We await the appeal of Rod Blagojevich. He was convicted of most counts remaining after counts 1,2 and 4 were removed by the Justice Department. You know, the Justice Department headed by liar and Obama buddy Eric Holder. As reported here yesterday, denying the motion from the Blagojevich defense team to unseal recorded conversations that were wiretapped, appears to be a huge argument to support the appeal and possibly part of the setup. The question is, was Blagojevich picked as the fall guy or will he end up with a slap on the wrist?

“A Protective Order was entered on the evidence in this case on April 14, 2009. Blagojevich has made prior requests to release recordings and other evidence in this case (the most recent filing of this nature was on February 8, 2011, Pacer Document #602). The instant request is of a global nature and requests that the Protective Order be lifted in its entirety.”

“The defense is put in the disadvantaged position of having to examine all filings to be sure the Protective Order has not been violated. The defense must also carefully craft arguments in such a manner to not violate the Protective Order. This impairs counsel‟s ability to vigorously and zealously defend Blagojevich. Yet the government is not circumscribed at all by the Protective Order. It is a fundamentally unfair playing field.”

“A recent example: Blagojevich filed a Motion for Discovery to Obtain Contents of Missing Telephone Calls, which was heavily and painstakingly redacted prior to filing.”
“Indeed, the parameters for recording wiretapped conversations are such that the F.B.I. is only to record conversations that it believes are pertinent to the charges that form the basis for the wiretap authorization. With thousands of recordings, making up many hundreds of hours, one would think the government would seek to play as much as possible to meet its heavy burden of proof beyond a reasonable doubt. However, the opposite is true – the government has released and played in court only fractions of a fraction (approximately 2%) of the recordings. If Blagojevich has violated the law, as the government alleges, why would the government seek to keep the evidence under lock and key?”

“If the prosecution is indeed interested in the truth, and not just seeking a notch-in-the-belt conviction, then the government should not challenge this request to lift the Protective Order.”

Regardless of how this plays out, it benefits Obama. If there is no appeal or the appeal is denied, Blagojevich will be sequestered. If the appeal proceeds, it could drag out beyond impacting the 2012 election cycle. The intent is obvious.

When was the last time that a Republican, with a history of shady deals, corruption figure connections, tied to Rezko, Blagojevich, et al, indicted for corruption involving a teacher retirement fund and scheduled for trial soon, was not being scrutinized, examined under a microscope and found guilty in the press?

Can you imagine such a scenario?

We have one now in the indictment and upcoming trial of William Cellini.

This is being very much underreported.

Why?

Here is a pretty good summary of Cellini’s background from The Beachwood Reporter October 31, 2008.
“”William Cellini has spent four decades as Illinois’ ultimate insider, cozying up to Republicans and Democrats alike as he wielded power and influence while trying to stay out of the spotlight,” the Tribune reports.

“But the spotlight found Cellini on Thursday when a federal grand jury indicted the millionaire Springfield businessman and pulled him into the center of the ongoing probe of corruption in the administration of Gov. Rod Blagojevich.”

Cellini, in fact, is the most classic embodiment of the concept of the Combine – the notion that a group of insiders both Democrat and Republican control the spoils of running state government, regardless of which party is actually, nominally, in power.

“A onetime high school teacher, Cellini latched on to politics early, was elected Springfield’s commissioner of streets and public improvements and, by age 35, became transportation czar in Gov. Richard Ogilvie’s Cabinet. After officially leaving state government, he became an influential fundraiser and powerful lobbyist who headed up the Illinois Asphalt Pavement Association,” the Tribune notes.

“His power grew even more during Gov. James Thompson’s 14-year reign when he won state contracts, landed a riverboat casino license in Alton and put together a sweetheart hotel deal that turned into a lemon for taxpayers.

“Under Gov. Jim Edgar, Cellini’s sister, Janis, served as patronage chief, a coveted position overseeing personnel issues in a sprawling government that runs on friends and political favors.

“When George Ryan became governor, Cellini kept a grip on state government through longtime loyalists he spent years placing in sensitive positions.”

When the Democrats finally took the governorship, it didn’t matter, as we now see.

“When we’re in, we’re in,” he once said, as recalled by the Sun-Times today. “And when you’re in, we’re in. We’re always in.”

And who is “we’?

“His business partners are equally powerful men, including Victor Cacciatore, president of Lakeside Bank; Earl Deutsch, a longtime Democratic attorney who, with Cellini, created Commonwealth Realty Advisors, which invests about $1 billion in state pension funds; Michael Marchese, president of Harlem Irving Companies, and Richard Stein, senior managing director of Mesirow Financial’s real estate division.”

And that gang has close ties to Michael Madigan, Ed Burke, and, of course, Richard M. Daley.”

“The suits making speeches on TV aren’t real politics. They’re just the suits making speeches. It is the men on the inside who matter, flying below the radar to swoop down to the public trough and feed without much notice.””

I mentioned that the William Cellini trial has been underreported. Well, it is worse than that. When Cellini’s trial date was set on December 2, 2010, it was reported at Citizen Wells on December 10, 2010.

I noticed some time later that the Chicago Tribune article was no longer there. I then searched within the Tribune site and the internet. The article was gone. However, another Chicago site still has the story up.

Opening Statement

 

In a simpler, more sincere world, in a world of justice and fairness envisioned by our founding fathers, I would just ask that the evidentiary proffer be read, a few questions be asked and a grand jury convened to indict Patrick Fitzgerald and Barack Obama. The indictment of Fitzgerald would naturally lead to further indictments in the US Justice Department. This is not the world we live in today. Sadly, we live in an Orwellian world with no regard for the US Constitution and rule of law. A world where the end justifies the means.

We now know for a fact that there has been corruption and bias in the US Justice Department for years. Whistleblowers such as J. Christian Adams, a former Justice Department employee, and long time Democrat, civil rights attorney, Bartle Bull, have corroborated our suspicions. Judges, including Supreme Court Justices, a crucial part of our checks and balances within the Judicial Branch as well as the larger checks and balances of the executive and legislative branches, have acted in a manner that if not conspiratorial, certainly biased or apathetic. And now, one of the chief players in this chicanery, Barack Obama, is in control of Eric Holder, the Attorney General. 

A cursory reading of this evidentiary proffer reveals a completed puzzle picture, a large billboard that reads:

  • Barack Obama was enmeshed in the Chicago corruption of Rod Blagojevich and Tony Rezko and was a participant in the rigging of the IL Health Planning Facilities Board. This well planned board rigging, which took place over many months, was a large part of the indictment and trial of Tony Rezko and the early legal charges against Rod Blagojevich.
  • The facts and reference to this rigging have diminished over time in the Justice Department legal documents and prosecution pleadings.
  • The prosecution of Rod Blagojevich has been repeatedly delayed.
  • Why was Tony Rezko, a businessman, prosecuted first instead of Blagojevich, the governor?
  • Why was the first Blagojevich trial so short?
  • Why were neither Tony Rezko or Stuart Levine called as witnesses?
  • Why was Rod Blagojevich arrested after the 2008 election?

The questions go on and on, but the answer is simple.
To protect Barack Obama.

 The mainstream media and the US Justice Department have been protecting Obama since 2008. In the LTC Terry Lakin Court Martial last year, Judge Denise Lind addressed the opening up of evidence about Obama’s eligibility in this manner:  “opening up such evidence could be an “embarrassment” to the president.” An embarassment means that he is not president.

More states are addresing the issue of vetting presidential candidates during the election cycle. New Hampshire is one of those states.

“Presidential candidates who want to be on New Hampshire’s primary ballot next year may have to produce a birth certificate under a proposal being brought before a state House committee.

Election Law Chairman David Bates said his committee will consider a bill Wednesday to require candidates to provide a birth certificate and affidavit swearing they are at least 35 years old and have lived in the United States for 14 years, as called for in the U.S. Constitution to qualify for the presidency.

“They need to produce a certified copy of the long form of their birth certificate and an affidavit swearing to residency,” the Windham Republican said Tuesday.

New Hampshire holds the earliest presidential primaries and takes pride that its voters help launch contenders toward the White House.
Bates said the purpose of the bill is to ensure that only those truly qualified for the presidency are on the ballot. He emphasized that the measure was not aimed at President Barack Obama, and said he may seek to make the bill effective in 2013 after the next election. If New Hampshire sought to make the requirement effective immediately, “then we’ll have a circus,” he predicted.

Meanwhile, House Republican Leader D.J. Bettencourt issued a statement against the measure.

“It is unnecessary and detracts from important business, namely our economy,” he said. “Moreover, this potential amendment could represent a threat to our first in the nation primary as it gives other states reason and desire to try to jump us in line.””

“A bill signed by 94 state House members would require all presidential and vice presidential candidates to present a birth certificate to the Georgia Secretary of State’s Office before they can be put on the statewide ballot.

The Presidential Eligibility Assurance Act, House Bill 401, would demand of each candidate a long-form birth certificate, a sworn statement that the candidate has never been a citizen of another country and a confirmation that the candidate has lived in the U.S. for the previous 14 years.

 During the 2008 presidential elections, allegations were raised that then-candidate Barack Obama was not a U.S. citizen, which spurred him to release documentation from Hawaii confirming his birth in that state.

Rep. Mark Hatfield, R-Waycross, the lead author on the bill, is skeptical of the documentation.

The document is a certificate of live birth from the state of Hawaii, valid for use in court proceedings and is considered by Hawaii a legitimate birth certificate.

But Hatfield called on Obama to release the actual piece of paper issued at his 1961 birth.

“I’m saying I don’t know where Obama was born,” said Hatfield. “It’s not just an Obama question.

It seeks to fill the void left by Congress” in enforcing Article II of the Constitution on presidential eligibility.”

Please understand that I am dealing with recalcitrant leadership which will not allow the bill to move through the committee process. We are trying to get the bill dislodged from subcommittee, and this proposal was made in an attempt to get the House leadership to allow the bill to be considered. The bill would not be required to stay in this form, but we have to try something to get the bill moving. If we don’t get some movement right away, the bill will be dead for the year. You don’t need to convince me that Obama needs to be subject to a law requiring proof of eligibility; I believe it wholeheartedly and have been actively advocating for it for years. Your efforts would be better spent contacting the leadership of the Georgia House and demanding that the bill be allowed to move. Nothing short of massive public outcry is going to get their attention it seems. I would appreciate your efforts and continued support of the bill.”

Patrick Fitzgerald has zero credibility with me. However, with rats jumping ship left and right, will Fitzgerald throw Obama under the bus?

“Moments after a rare setback, a chastened U.S. Attorney Patrick Fitzgerald was acting nothing like the swaggering prosecutor who just 20 months earlier proclaimed he had arrested a sitting governor to stop a political crime spree.

He would not take questions from reporters about his office’s failure to convict former Gov. Rod Blagojevich on 23 counts against him, winning a guilty verdict only on a single count of lying to the FBI,  among the least serious of the charges he faced.

Instead, Fitzgerald vowed to retry the case, then quickly ending his news conference.

“So, for all practical purposes, we are in the mode of being close to jury selection for a retrial,” he said.”

What unholy alliance prevented Tony Rezko from being called as a prosecution witness? Was it a pact between Rezko, Blagojevich and Obama? Is the US Justice Department complicit in a coverup? Was there pressure from entities in the Middle East? Perhaps a combination of those forces. In Blagojevich’s own words.

“As his sentencing nears, pressure is mounting on Tony Rezko to cooperate with federal investigations into some of the highest-profile politicians in the state — including Gov. Blagojevich.”

“A federal judge this morning officially postponed the sentencing of political fund-raiser Tony Rezko as he continues his discussions with the government.

U.S. District Judge Amy St. Eve indefinitely delayed Rezko’s Oct. 28 sentencing date and told the parties to meet again for a status in the case in December.
The sentencing, originally scheduled for Oct. 28, just before the election, was likely to bring unfavorable publicity to Rezko’s onetime friend Democratic Presidential nominee Barack Obama.

Prosecutors and Rezko lawyers said this morning they did not want to set a future date for sentencing.

Rezko lawyer William Ziegelmueller said they sought the delay to “work together to agree to otherwise narrow differences at sentencing.”

The agreement comes as Rezko is talking to federal prosecutors. The Sun-Times first reported Rezko’s meetings with the feds in August and sources close to the investigation later confirmed the talks last month.”

“Randall Samborn, spokesman for Fitzgerald, told The Examiner that Rezko “remains in federal custody,” although admitting that he didn’t know exactly where the convicted businessman was being held. Samborn also confirmed that “there is no sentencing date,” but would not elaborate. Sources in Chicago tell us that the long delay is “very unusual.””

“Is Rezko being held at another prison facility for his own safety? There are plenty of people in Chicago and Washington who might not want Rezko on the witness stand. They include:

Democratic Senate candidate Alexi Giannoulias.

Rezko was such an enthusiastic customer of Giannoulias’ failing Broadway Bank that he wrote $450,000 in bad checks against his account to pay off gambling debts.

Alderman Eddie Burke

Rezko hired Burke’s law firm to get a 77 percent reduction in the real estate taxes of a 62-acre property along the Chicago River he planned to develop using $140 million in city subsidies. After assuring the Chicago Board of Ethics that he would abstain from any Council votes on Rezko’s project, Burke voted for it anyway, blaming his conflict of interest on “an error.” The project was later abandoned.

President Barack Obama

Rezko was the president’s “real estate fairy,” as one Chicago columnist likes to put it. Remember how they bought a house together in Chicago? Rezko was one of Obama’s earliest and biggest fundraisers and donors. Obama was one of his go-to guys for housing legislation in the Illinois state Senate.

It is understandable why the Blagojevich defense team does not want Rezko on the stand. Judge Zagel’s comment about Rezko being a bad witness is at least horsecrap and reeks of conspiracy. Convicted felons of all categories are regularly used as witnesses. Stuart Levine, the key witness in the Rezko trial was not only enmeshed in corruption but was a long time drug user.
Here are the approximate number of times that “Rezko” is mentioned in US Justice Department documents.

Indictment:  100 times.

Criminal complaint:  170 times.

Evidentiary Proffer:  288 times.
Even if a strong argument is made against using Rezko as a witness, and good luck with that argument, Stuart Levine was used extensively as a witness in the Rezko trial, and his name was mentioned approx. 146 times in the Blagojevich Criminal Complaint. And don’t forget, Blagojevich’s name was mentioned at least 30 times on one day of the Rezko trial.

Patrick Fitzgerald, I am damn angry and am speaking up about US Justice Department corruption.

Those are interesting statements by Fitzgerald.

The question is, why did Patrick Fitzgerald and the US Justice Department wait until December 2008 to arrest Rod Blagojevich?

The prosecution in the Rod Blagojevich trial rested their case Tuesday, July 13, 2010.

Tony Rezko has not been called to the witness stand. Nor has Stuart Levine. Nor have a host of others with corruption ties to Blagojevich and Obama.

The US Justice Department had plenty of evidence indicting Rod Blagojevich by 2006. Why did the US Justice Department wait until December 2008, after the election, to arrest Blagojevich?

Who made the decision to wait to indict Blagojevich?

Was Patrick Fitzgerald involved in this decision?

I think that would be irresponsible.” Yes, Fitzgerald, I agree.

June 7, 2004: Stuart Levine, a longtime Republican reappointed to the powerful Illinois Health Facilities Planning Board, abruptly resigns on the eve of several important hospital expansion votes. The revelation is the first indication that the Blagojevich administration is under federal criminal investigation.

June 27, 2004: The Tribune discloses that an official for one hospital seeking permission to expand was wearing a federal bug during meetings in an effort to expose extortion attempts by Levine and others for contributions to Blagojevich.

July 2, 2004: Levine resigns from his seat on the board of the state Teachers’ Retirement System. It remains undisclosed that federal authorities had secretly taped Levine’s conversations.

May 9, 2005: Levine is indicted on corruption charges. Federal subpoenas are issued to numerous administration sources, including top Blagojevich fundraiser Antoin “Tony” Rezko

Before the Tony Rezko trial began in March 2008, the USDOJ and the FBI had more than enough to arrest Blagojevich and plenty on Obama. Stuart Levine had already provided the information revealed in the trial and more.

Kenneth J Conner was a whistleblower in the Rezko Obama lot sale transaction. Conner was interviewed by the FBI in 2007.

The real estate specialist, Kenneth J. Conner, said bank officials replaced an appraisal review he prepared on the property and FBI agents were investigating in late 2007 whether the Rezko-Obama deal was proper.

“Agents and I talked about payoff, bribe, kickback for a long time, though it took them only a short number of minutes of talking with me while looking at the appraisal to acknowledge what they already seemed to know: The Rezko lot was grossly overvalued,” Mr. Conner told The Washington Times Monday.

“Rezko paid the asking price on the same day Obama paid $300,000 less than the asking price to the same seller for his adjacent mansion,” he said. “This begs the question of payoff, bribe, kickback.””

By delaying the arrest of Blagojevich, two important things occurred.

More harm was done to the citizens of Illinois.

Obama was spared prosecution and association with crime figures. This allowed Obama to win the election.

Before the Rezko trial ended, the Illinois senate attempted a recall against Blagojevich.

Why wasn’t Blagojevich arrested by then?

March 21, 2008

“Stuart Levine thought he had hit the jackpot when he teamed up with Antoin “Tony” Rezko, the fundraiser for Gov. Rod Blagojevich who seemed to be able to get the administration to do anything he wanted. Levine’s third day on the stand at Rezko’s corruption trial was a sometimes wandering exploration of how Levine and Rezko exploited that immense clout in a variety of schemes to allegedly line their pockets.

“I have never been in a better position than I am right now,” Levine was heard bragging on a government wiretap. “Part of the reason is because there’s never been such tight control of the central apparatus. This guy is making decisions ? and can get anything done that he wants done.””

“But Blagojevich’s name has been mentioned often. It was brought up at least 30 times Wednesday morning by Stuart Levine, the government’s star witness against Rezko.

At one point, Levine described a flight from New York that he shared with Blagojevich Oct. 29, 2003. Levine had chartered the plane to ferry Blagojevich and others to a series of fundraisers.

On the return to Chicago, Levine said he took the opportunity to thank Blagojevich for re-appointing him to a seat on a state hospital regulatory board that prosecutors now say he and Rezko had corrupted to extort kickbacks from firms seeking regulatory approval.

Levine said the governor responded, “Never discuss any state board with me, discuss them with either Tony Rezko or Chris Kelly.” Kelly, along with Rezko, was a top fundraiser for Blagojevich as well as a close friend.

Then Levine said Blagojevich added: “But you stick with us and you’ll do very well for yourself.”

Asked by a prosecutor to elaborate, Levine said, “I took that to mean you have an opportunity to make a lot of money.””

Even if the USDOJ was waiting for the Rezko trial to end. It ended in June 2008, well before the election.

Obviously they did not need Rezko’s testimony.
It is obvious from the above that the feds had plenty on Blagojevich.

Fitzgerald did not wait years to go after Libby and Rove.

It is apparent to me that a deal was struck with the US Justice Department and that Patrick Fitzgerald was involved in the decision or minimally, was aware of it. The Justice Dept. had more than enough evidence to indict Blagojevich at the latest by the time Stuart Levine agreed to cooperate by August 5, 2006. They actually had enough wiretap evidence without Levine cooperating. Once Blagojevich was too tainted by investigation and Obama was being groomed for the presidency, Obama had to be protected.

Let me make this perfectly clear. I am accusing the US Justice Department of corruption, of being complicit in delaying the arrest of Rod Blagojevich until after the 2008 elections. Furthermore, the Justice Department has purposefully reworded the Indictment and refrained from calling witnesses and revealing testimony that would be further damning for Blagojevich and Obama. This is a criminal act which must be prosecuted.

I am calling for a congressional investigation.

I am also calling for more whistleblowers to come forward. Your identity will be protected.
