Health Care Bill Amish exemption, Religious exemption

The tax and control bill referred to as the Health Care Bill by Obama and the Democrat Congress, is clearly unconstutional on many levels. For some reason the word treason also comes to mind.

“Well, I have done it! I have read the entire text of: The Affordable Health Care
Choices Act of 2009. I studied it with particular emphasis from my area of
expertise, constitutional law. I was frankly concerned that parts of the
proposed law that were being discussed might be unconstitutional. What I found
was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is
in fact true, despite what the Democrats and the media are saying. The law does
provide for rationing of health care, particularly where senior citizens and
other classes of citizens are involved, free health care for illegal immigrants,
free abortion services, and probably forced participation in abortions by
members of the medical profession.
The Bill will also eventually force private insurance companies out of business,
and put everyone into a government run system. All decisions about personal
health care will ultimately be made by federal bureaucrats, and most of them
will not be health care professionals. Hospital admissions, payments to
physicians, and allocations of necessary medical devices will be strictly
controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I
have concluded that this legislation really has no intention of providing
affordable health care choices. Instead it is a convenient cover for the most
massive transfer of power to the Executive Branch of government that has ever
occurred, or even been contemplated. If this law or a similar one is adopted,
major portions of the Constitution of the United States will effectively have
been destroyed.”

Will the Amish and other religious sects be exempt from this bill?

Michelle Malkin reported the following on Hanuary 12, 2010.

“There’s a religious exemption from the Demcare insurance mandate”

“I think there’s going to be a wave of religious conversions this year. The Watertown Daily News reported this weekend that Amish families can claim an exemption from the Demcare’s planned government health care insurance mandate as a matter of faith:
Federal health care reform will require most Northern New Yorkers — but not all, it turns out — to carry health insurance or risk a fine.
Hundreds of Amish families in the region are likely to be free from that requirement.
The Amish, as well as some other religious sects, are covered by a “religious conscience” exemption, which allows people with religious objections to insurance to opt out of the mandate. It is in both the House and Senate versions of the bill, making its appearance in the final version routine unless there are last-minute objections.
Although the Amish consist of several branches, some more conservative than others, they generally rely upon a community ethic that disdains government assistance. Families rely upon one another, and communities pitch in to help neighbors pay health care expenses.
…Lawmakers reportedly included the provision at the urging of Amish constituents, although the legislation does not specify that community and the provision could apply to other groups as well, including Old Order Mennonites and perhaps Christian Scientists.”

“The Goshen News starts with a straightforward headline, “Health care reform and the Amish: What will it all mean?” and a lede that made me cringe:
With his long gray beard, plain clothes and lack of electricity, David Yoder of rural Middlebury hardly seems like someone who would know much about government issues.
But the rest of the article delivers, answering questions that other newspapers have left dangling out there. Turns out the House’s bill had a religious conscience clause that may exempt most Amish families. But that may not extend to younger Amish who have yet to officially join the church and likely wouldn’t exempt Amish-owned businesses.
Here’s what Third District Congressman Mark Souder told the paper’s Gary Kauffman:
Souder says there probably will be no compelling reason to give Amish business owners an exemption simply based on their faith.
“There probably will not be a way to exempt them any more than we can exempt Mennonites or others,” he said.
Souder said the Amish, along with other conservative groups, like Orthodox Jews, have been a topic of discussion already.
“The fundamental question is, ‘Is religious freedom trumped by a public health care program?’” he said. “There will be a religious liberty fight, but the Amish likely will be part of a bigger category than just themselves.””

Section 1501 is the correct section for Religious Exemptions. I work for one of the Old Order Mennonite / Amish health care sharing plans and we are a 501 (c) 12. Not a 501 (c) 3. We chose the c 12 over the c 3 designation because we don’t function as a charity and it would be dishonest to say we are a charity when we are not. We are a cooperative and cooperate among ourselves to meet our health care expenses. Many of the health care sharing plans are not registered with the IRS at all or are 501 (c) 12’s. Writing the law to allow only 501 (c) 3’s a religious exemption is in fact not allowing the Amish and Old Order Mennonites any exemption at all.”

I will continue to seek clarification on the religious exemption. If you have any knowledge on this subject, a response is appreciated.

What I really want to know is if it gets overruled…then will it gut the entire bill? also if we can get an injunction while its litigated to give businesses and insurance more opportunity to survive since it is said health insurance companies have about 2 years before falling and John Deere & Caterpillar are going to have to pay millions and thus relocate.I wish I could find a legal blog discussing this more.

  11. Hey, forget about the Amish… Congress exempted themselves from the bill. Of course, this is not surprising, given that a VP from Wellfleet co-wrote the bill. Please read this entire article AND the comments below. The author is trying to lambaste the insurance companies for finding loopholes that benefit themselves; but the comments are all over that! He even tries to tell me, I am wrong about the Congressional carve-out; but I (and other readers) set him straight.

  14. Why is the government now “establishing” certain religious rights, obviously defining how religions differ (favoring some while punishing others) based only on a narrow group of parameters.

    Other religions object on the basis of rationed care to the more vulnerable, like the elderly or those with more costly chronic or terminal diseases.

    The government shows bias against other religions (those objecting to the obvious funding towards abortion/euthanasia/eugenics/embryonic stem cell research) not included within the narrowly defined parameters of choice by Gov. exemption.

    Another huge area of being unconstitutional.

    White House Senior Adviser David Axelrod hailed the Massachusetts health-care program as “the template” for the national health-care reform legislation the president signed into law earlier this week. That should be cause for serious concern about this law’s ability to improve our health-care system at an affordable cost.

    As state treasurer, I can speak with authority about the Massachusetts pilot program. It has been a fiscal train wreck.

    The universal insurance coverage we adopted in 2006 was projected to cost taxpayers $88 million a year. However, since this program was adopted in 2006, our health-care costs have in total exceeded $4 billion. The cost of Massachusetts’ plan has blown a hole in the Commonwealth’s budget. Just last Thursday, Gov. Deval Patrick’s office announced a $294 million shortfall related to health-care costs.

    If not for federal Medicaid reimbursements and commitments from Washington to prop up this plan, Massachusetts would be broke. The only reason MassCare has survived is that we have been repeatedly bailed out by the federal government. But that raises the question: Who will bail America out if we implement a similar program?

    While everyone should have access to affordable health care, our experience in Massachusetts tells us that the new federal entitlement will burden future taxpayers with unfunded liabilities they cannot afford. Health-care inflation will continue. Mandates will increase insurance premiums. And the deficit will reach frightening levels as the law’s costs greatly exceed the projections of its advocates.

    As lawmakers push for changes in the bill, they should start by being honest about its costs and focus on making health care more affordable without bankrupting the country.

    Mr. Cahill is the state treasurer of Massachusetts. He is currently running as an independent for governor.

    Only the immediate parts…..the rest will take years……the immediate stuff is the foreclosures stop, imprisonment from taxes, release of prisoners, and of course by the end of the month they will have served all the Governors, Supreme Court and the military their Declarations where they either follow the orders of the people….represented by the de jure grand jury members or be removed!! Anyway that is what I see happening right away….there could be more stuff but I can’t remember!

    Good morning everyone!

    Welcome to the first day of the rest of your life in Barackistan.

    I doubt the elections this fall will make a difference. I doubt petitions will make a difference. The law suits will come too late.
    Only one more state needs to vote to call a Constitutional Convention. At this point in our history we must take the opportunity to legally reaffirm our personal and states rights. We CAN dismantle the wrongs foisted upon us by an oppressive federal regime.

    What do we have to lose? At this point in time, not much. Most of our freedoms have already been stolen from us. We are just a few more pieces of legislation away from having no freedoms. A national RFID card is on the way. New FCC controls for radio and internet, Cap & Tax, immigration “reform”, and more are waiting in the wings.

    In our own personal lives we have all made decisions to stop discretionary spending. If we could dismantle much of the bureaucracy of the federal government we might also be able to pay off our debt and prevent the economic collapse of our country.

    I know in the past some of you have expressed fear at the mere thought of a Constitutional Convention. A Constitutional Convention would give us a 50-50 chance of restoring the Founders’ vision for America. And, if restoration fails, the overthrow of the Constitution would be absolute and complete, and every citizen and every country in the world would know the truth about America.

  59. SueK, I heard Tim Cahill on the Jim and Margery show and he called it “Scary”…He said the cost is 4B and we have only added 4% of the un-insured! That is 1B for each percentage point. So how much is it going to cost to get all of them insured?

    Last October my deductible here went from $500.00 to $1,000.00. The premiums went up three time since and now we are paying 22% more and my deductible goes to $2000.00 effective 4/1.

    Just remember, once a national Constitutional Convention is called, it can change the “entire” Contitution. Some of the changes may not be an improvement, such as deleting the “Bill of Rights”. Of course, those Rights come from God, but the govenment would have a much easier time taking them away if they were not written into the Constitution. Also, the time limit of the President could also be changed, and not to our advantage. Really think about a Convention before you push for it. Look at what happened at the last election and imagine it happening at a National Constitutional Convention. Our Constitution could change into the Russian or Cuban Constitution.

    Just pray about it and “really” consider what you are wanting to do.

    Manning’s trial is a mock trial. It carries no weight. Having said that, the grand juries carry no weight, and I was on the first grand jury.

    I don’t have a problem having a mock trial. What I have a problem with is that if he has “proof” that Zero did not attend Columbia, then he should make it public.

    When we formed grand juries we used evidence that was public and was being ignored.

The dark horse that seems to be eluding attention is how many doctors will remain in practice given the fact that they are about to feel cuts in what they receive as payment from the alleged MEDICAID,and MEDICARE of over 70% of what they now receive for services rendered. If they decide to remain in practice it is PROBABLE that they will not accept a PROMMISORY NOTE from the US Government as payment for their services,and refuse to see anyone using Government provided healthcare. If you think the Canadian system is bad it is great when compared to what is going to happen very soon in the US. Axlerod seems to think that the alleged pilot program in Massachussetts, is really great. His thinking proves that he is a total numbskull. In reality it has bankrupted Massachussetts. Nice TEMPLATE HUH!. In short your doctor will probably refuse to see you unless you have cash on the barrelhead, or gold to pay him/her with. Wal Mart is considering putting low cost clinics in every store. This is designed to augment their growing pharmacy business. Instead of seeing a doctor you will see a NURSE-PRACTITIONER. This clinic business is apparently aimed at people with ailments like flu, sinus infections,etc. More serious stuff will probably be referred to either free clinics,or ER providers. Diabetics will probably suffer big time, because they will be caught in the NO MANS LAND in the middle ground.

Oregon State University Athletic Director Bob DeCarolis was considering firing their basketball coach, Craig Robinson, after an 8-11 start (2-5 in the Pac 10 conference). When word of this reached Washington , Undersecretary of Education Martha Kanter was dispatched to Corvallis with $17 million in stimulus money for the university. Craig Robinson’s job is safe for this year. For those of you unfamiliar with Coach Robinson, he just so happens to be Michelle Obama’s brother. Just a coincidence I’m sure!

    AT&T Taking $1B Charge to Cover Costs of New Health-Care Legislation

    AT&T (T: 26.24, 0.08, 0.31%) said Friday that tax ramifications related to the newly passed health-care legislation will force it to take a $1 billion non-cash charge in the first quarter.

    In papers filed with the U.S. Securities and Exchange Commission, AT&T said the charge stems from changes in the tax laws regarding the Medicare Part D subsidy. AT&T will no longer be able to deduct tax-free subsidies it receives from the government for providing retirees prescription-drug benefits.

    “AT&T Inc. intends to take a non-cash charge of approximately $1 billion in the first quarter of 2010 to reflect the impact of this change,” the company said.

    Furthermore, AT&T said in the filing that, as a result of this legislation, including the additional tax burden, “AT&T will be evaluating prospective changes to the active and retiree health care benefits offered by the company.”

    Last night, while we were out here in Boystown talking to people about what they thought of the Obamacare travesty, we ran into a friend of Robby’s who used to live in Boston. We started talking to him, and somehow in the conversation 9/11 came up — we think because Panda brought up the Real World, when one of the former cast members was spotted in Scarlet (quite a few reality has-beens live in Boystown) and he told everyone the story of Beth from the New Orleans cast.
    She was the girl who was supposed to be on one of the Boston to L.A. flights that hit the Twin Towers; the reason she survived was because about 20 minutes before she was supposed to leave for the airport to make her flight to California, she got into a random fight with her boyfriend that ended in a screaming match, and her refusal to keep her trip to visit him. That fight saved her life. If not for the argument, she would have boarded the plane and been one of those to die when Muslims took over the cockpit and turned the jet into a cruise missile.
    The guy from Boston, Jake, then told us a 9/11 story we’d never heard before, but that we’ve checked out and it is most definitely true.
    Jake used to workout at a Bally’s gym in Cambridge, near Boston. One of the personal trainers there was Muslim, and he was arrested not long after 9/11 for stealing the identities of club members. He photocopied all their member info, which included copies of their drivers’ licenses. This information was given to Muslim cells in California, where the information was used to make all sorts of fake IDs, fake passports, and the like for Muslim terrorists operating in the US.
    Apparently, this guy kept his eyes open for anyone he saw who could pass as a Muslim male for future use by one of the cells. He wasn’t looking for people who looked like specific terrorists. He was just looking for dark haired guys with pictures on their IDs that were close enough to what Muslims could make themselves look like if need be.
    This happened at a Bally’s.
    We wonder where else this is happening. It’s not all that hard to get a job as a trainer, and apparently gain access to membership files like that.
    It’s also not all that hard to get a job in Human Resources just about anywhere.
    Big hotels have hundreds of people working there. Large companies might have thousands. Just imagine the goldmine of useful information Muslim terrorist networks gain access to by having moles like that trainer in these sorts of environments.
    Scary stuff.

I think that from now on every letter written to a congressman should state the fact that it will be our intention to use the Religious exemption LOOPHOLE to LEGALLY bow out of the Health care mess. We will then put the money we save into a savings account in case we do get sick. But if we get really sick. We’ll just sign up for health care under the Previous Condition rule and get taken care of. Further more We’ll make sure that every church and religious organization in the country is aware of the same Loophole. It’ll be our goal to make sure that the only people paying into the government coffers are the atheists. Sure they will try to say that the exemption is only for the Amish but really how can the government exempt one small religion and not them all? I think this could really have potential and I’ll be surprised if lawsuits don’t start popping up. Someone should tell Orly.

    Need hard statics on waste and fraud-Medicare, Medicaid-MediAnything. 60 Minutes did a piece recently-40-60 billion waste and fraud per year.
    Crime especially drug trafficing-don’t know how many taxpayer billions go to that.
    My idea is that now that we have all become citizen journalists-we can become citizen detectives.
    Objective: save all the taxpayers money, jail the criminals or deport (depending).

    Hey, Chelley! That sounds like a wonderful idea; disbanding the fraud, waste, and abuse in the Health Care System; an idea whose time is surely long overdue.

    However, for my money, I would support lawyers/sheriffs/military personnel who are willing to take this “cartel of clowns” out one way or another.

    I am not sure how that can be done, but there are many people working hard to bring that about; either through protests, elections, and resistance of one kind or another.

    Weeding out the fraud, waste, and abuse used to be a passion of mine in my younger years. Now, I am interested in what can be done to deter, dissolve, and destroy the “enemy within.”

    I still believe the American people will rise up against these “corporate raiders.” They are getting much too cocky and arrogant and that, will not only make their demise swift and sure, but also contribute greatly to their destruction.

    They are so sure of themselves, they do everything right out in the open and rub it in our faces that they are in charge. Remember, the bigger they are, the harder they fall!


    PS Americans will survive this corporate takeover and come out stronger as a result.

    I have an even more obnoxious idea. You know how some of the young people have some crazy ideas “something for nothing” from Obama-parents can now really reclaim parenthood.
    For teens and college students who need an attitude readjustment: sorry all the families discretionary income is going to ObamaCare-no movies, no extra treats etc. don’t know how far parents can go with this. Complaints call Obama-Pelosi and Reid for money and here are their phone numbers. They won’t be fond of Democrats for long. You could add many dimensions to this.

The “chosen one” has some very powerful connection(s) who protect him from anyone who would expose him for the “trash” he is. How else could a literal “nobody” rise so quickly through the ranks to steal and seal his residency in the WH?

    That “somebody” [or somebodies] must be pretty powerful in the political arena and have as much to lose from being exposed as pp does.

I truly don’t care if they are Democrat, Republican, Independent or whatever. The self-serving must stop. This is a good way to do that. It is an idea whose time has come.

    In three days, most people in The United States of America will have the message. This is one proposal that really should be passed around.

    The ex-fiance worked for a medical supply concern in N.Y. City. I can’t even begin to tell you about the theft, double and triple billing for Medicare/Medicaid. I thought that was because it was in NYC, but this seems to be a nationwide issue.

    This is why an aspirin at a hospital costs you 10 bucks.

    I would start with that industry because I know for a fact that the fraud runs pretty deep. The big question is what will happen to that particular industry if DeathCare isn’t stopped? I’m assuming they’ll tank.

    How can you expect people to pay for something that they consider a moral and ethical crime? I keep hearing “for the health of the mother”-that is so rare it is almost negligible. They can’t even tell the truth-the mother finds the pregnancy inconvenient-therefore the pregnancy is terminated-her final solution. I really find this issue hard to discuss because of so much crib death among family and friends. It is beyond heartbreaking. This must be very hurtful to people who lost children. I’m not God and I never want to play God.

    Agree…one very important consideration.

    However, they will just argue that an ID Chip can be put on an ID Card that one must carry with him/her.

    One problem they have encountered, though, is the fact that employers would have to purchase equipment to screen employees upon entering the workplace. The screening machines are not cheap so they suggested a Post Office or other facility be used to screen employees.

    Can you imagine going to the Post Office before you go to work just to get into work every morning; quite inconvenient IMHO.

    State A.G.’s can file charges against the Reps and Senators from their states who took bribes for their votes and other unlawful activities.

    Also, I wonder if the millions of tea party protestors are ready to push these people out of power. Tens of thousands of plaintiffs may not be so easy to dismiss.

    Also, I wonder if all the betrayed pro-lifers are angry enough to file charges against their Reps in their states.

    I’m sure tens of thousands of irate constituents can compile a comprehensive list of all the laws broken just in the whole deathfare fiasco alone.

    For one thing, both Pelosi and Reid added new provisions to the “reconciliation bill,” which is illegal. According to the law, the new legislation was/is subject to filibuster, which didn’t happen.

    Maybe those 17,000 dems who signed onto the facebook page of a repub candidate, in one day, are motivated enough to sign complaints and to press criminal charges against their dem rep.

    Sounds like people are angry enough to push until these corrupt “officials” are unseated and brought to trial.

    At this point, we need massive numbers of people pushing back through the justice system, law enforcement, the media, the state legislature, their businesses, the local newspapers, just every possible avenue. We cannot just let this slide.

    Elected officials are not above the law, don’t get free passes, and are not exempt from the consequences of their criminal behavior.

    If Congress won’t hold themselves accountable, we the people have to do so . . . . or forever hold our peace.

    I recently had the pleasure of talking with Dr. James David Manning who has been ministering to the people of Harlem since 1981. He is now the Senior Pastor at ATLAH which stands for All the Land Anointed Holy, Manning’s inspired name for Harlem as of September 14, 1991.

    The CIA needed Muslims or others who could easily blend into the Muslim environment in the Middle East. The CIA persuaded Columbia University to extend their foreign student program to Obama, now a Columbia student, so that he might travel to Pakistan and enroll in the universities around Karachi in addition to the Patrice Lumumba School in Moscow. [1] The school, one of Russia’s most prestigious universities was founded on February 5, 1960 as The Peoples’ Friendship University of Russia (PFUR). It was renamed the Patrice Lumumba School on February 22, 1961. On February 5, 1992 the university re-adopted its former name. According to their web site, “The main aim was to give young people from Asia, Africa and Latin America, especially from poor families, an opportunity to get University education and to become highly qualified specialists. The students were admitted through non-governmental organizations, governmental establishments, and the USSR embassies and consulates.” [2]

    Obama, as an undercover agent, was the lead agent in the arms and money supply for the CIA-trained Taliban Army against the Soviet Army war machine. His actions were integral to the Taliban’s success in their opposition to the Soviet invasion of Afghanistan. Obama, it is publicly acknowledged, went to Pakistan in 1981. There is no way of knowing how often Obama traveled between Pakistan and Russia. According to Dr. Manning, Obama was an interpreter for the CIA during the war in Afghanistan. When Obama completed his CIA operations in the mid 1980s and returned to the U.S. he persuaded the State Department to maneuver his entrance into Harvard Law School; since the CIA, the U.S. president’s personal agency for black operations throughout the world, also has connections to federal and state politicians, they managed to arrange Obama’s entrance to yet another elite school in 1988.

The penalty increases from $95 in 2014, $350 in 2015 up to $750, with a maximum of $2,250 per family or 2 percent of household income, whichever is greater, by 2016. After 2016, the penalty increases automatically through a cost of living adjustment annually. See Patient Protection and Affordable Care Act, H.R. 3590, Sec. 5000A (2010).”

    Here’s the letter:

    I called the TX AG the other day and I also wrote to my AG. I got an email from John Boehner last night asking for money for his re-election. I wrote him this letter this morning:

    Mr. Boehner,

    There won’t be ANY re-elections if the gutless Congress doesn’t stand up and honor their oath to the constitution and demand Kenya Boy’s vital papers!!!!!!!!! We are just a few weeks away from Amnesty for illegal aliens. I know very well that every single member of Congress got the Presentments from the American Grand Jury last summer. Every single one of you know he is a usurper. The whole world knows he is a usurper and yet all of you continue this charade!!! It makes me sick!

    It’s going to be up to the citizens of this country to save America. All of the Republicans will be voted out! Even the good ones…Bachmann, Pence, DeMint and You too. That’s if we’re still standing. I have given money to Orly Taitz, and other patriots who are working feverishly to bring justice. I will never give money to the Republican Party. You have a lot of nerve asking the American people for money to impeach “Nazi Peloser”. Why don’t you just DO IT!!!!!!!

    I am heartbroken for my country. I have been fighting this for so long and I am so tired and so angry at all of you. I will NEVER give up. We are on the brink of a civil war. I am so disgusted with the government. You are all such cowards. Stop aiding and abetting treason and STAND UP!!!!!!
