As the Blaze recently reported, Jesus Diaz, a former U.S. border
agent, is serving a two-year prison sentence after being accused of
using excessive force in handcuffing a juvenile drug smuggler back in
2008. Diaz’s detention, which has come under fire from many who
believe that he isn’t guilty of the violence charges waged against
him, has become a hot-button issue.

This morning, Glenn Beck interviewed Diaz’s wife, Diana, on his radio
show to get the entire story, and by the end he was visibly
frustrated.

But before delving into the video of their exchange, let’s review some
brief background information on the case.

Diaz, who is now imprisoned and separated from his wife and six
children, was found guilty of inflicting pain on a known 16-year-old
Mexican drug smuggler in an effort to obtain more information about
where marijuana was being hidden. Authorities also claim that the
former agent kicked the teen and dropped him face-first on the ground.

But these accounts and the charges associated with them have come
under fire (GOP presidential candidate Michele Bachmann has said she
would work toward Diaz’s release). The Examiner has more about the
confusion surrounding the case:

According to the Law Enforcement Officers Advocates Council, the
government’s case is based on false testimony that is contradicted by
the facts. This includes the charge that Agent Diaz was physically
abusive to the then minor “MBE” as noted by court documents and
transcripts that Diaz allegedly put his knee on his back and pulled
back on his handcuffs.
“However, given the time of day during the incident, October 16, 2008
at about 2 a.m. and lack of lighting it would be impossible to have
actually seen much if anything. The agent who stood next to Mr. Diaz,
Marco Ramos testified that he did not see anything that was claimed to
have taken place,” Andy Ramirez, president of LEOAC explained.

A web site has been setup to advocate for Diaz’s release.

In the beginning of his discussion with Diana, Beck said, “I’m sorry
for what this government is doing to you…your family and your
husband.” Diana went on to explain what seems like a tragic story of
justice gone awry.

The Mexican government had apparently filed a complaint following the
incident, which the U.S. government then acted on. In the end, the
16-year-old avoided detention and was apparently sent back to his
homeland. Even more bizarrely, Diana claims that the young man was
brought back to America to testify (with immunity) against her
husband.”

“To summarize, U.S. Attorney Johnny Sutton and his minions used an
extremely weak charge, claiming Agent Diaz violated the civil rights
of an illegal alien doper under the color of law. Sutton and his
successor under the Obama Administration then put the full weight of
the Justice Department behind this prosecution, solely to give the
Mexican Government a Border Patrol Agent’s scalp. Law enforcement
officers commonly pull on a perps or suspects handcuffs. If this is
the new standard for a 10 year prison sentence, then all departments
either need to be questioned by the DOJ about this, or they need to
support Agent Diaz’ appeal and his family’s quest for justice.”

“In what appears to be yet another case of the Mexican Government
orchestrating a fake crime against one of their drug smuggling
criminals hauling dope into the U.S., Border Patrol Agent Jesus Diaz,
a 7-year Border Patrol veteran, was convicted in Federal Court on
February 24 of one count of excessive force (under color of law) and 5
counts of lying to Internal Affairs.  He is facing a maximum of 35
years in prison when he is sentenced in November.  Meanwhile, he’s
been in jail since the verdict nearly two months ago.  He’s in
solitary confinement 23 hours per day for his safety. So far, the
judge has refused to allow bond while Diaz awaits sentencing.”
“Diaz was tried in September 2010, but the case ended in a mistrial.
The DOJ tried the case again in February 2011 and this time they got
their conviction, even though federal agent witnesses admitted they
had lied to a grand jury.  The judge did not allow the fact that they
had committed perjury into the second trial.”

DEL RIO SECTOR CUSTOMS AND BORDER PATROL AGENT INDICTED
FOR ALLEGEDLY ASSAULTING A 15 YEAR OLD

United States Attorney John E. Murphy announced that 31-year–old U.S. Customs and Border Patrol Agent Jesus E. Diaz, Jr., stands charged by federal grand jury indictment with deprivation of rights under color of law.
The indictment, returned this week by a federal grand jury sitting in Del Rio, alleges that on October 16, 2008, Diaz assaulted a 15 year old depriving him of his constitutional right to be free from the use of unreasonable force by one acting under color of law.
Upon conviction, Diaz faces up to ten years in federal prison and a maximum $250,000 fine.
An indictment is merely a charge and should not be considered as evidence of guilt. The defendant is presumed innocent until proven guilty in a court of law.
This case was investigated by U.S. Immigration and Customs Enforcement – Office of Internal Affairs and the Office of Professional Responsibility. Assistant United States Attorney Kelly Blackburn is prosecuting the matter for the Government.”

I tried to obtain more information on this case yesterday. Here is what I know thus far, aside from articles on the web.

A. From the press release: “Diaz assaulted a 15 year old depriving him of his constitutional right to be free from the use of unreasonable force by one acting under color of law.”

  1. Illegals aliens do not have constitutional rights.
  2. The Deprivation of Rights Under Color of Law, Title 18, U.S.C., Section 242, states: “This law further prohibits a person acting under color of law,
    statute, ordinance, regulation or custom to willfully subject or cause
    to be subjected any person to different punishments, pains, or
    penalties, than those prescribed for punishment of citizens on account
    of such person being an alien or by reason of his/her color or race.”    Alien refers to a person visiting from another country legally or legally here on some kind of visa. This is not intended to protect someone in violation of the law.

B. Aside from the press release, I could find no other reference to the Jesus Diaz prosecution. Contrast this to the  Compean and Ramos Prosecution.

C. Something smells about this. We know the USDOJ cannot be trusted, especially under the control of Obama and Holder.

The crowd at Occupy Greensboro was a fairly diverse group of people very different from the bulk of attendees at the Occupy Wall Street protest in NY City. Many of the Tea Party folks would have felt at home with signs blaming government. Of course the Che Guevarra flag  would not have been so inviting. I  am still watching the union and Obama camp involvement in NC and will continue to monitor it. Recently the ACLU was spotted near the University of NC at Greensboro with petitions against some form of job discrimination in NC. What they failed to mention is that NC is a right to work state. An employee can be fired for any reason. This keeps the unions out and companies in the state.

Morgan Freeman and other racists, most of the people in attendance were white since, duh, the majority of the population is.

“When the Occupy movement that began on New York’s Wall Street comes to downtown Greensboro today, it will come with a head of steam that’s been building for weeks.

Organizers and supporters of Occupy Greensboro say the protests of economic inequity happening across the country inspired them to put together a local event.

Organizers say it also inspired them to do it the right way.”

“The group rented space at the park and the neighboring YWCA parking lot to avoid the standoff with police that happened at Occupy events in Boston and New York.

“The city greatly reduced its rental fee for us — from $700 a day to I believe around $200,” Wright said. “And we’ll have the YWCA parking lot for camping, which is private property.”

Initially, some in the group argued protesters should simply occupy the park without paying rent — under the theory there would be too many people for police to eject.

“In the end, we decided it was more important to have a good relationship with the city and the police,” Wright said.

Wright, a 29-year old who coaches lacrosse at Grimsley High and Wake Forest, said this is the first protest movement in which he’s taken part.”

“Hundreds of protesters surrounded the Bank of America building downtown Saturday afternoon as part of the “Occupy Greensboro” protest.

“Banks got bailed out, we got sold out,” they chanted to the beat of a marching drum corps, raising handmade signs and unfurling banners.

“Lobbyists Eat the Constitution for Breakfast” read one.

“Eight Years of College and Laid off Twice,” another read. “Where’s My Bailout?”

Those who marched from the Phill G. McDonald Plaza to Festival Park said they were inspired by the movement that began on New York’s Wall Street and has spread all over the world.

Police Chief Ken Miller, who oversaw his officers at Festival Park and spent some time chatting with protesters, estimated the crowd at about 600.

Organizers had expected between 500 and 1,000 people.

Some of the targets of the protest: fraud in the financial industry, economic inequality, and elected officials who protesters said serve donors and lobbyists rather than the American people.

“It’s hard to live in America today without coming to the conclusion that our government and all of our institutions are for sale to the highest bidder,” said Michael Duncan, 22.

Duncan said he was lucky to find a job in computer technical support after he graduated from college two years ago — many of his friends didn’t.

But he was laid off just a few months later as the company he worked for downsized. He found another job after a few months but was laid off again within a year.

“Our economy is on the verge of collapse,” Duncan said. “And it’s because of a housing bubble created by bankers and people on Wall Street who sold us a bill of goods, defrauded the American people and then were bailed out by our government along with a lot of other major corporations as average workers were laid off, their pay cut, and their houses foreclosed.

“Anyone who isn’t angry about that hasn’t been paying attention.”

The demonstration remained peaceful. No arrests were made as of Saturday night.

The event’s organizers worked closely with police and city officials to be sure the demonstration would be safe, family friendly and nonviolent.”

“A few area elected officials and political candidates also were among the crowd, including at-large Greensboro City Council candidate Marikay Abuzuaiter and Guilford County Register of Deeds Jeff Thigpen.

Thigpen’s crusade against mortgage fraud and improper documentation by major national banks in Guilford County has gotten national media coverage.

“The people who started this aren’t the protesters,” Thigpen said. “They’re on Wall Street and they ran our economy into the ground. I believe in an America where there isn’t one standard for banks and another standard for the rest of us.””

Jeff Thigpen, the Guilford County Register of Deeds, is a good guy and a friend of mine. He has been doing some good work in the area of “robo signatures” and circumventing of chain of title in mortgages. However, he continues to repeat the party line in terms of placing the majority of blame for the economy and housing crisis on the lenders. More guilty in this sham are people like Chris Dodd, Barney Frank, Maxine Waters and Barack Obama in sync with organizations like ACORN who pressured banks to make loans to unqualified and risky borrowers. Jeff, I will be discussing that with you soon.

“Authorities have charged four Wake County residents with voter fraud in connection with the last presidential election.

Twenty-six-year-old Kierra Fontae Leache of Pheiffer Drive in Raleigh, 46-year-old Shelia “Sheilia” Romona Hodges, also of Pheiffer Drive in Raleigh, and 25-year-old Brandon Earl McLean of Bethune Drive in Raleigh, allegedly cast two ballot votes in 2008.

All three are registered Democrats.

According to arrest warrants, Leache filed a no-excuse absentee application on Oct. 29, 2008, as well as voted at the polling place on Martin Luther King Boulevard in Raleigh on Nov. 4.

Leache later admitted to authorities that she did vote twice in the presidential election.

Hodges and McLean – who also is facing unrelated charges from this past June – both each participated in early voting at Chavis Heights Community Center in Raleigh and later voted on Election Day at their local fire department polling place, according to court documents.

They also admitted to the charges.

Authorities have not said if or how the suspects are connected to one another.

Arrest warrants for all three suspects note the date of offense as far back as March of 2010. All three have been placed under a $10,000 bond.

ABC11 has learned that the Wake Board of Elections uncovered the fraud and turned it over to the Wake County DA and got the SBI involved to investigate.

A fourth person, 54-year-old Lela Devonetta Murray of Edwards Mill Road in Raleigh, was also charged with voter registration fraud.

Authorities charge that she voted on Election Day 2010 as a transfer voter in one precinct and then voted on Election Day provisionally in another precinct. The reason given for the second vote was “wrong precinct.”

Murray was held on $10,000 bond.

The election, held on Nov. 4, 2008, had presidential candidates Democrat Sen. Barack Obama and Republican Sen. John McCain on the ballot.”

“Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has uncovered documents from the Federal Communications Commission (FCC) that indicate officials at the FCC colluded with the leftist Free Press organization to publicly push a new plan to regulate the Internet under the FCC’s so-called “net neutrality” program. Judicial Watch obtained the documents pursuant to a December 27, 2010, Freedom of Information Act request.

In December 2010, the FCC voted 3-2 to advance its “net neutrality program.” This decision seems to fly in the face of an April, 2010 federal appeals court ruling that the FCC had exceeded its authority in seeking to regulate the Internet and enforce “net neutrality” rules.

The supporters of “net neutrality,” including Free Press, argue that high-speed Internet access is a “civil right,” and are recommending new government regulations to provide taxpayer-funded broadband Internet access to all populations, especially those deemed “underserved.” Opponents of “net neutrality” argue the program is designed to impose greater government control over the Internet and will result in less access, not more. Moreover, opponents of “net neutrality,” also dispute the claim that Internet access is a basic civil right protected by the U.S. Constitution.

Judicial Watch uncovered internal correspondence showing unusual coordination by some officials at the FCC and Free Press in pushing the “net neutrality” agenda in the run up to the controversial FCC vote in December:

•On November 2, 2010, Free Press Associate Outreach Director Misty Perez Truedson sent an email to John Giusti, Chief of Staff to FCC Commissioner Michael Copps asking if Copps would write an op-ed for the Albuquerque Journal in advance of a November 16 hearing on Internet access: “Would Commissioner Copps be interested in drafting an Op-ed in advance of the hearing? It’s a great way to get the word out and to spark conversations in advance of the event,” Truedson wrote. “We’re working on the op ed,” Giusti wrote back on November 9.”

“Free Press has deep ties to radical leftists and socialists. Robert McChesny, former editor of the socialist magazine Monthly Review, is the co-founder and president of Free Press. Kim Gandy, the Chairman of the Free Press Board of Directors, served as the President of the National Organization for Women from 2001-2009. Craig Aaron, Free Press’s President and CEO, formerly worked as managing editor of the socialist tabloid In These Times. Free Press is financially supported by George Soros’s Open Society Institute and other hard-left groups such as the Ford Foundation and Democracy Alliance.

“Net neutrality is just another Obama power grab. This is nothing less than the Obama administration’s attempt to stage a government takeover of the Internet under the guise of ‘net neutrality.’ So it should come as no surprise that Free Press, the hard left organization with socialist ties, is improperly driving the so-called net neutrality agenda from inside the Obama administration. Pastor Gerald C. Primm Memorial Day Hero Obituary, WWII Air Force Fighter pilot, Man of God

I have read many obituaries. I always look for the ones of Word War II veterans. It is my way of thanking them for their sacrifices. Today I was presented an obituary that left me in awe and with respect for a shining example from the Greatest Generation. It is fitting that the world celebrate and give thanks for the life of Pastor Gerald C. Primm, a war hero and man of God.

From the Greensboro News and Record Obituaries, Sunday, May 29, 2011, Memorial Day Weekend.

“Gerald joined the Army Air Force during WWII to fight for his country. He became a Fighter Pilot flying the P-38 Lightning. During the war years he flew 56 combat missions (Note: only had to fly 50 but volunteered for 6 more). His exploits as a fighter pilot ranged from starting his European service in Casablanca, to starting his combat missions in Mateur, Tunisia in Northern Africa and in escorting bombers to Sardinia. After Sardinia was liberated by the Allies, he was stationed at Sardinia where he suffered from a bout of yellow jaundice. From Sardinia Gerald was stationed at Gioia del Colle on Italy proper.

He flew six combat missions out of Gioia del Colle – the most harrowing was the mission to escort bombers to bomb a ball-bearing plant in Wiener-Neustadt, Austria. When the bombers arrived at Wiener-Neustadt they had to abort their mission due to weather, but this just started the travails of Gerald as bandits (enemy) were spotted and Gerald counted about 25 of them and then another 35 were spotted for a total of 60. Outnumbered by 60 to 16, Gerald’s plane was fixed upon and a bullet knocked out his hydraulic system and one engine, thus his wing flaps were not maneuverable and his landing gear would not deploy. Gerald dismissed bailing out over Yugoslavia and decided to skim the mountain tops and glide over the Adriatic Sea. To compound Gerald’s problems a German plane was coming in for the kill and one of Gerald’s fellow pilots, Jim Advey, came to the rescue and drove the enemy fighter away. They remained life-long friends after the war. Gerald’s Wiener-Neustadt escapade ended as he spotted an airfield north of Foggia, Italy and Gerald crash landed at 130 miles an hour without the plane somersaulting down the runway.
he remaining number of his 50 missions would be flown out of Foggia airfields which included escorting bombers to bomb the infamous Ploesti oil refineries in Rumania. Other exploits included flying from England to Algiers and having to emergency land on Gibraltar because one engine had failed. But the most noteworthy assignment of the war came about after Gerald had received the promotion to captain and volunteered for more missions (6) beyond his obligatory requirement of 50. At this time he was called into the office of Lt. General Ira Eaker, Mediterranean Commander, USAAF at King Victor Emmanuel’s Palace where he was asked if he knew about the upcoming invasion of Southern France. Once Gerald said no, Eaker informed him that he had been selected to fly Lt. General Jacob Devers, Supreme Allied Commander of the Mediterranean, in a specially modified P-38 to view the invasion on August 15, 1944, called Operation Dragoon. This Gerald did as he and the General, as well as 7 other Generals flew out of Corsica to view the invasion of Southern France by the Allies.

For his exploits in WWII Gerald received the Distinguished Flying Cross awarded for “Heroism or Extraordinary Achievement” and the Air Medal with nine oak leaf clusters. In addition he received the Asian-Pacific Theatre Ribbon, Europe-Africa-Mediterranean Theater Ribbon with three battle stars and Distinguished Unit Citation.

After the war Gerald attempted to pick up his college education that had been interrupted by the war years by attending the UNC-Chapel Hill and moving to Texas to attend Baylor University. But a higher calling was in the offing for Gerald as he felt led to enter the Christian ministry as a Southern Baptist Preacher/Pastor. At about the same time he met the love of his life Ethel Brown at the First Baptist Church in Sanford where Ethel was Educational Director. Their marriage on December 28, 1948 formed a magnificent partnership in serving their Lord and Savior Jesus Christ until Ethel’s death on January 10, 2006. ”

“Gerald also took a stand for Civil Rights as evidenced by his bold and heroic actions in the 1950’s at his church in Raleigh which was located beside Shaw University, a black college. Some of the leaders of the church told Gerald that four Shaw University Students (African American) were attempting to enter the church to worship and these officials would not let them. Gerald rebuked them and told the officials to let them come in to worship. The next week Gerald, from the pulpit, resigned as pastor saying the courageous and truthful words to some members of the congregation that “their hearts were blacker than the faces of the students they barred from the place of worship”. This incident made statewide, national, and international news and brought Gerald great admiration from the African-American communities in Raleigh and threats from others. To the church’s credit they received the rebuke from their pastor and voted to rescind his resignation.
Gerald Primm was a war hero and a hero of the faith, but to the ones who loved him and knew him the most he was a loving friend, pastor, mentor, husband, brother, son and father. ”

Once again, in a move reminiscent of Nazi Germany, the Obama camp has enlisted the Obama youth to fight moves by the NC legislature to improve voting integrity. From the Greensboro News Record April 4, 2011.

“Students from area universities have been working behind the scenes to protest the proposed voter ID bill that is currently in the House. They held a forum Monday morning to discuss the bill and followed it with a press conference to voice their concerns.

“This bill makes it more difficult for me to exercise my vote and my voice,” said UNCG junior Caleb Patterson. “The voter ID bill would add one more obstacle to vote, which will discourage students from voting.”

HB 351 would require voters to show photo identification, such as a driver’s license, military ID or a voter registration card. Identification cards such as those issued to college students would not be accepted.

“We are getting involved because we as young people are fighting for our right to vote, said N.C. A&T senior Mitchell Brown. “This is an assault on our voting rights.”

The bill is called the Restore Confidence in Government Act, but state Rep. Alma Adams said it does anything but.”

alias names, knowing that the names on the documents
were in fact not the birth name or legal name of the

“Veronica Arias, of Texas, reported on May 2nd, 2008 to
the ACSO that someone in Swepsonville, NC had
stolen her identity and was using same to be employed.

 Maria Sanchez was arrested on May 6, 2008 by
investigators of the Alamance County Sheriff’s Office
for stealing and using the identity of Veronica Arias.

 Sanchez used the name, SSN, DOB, of Veronica Arias
who is a living resident of Texas.”

The problem is that these two dim bulbs actually outed the Obama campaign in voter fraud as there are not enough people in North Carolina to get the “new voters” Obama claims are there.
Harry Smith apparently has not concluded that ACORN can not be registering all these “voters”. One can not just go into North Carolina and register EXACTLY 800,000 voters.

“Yet another state investigates the union-backed voter fraud group for Barack

A Durham (NC) official is asking state elections administrators to check approximately 80 voter registration forms for possible fraud.

Mike Ashe, Durham County’s elections director, said the forms were among about 4,000 submitted to his office over the past four to six weeks by a national left-wing group called Acorn, for Association of Community Organizations for Reform Now.

“They will be turned over to the State Board of Elections for investigation and prosecution,” Ashe said of the questionable documents.

Most of the forms at issue bear one of six names. Ashe was not sure whether the people named existed or not.

Many of the papers are incomplete, which Ashe said is a nuisance, not a crime. But the group contains very different versions of what are purportedly the same person’s signatures.

Signing another person’s name on a voter registration form can result in up to 15 months in prison.”

Those that don’t pass muster will be overturned, he said.

Character and agendas are revealed sooner or later. Eric Holder has revealed his. His timing could not be better. I can not say much and I do not know where this will lead, but I have been in touch with a prominent congressman in regard to Obama’s eligibility issues and corruption in the US Justice Department, in particular the protection of Obama in the Blagojevich investigation and trial.

“Think about that,” Holder fired back. “When you compare what people endured in the South in the 60s to try to get the right to vote for African Americans, to compare what people subjected to that with what happened in Philadelphia, which was inappropriate….to describe it in those terms I think does a great disservice to people who put their lives on the line for my people,” said Holder, an African American.

“To compare that kind of courage, that kind of action, to say some Black Panther incident is of greater concern to us, historically, I think just flies in the face of history,” the attorney general said.”
