Davis said they were told that If they hired builder Jacob Kiferbaum’s
firm, , the then-Illinois Health Facilities Planning Board would
support their plans. Later, Kiferbaum and health board member Stuart
Levine and Tony Rezko, a top Blagojevich fundraiser, either pleaded
guilty or were convicted on federal charges.”

They actually had enough wiretap evidence without Levine cooperating. Once Blagojevich was too tainted by investigation and Obama was being groomed for the presidency, Obama had to be protected.

after the 2008 elections. Furthermore, the Justice Department has purposefully reworded the Indictment and refrained from calling witnesses and revealing

The real estate specialist, Kenneth J. Conner, said bank officials replaced an appraisal review he prepared on the property and FBI agents were investigating
in late 2007 whether the Rezko-Obama deal was proper.

“Agents and I talked about payoff, bribe, kickback for a long time, though it took them only a short number of minutes of talking with me while looking at
the appraisal to acknowledge what they already seemed to know: The Rezko lot was grossly overvalued,” Mr. Conner told The Washington Times Monday.

“Rezko paid the asking price on the same day Obama paid $300,000 less than the asking price to the same seller for his adjacent mansion,” he said. “This begs
the question of payoff, bribe, kickback.””

“Frawley says in the deposition that on March 13, 2006, he was in the Dirksen Federal Building at 219 S. Dearborn, making a phone call to Rezko’s cell phone and secretly recording him when attorney Weaver walked in and interrupted him.

Also in the room at the time, according to Frawley, were: Assistant U.S. Attorney Jacqueline Stern; James “Sam” Dorger Jr., of the Illinois attorney general’s office’s public-integrity unit; an “FBI agent whose name I do not recall”; and Thomas Durkin, a criminal attorney also representing Frawley.

“I was on the phone, making a phone call to Tony Rezko,” Frawley says, according to the transcript. “I had a luncheon engagement with him. George was outside of the room where I was making the telephone call, and the purpose of the call was for me to keep my luncheon engagement with Tony Rezko and to go over and to record Tony Rezko.

“George saw and heard me on the phone, came running in and went like this [demonstrating]: Cut it,” drawing his hand across his throat.

Later in the deposition, Weaver’s lawyer, Daniel F. Konicek, asks Frawley about what specific information Weaver is supposed to have told Frawley to withhold from federal authorities.

“I’m assuming the information is about the payments made by Rezko to Obama, so we know we’re talking about the right conversation, right?” Konicek asks Frawley.

Frawley doesn’t answer. So Konicek presses him: “Am I correct it was about Obama being paid by Rezko?”

Frawley replies: “I’m not answering that question, based upon my attorney’s instructions.”

Nobody directly involved with the deposition — including Frawley and his lawyers, Weaver and his lawyers, and the FBI and U.S. attorney’s office — would comment.”

“Chicago Sun Times Does Hit-and-Run on Obama-Rezko Payoff Lead”

“Last July, two Chicago Sun-Times reporters noted an allegation of “payments made by Rezko to Obama” that surfaced in a deposition involving former Rezko business partner Daniel T. Frawley. Since then, the only follow-up coverage from the Sun-Times has been the sound of crickets.
An article dated July 11, 2011, entitled “Ex-Rezko partner’s sentencing delayed,” announced that Daniel Frawley’s sentencing for bank fraud had been postponed, yet again. He came up for sentencing again this week, and — surprise! — there’s been another postponement.”

“If you read the deposition over the holidays, keep eggnog close. It is 65 pages of mind-numbing dialogue that finds, at one point, the opposing attorneys arguing over the meaning of the word “this.”

So, to summarize:

o A former key business associate of Tony Rezko pleads guilty to a crime after the statute of limitations had expired.

o Frawley agrees to pay a whopping $4 million in restitution, with no apparent means to do so. If, miraculously, he comes up with the four million, ask yourself: who benefits the most?

o His lawyers hope that his cooperation will mean a lighter sentence for a crime that was past the statute of limitations to begin with. Did the feds have something else on Frawley that they used as leverage?

o Frawley allegedly provides useful information on Rezko, but we don’t know what that was about. He didn’t testify at Rezko’s trial. How come?

o One last question, in an episode full of questions: did the Sun-Times back off this lead because of its continuing support for Barack Obama?

In a December 5, 2011 e-mail, this writer asked Tom McNamee, editorial page editor of the Chicago Sun-Times, if the paper stood by its 2008 endorsement of Obama for the presidency. McNamee responded:

When we write editorials, including updates on earlier editorials, it will be for Sun-Times readers, Mr. Cary. Keep reading the paper, as I’m sure you now will, and we will continue to weigh in on President Obama from time to time.

Hearing that as a non-answer, the question was forwarded to Andrew Herrmann, managing editor of the paper. He responded:

The paper endorsed Obama for president. He was elected president. Since then, we have critiqued his decisions regularly — some good, some bad. But we have never expressed any regret or reversal of our endorsement editorial.

No regrets from the Sun-Times. Just hit-and-run journalism.”

The Chicago SunTimes has become silent, but at least they covered the deposition. The Chicago Tribune shied away from the story. Don’t take my word for it. Go to your favorite search engine and search for a Tribune article on Daniel Frawley in 2011.

“Blagojevich jury forewoman says class saw a blank juror questionnaire”

“The jury forewoman in Rod Blagojevich’s second trial denied today that she improperly took a juror questionnaire and showed it to a high school class. The questionnaire in question was just a blank form that she got from the court to explain the civic process to students, forewoman Connie Wilson said.

“Of course, I couldn’t have access to any of my own forms because those are all sealed in court,” said Wilson, explaining that the court clerk sent her blank forms that are regularly issued to government classes and civic teachers.

The questionnaire issue arose last week when the former governor’s legal team filed an emergency motion alleging that Wilson may have flouted the judge’s orders that juror questionnaires be kept under seal and confidential. The motion cited a newspaper article that reported that Wilson showed “copies of her jury summons and questionnaire” to students during an appearance at an Aurora high school.

But in a sharply worded rebuke Monday, U.S. District Judge James Zagel denied the motion, calling it “harebrained” and suggesting that the Blagojevich lawyer who wrote the filing write a letter of apology to the juror.

“This motion was prepared without any adequate forethought,” Zagel said.

Wilson said she found out about the motion on Saturday from her sister, who called to tell her that it was all over the news. On Sunday, Wilson said reporters waited outside her home as she and her family threw their annual Christmas party.

“It was a little disconcerting,” Wilson said. “We’ve been so careful about everything we say and everything we talk about as jurors to make sure we are always appropriate.”

The filing was submitted by Lauren Kaeseberg, one of Blagojevich’s attorneys, but the rest of the legal team was included on the filing – Sheldon Sorosky, Aaron Goldstein and Elliott Riebman.

“If it is found that Ms. Wilson violated court rules, her violations must result in a new trial,” Blagojevich’s attorneys argued.

But Zagel on Monday said the motion “smacks a little bit of retaliatory (motive against) a juror.””

He is.  Pelosi backed off.  Issa appears to have done the same.  Holder is holding the line.  Information coming out of Chicago is still being limited – clamped down upon.  That doesn’t mean they aren’t nervous.  They are.
 Watch the Blagojevich thing – the trial.  The deal to be made.  Where there’s smoke, there’s fire.  And what happened to Rezko?  That’s part of the same deal.  A company called Companion Security…Blago, Rezko, the Feds.  It’s all brewing – maybe boiling over?  Of course the national media is burying all of this.  Most of it – that’s partly why we gotta back off.  The risk, the exposure, it’s too great.  We need help – help that I thought was coming but never fully materialized.

Rezko?  That could still be a problem for Obama?

(Laughs)  Yeah – do you think?  Hell yeah it could be a problem.  The guy has been holed up in jail waiting for sentencing.  Why?  Why so long?  Holder’s people are all over that thing – just like Blago.  Obama is in the mix of that mess for sure.  Does anybody really dispute that?  But you see, it’s the Justice Department’s complicity in protecting Obama during the ongoing investigations – talking current crimes here now… that is what can really sink them.  Not that there is just bank fraud, RICO  laws that were broken, payoffs, intimidations, – that’s all basic Chicago business as usual, right?  But now add the White House’s handling of all of that since Obama became President  – now you got a presidential scandal.  Now you got an investigation that leads to uncovering all of that mess.  Now you got grounds to legally go after Holder, Jarrett, and even the President of the United States.  Hell, throw in the First Lady too…”

“After this story was published Monday morning, U.S. District Judge Ronald A. Guzman canceled Daniel T. Frawley’s sentencing hearing, which had been scheduled for Tuesday. Court records did not indicate why Guzman did this. Frawley’s sentencing had not been re-scheduled.

Daniel T. Frawley once teamed with Tony Rezko — the political fixer who’s now in jail — in what turned out to be a doomed effort to open a training school for Iraqi security forces in western Illinois. Now, Frawley faces a federal prison stretch of his own.”

“Details about Frawley’s cooperation with the U.S. attorney’s office, the FBI and the Illinois attorney general’s office can be gleaned from a 65-page court deposition he gave seven months ago in a legal-malpractice lawsuit that he filed against his former longtime lawyer, George Weaver. In the lawsuit, Frawley accuses Weaver of having overbilled him and telling him to “withhold certain information from the government” when he was cooperating with authorities.

That sworn statement, given Dec. 1, 2010, is posted at suntimes.com/news/watchdogs. In it, Frawley talks about three meetings he’s had with law enforcement authorities since 2006. The deposition outlines how he secretly recorded Rezko, and it raises a new and unsubstantiated question about Rezko’s once-close relationship with Obama — an issue that dogged the then-U.S. senator during his presidential campaign four years ago.”

““I was on the phone, making a phone call to Tony Rezko,” Frawley says, according to the transcript. “I had a luncheon engagement with him. George was outside of the room where I was making the telephone call, and the purpose of the call was for me to keep my luncheon engagement with Tony Rezko and to go over and to record Tony Rezko.

“George saw and heard me on the phone, came running in and went like this [demonstrating]: Cut it,” drawing his hand across his throat.

Later in the deposition, Weaver’s lawyer, Daniel F. Konicek, asks Frawley about what specific information Weaver is supposed to have told Frawley to withhold from federal authorities.

“I’m assuming the information is about the payments made by Rezko to Obama, so we know we’re talking about the right conversation, right?” Konicek asks Frawley.

Frawley doesn’t answer. So Konicek presses him: “Am I correct it was about Obama being paid by Rezko?”

Frawley replies: “I’m not answering that question, based upon my attorney’s instructions.””

“Two years ago, Iraq’s Ministry of Electricity gave a $50 million contract to a start-up security company owned by now-indicted businessman Tony Rezko and a onetime Chicago cop with a checkered financial past. Within a month, an Iraqi leadership change left the deal in limbo.

Now the company, Companion Security, is working to revive its contract to train Iraqi power-plant guards in the United States.

Companion found support last summer from Gov. Blagojevich, whose staff offered to let the company lease a military facility in western Illinois. Since then, Companion has been lobbying officials from Washington to Baghdad about its Iraqi deal, according to documents obtained by the Chicago Sun-Times.

Blagojevich’s offer to assist Companion came as a federal investigation into Rezko’s state-government dealings was heating up. A former top fund-raiser for the governor and other politicians, Rezko was indicted on corruption charges in October — four months after Blagojevich’s homeland security chief wrote a letter inviting Companion to train the guards at the Savanna Army Depot.

The governor’s spokeswoman said state officials didn’t know Rezko had ties to Companion until the Sun-Times began asking questions. Blagojevich and his staff also didn’t know that Companion’s chief executive, former cop Daniel T. Frawley, had a history of financial problems, she said.

It’s unclear if Frawley and Rezko remain partners. They declined to comment.

After the state found a proposed training site, Frawley went to Sen. Barack Obama (D-Ill.) last August.

Obama’s staff declined to help.

“The Senate staff had two meetings, one conference call, and sporadically e-mailed with representatives of Companion Security about their request for Sen. Obama to write a letter introducing the company to senior officials in the Iraqi government,” Obama spokesman Ben LaBolt said. “That is not the kind of action Sen. Obama usually takes for individual companies, and our staff concluded on that basis to decline the requested assistance.”

LaBolt said Obama’s staff was unaware Companion had any ties to Rezko, who has raised campaign donations for Obama.
Companion beefed up its lobbying efforts in March, hiring a Washington attorney who has contacted the U.S. State and Commerce departments. Frawley wants U.S. officials to persuade the Iraqi government to honor the contract he signed on April 18, 2005, when Aiham Alsammarae, another friend of Rezko’s, ran Iraq’s electricity agency.”

“As Frawley sought to revive the contract in spring 2006, Blagojevich’s chief of staff, John Harris, directed the state’s homeland security adviser, Jill Morgenthaler, to find “a military site for the training of Iraqi police forces,” Morgenthaler wrote in an April 26, 2006, e-mail. She wrote the letter in June 2006 offering the Savanna site.

Two months later, Frawley sought help from Obama, a member of the Senate Foreign Relations Committee who is now running for president. Frawley met with Seamus Ahern, who runs Obama’s Moline office. Frawley and Ahern discussed the proposal over a period of about six months.

Obama and Blagojevich viewed Frawley’s efforts as a chance to create jobs in the Quad Cities area.”

The following events leading up to 2006 are damning!

June 7, 2004: Stuart Levine, a longtime Republican reappointed to the powerful Illinois Health Facilities Planning Board, abruptly resigns on the eve of several important hospital expansion votes. The revelation is the first indication that the Blagojevich administration is under federal criminal investigation.

June 27, 2004: The Tribune discloses that an official for one hospital seeking permission to expand was wearing a federal bug during meetings in an effort to expose extortion attempts by Levine and others for contributions to Blagojevich.

July 2, 2004: Levine resigns from his seat on the board of the state Teachers’ Retirement System. It remains undisclosed that federal authorities had secretly taped Levine’s conversations.

May 9, 2005: Levine is indicted on corruption charges. Federal subpoenas are issued to numerous administration sources, including top Blagojevich fundraiser Antoin “Tony” Rezko

May 20, 2005: The governor’s office acknowledges to the Tribune that Rezko has an ongoing eight-year professional relationship with Patricia Blagojevich’s home-based real estate brokerage, River Realty Inc.

Sept 15, 2005: Prominent Democratic fundraiser Joseph Cari and a former lawyer for the state’s teacher’s pension board pleads guilty in an extortion scheme that steered state pension business to favored companies in exchange for campaign contributions to a high-ranking public official described in court documents only as “Public official A.”

Oct. 25, 2005: The Tribune discloses a federal grand jury investigation into the alleged political hiring practices of the Blagojevich administration, including the governor’s top hiring aide, Joseph Cini.

Aug. 5, 2006: The Tribune reports that Levine is cooperating with the federal investigation of state government.

Sept. 10, 2006: The Tribune reveals that the FBI is investigating allegations by a one-time Blagojevich family friend that she had concerns her state job may have come in return for a $1,500 personal check her husband wrote to one of Blagojevich’s children.

Sept. 17, 2006: The Tribune reports that the Blagojevich administration skirted state hiring rules to give jobs to at least 360 people whose applications were sent through back channels by the governor’s offices and politically connected officials.

Oct. 11, 2006: Blagojevich confidant and top fundraiser Rezko is indicted on federal charges he sought millions of dollars in kickbacks and campaign donations from firms seeking state business.

Oct. 27, 2006: Political insider Levine pleads guilty in a scheme to squeeze millions of dollars from firms seeking state business. In court papers, federal authorities spell out allegations that Rezko and another schemer, identified by sources as Blagojevich confidant and top fundraiser Christopher Kelly, were using their influence for corrupt purposes.

Oct. 27, 2006: The Tribune reveals that Blagojevich’s wife, Patricia, earned more than $113,000 in real estate commissions in 2006 through a woman with a no-bid state contract whose banker husband–a major Blagojevich fundraiser–has business pending before state regulators. Both the FBI and the Cook County state’s attorney’s office begin investigations.”

Next examine what else happens in 2006.

“Illinois Gov. Rod Blagojevich has always been rumored to be interested in higher office. A single entry in a campaign-finance report he filed this week could add fuel to the speculation.

Blagojevich paid $7,500 in December to one of the top Democratic political strategists in Iowa, where contacts are important for anyone with presidential aspirations.”

“In the Summer of 2006, then-U.S. Sen. Obama backed Blagojevich even though there were serious questions at the time about Blago’s hiring practices.

At the time, numerous state agencies had had records subpoenaed, with U.S. Attorney Patrick Fitzgerald telling authorities he was looking into “very serious allegations of endemic hiring fraud” with a “number of credible witnesses.”

In an interview with the Chicago Daily Herald in July 2006, then-Sen. Obama said, “I have not followed closely enough what’s been taking place in these investigations to comment on them. Obviously I’m concerned about reports that hiring practices at the state weren’t, at times, following appropriate procedures. How high up that went, the degree at which the governor was involved, is not something I’m going to speculate on.

“If I received information that made me believe that any Democrat had not been acting in the public interest, I’d be concerned,” Obama said.

That said, Mr. Obama said, “If the governor asks me to work on his behalf, I’ll be happy to do it.”

Apparently the governor did. At the Illinois State Fair in August 2006, Obama spoke on Blagojevich’s behalf.

“We’ve got a governor in Rod Blagojevich who has delivered consistently on behalf of the people of Illinois,” Obama told the crowd.

In January 2007, Blagojevich’s office reserved the Old State Capitol for Mr. Obama’s presidential announcement at Obama’s request.”

Instead of protecting the citizens of Illinois as he has touted, Patrick Fitzgerald prosecuted Rezko, a businessman, instead of Blagojevich, the governor of Illinois.

From Patrick Fitzgerald’s Government Sentencing Memorandum.

“Antoin Rezko, …recently received a sentence of 126 months’ imprisonment for corrupt activity that he engaged in directly with Blagojevich or with  lagojevich’s tacit approval. Yet, Rezko: (a) held no elected office of trust;”

By prosecuting Rezko first and not calling him as a witness, they kept him incarcerated with no ability to rat on Obama.

They delayed the arrest of Blagojevich until after the 2008 election.

The prosecution botched the first Blagojevich trial and did not call Rezko as a witness.

Counts 1,2 and 4, the ones with the oldest corruption activity and the strongest ties to Obama, were dropped. The alleged excuse was to streamline and simplify the case. Of course if Blagojevich had been arrested by 2007 that would not have happened and Obama would not have been elected.

The second Blagojevich trial also did not call Rezko as a witness. This added to the delays. Blagojevich has just been sentenced.

The day of Blagojevich’s sentencing, we learn that Tony Rezko has filed an appeal. A Blagojevich appeal is sure to follow.

The Blagojevich and Rezko appeal process will go late into or past the 2012 election cycle. Once again protecting Obama.

This is simple enough even for a fifth grader, maybe even a congressman to follow.

There is so much to write about today Thursday, December 8, 2011. I just heard Rush Limbaugh state that this is the most corrupt administration in his lifetime. Rush had just remarked about the emails that have surfaced indicting Obama, Holder and the US Justice Department in an effort to push gun control in the US.

Yesterday Rod Blagojevich was sentenced to 14 years for some of the  corruption that he was involved in in Chicago and Illinois with Tony Rezko, et al and with cooperation from Barack Obama. We also learned yesterday that Tony Rezko is appealing his conviction.

Today, December 8, 2011, former senator and NJ Governor Corzine stated that he doesn’t know where the money is.

Judge James Zagel, Patrick Fitzgerald, Eric Holder and the entire US Justice Department have done their best to protect Obama. By waiting to prosecute Blagojevich, crafting 2 trials while dropping counts 1, 2 and 4, they have insured that even if Blagojevich appeals his conviction, it will be defered until after election cycles affecting Obama.

Rush, I am older than you. This is the most corrupt US Administration in my lifetime or that I have read about in history in this country.

Today we also learn that Tony Rezko, long time associate of Barack Obama and corruption crony, has filed a notice of appeal in his sentence of 10 and a half years for his June 2008 conviction.

“Attorneys for Rod Blagojevich’s former top fundraiser announced plans Tuesday to appeal his corruption-related convictions and 10 ½-year prison term, viewed by some as a baseline for the former Illinois governor in his sentencing later today.

Antoin “Tony” Rezko was sentenced last month for his 2008 convictions for fraud, money laundering and plotting to squeeze more than $7 million from companies seeking to do state business during Blagojevich’s tenure. A federal judge derided him for his “selfish and corrupt actions” in giving him 10 1/2 years, minus time served.

Rezko’s attorneys filed a notice of appeal Tuesday, but had not yet made a formal appeal to the 7th U.S. Circuit Court of Appeals.

A different judge, James Zagel, will decide Wednesday on a sentence for Blagojevich, convicted of trying to sell or trade a U.S. Senate seat and shaking down officials for campaign contributions.”

“Rezko, 56, was a former Chicago real estate developer and fast-food entrepreneur who was well-known in Illinois politics. Observers say Rezko’s sentence increases the odds Blagojevich’s term will be longer.

“Prosecutors are going to say, ‘Hey, Blagojevich was the grandmaster of all this – so he should certainly get even more time than Rezko,’” said Phil Turner, a former federal prosecutor in Chicago.

“The courtroom was packed. Rod is wearing a navy pinstripe suit. Looks paler than usual. Been alternating wringing his hands and clenching his jaw during proceedings. Patti is seate between her brother Rich who often has his arm around her and her sister Deb Mell. She is dressed in a grey pinstripe jacket and white top. She looks paler than when I last saw her and seems serious. This morning the Government and Defense both stated their cases- pretty much the same as has been reported in the recent court filings. The Defense says Blagojevich didn’t take anything, that he relied on his advisors and that indeed Childrens got their legislation and the racetrack passed their legislation. The Prosecution said “It is not an issue how much money was involved- the issue is what he wanted to obtain” They stressed that Blagojevich was the only one who stood to benefit- not his aides. Judge Zagel made a few points: – that Blagojevich’s failure to complete an offense does not necessarily lessen his culpability -“The Governor of Illinois had the power to inflict penalties on those who did not pay” -The recorded voice of the Defendant mentions $1.5 million – speaks only of this amount- that was the benefit he had in mind. In a very real sense that is what he said. The demand might have been more “the valuation is based on his words””

The 2 day sentencing hearing for Rod Blagojevich begins in a few minutes. Patrick Fitzgerald and the US Justice Department have done their best to delay the prosecution of Blagojevich and protect Obama. This should be clear to anyone paying attention, even the House Judiciary Committee. If you watch closely and pay attention, Patrick Fitzgerald let’s the cat out of the bag on several occasions.

From the Government’s Sentencing Memorandum, signed by Patrick Fitzgerald and filed on November 30, 2011.

“Over the course of a relatively brief period of time, during his machinations
surrounding the appointment of a United States Senator, and the shakedowns of
hospital and racetrack executives, the defendant revealed his corrupt, criminal
character. But, as the evidence and Blagojevich’s conduct at his trials established, these were not isolated incidents. They were part and parcel of an approach to public office that defendant adopted from the moment he became governor in 2002. In light of Blagojevich’s extensive corruption of high office, the damage he caused to the integrity of Illinois government, and the need to deter others from similar acts, the government suggests a sentence of 15 to 20 years imprisonment is sufficient but not greater than necessary to comply with § 3553.”
“Blagojevich’s criminal activity was serious, extended, and extremely damaging.
Blagojevich was the sitting governor of Illinois when he committed his crimes. As the chief executive of the state, Blagojevich was in a special position of responsibility to the public. His abuse of office is particularly grave given the faith put in him by the citizens of Illinois.”
“Blagojevich agreed to use his official powers for personal benefit from the very
moment he became governor. On the heels of one corrupt governor and after running on a campaign to end “pay-to-play,” Blagojevich took office and immediately began plotting with others to use the Office of Governor for his personal gain through fraud, bribery, and extortion. Blagojevich and others committed a variety of criminal acts for several years before Blagojevich became aware of the FBI investigation into his actions and the actions of his administration. As the evidence demonstrated, Blagojevich continued his criminal acts through 2008 despite his knowledge of the FBI’s investigation. Indeed, the arrest and conviction of various members of Blagojevich’s
inner circle did nothing to dissuade Blagojevich from continuing his criminal activity until the day of his arrest.3”
“Blagojevich held up funding to every children’s hospital in the State of
Illinois.”
“Further deprecating Blagojevich’s appreciation for his criminal conduct is his
request for a probationary sentence. See Statement of Aaron Goldstein on Chicago Tonight, 9/28/11. By way of comparison, Antoin Rezko, who voluntarily surrendered immediately after conviction to start serving what he knew would be a prison sentence, recently received a sentence of 126 months’ imprisonment for corrupt activity that he engaged in directly with Blagojevich or with Blagojevich’s tacit approval. Yet, Rezko:
(a) held no elected office of trust; (b) was not involved in any of Blagojevich’s 2008 criminal activity; (c) provided some cooperation to the government that proved valuable; (d) endured harsh conditions of confinement; and (e) ultimately accepted full responsibility for all of his criminal conduct. Blagojevich engaged in extensive criminal conduct with and without Rezko, provided no cooperation, perjured himself for seven days on the witness stand, and has accepted no responsibility for his criminal conduct. A probationary sentence would be entirely inconsistent with promoting respect for the law, and the request in itself demonstrates Blagojevich’s continuing refusal to recognize the seriousness of his criminal conduct.13”
“Blagojevich repeatedly committed serious criminal acts that have done
enormous damage to public confidence in Illinois government.”

Notice above that Patrick Fitzgerald helps make the case for Blagojevich being prosecuted first.

Yes, indeed, Patrick Fitzgerald allowed Blagojevich to remain in office until December 8, 2008 even though they knew as early as late 2003 that the Blagojevich Administration was involved in widespread corruption. The wide-ranging public corruption probe that led to the arrest of Illinois Gov. Rod Blagojevich got its first big break when a grandmother of six walked into a breakfast meeting with shakedown artists wearing an FBI wire.
Pamela Meyer Davis had been trying to win approval from a state health planning board for an expansion of Edward Hospital, the facility she runs in a Chicago suburb, but she realized that the only way to prevail was to retain a politically connected construction company and a specific investment house. Instead of succumbing to those demands, she went to the FBI and U.S. Attorney Patrick J. Fitzgerald in late 2003 and agreed to secretly record conversations about the project.

Her tapes led investigators down a twisted path of corruption that over five years has ensnared a collection of behind-the-scenes figures in Illinois government, including Joseph Cari Jr., a former Democratic National Committee member, and disgraced businessman Antoin “Tony” Rezko.

2004

  • March – May 2004: FBI chart presented to the Rezko Trial jury on April 28, 2008, shows 257 calls from Rezko’s phones to Blagojevich’s chief of staff, Lon Monk, between March 2004 and May 2004
  • June 7, 2004: Stuart Levine, a longtime Republican reappointed to the powerful Illinois Health Facilities Planning Board, abruptly resigns on the eve of several important hospital expansion votes. The revelation is the first indication that the Blagojevich administration is under federal criminal investigation.
  • June 27, 2004: The Chicago Tribune discloses that an official for one hospital seeking permission to expand was wearing a federal bug during meetings in an effort to expose extortion attempts by Levine and others for contributions to Blagojevich.
  • July 2, 2004: Levine resigns from his seat on the board of the state Teachers’ Retirement System. It remains undisclosed that federal authorities had secretly taped Levine’s conversations.

Why wasn’t Rod Blagojevich indicted in 2005?

  • May 9, 2005: Levine is indicted on corruption charges. Federal subpoenas are issued to numerous administration sources, including top Blagojevich fundraiser Antoin “Tony” Rezko.
  • May 20, 2005: The governor’s office acknowledges to the Tribune that Rezko has an ongoing eight-year professional relationship with Patricia Blagojevich’s home-based real estate brokerage, River Realty Inc.
  • September 15, 2005: Prominent Democratic fundraiser Joseph Cari and a former lawyer for the state’s teacher’s pension board pleads guilty in an extortion scheme that steered state pension business to favored companies in exchange for campaign contributions to a high-ranking public official described in court documents only as “Public official A.”
  • October 25, 2005: The Tribune discloses a federal grand jury investigation into the alleged political hiring practices of the Blagojevich administration, including the governor’s top hiring aide, Joseph Cini.

  • August 5, 2006: The Chicago Tribune reports that Stuart Levine is cooperating with the federal investigation of state government.
  • October 11, 2006: Stuart Levine pleads guilty. Levine is cooperating with the government. Patrick Fitzgerald: “This indictment describes a frenzy of corrupt scheming, particularly in April and May 2004, in which political insiders sought to manipulate the activities of two state boards to fleece investment firms and individuals.   • January 16, 2007:”Judicial Watch filed an open records lawsuit against the office of Governor Rod Blagojevich (D-IL), who is under federal investigation on several fronts, including corrupt hiring practices. Judicial Watch’s lawsuit, filed on January 16, 2007 in the Cook County, Illinois Circuit Court, specifically seeks, among other documents, any and all grand jury subpoenas received by the Governor’s office or any state agencies under the Governor’s control. The subpoenas reportedly were issued by U.S. Attorney Patrick Fitzgerald’s office.Governor Blagojevich’s office refuses to release the subpoenas, claiming they are exempt from public disclosure. In a letter to Judicial Watch dated December 7, 2006, Allison Benway, Legal Counsel for Governor Blagojevich stated, “This Office cannot confirm or deny the existence of the documents requested, and even if this Office were to have documents responsive to your request, such documents would be exempt from release…””  http://www.judicialwatch.org/blagojevich
  •  March 9, 2007: Anita Mahajan, with business ties to Patti Blagojevich, received six felony charges.
  • December 13, 2007: Blagojevich fundraiser Christopher Kelly is indicted on federal tax evasion charges.

Or prosecuted in spring of 2008 instead of Tony Rezko.

Rod Blagojevich was governor of Illinois and had been monitored since late 2003. Tony Rezko was a businessman and never called as a witness.

Despite the doubletalk coming from Patrick Fitzgerald about protecting the citizens of Illinois, Blagojevich was arrested after the 2008 election in December.

Patrick Fitzgerald’s own words are damning.

“I was not going to wait until March or April or May to get it all nice and tidy”  “I think that would be irresponsible.””

“Governor Blagojevich has been arrested in the middle of what we can only describe as a political corruption crime spree. We acted to stop that crime spree.”.

“I just think it’s very, very disturbing that we have these pay-to-play allegations going on for years.”

And perhaps one more.

“We make no allegations that Obama was aware of any alleged scheming by Blagojevich.”
