“Why did the Illinois Senate Health & Human Services Committee, with Obama as chairman, create and push Bill 1332, “Illinois Health Facilities Planning Act,” early in 2003, which reduced the number of members on the Board from 15 to 9, just prior to rigging by Tony Rezko and Rod Blagojevich?”…Citizen Wells

I guess the Obama camp was resting under the false illusion that most of Obama’s corruption buddies were in prison or going through a lengthy appeal process that will inevitably drag on through the election cycle and stay out of the news. That is except for Daniel Frawley who linked Obama to a payment from Rezko in a deposition last year.

Of course, there is still the lingering question of why the prosecution of Blagojevich was delayed so long

and why Tony Rezko was never called as a witness

and where is Stuart Levine

and why Patrick Fitzgerald was aggressively pursuing Karl Rove and Scooter Libby

and why Colin Powell did not inform the Bush Administration of Rove’s innocence

and why Colin Powell endorsed Barack Obama??????

It is going to be a busy court week for Barack Obama. One of his corruption cronies, William Cellini, has a hearing today for a ruling on a possible retrial. Judge James Zagel may make that ruling today. Tomorrow, January 25, 2012, Stuart Levine and Steven Loren have a status hearing in the courtroom of Judge Amy J. St. Eve. And conspicuously absent from the courtroom is Daniel Frawley, ex partner of Tony Rezko. Frawley’s sentencing has been repeatedly delayed. Daniel Frawley linked a payment from Tony Rezko to Barack Obama in a deposition.

And of course, Obama has a court date on January 26, 2012 in GA regarding his eligibility to be on the Georgia ballot and his Natural Born Citizen Status.

Will Bill Cellini get a new trial?
From the Chicago Tribune January 7, 2012.

“Cellini juror defiantly denies bias
Woman who failed to disclose her criminal past is openly hostile to defense attorney”

“In between colorful tirades aimed at William Cellini’s lawyer Friday, a juror in the Springfield power broker’s case acknowledged that she misled the court about her criminal past during jury selection but said she followed the judge’s orders to be fair-minded during the trial.

Candy Chiles, a 50-year-old child care provider from the South Side, made no attempt to hide her disdain for the attorney, Dan Webb, during a daylong hearing aimed at determining whether her equivocations masked a bias toward the judicial process. At one point, she shouted at Webb to sit down because he was getting on her nerves.

“Don’t make a fool out of me,” she said. “I sat here for five weeks and watched the way you work. I know what you’re doing.”

Heated responses are rare in the staid federal courthouse, where decorum typically prevails. And such daggers are certainly seldom thrown at Webb, a former U.S. attorney who is considered to be one of the nation’s top lawyers.

Chiles, however, said she resented being used as a scapegoat in Cellini’s efforts to get his conviction overturned.

“You’re trying to see if I’m a liar so you can get him off?” Chiles said as her voice choked with emotion. “Leave me alone! Leave me alone!”

U.S. District Judge James Zagel cut that outburst short by ordering a 90-minute recess. Chiles quickly walked out of the courtroom, shaking her head and muttering about the defense team.

It was one of her many blowups at Webb during his pointed, two-hour examination, which centered on whether Chiles knew she was being untruthful when she told the court she had not been arrested or convicted of a crime. He also questioned whether Chiles misled the court when she said she had never been involved in a civil lawsuit, despite being sued in four eviction proceedings.

Chiles repeatedly said she didn’t know that those counted as lawsuits.

“Do not do me like this,” she said from the jury box in Zagel’s courtroom. “I am not a criminal. I didn’t steal anything. … Damn you.”

Zagel — who did not order background checks on potential jurors before the high-profile trial — called the hearing to determine if Chiles’ false answers denied Cellini a fair trial. He is expected to hear arguments from both the defense and prosecution later this month before ruling.

Zagel acknowledged that Chiles hadn’t been truthful in her answers to the court during jury selection.

“I think it’s pretty clear … you did not give complete answers to these questions,” the judge said. “In a way, you did not follow the instructions of the court to answer truthfully.”

Prosecutors did not question Chiles during the hearing but made several successful objections to questions Webb asked about her past. Chiles smiled at them and said “thank you” as she left the courtroom after questioning of her ended.

Chiles, who indicated she never wanted to be picked for jury duty, said that she didn’t reveal a 2000 drug conviction because she had put the incident behind her.

“It’s in my past. I never mention it at all, that foolishness in my life,” she said.

Chiles also did not tell the court about a felony DUI conviction in 2008 and an assault arrest in 1994. She initially told the judge that she didn’t know why she failed to disclose those cases but later said that she was confused and nervous during jury selection.

But to overturn a conviction, the defense must prove that the juror had bias or prejudice toward the judicial process. Chiles insisted she had been fair to Cellini and had followed all other jury instructions.

Cellini’s lawyers are seeking a new trial based in part on revelations in a Nov. 11 Tribune story that Chiles failed to disclose two felony convictions.”

William Cellini, who was convicted of 2 counts of conspiracy to commit extortion and aiding and abetting the solicitation of a bribe on November 1, 2011, is scheduled for a evidentiary hearing on Friday,January 6, 2012 in the courtroom of Judge James Zagel. The Mainstream media has done it’s part in conjunction with the Justice Department to keep Obama out of this story.

From NBC Chicago  January 3, 2012.

“Illinois powerbroker William Cellini could get a new trial after it was revealed a juror in his recently-ended trial failed to disclose two felony convictions.

Judge James Zagel on Wednesday called for an evidentially hearing to see if the juror was biased and if a new trial is warranted.

Shortly after jurors earlier this month found the clout-heavy millionaire guilty of conspiracy to commit extortion and aiding and abetting bribery, the Chicago Tribune revealed that one of the jurors failed to disclose a felony conviction for crack-cocain possession and an aggravated DUI conviction.

Cellini was accused of conspiring with three other men to shake down the producer of “Million Dollar Baby” for a $1.5 million campaign contribution to former Illinois Gov. Rod Blagojevich.”

The following comment placed there proves my point.

“Guilty of a shakedown of a movie producer, that is it? I can only hope there are a pile of cases behind this one that are much more serious when it comes to RICO and Obama.”

There is obviously more to this long story of Chicago corruption and Rezko could have filled in many blanks.

From Citizen Wells October 19, 2011.

“In the media, Obama always made it sound like he rarely saw Rezko, saying they met for breakfast or lunch once or twice a year. However, the FBI mole John Thomas helped investigators “build a record of repeat visits to the old offices of Rezko and former business partner Daniel Mahru’s Rezmar Corp., at 853 N. Elston, by Blagojevich and Obama during 2004 and 2005,“

During his March 14, 2008 interview, the Times told Obama, Thomas is an FBI mole and he “recently told us that he saw you coming and going from Rezko’s office a lot.”

“And three other sources told us that you and Rezko spoke on the phone daily.””

“Following Obama’s efforts, the Illinois Teachers’ Retirement System gave Ariel Capital $112.5 million to manage, and added hundreds of millions more over the next few years.”

“Three other minority-run firms — Holland Capital, Loop Capital and Capri Capital Partners — also saw hundreds of millions of assets turned over to them to manage after meeting with Obama and the state pension boards.”

“Capri Capital is a little more interesting.

From the William Cellini Indictment Press Release:”
“Cellini’s alleged crimes – essentially conspiring with others to force Capri Capital, also a real estate investment firm, and Thomas Rosenberg, a principal and part owner of Capri, to raise or donate substantial political contributions for Public Official A – were the subject of testimony earlier this year at the trial of alleged co-conspirator Antoin “Tony” Rezko. Cellini was charged with conspiring with Rezko, former TRS trustee Stuart Levine, the pension fund’s outside lawyer Steven Loren and others between the spring of 2003 and the summer of 2005 to defraud TRS beneficiaries and the people of Illinois of Levine’s honest services as a TRS trustee. TRS, a public pension plan for teachers and administrators in public schools statewide except in Chicago, serves hundreds of thousands of members and beneficiaries and has assets in excess of $30 billion.

From Citizen Wells October 18, 2011.
“The significance of Stuart Levine’s testimony in the William Cellini trial yesterday went unnoticed except for those of us watching with great scrutiny and keeping the Obama connection to Chicago corruption stories alive.”
“Stuart Levine says he also paid bribes more than 10 times to the Chicago Board of Education to get contracts for a bus company.”

“We knew from the Rezko trial that Levine had bribed the Chicago Board of Education. We now know that it happened more than 10 times. This was an ongoing activity. When I read this I intuitively knew that Obama was connected. It did not take long to find out.”

“The William Cellini trial is scheduled for October 3, 2011. Tony Rezko and Stuart Levine have not been sentenced. “Judge Amy St. Eve told attorneys at a hearing Friday that she’ll sentence Tony Rezko on Oct. 21.

Rezko’s attorneys and prosecutors had asked the judge earlier to delay Rezko’s sentencing to allow for the possibility he could testify at two upcoming
trials, including Blagojevich’s corruption retrial in April.”

“Prosecutors in the Blagojevich trial have dropped 3 counts from the indictment against him. That is approximately 15 %. That does not appear on the surface
to be significant. However, counts 1 and 2 represent about half of the indictment and mention numerous Chicago corruption figures with ties to Obama. Get the

May 31, 2011.

“Rezko’s January sentencing was postponed to leave open the possibility that the onetime powerful political fund-raiser could testify in either Blagojevich’s
trial or that of Downstate businessmen William Cellini, Rezko’s lawyer said. However, prosecutors did not say whether they would tap Rezko.

Meanwhile, Rezko, who spoke briefly at a federal court hearing Thursday, revealed for the first time where he’s being housed — about 150 miles away inside the Dodge County, Wis., lock-up.”

“Assistant U.S. Attorney Christopher Niewoehner said only that it was in the interest of both the prosecution and Rezko to delay sentencing. He implied that
prosecutors hadn’t decided yet on whether Rezko will be called to testify.

Rezko’s lawyers said the convicted businessman would like to reap the benefits of testifying and possibly receive a lighter sentence. But he will not seek a
delay in sentencing beyond September.”

“I was pleased and amazed to see a reference to the Health Facilities Planning Board and Pam Davis in a Chicago Tribune article dated July 26, 2011.”

“Two members in the audience played an early but crucial role in the
FBI investigation that uncovered widespread corruption in
Blagojevich’s administration.

Pam Davis, CEO of Edward Hospital in Naperville, and William Kottmann,
CEO of Edward Medical Group, both secretly wore a listening device for
the FBI for eight months in 2003 after raising extortion complaints in
their bid to build a $218 million hospital inPlainfield.

Davis said they were told that If they hired builder Jacob Kiferbaum’s
firm, , the then-Illinois Health Facilities Planning Board would
support their plans. Later, Kiferbaum and health board member Stuart
Levine and Tony Rezko, a top Blagojevich fundraiser, either pleaded
guilty or were convicted on federal charges.”

“Jan. – Aug. 2003: Obama was Chairman of the IL Senate Health and Human Service Committee.

Feb. 20, 2003: Senate Bill 1332 “Illinois Health Facilities Planning Act” filed. Reduced members of IL Health Planning and Facilities Board from 15 to 9.”

“Ziegelmueller asked Hayden about a 2003 e-mail exchange with Lichtenstein, then the governor’s top lawyer, in which Wilhelm made recommendations for the Illinois Health Facilities Planning Board.
The name of Barack Obama, the Democratic front-runner for the presidential nomination, also appears in the e-mail as a member of a strategic team reviewing
hospital board matters with the governor’s staff when he was a state senator. The hospital board was scheduled to be revamped in the summer of 2003.
Obama was then chairman of the Senate Committee on Health & Human Services.”

“It is apparent to me that a deal was struck with the US Justice Department and that Patrick Fitzgerald was involved in the decision or minimally, was aware
of it. The Justice Dept. had more than enough evidence to indict Blagojevich at the latest by the time Stuart Levine agreed to cooperate by August 5, 2006.
They actually had enough wiretap evidence without Levine cooperating. Once Blagojevich was too tainted by investigation and Obama was being groomed for the presidency, Obama had to be protected.

Let me make this perfectly clear. I am accusing the US Justice Department of corruption, of being complicit in delaying the arrest of Rod Blagojevich until
after the 2008 elections. Furthermore, the Justice Department has purposefully reworded the Indictment and refrained from calling witnesses and revealing
testimony that would be further damning for Blagojevich and Obama. This is a criminal act which must be prosecuted.

I am calling for a congressional investigation.”

“A former Illinois real estate specialist says FBI agents have questioned him about a Chicago property that had been bought by convicted felon Tony Rezko’s
wife and later sold to the couple’s next-door neighbor, Sen. Barack Obama.

The real estate specialist, Kenneth J. Conner, said bank officials replaced an appraisal review he prepared on the property and FBI agents were investigating
in late 2007 whether the Rezko-Obama deal was proper.

“Agents and I talked about payoff, bribe, kickback for a long time, though it took them only a short number of minutes of talking with me while looking at
the appraisal to acknowledge what they already seemed to know: The Rezko lot was grossly overvalued,” Mr. Conner told The Washington Times Monday.

“Rezko paid the asking price on the same day Obama paid $300,000 less than the asking price to the same seller for his adjacent mansion,” he said. “This begs
the question of payoff, bribe, kickback.””

“The wide-ranging public corruption probe that led to the arrest of Illinois Gov. Rod Blagojevich got its first big break when a grandmother of six walked into a breakfast meeting with shakedown artists wearing an FBI wire.
Pamela Meyer Davis had been trying to win approval from a state health planning board for an expansion of Edward Hospital, the facility she runs in a Chicago suburb, but she realized that the only way to prevail was to retain a politically connected construction company and a specific investment house. Instead of succumbing to those demands, she went to the FBI and U.S. Attorney Patrick J. Fitzgerald in late 2003 and agreed to secretly record conversations about the project.

Her tapes led investigators down a twisted path of corruption that over five years has ensnared a collection of behind-the-scenes figures in Illinois government, including Joseph Cari Jr., a former Democratic National Committee member, and disgraced businessman Antoin “Tony” Rezko.”

The following events leading up to 2006 are damning!

June 7, 2004: Stuart Levine, a longtime Republican reappointed to the powerful Illinois Health Facilities Planning Board, abruptly resigns on the eve of several important hospital expansion votes. The revelation is the first indication that the Blagojevich administration is under federal criminal investigation.

June 27, 2004: The Tribune discloses that an official for one hospital seeking permission to expand was wearing a federal bug during meetings in an effort to expose extortion attempts by Levine and others for contributions to Blagojevich.

July 2, 2004: Levine resigns from his seat on the board of the state Teachers’ Retirement System. It remains undisclosed that federal authorities had secretly taped Levine’s conversations.

May 9, 2005: Levine is indicted on corruption charges. Federal subpoenas are issued to numerous administration sources, including top Blagojevich fundraiser Antoin “Tony” Rezko

May 20, 2005: The governor’s office acknowledges to the Tribune that Rezko has an ongoing eight-year professional relationship with Patricia Blagojevich’s home-based real estate brokerage, River Realty Inc.

Sept 15, 2005: Prominent Democratic fundraiser Joseph Cari and a former lawyer for the state’s teacher’s pension board pleads guilty in an extortion scheme that steered state pension business to favored companies in exchange for campaign contributions to a high-ranking public official described in court documents only as “Public official A.”

Oct. 25, 2005: The Tribune discloses a federal grand jury investigation into the alleged political hiring practices of the Blagojevich administration, including the governor’s top hiring aide, Joseph Cini.

Aug. 5, 2006: The Tribune reports that Levine is cooperating with the federal investigation of state government.

Sept. 10, 2006: The Tribune reveals that the FBI is investigating allegations by a one-time Blagojevich family friend that she had concerns her state job may have come in return for a $1,500 personal check her husband wrote to one of Blagojevich’s children.

Sept. 17, 2006: The Tribune reports that the Blagojevich administration skirted state hiring rules to give jobs to at least 360 people whose applications were sent through back channels by the governor’s offices and politically connected officials.

Oct. 11, 2006: Blagojevich confidant and top fundraiser Rezko is indicted on federal charges he sought millions of dollars in kickbacks and campaign donations from firms seeking state business.

Oct. 27, 2006: Political insider Levine pleads guilty in a scheme to squeeze millions of dollars from firms seeking state business. In court papers, federal authorities spell out allegations that Rezko and another schemer, identified by sources as Blagojevich confidant and top fundraiser Christopher Kelly, were using their influence for corrupt purposes.

Oct. 27, 2006: The Tribune reveals that Blagojevich’s wife, Patricia, earned more than $113,000 in real estate commissions in 2006 through a woman with a no-bid state contract whose banker husband–a major Blagojevich fundraiser–has business pending before state regulators. Both the FBI and the Cook County state’s attorney’s office begin investigations.”

Next examine what else happens in 2006.

“Illinois Gov. Rod Blagojevich has always been rumored to be interested in higher office. A single entry in a campaign-finance report he filed this week could add fuel to the speculation.

Blagojevich paid $7,500 in December to one of the top Democratic political strategists in Iowa, where contacts are important for anyone with presidential aspirations.”

http://www.swamppolitics.com/news/politics/blog/2006/02/blagojevich_for_president.html

“In the Summer of 2006, then-U.S. Sen. Obama backed Blagojevich even though there were serious questions at the time about Blago’s hiring practices.

At the time, numerous state agencies had had records subpoenaed, with U.S. Attorney Patrick Fitzgerald telling authorities he was looking into “very serious allegations of endemic hiring fraud” with a “number of credible witnesses.”

In an interview with the Chicago Daily Herald in July 2006, then-Sen. Obama said, “I have not followed closely enough what’s been taking place in these investigations to comment on them. Obviously I’m concerned about reports that hiring practices at the state weren’t, at times, following appropriate procedures. How high up that went, the degree at which the governor was involved, is not something I’m going to speculate on.

“If I received information that made me believe that any Democrat had not been acting in the public interest, I’d be concerned,” Obama said.

That said, Mr. Obama said, “If the governor asks me to work on his behalf, I’ll be happy to do it.”

Apparently the governor did. At the Illinois State Fair in August 2006, Obama spoke on Blagojevich’s behalf.

“We’ve got a governor in Rod Blagojevich who has delivered consistently on behalf of the people of Illinois,” Obama told the crowd.

In January 2007, Blagojevich’s office reserved the Old State Capitol for Mr. Obama’s presidential announcement at Obama’s request.”

Instead of protecting the citizens of Illinois as he has touted, Patrick Fitzgerald prosecuted Rezko, a businessman, instead of Blagojevich, the governor of Illinois.

From Patrick Fitzgerald’s Government Sentencing Memorandum.

“Antoin Rezko, …recently received a sentence of 126 months’ imprisonment for corrupt activity that he engaged in directly with Blagojevich or with  lagojevich’s tacit approval. Yet, Rezko: (a) held no elected office of trust;”

By prosecuting Rezko first and not calling him as a witness, they kept him incarcerated with no ability to rat on Obama.

They delayed the arrest of Blagojevich until after the 2008 election.

The prosecution botched the first Blagojevich trial and did not call Rezko as a witness.

Counts 1,2 and 4, the ones with the oldest corruption activity and the strongest ties to Obama, were dropped. The alleged excuse was to streamline and simplify the case. Of course if Blagojevich had been arrested by 2007 that would not have happened and Obama would not have been elected.

The second Blagojevich trial also did not call Rezko as a witness. This added to the delays. Blagojevich has just been sentenced.

The day of Blagojevich’s sentencing, we learn that Tony Rezko has filed an appeal. A Blagojevich appeal is sure to follow.

The Blagojevich and Rezko appeal process will go late into or past the 2012 election cycle. Once again protecting Obama.

This is simple enough even for a fifth grader, maybe even a congressman to follow.

“The citizens of Illinois deserve public officials who act solely in the public’s interest, without putting a price tag on government appointments, contracts and decisions.”…Patrick Fitzgerald

“I was not going to wait until March or April or May to get it all nice and tidy”  “I think that would be irresponsible.””…Patrick Fitzgerald

“Governor Blagojevich has been arrested in the middle of what we can only describe as a political corruption crime spree. We acted to stop that crime spree.”…Patrick Fitzgerald

“I just think it’s very, very disturbing that we have these pay-to-play allegations going on for years.”…Patrick Fitzgerald

“By way of comparison, Antoin Rezko,…received a sentence of 126 months imprisonment for corrupt activity that he
engaged in directly with Blagojevich or with Blagojevich’s tacit approval. Yet, Rezko:
(a) held no elected office of trust;”…Patrick Fitzgerald Sentencing Memorandum

The 2 day sentencing hearing for Rod Blagojevich begins in a few minutes. Patrick Fitzgerald and the US Justice Department have done their best to delay the prosecution of Blagojevich and protect Obama. This should be clear to anyone paying attention, even the House Judiciary Committee. If you watch closely and pay attention, Patrick Fitzgerald let’s the cat out of the bag on several occasions.

From the Government’s Sentencing Memorandum, signed by Patrick Fitzgerald and filed on November 30, 2011.

“Over the course of a relatively brief period of time, during his machinations
surrounding the appointment of a United States Senator, and the shakedowns of
hospital and racetrack executives, the defendant revealed his corrupt, criminal
character. But, as the evidence and Blagojevich’s conduct at his trials established, these were not isolated incidents. They were part and parcel of an approach to public office that defendant adopted from the moment he became governor in 2002. In light of Blagojevich’s extensive corruption of high office, the damage he caused to the integrity of Illinois government, and the need to deter others from similar acts, the government suggests a sentence of 15 to 20 years imprisonment is sufficient but not greater than necessary to comply with § 3553.”
“Blagojevich’s criminal activity was serious, extended, and extremely damaging.
Blagojevich was the sitting governor of Illinois when he committed his crimes. As the chief executive of the state, Blagojevich was in a special position of responsibility to the public. His abuse of office is particularly grave given the faith put in him by the citizens of Illinois.”
“Blagojevich agreed to use his official powers for personal benefit from the very
moment he became governor. On the heels of one corrupt governor and after running on a campaign to end “pay-to-play,” Blagojevich took office and immediately began plotting with others to use the Office of Governor for his personal gain through fraud, bribery, and extortion. Blagojevich and others committed a variety of criminal acts for several years before Blagojevich became aware of the FBI investigation into his actions and the actions of his administration. As the evidence demonstrated, Blagojevich continued his criminal acts through 2008 despite his knowledge of the FBI’s investigation. Indeed, the arrest and conviction of various members of Blagojevich’s
inner circle did nothing to dissuade Blagojevich from continuing his criminal activity until the day of his arrest.3”
“Blagojevich held up funding to every children’s hospital in the State of
Illinois.”
“Further deprecating Blagojevich’s appreciation for his criminal conduct is his
request for a probationary sentence. See Statement of Aaron Goldstein on Chicago Tonight, 9/28/11. By way of comparison, Antoin Rezko, who voluntarily surrendered immediately after conviction to start serving what he knew would be a prison sentence, recently received a sentence of 126 months’ imprisonment for corrupt activity that he engaged in directly with Blagojevich or with Blagojevich’s tacit approval. Yet, Rezko:
(a) held no elected office of trust; (b) was not involved in any of Blagojevich’s 2008 criminal activity; (c) provided some cooperation to the government that proved valuable; (d) endured harsh conditions of confinement; and (e) ultimately accepted full responsibility for all of his criminal conduct. Blagojevich engaged in extensive criminal conduct with and without Rezko, provided no cooperation, perjured himself for seven days on the witness stand, and has accepted no responsibility for his criminal conduct. A probationary sentence would be entirely inconsistent with promoting respect for the law, and the request in itself demonstrates Blagojevich’s continuing refusal to recognize the seriousness of his criminal conduct.13”
“Blagojevich repeatedly committed serious criminal acts that have done
enormous damage to public confidence in Illinois government.”

Notice above that Patrick Fitzgerald helps make the case for Blagojevich being prosecuted first.

“By way of comparison, Antoin Rezko,…received a sentence of 126 months imprisonment for corrupt activity that he engaged in directly with Blagojevich or with Blagojevich’s tacit approval. Yet, Rezko:
(a) held no elected office of trust;”

Yes, indeed, Patrick Fitzgerald allowed Blagojevich to remain in office until December 8, 2008 even though they knew as early as late 2003 that the Blagojevich Administration was involved in widespread corruption. If you are still not convinced, here is a Citizen WElls article from November 13, 2011.

Tony Rezko, Rod Blagojevich and other Chicago corruption figures are scheduled for sentencing in a few days. The US Justice Department knew about corruption in the administration of Governor Blagojevich by at least the latter part of 2003. Here is what we know from US Justice Department and court records and media reports.

2002

From the Blagojevich arrest press release.

Pay-to-Play Schemes

“The charges include historical allegations that Blagojevich and Harris schemed with others – including previously convicted defendants Antoin Rezko, Stuart Levine, Ali Ata and others – since becoming governor in 2002 to obtain and attempt to obtain financial benefits for himself, his family and third parties, including his campaign committee, Friends of Blagojevich, in exchange for appointments to state boards and commissions, state employment, state contracts and access to state funds.”

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

From John Kass and the Chicago tribune December 1, 2011.

“Don’t let Blago’s sentencing distract you from other political theatrics”

“Former Gov. Dead Meat is scheduled to be sentenced at a hearing scheduled for next Tuesday and Wednesday, as Illinois taxpayers watch another corrupt governor head to prison.

Rod Blagojevich has been convicted on 17 counts of corruption, including trying to sell a U.S. Senate seat. In a court filing on Wednesday, federal prosecutors asked that Dead Meat sit in federal stir for the next 15 to 20 years.

During his machinations surrounding the appointment of a United States senator, and the shakedowns of hospital and racetrack executives, the defendant revealed his corrupt, criminal character,” federal prosecutors said in their court filing.

But this is still Illinois, where politics is often about distraction. So with our second consecutive governor doing the long goodbye in federal court, try to keep your eye on the shell with the pea inside.

The deadline for petitions of candidacy for judges and legislators is 5 p.m. Monday. So let’s not forget all those who get the petitions signed, all those patronage and union workers, precinct captains, guys who owe guys for favors, and just plain decent citizens who care about goodness and honesty in government.

Before it’s over, Dead Meat’s nemesis, House Speaker Mike Madigan, D-Lisa’s Daddy, will certainly exert his influence here. The Lord of Madiganistan doesn’t want you to look too closely, but he always has something to say about who gets to wear the black robes. He’s chairman of the Illinois Democratic Party, and those boys still decide who wields the gavel from the county level to the Illinois Supreme Court.

Then on Tuesday, as the Blagojevich hearing begins, more unrelated theatrics are scheduled at City Hall. City Aviation Commissioner Rosemarie Andolino, the airports czarina, has been invited to appear before the Chicago City Council’s Committee on Aviation.”

“Then on Wednesday, as Blago is likely to be standing before U.S. District Court Judge James Zagel to plead for mercy, there will be yet another important hearing in another government building.

This time, it’s a state panel, a meeting of the Illinois Health Facilities and Services Review Board, which OKs new hospital construction.

And here’s the irony. The state board is scheduled to consider a proposal by a Wisconsin hospital group — Mercy Health System — to build a medical facility in Crystal Lake. (Mercy Health System is not affiliated with Mercy Hospital and Medical Center of Chicago.)

In 2003, Mercy Health System sought the state board’s approval on a similar project.

As federal testimony in a number of cases has explained, there was much behind-the-scenes intrigue. FBI agents got involved and by the time they were done, the federal Operation Board Games probe had exposed Republican and Democratic corruption throughout state government and led to Blagojevich’s indictment.

The feds brought down Stuart Levine, a member of the state hospital board, who pleaded guilty to extortion, bribery and money laundering. Levine rolled over and testified against others, including the recently convicted Republican boss, William Cellini.

In April of 2003, Mercy Health System hired a Levine confederate, Jacob Kiferbaum, of Kiferbaum Construction, to build the hospital. Levine testified that he thought he’d get his kickback from Kiferbaum. The state hospital panel controlled by Levine gave Mercy Health System the go-ahead for the Crystal Lake project.

Soon the feds were all over it. In 2005, a judge overturned the state board’s ruling. Kiferbaum pleaded guilty to attempted extortion in an unrelated hospital shakedown.”

Rod Blagojevich lawyers request special hearing, John Wyma testimony, Judge James Zagel, Tony Rezko, Provena Health, Evidentiary hearing request

Rod Blagojevich lawyers request special hearing, John Wyma testimony, Judge James Zagel, Tony Rezko, Provena Health, Evidentiary hearing request

“Why did Patrick Fitzgerald and the US Justice Department wait until December 2008 to arrest Rod Blagojevich?”…Citizen Wells

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

From the Chicago SunTimes November 28, 2011.

“Blago’s lawyers want hearing based on new John Wyma information”

“Rod Blagojevich’s lawyers are asking for a special hearing to discuss what they say is new information regarding a key witness at the former governor’s trial.

They are asking U.S. District Judge James Zagel for an evidentiary hearing regarding the testimony of onetime Blagojevich friend and lobbyist John Wyma, arguing they weren’t allowed to properly cross examine him at trial. It was Wyma’s cooperation in 2008 that led to FBI wiretaps against the now-convicted ex-governor.

In a weekend filing, lawyers questioned whether the government properly vetted information against Wyma that was provided by a cooperating Tony Rezko. Rezko, a onetime fund-raiser to Blagojevich convicted on 16 counts of corruption, was sentenced to 10 ½ years last week.

In filings regarding Rezko’s sentencing, Wyma’s cooperation with the government is discussed, including that Rezko told prosecutors that he tried to extract a campaign contribution through Wyma from Provena Health, whom Wyma represented as a lobbyist at the time.

Lawyers question whether bribery was involved when Provena was granted a certificate of need from an Illinois hospital board. Rezko told prosecutors in private sessions that Provena had a dispute with someone on the hospital board and resolved it by paying the board member, according to the Blagojevich defense filing. Prosecutors say the charge was unsubstantiated.

“Blagojevich did not have any knowledge about and was absolutely unaware of the Provena activities of Rezko and Wyma,” the filing says.

It says after Rezko gave the information to prosecutors, Wyma was hit with a subpoena.

“Shortly after Wyma received this grand jury subpoena, he agreed to be, and became, an informant for the government. This allowed the government to obtain a wiretap on Blagojevich’s telephones,” lawyers wrote.

After the taps were secured, Blagojevich’s lawyers said, prosecutors deemed Rezko’s information “not substantiated.”

“If the incriminating evidence against Wyma was not substantiated because it was not investigated, the government’s statement is misleading,” defense lawyers wrote.

Provena officials could not immediately be reached for comment.

Blagojevich’s lawyer, Shelly Sorosky, said the new information was based on filings before Rezko’s sentencing, where both sides agree Rezko’s cooperation led the government to Wyma.”

Tony Rezko has been sentenced to 10.5 years. Rezko was clearly the fall guy. That is why he was prosecuted before Rod Blagojevich, the Governor of Illinois, and kept away from the public and the press. That doesn’t mean that Obama doesn’t have a Rezko problem. Rod Blagojevich and Daniel Frawley have not been sentenced yet and Stuart Levine and Steven Loren have a status hearing next Thursday, December 1, 2011 in the courtroom of  Judge  Amy J.
