There is one theme that I have referred to constantly since early  2008. That is the scary analogy to the world of “1984” that we have been experiencing. It was clear then as now that the mainstream media of the US was doing the bidding of the Obama camp to spread lies and  misinformation. Recently Pravda, “The Truth”, began covering the LTC Terry Lakin court martial and Obama eligibility issues. What a strange world that we live in.

Part of the reason that this blog has succeeded, part of the reason that I have worked so hard was to counteract the mainstream media lies on such topics as Obama eligibility, Obama’s connection to Rezko and Chicago corruption, the real truth about Blagojevich and the US Justice Dept. protecting Obama and now the court martial of LTC Terry Lakin.

I spend much time searching the internet and subsequently I discover which of the Orwellian deceivers are getting first page on Google and other search engines. I knew months ago that The Huffington Post, a paid mouthpiece of the Obama camp, had gotten number one on Google for the following search:

Lakin court martial.

I did not forget this fact and was compelled once again to fight the smears coming from the Orwellian Obama camp.

We have watched in horror as internet scrubbing and revisionist history has taken place on the internet. Search engines have also been tweaked. Much money has been in play. My article on CitizenWells.com is intended to counteract misinformation and lies and to support LTC Terry Lakin, an American hero and patriot.

I challenge the above media and anyone else to a debate. If you have legitimate proof that Obama was born in Hawaii, present it. Otherwise correct your stories and shut the hell up. I challenge any of the above. If anything that I have written is incorrect, prove it.

This is amazing. I have been searching on Lakin Court Martial for several months on Google. Last night The Huffington Post was still first on the search. I just looked again, after posting both articles, and the Huffington Post does not even show up on the first page. CBS is number three.

Judge Lind decision flawed, Defense of LTC Terrence Lakin, White paper

Courts Martial Defense of LTC Terrence Lakin September 3, 2010 researched and Prepared by J.B. Williams and Timothy Harrington

“We find foundational flaws in Col. Lind’s decision, which Lakin’s defense team must seize upon in orderto alter the current course of this trial.

  • Lind’s authority is derived from the same place as LTC Lakin’s and all other members of the United States Military – from the supreme command of the office of Commander-in-Chief, the President of the United States.
  • Lind is attempting to use her authority under her Commander-in-Chief to break the military chain of command, isolating the Commander-in-Chief of the US Military specifically, exempting the President from his position of authority in the chain of command, without which, Lind herself has no authority to convene the Courts Martial.
  • Lind then reaches outside of the US Military Justice system to the Civil Court, relying upon civil court precedent to deny Lakin any access to discovery and thereby, a proper defense guaranteed him by the US Constitution and UCMJ, Uniform Code of Military Justice. Civil Court precedent has no legal standing in a UCMJ criminal proceeding. In fact, the UCMJ is based upon the Articles of War (aka War Articles) and is a “penal system” unlike the US Justice System – as explained by Col. William Winthrop in Military Law and Precedents. As a result, precedents set in courts outside of the UCMJ are without legal standing in any UCMJ proceeding.
  • Not even in the UCMJ can the United States government deny the accused his/her right to a trial, complete with discovery of related evidence. Yet Lind attempts to do so, under the authority derived from her Commander-in-Chief. If the chain of command is broken, then Lind herself has no authority.
  • Lind’s statement that the legality of the Commander-in-Chief is “not relevant” in matters ofmilitary command is false on its face. As stated in a sworn affidavit filed by LTG Thomas G. McInerney executed on August 20, 2010 – “In refusing to obey orders because of his doubts as totheir legality, LTC Lakin has acted exactly as proper training dictates. – By thus stepping up to the bar, LTC Lakin is demonstrating the courage of his convictions and his bravery. – That said, it is equally essential that he be allowed access to the evidence that will prove whether he made the correct decision.”
  • Lind attempts to break the chain of command at The Pentagon level, which she claims has no issue with the current Commander-in-Chief and that this should be good enough for Lakin. Yet she cannot break this chain of command without eliminating her own authority, and Lakin’s oath requires that he decide for himself whether or not his orders are legal, as affirmed in LTG McInerney’s sworn affidavit.

At issue is not whether or not LTC Lakin refused orders, but rather whether or not he “unlawfully” refused orders. If his orders were not “lawful,” including but not limited to, emanating from a “lawful”chain of command which begins with a lawful Commander-in-Chief, then Lakin must be found NOTGUILTY of “unlawfully” refusing orders.

Here is an update from American Patriot Foundation on the Lieutenant General Thomas McInerney affidavit in support of Lt Col Terry Lakin.

“McInerney’s affidavit can be viewed at www.safeguardourconstitution.com. The following are extracts:

The President of the United States, as the Commander in Chief, is the source of all military authority. The Constitution requires the President to be a natural born citizen in order to be eligible to hold office. If he is ineligible under the Constitution to serve in that office that creates a break in the chain of command of such magnitude that its significance can scarcely be imagined.

As a practical example from my background I recall commanding forces that were equipped with nuclear weapons. In my command capacity I was responsible that personnel with access to these weapons had an unwavering and absolute confidence in the unified chain of command, because such confidence was absolutely essential– vital– in the event the use of those weapons was authorized. I cannot overstate how imperative it is to train such personnel to have confidence in the unified chain of command. Today, because of the widespread and legitimate concerns that the President is constitutionally ineligible to hold office, I fear what would happen should such a crisis occur today.

In refusing to obey orders because of his doubts as to their legality, LTC Lakin has acted exactly as proper training dictates. That training mandates that he determine in his own conscience that an order is legal before obeying it…Indeed, he has publicly stated that he “invites” his own court martial, and were I the Convening Authority, I would have acceded to his wishes in that regard. But thus stepping up the bar, LTC Lakin is demonstrating the courage of his convictions and his bravery. That said, it is equally essential that he be allowed access to the evidence that will prove whether he made the correct decision.

For the foregoing reasons, it is my opinion that LTC Lakin’s request for discovery relating to the President’s birth records in Hawaii is absolutely essential to determining not merely his guilt or innocence but to reassuring all military personnel once and for all for this President whether his service as Commander in Chief is Constitutionally proper. He is the one single person in the Chain of Command that the Constitution demands proof of natural born citizenship. This determination is fundamental to our Republic, where civilian control over the military is the rule. According to our Constitution, the Commander in Chief must now, in the face of serious– and widely held– concerns that he is ineligible, either voluntarily establish his eligibility by authorizing release of his birth records or this court must authorize their discovery. The invasion of his privacy in these records is utterly trivial compared to the issues at stake here. Our military MUST have confidence”

Retired Air Force Lieutenant General Thomas McInerney has supplied an affidavit in support of Army Lieutenant Colonel Terrence Lakin, who faces trial on October 13-15. The retired Air Force three-star is the highest ranking officer yet to lend public support to LTC Lakin. His affidavit acknowledges widespread concerns over the President’s Constitutional eligibility and demands the President release his birth records or the court authorize discovery.

Terry Lakin, US Military, Stand by Lakin and military

I have not forgotten about LTC Terry Lakin. I stand by him now and going forward. Lakin is a true patriot. Lakin’s superiors, if they do not uphold their oath to defend the US Constitution and question Obama and his orders, are cowards and treasonous. I am prepared to say it to their face.

I received the following in an email this morning. Another reason to support our military.

“The story is about Channing Moss, who was impaled by a live RPG during a Taliban ambush while on patrol. Army protocol says that medivac choppers are never to carry anyone with a live round in him. Even though they feared it could explode, the flight crew said damn the protocol and flew him to the nearest aid station. Again, protocol said that in such a case the patient is to be put in a sandbagged area away from the surgical unit, given a shot of morphine and left to wait (and die) until others are treated. Again, the medical team ignored the protocol. Here’s a short video put together by the Military Times, which includes actual footage of the surgery where Dr. John Oh, a Korean immigrant who became a naturalized citizen and went to West Point , removed the live round with the help of volunteers and a member of the EOD (explosive ordinance disposal) team. Moss has undergone six operations but is doing well at home in Gainesville , GA. I think you’ll find the video absolutely remarkable.”

Why has Obama employed a legion of private and government attorneys to avoid presenting a legitimate birth certificate and college records?…Citizen Wells and millions of concerned Americans

Military officers take the following oath:

“I, _________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

They are duty bound to support and defend the Constitution and disobey illegal orders. Attorneys in the military are duty bound to uphold justice.

Great commenter and blogger Zach Jones provided this article from  CNN.

“A court hearing is scheduled for Friday in the case of a soldier who has refused to deploy to Afghanistan until President Obama proves that he was born in America and is legally eligible to be president.

Lt. Col. Terrence Lakin is scheduled to go before a judge in Virginia to enter a plea on charges that include disobeying a lawful order and dereliction of duty.

He is a decorated Army doctor and an 18-year veteran who is now facing court martial for disobeying orders to ship out for another tour of duty in Afghanistan.

Lakin says the orders are illegal because, he claims, Obama — the commander-in-chief — has not proven he was born in this country.

Lakin wants Obama to produce his birth certificate.

“It’s a fundamental of the Constitution, and my oath of office is to the Constitution. And I believe we need truth on this matter,” Lakin told CNN’s “AC 360″ in May.”

Alert: Hearing Location Changed to Ft. Belvoir on Friday Aug 6 at 11am

This an arraignment to formally enter Terry’s plea. The hearing will last no longer than 30 minutes. This hearing precedes the formal courts martial which has not yet been scheduled. This is a pubic hearing. However, there are established protocols and standards for behavior. Please read the following paragraphs carefully if you are planning to attend the hearing:

 
Courts martial are public hearings, and by law and custom all are welcomed to attend any proceeding. However, the rules for courts martial require strict formality during all proceedings, and prohibit among other things, reading, gum chewing, making any kind of noise, contacting the judge in any way and generally preclude any disruption or demonstration of any kind, either of support or of opposition to the court’s rulings. We encourage LTC Lakin’s supporters to attend the hearing August 6th as well as all future hearings. While LTC Lakin would be pleased to meet and greet supporters afterwards, it is of the utmost importance that spectators show respect for the process and the court itself. The judge in this case is his superior officer, and if you attend the hearing you will see LTC Lakin accord her the deference and courtesy that all good soldiers show their superiors. The best way to demonstrate support for LTC Lakin if you are attending is to pray for him, and after the hearing to speak with him. Demonstrations of any other kind are inappropriate, and will not be tolerated by the court. LTC Lakin’s reputation in the Army is of a good, even exemplary, soldier who has always shown his superior officers the respect and courtesy their rank and position demand. Please follow his example in the court room Friday and strictly observe the rules of decorum.

Army Refers Charges Against Lakin To Court Martial
Military Judge Appointed
Arraignment Set for Hearing on August 6, 2010
Washington, D.C., August 2, 2010.  The Army has now referred charges against LTC Terrence Lakin for a General Court Martial.  This action triggered the appointment of a Military Judge to preside over the trial, which will likely be scheduled before October, and held in Washington, D.C. at Ft. McNair.
 
On August 6, 2010 at Ft. McNair in Washington, D.C., the court will convene for the purpose of Judge Lind taking Lakin’s plea to the charges which consist of “missing movement” and of refusing to obey orders. 
 
Today Lakin stated: “I am not guilty of these charges, and will plead ‘not guilty’ to them because of my conviction that our Commander-in-Chief may be ineligible under the United States Constitution to serve in that highest of all offices.  The truth matters. The Constitution matters. If President Obama is a natural born citizen then the American people deserve to see proof, and if he is not, then I believe the orders in this case were illegal.” 
 
If convicted, Lakin faces up to four years at hard labor in a federal penitentiary.
 
LTC Lakin is a doctor and is in his 18th  year of service in the Army.  He is Board Certified in Family Medicine and Occupational and Environmental Medicine.  He has been recognized for his outstanding service as a flight surgeon for year-long tours in Honduras, Bosnia and Afghanistan.  He was also awarded the Bronze Star for his service in Afghanistan and recognized in 2005 as one of the Army Medical Department’s outstanding flight surgeons. 
 
In March of this year, he announced in a video posted on YouTube that he would refuse to obey orders until receiving proof of the President’s eligibility.  So far, more than 200,000 people have viewed that video.
 
Army Col. Denise R. Lind will preside over the trial.  Before becoming a judge, she served tours of duty both prosecuting and defending soldiers in court martial proceedings. She is a 1982 magna cum laude graduate of Siena College, and earned her law degree from Albany Law School in 1985.  As Military Judge, she will decide all matters of law, including requests from the defense for discovery, and a motion the prosecution has said it will make to determine the lawfulness of the orders LTC Lakin is charged with refusing to obey.  A “jury” comprised of Army officers will decide based on the facts whether Lakin is guilty or not guilty of the various felony-equivalent charges pending against him.
 
In standing up for his convictions and in keeping with his training that illegal orders must be disobeyed, LTC Lakin has been widely praised for upholding the rule of law and the paramount supremacy in our society of the United States Constitution.
 
Lakin is represented by military counsel, and by Paul Jensen, a civilian attorney from California who has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense.
