State Dept. says it won’t release them all, but will check them when requested

Former Secretary of State Hillary Rodham Clinton’s top aides have belatedly turned over more than 100,000 pages of emails they had kept on personal email accounts, or accounts tied to Mrs. Clinton’s server, the government told a federal judge late Friday.

Huma Abedin turned over an estimated 23,000 pages of emails, Philippe Reines gave back 70,000 pages of messages and Cheryl Mills returned somewhere in the neighborhood of 11,870 pages, the Obama administration told Judge Rudolph Contreras in a court filing.

And unlike Mrs. Clinton’s emails, the State Department does not have plans to post online all of those three aides’ messages, instead deciding to release only select messages that are requested through particular open-records demands.”

“Those messages have effectively been shielded from public scrutiny for years, in defiance of federal policies that discourage use of personal email accounts and insist that when they are used, all government-related business be forwarded to an official account for record-keeping.

Mrs. Clinton returned about 32,000 messages to the government in December. Ms. Mills didn’t return her last batch of messages until Aug. 12, and Ms. Abedin was even later, taking until Sept. 1 — or after the deadline the State Department had agreed to — to finally give back all of her government business messages.”

Several months ago when I engaged in an email debate with Jan Hatzius of Goldman regarding the employment situation and impact of baby boomers, I came to the conclusion that he and other economists were too entrenched in the theoretical realm of economies to see the reality of the economy and employment in the US.

Are Jan Hatzius and Goldman finally facing a reality check on the real condition of the economy?

“Is Yellen About To Shock Everyone: Goldman Says The “Fed Should Think About Easing””

“What a difference a little over a year makes.

Back in January 2014, just after the Fed announced the tapering of QE (because, you know, the “date-dependent” Fed would never be tapering if the economy wasn’t improving, right?) the propaganda machine went into overdrive, with Wall Street’s pet economist, not to mention the NY Fed’s key “outside advisor”, Goldman Jan Hatzius preaching that the long awaited recovery had finally arrived.

This is how the tabloid pseudo-finance website Business Insider characterized his call at the time: “Goldman’s top economist, Jan Hatzius, just said the words we’ve been wanting to hear for five years. He believes the economy is now growing at an above-trend pace.””

“For what it was worth, we disagreed with Hatzius, noting that this would simply be the second time in five years Goldman has jumped the “recovery” shark after its dramatic reversal in December 2010 when as QE 2 was ending, Goldman once again sought to boost wholesale confidence by going fundamentally bullish and saying “This outlook represents a fundamental shift in the thinking that has
governed our forecast for at least the last five years.”

Fast forward a little over a year when we learn that Goldman was once again wrong (for what it’s worth, naturally Business Insider was too).

First it was in April of 2015 – some 16 months after his “bold” prediction – that the same “above trend growth”-forecasting Hatzius said we “do not have much confidence in the inflation outlook and believe that the right policy would be to put hikes on hold for now.”

But… what happened to above trend growth?

Then in the first week of June, Hatzius once again hedged saying “Our forecast remains that the Fed policy committee will hike rates at the September meeting, but …this remains a close call. There is a strong risk management case for delaying liftoff.” In other words, the market determines Fed policy, not the economy, despite the reflexive lies to the opposite.

Then just two weeks later, on June 18, Hatzius having long given up on his “above trend growth” forecast changed his tune again, and now said he expected a December rate hike instead.

“In large part this reflects the fact that seven FOMC participants are now projecting zero or one rate hike this year, a group that we believe includes Fed Chair Janet Yellen…. We had viewed a clear signal for a September hike at the June meeting as close to a necessary condition for the FOMC to actually hike in September, because we did not believe that the FOMC would want to surprise markets on the hawkish side when they raise the funds rate.”

Of course, if the economy had grown at an “above trend pace” since his January 2014 call, the Fed would have to be at 1% or higher by now.

Just to make sure nobody is surprised next week when Yellen does not hike and unleashes a massive relief rally, Hatzius added that a September rate hike announcement this Thursday “shouldn’t be close”, and as we showed previously, unveiled 7 reasons why. Amazing how Goldman’s narrative changes with every month.

And then, the humiliation was complete last night when the same Jan Hatzius, having long-forgotten his January 2014 prediction, in a note previewing the US economy in “September and Beyond” had this to say:

In our view, the recent events have largely sealed the case against a rate hike next week. Fed officials have made clear that “data dependent” policy refers to incoming economic news as well as factors that could impinge on the outlook—including changes in financial conditions…. The news on wage and price inflation, however, has been softer than generally expected a few months ago…. most of the inflation shortfall relative to the Fed’s 2% target is due to more persistent factors, including continued labor market slack.

…

We expect modest downward revisions to GDP growth in 2016 and 2017 in light of tighter financial conditions.
Hm… maybe Jan meant below-trend growth?

And here we get to the punchline, because Goldman which originally expected a September rate hike, then pushed it to December in June, is now fairly confident that there may not be a 2015 rate hike at all!”

“Total nonfarm payroll employment increased by 173,000 in August, and the
unemployment rate edged down to 5.1 percent, the U.S. Bureau of Labor Statistics reported today.”

There was an increase in 23,000 white American employment in August.
However, white employment is down 132,000 since January!!!

“The Hamilton Project explores the monthly “job gap” based on the employment numbers—or the number of jobs the economy needs in order to return to return to pre-recession employment levels while absorbing the 125,000 people who enter the labor force each month.

“Source: FBI ‘A-team’ leading ‘serious’ Clinton server probe, focusing on defense info”

“An FBI “A-team” is leading the “extremely serious” investigation into Hillary Clinton’s server and the focus includes a provision of the law pertaining to “gathering, transmitting or losing defense information,” an intelligence source told Fox News.

The section of the Espionage Act is known as 18 US Code 793.

A separate source, who also was not authorized to speak on the record, said the FBI will further determine whether Clinton should have known, based on the quality and detail of the material, that emails passing through her server contained classified information regardless of the markings. The campaign’s standard defense and that of Clinton is that she “never sent nor received any email that was marked classified” at the time.

It is not clear how the FBI team’s findings will impact the probe itself. But the details offer a window into what investigators are looking for — as the Clinton campaign itself downplays the controversy.

The FBI offered no comment.

A leading national security attorney, who recently defended former CIA officer Jeffrey Sterling in a leak investigation, told Fox News that violating the Espionage Act provision in question is a felony and pointed to a particular sub-section.

“Under [sub-section] F, the documents relate to the national defense, meaning very closely held information,” attorney Edward MacMahon Jr. explained. “Somebody in the government, with a clearance and need to know, then delivered the information to someone not entitled to receive it, or otherwise moved it from where it was supposed to be lawfully held.”

Additional federal regulations, reviewed by Fox News, also bring fresh scrutiny to Clinton’s defense.

The Code of Federal Regulations, or “CFR,” states: “Any person who has knowledge that classified information has been or may have been lost, possibly compromised or disclosed to an unauthorized person(s) shall immediately report the circumstances to an official designated for this purpose.”

A government legal source confirmed the regulations apply to all government employees holding a clearance, and the rules do not make the “send” or “receive” distinction.

Rather, all clearances holders have an affirmative obligation to report the possible compromise of classified information or use of unsecured data systems.

Current and former intelligence officers say the application of these federal regulations is very straightforward.

“Regardless of whether Mrs. Clinton sent or received this information, the obligations under the law are that she had to report any questions concerning this material being classified,” said Chris Farrell, a former Army counterintelligence officer who is now an investigator with Judicial Watch. “There is no wiggle room. There is no ability to go around it and say I passively received something — that’s not an excuse.””

Yes, it is exactly as bad as it seems if not worse. When the Dow can open 1000 points down on a Monday and China can lose all of its gains for 2015 in the span of a few weeks despite institutionalized stimulus measures lasting years, then something is very wrong. This is not a “hiccup”. This is not a correction which has already hit bottom. This is only the beginning of the end.

Stocks are not a predictive indicator. They do not follow positive or negative fundamentals. Stocks do not crash before or during the development of an ailing economy. Stocks crash after the economy has already gone comatose. Stocks crash when the system is no longer salvageable. Since 2008, nothing in the global financial structure has been salvaged and now the central banking edifice is either unable or unwilling (I believe both) to supply the tools to allow us even to pretend that it can be salvaged. We’re going to feel the hurt now, all while the establishment tells us the whole thing is in our heads.”

“For months, the U.S. State Department has stood behind its former boss Hillary Clinton as she has repeatedly said she did not send or receive classified information on her unsecured, private email account, a practice the government forbids.

While the department is now stamping a few dozen of the publicly released emails as “Classified,” it stresses this is not evidence of rule-breaking. Those stamps are new, it says, and do not mean the information was classified when Clinton, the Democratic frontrunner in the 2016 presidential election, first sent or received it.

But the details included in those “Classified” stamps — which include a string of dates, letters and numbers describing the nature of the classification — appear to undermine this account, a Reuters examination of the emails and the relevant regulations has found.

The new stamps indicate that some of Clinton’s emails from her time as the nation’s most senior diplomat are filled with a type of information the U.S. government and the department’s own regulations automatically deems classified from the get-go — regardless of whether it is already marked that way or not.

In the small fraction of emails made public so far, Reuters has found at least 30 email threads from 2009, representing scores of individual emails, that include what the State Department’s own “Classified” stamps now identify as so-called ‘foreign government information.’ The U.S. government defines this as any information, written or spoken, provided in confidence to U.S. officials by their foreign counterparts.

This sort of information, which the department says Clinton both sent and received in her emails, is the only kind that must be “presumed” classified, in part to protect national security and the integrity of diplomatic interactions, according to U.S. regulations examined by Reuters.

“It’s born classified,” said J. William Leonard, a former director of the U.S. government’s Information Security Oversight Office (ISOO). Leonard was director of ISOO, part of the White House’s National Archives and Records Administration, from 2002 until 2008, and worked for both the Bill Clinton and George W. Bush administrations.”

More damning evidence against Hillary Clinton to be found?

“A federal judge on Thursday said that Hillary Rodham Clinton did not comply with government policies in her exclusive use of a personal email account while she was secretary of state, challenging her longstanding position that she abided by the rules.

At a hearing for a Freedom of Information Act lawsuit against the State Department, the judge, Emmet G. Sullivan of Federal District Court for the District of Columbia, said that “we wouldn’t be here today if the employee had followed government policy.”

Judge Sullivan also opened the door for the F.B.I., which is investigating whether there was classified information on Mrs. Clinton’s account, to expand its inquiry to pursue emails that she may have deleted. The judge ordered the State Department to ask the F.B.I. to give it any emails recovered from Mrs. Clinton’s private server that were not already in the State Department’s possession or that may be related to the lawsuit.

The Justice Department, which oversees the F.B.I., has argued that Freedom of Information Act searches do not typically involve a government employee’s personal email account.

Mrs. Clinton has said she gave the State Department more than 30,000 emails related to her work in office. She deleted about the same number of emails that she said were personal. Her lawyer has said the server was then wiped clean. Mrs. Clinton has also said that she had no classified information on her account.

In a statement, a spokesman for Mrs. Clinton defended her use of the account. “Hillary Clinton’s use of a personal email account was consistent with the practice of other secretaries of state, and permissible under the department’s policy at the time,” said the spokesman, Brian Fallon.

When Mrs. Clinton became secretary in February 2009, the State Department’s general policy was “that normal day-to-day operations be conducted on an authorized” government computer. Nine months later, federal regulations were toughened to say that government agencies that allow employees to use nongovernment email accounts must “ensure that federal records sent or received on such systems are preserved in the appropriate agency record-keeping system.””

“A full appellate court indicated Wednesday that it will not rehear an appeal of Rod Blagojevich’s corruption convictions, and his lawyer responded that the imprisoned former Illinois governor will appeal next to the U.S. Supreme Court.

After a three-judge panel tossed out five of his 18 convictions in July, the Democrat had hoped the full court might overturn even more. But the 7th U.S. Circuit Court of Appeals posted a notice Wednesday saying not a single judge on the court asked for a rehearing.

Blagojevich, 58, is serving a 14-year prison sentence at a federal prison in Colorado on convictions including his attempt to sell an appointment to President Barack Obama’s old U.S. Senate seat.

An appeal to the high court is a last slim hope for Blagojevich, who proclaimed his innocence for years on talk shows, including NBC’s “The Apprentice” when Donald Trump still presided over the reality show.

There’s no guarantee the Supreme Court would even agree to hear Blagojevich’s appeal. It accepts only around 80 cases a year out of more than 10,000 requests to take up a case, according to court data. It also favors cases that raise unique, weighty issues.

Defense attorney Leonard Goodman, however, suggests that the Supreme Court might agree to a view that 7th Circuit judges did not agree with: That in each case of alleged corruption, Blagojevich was participating in legal, run-of-the-mill politicking.

Allowing all the convictions to stand, Goodman said in a written statement, “puts every public official who must raise campaign funds to stay in office and to be effective at the mercy of an ambitious or politically motivated federal prosecutor.””

“In a modest win for Blagojevich, the panel ordered that he be brought back to Chicago to be resentenced, something that could happen within the next several months. But it also said his original 14-year sentence might be considered fair even after subtracting the five overturned counts.”
