Citizen Wells letter and warning to Edward Snowden, Do not return to Obama Justice Department controlled US, Avoid America until Obama leaves White House, There is no justice with Obama, One North Carolinian to another

“The Party told you to reject the evidence of your eyes and ears. It was their final, most essential command. His heart sank as he thought of the enormous power arrayed against him, the ease with which any Party intellectual would overthrow him in debate, the subtle arguments which he would not be able to understand, much less answer. And yet he was in the right! They were wrong and he was right. The obvious, the silly, and the true had got to be defended. Truisms are true, hold on to that! The solid world exists, its laws do not change. Stones are hard, water is wet, objects unsupported fall towards the earth’s centre. With the feeling that he was speaking to O’Brien, and also that he was setting forth an important axiom, he wrote:

Freedom is the freedom to say that two plus two make four. If that is granted, all else follows.”…George Orwell, “1984”

Citizen Wells to Edward Snowden.

I will make this short and sweet.

As one North Carolinian to another.

Truth seeker to truth seeker.

Under no circumstances should you return to the US as long as Obama is in the White House.

It was scary enough before Obama took control of the White House and Justice Department in January 2009.

The bias in US courts of all levels in 2008 was surprising and scary.

I will not burden you with details but there are plenty on this site.

However, the fact that numerous Justice Department attorneys assisted Obama with keeping his records hidden should be enough to frighten you.

Scan this website for court and Justice Department references.

If you have any questions do not hesitate to contact me.

At your service Wells.

God bless.

“Why has Obama, since taking the White House, used Justice Department Attorneys, at taxpayer expense,  to avoid presenting a legitimate birth certificate and college records?”…Citizen Wells

“Based on my firsthand experiences, I believe the dismissal of the Black Panther case was motivated by a lawless hostility toward equal enforcement of the law. Others still within the department share my assessment. The department abetted wrongdoers and abandoned law-abiding citizens victimized by the New Black Panthers. The dismissal raises serious questions about the department’s enforcement neutrality in upcoming midterm elections and the subsequent 2012 presidential election.”…J. Christian Adams

“Why did Justice Department and White House staff yell and curse at CBS reporter Sharyl Attkisson over questions about Fast and Furious?”…Citizen Wells

Loretta Lynch, Obama’s Attorney General appointee and I have at least one thing in common.

We were living in Greensboro, NC at the same time.

Was she grounded by her roots or does she carry a grudge?

The fact that Obama chose her probably answers that question.

Here is some more insight from a speech she gave on August 13, 2014.

“U.S. Attorney Loretta Lynch For The Eastern District Of New York Delivers Remarks At The Convention On The Elimination Of Racial Discrimination”

“Mr. Chairperson, distinguished members of the committee, and representatives of civil society, it is an honor to be a part of the U.S. delegation and share some of the highlights of the Department of Justice’s efforts to eliminate racial discrimination and uphold human rights in the area of criminal justice.

Attorney General Eric Holder – and all of us at the Department of Justice who work on criminal justice issues – take seriously our obligation to protect the safety of all Americans and the security of our nation; to safeguard civil and human rights; to prevent and combat violent crime, financial fraud, and threats to the most vulnerable members of society; and to strengthen collaboration among government, law enforcement and our community partners.

As part of this mission, the department has made great progress in reforming America’s criminal justice system. Our focus is not just on the prosecution of crime, but on eradicating its root causes as well as providing support for those re-entering society after having paid their debt to it.

There is, of course, much work still to be done. Currently our country imprisons approximately 2.2 million people, disproportionately people of color. This situation is a drain on both precious resources and human capital. The Attorney General is committed to reform of this aspect of our criminal justice system.

Last August the Attorney General announced the “Smart on Crime” initiative. Under this initiative, we’re ensuring that stringent mandatory minimum sentences for certain federal drug crimes will now be reserved for the most serious criminals. This is not an abandonment of prison as a means to reduce crime, but rather a recognition that, quite often, less prison can also work to reduce crime. We’re advancing alternative programs in place of incarceration in appropriate cases. And we’re committed to providing formerly incarcerated people with fair opportunities to rejoin their communities and become productive, law-abiding citizens.

As part of this effort, the Attorney General has directed every component of the Justice Department to review proposed rules, regulations or guidance with an eye to whether they may impose collateral consequences that may prevent reintegration into society. He has called upon state leaders to do the same, with a particular focus on enacting reforms to restore voting rights to those who have served their debt to society, thus ending the chain of permanent disenfranchisement that visits many of them.

To further ensure that the elimination of discrimination is an ongoing priority, the Attorney General has created a Racial Disparities Working Group, led by the U.S. Attorney community, to identify policies that result in unwarranted disparities within criminal justice and to eliminate those disparities as quickly as possible

From the reduction of the use of solitary confinement, to the expansion of the federal clemency program, to our support for the retroactive reduction of penalties for non-violent drug offenders to the reduction in the sentencing disparity between crack and powder cocaine, we have worked to improve our criminal justice system in furtherance of our human rights treaty obligations. We look forward to the future and the opportunity to do even more.

Thank you for the opportunity to discuss these issues with you. Our next speaker is my friend and colleague, Mark Kappelhoff, of the department’s Civil Rights Division.”

Perhaps if the policies of the left, Obama, et al, were more grounded, the unemployment rate of blacks and job prospects would be better and fewer would be incarcerated.

All indications are that Lynch is just another Obama crony like Holder. Preoccupied with skin color

If I were on the senate committee scrutinizing Loretta Lynch, here are just a few of the questions or scenarios I would confront her with.

1. Why is the DOJ so preoccupied with protecting foreigners and illegal aliens over US citizens?

Reported by J. Christian Adams, former DOJ attorney, at Pajamas Media February 12, 2014.
“DOJ Argues to Court Against Rules to Prevent Foreigners From Voting”

“Justice Department lawyer Bradley Heard was in court today trying to stop Kansas from ensuring that only citizens register to vote. Kansas Secretary of State Kris Kobach, relying on a United States Supreme Court opinion of last year, asked the federal Election Assistance Commission to permit him to ensure that only citizens were registering to vote.

https://citizenwells.wordpress.com/2014/02/14/15560/

2. Do you approve of the White House and Justice Dept. harrassing reporters such as Sharyl Attkisson for simply doing their job?

“Here’s an excerpt from the interview in which she revealed the abuse to radio talk show host Laura Ingraham.
INGRAHAM: So they were literally screaming at you?
ATTKISSON: Yes. Well, the DOJ woman was just yelling at me. A guy from the White House-
INGRAHAM: Who was it?
ATTKISSON: On Friday night literally screamed at me and cussed at me-
INGRAHAM: Who was the person? Who was the person at Justice screaming?
ATTKISSON: Eric Schultz- oh, the person screaming was [DOJ spokeswoman] Tracy Schmaler. She was yelling, not screaming-
INGRAHAM: Oh, really?
ATKISSON: And the person who screamed at me was Eric Schultz at the White House.”

3.

“REPORT: DOJ NEEDED HOLDER’S SIGNATURE TO GET AP PHONE RECORDS”

“The Associated Press reported Monday that the Department of Justice had secretly seized two months worth of telephone records from reporters and editors working for the global news organization.

Needless to say, news that the DOJ had secretly obtained AP phone records has rocked the media. As it turns out, people really, really don’t like being spied on or having the feds snoop around their personal information.

This is going to take some explaining.

And it looks like it’ll take a lot more than a “low-level employee” to get U.S. Attorney General Eric Holder out of this tight spot.”

4. How about Obama using Justice Dept. attorneys at taxpayer expense to help keep his records hidden. One of those attorneys, Tony West, was rewarded with a high level DOJ job.

You were warned.

Beginning in 2008, and especially with the revelations from the Tony Rezko trial, you were warned that Obama would bring his Chicago Pay to Play Politics to Washington, DC.

It has happened. In one of the worst possible places.

The US Justice Department.

One of the latest and best examples is the promotion of Tony West in the USDOJ.

First, a little background on Tony West.

“But West didn’t have to be elected to become President Barack Obama’s assistant attorney general for the Justice Department’s Civil Division – just confirmed by the Senate. He now heads the DOJ office charged with defending the federal government in litigation. West has made a career out of handling complex legal issues in criminal and civil trials as well as during negotiations.

West, who is a part of a power family in California, has known Obama since 2004, and he was a top fundraiser for Obama during the 2008 presidential campaign. He was finance co-chair of Obama’s California campaign, where the then-senator raised a record total of $65 million.”

“USDOJ attorneys complicit with Obama.

“Here is a list of some of the US Justice Department attorneys who have assisted Obama in keeping his records hidden. Their representation of Obama is a matter of public record. This list does not include the support staffs.

5. The case against the New Black Panther Party was dismissed and whistleblower J. Christian Adams was persecuted for speaking out.

“On the day President Obama was elected, armed men wearing the black berets and jackboots of the New Black Panther Party were stationed at the entrance to a polling place in Philadelphia. They brandished a weapon and intimidated voters and poll watchers. After the election, the Justice Department brought a voter -intimidation case against the New Black Panther Party and those armed thugs. I and other Justice attorneys diligently pursued the case and obtained an entry of default after the defendants ignored the charges. Before a final judgment could be entered in May 2009, our superiors ordered us to dismiss the case.

The New Black Panther case was the simplest and most obvious violation of federal law I saw in my Justice Department career. Because of the corrupt nature of the dismissal, statements falsely characterizing the case and, most of all, indefensible orders for the career attorneys not to comply with lawful subpoenas investigating the dismissal, this month I resigned my position as a Department of Justice (DOJ) attorney.”

6. Obama and Eric Holder guilt in Fast and Furious scandal and subsequent lack of cooperation in investigations.

“The Justice Department is trying to protect its political appointees from the Fast and Furious scandal by concealing an internal “smoking gun” report and other documents that acknowledge the role top officials played in the program that allowed firearms to flow illegally into Mexico, according to the head of the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Kenneth E. Melson, the ATF’s acting director, also told congressional investigators this month that the affidavits prepared to obtain wiretaps used in the ill-fated operation were inconsistent with Justice Department officials’ public statements about the program. Justice Department officials advised him not to raise his concerns with Congress about “institutional problems” with the Fast and Furious operation, Melson said.
“It was very frustrating to all of us,” Melson told congressional investigators in a private meeting over the Fourth of July holiday, “and it appears thoroughly to us that the department is really trying to figure out a way to push the information away from their political appointees at the department.”

Not only was the department slow to react, Melson said, but Justice Department officials indicated they did not want him to cooperate with Congress.”

Loretta Lynch speaks of protecting US citizens and concern for this country.

Talk is cheap.

The bottom line questions are would she prosecute Eric Holder and Barack Obama.

Doubtful.

“‘the Framers of the Constitution intended the States to keep for themselves, as provided in the Tenth Amendment, the power to regulate elections.’”

“The Voting Rights Act sharply departs from these basic principles. It suspends “all changes to state election law—however innocuous—until they have been preclearedby federal authorities in Washington, D. C.” Id., at 202. States must beseech the Federal Government for permission to implement laws that they would otherwise have the right to enact and execute on their own”… Chief Justice Roberts, Shelby County, AL vs Holder, Attorney General, et al

“We the people are the rightful masters of both Congress and the courts, not to overthrow the Constitution but to overthrow the men who pervert the Constitution.”…Abraham Lincoln

The corrupt Obama US Justice Dept. led by Obama’s pal Eric Holder is sueing the state of NC over its recent changes to the voter laws.

First of all I would like to thank Eric Holder for helping to highlight the impact of the Obama Administration on blacks in NC.
“According to the 2010 American Community Survey 1-Year Estimates, the unemployment rate for non-Hispanic black residents in North Carolina was almost twice the rate for non-Hispanic white residents (19.2% compared to 10.5%).”

Eric Holder claims that the new NC voting law changes are discriminatory.

“Provisions of HB 589
23. HB 589 makes several significant changes to North Carolina’s election law. Among other changes, HB 589 alters existing law by reducing the number of early voting days available to voters, eliminating same-day voter registration during the early voting period, and prohibiting the counting of provisional ballots cast by voters who attempt to vote in their county, but outside their home precinct. HB 589 also imposes a new photo identification requirement for in-person voters.

“the discriminatory impact of photo identification requirements on minority voters, and the challenges people encounter in obtaining the underlying documentation needed to acquire the types of photo identification that would be required by the proposed law.”

“Implementation of HB 589 Will Have a Discriminatory Result”

“The reduction of the number of days of early voting and elimination of the first seven days of early voting, including the first weekend days of early voting, will have a discriminatory impact on African-American voters in North Carolina.”

http://www.justice.gov/iso/opa/resources/646201393013723793555.pdf

Legal definition of discrimination.
“In Constitutional Law, the grant by statute of particular privileges to a class arbitrarily designated from a sizable number of persons, where no reasonable distinction exists between the favored and disfavored classes. Federal laws, supplemented by court decisions, prohibit discrimination in such areas as employment, housing, voting rights, education, and access to public facilities. They also proscribe discrimination on the basis of race, age, sex, nationality, disability, or religion. In addition, state and local laws can prohibit discrimination in these areas and in others not covered by federal laws.”

http://legal-dictionary.thefreedictionary.com/discrimination

The NC voting laws are clearly not discriminatory. They apply equally to all citizens.

A fifth grader can understand that.

From Gateway Pundit September 30, 2013.

“So, will Holder sue the majority of US States?

  • 14 states allow straight party voting. North Carolina now joins the 36 other states that do not.
  • 15 states allow NO early voting or no-excuse absentee voting. (Those include NY and Mass)
  • 32 states allow early voting ranging from 4 days prior to election day to 45 days with an average 19 days. North Carolina allows 10 days but requires the same number of hours of early voting that was available in 2012 and 2010 when the early voting period was 17 days.
  • Only 1 state allows same day registration during early voting. NC was the only other state to allow this and has now joined 49 states in not allowing same day registration during early voting.
  • 11 states allow same day registration on Election Day. North Carolina does not.
  • 5 states allow 16 and 17 year olds to pre-register to vote. 45 states do not, including now, North Carolina.

Illinois and Delaware require voter ID. Hawaii has even stricter voter ID requirements. Why is Holder not suing those states?”

FURTHERMORE

Even though the recent US Supreme Court decision in Shelby County, AL vs Holder, Attorney General, et al addressed the preclearance requirement of the Voting Rights Act, Chief Justice Roberts emphasized the constitutional provisions giving the states most of election powers.

“Outside the strictures of the Supremacy Clause, States retain broad autonomy in structuring their governments and pursuing legislative objectives. Indeed, the Constitution provides that all powers not specifically granted to the Federal Government are reserved to the States or citizens. Amdt. 10. This “allocation of powers in our federal system preserves the integrity, dignity, and residual sovereignty of the States.” Bond v. United States, 564 U. S. ___, ___
(2011) (slip op., at 9). But the federal balance “is not just an end in itself: Rather, federalism secures to citizens the liberties that derive from the diffusion of sovereign power.” Ibid. (internal quotation marks omitted).
More specifically, “‘the Framers of the Constitution intended the States to keep for themselves, as provided in the Tenth Amendment, the power to regulate elections.’” Gregory v. Ashcroft, 501 U. S. 452, 461–462 (1991) (quoting Sugarman v. Dougall, 413 U. S. 634, 647 (1973); some internal quotation marks omitted). Of course, the Federal Government retains significant control over federal elections. For instance, the Constitution authorizes Congress to establish the time and manner for electing Senators and Representatives. Art. I, §4, cl. 1; see also Arizona v. Inter Tribal Council of Ariz., Inc., ante, at 4–6. But States have “broad powers to determine the conditions under which the right of suffrage may be exercised.” Carrington v. Rash, 380 U. S. 89, 91 (1965) (internal quotation marks omitted); see also Arizona, ante, at 13–15. And “[e]ach State has the power to prescribe the qualifications of its officers and the manner in which they shall be chosen.” Boyd v. Nebraska ex rel. Thayer, 143 U. S. 135, 161 (1892). Drawing lines for congressional districts is likewise “primarily the duty and responsibility of the State.” Perry v. Perez, 565 U. S. ___, ___ (2012) (per curiam) (slip op., at 3)(internal quotation marks omitted).
Not only do States retain sovereignty under the Constitution, there is also a “fundamental principle of equal sovereignty” among the States. Northwest Austin, supra, at 203 (citing United States v. Louisiana, 363 U. S. 1, 16 (1960); Lessee of Pollard v. Hagan, 3 How. 212, 223 (1845); and Texas v. White, 7 Wall. 700, 725–726 (1869); emphasis added). Over a hundred years ago, this Court explained that our Nation “was and is a union of States, equal in power, dignity and authority.” Coyle v. Smith, 221 U. S. 559, 567 (1911). Indeed, “the constitutional equality of the States is essential to the harmonious operation of the scheme upon which the Republic was organized.” Id., at
580. Coyle concerned the admission of new States, and Katzenbach rejected the notion that the principle operated as a bar on differential treatment outside that context. 383 U. S., at 328–329. At the same time, as we made clear in Northwest Austin, the fundamental principle of equal sovereignty remains highly pertinent in assessing subsequent disparate treatment of States. 557 U. S., at 203.
The Voting Rights Act sharply departs from these basic principles. It suspends “all changes to state election law—however innocuous—until they have been precleared by federal authorities in Washington, D. C.” Id., at 202. States must beseech the Federal Government for permission to implement laws that they would otherwise have the right to enact and execute on their own, subject of course to any injunction in a §2 action. The Attorney General has 60 days to object to a preclearance request, longer if he requests more information. See 28 CFR §§51.9, 51.37. If a State seeks preclearance from a three judge court, the process can take years.
And despite the tradition of equal sovereignty, the Act applies to only nine States (and several additional counties). While one State waits months or years and expends funds to implement a validly enacted law, its neighbor can typically put the same law into effect immediately, through the normal legislative process. Even if a non covered jurisdiction is sued, there are important differences between those proceedings and preclearance proceedings; the preclearance proceeding “not only switches the burden of proof to the supplicant jurisdiction, but also applies substantive standards quite different from those governing the rest of the nation.” 679 F. 3d, at 884 (Williams, J., dissenting) (case below).
All this explains why, when we first upheld the Act in 1966, we described it as “stringent” and “potent.” Katzen
bach, 383 U. S., at 308, 315, 337. We recognized that it“may have been an uncommon exercise of congressional power,” but concluded that “legislative measures not otherwise appropriate” could be justified by “exceptional conditions.” Id., at 334. We have since noted that the Act “authorizes federal intrusion into sensitive areas of state and local policy making,” Lopez, 525 U. S., at 282, and represents an “extraordinary departure from the traditional course of relations between the States and the Federal Government,” Presley v. Etowah County Comm’n, 502 U. S. 491, 500–501 (1992). As we reiterated in Northwest Austin, the Act constitutes “extraordinary legislation otherwise unfamiliar to our federal system.” 557 U. S., at 211.”
Is this just another Obama administration race baiting move or retribution for NC rejecting Obama and the Democrat Party in 2012?
What a bunch of morons.
In their zeal to attack the state of NC they reveal the plight of blacks under Obama.
“According to the 2010 American Community Survey 1-Year Estimates, the unemployment rate for non-Hispanic black residents in North Carolina was almost twice the rate for non-Hispanic white residents (19.2% compared to 10.5%).”

So many Obama scandals.

It is difficult to focus on one.

That is the intent.

From WND June 13, 2013.

“OBAMA GUN-RUNNERS ‘GOT AWAY WITH IT'”
“A congressional committee chaired by Rep. Darrell Issa, R-Calif., may have moved on to other Obama administration scandals, but Arizonans still want answers to the Fast and Furious gun-running project that sent thousands of weapons to drug lords in Mexico.

Will they get them?

Not if a reported conspiracy of intimidation and enforced silence wins.

Arizona State Rifle and Pistol Association President Noble Hathaway said it angers Arizonans that it looks like the federal officials involved with Fast and Furious “got away with it.”

“To Arizonan’s it looks like they all got promotions and were commended for executing this scheme. I hope I am wrong but that is the appearance it had,” Hathaway said.

“By having the top people in management saying they did not know about it, this is worse than just saying they made a mistake and moving on. Not many in this administration preach personal responsibility though so it’s par for the course,” Hathaway said.

A former U. S. intelligence and State Department Security officer who still has connections in the State Department says he knows why “they got away with it.”

The operative, who asked not to be named, said silence is part of the deal.

“It is highly likely that gun shops in Arizona were forced to assist the U. S. government [in] getting the Fast and Furious guns and ammunition out of the country into Mexico,” he said. “As a result, the gun shops don’t dare elucidate in public on this issue.”

He said many of Arizona’s gun shops were intimidated into cooperating with the federal government and now are being intimidated into silence.

“The government intimidation process included a threat to restrict gun shops’ acquisition of these products through stiffer regulations of the products. This was done by executive action,” he said.

There is evidence that the former intelligence operative and security officer’s claims are on target.

A gun shop owner who declined to allow WND to use his name said he believes that the reason the issue has faded from public and that no gun shops will talk to the media is political pressure.”

The following was written by Debra J. Saunders of the San Francisco Chronicle and reported at the Greensboro News Record on May 22, 2013.
“Obama may use power to pardon sparingly, if at all”

“Last week, Attorney General Eric Holder gave Washington a preview of how the last few months of the Obama administration are going to look, and they’re going to be ugly.

Holder knows ugly. He was, after all, deputy attorney general when President Bill Clinton issued his infamous 140 out-the-door pardons to unworthies such as Marc Rich, who fled to Switzerland after federal prosecutors issued a 51-count indictment against him in 1983 for tax evasion, racketeering and illegal trading with Iran. Even though Rich was a fugitive from federal prosecution, Holder issued a “neutral, leaning towards favorable” opinion on the pardon; Rich’s attorney also used to be Clinton’s attorney.”

Will Obama pardon Blagojevich?

One has to wonder that if Obama appears to be in jeopardy if Blagojevich or even Rezko will talk.

Don’t believe Obama can be touched?

From WND May 19, 2013.

“HALF OF AMERICA WANTS OBAMA IMPEACHED”

“The faux stone columns from his Denver acceptance speech are crumbling, the fireworks have fizzled and the unadulterated adulation of Barack Obama is a sour feeling of disillusion, as a new poll reveals half of America wants him impeached, including a stunning one in four Democrats.

“It may be early in the process for members of Congress to start planning for impeachment of Barack Obama, but the American public is building a serious appetite for it,” said Fritz Wenzel, of Wenzel Strategies, which did the telephone poll Thursday. It has a margin of error of 4.36 percent.

“Half or nearly half of those surveyed said they believed Obama should be impeached for the trifecta of scandals now consuming Washington.””

From The Examiner June 16, 2010.

“Obama nominee defended Saudi terrorist”

“President Barack Obama’s nominee for the number two spot at the U.S. Justice Department served as a lawyer for the Saudi royals who helped finance the 9-11 terrorist attacks and raked in millions of dollars to “monitor” a collapsed insurance company that got a massive government bailout, according to a Washington, DC watchdog group.

According to public-interest group Judicial Watch, the president’s choice — James Cole — to be Deputy Attorney General believes that the Middle Eastern terrorists, who attacked the World Trade Center and the Pentagon on September 11, 2001, are simply domestic criminals who commit crimes such as rape and murder.

This should concern Americans since, as a ranking official at the Justice Department, Cole would play a lead role in decision-making involving terrorism arrests and prosecutions.

Known as a top criminal defense attorney in Washington, D.C. specializing in white-collar crime, Cole is a longtime friend of Attorney General Eric Holder, who served as deputy of the Justice Department’s Public Integrity Division under Bill Clinton. It was Holder who brokered the deal to release terrorists who bombed office buildings and killed cops in New York City in the 1970s. The deal was made to garner votes for Clinton’s wife who was running for New York’s U.S. Senate seat.

Obama nominated Cole last month and the Senate Judiciary Committee is holding confirmation hearings this week.

Cole has a shady history that contradicts the president’s assertion that “the American people will be well served by his integrity and commitment to the law,” according to Judicial Watch.

Cole represented Saudi Prince Naif bin Abdulaziz Al-Saud when insurance carriers and September 11 survivors sued him and others for financing terrorists. Treasury Department documents provided evidence of extensive financial support for Al-Qaeda and other extremist groups by members of the Saudi royal family and Prince Naif ran the Al Haramain Foundation, a Saudi charity that diverted funds to Al-Qaeda before and after September 11, 2001.”

From the NY Times May 15, 2013.

“Justice Dept. Defends Seizure of Phone Records”

“Attorney General Eric H. Holder Jr. on Tuesday defended the Justice Department’s sweeping seizure of telephone records of Associated Press journalists, describing the article by The A.P. that prompted a criminal investigation as among “the top two or three most serious leaks that I’ve ever seen” in a 35-year career.

“It put the American people at risk, and that is not hyperbole,” he said in an apparent reference to an article on May 7, 2012, that disclosed the foiling of a terrorist plot by Al Qaeda’s branch in Yemen to bomb an airliner. “And trying to determine who was responsible for that, I think, required very aggressive action.”

In a statement in response, The A.P.’s president and chief executive, Gary Pruitt, disputed that the publication of the article endangered security.

“We held that story until the government assured us that the national security concerns had passed,” he said. “Indeed, the White House was preparing to publicly announce that the bomb plot had been foiled.” Mr. Pruitt said the article was important in part because it refuted White House claims that there had been no Qaeda plots around the first anniversary of the killing of Osama bin Laden.

At a news conference at the Justice Department, Mr. Holder also disclosed that he recused himself last year from overseeing the case after F.B.I. agents interviewed him as part of their investigation. His deputy, James M. Cole, approved the subpoena seeking call records for 20 office and personal phone lines of A.P. reporters and editors.

Mr. Pruitt disclosed the seizure of the phone records on Monday in a letter to Mr. Holder protesting the action as overly broad and “a serious interference with A.P.’s constitutional rights to gather and report the news.”

But in a letter to The A.P. on Tuesday, Mr. Cole portrayed the search as justified and disputed a detail in the wire service’s account of the Justice Department action. While the news organization had said that records from “a full two-month period” had been taken, Mr. Cole said that the seizure covered only “a portion” of two calendar months.

“We understand your position that these subpoenas should have been more narrowly drawn, but in fact, consistent with Department policy, the subpoenas were limited in both time and scope,” he wrote. He added that “there was a basis to believe the numbers were associated with A.P. personnel involved in the reporting of classified information. The subpoenas were limited to a reasonable period of time and did not seek the content of any calls.””

“Lucy Dalglish, dean of the journalism school at the University of Maryland, criticized the Justice Department’s broad seizure of phone records, saying it would chill the ability of reporters to report the news. The subpoena came against the backdrop of six prosecutions of officials in leak-related cases under President Obama — twice the number prosecuted under all previous presidents combined.

“The message is loud and clear that if you work for the federal government and talk to a reporter that we will find you,” she said.”

Attorney General Eric Holder states no, Constitution allow a US citizen on US soil to be killed by a drone?, No imminent and immediate threat of death and bodily harm

“In the Department’s view, a lethal operation conducted against a U.S. citizen whose conduct poses an imminent threat of violent attack against the United States would be a legitimate act of national self-defense that would not violate the assassination ban. Similarly, the use of lethal force, consistent with the laws of war, against an individual who is a legitimate military target would be lawful and would not violate the assassination ban.”…Obama DOJ Memo

“Ted Cruz Goads Eric Holder Into Admitting That Killing Americans With Drones On U.S. Soil Is Unconstitutional”

“On Tuesday, the Department of Justice sent shockwaves through the nation when Attorney General Eric Holder informed Sen. Rand Paul (R-KY) in writing that the White House would be within its legal authority to execute an American citizen via drone on U.S. soil if that person was determined to pose a threat to national security. On Wednesday, testifying before a Senate panel, Holder was prodded repeatedly about this assertion by Sen. Ted Cruz (R-TX). Holder eventually admitted that it would not be constitutional to execute an American citizen without due process.

“In your legal judgment, does the Constitution allow a U.S. citizen on U.S. soil to be killed by a drone?” Cruz asked Holder pointedly.

“For sitting in a café and having a cup of coffee?” Holder replied. Cruz clarified that his hypothetical individual subject to a drone strike did not pose an “imminent and immediate threat of death and bodily harm,” but that person is suspected to be a terrorist.

“I would not think that that would be an appropriate use of any kind of lethal force,” Holder replied.”

““You keep saying appropriate – my question isn’t about propriety,” Cruz goaded. “My question is about whether something is constitutional or not.”

When Cruz was about to abandon his line of questioning after a number of equivocations from Holder, the attorney general clarified that he was saying “no” such actions would not be constitutional.”

From Fox News September 19, 2012.

“Obama Slides Taliban Lawyer Into Top Spot At Justice Department”

“A lawyer who came to prominence for his full-throated defense of a subsequently convicted terrorist was quietly promoted to the No. 3 slot at the Department of Justice last month, a post that puts him in charge of the administration’s policy regarding Guantanamo Bay detainees.

The move has raised red flags on Capitol Hill and elsewhere among national security stalwarts who argue that the promotion could imperil the country’s longstanding war on terrorism.

The Obama administration appointee at the center of the debate is Tony West, a longtime Justice Department lawyer who received national attention for his aggressive defense of John Walker Lindh, the so-called American Taliban who is currently serving 20-years in prison for colluding with al Qaeda in Afghanistan and taking up arms against U.S. troops.”

http://nation.foxnews.com/department-justice/2012/09/19/obama-slides-taliban-lawyer-top-spot-justice-department

Fox failed to mention that Tony West represented Obama in an eligibility lawsuit, i.e., West helped Obama keep his records hidden at taxpayer expense.

From Citizen Wells March 7, 2012.

From the US Justice Department February 27, 2012.

“Attorney General Appoints Tony West as Acting Associate Attorney General and Stuart Delery as Acting Assistant Attorney General for the Civil Division”

“Attorney General Eric Holder announced today the appointments of Tony West to serve as the Department of Justice’s Acting Associate Attorney General and Stuart Delery as Acting Assistant Attorney General for the Civil Division.

“Tony and Stuart have served the department with professionalism, integrity and dedication, and both bring a wealth of experience to their new positions,” said Attorney General Holder. “I’m confident they will provide invaluable leadership and will play a critical role in furthering the department’s key priorities and fulfilling its traditional missions.”

West will become Acting Associate Attorney General, the third highest official at the Justice Department, upon the departure of Associate Attorney General Thomas Perrelli.

West has served as Assistant Attorney General for the Civil Division since April 2009. In that capacity, West led the Department’s largest litigating division, with a docket including significant national security matters, defending the Affordable Care Act against constitutional challenges, the government’s response to the Deepwater Horizon oil spill in the Gulf of Mexico, and leading the department’s preemption lawsuits against state immigration laws passed in Arizona, Alabama, South Carolina and Utah.

During his time as Assistant Attorney General, West has bolstered the Civil Division’s affirmative civil enforcement efforts in areas such as health care fraud, procurement fraud and mortgage fraud. Since January 2009, the Civil Division has used the False Claims Act to recover over $8.8 billion in taxpayer money lost to fraud and abuse – the largest three-year total in the Department’s history.”

attorney for an American terrorist to the No. 3 spot at the Justice

J. Christian Adams, once an elections lawyer who accused the Justice
Department of racial bias in its decision to not prosecute a voter
intimidation case involving the New Black Panther Party, said Tony West’s
promotion from assistant attorney general for the Civil Division to acting
associate attorney general is one more step toward letting radicals run the
Justice Department.”
“”Tony West took on, and his firm, took some of the most radical causes for
America’s enemies before coming to the Justice Department,” he said.
“When he took on the representation of John Walker Lindh, even after the
sentencing, he was out shilling for him. He said things like … ‘I think
he’ll have a lot to offer after he gets out of jail.’ I mean, what is he
going to have to offer after when he gets out of jail? How to endear
yourself to prominent Democrat lawyers? I mean there’s no reason to be
talking like that.””

“West, who was a a finance co-chairman in President Obama’s 2008 election,
was nominated for his Civil Division post in January 2009 and approved by
the Senate in April of that year. Prior to joining the administration, he
was a special assistant attorney general in California and a lawyer at a
San Francisco firm.”

“Why do the wheels of justice become mired or stopped when a case touches Obama?”…Citizen Wells

The wheels of justice turn very slowly when the case touches Obama. It some cases the wheels of justice stop, as in the case of the New Black Panther Party.

From Citizen Wells July 31, 2012.

“Federal Court finds Obama appointees interfered with New Black Panther prosecution”

“A federal court in Washington, DC, held last week that political appointees appointed by President Obama did interfere with the Department of Justice’s prosecution of the New Black Panther Party.

The ruling came as part of a motion by the conservative legal watch dog group Judicial Watch, who had sued the DOJ in federal court to enforce a Freedom of Information Act (FOIA) request for documents pertaining to the the New Black Panthers case. Judicial Watch had secured many previously unavailable documents through their suit against DOJ and were now suing for attorneys’ fees.”

“The Court’s decision is another piece of evidence showing the Obama Justice Department is run by individuals who have a problem telling the truth,” Judicial Watch President Tom Fitton said. “The decision shows that we can’t trust the Obama Justice Department to fairly administer our nation’s voting and election laws.””

Rod Blagojevich is in prison and his appeal process may drag on for many many months. Blagojevich was arrested after the 2008 election.

Tony Rezko, the kingpin of Chicago corruption, is in prison and was never called as a witness.

Stuart Levine, who began cooperating with the feds in 2004 and who knows almost as much about Obama’s corruption ties as Rezko, was recently sentenced.

Patrick Fitzgerald aggressively and promptly prosecuted former Republican Governor George Ryan.

Mutual Bank loan to Rezko’s for Obama lot purchase.

From No Quarter USA October 12, 2008.

“”Because I tend to rely on evidence and not on hearsay, I believe we should focus our attention on Amrish Mahajan and the Mutual Bank of Harvey, not on Giannoulias and the Broadway Bank, if we are to assign names to the financial institution about which Sneed of the Chicago Sun-Timeshas heard “rumblings.” Although Mahajan is not known to readers ofNo Quarter and to the national media, I imagine they will desire more information on the unscrupulous banker once they read the information I unpack below the fold. And yes, Obama is involved, deeply involved.”

My interest in Amrish Mahajan and the Mutual Bank of Harvey was picqued by this list of contributors in Rezko’s bundling network provided by the Chicago Sun-Times last March. View the second page of the document, and notice the following entry:

Last name First name Obama donations Rezko connection
Mahajan Amrish $2,500 Banker whose bank loaned money to Rezko companies. The bank also loaned Rezko’s wife money to buy a vacant lot next to Obama’s home.

The data available in the Sun-Times spreadsheet is corroborated by the following data, which is democratically available at the Federal Election Commission‘s website:

MAHAJAN, AMRISH
CHICAGO, IL 60607
MUTUAL BANK

OBAMA, BARACK
VIA OBAMA FOR ILLINOIS INC
12/20/2003 500.00 24020030170
04/14/2004 1000.00 24020461757

Not only was Mahajan a member of Rezko’s bundling network; his bank, the Mutual Bank of Harvey, granted Rita Rezko the $500,000 mortgage she neededin order to purchase the lot on which the Obama mansion in Chicago sits. As many of you may recall, the Obamas could not have purchased the mansion they could not afford unless transactions for the mansion and the lot closed on the same day. Obama needed to locate someone who would buy the lot, and he approached Rezko, the convicted slumlord with whom Obama toured the property before they mutually agreed to the following arrangement:

The home and lot sales closed on June 15, 2005. A land trust controlled by the Obamas bought the house for $1.65 million, and the Obamas secured a $1.32 million mortgage from Northern Trust to complete that purchase. That same day, Rezko’s wife, Rita Rezko, bought the side lot for $625,000. A $37,000- a-year Cook County employee, she secured a $500,000 mortgage from Mutual Bank of Harvey.

The structure of this transaction begs the following question: What bank would lend a government employee who earns $37,000 per annum a $500,000 mortgage? What bank would assume such a risk?

The Mutual Bank of Harvey, of course, for the Mutual Bank of Harvey’s President is a man who is deeply connected to the Chicago machine that backed Barack Obama. Indeed, Amrish Mahajan was one of Mayor Daley’s first political appointments in 1989, when he was named to a seat on Chicago’s Plan Commission, where he would be joined by Obama’s former boss and Rezko’s business partner Allison Davis and by Valerie Jarrett, Daley’s Chief of Staff whochaired the Commission from 1991-1995. Mahajan, in other words, worked with those who devised and profited from Daley’s failed public housing experiment in Chicago, a public housing policy Obama helped fund as state Senator and US Senator.

Rezko, according to the Boston Globe, was one of the major beneficiaries of Obama’s legislative advocacy for funding of Daley’s public housing experiment. Other major beneficiaries are Jarrett and Allison Davis. Mahajan was also a beneficiary, for his bank had made $3.4 million dollars in loans to Tony Rezko’s slum landlord business since 2002. A banker for one of the slumlords who benefitted from the Daley housing program Obama helped bankroll, Mahajan was returning a favor when he wrote a $500,000 mortgage in 2005 for the wife of one of his clients. Although Tony’s financial problems were mounting in 2005, and although Rita earned only $35,000 per annum, Mahajan underwrote the mortgage. Favors must be reciprocated, I guess, especially when one can satisfy two parties at once: the person with whom one has a complicated relationship in real estate and the politician who helped finance that complicated relationship as state Senator and US Senator.”

Kenneth J. Conner questioned the appraisal of the lot and was subsequently fired.

From Citizen Wells November 1, 2011.

“Here is what we know about the purchase of a lot by Barack and Michelle Obama from Rita Rezko in 2006:

1. “In June, 2005, Mutual Bank President and CEO Amrish Mahajan and
other Mutual Bank officers approved a loan to Rita Malki Rezko (Rita
Rezko) which was guaranteed by Antonin Rezko so that Rita Rezko could
purchase a 9,090 square foot vacant parcel of real estate at 5050 S.
Greenwood Avenue, Chicago.” (Conner lawsuit)

2. “On or about January 4, 2006, Rita Rezko entered into an
agreement with Senator Barack and Michelle Obama (Obamas) to sell a
ten-foot strip of the 5050 S. Greenwood property to the Obamas.”
(Conner lawsuit)

3. “In late 2005 or early 2006, Conner performed an appraisal review
of the Adams Appraisal (Exhibit C) per the directive of Richard Barth
and James Murphy. Conner prepared a written Appraisal Review report
(ARR) opining that the Adams Appraisal overvalued the Greenwood lot by
a minimum of $ 125,000.00 and that a reasonable and fair valuation for
Mutual Banks’s underwriting purposes should be no greater than $
500,000.00 for the entire 5050 S. Greenwood parcel as originally
purchased by Rita Rezko.” (Conner lawsuit)

4. “On or about October 19, 2006, Mutual Bank received a Grand Jury
Subpoena (GJS) requiring Mutual Bank to produce the Rezko 5050
Greenwood loan file, as well as a Rita Rezko Riverside District
Development LLC checking account and loan file.” (Conner lawsuit)

5. “In October, 2007, Conner had various communications with Mutual
Bank’s Human Resources Department representative, Lana Schlabach. In
an email communication of October 15, 2007, Conner directly referenced
“Resentment over my mentioned discovery of the removal/replacement of
an appraisal review that I conducted. That appraisal review contained
substantial observations and suggestions. The transaction and parties
involved were high profile in the media.I am under the impression that
the FBI has since looked at the file.”” On October 23, 2007, eight days after Conner’s October 15, 2007 email to Schlabach attached as Exhibit J, Mutual Bank terminated Conner’s employment for pretextual reasons.” (Conner lawsuit)

The FDIC has filed a lawsuit against Mutual Bank, Amrish Mahajan, Richard Barth, et al.

From Citizen Wells October 31, 2011.

“The FDIC is suing eight former directors, two officers and the bank’s lawyer.

The failure of the $1.7 billion-asset bank, which had 10 branches in
the Chicago area, is expected to cost the FDIC $775 million. From 2005
to 2009, the lender had nearly doubled in size, fueled by what would
turn out to be bad real estate loans, many of which were made to about
15 borrowers. Record-keeping was shoddy, and loan terms were changed
at closing with no board approval, the suit said. Mutual had become a
“lender of last resort for failed real estate projects,” particularly
in the hotel industry, the suit said.

One of the defendants, former bank president and board member Amrish
Mahajan, couldn’t be reached for comment.”
“5. Collectively, the Director Defendants and Officer Defendants
(“Director and Officer Defendants”) (a) recklessly implemented a
strategy of rapid asset growth through approving a high concentration
of risky CRE, ADC and out-of-area loans to a small concentration of
high-volume borrowers; (b) failed to implement appropriate
underwriting and credit administration practices; (c) ignored the
Bank’s loan policies; (d) ignored federal lending regulations; and (e)
disregarded warnings from the Bank’s regulators regarding the Bank’s
lending activities.”

open and pervasive hostility within the Justice Department to bringing

Equal enforcement of justice is not a priority of this administration. Open
contempt is voiced for these types of cases.

Some of my co-workers argued that the law should not be used against black
wrongdoers because of the long history of slavery and segregation. Less
charitable individuals called it “payback time.” Incredibly, after the case
was dismissed, instructions were given that no more cases against racial
minorities like the Black Panther case would be brought by the Voting
Section.

Refusing to enforce the law equally means some citizens are protected by
the law while others are left to be victimized, depending on their race.
Core American principles of equality before the law and freedom from racial
discrimination are at risk. Hopefully, equal enforcement of the law is
still a point of bipartisan, if not universal, agreement. However, after my
experience with the New Black Panther dismissal and the attitudes held by

From Obama Release Your Records March 4, 2012.

“Obama’s Top DOJ Eligibility Attorney Promoted to Number 3 Spot at Justice”

That’s right. Tony West represented Barack Obama as a defense attorney, at taxpayer expense, to help Obama keep his records hidden and violate the US Constitution. Here is one small example.

“Case: 09-4209 Document: 003110049041 Page: 1 Date Filed: 03/08/2010”

“CHARLES KERCHNER, JR., et al.,
Plaintiffs-Appellants,
v.
BARACK OBAMA, et al.,”

“ON APPEAL FROM THE UNITED STATES DISTRICT COURT
FOR THE DISTRICT OF NEW JERSEY
________________________
BRIEF FOR DEFENDANTS-APPELLEES”

“TONY WEST
Assistant Attorney General”

“Plaintiffs’
alleged grievances regarding President Obama’s constitutional
qualifications reflect a generalized interest in the proper
administration of the law “shared by all the American people,”
App. 10, not a concrete injury particular to plaintiffs. The
Supreme Court has repeatedly held that Article III standing may
not be predicated on such injury. Plaintiffs’ attempts to
aggrandize their harms, based on oaths they have taken to support
to the Constitution, their heightened interest in constitutional
principles, or the possibility of future military service, fail.”
