and cut cleanly NOW!

Blagojevich retrial, Rezko Levine et al waiting sentencing, Citizen Wells open thread, August 23, 2010

Blagojevich retrial, Rezko Levine et al waiting sentencing

From the Chicago tribune, a list of Blagojevich trial potential witnesses waiting on sentencing.

“–Antoin “Tony” Rezko: Former fundraiser for Blagojevich and Barack Obama and key adviser to Blagojevich, convicted in June 2008 of fraud, money laundering and bribery for scheming to make millions of dollars by squeezing campaign contributions or kickbacks from firms seeking business with the Teachers Retirement System and Health Facilities Planning Board. On the witness list for Blagojevich’s trial, but did not testify, and is awaiting sentencing. Still faces charges of fraudulently obtaining a $10.5 million business loan.

–Stuart Levine: Millionaire attorney and longtime Republican donor. Pleaded guilty in October 2006 to fraud and money laundering in the Rezko schemes and was the government’s top witness against Rezko. Member of both the TRS and health planning boards, reappointed by Blagojevich to both. Testified that Blagojevich told him, “Stick with us and you will do very well for yourself.” Awaiting sentencing. Faced life in prison but could get 5 1/2 years for cooperating.

–William Cellini: Longtime Republican fundraiser in Springfield who did business with TRS. Was indicted with Blagojevich on charges of fraud and extortion conspiracy and attempted extortion in connection with a plan to block a Hollywood producer’s real estate investment company from getting $220 million in teachers pension money to invest unless the producer contributed to Blagojevich. Pleaded not guilty in November 2008, got his case separated from Blagojevich’s last fall and has not had a trial date set.

–Alonzo “Lon” Monk: Blagojevich’s law school roommate, gave up a career as a sports agent to join Blagojevich and was the governor’s first chief of staff and campaign manager. Pleaded guilty in October 2009 to one count of wire fraud for attempting to squeeze a racetrack owner for a $100,000 campaign contribution. Testified at Blagojevich’s trial that the two of them, Kelly and Rezko discussed ways to make money through state government connections. Has yet to be sentenced. He faced 37 to 46 months in prison but could get 24 months because he cooperated.

–John Harris: Blagojevich’s chief of staff from late 2005 until his arrest in December 2008, pleaded guilty to one count of wire fraud. Testified that Blagojevich sent word to the Obama administration that he would appoint one of the president-elect’s close friends to Obama’s vacated Senate seat if Blagojevich got a cabinet post in Washington. Has yet to be sentenced, but prosecutors have promised to urge a maximum 35-month term.

–Ali Ata: Rezko associate who pleaded guilty to lying to the FBI about Rezko’s role in getting him his job as executive director of the Illinois Finance Authority. Testified he was at a meeting in 2003 when Ata gave Rezko a $25,000 contribution for Blagojevich and the governor asked Rezko whether he’d spoken to Ata about a state job. He gave another $25,000 the following summer and Blagojevich told him the job he got should allow him to “make some money.” Awaiting sentencing. Faced 18 months in prison, but cooperation could mean even less than the 12-month minimum.

–Joseph Cari: Former Democratic National Committee finance chairman. Pleaded guilty in September 2005 to attempted extortion after telling a company seeking TRS business it had to send $750,000 to a consultant of his choice. Testified that Rezko and Kelly tried to recruit him to raise money for a Blagojevich presidential run and that the ex-governor told him governors are in a better position than senators to seek the presidency because they can hand out legal work and other contracts to contributors.”

Blagojevich trial, Obama, Ali Ata, Ata ties to Blagojevich Obama, Obama enmeshed in Chicago and Illinois corruption, Obama ties to Muslims Arabs Middle East, Obama trial?

Blagojevich trial, Obama, Ali Ata, Ata ties to Blagojevich Obama

***  Update Below  ***

You now know that Obama’s name was mentioned again during the Rod Blagojevich trial. You were advised of this earlier at Citizen Wells and Citizen News.

There are many opportunities for Obama’s name to surface during the Blagojevich trial, just as Blagojevich’s name surfaced during the Tony Rezko trial. Obama is deeply enmeshed in Chicago and Illinois corruption. There is another side of Obama, his connections and allegiance to Muslims and Arabs. Now, as Paul Harvey always said, “The rest of the story.”
Ali Ata is another name likely to surface soon as a witness. Apparently, or at least from the documentation I have read, Ata was more involved in corruption than Joseph Aramanda. Perhaps not. Ali Ata has ties to Barack Obama.
From Citizen Wells December 19, 2008.
“Why Barack Obama should be indicted
Part 9”
“Longtime Blagojevich friend Ali Ata, in a plea bargain on charges of lying to the FBI, said that he handed $25,000 to a Blagojevich fundraiser and that the governor immediately brought up the subject of getting Ata a state job.”
“Obama’s ties to Ali Ata

“The morning after the prosecution announced that Loren would testify, Hamilton dropped another bombshell by informing the judge that Jordanian-native and co-schemer, Ali Ata, the former head of the Illinois Finance Authority, had pled guilty and entered into a plea agreement and he would testify that he received the same information in 2004.”

“Maloof is one of the donors used to funnel two $10,000 contributions to Obama through bank accounts from Rezko‘s pizza businesses from the pension fund kickback. An exhibit produced for the jury shows Maloof also made a $10,000 contribution to Blagojevich.”

“As predicted, on May 1, 2008, Ata testified that he was assured there was a plan in place to remove Fitzgerald after Bush was reelected in 2004. “Mr. Rezko informed me that they had just finished meeting with Mr. Kjellander and that there will be a change in U.S. attorney’s office come the new administration,” he said.”

“Ata told the jury he delivered one $25,000 contribution to Blagojevich at Rezko’s office in the latter part of 2002, and the three men discussed the prospects of Ata getting an appointment in the administration. He said people at the office that day included Blagojevich’s campaign chief and later chief of staff, Lon Monk, Christopher Kelly, and state Representative Jay Hoffman.”

““The way Ali Ata described it, the waiting room in the North Side office of Antoin “Tony” Rezko seemed as busy as an airport terminal,” the Tribune noted on May 1, 2008.

Ata brought another $25,000 check to a fundraiser on July 25, 2003, and he was appointed to lead the Finance Authority.

Ata made a $5,000 donation to Obama less than a month earlier on June 30, 2003. Ata is also an investor in Riverside Park. Almost without fail, the people identified in the Board Games cases as investors in Riverside Park contributed to Obama’s US senate campaign.””

““The corruption in this case involves the Illinois Finance Authority. The IFA was established, “to support the Governor of Illinois’ economic development agenda,” and “IFA approves about $3 billion in project financing each year,” according to its web site.

Co-schemer Ali Ata was appointed to lead the IFA. He made a $5,000 donation to Obama on June 30, 2003.”
“Talat Othman was appointed to the IFA Board, and he donated $1,000 to Obama on June 30, 2003.

David Gustman was made chairman, and his wife, Lisa, also gave Obama $1,000 on June 30.

Co-schemer Abdelhamid Chaib is the former the director of Rezko Concessions. Chaib’s wife was appointed to the Department of Employment Security Review Board. Obama received $5,000 from Chaib on June 30, 2003.”

“As part of the scheme, Ata signed a letter on Finance Authority letterhead that falsely made it appear that Dr Paul Ray had applied for financing with the IFA for acquisition of the pizza restaurants. The letter stated that Ray’s financing would be recommended for approval by the IFA Board on March 15, 2004, and that the IFA would guarantee 50% of the total $16 million.”

“But Ata said Rezko scoffed at the concerns. “He said as far as the publicity, he will get the governor’s office to approve the transaction, and as far as the board,” Ata told the jury, Rezko said, “We put them there.”””
“”Ata is a former president of the Chicago Chapter of the American Arab Anti-Discrimination Committee. He represents “a deeper corruption” in the Arab American community, “an aspect of the story that has not received much attention,” according to a May 2, 2008 report by Ray Hanania in the Southwest News-Herald.”

“In his report, Hanania explains how Ata and others would help organize political dinners attended by Arab Americans from the suburbs at which politicians where “honored.”

“These Arab community “leaders,” he says, “would tell the community that if they bought tickets to their “candidate’s nights,” their organization fundraisers or donated through them to local politicians, these politicians would respond by giving the Arab American community empowerment.”

“In truth,” Hanania says, “these political leaders lied.”

“They did get jobs, contracts and clout,” he notes, “but the people who benefited were not members of the community but rather the relatives, children, friends and business associates of these leaders.”””

“More Obama ties to Ata and slumlords

“”The Illinois Finance Authority was established by Blagojevich in 2004. Its “role is to support the Governor of Illinois’ economic development agenda,” and “IFA approves about $3 billion in project financing each year,” according to the its site.

Rezko business associate, Ali Ata, was appointed to head the Finance Authority. He is now under indictment in a separate criminal case in which Rezko is also charged. On June 30, 2003, Ata contributed $5,000 to Obama’s US senate campaign.

On June 13, 2007, the Sun-Times reported that as a state senator, “Obama wrote letters to city and state officials supporting his political patron Tony Rezko’s successful bid to get more than $14 million from taxpayers to build apartments for senior citizens.”

“I am writing in support of the New Kenwood LLC’s proposal to build a ninety-seven unit apartment building at 48th and Cottage Grove for senior citizens,” Obama wrote in October 28, 1998 letters to both city and state housing officials. “This project will provide much needed housing for Fourth Ward citizens.””
“In the Times, Novak reported that the deal included $855,000 in development fees for Rezko and Davis, while Obama was still working at the Davis law firm, for a bid on a project that was “four blocks outside Obama’s state Senate district.”””

And this.

From the LA Times April 10, 2008

“Allies of Palestinians see a friend in Obama”

“It was a celebration of Palestinian culture — a night of music, dancing and a dash of politics. Local Arab Americans were bidding farewell to Rashid Khalidi, an internationally known scholar, critic of Israel and advocate for Palestinian rights, who was leaving town for a job in New York.

A special tribute came from Khalidi’s friend and frequent dinner companion, the young state Sen. Barack Obama. Speaking to the crowd, Obama reminisced about meals prepared by Khalidi’s wife, Mona, and conversations that had challenged his thinking.”

“Their belief is not drawn from Obama’s speeches or campaign literature, but from comments that some say Obama made in private and from his association with the Palestinian American community in his hometown of Chicago, including his presence at events where anger at Israeli and U.S. Middle East policy was freely expressed.

At Khalidi’s 2003 farewell party, for example, a young Palestinian American recited a poem accusing the Israeli government of terrorism in its treatment of Palestinians and sharply criticizing U.S. support of Israel. If Palestinians cannot secure their own land, she said, “then you will never see a day of peace.”

One speaker likened “Zionist settlers on the West Bank” to Osama bin Laden, saying both had been “blinded by ideology.””

Joseph Cari tied to Joe Biden

Cari has maintained he did not know the details of that scheme or any other.

Cari’s sentencing is delayed while he cooperates with the investigation. He testified at Rezko’s trial earlier this year, in which a jury found Rezko guilty on 16 of 24 corruption-related felony charges. Obama, who entered into a complex real estate transaction with Rezko and his wife in 2005 that appeared to aid the senator, has returned nearly $150,000 in donations he received from Rezko and his associates over the years.”

Blagojevich Trial Coverup Scandal

Part 2

Rod Blagojevich’s name was mentioned constantly during the Tony Rezko trial. The FBI was wiretaping star witness in 2004 and knew plenty of Blagojevich’s extensive involvement in the corruption. Here is just a snippet from the Rezko indictment.
“In or about early May 2004, REZKO instructed a State of Illinois employee responsible for facilitating appointments to state boards to move forward on LEVINE’s reappointment to the TRS Board, and represented that the reappointment had been approved by a high-ranking state official. The high-ranking state official subsequently directed that LEVINE be reappointed to the TRS Board. Also in or about May 2004, two new members were appointed to the TRS Board who voted with LEVINE on matters of interest to REZKO and LEVINE.”
From the Rezko trial.

“March 6, 2008; 11:50 a.m.

In her opening, prosecutor Carrie Hamilton likened Antoin “Tony” Rezko to a master puppeteer. She said he made sure that Gov. Rod Blagojevich kept Highland Park businessman Stuart Levine on the boards of the Teacher’s Retirement System and the Illinois Hospital Facilities Planning Board.

Levine, she said, was the front man, but “Rezko was the man behind the curtain pulling the strings.”

Hamilton said that Levine and Rezko worked as a team to “corrupt” the two regulatory panels, siphoning off millions of dollars in finders fees paid to investment firms seeking pension fund business. At the Teacher’s Retirement System, which invests billions of dollars in teachers pension funds, Hamilton said the pair made it clear to investment firms seeking pension fund business that “they were going to have to pay to play.””

We now know with a 100% certainty that the “high-ranking state official” is Rod Blagojevich. The feds knew it then.

These questions beg for an answer and we deserve one.
Why wasn’t Rod Blagojevich indicted soon after the Rezko trial ended in June 2008? He was wreaking havoc on the citizens of Illinois.
Why was the arrest of Blagojevich delayed until December 2008, after the 2008 elections?
Why was prosecutor Patrick Fitzgerald given this assignment by Barack Obama?
August 5, 2009
“I was preparing a new article, a more detailed version of an earlier article about Obama’s role in rigging the Illinois Health Planning Facilities Board (you know, the board mentioned in the indictments of Rezko, Levine, Weinstein, Blagojevich, et al). The events leading up to the Blagojevich trial are dragging on in typical fashion and I did not want the American public to forget about Obama’s strong ties to Chicago corruption. The Citizen Wells blog has for many months stated that Obama should be indicted next. The question was, would Patrick Fitzgerald do his duty or be controlled by the Obama camp.

Now we have the answer.

I was hoping that Patrick Fitzgerald had integrity and patriotism.

Perhaps he received, in the tradition of Chicago thuggery, an offer he couldn’t refuse.

In February 2009 we learned

“US Attorney Patrick Fitzgerald, who brought criminal fraud charges against former Illinois Gov. Rod Blagojevich, will stay on with the Obama administration, reports Pete Williams at NBC.””

“July 30,  2009, we discover

“Patrick Fitzgerald, the top prosecutor in Illinois’ Northern District, has been named interim chairman of the Attorney General’s Advisory Committee of U.S. Attorneys (AGAC).
In his new role, Fitzgerald will be the lead voice for the U.S. attorney community. It’s the latest high-profile assignment for America’s prosecutor, who has been busy overseeing the prosecution of Illinois Gov. Rod Blagojevich (D), bringing down mortgage fraudsters, and fighting with journalists.””

On December 11, 2008, the following article was posted here and faxed to the US Department of Justice office in Chicago, IL.
“From the Petition to Impeach, expel Senator Obama

Whereas: Senator Barack Obama used the office of IL Senator to facilitate the vote rigging in Chicago as chairman of the Illinois Senate Health and Human Services Committee. Mr. Obama pushed legislation in Senate Bill 1332 to reduce the number of members of the Health Facilities Planning Board from 15 to 9.

Mr. Obama did conspire with Stuart Levine, Tony Rezko and Rod Blogojevich to rig the committee and was rewarded with campaign contributions. The new members appointed included 3 doctors who contributed to Mr. Obama. On April 21, 2004, Stuart Levine explicitly advised Dr. Robert Weinstein, who is now indicted, of Tony Rezko’s role in manipulating the Planning Board’s vote.”
“Chicago Tribune Rezko Trial Transcripts
March 6, 2008; 12:29 a.m.

“Hamilton finished remarks after an hour. She did not mention the name of Democratic presidential contender Barack Obama, whose U.S. Senate campaign in 2004 allegedly was the beneficiary of $20,000 in campaign cash from intermediaries in the kickback schemes the government says were orchestrated by Rezko.”

March 10, 2008; 4:16 p.m.

“The name of Barack Obama, the Democratic front-runner for the presidential nomination, also appears in the e-mail as a member of a strategic team reviewing hospital board matters with the governor’s staff when he was a state senator. The hospital board was scheduled to be revamped in the summer of 2003.

Obama was then chairman of the Senate Committee on Health & Human Services. Other legislative leaders, including Madigan, were part of that review panel as well, according to the e-mail.”

March 13, 2008; 3:09 p.m.

“Dr. Imad Almanaseer is on the witness stand this afternoon, testifying about his links to Antoin “Tony” Rezko and his time on the Illinois Health Facilities Planning Board”.
“Almanaseer was appointed to the planning board in 2003 on Rezko’s recommendation. Prosecutors contend he became part of a five-member voting bloc on the board that followed Rezko’s wishes. Almanaseer said board Chairman Thomas Beck tried to steer his voting.”

March 19, 2008; 11:21 a.m.

“Prosecution witness Stuart Levine is walking jurors through the evolution of his relationship with defendant Tony Rezko. The two met at a dinner party shortly before the 2002 election in which Rezko’s close friend Rod Blagojevich was elected governor.”

“Levine said he met increasingly with Rezko in early 2003 after Blagojevich was sworn in as governor. On occasion, Levine said, Rezko described his close relationship with Blagojevich.

“He said that he had raised a great deal of money for Gov. Blagojevich and that he had great hopes and expectations that Gov. Blagojevich would run for president,” Levine recalled. “And although he knew it was a long shot, he was working toward that end.””

“”Mr. Rezko told me that he was able to have individuals appointed to state boards and was able to have individuals hired into state agencies and that he spoke very often — and in fact went over decisions — that Lon Monk would put into place,” Levine said.”

March 21, 2008; 12:10 p.m.

“Another government wiretap has been played with Antoin “Tony” Rezko’s voice on it, and this one could prove damaging to his defense. On the tape, recorded May 18, 2004, Rezko can be heard giving orders to political fixer Stuart Levine about how he wanted to manipulate the vote of one of Levine’s fellow members on the Illinois Health Facilities Planning board, Danalynn Rice.

On the call, Rezko is heard mentioning Chris Kelly, who with Rezko was one of the top fundraisers for Gov. Rod Blagojevich. Both Rezko and Kelly were key members of Blagojevich’s kitchen cabinet.

Rezko makes it clear in the phone call that Kelly, too, had been involved in trying to manipulate decisions of the hospital board, which Rezko has been charged with corrupting. Kelly apparently had called Levine earlier and told him he should be Rice’s mentor on the board, directing her to follow his lead on voting. Rice had been recently installed on the hospital panel at the insistence of a leader of the Laborers’ International Union, which had contributed more than $133,000 to Blagojevich’s campaign.””

Obama’s role in rigging the Health Planning Facilities Board
Evelyn Pringle, Obama Curtain Time 2
“Obama was chairman of the Senate Health & Human Services Committee in January 2003. A few articles in the media have mentioned that Obama sat on a committee that reviewed matters related to the Planning Board in conjunction with the Governor’s staff but none have discussed his integral part in getting the bill passed.

A review of senate records from January 2003 to August 2003, shows Obama played a major role as chairman of that committee, in pushing through Senate Bill 1332, that led to the “Illinois Health Facilities Planning Act,” which reduced the number of members on the Board from 15 to 9, making the votes much easier to rig.

Democratic Senator Susan Garrett sponsored the bill in the senate, and the chief co-sponsor was Republican Senator Dale Righter. These two senators were also on the Human Services Committee with Obama.

The bill was filed with the senate secretary on February 20, 2003, and assigned to Human Services Committee for review on February 27. Less than a month later, as chairman, Obama sent word that the bill should be passed on March 13, 2003.

On May 31, 2003, the House and Senate passed the bill and the only senator listed in the “yes” votes mentioned in the Board Games indictments is Obama.

Blagojevich made the effective date June 27, 2003, and the co-schemers already had the people lined up to stack the Board and rig the votes with full approval from Obama.”

We now have another reason

to question the

US Department of Justice

and

Patrick Fitzgerald

The following is included in the Second Superceding indictment of Blagojevich.

“The Illinois Health Facilities Planning Board (“Planning Board”) was a commission of the State of Illinois, established by statute, whose members were appointed by the Governor of the State of Illinois. State law required an entity seeking to build a hospital, medical office building, or other medical facility in Illinois to obtain a permit, known as a “Certificate of Need,” from the Planning Board prior to beginning construction.”

“Defendant ROD BLAGOJEVICH, Monk, and Harris, while serving as officers and employees of the State of Illinois, and Levine, while serving as a Trustee of TRS and a member of the Planning Board, were bound by the following laws, duties, policies, and procedures:
As Governor, defendant ROD BLAGOJEVICH was a constitutional officer and as such, at the outset of each term as Governor, was required to take an oath of office to support the Constitution of the  United States and the Constitution of the State of Illinois, and to faithfully discharge the duties of the office of Governor to the best of his ability.”

Indictment:
http://www.justice.gov/usao/iln/pr/chicago/2010/pr0204_02a.pdf

The following was included in the Blagojevich Criminal Complaint

“According to Levine, in approximately late October 2003, after Levine was
reappointed to the Planning Board, he shared a private plane ride from New York to Chicago
with ROD BLAGOJEVICH and Kelly. Levine, ROD BLAGOJEVICH, and Kelly were the
only passengers on the flight. According to Levine, at the beginning of the flight, Levine
thanked ROD BLAGOJEVICH for reappointing him to the Planning Board. ROD BLAGOJEVICH responded
that Levine should only talk with “Tony” [Rezko] or [Kelly]
about the Planning Board, “but you stick with us and you will do very well for yourself.”
ROD BLAGOJEVICH said this in front of Kelly. According to Levine, Levine understood
from ROD BLAGOJEVICH’s manner of speaking and words that ROD BLAGOJEVICH
did not want Levine to talk to ROD BLAGOJEVICH directly about anything to do with the
boards, but that Levine should talk to Rezko or Kelly. Levine also understood that ROD
BLAGOJEVICH meant that Levine could make a lot of money working with ROD
BLAGOJEVICH’s administration. According to Levine, ROD BLAGOJEVICH did not
seem to expect a response from Levine, and Kelly then shifted the conversation to something
else.”

“b. Corruption of the Planning Board
“As described more fully in the following paragraphs, Mercy Hospital, which
sought permission from the Planning Board to build a hospital in Illinois, received that
permission through Rezko’s exercise of his influence at the Planning Board after Rezko was
promised that Mercy Hospital would make a substantial campaign contribution to ROD
BLAGOJEVICH. Rezko later told a member of the Planning Board that Mercy Hospital
received the permit because ROD BLAGOJEVICH wanted the organization to receive the
permit.”

Levine’s criminal activities included his abuse of his position on the Planning
Board to enrich both himself and Friends of Blagojevich. The Planning Board was a
commission of the State of Illinois, established by statute, whose members were appointed
by the Governor of the State of Illinois. At the relevant time period, the Planning Board
consisted of nine individuals. State law required an entity seeking to build a hospital,
medical office building, or other medical facility in Illinois to obtain a permit, known as a
“Certificate of Need” (“CON”), from the Planning Board prior to beginning construction.”
Why was the above left out of the Indictment?

Why is this not being shouted from the rooftops?
“At the relevant time period, the Planning Board consisted of nine individuals.”

The following sentence is one of the clearest connections of Obama to the rigging
of the Planning Board. Obama was chairman of the IL Senate committee that changed
the number of members from 15 to 9.

Why was this left out of the indictment?

It is damning for Blagojevich and Obama.
Why did the US Department of Justice wait until after the 2008 elections to arrest Blagojevich?

It was damning for Obama.
Why did Obama give Patrick Fitzgerald a supervisory position in 2009?

Why is the media, including Fox, not covering this???

Blagojevich trial, May 1, 2010, Pay to play politics, Obama Blagojevich Rezko corruption cronies

“The investigation dubbed “Operation Board Games,” into the influence peddling within the cesspool of corruption that encompasses Illinois politicians from both major parties, has developed into multiple subplots, many of which feature Barack Obama.

Therefore, Obama should start bidding for the starring role in the movie that is sure to follow the criminal trials involved in this case because he has absolutely no chance of winning the White House, even if the leaders of the Democratic party allow this sorry charade to carry on and his name appears on the ballot.

The major media organizations continue to ignore a story that is destined to become the biggest political scandal of the decade, except for a bleep here and there. By now this can only mean one of two things. They are either unwilling to commit the manpower necessary to connect the dots of all the subplots or they know the Republicans will supply the goods free of charge the minute Obama becomes the nominee.”…Journalist Evelyn Pringle, April 21, 2008

The Democrats, Republicans and Mainstream Media allowed Barack Obama to slip through the 2008 election cycle without being vetted, without being adequately challenged.

Why?

Some or all of the following words apply:

Corruption

Status quo

Stupidity

Conspiracy

Party politics over country

From Evelyn Pringle at The Real Obama, April 21, 2008.

“This two-part article is the last article in a 3-part series. The first two, Barack Obama — Wizard of Oz and Barack Obama — Operation Board Games for Slumlords, cover Obama’s rise to fame in the political mafia of Illinois, bankrolled by the now infamous Syrian-born influence peddler, Antoin “Tony” Rezko.

They also give the details of Obama’s involvement in a slumlord business largely operating out of the Chicago-based Davis, Miner & Barnhill law firm, which hired Obama in 1993, with his boss, Allison Davis, reaping in the profits with Rezko‘s development company, Rezmar.

The “Board Games For Slumlord” article gives in-depth details of the federal investigation along with the names of people who are listed as “Co-Schemers” and “Individuals” in the indictments issued thus far. Therefore for the most part, this article will refer to all the scams collectively as what prosecutors refer to as “pay-to-play” schemes.

The mainstream media continues to refer to the corruption trial currently taking place in a Federal courthouse in Chicago as the Rezko case, never mentioning the fact that Rezko is sitting in the courtroom alone at the defendant’s table only because many of the co-defendants have already pleaded guilty, or have not been indicted yet.

Some of the people listed in the indictments as co-schemers and individuals include William Cellini, a long-standing Republican powerbroker in Illinois, and Robert Kjellander, treasurer for the Republican National Committee.

In the April 3, 2008 Chicago Sun-Times, Mark Brown wrote: “For more than three decades, William Cellini has been the unseen hand pulling the strings of Illinois government, adroitly manipulating it to his purpose.”

“That purpose,” Brown noted, “was mainly to make himself rich — through lobbying fees and insider contracts, government loans and leases for his real estate developments, and finally the coup de grace, his own riverboat casino company.”

Cellini was a co-founder of Commonwealth Realty Advisors, “a firm that has received hundreds of millions of dollars in pension funds to invest on behalf of retired state employees and teachers,” according to a report by Rick Pearson in the April 6, 2008 Chicago Tribune.

The Feds have several incriminating taped conversations between Cellini and the co-schemers and after hearing the tapes, Sun-Time reporter, Mark Brown wrote:

“That Cellini would slip up and allow himself to be caught on a federal wiretap is nothing short of a miracle to those of us who have marveled at his career and attempted to expose his deals where we could — mostly in vain and always too late to foil him.””

“Rezko is widely known to be a bipartisan influence peddler. During his opening statement, Rezko’s lead defense attorney, Joseph Duffy, told the jury that Rezko raised money for Democrats and Republicans alike, such as former Cook County Board President, John Stroger, and Representative Luis Gutierrez, Democrats, and former Governor Jim Edgar, a Republican, along with current Governor Rod Blagojevich and Obama, both Democrats.

Duffy told the jurors that Rezko “met Barack Obama when he was in Harvard Law School and tried to hire him” to be the lawyer for his development company. During 2003 and 2004, he said, Rezko helped organize fundraisers for both President Bush and Obama

Persons who have avoided trial in the Board Games case by pleading guilty to corruption charges include the government’s star witness, Stuart Levine, a Chicago businessman who had been a major fundraiser for Republicans in Illinois for decades, including Bush.

Levine was the first defendant nailed in the Board Games investigation. The FBI confronted him four years ago on May 20, 2004, and although he was cooperating with the Feds for some time, he did not enter an official guilty plea until October 2006.

Defendants who pleaded guilty as early as September 2005, include Chicago attorney, Steve Loren, a lawyer for the teacher’s retirement pension fund, Joseph Cari, an attorney and former finance chairman for the national Democratic National Committee, and Jacob Kiferbaum, owner of a Chicago area construction company.”

“The first indictment alleged that Rezko participated in a scheme to obtain millions of dollars by shaking down firms doing business before two Illinois regulatory boards, the Teachers Retirement System (TRS) and the Hospital Facilities Planning Board, on which Levine served. In the press release, Fitzgerald stated:

“This indictment describes a frenzy of corrupt scheming, particularly in April and May 2004, in which political insiders sought to manipulate the activities of two state boards to fleece investment firms and individuals. The defendants and their associates put the word out loud and clear: you have to pay to play in Illinois.””

“Allison Davis, Obama’s boss at the law firm, is also listed in legal documents as playing a part in setting up a major extortion attempt in the Board Games case.”

“The first two articles in this series reported that Blagojevich was supposed to be the candidate for President, not Obama. That assertion was based on testimony in the trial by the government’s star witness, Stuart Levine, about conversations he had with Rezko.

That one of the main goals of the “pay-to-play” schemes was to raise money for a presidential run by Blagojevich was collaborated by testimony on April 15, 2008, by Joseph Cari.

He told the jury about a conversation he had with Blagojevich himself in 2003, in which Blagojevich told him that it would be easer for him to raise money then a senator because now that he was governor, Blagojevich had the power to hand out contracts and state business to people who contributed to his campaign.”

“Obama’s political career was bankrolled by the same gang that planned to make Blagojevich president. For instance, Fortunee Massuda, another participant identified in the “pay-to-play” schemes, contributed $25,000 to Blagojevich compared to $2,000 to Obama. Michel Malek, another participant, threw $25,000 to Blagojevich and $10,500 to Obama.

Ali Ata, another guy listed as a co-schemer in one indictment, was made executive director of the Illinois Finance Authority, and he contributed $25,000 to Blagojevich and $5,000 to Obama.

Jay Wilton, identified by prosecutors as a major contributor to Blagojevich, is the owner of Wilton Partners, a construction company in California. He donated $50,000 to Blagojevich shortly after his firm cinched an $83 million contract with the state to refurbish the Illinois tollway’s oasis rest stops. Wilton also gave $5,000 to Obama.

Joe Cari donated $15,000 to Blagojevich but only gave $1,335 to Obama.

A trial exhibit produced by an FBI agent, identifies major contributors who donated $1.43 million to Blagojevich between 2001 and 2004. The Chicago Sun-Times compared the exhibit to government campaign records on Obama and found he received more than $220,000 from many of the same donors between 2001 and 2004.

John Rogers, the head of Ariel Capital, an investment firm that ended up with major money from the pension funds, is on the FBI’s summary of Blagojevich’s top contributors. He also gave Obama $25,000.”

“Daniel Mahru, a major player in the Chicago slumlord racket, has reportedly flipped in the Board Games case and is cooperating with the prosecution. He is the owner of Automatic Ice Company, which donated $10,000 to Blagojevich. Mahru gave $5,000 to Obama.

Attorney, Jack Carriglio, contributed $25,000 to Blagojevich and was appointed to the TRS Board. He also gave $1000 to Obama.

After Rezko’s indictment was unsealed in October 2006, the first report in the Chicago Tribune noted, “Obama donated $11,500 to charity — a total that represents what Rezko contributed to the senator’s federal campaign fund.”

That statement intentionally leads readers to believe that Obama donated all campaign contributions from Rezko to charity, which is so far from the truth that it’s laughable.

On November 5, 2006, the Tribune reported that, Obama said Rezko raised as much as $60,000 for him during his political career. The next day, the Sun-Times quoted Obama as saying: “I did however donate campaign contributions from Rezko to charity.”

The Obama camp stuck with the $50,000 or $60,000 story for nearly a year until Obama’s March 14, 2008 interviews with the Chicago Sun-Times and Tribune and the team of reporters pinned him down and the amount added up to $250,000.”

“A podiatrist, Fortunee Massuda, selected to a serve “on a powerful state health-care oversight panel is a partner in a real estate venture with a top Blagojevich fundraiser and counselor who recommended her appointment,” the report stated.

Massuda’s connection to Antoin Rezko, the Blagojevich fundraiser and adviser, was not publicly disclosed when the governor appointed her to the Health Facilities Planning Board on August 12, 2003, the Times pointed out.

The report also noted that Massuda was one of “several members” appointed by Blagojevich to sit on the board, “after the governor won legislative approval” to overhaul its membership. That would be the “legislative approval” that Obama signed off on.”

“And let there be no doubt, Obama is a member of this corrupt gang. On January 22, 2007 ABC News in Chicago announced that Senator Obama “is supporting Mayor Daley’s re-election bid despite a series of City Hall corruption scandals.”

Mayor Daley endorsed Obama for president a few weeks ago and the mayor’s brother Bill is now an Obama advisor, the report noted.

“So in the spirit of political payback, Obama is endorsing Daley for re-election over two African American challengers despite a series of City Hall corruption scandals that Obama called deeply troubling as recently as a few months ago.”

ABC reported that Obama said, “Daley’s overall record, his style of inclusion and his love of Chicago make him a better choice than challengers.”

Obama also endorsed Daley’s running mates for City Clerk, Miguel Del Valle, and Stepanie Neeley, for Treasurer, ABC News added. It should be noted, that the last City Clerk just got out of prison after being convicted in the Hired Truck scandal, and has written a book about the corruption in the Daley administration.

Five months after Obama publicly endorsed Daley, a report by David Jackson and John McCormick in the June 12, 2007 Tribune noted that:

“Obama endorsed former Ald. Dorothy Tillman (3rd), calling her “a very early supporter of my campaign.” Tillman was then under fire for her stewardship of the scandal-plagued Harold Washington Cultural Center, where contracts benefited members of her family.

“Obama supported the re-election of Gov. Rod Blagojevich, whose administration is embroiled in corruption probes.”

And during the race for Cook County Board president, Obama predictably endorsed Todd Stroger over a Republican and was criticized for calling Stroger “a good progressive” despite allegations of job-rigging to favor members of Stroger’s 8th Ward organization,” according to the report.

On September 5, 2007, the New York Post reported that: “A man who has long been dogged by charges that the bank his family owns helped finance a Chicago crime figure will host a Windy City fund-raiser tonight for Senator Barack Obama.”

Alex Giannoulias became Illinois state treasurer last year after Obama vouched for him, has pledged to raise $100,000 for the senator’s Oval Office bid, the Post noted.”

The information about Barack Obama, easily available on the internet early in 2008, would have prevented any other candidate running for office in this country from moving forward. Why was Obama allowed to escape this scrutiny. What entities made this possible?

If the trial of Rod Blagojevich does not display this rampant corruption before the world, we have a very serious problem.

Rod Blagojevich, the Obama camp and the mainstream media have done such an Orwellian job of misrepresenting what the Blagojevich trial is about and who is involved in the corruption, that I decided, as a public service, to present a primer to fill in the gaps (gaping chasms). This information will be presented on a regular basis up to, and during, if necessary, the trial, which begins June 3, 2010. Additional insights may be gained by searching the archives of this blog.

Remember, during the Rezko trial, Blagojevich had not been indicted, but his name began surfacing.

The recently released Evidentiary Proffer Mentions Obama’s name multiple times.

Blagojevich trial, Update, Tony Rezko, Obama subpoena, Obama Rezko ties, Where is Tony Rezko?, Recent Rezko interviews with government

Blagojevich trial, Update, Tony Rezko, Obama subpoena, Obama Rezko ties

Where is Tony Rezko, convicted crime buddy of Blagojevich and Obama?

From the Washington Examiner.

“Where in the world is Tony Rezko?”

“Why is Antoin “Tony” Rezko under lock and key at an undisclosed location, like some sort of CIA-renditioned al Qaeda operative? And why hasn’t he been sentenced yet?

As the June 3 corruption trial of former Illinois Governor Rod Blagojevich for allegedly trying to sell Obama’s former Illinois Senate seat approaches, the whereabouts of the former Blago and Obama fundraiser is literally a state secret.

The Chicago Sun-Times reported that Rezko was moved from Chicago’s downtown Metropolitan Correctional Center on December 16th, even though it’s right across the street from the federal courthouse where Blago will be tried.

Rezko’s not listed on the federal Bureau of Prisons’ inmate locator, either.

“Nobody knows where he is,” a source in Chicago told The Examiner.

The other big question: Why hasn’t Rezko been sentenced yet? It’s been almost two years since the Chicago restaurant and real estate developer was convicted on bribery, fraud and money laundering charges.

After months of unexplained delays, Rezko’s January 6th sentencing date was canceled again – this time indefinitely – by U.S. District Court Judge Amy St. Eve, a former Whitewater prosecutor. Reporters were initially told that Rezko was cooperating with prosecutors, but he apparently stopped talking and demanded to be sentenced as soon as possible. That request was obviously denied.”

From the recent motion to subpoena Barack Obama from the Blagojevich defense team we know this.

“22. However, the defense has a good faith belief that Mr. Rezko, President Obama’s
former friend, fund-raiser, and neighbor told the FBI and the United States Attorneys
a different story about President Obama. In a recent in camera proceeding, the
government tendered a three paragraph letter indicating that Rezko “has stated
in interviews with the government that he engaged in election law violations by
personally contributing a large sum of cash to the campaign of a public official
who is not Rod Blagojevich. … Further, the public official denies being aware of
cash contributions to his campaign by Rezko or others and denies having
conversations with Rezko related to cash contributions. … Rezko has also stated
in interviews with the government that he believed he transmitted a quid pro quo
offer from a lobbyist to the public official, whereby the lobbyist would hold a
fundraiser for the official in exchange for favorable official action, but that the
public official rejected the offer. The public official denies any such
conversation. In addition, Rezko has stated to the government that he and the
public official had certain conversations about gaming legislation and
administration, which the public official denies having had.”10

10 The defense has a good faith belief that this public official is Barack Obama. See, “Obama on Rezko deal: It
was a mistake”, Dave McKinney, Chris Fusco, and Mark Brown, Chicago Sun Times, November 5, 2006. Senator
Barack Obama was asked: “Did Rezko or his companies ever solicit your support on any matter involving state or
federal government? Did Al Johnson, who was trying to get a casino license along with Tony Rezko, or Rezko
himself ever discuss casino matters with you?” Senator Obama answered: “No, I have never been asked to do
anything to advance his business interest. In 1999, when I was a State Senator, I opposed legislation to bring a
casino to Rosemont and allow casino gambling at docked riverboats which news reports said Al Johnson and Tony
Rezko were interested in being part of. I never discussed a casino license with either of them. I was a vocal
opponent of the legislation.” Obama’s involvement with Tony Rezko and this legislation coincides with the
three paragraph summary the government has provided to the defense referenced above.”

Apparently Tony Rezko is talking. And don’t forget, there are plenty more of Blagojevich’s and Obama’s cronies who may talk to get a lighter sentence. Stuart Levine has talked plenty already.

Yesterday we learned of the Blagojevich defense team filing a motion to subpoena Barack Obama for the Rod Blagojevich trial. Later in the day we discovered that redacted segments of the motion had been made available. There is some interesting material that was redacted. The part that caught my eye was references to Obama andRezko discussions that Obama has denied.

From the Tony Rezko trial in 2008.

April 15, 2008

“Democratic presidential contender Barack Obama’s name came up again at the Antoin “Tony” Rezko corruption trial Monday.”

“Here’s the back story. Rezko, of course, was a longtime political fundraiser for both Obama and Blagojevich, though the corruption charges Rezko is now facing involve his role as an influential adviser to the governor. Prosecution star witness Stuart Levine testified that he attended a party in Rezko’s Wilmette house in April 2004 for Nadhmi Auchi, a controversial British billionaire.

Rezko was trolling for investment capital for a South Loop development, and the party was part of his campaign to get Auchi to invest. Levine said guests at the party included Obama and his wife.”

From the Blagojevich trial proffer recently released by judge James Zagel.

Illinois Health Facilities Planning Board Kickback
The Illinois Health Facilities Planning Board (the “Planning Board”) is a commission of the
State of Illinois, established by statute, whose members are appointed by the Governor of the State
of Illinois. During the relevant time period, the Planning Board consisted of nine individuals. State
law required an entity seeking to build a hospital, medical office building, or other medical facility
in Illinois to obtain a permit, known as a “Certificate of Need” (“CON”), from the Planning Board
prior to beginning construction.
Rezko was able to obtain significant influence over the affairs of the Planning Board by
arranging for Blagojevich to appoint five of Rezko’s associates and/or friends, including Levine, as
members of the Planning Board in 2003. Rezko and Levine subsequently agreed to use their
influence over the Planning Board to obtain a kickback of at least $1 million from a contractor,
Jacob Kiferbaum, who wanted the Planning Board to award Mercy Hospital a CON to build a new
hospital. Rezko and Levine were able to arrange for Mercy Hospital to receive its CON at the April
2004 Planning Board meeting, but their scheme was interrupted by the FBI before any kickback was
paid

Control over the Planning Board
Levine was on the Planning Board when Blagojevich became governor, but his term was due
to expire in 2003. Levine sent a message to the Blagojevich administration through Cellini that he
wanted to be re-appointed. Levine later heard from both Kelly and Cellini that he would be reappointed,
and Levine was re-appointed to the Planning Board in the Fall of 2003.
After Levine was reappointed, he shared a private plane ride from New York to Chicago with
Blagojevich and Kelly. Levine, Blagojevich, and Kelly were the only passengers on the flight. At
the beginning of the flight, Levine thanked Blagojevich for reappointing him to the Planning Board.
Blagojevich responded (in Kelly’s presence) that Levine should only talk with “Tony” [Rezko] or
“Chris” [Kelly] about the board, “but you stick with us and you will do very well for yourself.”
Levine understood from Blagojevich’s manner of speaking and words that Blagojevich did not want
Levine to talk to Blagojevich directly about anything to do with the boards, but that Levine should
talk to Rezko or Kelly. Levine also understood that Blagojevich meant that Levine could make a
lot of money working with Blagojevich’s administration. Blagojevich did not seem to expect a
response from Levine, and Kelly then shifted the conversation to something else.
Around the time that Levine was reappointed, Rezko told Levine that he expected to control
the Planning Board. Rezko said that he had discussed the makeup of the Planning Board with
Thomas Beck, who was the Chairman of the Planning Board. Before one of the Planning Board
meetings, Beck talked to Levine about how there were five members of the Planning Board who
were Rezko’s people, including Levine and Beck. The other three individuals who would vote as
Rezko wished were Fortune Massuda, Imad Almanaseer, and Michel Malek. Documents and
testimony from individuals in Illinois state government who helped select candidates for boards and
commissions positions, including the Planning Board, confirm that Rezko was the individual
responsible for selecting those five individuals to be appointed to the Planning Board. Since it took
five votes to approve any CON, Rezko’s people effectively controlled what the Planning Board did.
Beck typically indicated to Levine and the other three members of Rezko’s voting bloc the items on
the Planning Board agenda that Rezko cared about and how Rezko wanted them to vote.”

How is Obama tied to this scheme?

From the Rezko trial.

March 6, 2008

Duffy mentions Levine’s close political ties to the late Mayor Harold Washington, U.S. Sen. Barack Obama (D-Ill), former Gov. Jim Edgar and U.S. Rep. Luis Gutierrez (D-Chicago) as examples of how connected Levine was.”

March 10, 2008

“Ziegelmueller asked Hayden about a 2003 e-mail exchange with Lichtenstein, then the governor’s top lawyer, in which Wilhelm made recommendations for the Illinois Health Facilities Planning Board.
The name of Barack Obama, the Democratic front-runner for the presidential nomination, also appears in the e-mail as a member of a strategic team reviewing hospital board matters with the governor’s staff when he was a state senator. The hospital board was scheduled to be revamped in the summer of 2003.

Obama was then chairman of the Senate Committee on Health & Human Services. Other legislative leaders, including Madigan, were part of that review panel as well, according to the e-mail.”

March 12, 2008

“Fast forward to July 15, 2003, when Gov. Rod Blagojevich was revamping the hospital board on which Beck held a seat for several years. Beck said he wanted to stay on the panel so he called on Rezko at his North Side office. He came armed with a $1,000 check for Blagojevich’s campaign fund. Beck said he asked Rezko to put in a good word for him and Rezko said he would see what he could do.

A few weeks later, Beck said Rezko called him with the good news that he would be reappointed to the board along with Stuart Levine and another holdover member. Rezko also said three doctor friends of his were going to be put on the revamped panel by Blagojevich, Beck testified.”
“Key to the government case are dozens of recorded wiretap conversations on three phone lines into the home of Stuart Levine, the former member of two state boards whom prosecutors say worked with Antoin “Tony” Rezko to rig decisions of those panels.

FBI Special Agent Daniel Cain, the primary case agent on the investigation into Levine and Rezko, is on the stand now in testimony that is laying the foundation for entering the wiretaps into evidence.

Cain said the investigation, dubbed Operation Board Games by the federal agents, began in December 2003 and was prompted by information gleaned from an informant whom he did not identify. That witness, he said, took part in meetings with two other individuals who were in contact with Levine by phone at his home.

Cain said Levine had three phone lines in his North Shore home. Federal agents recorded conversations on those lines April 8-May 21, 2004. Those dates span the time when Levine, Rezko and others allegedly were working to rig the hospital board vote on a Mercy Health System hospital proposal for Crystal Lake and other kickback schemes prosecutors claim they were engaged in.”

Just as Rod Blagojevich’s involvement in Chicago, IL corruption was revealed during the Tony Rezko trial, Obama’s involvement should be revealed in the Blagojevich trial.

Reported here (and much earlier), April 1, 2010.

“In the media, Obama always made it sound like he rarely saw Rezko, saying they met for breakfast or lunch once or twice a year. However, the FBI mole John Thomas helped investigators “build a record of repeat visits to the old offices of Rezko and former business partner Daniel Mahru’s Rezmar Corp., at 853 N. Elston, by Blagojevich and Obama during 2004 and 2005,“ according to the February 10, 2008 Sun-Times.

During his March 14, 2008 interview, the Times told Obama, Thomas is an FBI mole and he “recently told us that he saw you coming and going from Rezko’s office a lot.”

“And three other sources told us that you and Rezko spoke on the phone daily.””

“The rigging of the IL Health Planning Facilities Board is a major charge in the indictments of Rod Blagojevich, Tony Rezko, Stuart Levine, Robert Weinstein and others tied to Barack Obama.”

“In or about the spring of 2004, REZKO and LEVINE agreed that LEVINE, whose term on the TRS Board was due to expire in May 2004, needed to be reappointed to the TRS Board and that additional TRS Board members needed to be appointed who would cooperate with REZKO and LEVINE.”

“Obama was chairman of the Senate Health & Human Services Committee in January 2003.”
“A review of senate records from January 2003 to August 2003, shows Obama played a major role as chairman of that committee, in pushing through Senate Bill 1332, that led to the “Illinois Health Facilities Planning Act,” which reduced the number of members on the Board from 15 to 9, making the votes much easier to rig.”
“The bill was filed with the senate secretary on February 20, 2003, and assigned to Human Services Committee for review on February 27. Less than a month later, as chairman, Obama sent word that the bill should be passed on March 13, 2003.”
“On May 31, 2003, the House and Senate passed the bill and the only senator listed in the “yes” votes mentioned in the Board Games indictments is Obama.
Blagojevich made the effective date June 27, 2003, and the co-schemers already had the people lined up to stack the Board and rig the votes with full approval from Obama.”

“So far, Blagojevich, reelected in 2006, is more deeply enmeshed in the scandal than Obama, who’s not been implicated in any wrongdoing.

But all three operated in the murky world of Illinois Democratic politics, where money, family relationships and long business associations provide the invisible glue of the local political world.”
“Using Federal Election Commission and Illinois state records, The Times’ Dan Morain compared donors on the FBI spreadsheet to Obama’s contributors. Guess what.

Sen. Obama received $222,000 during the same 2001-2004 period from Rezko-related Blagojevich donors.”

“At the relevant time period, the Planning Board consisted of nine individuals.”

“Ata made a $5,000 donation to Obama less than a month earlier on June 30, 2003. Ata is also an investor in Riverside Park. Almost without fail, the people identified in the Board Games cases as investors in Riverside Park contributed to Obama’s US senate campaign.”

Reported here  December 11, 2008.

“In addition, the contributions extorted through the Planning Board scheme were for the intended presidential candidate, Blagojevich. Obama’s US senate war chest was already funded and by the time these kickbacks were paid that campaign would be over.

But Obama did end up with $20,000 from the very first kickback paid in the pension fund scheme set up through the Board of the Teacher’s Retirement System.

Elie Maloof and Joseph Aramanda, the straw donors used to funnel the contributions to Obama, also made $1,000 contributions of their own for his failed run for Congress in 2000, on the same day March 17, 2000.

In addition, Aramanda gave $500 to Obama’s senate campaign on June 30, 2003. In the summer of 2005, Aramanda’s teenage son landed a coveted intern position in Obama’s senate office in Washington.

Obama also received contributions directly from the persons appointed to the pension board for the express purpose of rigging the votes. On June 30, 2003, appointee, Jack Carriglio contributed $1,000.

The other appointee, Anthony Abboud, donated $500 to Obama on June 30, 2003, $250 on March 5, 2004, and $1,000 on June 25, 2004.

Michael Winter, who prosecutors say agreed to serve as a funnel for kickbacks paid through an investment firm in one scheme donated $3,000 to Obama on June 30, 2003.”
