Here is the latest update from Philip J Berg Dated December 4, 2008:

“We understand everyone is eager to learn what occurred on December 1, 2008, at the U.S. Supreme Court. There is a rumor claiming Mr. Obama was Court Ordered by Justice Souter to turn over his birth certificate by December 1, 2008. This is NOT true.

When a Petition for a Writ of Certiorari is filed the Defendants automatically are given thirty (30) days to respond. They are not required to respond. The end of thirty (30) Days in the Berg v. Obama case was December 1, 2008. Keep in mind, the Defendants could have mailed in a response to the Petition for Writ of Certiorari and the Court allows approximately a week for mail. If this is the case, the envelopes must be postmarked December 1, 2008.

In the afternoon, December 1, 2008, Lisa, Mr. Berg’s Assistant contacted the U.S. Supreme Court and spoke with the Clerk. The Clerk informed Lisa Mr. Berg’s Petition for Writ of Certiorari would be distributed to all nine (9) Justices and a conference should be set within ten (10) days. As I’m sure you are aware, during the conference the Justices will discuss Mr. Berg’s Petition for the Writ of Certiorari and decide whether or not to grant or deny the Petition. It only takes four (4) out of nine (9) Justices to agree to grant Mr. Berg’s Petition for Writ of Certiorari. The Justices can also make other Orders during the Conference.

Mr. Berg’s Office also learned the Solicitor General is only representing the Federal Election Commission

Hospital after Hospital – all Have No Record of Obama being born or Mom Ever being There. 
Hospital after hospital in Honolulu all have NO RECORD of Obama or mother ever being there.   Is this some state secret? Are we to believe that even the hospital that he was born in should remain secret? Why lie to us as if it matters I mean the man did win the Presidential vote? Why the lies and secrecy?

We already know that Obama’s family and the entire nation of Kenya (which is about to have a national holiday for Obama) know that Barack Obama was born in Mombasa Coastal Hospital in Kenya. The government of Kenya has sealed these records.  More and more secrecy due to the fact that once proven, Obama will not be constitutionally allowed to become President of the United States!

All of these were called from November 20 – December 2nd 2008. It is confirmed, OBAMA not born in any hospital in Honolulu County! NONE FACT!

The founding fathers set up guidelines for presidential elections and laid out the rules in the US
Constitution and subsequently Federal Election laws. There are two aspects that stand out about the
rules. First, the eligibility requirement for president is defined. But even more clear than
presidential eligibility, the powers given to the states are clearly defined. The states are given
control of the election process through the vote by the Electoral College Electors. The state
election laws vary widely and regardless of how explicit and detailed they are written, they all
fall under the guidelines and rules of the US Constitution. The ultimate objective is to elect a
qualified president. All laws and procedures must work to that end. The Electoral College Electors
are bound to uphold the US Constitution and therefore must only vote for a constitutionally
qualified candidate.

State laws have evolved out of tradition and indeed tradition drives many procedures and opinions
about allowing candidates on ballots and proceeding through the election process to being chosen
by Electoral College Electors. Allowing candidates to appear on ballots from instructions by major
political parties has evolved into many variations by state. The political parties are given no
special powers in the US Constitution. It is clear that each state has the full power and obligation
to ensure that a candidate running for president is qualified to hold office. To do otherwise
threatens to disenfranchise a myriad of voters. The citizens of each state expect state officers and
election officials to protect them and their votes.

It is clear that the states have been given the power to control the election process through the
Electors vote. Some states have recognized their power to challenge eligibility in state laws. It is also
clear in the Tenth Amendment to the US Constitution, part of the Bill of
Rights, that any powers not reserved for the federal government or the states, are reserved for the
people. Any state taking the position, incorrectly, that they have no power to challenge the
credentials of a presidential candidate have relinquished that power to their citizens.

One thing is clear from the research I have done. There is much confusion and misunderstanding about
the election process and responsibilities. As stated above, tradition is a huge driving force. I have
reviewed the US Constitution, Federal Election law and many state election statutes. I have also read
legal opinions and writings from constitutional experts. Below are federal and state laws and the major
players who have responsibilities in governing elections, state officers and election officials, judges
and congressmen.

North Carolina

NC Statute § 163-114.  Filling vacancies among party nominees occurring after nomination and before election.

“If any person nominated as a candidate of a political party for one of the offices listed below (either in a primary or convention or by virtue of having no opposition in a primary) dies, resigns, or for any reason becomes ineligible or disqualified before the date of the ensuing general election, the vacancy shall be filled by appointment according to the following instructions:

Georgia

§ 21-2-5.  Qualifications of candidates for federal and state office; determination of qualifications

(b) The Secretary of State upon his or her own motion may challenge the qualifications of any candidate at any time prior to the election of such candidate. Within two weeks after the deadline for qualifying, any elector who is eligible to vote for a candidate may challenge the qualifications of the candidate by filing a written complaint with the Secretary of State giving the reasons why the elector believes the candidate is not qualified to seek and hold the public office for which he or she is offering. Upon his or her own motion or upon a challenge being filed, the Secretary of State shall notify the candidate in writing that his or her qualifications are being challenged and the reasons therefor and shall advise the candidate that he or she is requesting a hearing on the matter before an administrative law judge of the Office of State Administrative Hearings pursuant to Article 2 of Chapter 13 of Title 50 and shall inform the candidate of the date, time, and place of the hearing when such information becomes available. The administrative law judge shall report his or her findings to the Secretary of State.”

Florida

102.168  Contest of election.–

“(1)  Except as provided in s. 102.171, the certification of election or nomination of any person to office, or of the result on any question submitted by referendum, may be contested in the circuit court by any unsuccessful candidate for such office or nomination thereto or by any elector qualified to vote in the election related to such candidacy, or by any taxpayer, respectively.”

“Constitutionally speaking, Judge Surrick’s reasoning is completely illogical and a total dereliction of his duty as a judge to substantively address this most vital constitutional controversy. Instead, in a gutless manner, Surrick dismissed Berg’s complaint 10 days before the elections on a technicality of standing, which to any rational person begs the question: If Philip J. Berg as an American citizen, a respected Democratic operative and former attorney general of Pennsylvania doesn’t have the “standing” to bring this type of lawsuit against Obama, then who in America does have standing? The good judge in all 34 pages of legal mumbo jumbo didn’t bother to answer this pivotal question.”

Senator Mel Martinez of Florida

The following is from a response from Senator Mel Martinez of Florida. Mr. Martinez clearly has no
understanding of the US Constitution  or election laws. The scary part is that Congress is part of the
last checks and balances during the election. Congress has the power to sertify the Electoral College
votes and challenge them.

“Thank you for contacting me regarding President-Elect Obama’s citizenship. I appreciate hearing from you and would like to respond to your concerns.

Like you, I believe that our federal government has the responsibility to make certain that the Constitution of the United States is not compromised. We must fight to uphold our Constitution through our courts and political processes.

Article II of the Constitution provides that “no Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.” The Constitution, however, does not specify how that qualification for office is to be enforced. As you may know, a voter recently raised this issue before a federal court in Pennsylvania. On October 24, 2008, the United States District Court for the Eastern District of Pennsylvania released an order in the case of Berg v.Obama.In that case, the plaintiff, Phillip Berg, raised the same issue that your letter raises regarding proof of the President-Elect’s birthplace. Through his lawsuit, Mr. Berg sought to compel President-Elect Obama to produce a certified copy of his birth certificate.

The District Court dismissed Mr. Berg’s suit and held that the question of Obama’s citizenship is not a matter for a court to decide. The court further noted that voters, not courts, should decide whether a particular presidential candidate is qualified to hold office.

Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party’s nomination after one of the most fiercely contested presidential primaries in American history. And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama’s birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of President.”

I contacted Senator Martinez’ office this morning and no one has responded. If Senator Martinez would like
to respond, we welcome that. If you are a citizen of the state of Florida you may want to contact Senator
Martinez and voice your concerns over his lack of knowledge. I am certain he is not the only member of
Congress to be informed.
What we have here is a failure to communicate and a real mess.

What can we do?

Continue to inform all of those involved in the election process of their legal duties and demand that
Barack Obama prove legally that he is eligible.

For those state officers, election officials, Electors, judges and congressmen that fail to do their
job and uphold the US Constitution, hold them accountable. State laws vary but their are usually remedies
available such as recall, impeachment and dismissal. Don’t forget, you have more power than is normally
recognized. The Tenth Amendment gives us plenty of power. Also, make sure you share information with
others and ask them to do the same.

God help us if the US Supreme Court fails us

Cort Wrotnowski lawsuit, US Supreme Court, Update, December 2, 2008, Emergency Application hand delivered, Wrotnowski versus Connecticut Secretary of State, SCOTUS Docket No. 08A469, Wrotnowski avoids anthrax screening, Delivered to Associate Justice Antonin Scalia

Here is the latest on the Cort Wrotnowski lawsuit, Wrotnowski versus Connecticut Secretary of State,
that is before the US Supreme Court.

“Cort Wrotnowski, (SCOTUS Docket No. 08A469), a day after facing the shock of his life when told by a SCOTUS clerk that his renewed application to Justice Scalia would be held back for 7 days due to anthrax screening, hand delivered 10 copies of his renewed application to the Security booth at SCOTUS this morning at 10:30 AM.  Cort was told by the Clerk’s office that the papers would “probably” be in the Clerk’s office by 2:00 PM.   Cort’s application, according to Supreme Court Rule 22.1, should be “transmitted promptly” to the Honorable Associate Justice Antonin Scalia.  Keep your eyes on that Docket to see if they will follow the Rules of Court.

In my case, SCOTUS Docket No. 08A407, Donofrio v. Wells, the docket has been updated to include the letter I sent to all nine Justices which included copies of official Judicial Misconduct allegations against the New Jersey Judge who handled my initial NJ Appellate Division case.  This is important because the letter made clear that should the SCOTUS request an official copy of the case file from the lower court, the file on record there is fraudulent.

It’s significant to note that I sent this letter directly to the nine Justices.  While I did send a copy to the Clerk of the Court, the copies I sent to Justices went directly to them without asking the Clerk to distribute them.  Since this was not an official pleading, I wasn’t required to go through the Clerk’s office.  The letter was sent on November 22, 2008 but has only just hit the Docket today, December 2, 2008.  I didn’t think this letter would become part of the Docket.  I expect members of the press might be able to find out what this means. Nobody in the Clerk’s office will take my calls.”

Philip J Berg lawsuit, US Supreme Court, Update December 2, 2008, Emergency Injunction, Writ of Certiorari deadline, Obama and DNC have not responded

Jeff Schreiber has provided an update from Philip J Berg on his US Supreme Court Writ of Certiori.

“One day after the deadline set by Supreme Court Justice David Souter for Barack Obama and the DNC to respond to attorney Philip Berg’s Petition for Writ of Certiorari has passed without an answer, Berg is filing a motion in the Court in an attempt to further prevent Obama from taking office in January as the 44th president of the United States.

From what I could gather, the emergency motion for immediate injunction contains two main parts — in filing the motion, Berg is looking for the Court (1) to prohibit the certification of electors by the governors of each individual state in order to stay the Electoral College from casting votes for Obama on December 15, and (2) to stay the official counting of any votes for Obama by Vice President Dick Cheney, the House of Representatives and United States Senate on January 6, 2009, pending any decision on his appeal.

“As I’ve said over and over and over again, we’re headed toward a constitutional crisis, and it is absolutely imperative that we find out now, before he is sworn in, whether Obama is qualified under the United States Constitution to be president,” Berg said.

“It is my firm belief, my one thousand percent firm belief,” he said, “that he does not meet the natural born qualifications, that he should not be voted for by the electors, and that he should not be sworn in this January unless he shows his credentials … which he of course cannot, simply because he does not have them.”

The motion comes one day after Obama and the DNC were directed to respond to Berg’s Petition for Writ of Certiorari (the parties, however, are allowed two more days for mail service). On Wed., Nov. 19, the Federal Election Commission formally waived its right to respond to Berg’s petition and, while such waiver is not necessary, neither is any such response to a petition. Like the FEC, Obama and the DNC could essentially bank on the low odds that any one matter will be heard by the Court (only somewhere between 70 and 120 of the approximately 8,000 petitions are granted each year), or rely on arguments already made that Berg lacks standing to sue at all.”

PROCEDURAL BACKGROUND

 

FACTS
 

The facts of this case are best understood as a chronological series of events.  During the early part of 2008, there was growing pressure for Sen. Barack Obama to produce proof that he was a natural born citizen of the U.S.  In June 2008, an image of a document purported as a “Birth Certificate” actually titled “Certification of Live Birth” from the State of Hawaii bearing Barack Obama’s name was posted on an official campaign web site for Barack Obama.  (Exhibit X).    Table 1 gives the basic chronology.

Suspicions were immediately aroused when no city, place, witnesses or other personally identifying documentation was shown on this version of the form. Forensic experts weighed in as to whether it was authentic or not but that is a mute point in that it is not the version of the  birth certificate useful in answering the question.

Note that the “Certification’ version is worthless and stated so by the Hawaii government.

 

Note that that worthless “Certification” document is principally used for individuals born overseas to a Hawaiian citizen just like Berg had been asserting. 

 

Mr. Obama has not left a paper trail for the public to follow forcing the public to demand proof. Mr. Obama and able bodies supporters purported to the public that this “Certification” document was proof  that he was born in Hawaii and therefore, “Natural Born.”

 

The exhibits V-Y before the court make it plain that that claim of proof is patently false. Subsequent demands for the real Birth certificate fell on deft ears and multiple lawsuits to date have only yielded obfuscation, untold thousands of dollars spent by Mr. Obama on legal teams who used every delay tactic possible to avoid delivering the same document most little league teams require to join their team.  The brick wall is preposterous, so undeserved and unnatural as an appropriate response to the people’s request that it leads to only one conclusion; voter fraud of the most audacious magnitude.

 

That Mr. Obama has steadfastly refused to allow certified access to his birth, adoption passport and repatriation documents has defrauded millions of Americans and Plaintiff.

         

LEGAL ISSUES
1) Does the Secretary of State, as the Chief of Elections, have the responsibility to protect Connecticut voters from election fraud, including national elections conducted within the state?

 

The Connecticut Secretary of State asserts in an email to the plaintiff:

 “…I do not have the statutory authority to remove a candidate from the ballot unless that candidate officially withdraws by filling a form with my office to that effect.”

She also asserts: 

“Likewise, neither the Connecticut General Statutes nor the Constitution of the State of Connecticut authorizes me to investigate a Presidential candidate’s eligibility to run for the office of President of the United States.  Because this is a matter prescribed in the Constitution of the United States, and absent any authority and/or procedures in our state constitution, the question of the verification of a Presidential candidate’s status as a “natural born” citizen is a federal matter subject to U.S. Congressional action…”

 

Plaintiff asserts the Secretary of State has misread the law and is instead the state officer directly responsible for preventing election fraud against Connecticut voters in a national election. In this most important regard the Secretary of State has failed to act to secure the public confidence and avoid the appearance and actuality of fraud. There is no law restricting the secretary of state from investigating fraud as she claimed. Ridiculous!

 

Silence constitutes an implied representation of the existence of the state of facts in question and will operate as an estoppel.

 

“Silence can only be equated with fraud where there is a legal or moral duty to speak or where an inquiry left unanswered would be intentionally misleading.” U.S. v. Tweel, 550 F. 2d. 297, 299 (5th Cir. 1977), quoting U.S. v. Prudden, 424 F.2d 1021, 1032 and Carmine v. Bowen, 64 A. 932 (1906).;

 

2) Does the Connecticut Supreme Court have the responsibility to direct a state officers to prevent election fraud, if sufficient reason is shown?

 

Plaintiff asserts that precedent set in Connecticut (In re Election of the U.S. Rep. for the Second Congressional District, 213 Conn. 602, 618, n.18, 653 A.2d 79 (1994))  provides guidance to the court that they may act to resolve disputes involving election to national offices.

 

From Connecticut Appellate Practice and Procedure, 3rd Edition, chapter titled:  Original Proceedings in the Supreme Court Section D Subsection 10.17 Procedure (a) Rules of Practice

“Except for the complaint, the statute and rules are silent as to the matters of procedure in original actions in the Supreme Court (C.G.S. 9-232).  Accordingly, in federal election disputes the justices are free to fashion such rules as will expedite a fair and speedy resolution of the dispute”

 

Clearly the Supreme court of Connecticut  may if justified direct the Connecticut Secretary of State or other state officer to take such actions as would be deemed sufficient and necessary to provide necessary remedy.

 

 

 

HOLDING BY THE PLAINTIFF

 

Holding Regarding the Role of the State Supreme Court
 

The plaintiff asserts that Connecticut law is not explicit with respect to taking action against potential election fraud at the national level.  It neither authorizes nor prohibits.  In fact, it is silent on this important issue.  The only statutes providing direction are 9-323, and for Federal Election Disputes, sec. 10-13, 10-14, 10-15, and 10-17(a) (as found in  Connecticut Appellate Practice and Procedure, 3rd Edition, chapter titled:  Original Proceedings in the Supreme Court, pages 385-387.) 

 

We do not have a federal ballot controlled by the federal government, we have Connecticut state election for electors who are pledged for a particular candidate which allows each state to determine how and in what manner they choose to project their power at the National Electoral College.

 
In the special case of individuals seeking the office of President of the United States, the US constitution prescribes a system of electors where citizens of the respective state have a state controlled election wherein electors representing the interest of the named individual on the state ballot are so elected as to represent the interests of the respective state at the Electoral College. 
 

State law determines how the electors are determined and act. Since this is in actual fact a state election, our Secretary of State has prevue over certification of not just the counts of the ballots so cast for the named candidate for President, but also the veracity of the system which including publishing and promoting the ballot and for certifying or decertifying challenged candidates; in this case the electors who act as proxies for the candidate.
 

The plaintiff argues that the Connecticut constitution and statutes and enforcement should be consistent with the principles of the U.S. constitution.  When Connecticut law provides no guidance, then an electoral duty ascribed at the national level applies at the state level as well.  If there are national standards for preventing fraud in an election, then there need to be similar standards at the state level.  The state Supreme Court is responsible for ensuring that that Connecticut laws follows the U.S. Constitution.  In particular, Sec. 10-17(a) sets forth how the State Supreme Court can provide remedy.

 

Holding regarding Responsibility of the Secretary of State in National Elections
 

It is argued that the lack of language in the state law does not preclude the Secretary of State, as the Chief of Elections, from verifying national candidates for whom her constituents will vote especially so when allegations of blatant profound fraud is widely asserted.

 

She has threaded a path to inaction by her selective choice of words.  Hers is a “sin of omission” argument.  Estopple argument would say otherwise. Furthermore, without explicate legislative direction, there are still very clear “implied duties” that follow from Connecticut Statutes, Connecticut Constitution and  the U.S. Constitution that demand consideration and action from this independent branch of Government charged with action.

 

There are at least four statutes that set forth the duties of the Secretary of  State.  Plaintiff bolded passages in Sec. 9-3 for emphasis.

Sec. 3-77. General duties; salary. Office of Secretary full time.

…  provisions of section 11-4c. The Secretary may give certified copies of any entries in such records, files, books or other papers and of the files and records of said Superior Court and of the Supreme Court, remaining in the office, which copies shall be legal evidence. … The Secretary shall receive an annual salary of one hundred ten thousand dollars and shall devote full time to the duties of the office.

 

 Sec. 9-3. Secretary to be Commissioner of Elections. Presumption concerning rulings and opinions.

The Secretary of the State, by virtue of the office, shall be the Commissioner of Elections of the state, with such powers and duties relating to the conduct of elections as are prescribed by law and, unless otherwise provided by state statute, the secretary’s regulations, declaratory rulings, instructions and opinions, if in written form, shall be presumed as correctly interpreting and effectuating the administration of elections and primaries under this title, except for chapter 155, provided nothing in this section shall be construed to alter the right of appeal provided under the provisions of chapter 54.

 

  

The bolded language in Sec. 9-3  demonstrates that the legislature fully expected the Secretary of State to act independently and proactively to address situations germane to the task of executing elections consistent with all requirements of the constitutions and statutes.

 

The implied duty argument is vital for circumstances where questions about candidates remain, even up to Election Day.  She claims no such responsibility, yet the “national system” to which Secretary Bysiewicz refers to does not exist and/or has provided no remedy.  Despite popular misunderstanding, the FEC provides no verification whatsoever.  As the Chief of Elections, the Secretary of State is responsible for protecting Connecticut voters from fraud and unfair elections. Buck stops there.

 

Eligibility is a fundamental issue that strikes at the heart of fair elections.  Where the question of eligibility has become so obvious and clear, as in the case of Sen. Obama’s missing birth certificate, the Secretary of State must move to protect the voters, investigating the allegations of fraud or directing such agency as deemed proper such as the SEEC which would investigate and inform the Secretary of State of their findings.

 

Analogous Argument
If a crime is being committed and you have the ability to stop it, you don’t wait for the police to show up.  That’s why we have Citizen’s Arrest.  Similarly, if an electoral crime is being committed, and you have the ability to stop it, you don’t stand by and do nothing.  If Secretary Bysiewicz is unclear on this issue, then we ask this court to clearly explain it to her in the form of a Writ of Mandamus since she has clearly ignored prudence and the petitions of citizens.

 

States do not have the right to promote on the ballot  presidential candidates that violate the eligibility standards of the U.S. Constitution, but that is what Secretary Bysiewicz chooses to do. She has failed to provide Connecticut voters with the most basic protections against fraudulent candidates like Calero.  She wishes to be consistent in her negligence by also neglecting to demand Sen. Obama produce his authentic birth certificate.

 

 

CONCLUSION:  PLAINTIFF’S PROPOSED REMEDY

 

I Move that this court would issue a writ of mandamus requiring that Connecticut, Secretary of State Bysiewicz immediately acquire primary documents or certified copies from primary sources such as the appropriate Health Department and/or appropriate hospital records.  If such reasonable documents as would establish place and date of birth are not made available to the Secretary of State by the time expected for certification of the election results, then the Secretary of State is ordered to declared that candidate as ‘not certified’ as a valid candidate for the office of President of the United States under the United States Constitution, Article II, Section I;
 

This action is the only legal remedy available for Connecticut voters.

There has been much confusion regarding Barack Obama’s eligibility and the aspect of Leo Donofrio’s lawsuit that sets it apart is his claim that Obama does not meet the constitutional definition of Natural Born Citizen. Here is an explanation from Leo Donofrio:

“Don’t be distracted by the birth certificate and Indonesia issues. They are irrelevant to Senator Obama’s ineligibility to be President. Since Barack Obama’s father was a Citizen of Kenya and therefore subject to the jurisdiction of the United Kingdom at the time of Senator Obama’s birth, then Senator Obama was a British Citizen “at birth”, just like the Framers of the Constitution, and therefore, even if he were to produce an original birth certificate proving he were born on US soil, he still wouldn’t be eligible to be President.

The Framers of the Constitution, at the time of their birth, were also British Citizens and that’s why the Framers declared that, while they were Citizens of the United States, they themselves were not “natural born Citizens”.

Hence their inclusion of the grandfather clause in Article 2, Section 1, Clause 5 of the Constitution: No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution shall be eligible to the Office of President; That’s it right there. (Emphasis added.)

The Framers wanted to make themselves eligible to be President, but they didn’t want future generations to be Governed by a Commander In Chief who had split loyalty to another Country. The Framers were comfortable making an exception for themselves. They did, after all, create the Constitution. But they were not comfortable with the possibility of future generations of Presidents being born under the jurisdiction of Foreign Powers, especially Great Britain and its monarchy, who the Framers and Colonists fought so hard in the American Revolution to be free of.

The Framers declared themselves not eligible to be President as “natural born Citizens”, so they wrote the grandfather clause in for the limited exception of allowing themselves to be eligible to the Presidency in the early formative years of our infant nation.

But nobody alive today can claim eligibility to be President under the grandfather clause since nobody alive today was a citizen of the US at the time the Constitution was adopted.

The Framers distinguished between “natural born Citizens” and all other “Citizens”. And that’s why it’s important to note the 14th Amendment only confers the title of “Citizen”, not “natural born Citizen”. The Framers were Citizens, but they weren’t natural born Citizens. They put the stigma of not being natural born Citizens on themselves in the Constitution and they are the ones who wrote the Document. Since the the Framers didn’t consider themselves to have been “natural born Citizens” due to their having been subject to British jurisdiction at their birth, then Senator Obama, having also been subject to British jurisdiction at the time of his birth, also cannot be considered a “natural born Citizen” of the United States.
Brack Obama’s official web site, Fight The Smears, admits he was a British Citizen at birth. At the very bottom of the section of his web site that shows an alleged official Certification Of Live Birth, the web site lists the following information and link thereto: FactCheck.org Clarifies Barack’s Citizenship

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

That is a direct admission Barack Obama was a British citizen “at birth”.

My law suit argues that since Obama had dual citizenship “at birth” and therefore split loyalties “at birth”, he is not a “natural born citizen” of the United States. A “natural born citizen” would have no other jurisdiction over him “at birth” other than that of the United States. The Framers chose the words “natural born” and those words cannot be ignored. The status referred to in Article 2, Section 1, “natural born citizen”, pertains to the status of the person’s citizenship “at birth”.

The other numerous law suits circling Obama to question his eligibility fail to hit the mark on this issue. Since Obama was, “at birth”, a British citizen, it is completely irrelevant, as to the issue of Constitutional “natural born citizen” status, whether Obama was born in Hawaii or abroad. Either way, he is not eligible to be President.

Should Obama produce an original birth certificate showing he was born in Hawaii, it will not change the fact that Obama was a British citizen “at birth”. Obama has admitted to being a British subject “at birth”. And as will be made perfectly clear below, his being subject to British jurisdiction “at birth” bars him from being eligible to be President of the United States.

As I have argued before the United States Supreme Court, the 14th Amendment does not confer “natural born citizen” status anywhere in its text. It simply states that a person born in the United States is a “Citizen”, and only if he is “subject to the jurisdiction” of the United States.

Article 2, Section 1, Clause 5 of the Constitution of the United States:

“No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”

The most overlooked words in that section are: “…or a Citizen of the United States, at the time of the Adoption of this Constitution…” You must recall that most, if not all, of the framers of the Constitution were, at birth, born as British subjects.

Stop and think about that.

The chosen wording of the Framers here makes it clear that they had drawn a distinction between themselves – persons born subject to British jurisdiction – and “natural born citizens” who would not be born subject to British jurisdiction or any other jurisdiction other than the United States. And so the Framers grandfathered themselves into the Constitution as being eligible to be President. But the grandfather clause only pertains to any person who was a Citizen… at the time of the Adoption of this Constitution. Obama was definitely not a Citizen at the time of the adoption of the Constitution and so he is not grandfathered in.

And so, for Obama or anybody else to be eligible to be President, they must be a “natural born citizen” of the United States “at birth”. It should be obvious that the Framers intended to deny the Presidency to anybody who was a British subject “at birth”. If this had not been their intention, then they would not have needed to include a grandfather clause which allowed the Framers themselves to be President.”

Leo Donofrio has provided an update today, Sunday, November 23, 2008 regarding his NJ lawsuit that is before the US Supreme Court.

“This past week, Leo C. Donofrio forwarded to the Honorable Chief Justice John G. Roberts an official allegation of misconduct against SCOTUS stay clerk, Danny Bickell.

United States Supreme Court docket no. 08A407, Donofrio v. Wells, is now “Distributed for Conference of Dec. 5th, 2008″ to the full Court meeting in private on that date. The case was the subject of previous sabotage by SCOTUS stay clerk, Danny Bickell (as well as judicial misconduct by NJ Appellate Division Judge Jack M. Sabatino). Bickell, after receiving the emergency stay application which requested extraordinary relief to stay the national election, took it upon himself to deny the application on the very time sensitive date it was filed, Nov. 3, a day before the election day popular vote.

As it stands, this case, and the Presidency, now rest in the hands of the nine Supreme Justices, a situation that could have come to pass prior to the votes being counted on election day had Mr. Bickell actually done the job he’s paid to do – be a clerk – as opposed to his specious illegal attempt to play Supreme Court Justice and overrule the long standing precedent of McCarthy v. Briscoe, 429 U.S. 1317 (1976). Please note that the link provided goes to the 5th Circuit follow up action as all links to the actual Supreme Court decision appear to have been mysteriously cut off.

Incredibly, the McCarthy v. Briscoe case provides multiple controlling precedent to the justiciability of the action now before the Supreme Court. No wonder this Supreme Court decision can’t be found online...anywhere. Hopefully, broken links to the case will be resolved as this blog makes the rounds.

The American people need to familiarize themselves with McCarthy v. Briscoe 429 U.S. 1317 (1976) (check note 1 when you find the case) in order to understand the precedent which supports the relief requested by Donofrio.

That case is relevant as to the procedural grounds Mr. Bickell incorrectly (and illegally) applied in denying to pass on Donofrio’s stay application. But more important is that the case also provides supporting precedent for Donofrio in that US Supreme Court Justice Powell, late in the 1976 Presidential cycle, intervened on behalf of 3rd party candidate Eugene McCarthy, and forced the Texas Secretary of State to include McCarthy on the ballots after McCarthy made an emergency application to the Supreme Court.

In the first count of Donofrio’s stay application, he had requested the SCOTUS remove the names of Obama and McCain from New Jersey ballots. (His second count also requested that the SCOTUS stay the national election.) McCarthy v. Briscoe stands for the precedent that the SCOTUS has the power to order a Secretary of State to include or remove names from ballots when a Constitutional issue has been invoked.

The case is also procedurally relevant because Bickell told Donofrio he didn’t submit the stay application to Justice Souter because it failed to meet the criteria of Supreme Court Rule 23.3 in that Donofrio’s NJ Supreme Court request for emergency relief used the words “injunctive relief” instead of the word “stay” and therefore Donofrio had failed to request a stay in the lower court and was not thereafter allowed to come to the US Supreme Court with such a request.

This was a disgusting attempt at one of the worst bluffs I’ve ever seen. Bickell was called with a lightning fast “all in” only to be found holding the infamous 7-2 off suit and the flop, turn and river all failed to connect with his crap holding because:

1. Donofrio did request a “stay” in his initial Appellate Division complaint. Also, the NJ Attorney General’s office argued, in their reply brief, against the court issuing a “stay”.

2. Donofrio’s NJ Supreme Court motion relied on his full lower court record when he requested a “Motion for injunctive relief” from the NJ Supreme Court by way of a signed certification and the submission of a 75 page appendix which Bickell did not have in his possession to review.

3. A stay isinjunctive relief”. Any first year law student would know that. But Mr. Bickell is a staff attorney at the United States Supreme Court. He knew damn well that the interference he ran was willfull misconduct.

4. The case has actually been distributed for conference of all nine Justices, a situation Bickell tried to prevent.

5. The case McCarthy v. Briscoe stated,

“Indeed, an application styled as one of for a stay, if it in fact seeks some form of affirmative relief, may be treated as a request for an injunction and disposed of accordingly.”

Isn’t that just amazing. Stay clerk Bickell tried to overturn historic United States Supreme Court precedent when he refused to pass on my stay application based on a false semantic attack not even grounded in law, but rather directly opposed to it. Had Bickell treated the emergency application with the dignity it deserved, the issue of whether Obama and McCain were Constitutionally eligible to be President could have been settled prior to the popular vote.

Had Bickell passed the stay application to Justice Souter on Nov. 3, Souter would have denied it straight away, as he did when it was passed on to him on Nov. 6. Then if Bickell had followed US Supreme Court Rule 22.6, which required that Donofrio be notified of the disposition of the stay application “by appropriately speedy means”, Donofrio could have renewed the application to Justice Clarence Thomas on the evening of Nov. 3, or the next morning at the latest, and the SCOTUS could have stayed the popular vote until they made a decision on the merits.

But Bickell not only failed to pass on the application, he never gave Donofrio any notice whatsoever until Donofrio finally got through to Bickell‘s phone on Nov. 6 when Bickell told Donofrio that since he – not a Supreme Court Justice – had disposed of the case, no disposition notice was necessary at all. To hell with Rule 22.6.

Now that the popular vote has been recorded, Bickell has made a difficult situation ever more dangerous as millions of citizens who voted for Obama (and McCain) stand to have their votes voided post election, a situation my law suit sought desperately to preempt.

Now that the case – and the issues discussed therein – have been deemed legitimate by the Court having utilized the extraordinary step (see textbook image below) of distributing for conference a previously denied stay application, Mr. Bickell’s motivations should be thoroughly investigated by the Supreme Court and also by a U.S. Attorney.

Furthermore, Mr. Bickell should be fired and “we the people” need to see that it happens fast before he has the chance to pull the same cheap bluffs on other pending emergency stay applications headed swiftly to the Supreme Court this week. You can expect a very important update on this issue within the next 24 hours.

Dr. Rod Polarik has been examining the COLB, Certificate of Live Birth, that the Obama camp has presented
on such sites as Daily Kos, Fight the Smears, FactCheck.org and other pro Obama sites. Here are some exerpts from Dr. Polarik’s Final Report on November 22, 2008:

“The following report is the culmination of over four months of intensive, empirical research whose sole purpose has been to determine if the images and photographs posted on the Internet are true reproductions of a genuine document purported to be Obama’s original birth certificate. The idea for the research actually began from the time when the first image was posted on June 12 to the Daily Kos blog. I don’t recall on which website I actually saw the story (most likely World Net Daily), but the news had gone viral basically from the moment that it hit the Internet.

Before seeing the image, I had no idea that Barack Obama’s birthplace was in question, or that his status as a natural-born US citizen had never been proven. Like millions of other Americans, I believed the story he told about being born in Hawaii to an American Mother (and a U.S. citizen) and an African Father (a Kenyan national attending college on a student visa). I had no idea that this issue would mushroom and take on a life of its own. What I did know, however, was that from the first time I saw the Daily Kos image, or what I now call, “Obama’s bogus birth certificate,” that something was just not right about it. As someone who has scanned hundreds of thousands of documents in his lifetime, I had a hard time accepting that this was an original scan image made from an original paper document. As Fate would have it, right then, on June 13, I was looking at the conclusive evidence that the text on this image had been graphically altered, or “manufactured,” as my first blog post would claim.

From that point onward, I had no inkling of what was to come. I had no idea that I would wind up being the only person on the Planet (at that time) to have spotted the anomalies that I knew were the by-products of intentional, graphic alteration, and to go on record as stating that the Daily Kos image was a fake. I was also not prepared for what came along with this knowledge, for what I had to endure for making it public. Basically, I had painted a big bullseye on my chest and my research findings, and the critics were now coming out of the virtual woodwork taking shots at me personally, and my research, secondly. I had started a new online game called, “Let’s pile on Polarik,” and every little error I made was magnified into a major transgression. Yet, the crux of my contention was never successfully refuted.

Now, if I had to do it all over again, I probably would not have done it at all, knowing that I’d be spending the next four months conducting further research and compiling evidence on not just the COLB image, but also the digital photographs that were to follow two months later. The personal costs to me were enormous, and I will not elucidate on them (but for those who know me, they also know what were those costs). What began as sort of a curiosity turned into my personal quest for the “Holy Grail,” so to speak. I was guided only by the need to uncover the truth, and by the constant harassment by my critics. Had they left me alone from the beginning, I probably would not be writing this report today.

I debated, long and hard, about the title of my report. Aside from it being catchy, I ran the danger of being lumped into a group of false conspiracy theorists, and brushed aside as an idiot wearing a “tinfoil hat.” (Actually, that’s already happened, many times over). Perhaps there are a lot of false conspiracies, including some really outlandish ones, but there would not be laws on the books, both at a state level and a federal level, that specifically mention the act of conspiracy when the purpose of that conspiracy is to either engage in illegal activity, engage in a cover-up of that illegal activity, or interfering with the investigation of that illegal activity. Conspiracy can involve all of these. Yet, somehow, the word, “Conspiracy,” has become a pejorative for “nutty theories from the fringe,” as if there has never been a real “conspiracy.”

Do you remember, or ever hear about, the “Watergate Conspiracy?” Do you remember, or ever hear about, what happened to President Richard Nixon as a result?

I would tell all of you who think that “conspiracies” are a joke and that the people who claim to have found them are “idiots wearing tinfoil hats,” to just ask an FBI agent what he or she thinks about “conspiracy.” Or, go ahead and ask a federal judge what he or she thinks about “conspiracy.”

“Conspiracy” is no laughing matter, ladies and gentlemen, and neither is “document fraud,” as in creating and passing a counterfeit birth certificate.

I should now alert you to the fact that I have been using the phrase, “Bogus birth certificate,” as a euphemism for “Counterfeit birth certificate,” which is defined as, “A copy or imitation of a state-issued birth certificate that is intended to be taken as authentic and genuine in order to deceive another.”

Sound familiar? According to Authenticate-360:

Birth certificates are generally used as “breeder” documents to gain other identity documents and to perpetuate fraud. But unlike Social Security cards, birth certificates are issued by hundreds, if not thousands, of entities, with little regard to consistency or security. An accurately forged birth certificate is a dangerous document, allowing the bearer significant access to everything from driver’s licenses to passports…The increasing availability and affordability of high-quality digital scanners and copiers is a constant threat to the authenticity of government issued documents.

There are current Federal laws in place that prohibit the use of false identity documents, such as a birth certificate, and they are spelled out in Chapter 18 of the United States Code, Section 1028, Fraud and related activity in connection with identification documents, authentication features, and information. In particular, there are specific paragraphs that relate to the use of a false identification document:

The term “false identification document” means a document of a type intended or commonly accepted for the purposes of identification of individuals that – (A) is not issued by or under the authority of a governmental entity or was issued under the authority of a governmental entity but was subsequently altered for purposes of deceit; and(B) appears to be issued by or under the authority of the United States Government, a State, a political subdivision of a State, a foreign government, a political subdivision of a foreign government, or an international governmental or quasi-governmental organization.

What you are about to read in this report are well-documented facts arising from evidence collected over a period of four months and subjected to intense scrutiny and empirical evaluation. Given the overriding fact that the individual whose identity document is in question, has repeatedly failed to provide a genuine identity document, the charge that this individual, along with other individuals, did conspire to proffer in its place, a false identification document, is hereby levied by the American people, by way of one of its citizens. To summarize the seriousness of these actions and this charge, and to the importance of what is contained within this report:

There is conclusive and irrefutable evidence that the COLB image created and distributed by Obama’s campaign to the Daily Kos, Annenberg’s Factcheck, and the St. Pete Times, Politifact, is, unquestionably, a false identification document. Furthermore, there is conclusive and irrefutable evidence that the photos taken by Annenberg’s Factcheck, in collusion with the Obama campaign, are themselves, false identification documents, having been made from the same false identification document image, as well as from additional false identification documents created for the same purpose; namely, to proffer these false identification documents as true reproductions of a genuine, Hawaii-issued and certified, “Certification of Live Birth” document, and thereby, intentionally deceive the American public into believing that Barack Hussein Obama is a natural-born citizen of the United States, and thereby, fully qualified to become their President.

I never imagined that my studies would amount to this. I thought, like most Americans, that maybe the information was accurate even though the document image was fake. I thought, like most Americans, that Obama would simply present a copy of his real, original birth certificate, and that would be that. Yet, here we are, more than twenty months after Obama announced his candidacy for the Presidency, and nearly three weeks after the election, and Obama still refuses to show his real birth certificate!

Sadly, mainstream media have totally ignored this inconvenient truth and are not even been willing to even look at this birth certificate issue. They are all still in-the-tank with Obama, but even more so now that he is in line to be President. They all bought into the lies and fraudulent documents proffered up as evidence on Obama’s qualifications. They have been too quick to label as “trash” or “garbage” any legitimate questions asked about Obama’s real birth certificate. Even thigh-ranking governmental officials in the state of Hawaii where Obama was allegedly born, won’t reveal what’s on Obama’s original birth certificate. All they have said is that they have it. They have not said (1) where Obama was born. (2) when Obama was born, or (30 even to whom Obama was born.

The answer to “What’s on Barack Obama’s real, original birth certificate” ranks right up there with some of the great mysteries of our time — and that is really hard to swallow. That a man, with a dubious background, has been elected to the highest office of the greatest superpower in the world without ever having to prove who he says he is! That is not “nutty,” that’s just plain insane!
