“Dear Mr. Coates,
I represent Minnesota Majority, a non-profit public policy watchdog group. I am contacting you to request a
formal investigation into apparent voter registration irregularities in Minnesota. We believe that the
Minnesota Secretary of State may be in violation of requirements for voter registration practices as defined
by the Help America Vote Act (HAVA). I will begin by providing some background on the situation, which
prompted this letter. I will then provide my specific complaint and our request of your office.
BACKGROUND
As part of Minnesota Majority’s issue advocacy activities, we make use of Minnesota’s voter file, as
provided under Minnesota law. It was in the course of utilizing this list that we began to notice a number of
unusual anomalies in the data, which prompted us to conduct additional research. Our cursory review of the
data revealed a number of potential issues, including:

• POTENTIAL DUPLICATE VOTER REGISTRATION RECORDS: We discovered thousands of voter
registration records that have an exact match on the criteria of first name, middle name, last name and
birth year.

• VACANT AND NON-DELIVERABLE ADDRESSES: The United States Postal Service has flagged
nearly 100,000 voter registration records as being either “vacant” or “undeliverable”. We visited
approximately two-dozen of these addresses to verify the USPS results and discovered approximately
50% of the addresses to be correctly flagged, in that the addresses did not exist. We have taken
photographs of empty lots and non-existent addresses where our investigation revealed invalid addresses.

• DEFICIENT VOTER REGISTRATIONS: Minnesota Statute 201.071 requires voter registrations
recorded after August 1, 1983 to include the voter’s name, address, date of birth and signature. We
discovered thousands of voter registrations that would be considered “deficient” under Minnesota law
due to missing or invalid information. Minnesota law requires these deficient registrations to be
corrected before an individual is allowed to vote.

• DECEASED VOTERS: Using a standard deceased matching service commonly utilized by mailing
houses, we discovered thousands of apparently deceased individuals who are still on the voter rolls.
• DOUBLE VOTING: We found nearly 100 cases in which voter registration and voter history records
suggest that a single voter may have voted more than once in a single election. There are thousands of
additional records that merit review.

• OTHER INCONSISTENCIES: We have discovered several thousand voters registered after August 1,
1983 that had birth years suggesting these individuals are 108 years of age or older. We also found
nearly 2,000 individuals who appear to have registered and voted before the age of 18.”

“Minnesota is becoming to 2008 politics what Florida was in 2000 or Washington State in 2004 — a real mess. The outcome will determine whether Democrats get 58 members of the U.S. Senate, giving them an effective filibuster-proof vote on many issues.

When voters woke up on Wednesday morning after the election, Senator Norm Coleman led Al Franken by what seemed like a relatively comfortable 725 votes. By Wednesday night, that lead had shrunk to 477. By Thursday night, it was down to 336. By Friday, it was 239. Late Sunday night, the difference had gone down to just 221 — a total change over 4 days of 504 votes.

Amazingly, this all has occurred even though there hasn’t even yet been a recount. Just local election officials correcting claimed typos in how the numbers were reported. Counties will certify their results today, and their final results will be sent to the secretary of state by Friday. The actual recount won’t even start until November 19.

Correcting these typos was claimed to add 435 votes to Franken and take 69 votes from Coleman. Corrections were posted in other races, but they were only a fraction of those for the Senate. The Senate gains for Franken were 2.5 times the gain for Obama in the presidential race count, 2.9 times the total gain that Democrats got across all Minnesota congressional races, and 5 times the net loss that Democrats suffered for all state House races.

Virtually all of Franken’s new votes came from just three out of 4130 precincts, and almost half the gain (246 votes) occurred in one precinct — Two Harbors, a small town north of Duluth along Lake Superior — a heavily Democratic precinct where Obama received 64 percent of the vote. None of the other races had any changes in their vote totals in that precinct.””

“A public watchdog group is calling for federal authorities to investigate allegations of widespread voter fraud in Minnesota, charging that state election officials have been unable to establish the eligibility of over 30,000 persons whose ballots were included in the November election.

A lawsuit filed by the nonprofit group Minnesota Majority alleges that Minnesota Secretary of State Mark Ritchie and 25 county election officials failed to reconcile registrations — matching votes cast with actual voter registrations of people who live at valid addresses — thereby casting a shadow over the legitimacy of thousands of ballots cast on Nov. 4.

The lawsuit transcends the issues being debated in the ongoing Senate election contest between Democrat Al Franken and former GOP Sen. Norm Coleman, which is now under review by the state’s supreme court.

“When you’re talking about a major U.S. Senate race that’s being decided by 312 votes, whether you’re for Coleman or Franken, it doesn’t give me a great deal of confidence in the election,” Minnesota Majority founder and CEO Jeff Davis tells Newsmax. “I would guess that both camps would be really interested in knowing what the heck is going on.”

Davis is calling for a federal investigation into what he sees as systemic voter fraud in Minnesota elections. Minnesota law allows people to show up at the polls on Election Day, fill out a voter registration card based on a pledge that they are eligible, and cast a ballot.””

“Minnesota Majority has experienced the DOJ’s refusal to investigate these kind of cases first-hand. On November 17th of 2008 (immediately following the 2008 General Election and while the Coleman-Franken recount battle was getting underway), Minnesota Majority president Jeff Davis sent a certified letter to then Voting Section chief of the Civil Rights Division at the DOJ, Christopher Coates, requesting an investigation into apparent failures to comply with HAVA by Secretary of State Mark Ritchie. No response was forthcoming.
 
Since the DOJ in Washington DC failed to follow up on Davis’ complaint, Minnesota Majority contacted the local FBI office and lodged the same complaint. Special Agent Brian Kinney responded and visited the Minnesota Majority office to examine Minnesota Majority’s findings. At that time, he said, “based on what I see here there is more than enough evidence to initiate an internal complaint.” He gave his assurances that he would bring the matter to the attention of his supervisors. There was no further follow-up.”

“The suspect voting machines in Clark County Nevada are serviced by the SEIU.

The SEIU is the same corrupt union that is behind thousands of bogus voter registrations across the nation. The group is spending millions this year to help democrats win back their majorities in Congress.
The Washington Examiner reported:

Clark County is where three quarters of Nevada’s residents and live and where Senate Majority Leader Harry Reid’s son Rory is a county commissioner. Rory is also a Democratic candidate for governor.

Since early voting started, there have been credible reports that voting machines in Clark County, Nevada are automatically checking Harry Reid’s name on the ballot:

Voter Joyce Ferrara said when they went to vote for Republican Sharron Angle, her Democratic opponent, Sen. Harry Reid’s name was already checked.

Ferrara said she wasn’t alone in her voting experience. She said her husband and several others voting at the same time all had the same thing happen.

“Something’s not right,” Ferrara said. “One person that’s a fluke. Two, that’s strange. But several within a five minute period of time — that’s wrong.””

“On Friday it was reported that the Yuma Recorder’s office was checking the 3,000 last minute voter registration forms turned in by the far left Mi Familia Vota organization. The recorder’s office found that already more than 65% of the registrations were invalid due to the registrant not being a citizen, wrong/invalid address, false signature, etc.

Mi Familia Vota is a SEIU sub-organization. It is just as “non-partisan” as ACORN was before documented fraudulent behaviors finally killed it.”

NC voting machines malfunction in favor of Democrats

“A Craven County voter says he had a near miss at the polls on Thursday when an electronic voting machine completed his straight-party ticket for the opposite of what he intended.

Sam Laughinghouse of New Bern said he pushed the button to vote Republican in all races, but the voting machine screen displayed a ballot with all Democrats checked. He cleared the screen and tried again with the same result, he said. Then he asked for and received help from election staff.

“They pushed it twice and the same thing happened,” Laughinghouse said. “That was four times in a row. The fifth time they pushed it and the Republicans came up and I voted.””

“I’ll give you an example of why President Obama is not right for America.  He sure as hell has not been right for the party.  Not long ago, the president took a meeting.  He’s late, which apparently is becoming more and more common with him.  The meeting was almost cancelled.  In strolls the president, joking with an aide.  He plops down on a sofa, leans over and claps another guy on the back asking how he’s been.  Apologizes for being late, says he was “held up”.  He laughs some more.  The meeting begins.  After just ten minutes, during which time the president appears to almost totally withdraw into himself,  an aide walks in and whispers something to the president, who then nods and quickly stands up, shakes a few hands and tells another aide to update him later on the rest of the meeting.  As the president is walking out he is laughing at something yet again.  He asked no questions of those at the meeting – not one.  He left after just ten minutes, coming in laughing and leaving laughing.  His behavior during that brief time he was there was described as “borderline manic”.”

“Why has Obama, for over 2 years, employed numerous private and government attorneys to avoid presenting a legitimate birth certificate and college records?”…Citizen Wells and millions of concerned Americans

I am trying to determine the status of the testimony of Tim Adams,  an election official in Hawaii during 2008 election, who is the only potential witness to come forward. Tim Adams stated that Obama was not born in Hawaii and for that reason he was given a Certification of Live Birth by the state of Hawaii. He also stated that because Obama was a US citizen, that he was eligible to be president. That is absolutely incorrect. Adams also goes on to assume that those who question Obama’s eligibility are racists or are politically motivated. That is an ignorant assumption.

It’s the Constitution stupid!

Far left websites are trying to downplay and twist what Adams has attested to. I believe that it has been confirmed that Tim Adams did in fact have the position with the State of Hawaii in 2008 as an election official.

“CBS’s Harry Smith was drooling over Obama numbers in a rant fest with Michael Crowley of the New Republic.
The problem is that these two dim bulbs actually outed the Obama campaign in voter fraud as there are not enough people in North Carolina to get the “new voters” Obama claims are there.
Harry Smith apparently has not concluded that ACORN can not be registering all these “voters”. One can not just go into North Carolina and register EXACTLY 800,000 voters.

On April 29, 2010, Congressman Chris Van Hollen (D-MD) introduced H.R. 5175, the Democracy is Strengthened by Casting Light on Spending in Elections (DISCLOSE) Act.  The bill is a direct response to Citizens United v. Federal Election Commission – a First Amendment victory in which the Supreme Court overturned the prohibition on corporations and unions using treasury funds for independent expenditures supporting or opposing political candidates at any time of the year.  Simply put, the DISCLOSE Act will limit the political speech that was protected and encouraged by Citizens United. 
 
The DISCLOSE Act was marked up on Thursday, May 20, 2010, and may come to the floor later this week after rumors that the Democrats have reached an agreement with certain key groups.  This is not meant to be an extensive analysis – which will be provided in the Legislative Bulletin once the bill comes to the floor – but rather to highlight some of the most egregious provisions of the bill.
 
Partisan ploy to get Democrats elected to Congress.  The bill, “coincidentally” sponsored by the chairman of the Democratic Congressional Campaign Committee in charge of electing Democrats to Congress, re-writes campaign finance laws in favor of Democrats right before elections.  It was crafted behind closed doors with no input from Republican members of the House Administration Committee.  The bill was designed by Democrats to silence their political opponents.
 
Creates a special, narrow carve-out for specific organizations intended to sway votes toward passage of the bill.  The National Rifle Association (NRA), the Humane Society, and possibly a very small number of other groups, are reportedly covered in a last minute deal that creates an exemption from the financial disclosure requirements in the bill.  This carve out does nothing to protect the First Amendment rights of millions of Americans who want to engage in the political process but will instead be deterred by this bill. As stated in a Wall Street Journal editorial this morning, “Creating a special exception for the NRA, and thereby assuring the Democrats ‘good grades’ on Second Amendment rights, eases the way for the bill to be passed. A failing grade on First Amendment rights is somebody else’s problem.”  The exemption is intended to make it easier for a bad bill to get the votes it needs to pass.
 
Favors unions over corporations.  Current law already bans foreign nationals from contributing to elections. See the RSC Policy Paper on Citizens United for more details. DISCLOSE makes current law much more restrictive and bans independent expenditures on activity by American corporations with 20% or more foreign ownership.  However, similar restrictions are not included for unions with foreign members or non-citizen members.  As eight former Federal Election Commissioners stated in a recent Wall Street Journal article, “… Disclose does not ban foreign speech but speech by American citizen shareholders of U.S. companies that have some element of foreign ownership, even when those foreigners have no control over the decisions made by the Americans who run the company.”  Additionally, the new threshold for reporting ($600 in donations for independent expenditures) will have little effect on unions whose members’ annual dues average much lower than $600.  This would preclude unions from having to report.  The bill also prohibits independent expenditures or disbursing funds for electioneering communications by anyone with a government contract greater than $7 million.  (Originally, the threshold was $50,000, which was changed in mark-up.)  This does not apply to unions in collective bargaining agreements with the government.
 
Threatens organizations with lawsuits for non-compliance.  The bill becomes effective 30 days after enactment, giving the Federal Election Commission no time to craft regulations relating to the implementation of the bill, which will certainly be complicated, and not to mention expensive, to execute.  Organizations would have to operate without any guidance from the FEC and risk possible lawsuits.
 
Onerous disclosure and reporting requirements will deter citizen engagement.  The bill includes requirements that every incorporated entity engaged in independent campaign activity must list all donors of $600 or more with the Federal Election Commission (FEC).  The bill also requires CEOs of organizations to appear in the ads, and state their name and their organization two times.  Additionally, the top five funders of the organization must be listed in the ad (and top two for radio), and if there is a top “significant” funder, he or she must identify himself or herself, his or her title,  and state the name of the organization three times in the ad. These tedious and onerous requirements will have the effect of deterring organizations from getting involved in elections (and potentially take up most of the ad time). 
 
 
Citizens United was a triumph in defense of the First Amendment right to free speech and a reaffirmation of the rights of businesses, unions, and citizens’ associations to engage in political communications.  The DISCLOSE Act is the opposite, and the business community knows it.  This bill is an attack on the ability of non-party organizations to engage in the political realm during an election year.

As I am about to show, WorldNetDaily only got half of their story right (full disclosure: The Right Side of Life.com has been featured on WND in the past and I still “trust but verify” what they post, most of the time).

I decided to actually contact Mr. Tim Adams at the email address linked in the Western Kentucky University faculty page mentioned in the WND article to find out for myself (and for you, loyal TRSoL readers) why he chose to “come out” now regarding the alleged quotes that WND has posted.

However, before I get to the email I received back from him (and that I subsequently received explicit permission from Mr. Adams to reveal), here are key excerpts from the WND article:

“There is no birth certificate,” said Tim Adams, a graduate assistant who teaches English at Western Kentucky University in Bowling Green, Ky. “It’s like an open secret. There isn’t one. Everyone in the government there knows this.”

Adams, who says he’s a Hillary Clinton supporter who ended up voting for John McCain when Clinton lost the Democratic nomination to Obama, told WND, “I managed the absentee-ballot office. It was my job to verify the voters’ identity.”

He says during the 2008 campaign when the issue of Obama’s constitutional eligibility first arose, the elections office was inundated with requests to verify the birthplace of the U.S. senator from Illinois.

“I had direct access to the Social Security database, the national crime computer, state driver’s license information, international passport information, basically just about anything you can imagine to get someone’s identity,” Adams explained. “I could look up what bank your home mortgage was in. I was informed by my boss that we did not have a birth record [for Obama].” …

“They told us, ‘We don’t have a birth certificate for him,’” he said. “They told my supervisor, either by phone or by e-mail, neither one has a document that a doctor signed off on saying they were present at this man’s birth.” …

…”They may say, ‘We don’t have access to that.’ The regular workers don’t, the ones processing ballots; but the people in administration do. I was the one overseeing the work of the people doing the balloting.”

Adams stressed, “In my professional opinion, [Obama] definitely was not born in Hawaii. I can say without a shadow of a doubt that he was not born in Hawaii because there is no legal record of him being born there. If someone called and asked about it, I could not tell them that person was born in the state.” …

“Anyone can get that [COLB],” said Adams. “They are normally given if you give birth at home or while traveling overseas. We have a lot of Asian population [in Hawaii]. It’s quite common for people to come back and get that.” …”

Thank you for the Email. Actually I believe God has a sense of humor, because I thought these notions were pretty well common and not very important. I was actually just in Nashville, observing a conservative political conference, I’m not a member of any kind of group, and too liberal for these guys, when James Edwards, the host of the Political Cesspool, heard about me from someone and asked if I would simply state what I had observed and been told while working in Hawaii. I believe Pres. Obama was born a United States citizen, and is eligible to hold office, I find the idea that because he was probably born outside of the U.S., he must be some kind of alien to be basically racist. I do think we should close this issue and pass legislation requiring office seekers to prove identity before running for elected office.”

“After all, isn’t the point of debating eligibility to make sure that all the facts are known, in context?
