Part 1

The Blagojevich arrest was delayed

Was Barack Obama the original plan for the presidency by the DNC and Chicago Machine? Rod Blagojevich envisioned himself in that office. But in a high
profile position as Governor of Illinois, with brashness by nature and a less stealthy approach to pay to play politics than Obama, the feds began investigating him in 2003 and reports soon hit the Chicago media of corruption in his administration.

The bulk of the charges in the Criminal complaint, indictment and evidentiary proffer and indeed, what the Tony Rezko trial centered around, took place from 2003 to 2005. They include much activity involving the TRS, Teacher Retirement System, Hospital construction approval, a plan to shakedown Children’s Memorial Hospital, appointments to state government such as Ali Ata to the Illinois Finance Authority and real estate transactions involving Blagojevich’s wife Patti.

One of the clearest examples of impacting the citizens of Illinois was the corruption of the TRS.

2003: “Of the five funds, the one in the sorriest shape is the Illinois Teacher Retirement System, which provides the pensions for suburban and downstate
teachers. Its ratio of assets to liabilities stood at a mere 52 percent last year, so poor that it was considered among the five worst-funded plans in the
country.”  Chicago Magazine March 23, 2011

“Rezko’s partner in the Rezmar development company, Daniel Mahru, is referred to as “Individual Z” in the indictment, and according to court filings, Rezko told Mahru that “$500 million” of TRS money was earmarked for their company. Mahru is reportedly cooperating with federal investigators.”

“In addition to lining their own pockets, the money gained through the scheme was funneled to the campaigns of Blagojevich and Obama. Prosecutors have identified two $10,000 payments that were made to Obama’s US Senate campaign through straw donors Joseph Aramanda and Elie Maloof, which originated from a kickback paid by investment firm, Glencoe Capital, to secure approval for a $50 million deal. Hospitals:

“The brief conversation was between Levine and Rezko on April 24, 2004, just three days after Levine said he and Rezko had rigged a vote of a state hospital
planning board to approve a controversial hospital in Crystal Lake. Hospital contractor Jacob Kiferbaum was going to pay Levine and Rezko $1 million in
bribes if the Crystal Lake facility won approval, Levine has testified.

Levine testified that he called Rezko on April 24 to set up a meeting to discuss their next shakedown target: Children’s Memorial Hospital. Just minutes
before Levine called Rezko, Levine had hung up with a money manager from the investment banking firm Bear Stearns named Nicholas Hurtgen, who prosecutors say was a confederate in past Levine kickback schemes.” Rezko trial, March 21, 2008 

So, why would the prosecution of Blagojevich be delayed despite the fact that he profoundly affected the citizens and state of IL?

  • Obama had a clear role in the rigging of the health planning board.
  • Obama played a role in cronyism affecting the TRS, Teacher Retirement System.
  • Obama had long time and regular associations with Tony Rezko and was as Blagojevich stated in a wiretap “more tony’d up than me.”
  • A blagojevich trial before the 2008 elections would have stopped Obama. Tony Rezko would not talk about Obama, Blagojevich did and would.

The following facts make the argument that Rod Blagojevich should have been arrested long before December 8, 2008 and before Tony Rezko.

  • Blagojevich began scheming as soon as he entered office. From the Blagojevich arrest press release. “The charges include historical allegations that Blagojevich and Harris schemed with others – including previously convicted defendants Antoin Rezko, Stuart Levine, Ali Ata and others – since becoming governor in 2002 to obtain and attempt to obtain financial benefits for himself, his family and third parties, including his campaign committee, Friends of Blagojevich, in exchange for appointments to state boards and commissions, state employment, state contracts and access to state funds.”
  • Pamela Meyer Davis began wearing a secret FBI wiretap  in late 2003 to record conversations involving state health planning board.
  • Most of the corruption in the Tony Rezko, Stuart Levine and Rod Blagojevich indictments took place between 2003 and 2005. Counts 1, 2 and 4 in the Blagojevich Indictment were eventualy dropped. Those counts covered that time period and represented approximately half of the indictment.
  • “FBI Special Agent Daniel Cain, the primary case agent on the investigation into Levine and Rezko, is on the stand now in testimony that is laying the foundation for entering the wiretaps into evidence. Cain said the investigation, dubbed Operation Board Games by the federal agents, began in December 2003 and was prompted by information gleaned from an informant whom he did not identify. That witness, he said, took part in meetings with two other individuals who were in contact with Levine by phone at his home. Cain said Levine had three phone lines in his North Shore home. Federal agents recorded conversations on those lines April 8-May 21, 2004. Those dates span the time when Levine, Rezko and others allegedly were working to rig the hospital board vote on a Mercy Health System hospital proposal for Crystal Lake and other kickback schemes prosecutors claim they were engaged in.” Rezko trial March 12, 2008
  • June 7, 2004: Stuart Levine, member of the Illinois Health Facilities Planning Board, abruptly resigns. This is the first indication that the Blagojevich administration is under federal criminal investigation.
  •  July 2, 2004: Stuart Levine resigns from the state Teachers’ Retirement System board.
  •  May 9, 2005: Stuart Levine indicted on corruption charges. Federal subpoena issued to Tony Rezko.
  •  Sept. 15, 2005: Joseph Cari, former lawyer for the state’s teacher’s pension board pleads guilty to extortion. A high ranking public official is described in court documents only as “Public official A.”
  •  Oct. 25, 2005: The Chicago Tribune reports about a federal grand jury investigation into the alleged political hiring practices of the Blagojevich administration.
  •  Aug. 5, 2006: The Chicago Tribune reports that Stuart Levine is cooperating with the federal investigation of state government.
  • Sometime  between May 9, 2005 and August 5, 2006, Levine has begun cooperating with the feds. Levine knows almost as much as Rezko and becomes the key witness in the Rezko trial and other prosecutions. The Feds know plenty about Blagojevich at this point.
  •  Oct. 11, 2006: Tony Rezko is indicted on federal charges he sought millions of dollars in kickbacks and campaign donations from firms seeking state business.
  • So far everything seems normal and makes sense.  The next move should be to indict Blagojevich. Blagojevich, the governor, versus Rezko, the businessman, has the power to corrupt state government, has been doing so and thanks to Levine, the Feds know the details. If you have any doubts about this, read the transcripts of the Rezko trial. For example: “Gov. Rod Blagojevich has avoided answering questions about the corruption trial of Antoin “Tony” Rezko, the other day declaring, “I’m not in that case.” But Blagojevich’s name has been mentioned often. It was brought up at least 30 times Wednesday morning by Stuart Levine, the government’s star witness against Rezko. Rezko trial March 19, 2008.
  • Patrick Fitzgerald and the feds wait over 2 years, until December 9, 2008 to arrest Blagojevich and then state they are trying to protect the citizens of Illinois. From the Government’s Sentencing Memorandum, signed by Patrick Fitzgerald and filed on November 30, 2011: “By way of comparison, Antoin Rezko,…received a sentence of 126 months imprisonment for corrupt activity that he engaged in directly with Blagojevich or with Blagojevich’s tacit approval. Yet, Rezko:(a) held no elected office of trust;”
  • Oct. 22, 2006: Obama publicly states he is considering a run for the Presidency.
  • Oct. 27, 2006: Stuart Levine pleads guilty in a scheme to squeeze millions of dollars from firms seeking state business. Court papers contain  allegations that Rezko and  Christopher Kelly were using their influence for corrupt purposes.
  • November 7, 2006 USA Today reports: “Despite scandal, Gov. Blagojevich wins re-election in Illinois” “U.S. Attorney Patrick Fitzgerald has said he is investigating “very serious” allegations of hiring fraud at multiple agencies under Blagojevich.”

  • January 16, 2007:”Judicial Watch filed an open records lawsuit against the office of Governor Rod Blagojevich (D-IL), who is under federal investigation on several fronts, including corrupt hiring practices.   • October 28, 2007 the Chicago Tribune reports: “Removing a governor” “The public disappointment in Rod Blagojevich, whose tenure follows the corrupt regime of George Ryan, should launch a public debate: Do the people of this state want a way to say to their politicians, “You are serving your interests, not ours.   • May 2, 2008 a governor recall initiative was narrowly defeated. “State government is hemorrhaging with scandal and corruption,”  Sen. Dan Cronin, sponsor.
  • June 4, 2008 Tony Rezko convicted on 16 of 24 counts. Counts 1, 11, 12, 14, 15 were related to Mercy Hospital and the rigging of the Planning Board.
  • Dec. 9, 2008 Blagojevich is arrested. “Fitzgerald said, “We make no allegations” that Obama was aware of any alleged scheming by Blagojevich.”
  • Jan. 9, 2009 IL House votes 114 to 1 to impeach Blagojevich.
  •  Jan 29, 2009 IL Senate removes Blagojevich from office.

Having read the above, forget for a moment the supposition that Patrick Fitzgerald and the US Justice Department were protecting Obama and ask the simple question:

Why was Blagojevich left in office until December 2008?

Good question, eh?

Some truths are ageless and I often quote Shakespeare.

For example:

“The lady doth protest too much, methinks.”

Patrick Fitzgerald stated after the Blagojevich arrest:

“The complaint makes no allegations about the president-elect whatsoever.”

“We make no allegations that he’s aware of anything.”

“But we ask that the press, in particular, recognize that we are not casting aspirsions on people other than the two people we charged and bear that in mind and be responsible.”

Fitzgerald admits that the crime spree had been going on for years.

“I just think it’s very, very disturbing that we have these pay-to-play allegations going on for years.”

Yes, disturbing.

And I would add, criminal.

I stand by earlier statements that the selling of the senate seat was a well crafted diversion. The facts presented above and in coming articles will make this intuitively obvious.

Just as Obama’s unwise “house of sand” economy has collapsed, symbolically, the sand sculpture bust of  Obama has been damaged by the water and wind.

“A torrential downpour that struck Charlotte Saturday afternoon damaged the Mount Rushmore-style sand sculpture bust of President Obama — an ominous beginning to what many fear is a plagued convention.

Workers were trying Saturday afternoon to reform the base of the sculpture, built from sand brought in from Myrtle Beach, S.C., pounding and smoothing out the sand that had washed off the facade of the waist-up rendering of the chief executive.

The sand sculpture was protected from above, and Mr. Obama’s face didn’t see too much damage. But the storm was so strong that its heavy winds blew the rain sideways, pelting the president’s right side and leaving the sand pockmarked and completely erasing his right elbow.

Democrats’ choice of Charlotte has drawn criticism from unions who don’t like North Carolina’s labor laws, and the state seems to be tilting away from Democrats politically.

The large Rushmore-style sculpture drew comparisons to Mr. Obama’s 2008 convention in Denver, when he accepted his party’s nomination on a stage that looked like a Greek temple.”

Deja vu for Obama Democrat Convention.

The Obama camp and mainstream media, in conjuction with the US Justice Department, spared Obama from more embarrassing questions about his ties to Chicago pay to play corruption with the delay of the arrest of Rod Blagojevich until after the 2008 election. This time around, the appeal process for Blagojevich has been delayed.

“You have read it here at Citizen Wells for some time. The delays in prosecuting Rod Blagojevich were designed to protect Obama. You also read here that the appeal process for Blagojevich would drag on past the election. We now have more proof.”

“It’s been almost eight months since Blagojevich was sentenced on Dec. 7, 2011. His attorneys discussed how they’d appeal six days after that.

“Well there’s a tremendous amount of work to do now, we need to read through all the transcripts,” defense attorney Lauren Kaeseberg said. “There’s two trials, there’s a significant amount of work.”

“But FOX Chicago News learned that since then, that first key step toward an appeal – getting the 16,000 pages of transcripts – has not yet been accomplished.

“They have to file briefs. The briefs have to be based on alleged errors that occurred in the course of the trial,” Kent College of Law professor Richard Kling said. “Those errors, if they occurred, are reflected in the transcript.”

The 7th Circuit Court of Appeals recently warned Kaeseberg that she could face monetary or disciplinary sanctions if she didn’t explain why the transcripts weren’t done yet.

Kaeseberg responded by producing these emails she had sent to Judge James Zagel’s court reporter, asking for the transcripts.

Finally, about two weeks ago, the court reporter filed her own motion asking for more time, saying she had taken a leave of absence for five and half months and has been swamped with work since her return.

She has now promised to have the transcripts done by late September, with any appellate review not likely for months after then.”

As you can see, appeals cases transcripts are expected to be produced in a timely fashion. There are numerous clearly defined rules for processing them. The responsibilities and contingencies are well covered.
So why is this possibly a perfect Chicago crime?

First of all, without a doubt, this protects Obama again during an election cycle. News from a Blagojevich appeal stays out of the media as does Blagojevich himself.

Secondly, this is another nail in the coffin of judicial misconduct during the Blagojevich prosecutions and another reason for an appeals court judge to throw out the convictions.

I recently issued a request for citizen journalists to assist in researching an important story that is playing out before us in real time.

The Rod Blagojevich appeal process has been delayed in direct contradiction to US Court rules and guidelines. The court reporter for Judge James Zagel, the person responsible for producing trial transcripts needed for the appeal, took a 5 and 1/2 month leave of absence and now has filed a request for an extension. She now claims to have the transcripts ready by late September.

Read the guidelines for yourself. The Court Reporter has accountability, Judge James Zagel has accountability and the 7th Circuit Court of Appeals has accountability.

This case impacts a former governor and current occupant of the White House.

Over the past almost 4 years I have presented compelling circumstantial evidence why Blagojevich should have been arrested much earlier and before Tony Rezko. Certainly not after the 2008 election to protect Obama.

There is so much to keep up with about Obama, some may have forgotten some details and new readers come along, so I will be presenting some information again.

In part 1 of a multi part series, I will lay out the facts in detail that support my contention. To paraphrase Dickens, it is important to know this information to understand what is happening now.

With all of the huge Obama corruption, radical ties and hidden records stories we have tried to get reported, one of the biggest scandals ever to hit this country is playing out now. It is barely being reported and mostly here.

I am calling for all citizen journalists to join in this effort. To bring this enormous chicanery to the surface & discover who is orchestrating it.

As some of you know, and predicted here in 2011, the Blagojevich appeal process is being delayed.

What is the biggest reason for the delay?

The court reporter assigned to Judge James Zagel took a 5 and 1/2 month leave of absence.

Your response might be, well things like this happen, and that is true. However, there are strict guidelines, especially when a case is being appealed.

And this case impacts a former governor and sitting occupant of the White House.

Judges are in general terms considered supervisors of court reporters, but I wanted more clarification. Eralier today I called the Court Reporter Coordinator, Brooke Wilson. I received a voice message indicating she will return next Tuesday.

My next move was to present an article on the court reporter and associated rules. However, my mind began playing connect the dots and I then began looking for connections to district court judges for the Northern District of Illinois.

Judge St. Eve presided over the Rezko and Levine trial and sentencing. She took part in the delay of sentencing of Rezko until November 22, 2011 and Levine June 28, 2012.

Judge Zagel presided over both trials of Blagojevich and made several controversial rulings and statements. He also, presumably supervises his court reporter, Blanca Lara. Regardless, he has accountability for her job performance.

Judge Kendall is presiding over the trial of FDIC lawsuit, Mutual Bank v. Mahajan . Mutual Bank loaned the Rezkos the money for the lot purchase that was sold to the Obamas. Mutual Bank also fired whistleblower Kenneth J. Conner who questioned the appraisal of the lot. The lawsuit is still active and moving slowly.

Judges Chang, Coleman, Feinerman, Lee and Tharp were appointed by Obama.

Nominated Thursday were John Lee, a partner specializing in commercial litigation at Freeborn & Peters law firm, and John Tharp, a partner at Mayer Brown and co-leader of its securities litigation and enforcement practice.

Daley was once a partner at Mayer Brown.”

“Lee began his legal career as a trial attorney in the Environmental and Natural Resources Division of the United States Department of Justice. He received his J.D. in 1992 from Harvard Law School and his A.B. in 1989 from Harvard College. He worked as an associate at Mayer Brown from 1994 to 1996 and at Grippo & Elden from 1996 to 1999. He’s currently a partner at Freeborn & Peters.

Tharp served in the United States Marine Corps for five years before earning law degrees at Northwestern University and Duke University. He worked in private practice at Kirkland & Ellis from 1991 to 1992 and is currently partner at Mayer Brown.”

It’s been almost eight months since Blagojevich was sentenced on Dec. 7, 2011. His attorneys discussed how they’d appeal six days after that.

“Well there’s a tremendous amount of work to do now, we need to read through all the transcripts,” defense attorney Lauren Kaeseberg said. “There’s two trials, there’s a significant amount of work.”

“But FOX Chicago News learned that since then, that first key step toward an appeal – getting the 16,000 pages of transcripts – has not yet been accomplished.

“They have to file briefs. The briefs have to be based on alleged errors that occurred in the course of the trial,” Kent College of Law professor Richard Kling said. “Those errors, if they occurred, are reflected in the transcript.”

The 7th Circuit Court of Appeals recently warned Kaeseberg that she could face monetary or disciplinary sanctions if she didn’t explain why the transcripts weren’t done yet.

Kaeseberg responded by producing these emails she had sent to Judge James Zagel’s court reporter, asking for the transcripts.

Finally, about two weeks ago, the court reporter filed her own motion asking for more time, saying she had taken a leave of absence for five and half months and has been swamped with work since her return.

She has now promised to have the transcripts done by late September, with any appellate review not likely for months after then.”

“Defense lawyers actually faced possible sanctions because they’ve been unable to get the trial transcripts up to the appeals court to start the appeal.

What the Fox News reporter did not tell you is that there are extensive references to procedures in handling appeal case transcripts. The rules are clear.

I can tell you that, based on court rules and procedures, Judge James Zagel carries some of the blame for the delay in the transcripts.

As you can see, appeals cases transcripts are expected to be produced in a timely fashion. There are numerous clearly defined rules for processing them. The responsibilities and contingencies are well covered.
So why is this possibly a perfect Chicago crime?

First of all, without a doubt, this protects Obama again during an election cycle. News from a Blagojevich appeal stays out of the media as does Blagojevich himself.

Secondly, this is another nail in the coffin of judicial misconduct during the Blagojevich prosecutions and another reason for an appeals court judge to throw out the convictions.

Who engineered these delays and who is responsible?

“Former Illinois first lady Patti Blagojevich is not happy about delays in the appeals process for her husband, convicted ex-governor Rod Blagojevich.

In an exclusive interview, she told FOX Chicago News that the situation is “incredibly frustrating.”

“I mean, my girls miss their dad, he’s missing their birthday, my daughter had her sixteenth birthday just the other day,” Patti said.

Mrs. Blagojevich said it’s been bugging her for months.

As FOX Chicago revealed Tuesday, even though Rod Blagojevich was convicted last summer and sentenced in December, the transcripts from his two trials have not yet been completed for the appellate court.

“There sure was a rush to get my husband in jail,” Blagojevich wrote to friends on Facebook, “where he now sits waiting for the long overdue transcripts.”

The former Illinois governor reported to prison in March. He’s serving time at the Englewood federal corrections facility outside Denver.

“We’ve been waiting for the transcripts to start the appeal,” Mrs. Blagojevich said. “You can’t start the appeal until your appellate lawyer can review the transcripts.”

Judge James Zagel’s court reporter filed a request for an extension of time three weeks ago. The request informed the appeals court that she had been on a five and half month personal leave of absence, and returned to a mountain of work.

Defense attorney Lauren Kaeseberg told the court that she has made numerous requests for the transcripts over the last year, without success. She even produced emails to prove it.

“For five and half months we’ve been waiting for these transcripts to appear,” Patti said. “Meanwhile, the trials have been over. the first trial’s been over for two years, the second trial’s been over a year.””

  • Obama had 17 unpaid parking tickets from his days at Harvard.
  • Obama omitted his aliases of Barry Soetoro and Barry Obama.
  • Obama admitted to drug use when he was younger and there is strong reason to believe he was still using drugs.

“Before Barack Obama was a United States senator and a presidential hopeful, he was a Harvard University law student living in Somerville who parked in bus stops and accumulated hundreds of dollars in parking tickets. And for nearly two decades those parking tickets went unpaid, until a representative of Obama’s settled all his outstanding debts with Cambridge’s Traffic, Parking and Transportation Department Jan. 26.

Obama attended Harvard Law School from 1988 to 1991. During his time at Harvard, Obama lived at 365 Broadway in Somerville, according to his parking tickets. Records from the Cambridge Traffic, Parking and Transportation office show that between Oct. 5, 1988 and Jan. 12, 1990 Obama was cited for 17 traffic violations, sometimes committing two in the same day. The abuses included parking in a resident permit area, parking in a bus stop and failing to pay the meter.

Twelve of Obama’s 17 tickets were given to him on Massachusetts Avenue.

In one eight day stretch in 1988, Obama was cited seven times for parking violations and was fined $45. Thirteen of the 17 violations occurred within one month in 1988.

Obama’s disobedience of the rules of the road earned him $140 in fines from the City of Cambridge. The tickets went unpaid for over 17 years and $260 in late fees were added to the tab. On Jan. 26, the fines and late fees were paid in full. The final tally for Obama’s parking breaches was $400, according to Cambridge Traffic, Parking and Transportation.

Obama spokeswoman Jennifer Psaki said the presidential candidate’s parking violations were not relevant.”

attached ARDC page). He is currently inactive.

b. IBAB requirements
The IBAB requires that bar admission applicants disclose whether they have
outstanding parking tickets (see attached excerpt from current application).
Obviously, in so far as the admission of Mr. Obama is concerned, the form of
the 1991 IBAB application would be controlling.

c. Outstanding parking tickets of Obama
Mr. Obama recently paid outstanding parking tickets that were unpaid at the
time of his admission to the bar (see attached news stories).

2. Legal issues
If in 1991 Mr. Obama signed an application to IBAB and denied that he owed
outstanding parking tickets, he falsified his application and gained
admission to the bar by fraud.

3. Request for relief/investigation/action
I would respectfully submit that Mr. Obama’s 1991 application should be
scrutinized to determine whether he falsified his answers and whether he
gained admission to the bar on the basis of fraudulent representations.
If the investigating authority determines that Mr. Obama’s answers were
deceptive, I believe an appropriate sanction should be imposed. It obviously
should not be a major sanction but a public reprimand or other appropriate
sanction should be imposed to protect the integrity of the admissions
process.

We already knew that Georgia is a corrupt state. We learned this during the recent handling of the Obama ballot challenges in GA by the behaviour of the Secretary of State, other election officials and the GA courts. We now have independent confirmation from a recent study of state ethics, open records and disclosure laws.

In Georgia, more than 650 government employees accepted gifts from vendors doing business with the state in 2007 and 2008, clearly violating state ethics law. The last time the state issued a penalty on a vendor was 1999.”

Nineteen states got C’s and 18 received D’s. The F’s went to Michigan, North Dakota, South Carolina, Maine, Virginia, Wyoming, South Dakota, and Georgia.

What’s behind the dismal grades? Across the board, state ethics, open records and disclosure laws lack one key feature: teeth.

Political loyalties can be a potential problem, especially since many ethics agencies are staffed by gubernatorial or legislative appointments.”

“For state judges, it’s a similar situation. Nearly all states have rules, codes, or regulations outlining recusal requirements, but again they leave it up to the judges to decide their own impartiality.

“There’s a longstanding principal that no judge should be the judge in his or her own case,” said Charlie Hall, director of communications for Justice at Stake, a national organization that promotes a fair and impartial court system. “There’s a strong sense by many that if one party asks a judge to step aside, there’s something not satisfying by the judge saying, ‘I think I can be impartial. I can make the decision.’”

Nine states don’t require judges to disclose outside assets, making it almost impossible to determine if a judge has a conflict at all. And in states where judges run for election, the potential for conflicts to arise is even greater.

“Special interests have discovered judicial elections and the money is pouring in,” Hall said.

Spending on judicial elections more than doubled in the past 20 years. From 2000 to 2009, special interests funneled about $206 million into court elections, up from about $83 million in the previous decade.”

When I first discovered the Ankeny v Daniels Appeal ruling I smelled a rat. I am smelling a much larger rat now.

When I wrote the article yesterday on the GA Obama ballot challenge ruling by Judge Michael Malihi, I based my comments on the Ankeny v Daniels Appeal decision based purely on my reading and analyzing the Indiana “judge’s” ruling. In the article I wrote several times “Was this written by a judge?” There are obvious reasons for my doing so. In one instance, I call the author a liar.

I just came across a Free Republic article posted on January 10, 2012, several weeks before the Judge Michael Malihi ruling. As is often the case at Free Republic, it is interesting and insightful.

As we all know, Minor v Happersett is binding precedent on what a natural born Citizen is, born in the country to citizen parents. My question is if the judges got it wrong in Ankeny v Daniels, why didn’t the plantiffs appeal the ruling to the Supreme Court? There seems to be no answer to this question.”

The Indiana Supreme Court is NOT where one ordinarily goes looking for precedent. But the fact that Team Obama does harp upon it, makes it worthy of some inquiry.

The lack of appeal is troubling. Could it have been a “set-up?””

“Gold standard” is a misnomer for describing the case. There are a variety of problems with it that, when itemized, turns Obots into namecallers or makes them flee. The case was appealed to the state supreme court, but it’s not clear if new arguments were presented to the higher court. Not sure this would be eligible for SCOTUS appeal. And of course the decision to appeal is up to the plaintiff who filed the case, so it should be asked of him.

This appeals decision wisely does NOT declare Obama to be a natural-born citizen. Even by its own rationale, it can’t, because to date, there has been no legal evidence Obama was born in the United States. None was presented here and the court does NOT say Obama was born in Hawaii. This decision’s opinions on NBC are nothing more than window dressing. The meat of the decision is in the first part where it dismisses the case on a procedural obstacle … failure to state a claim upon which relief can be granted, which is the state’s version of “standing.” It says the governor of Indiana can’t be held responsible for vetting presidential candidates.

Again, there are several problems and outright contradictions in the section on NBC. I’ve illustrated those before, but can do so again if need be.”

The decision contradicts itself. First it claims guidance and then admits that the decision from which it divined that guidance doesn’t actually make the same conclusion:
We note the fact that the Court in Wong Kim Ark did not actually pronounce the plaintiff a “natural born Citizen” using the Constitution?s Article II language is immaterial.
The court in Wong Kim Ark did NOT pronounce the plaintiff to be a natural-born citizen. IOW, the Supreme Court didn’t follow this so-called “guidance.” Ankeny claims that this inconvenient fact is immaterial. Why do they say this??

For all but forty-four people in our nation?s history (the forty-four Presidents), the dichotomy between who is a natural born citizen and who is a naturalized citizen under the Fourteenth Amendment is irrelevant.
They’re claiming this is irrelevant to everyone but the people who were elected president. This is sheer stupidity. The natural-born citizen requirement isn’t there for the benefit or the convenience of the electee. It’s there to ensure the best leadership for this government of the people. It’s not irrelevant to everyone else. We know this because of John Jay’s letter suggesting that it would help prevent foreign influence. The Ankeny decision does nothing to support this presumption.

The Ankeny decision cites this citation from Wong Kim Ark:

All persons born in the allegiance of the king are natural-born subjects, and all persons born in the allegiance of the United States are natural-born citizens.
This paragraph is talking about people born in the United States. It’s saying you can be born on U.S. soil and NOT be a U.S. citizen. This citation is describing a passage from Shanks v. Dupont which noted that the Treaty of 1783 said those who were natives or otherwise were either citizens OR British subjects depending on whether the parents adhered to the Crown or United States allegiance. You can’t be both. Under this citation, Obama is a British subject and NOT a U.S. citizen.

Ankeny makes this ridiculous claim about the Minor definition of NBC:

… the Court left open the issue of whether a person who is born within the United States of alien parents is considered a natural born citizen.
A) This isn’t true. Such persons were characterized as foreigners or aliens in the passage they quoted. B) Minor went on to discuss the naturalization act of 1790 which said that the children of aliens could become citizens AFTER their fathers naturalized. Further, Ankney contradicts themselves in their own footnote on this point:

Note that the Court in Minor contemplates only scenarios where both parents are either citizens or aliens, rather in the case of President Obama, whose mother was a U.S. citizen and father was a citizen of the United Kingdom.
Here it says the court contemplated situations where both parents are aliens. Note, there’s nothing cited that says they left any questions open on these children, so how do they “contemplate” something and leave a question open?? Contemplate means “to consider at length.” IOW, if they contemplated the scenario, then they addressed it, rather than left the question open.

Then Ankeny says this:

The Court in Wong Kim Ark reaffirmed Minor in that the meaning of the words “citizen of the United States” and “natural-born citizen of the United States” “must be interpreted in the light of the common law, the principles and history of which were familiarly known to the framers of the constitution.”
Minor does NOT say anything about considering anything in the light of the common law. The NBC definition is uses is from the Law of Nations, as it matches verbatim. The Law of Nations was a principle and history which were famiilarly known to the framers.

Ankeny stabs itself in the foot here:

In Minor, written only six years after the Fourteenth Amendment was ratified, the Court observed that:

The Constitution does not, in words, say who shall be natural-born citizens.
The 14th amendment IS the Constitution. IOW, the 14th amendment doesn’t say who shall be natural-born citizens. IOW, the guidance that Ankeny claims is simply NOT there.

Here’s another error. They quote Justice Story in Inglis v. Sailor’s Snug Harbor.

Also, as quoted in Wong Kim Ark, Justice Joseph Story once declared in Inglis v. Trustees of Sailors? Snug Harbor, 28 U.S. (3 Pet.) 99 (1830), that “Nothing is better settled at the common law than the doctrine that the children, even of aliens, born in a country, while the parents are resident there under the protection of the government, and owing a temporary allegiance thereto, are subjects by birth.”
That’s all well and good if we’re trying to determine who British subjects are. The person Story was talking about was born in the U.S. but he was considered to be a British subject (which would mean Obama is too, under this doctrine). This wasn’t about making someone a citizen by birth in the country.

It appears to me, that upon principles of public law as well as of the common law, he must if born a British subject, be deemed to adhere to, and retain the national allegiance of his parents, at the time of the treaty. Vattel considers the general doctrine to be, that children generally acquire the national character of their parents (Vattel, B. 1, ch. 19. sec. 212, 219); and it is certain, both by the common law and the statute law of England, that the demandant would be deemed a British subject.
Further, from the same decision, it is acknowledged in the opinion of the court, that citizenship descends from the father:

The facts disclosed in this case, then, lead irresistibly to the conclusion that it was the fixed determination of Charles Inglis the father, at the declaration of independence, to adhere to his native allegiance. And John Inglis the son must be deemed to have followed the condition of his father, and the character of a British subject attached to and fastened on him also, which he has never attempted to throw off by any act disaffirming the choice made for him by his father.
Finally, I just wanted to address a couple of the sloppy points in the Ankeny decision. They can’t seem to get the facts straight:

As to President Obama?s status, the most common argument has been waged by members of the so-called “birther” movement who suggest that the President was not born in the United States ….

The Plaintiffs in the instant case make a different legal argument based strictly on constitutional interpretation. Specifically, the crux of the Plaintiffs? argument is that “[c]ontrary to the thinking of most People on the subject, there?s a very clear distinction between a „citizen of the United States? and a „natural born Citizen,? and the difference involves having [two] parents of U.S. citizenship, owing no foreign allegiance.”
Now, Ankeny says the plaintiffs aren’t arguing place of birth, but just a few pages earlier, the court said:

Specifically, Plaintiffs appear to argue that the Governor did not comply with this duty because: (B) neither President Barack Obama nor Senator John McCain were eligible to hold the office of President because neither were “born naturally within any Article IV State of the 50 United States of America . . . .”
Okay, so which is it?? The plaintiffs are or are NOT arguing where Obama was born??? And then stuff like this is just bizarre:

The bases of the Plaintiffs? arguments come from such sources as FactCheck.org, The Rocky Mountain News, an eighteenth century treatise by Emmerich de Vattel titled “The Law of Nations,” and various citations to nineteenth century congressional debate.11

11 Plaintiffs do not provide pinpoint citations to the congressional debate quotations to which they cite.
Now, I just showed where a Supreme Court case that Ankeny cited, Inglis, quoted Vattel from The Law of Nations. They don’t seem to understand the Supreme Court has regularly used Vattel as a legal resource. Second, the “ninenteenth century congressional debate” citations were being used as the original intent of the authors of the 14th amendment. Why does this court downplay original intent?? Then the Ankeny court quotes Wong Kim Ark citing things like Dicey’s “Conflict of Laws” …. how is that okay, but not Vattel?? The Ankney court concludes with this doozy:

To the extent that these authorities conflict with the United States Supreme Court?s interpretation of what it means to be a natural born citizen, we believe that the Plaintiffs? arguments fall under the category of “conclusory, non-factual assertions or legal conclusions” that we need not accept as true when reviewing the grant of a motion to dismiss for failure to state a claim.
A) Vattel does NOT conflict with the Supreme Court’s interpretation of natural-born citizen. The ONE definition that Ankeny cited matches Law of Nations verbatim. B) This court basically just says it doesn’t have to accept the plaintiffs assertions as true, even though the Supreme Court regularly relies on such authorities as were used by the plaintiffs. This decision is simply an embarrassment to the legal profession.

Not sure if you have been exposed to the term – dictum. It is background used by a judge to then form a ruling. The appellate judges ruling is 99% dictum to reach a simple decision:

“Steve Ankeny and Bill Kruse (collectively, “Plaintiffs”), pro se, appeal the trial courts grant of a motion to dismiss filed by Mitch Daniels, in his official capacity as the Governor of the State of Indiana (“Governor”). Plaintiffs raise nine issues, which we revise and restate as whether the trial court erred by granting the motion to dismiss under Ind. Trial Rule 12(B)(6).1 We affirm. 2”

That is the entire ‘ruling’. Everything else after that is dictum. Nauseating dictum at that. And unnecessary dictum since the ruling above did not rely on any of it. It was all show to provide fodder for those who want this to stop – basically an politician or government official.

The ruling above relied on this simple rule in Indiana trial law:

“(B) How presented. Every defense, in law or fact, to a claim for relief in any pleading, whether a claim, counterclaim, cross-claim, or third-party claim, shall be asserted in the responsive pleading thereto if one is required; except that at the option of the pleader, the following defenses may be made by motion:

(6) Failure to state a claim upon which relief can be granted, which shall include failure to name the real party in interest under Rule 17; “

So it is odd that a judge who makes a ruling citing only state trial law rules would go out their way to write so much dictum that used SCOTUS rulings and other material.

We clearly have a flawed ruling in GA based on a flawed ruling in IN. It is not uncommon for lower court decisions to be reversed based on errors or misinterpretation of the law. However, the Indiana ruling was either written by a baised or incompetent judge.

Did Chief Judge Margret G. Robb read the ruling?

Judges Crone and May concurred with Judge Elaine B. Brown. Did they read it?

President Obama continues to countenance actions by his appointees that undermine the rule of law and constitutional government:

In an historic victory for Judicial Watch and an embarrassing defeat for the Obama White House, a federal court ruled on August 17, 2011 that Secret Service White House visitor logs are agency records that are subject to disclosure under the Freedom of Information Act. The Obama White House continues to fight full disclosure and has stalled the release of records by appealing the lower court decision.(Judicial Watch gave Obama a “failing grade” on transparency in testimony before Congress in 2011. (Read the testimony in full as well as additional congressional testimony during a hearing entitled “White House Transparency, Visitor Logs and Lobbyists.”))

In 2011, the Obama National Labor Relations Board sought to prevent the Seattle-based Boeing Company from opening a $750 million non-union assembly line in North Charleston, South Carolina, to manufacture its Dreamliner plane. Judicial Watch obtained documents from the National Labor Relations Board (NLRB) showing this lawsuit was politically motivated. Judicial Watch uncovered documents showing NLRB staff cheerleading for Big Labor, mouthing Marxist, anti-American slurs and showing contempt for Congress related to the agency’s lawsuit against Boeing, including email correspondence attacking members of Congress. And it starts at the top. Obama bypassed Congress and recess-appointed Craig Becker, who is connected to the AFL-CIO, the SEIU and ACORN, to the NRLB.

Obama’s corrupt Chicago dealings continued to haunt him in 2011.Obama’s real estate partner, campaign fundraiser and Obama pork recipient Antoin “Tony” Rezko was finally sentenced to jail this year as was former Illinois Governor Rod Blagojevich, who is now set to serve 14 years for attempting to sell Obama’s former Senate seat to the highest bidder. The FBI continues to withhold from Judicial Watch documents of its historic interview of then-Senator Obama about the Illinois corruption scandal. The FBI interview was conducted in December, 2008, about one month before Obama was sworn into the presidency.”

“Attorney General Eric Holder: Attorney General Eric Holder now operates the most politicized and ideological Department of Justice (DOJ) in recent history. And revelations from the Operation Fast and Furious scandal suggest that programs approved by the Holder DOJ may have resulted in the needless deaths of many, including a federal law enforcement officer.

Fast and Furious was a DOJ/Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) “gun-running” operation in which guns were sold to Mexican drug cartels and others, apparently in hopes that the guns would end up at crime scenes. This reckless insanity seems to have resulted in, among other crimes, the murder of Border Patrol Agent Brian Terry, who was killed in a shootout with Mexican criminals in December 2010. Fast and Furious guns were found at the scene of his death.

The Fast and Furious operation by itself should have resulted in Holder’s resignation, but it is the cover-up that has prompted serious calls for Holder’s ouster.

On May 3, 2011, in a House Judiciary Committee hearing chaired by Rep. Lamar Smith (R-TX), Holder testified: “I’m not sure of the exact date, but I probably heard about Fast and Furious for the first time over the last few weeks.” Newly released documents show he was receiving weekly briefings on Fast and Furious as far back as July 5, 2010. It appears Holder lied to Congress. (Judicial Watch sued the DOJ and the ATF to obtain Fast and Furious records. The Judicial Watch investigation continues.)

Unfortunately, when it comes to Holder corruption and abuse of office, Fast and Furious is just the tip of the iceberg.

On February 23, 2011, Attorney General Eric Holder announced that DOJ lawyers would no longer defend the constitutionality of Section 3 of the Defense of Marriage Act (DOMA), as applied to homosexual couples. DOMA had passed Congress by a vote of 85–14 in the Senate and a vote of 342–67 in the House. President Clinton signed the act into law on September 21, 1996.

Judicial Watch filed two Freedom of Information Act (FOIA) lawsuits against the DOJ (including one on behalf of the Family Research Council) for records related to this pro-homosexual marriage decision. This failure to defend this federal law is unprecedented and raises serious questions as to whether President Obama and Eric Holder are upholding their oaths of office and following the Constitution’s command to “take care that the laws be faithfully executed.”

The DOJ continues to stonewall the release of information regarding Supreme Court Justice Elena Kagan’s participation in Obamacare discussions when she served as Solicitor General. In addition to forcing Judicial Watch to file a lawsuit to obtain this information, Holder’s DOJ thumbed its nose at Congress by failing to release this material to the Senate Judiciary Committee during Kagan’s judicial confirmation hearing. Holder continues to personally resist requests from Judicial Watch and Congress for additional information on this controversy. Kagan’s role in these discussions is especially significant now that the U.S. Supreme Court has announced it will consider challenges to the constitutionality of Obamacare in Spring 2012.

New revelations emerged in 2011 about the DOJ’s Black Panther scandal. Judicial Watch uncovered evidence that the liberal special interest group National Association for the Advancement of Colored People (NAACP) may have had an inappropriate amount of influence on the DOJ’s decision to drop its voter intimidation lawsuit against the New Black Panther Party for Self Defense. This comes on the heels of sworn testimony that the Civil Rights Division of the Holder DOJ makes enforcement decisions based upon race.

Most recently, Judicial Watch obtained shocking documents suggesting the Holder DOJ is conspiring with scandal-ridden Project Vote (President Obama’s former employer and ACORN front) to use the National Voter Registration Act to increase welfare voter registrations. One former ACORN employee (and current Project Vote Director of Advocacy), Estelle Rogers, is even helping to vet job candidates for the Justice Department’s Voting Rights Division! (ACORN and Project Vote have a long record of voter registration fraud.)

Seeming to affirm ACORN’s hijacking of the DOJ, Holder recently said in a speech that he plans to use “the full weight” of the agency in 2012 to attack states that are enforcing laws that protect against fraud in the voting booths. This speech ended the pretense that the DOJ is independent from the Democratic National Committee and the Obama campaign – as it repeated almost verbatim the partisan arguments made by the Democratic Party against voter ID laws.

Holder must go. Pick your reason – Black Panthers, race-based decision making, abandoning the Defense of Marriage Act, Fast and Furious killings and lies, or turning the DOJ into an arm of the radicalized left – but Holder must go.”
