“The federal judge presiding over the retrial of former Gov. Rod Blagojevich ruled today that he intends to keep the names of jurors secret until after the verdict and won’t publicly release the written questionnaires they fill out.

U.S. District Judge James Zagel said he intends to destroy the questionnaires to “help ensure full candor of responses.” He took the same action after the first trial last year.

The judge also said he would identify jurors by number during the trial and only release their names eight hours after the verdict is returned. He released the names moments after the verdict was announced last time.

Zagel wasn’t specific about why he made the change, writing, “Incidents occurring after juror names were released following the first trial counsels the wisdom of providing a short delay in releasing jurors’ names, even after the verdict is returned.””

“Attorneys for Rod Blagojevich filed a pretrial motion Tuesday seeking what they claimed was missing evidence in the impeached Illinois governor’s corruption trial, including records of a phone call between a Blagojevich aide and then White House chief of staff Rahm Emanuel.

The motion claims the telephone conversation took place just a day before Blagojevich’s December 2008 arrest on charges that include allegations he sought to sell or trade the appointment to President Barack Obama’s vacated Senate seat for personal gain. The motion says details of that conversation could bolster a defense contention that Emanuel, who has not been accused of any wrongdoing, was willing to help with a political deal in which Blagojevich would have named Illinois’ attorney general to the seat.

But the call between Emanuel and then Blagojevich chief of staff John Harris is not among hundreds of transcripts of secret FBI wiretaps recorded before Blagojevich’s arrest. The defense motion points only to circumstantial evidence that it even happened, including a reference in a White House transition-team report from after the arrest that said Emanuel had “about four” conversations with Harris. The defense was given records of only three conversations, according to the motion.

“The fourth and final phone call is the call that is mysteriously missing,” it adds. “Piecing together multiple documents after the first trial, Blagojevich uncovered the fact that the December 8th phone call … took place.”

A message seeking comment left on a voicemail overnight at the U.S. attorney’s office wasn’t immediately returned.

Blagojevich faces 23 charges at his April retrial, after jurors at his first trial last year agreed only on one of 24 counts and convicted him of lying to the FBI. Both prosecutors and defense attorneys have been ordered to file all pretrial motions by next week.

The defense’s latest filing comes just two weeks before Chicago’s mayoral election. Emanuel has a considerable fundraising advantage and leads in polls in the race to replace retiring Mayor Richard Daley.

Emanuel has said little about the Blagojevich case publicly, often citing the ongoing legal proceedings for not commenting in detail. The White House report released in 2008 by the then president-elect’s office concluded neither Emanuel nor anyone else on Obama’s staff had had any “inappropriate discussions” with Blagojevich or his aides.

It found that Emanuel had had “one or two telephone calls” with Blagojevich and “about four” with Harris, who testified for the government at Blagojevich’s first trial.”

““This case is upside down. They lied about me. They couldn’t prove a single corruption allegation, and we didn’t even put a defense on,” Blagojevich said.
A jury deadlocked on 23 of 24 counts against Blagojevich last month, convicting him only of lying to FBI agents. Federal prosecutors are going forward with a second trial on the other 23 counts – including allegations that he tried to sell or trade an appointment to the U.S. Senate seat vacated by President Barack Obama.
Blagojevich calls it a “grim” duty to have to prepare and go to trial for a second time on April 20.”

It will be a grim duty alright if the US Justice Department and federal prosecutors actually present a real case this time. A case that will touch Obama.

An Obama campaign official, who spoke on condition of anonymity, said the headquarters will open this spring.

The news came as senior adviser David Axelrod prepares to leave the White House and return to Chicago soon after the president’s State of the Union speech on Tuesday in order to spearhead the re-election bid.

As recently as late last month, White House officials said Obama had not decided where to locate his re-election headquarters. Observers, though, expected him to pick Chicago.
The decision bucks recent history. Every two-term president in the last 30 years — George W. Bush, Bill Clinton and Ronald Reagan — set up his re-election campaign offices near the White House or in suburban Virginia.”

“Rahm Emanuel may have retained his spot on the mayoral ballot, but he’s also kept a spot in another, less desirable place — a federal subpoena.

An attorney for former Gov. Rod Blagojevich said Emanuel remains under defense subpoena for the upcoming retrial, scheduled for April 20.

“It’s certainly possible we would call Rahm Emanuel as a witness,” Blagojevich attorney Sheldon Sorosky said.

Sorosky said at the direction of U.S. District Judge James Zagel, all the subpoenas issued in last summer’s first Blagojevich trial would be still valid in the second trial.

Emanuel, who was captured on tape in conversations with Blagojevich and his staff, was not called as a witness in the first trial where Blagojevich was convicted on just one of 24 counts.

But Sorosky said if the government opens the door in this go-around, Emanuel could take the stand.

“We’d have to see just what evidence the government presents,” Sorosky said.

Defense lawyers have said that Emanuel would be of interest to them because they believe he would testify that nothing nefarious took place in his conversations with Blagojevich or his staff in late 2008. Emanuel is not accused of wrongdoing.

While Emanuel was captured on some recordings made in the course of the investigation into Blagojevich, none were played at trial.

In one of those recordings, Emanuel appears to be asking Blagojevich for a favor involving Emanuel’s soon-to-be-vacant congressional seat, the Chicago Sun-Times reported in 2009. Emanuel, who was working as President Obama’s chief of staff, would not answer questions at the time.”

When the story of the alleged missile being fired off the coast of southern California northwest of Catalina Island broke recently, I decided to wait for the truth and straight answers. Well, I have not received a straight answer yet.

“Military and aviation officials say they don’t know who may have launched a mysterious object spotted in the sky late Monday off the Southern California coast, but said that whatever the projectile was, it did not pose a threat to national security.

A KCBS news helicopter spotted what appeared to be a missile traveling through the sky northwest of Catalina Island, about 35 miles west of Los Angeles.

Video posted online by the television station showed a luminous point hurtling through the sky followed by a long contrail.

Officials with the Defense Department, the Navy and the Air Force said did not have any details on the object or its launch site. Pentagon officials said that initial indications were that the military was not involved.
“We are aware of the unexplained contrail reported off the coast of Southern California yesterday evening,” according to a statement from the North American Aerospace Defense Command and the U.S. Northern Command, which operates the U.S. and Canadian missile warning system. “At this time, we are unable to provide specific details but we are working to determine the exact nature of this event.”

“We can confirm that there is no indication of any threat to our nation and we will provide more information as it becomes available,” the statement said.

The Federal Aviation Administration didn’t approve any commercial space launches in the area Monday, said spokesman Ian Gregor.”

Is our government lying to us again?

I am not saying or implying that a UFO was involved. However, after listening to all the denials, I was reminded of an incident from 1966 off the coast of Catalina Island.

“There’s a new lawyer and a new, still-unreleased strategy being developed for a career doctor in the Army who is challenging the president to prove his eligibility to be commander in chief, and therefore document the validity of the orders under his command.

The move is being made by Lt. Col. Terrence Lakin, whose most recent hearing in the military judiciary found the judge essentially concluding that he would be allowed to argue only two points at a court-martial: whether he was issued orders and whether he followed them.

According to the American Patriot Foundation, which has been running the Safeguard our Constitution website and working in support of Lakin, that work will continue with minor modifications.

Specifically, officials confirmed links to a defense fund set up for Lakin will continue to provide the public an opportunity to have a hand in an issue that the officer considers so serious it’s worth endangering his career.
Neither Lakin nor his new attorney, who according to online reports is Neal Puckett, could be reached immediately for details.

But the firm’s website said Puckett served as a ground combat officer for the U.S. Marine Corps and for some time, the firm’s sole focus was military law.

The American Patriot Foundation, in its announcement, said Lakin is repositioning his forces and will be focusing for the next several weeks on the court-martial, scheduled now for Nov. 3-5.

“LTC Lakin is consistent in continuing on the same path that he announced publicly six months ago when he released his first YouTube video – and consistent with his military training, to continue to request assurance from Pentagon leadership that his military orders, including his deployment orders to Afghanistan, are legal – authorized at the highest level by a commander-in-chief who is constitutionally eligible, per Article II, Section 1 of the U.S. Constitution,” the foundation confirmed.

“As a medical officer and not a lawyer or constitutional scholar, LTC Lakin is not laying claim to be the sole arbiter of the president’s constitutionality in attempting to determine, without any genuine evidence to make such a determination, the president’s ‘natural born’ citizen status,” the organization said.

“The burden of proof rests solely on Barack Obama to demonstrate to the American people and to the U.S. armed forces that he commands, that he is lawfully serving in his current capacity as head of the executive branch of the federal government,” the foundation said.

The foundation said Army prosecutors, along with the acting judge in the case, Denise Lind, have “made this determination of the commander in chief’s eligibility under the Constitution impossible – by denying discovery – and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges.””

Judge Lind decision flawed, Defense of LTC Terrence Lakin, White paper

Courts Martial Defense of LTC Terrence Lakin September 3, 2010 researched and Prepared by J.B. Williams and Timothy Harrington

We find foundational flaws in Col. Lind’s decision, which Lakin’s defense team must seize upon in orderto alter the current course of this trial.

  • Lind’s authority is derived from the same place as LTC Lakin’s and all other members of the United States Military – from the supreme command of the office of Commander-in-Chief, the President of the United States.
  • Lind is attempting to use her authority under her Commander-in-Chief to break the military chain of command, isolating the Commander-in-Chief of the US Military specifically, exempting the President from his position of authority in the chain of command, without which, Lind herself has no authority to convene the Courts Martial.
  • Lind then reaches outside of the US Military Justice system to the Civil Court, relying upon civil court precedent to deny Lakin any access to discovery and thereby, a proper defense guaranteed him by the US Constitution and UCMJ, Uniform Code of Military Justice. Civil Court precedent has no legal standing in a UCMJ criminal proceeding. In fact, the UCMJ is based upon the Articles of War (aka War Articles) and is a “penal system” unlike the US Justice System – as explained by Col. William Winthrop in Military Law and Precedents. As a result, precedents set in courts outside of the UCMJ are without legal standing in any UCMJ proceeding.
  • Not even in the UCMJ can the United States government deny the accused his/her right to a trial, complete with discovery of related evidence. Yet Lind attempts to do so, under the authority derived from her Commander-in-Chief. If the chain of command is broken, then Lind herself has no authority.
  • Lind’s statement that the legality of the Commander-in-Chief is “not relevant” in matters ofmilitary command is false on its face. As stated in a sworn affidavit filed by LTG Thomas G. McInerney executed on August 20, 2010 – “In refusing to obey orders because of his doubts as totheir legality, LTC Lakin has acted exactly as proper training dictates. – By thus stepping up to the bar, LTC Lakin is demonstrating the courage of his convictions and his bravery. – That said, it is equally essential that he be allowed access to the evidence that will prove whether he made the correct decision.”
  • Lind attempts to break the chain of command at The Pentagon level, which she claims has no issue with the current Commander-in-Chief and that this should be good enough for Lakin. Yet she cannot break this chain of command without eliminating her own authority, and Lakin’s oath requires that he decide for himself whether or not his orders are legal, as affirmed in LTG McInerney’s sworn affidavit.

At issue is not whether or not LTC Lakin refused orders, but rather whether or not he “unlawfully” refused orders. If his orders were not “lawful,” including but not limited to, emanating from a “lawful”chain of command which begins with a lawful Commander-in-Chief, then Lakin must be found NOTGUILTY of “unlawfully” refusing orders.

“The judge who presided over Rod Blagojech’s corruption trial says he’ll likely set the retrial for early January and reiterated that he probably won’t allow the former governor to have more than two taxpayer-funded lawyers.

Judge James Zagel said today he would be open to allowing more attorneys if they volunteered their time, or allowing attorneys paid for by a benefactor.

Zagel said the trial date will likely be the first week of the new year, but not on Jan. 3, just after the New Year’s holiday.

The judge said the date revolves around the complications of getting a jury selected. That process lasts six to eight weeks, and begins with a questionnaire on whether prospective panelists can serve on a lengthy trial.

If that process started immediately, opening statements would be given in October and  jury deliberations could run into the holidays, Zagel said.

“We have a certainty that we’re dealing with deliberations in the last half of December, and that’s a bad time to do it – a distracted jury,” Zagel said.

A delay until January also will allow some of the publicity surrounding the case to die down, he said, and will lead to a jury pool that includes people who have a general memory of the case but not a specific one.”

“After the hearing, Blagojevich lawyer Sam Adam Sr. disputed reports that he and his animated lawyer son, Sam Adam Jr., had decided not to represent the former governor at a retrial.

Adam Sr. said he, his son and the other lawyers representing Blagojevich would discuss the makeup of the legal team for a second trial with their client, but allow him to make the final call on who stays and who goes.

Adam Sr. said everything would be on the table, including the possibility of seeking a plea deal, though he acknowledged that wasn’t likely since Blagojevich has said in recent media interviews that he would not do so.

“I have never discussed a possible plea with the government,” he said, stressing that prosecutors have never broached the idea of a deal either. “But I’ll discuss anything.”

“It’s up to him,” Adam Sr. said of Blagojevich. “He’s the client. Whatever he thinks is best we’ll do.”

And Adam Sr. said he would even consider remaining on the legal team and working for free if Blagojevich asked him to. “I’m prepared to do anything the client wants, including working for free. He’s our friend and he’s our client. ”

“Here’s what Fox local news in Chicago reports:
Jurors who have been interviewed so far will not identify the juror, other than to say the juror was a female.
FOX Chicago News reported that speculation is centering on juror Jo Ann Chiakulas of Willowbrook, after a second-hand acquaintance said that she has been saying for weeks that she would find Blagojevich not guilty.

Chiakulas is a retired director from the Illinois Department of Public Health.

Contacted Tuesday night, she told FOX Chicago News she would call on Wednesday if she wished to talk about the case.

On one count at least, Chiakulas voted with her fellow jurors, agreeing to convict Blagojevich of lying to federal agents.

Note that that is not yet confirmed. It is now confirmed by CBS local news Chicago.

They actually could have reported more — because pre-trial, they had this to say about a female “retired public health director” on the jury panel:
Juror # 106, a black female believed to be in her 60s, is a retired state public health director who has ties to the Chicago Urban League. She has handed out campaign literature for a relative who ran for public office. She listens to National Public Radio and liberal talk radio shows.

Media accounts mention the campaign literature, but they don’t mention NPR and liberal talk radio. Why?

We know they read this description — why do they end their repetition of it at that point?

The media is quick to stereotype conservative-tilting Americans and attribute to them bad motives.

Think they’ll do the same here?

What were her motives for so egregiously ignoring the law to set a guilty man free that her fellow jurors had to confront her with her own oath to render a true verdict?

This information surprises none of us. For the far left, the guiding principle seems to be the end justifies the means.

This woman is no worse than the judges, election officials and others who have ignored the US Constitution to justify the end.

And furthermore, this may be a blessing in disguise. For starters, this has highlighted the weak case of the prosecution and the failure to present a smoking gun, aka, Tony Rezko. This also brings more attention to the case and thus Obama and his fellow thugs and cronies. The prosecution may actually have to step up to the plate and present evidence. And who knows, perhaps Patrick Fitzgerald will unhitch his wagon from a falling star. And of course, it presents another platform for me and others to reveal the truth about Blagojevich and Obama. 

Perhaps the hand of God touches this.

“Moments after a rare setback, a chastened U.S. Attorney Patrick Fitzgerald was acting nothing like the swaggering prosecutor who just 20 months earlier proclaimed he had arrested a sitting governor to stop a political crime spree.

He would not take questions from reporters about his office’s failure to convict former Gov. Rod Blagojevich on 23 counts against him, winning a guilty verdict only on a single count of lying to the FBI,  among the least serious of the charges he faced.

Instead, Fitzgerald vowed to retry the case, then quickly ending his news conference.

“So, for all practical purposes, we are in the mode of being close to jury selection for a retrial,” he said.”

“Lawyers in the case are to be back in court Aug. 26, possibly to pick a retrial date. Prosecutors are expected to push for the case to be back before a jury this fall, while the defense is likely to drag its heels and promised to appeal the single count the former governor was convicted on.
While gaining a conviction of the former governor on one count, the result of the trial was a far cry from the sweeping convictions in public corruption cases that Fitzgerald and his prosecutors have grown accustomed to. In his nine years at the helm of the prosecutor’s office here, Fitzgerald has secured guilty verdicts for an array of public officials, ranging from aldermen to the patronage chief for Mayor Richard Daley to Blagojevich’s predecessor as governor, Republican George Ryan.
The government case against Blagojevich was a vivid example of how slowly the wheels of justice can grind in public corruption cases. Blagojevich was arrested just weeks after he allegedly began plotting to sell Obama’s Senate seat, but federal agents had been probing wrongdoing in the governor’s administration since at least 2004 — his second year in office — and questioned Blagojevich for the first time in 2005 during his first term.”
