Philip J Berg is appealing his lawsuit dismissal to the US Supreme Court. Here is Mr. Berg’s news release:

(Lafayette Hill, Pennsylvania – 10/25/08) – Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.

Berg said, “I am totally disappointed by Judge Surrick’s decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.

This is a question of who has standing to uphold our Constitution. If I don’t have standing, if you don’t have standing, if your neighbor doesn’t have standing to question the eligibility of an individual to be President of the United States – the Commander-in-Chief, the most powerful person in the world – then who does?

So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.

According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

What happened to ‘…Government of the people, by the people, for the people,…’ Abraham Lincoln in his Gettysburg Address 1863.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

I contacted the NC Board of Elections this morning and asked if they
were aware of the Philip J Berg lawsuit that states that Barack Obama
is an Indonesian citizen, an illegal alien and not eligible to run
for president. I was told they had been aware of the lawsuit for several
months. I was also told they get their cue from the DNC. The gentleman
that I spoke to mentioned the case that was dismissed against John McCain.
These two cases are totally different. One huge difference is that John
McCain provided a vault version of his birth certificate to congress.
Obama filed a motion to dismiss the Berg lawsuit instead of proving
citizenship. The gentleman did not allow me to speak at first but did
listen for a brief moment. I told him that I would be posting about
this. I included a subchapter of NC law that pertains to replacing
candidates that are disqualified.

So, what is the primary source of determining qualifications to be
president? The US Constitution.

I am requesting that all of you, the citizens of the US, look up the laws
in your state regarding a candidate being on the ballot and email and
call your state board of elections. Here is the email that I sent to the
NC State Board of Elections:

in federal court on August 21, 2008. Mr. Berg states that Obama
is not qualified to be president. I helped break this story and I am

§ 163-114. Filling vacancies among party nominees occurring
after nomination and before election.
If any person nominated as a candidate of a political
party for one of the offices listed below (either in a primary
or convention or by virtue of having no opposition in a primary)

dies, resigns, or for any reason becomes ineligible or
disqualified before the date of the ensuing general election,
the vacancy shall be filled by appointment according to the

I just contacted the NC Board of Elections. I first sent them an email and then had a phone conversation. I asked if they were aware of the Philip J Berg lawsuit. The answer was yes. Then the gentleman mentioned the McCain lawsuit and his eligibility. He also stated that he had been aware of the Berg lawsuit for several months. I stated that I had researched them both. He stated that they get their cues from the national party committees. He also stated that he would read the email. I gave him a heads up that I was going to post this.

Here is a copy of the email that I sent:

John McCain is qualified to be president. That issue was put to rest and McCain presented a vault COLB to congress.

It is apparent that Obama is not qualified to be president. Instead of presenting proof, he filed a motion to dismiss Berg’s lawsuit.

The NC Board of Elections is aware of Obama not proving his qualifications, and while I am sympathetic with them for being at the mercy of the DNC, ignorance is not bliss.

Philip J Berg answer, September 17, 2008, constitutional issue, Jeff Schreiber questions, Obama not qualified to be president, No pending motion to dismiss

Philip J Berg has responded to the email I sent earlier regarding questions posed by Jeff Schreiber. Here is some of the dialogue Jeff Schreiber had with Mr. Berg:

“I ran into Philip Berg yesterday at the courthouse here in Philadelphia and, knowing from previous cases against McCain what to expect from Judge Alsup in California, once again asked him about standing. I mentioned that, just as McCain and the GOP did against Markham Robinson, Barack Obama and the DNC will likely respond to the complaint with a similar motion to dismiss for lack of standing, and asked why he felt his situation was so markedly different than those of Robinson or John Hollander.

Berg maintained that this is a constitutional issue, and that Robinson did not necessarily frame it in that regard, and mentioned that during the initial hearing on the temporary restraining order Judge Surrick asked about his standing and was satisfied enough with the answer so as not to dismiss the case outright. Personally, I look at the constitutional nature of Berg’s suit as sufficient to satisfy questions of subject matter jurisdiction, not standing.”

As Jeff Schreiber and I discussed, there is not a pending motion to dismiss by any of the Defendants before the Court.  Defendants may choose to file a motion to dismiss, at which time I will properly Oppose and reply.   For this reason, and at this point, I can’t tip my hand.

Obama challenging Senator Obama’s eligibility to serve as President of the United States, has received confirmation from his Process Service Company that the Democratic National Committee (DNC) and Senator Barack Obama were served today, September 4, 2008, with the legal documents pertaining to Berg vs. Obama, Civil Action No. 08-cv-4083.  The DNC was served at 12:00 p.m. and Senator Obama was served at 1:00 p.m.  The U.S. Attorney’s Office accepted service on behalf of the Federal Elections Committee (FEC) on or about August 22, 2008.

Philip J Berg Lawsuit update, Summons Reissued, Obama to be Served by Tomorrow, Obama never received the summons, Obama not qualified to be president

We just received an update on the Philip J Berg lawsuit against Barack Obama statting that Obama is not qualified to be president. The source of the information has been reliable and is the same source that gave us a heads up when the lawsuit was filed. Here is the update as received:

“Summons Reissued, Obama to be Served by Tomorrow

Philip Berg, the well-known Philadelphia attorney and former Deputy Attorney General for the State of Pennsylvania who two weeks ago sued Illinois senator and Democratic Party presidential nominee Barack Obama in federal court challenging the constitutionality of his White House bid, was at the courthouse this morning to file a Praecipe for Reissuance of Summons.

While the original summons was accepted ten days ago by the U.S. Attorney’s office on behalf of the Federal Election Commission, also a named defendant in Berg’s suit, proper service never reached the Democratic National Committee or Barack Obama’s agent for service. Today’s procedure will ensure that proper service is made, but the reasons behind the procedural hiccup remain a mystery to everyone involved.

“For whatever reason, Sen. Obama never received the summons,” said Berg over the telephone this afternoon. “The court mailed everything out on August 22nd.”

This time, rather than relying solely upon the court to mail the summonses following the filing of the complaint, the papers were faxed to a court service company in Washington, D.C. While on the phone, Berg received a call on the other line and confirmed that the papers were indeed in D.C. and would be served, at the latest, by tomorrow.

Still, he said, the information about the suit is out there. It was picked up by the Washington Times and by the [Norristown, PA] Times-Herald and has spread across the Internet like a wildfire. His own Web site, the ever so objectively-named ObamaCrimes.com, has received more than 5 million hits. Mainstream media exposure has been understandably slow, he said, and when I asked whether he thought the deafening silence on the part of Rush Limbaugh, Sean Hannity, Laura Ingraham and more could be a sign that this information was perhaps at the heart of the GOP’s “October Surprise,” his answer was simple.

“It could be. If so, it looks like I jumped the gun,” he said, reminding me that part of his motivation for filing suit when he did was to avoid the catastrophe for the Democratic Party which would inevitably occur should the GOP bring it up closer to Election Day.

“I filed this case because of the constitutional and party implications, but I am concerned about [Barack Obama],” he said, before adding that he is still 99.99 percent certain that his allegations in the lawsuit are true. “As every day goes by without a response, I think we’re on target. Obama has a well-oiled machine that responds to everything else immediately. When McCain put out a video, they have a response video out within hours. No comment from Obama leads me to believe that I’m correct.””

Philip J Berg, attorney at law, filed a complaint on Thursday, August
21, 2008, against Barack Obama. The complaint states that “Obama does not meet the qualifications to be President of the United States.”
MR. Berg states the following in his press release:

“Berg filed this suit for the best interests of the Democratic Party and the citizens of the United States.“Eighteen million Democratic Primary voters donated money, volunteered their time and energy, worked very hard and then not only supported Senator Clinton, but voted for her and often recruited other supporters as well. All the efforts of supporters of legitimate citizens were for nothing because this man lied and cheated his way into a
Philip J. Berg, Esquire stated in his lawsuit that Senator Obama:

1. Is not a natural-born citizen; and/or

2. Lost his citizenship when he was adopted in Indonesia; and/or

3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

Berg stated: “I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.”
