Security union’s leader probed for possible fraud

Detroit— Federal agents are investigating allegations a labor boss stole money from a union whose members guard nuclear power plants, a NASA space center, auto plants and Detroit’s three casinos, The Detroit News has learned.

Racketeering and fraud investigators recently raided the Security, Police and Fire Professionals of America’s international headquarters in Roseville and the Troy home of labor leader David Hickey, according to federal court records obtained by The News.

Search and seizure warrants chronicle a quirky investigation that is focusing on the union’s finances and a labor leader who also performs as a popular magician.

Along with financial records, agents seized several cases filled with magic tricks, including a rubber dove, foam bricks and card tricks, according to federal search warrants filed in U.S. District Court in Detroit.

Agents probably suspect the magic tricks were purchased with money stolen from the union, said Peter Henning, a former federal prosecutor and current law professor at Wayne State University.

“If you find a bag of money, you take the bag of money. If you have a bag of tricks, then you seize the bag of tricks,” Henning said.

Hickey, 58, international president of the Security, Police and Fire Professionals of America, declined comment.

His lawyer, Robert Morgan, said agents were searching for evidence that Hickey may have stolen money from the union.

“I’m confident that when the government goes through all the records that there’s not going to be any basis to charge Mr. Hickey with the offense of embezzlement of union assets,” Morgan said.

He wouldn’t address why investigators seized Hickey’s magic tricks.

“The intriguing,” he said, “is intriguing.”

The investigation involves the investigators from the Labor Department’s Office of Labor Racketeering and Fraud Investigations. The agency targets labor racketeering and corruption in employee benefit plans, labor-management relations and internal union affairs, according to the office’s website.

Peer: Magic is Hickey’s life

At 24,519 members, the union is small, but important. The union bills itself as the country’s largest and oldest security police union in the United States.

Members work at almost half of the country’s 104 nuclear facilities — but at none of the Michigan sites — and guard NASA facilities including Cape Canaveral Air Force Station and Kennedy Space Center in Florida.

Its members work at Detroit’s three casinos and at General Motors Co. and Chrysler Group LLC facilities. The union also has members in Puerto Rico and Canada.

Hickey, who served as a union director and as secretary/treasurer before being elected president 12 years ago, was paid $156,639 last year, according to the union’s most recent annual report filed with the Labor Department.

The union’s total assets were almost $6.23 million last year, which included almost $4.7 million cash, according to the annual report.

“We have cooperated fully with the Department of Labor and will continue to do so,” said Gordon Gregory, the union’s general counsel.

The probe sheds light on Hickey’s life in the magic community. Gregory calls it a “hobby.”

In his free time, Hickey performs magic tricks using the stage name Dave Devin, friends said. He also invents and sells magic tricks and gags such as the Stretch-a-Buck.

Hickey’s stage name is listed as the resident agent of a company called Magical Promotions Unlimited, LLC, according to state business records. The company’s address is the union headquarters on Kelly Road in Roseville.

Magician Keri Kazz of Mount Clemens met Hickey through a local magic shop. He said Hickey is known as a consultant for magicians who specialize in close-up tricks that rely on sleight of hand.

“I want to say magic is his hobby, but it’s more like it’s his life,” Kazz said.

Hickey also invented and sells card tricks that are carried at area magic shops, including Wunderground Magic Shop in Clawson.

“He’s a guy who produces a lot,” Kazz said. “He’s definitely a creative mind.”

Home, union HQ raided

Hickey’s professional and private life collided late last month.

Federal agents armed with search warrants launched simultaneous raids March 28 at the union’s international headquarters and Hickey’s house.

Agents seized 43 items at the union headquarters, including Hickey’s personal expense vouchers, bank and credit card statements, a union financial summary, cash receipts and audit paperwork.

They also left with at least eight boxes or cases filled with magic tricks, foam bricks, ropes, a rubber dove, DVDs and magic-related items carrying the name “Dave Devin.”

Gregory, the union lawyer, wasn’t concerned that agents seized magic items stored at the union headquarters.

“I was puzzled, frankly, and well, that’s it,” Gregory said.

Labor Racketeering and Fraud Investigations Special Agent Megan Howell, who raided the union headquarters, could not be reached for comment and the U.S. Attorney’s Office declined comment.

While agents were hauling away Hickey’s magic tricks, others were raiding his home in Troy.

Agents seized two Apple computers, a camcorder, portable DVD players, a woman’s gold necklace and diamond charm, magic books and movies.

Union Vice President Mark Crawford said he knew about the raid at union headquarters, but not the Troy raid.

“We have nothing to worry about,” Crawford said. “These are routine investigations.”

Hickey’s job status has not changed as the probe continues.

“There is absolutely no basis for any action,” said Gregory, the union’s lawyer.

The raids didn’t stop Hickey’s magic career.

One day after the raids, Hickey served as master of ceremonies during a magic show at the Emerald Theatre in downtown Mount Clemens.

“First lady Michelle Obama pleaded with voters Tuesday to reward her husband with re-election, telling delegates at the Democrats’ convention that President Obama comes from humble beginnings but was able to reach the White House by taking advantage of the same kind of social safety net he defends on the campaign trail.

Democrats convened their nominating convention with a mix of sharp barbs against Republican presidential nominee Mitt Romney and his personal wealth, and a defense of Mr. Obama’s first-term record on everything from health care to gay rights.

Seeking to unify Democrats and win over independents with the inspirational story that powered Mr. Obama to an historic election in 2008, Mrs. Obama told delegates her husband is still pushing for the vision voters embraced four years ago.

She said also the president’s push for government programs is personal because they are the foundation he himself used to climb to the White House.

“Democrats pointed to a series of laws he’s signed, including health care and the Lilly Ledbetter Act, which overturned a Supreme Court decision and made it easier for women to sue over pay discrimination.

She also challenged Mr. Romney to take a stand on the Paycheck Fairness Act, which would open up still more opportunities to sue over pay discrimination.”

In opening the convention on Tuesday, delegates voted by voice to adopt their platform, becoming the first major political party to specifically endorse same-sex marriage as an option. As expected, they used the benevolent sounding phrase “Social safety net.” The Democrats are big on that and they should be. They are great job destroyers. However most of us want a safety net to be just that. Something to catch any of us if an exception occurs, not a substitute for jobs.

Obama and the Democrats are in bed with law firms and attorneys. That is why these statements were made.

The crowd at Occupy Greensboro was a fairly diverse group of people very different from the bulk of attendees at the Occupy Wall Street protest in NY City. Many of the Tea Party folks would have felt at home with signs blaming government. Of course the Che Guevarra flag  would not have been so inviting. I  am still watching the union and Obama camp involvement in NC and will continue to monitor it. Recently the ACLU was spotted near the University of NC at Greensboro with petitions against some form of job discrimination in NC. What they failed to mention is that NC is a right to work state. An employee can be fired for any reason. This keeps the unions out and companies in the state.

Morgan Freeman and other racists, most of the people in attendance were white since, duh, the majority of the population is.

Organizers and supporters of Occupy Greensboro say the protests of economic inequity happening across the country inspired them to put together a local event.

Organizers say it also inspired them to do it the right way.”

“The group rented space at the park and the neighboring YWCA parking lot to avoid the standoff with police that happened at Occupy events in Boston and New York.

“The city greatly reduced its rental fee for us — from $700 a day to I believe around $200,” Wright said. “And we’ll have the YWCA parking lot for camping, which is private property.”

Initially, some in the group argued protesters should simply occupy the park without paying rent — under the theory there would be too many people for police to eject.

“In the end, we decided it was more important to have a good relationship with the city and the police,” Wright said.

Wright, a 29-year old who coaches lacrosse at Grimsley High and Wake Forest, said this is the first protest movement in which he’s taken part.”

“Hundreds of protesters surrounded the Bank of America building downtown Saturday afternoon as part of the “Occupy Greensboro” protest.

“Banks got bailed out, we got sold out,” they chanted to the beat of a marching drum corps, raising handmade signs and unfurling banners.

“Lobbyists Eat the Constitution for Breakfast” read one.

“Eight Years of College and Laid off Twice,” another read. “Where’s My Bailout?”

Those who marched from the Phill G. McDonald Plaza to Festival Park said they were inspired by the movement that began on New York’s Wall Street and has spread all over the world.

Police Chief Ken Miller, who oversaw his officers at Festival Park and spent some time chatting with protesters, estimated the crowd at about 600.

Organizers had expected between 500 and 1,000 people.

Some of the targets of the protest: fraud in the financial industry, economic inequality, and elected officials who protesters said serve donors and lobbyists rather than the American people.

“It’s hard to live in America today without coming to the conclusion that our government and all of our institutions are for sale to the highest bidder,” said Michael Duncan, 22.

Duncan said he was lucky to find a job in computer technical support after he graduated from college two years ago — many of his friends didn’t.

But he was laid off just a few months later as the company he worked for downsized. He found another job after a few months but was laid off again within a year.

“Our economy is on the verge of collapse,” Duncan said. “And it’s because of a housing bubble created by bankers and people on Wall Street who sold us a bill of goods, defrauded the American people and then were bailed out by our government along with a lot of other major corporations as average workers were laid off, their pay cut, and their houses foreclosed.

“Anyone who isn’t angry about that hasn’t been paying attention.”

The demonstration remained peaceful. No arrests were made as of Saturday night.

The event’s organizers worked closely with police and city officials to be sure the demonstration would be safe, family friendly and nonviolent.”

“A few area elected officials and political candidates also were among the crowd, including at-large Greensboro City Council candidate Marikay Abuzuaiter and Guilford County Register of Deeds Jeff Thigpen.

Thigpen’s crusade against mortgage fraud and improper documentation by major national banks in Guilford County has gotten national media coverage.

“The people who started this aren’t the protesters,” Thigpen said. “They’re on Wall Street and they ran our economy into the ground. I believe in an America where there isn’t one standard for banks and another standard for the rest of us.””

Jeff Thigpen, the Guilford County Register of Deeds, is a good guy and a friend of mine. He has been doing some good work in the area of “robo signatures” and circumventing of chain of title in mortgages. However, he continues to repeat the party line in terms of placing the majority of blame for the economy and housing crisis on the lenders. More guilty in this sham are people like Chris Dodd, Barney Frank, Maxine Waters and Barack Obama in sync with organizations like ACORN who pressured banks to make loans to unqualified and risky borrowers. Jeff, I will be discussing that with you soon.

With the shock of a Republican leading a Democrat in the polls, some political observers believe the Massachusetts Senate race is ripe for fraud and abuse by an embattled Democrat Party.
 
In fact, some election watchdog groups have gone as far as issuing issued a warning that Tuesday’s Massachusetts special election to elect a successor to the late Senator Edward Kennedy is open to manipulation and voter fraud.
 
“It doesn’t help when a guy like Ed Shultz [an MSNBC host] angrily tells his viewers that if he lived in Massachusetts he’d vote 10 times to keep those bastards [Republicans] from winning,” said political strategist Mike Baker.
 
“These leftists believe they are righteous in their quest to win by any means necessary and that the law doesn’t apply to them,” adds Baker.
 
Some observers point to allegations that during the presidential election in November 2008, the New Black Panthers perpetrated voter intimidation with impunity and the Democrat-run U.S. Justice Department failed to investigate those allegations.
The latest polls show that Republican Scott Brown is leading Democrat Martha Coakley by as much as 51% to 46%, with Brown’s lead widening after President Barack Obama visited Massachusetts on Sunday to stump for the gaff-ridden Coakley campaign.

Watchdog groups are warning officials in Massachusetts — the bluest of the so-called Blue States — that they must increase security precautions for the Senate race.”

Scott Brown is leading in the absentee voting 58-42. 9% of registered voters said they have already cast a ballot.
