Congress should certify the electoral vote on Wednesday, January 6. Attempts to thwart or delay this process run counter to the essential tenets of our democracy.

” Georgia Secretary of State has recertified the election results, but Coffee County Board of Elections officials sent out a letter last week saying they could not certify its results following a second recount.

In the letter, election officials said they could not certify the electronic recount numbers given its “inability to repeatably duplicate creditable election results.”

“Any system, financial, voting, or otherwise, that is not repeatable nor dependable should not be used,” officials wrote in the letter. “To demand certification of patently inaccurate results neither serves the objective of the electoral system nor satisfies the legal obligation to certify the electronic recount.”

Along with the letter, Coffee County elections officials also sent Raffenserger’s office a document that “illuminates that the electronic recount lacks credibility.” Election officials also said that no election board has the ability to “reconcile the anomalies” that are shown in that document.

“Accordingly, the Coffee County Board of Elections and Registration have voted to certify the votes cast in the Election Night report,” the letter states. “The Election Night numbers are reflected in the official certification of results submitted by our office.””

“The most direct precedent on this question arose in 1877, following serious allegations of fraud and illegal conduct in the Hayes-Tilden presidential race. Specifically, the elections in three states-Florida, Louisiana, and South Carolina-were alleged to have been conducted illegally.

“In 1877, Congress did not ignore those allegations, nor did the media simply dismiss those raising them as radicals trying to undermine democracy. Instead, Congress appointed an Electoral Commission-consisting of five Senators, five House Members, and five Supreme Court Justices-to consider and resolve the disputed returns.

“We should follow that precedent. To wit, Congress should immediately appoint an Electoral Commission, with full investigatory and fact-finding authority, to conduct an emergency 10-day audit of the election returns in the disputed states. Once completed, individual states would evaluate the Commission’s findings and could convene a special legislative session to certify a change in their vote, if needed.

“Accordingly, we intend to vote on January 6 to reject the electors from disputed states as not ‘regularly given’ and ‘lawfully certified’ (the statutory requisite), unless and until that emergency 10-day audit is completed.

“We are not naïve. We fully expect most if not all Democrats, and perhaps more than a few Republicans, to vote otherwise. But support of election integrity should not be a partisan issue. A fair and credible audit-conducted expeditiously and completed well before January 20-would dramatically improve Americans’ faith in our electoral process and would significantly enhance the legitimacy of whoever becomes our next President. We owe that to the People.

“Georgia election officials said Tuesday they will correct absentee ballot instructions that erroneously told voters to insert ballots into envelopes that no longer exist.”

“The secretary of state’s office only learned that absentee ballot packets wouldn’t include inner envelopes when voters began receiving them late last week, Sterling said.

The problem occurred because of a miscommunication between the state and its ballot mailing company, Arizona-based Runbeck Election Services. The privacy sleeve looked identical to typical inner envelopes in images approved by state election officials, Sterling said.

“It’s more important for people to get their ballots and turn them in than have a perfect set of instructions,” Sterling said. “We’re having to deal with the real world and the COVID situation. This was a Herculean effort. The main thing is ballots are going out the door.”

The secretary of state’s office hired Runbeck to mail ballots to voters statewide to deal with a surge in people requesting absentee ballots so they can avoid human contact at in-person voting locations. In prior elections, ballots were mailed by county election offices.”

“Printing Issue Affects 1/3 of Mail-In Ballots in Tarrant County, Administrator Says

Tarrant County commissioners on Tuesday learned that a large portion of mail-in ballots that have been processed so far have been unreadable by the machine that scans them.

Tarrant County Elections Administrator Heider Garcia announced the development at Tuesday morning’s county commissioners meeting. Garcia said approximately one in three of the ballots had printing issues from the vendor and will need to be remade by hand by the elections office.

“What we believe at this point is that the print shop that did these ballots for us…basically can improve the quality of the printing because those bar codes are not 100% legible, 100% of the time,” Garcia said. “So what’s happening is we scan the ballots and the scanner says, ‘I don’t identify these documents, I can’t see the barcode.’ When the scanner doesn’t see the bar code, it might as well have been a newspaper that you scan. It’s just not a ballot.””

“The Phoenix-based printing vendor Runbeck Election Services was state-authorized, according to Tarrant County Judge Glen Whitley. On Tuesday, the company provided the following statement to NBC 5 regarding the barcode defect.

“We were concerned to learn that some Tarrant County ballots are not able to be scanned properly by Hart Intercivic tabulation machines, as Runbeck Election Services is a certified ballot printer for Hart Intercivic. This election year alone we have printed nearly 100 million ballots, many of which have been the same type of ballot used in Tarrant County, without experiencing any scanning issues. Runbeck Election Services is working with Tarrant County elections officials to investigate if the problem is printing-related or scanning-related. Once the investigation is complete, we will offer our support to all partners and vendors involved to determine the appropriate next steps to ensure that all ballots are properly tabulated.””
