“The convictions on Counts 5, 6, 21, 22, and 23 are vacated; the remaining convictions are affirmed. The sentence is vacated, and the case is remanded for retrial on the vacated counts. Circuit Rule 36 will not apply. If the prosecutor elects to drop these charges, then the district court should proceed directly to resentencing. Because we have affirmed the convictions on most counts and concluded that the advisory sentencing range lies above 168 months, Blagojevich is not entitled to be released pending these further proceedings.”

July 21, 2012 Obama economy and jobs bleak, 27 states recorded unemployment rate increases, Black unemployment up 1.4 percent in 2 months, NC rate suspect

The Obama camp is using every opportunity to divert attention away from the dismal economy and jobs situation. Even the mainstream media has made note of the lies Obama has told about Mitt Romney. The stated unemployment rate in NC is 9.4 percent and that looks suspect, even accounting for historic low labor participation rates.

Doug Clark of the Greensboro News Record of the Greensboro News Record stated yesterday:

“North Carolina loses or gains jobs in June, depending on which state numbers you believe, if any”

“North Carolina lost nearly 8,000 jobs in June from the previous month, the state’s Commerce Department reports this morning.”

“The unemployment rate held at 9.4 percent, but that was because the labor force decreased.”

“Here’s a BLS explanation (sort of) of smoothing. Obviously, this statistical maneuvering makes a significant difference. In the state’s numbers, we either have fewer people working but are gaining jobs, or have more people working but are losing jobs.

Please weigh in on the credibility of these numbers.”

On Thursday, July 19, 2012, the US Labor Department reported initial claims were up 34,000 from the prior week to  386,000. 20 states had an increase of 1,000 or more. NC was one of those states.

On Friday, July 20, 2012, the US Labor Department Regional and State Employment and Unemployment Summary reported:

The national jobless rate, at 8.2 percent.

Twenty-seven states recorded unemployment rate increases.

“In June 2012, 11 states recorded statistically significant over-the-month changes in employment, 8 of which were increases and 3 of which were decreases. The largest statistically significant job gains occurred in California (+38,300), Ohio (+18,400), and North Carolina (+16,900).”

Note from the Greensboro News Record report:

Citizen Wells: I smell a rat. A NC Democrat Convention rat.

Also significant from the report are the following unemployment increases from April to June 2012.

Blacks: From 13.0 to 14.4 percent.

Asians: From 5.2 to 6.3 percent.

Hispanics: From 10.3 to 11.0 percent.

Blagojevich trial, Rod not called to stand yet, Rezko and Levine not called by prosecution

Rod Blagojevich was not called to the witness stand yesterday. Tony Rezko and Stuart Levine were not called by the prosecution. This still smells badly to me and I believe the fix was in on this trial years ago. Blagojevich attorney comments from yesterday, July 20, 2010.

“But in a stunning twist as his time to take the witness stand came, Blagojevich’s attorneys told U.S. District Judge James Zagel on Tuesday that the ex-governor would not testify and that they were prepared to rest their case without calling a single witness, sources told the Tribune. After conferring that message privately to Zagel and prosecutors in a lengthy sidebar, the defense team was told by the judge to mull the decision overnight.

The decision means Blagojevich won’t be able to play any undercover recordings that he felt backed up his denials of wrongdoing. Last week, the judge took parts of two days to decide what recordings could be played for the jury by the defense, though he blocked many of the ones it sought to air.

A number of sources said several factors went into the sudden reversal of course.

 
Blagojevich’s lawyers believed prosecutors had held back part of their case against the former governor to use against him in what promised to be a bruising cross-examination by Assistant U.S. Attorney Reid Schar, who glared toward the defense table after learning of the decision.

The attorneys also were operating under the belief that if Blagojevich testified, convicted fundraiser Antoin “Tony” Rezko, who has cooperated with the government, was likely to be called as a powerful rebuttal witness by prosecutors. Sources have said Rezko, who allegedly helped Blagojevich scheme to make money by leveraging the powers of his office, had not been prepared by prosecutors to testify but was on notice that he could very likely be called to the stand on short order.”

“”Listen, they told us they were going to bring on Rezko,” Adam Sr. said of the prosecution. “They told us they were going to bring on (convicted political insider Stuart) Levine. They told us they were going to bring on all these witnesses and they didn’t do it. They did not bring them on.””

Why wouldn’t the prosecution bring Rezko, Levine and others to the witness stand. Their names are mentioned constantly in all of the legal documents. More on that soon.

“Former Blago chief of staff postpones guilty plea”

“CHICAGO – An attorney accused of scheming with former Gov. Rod Blagojevich to use the governor’s office as a vehicle for making money postponed Monday his plan to plead guilty to federal corruption charges.

Alonzo Monk, 50, Blagojevich’s law school roommate and first chief of staff in the governor’s office, is now set to plead guilty at an Aug. 11 hearing.

Monk attorney Michael J. Shepard of San Francisco declined to comment on the reason for the delay. Other attorneys in the case said there was no reason to suspect the snag was anything that couldn’t be ironed out.

The one-time chief of staff has been cooperating with federal prosecutors in hopes of getting a lighter sentence. Plea negotiations can be complicated and delays are common.”

“The indictment also says Monk schemed with Blagojevich, convicted influence peddler Tony Rezko and others to use the governor’s office to squeeze individuals wanting to do business with the state for payoffs.”
