CNN is reporting on the LTC Terry Lakin court martial proceedings. While I am pleased that they are presenting this story, CNN is not letting facts get in the way of covering for Obama and his eligibility problems.

“Lt. Col. Terrence Lakin is a poster soldier for the so-called birther movement, but for 17 years prior to his court-martial proceedings, the flight surgeon served around the globe, racking up a chest full of medals.
Military prosecutors allege that the Colorado native intentionally missed a plane in April after disobeying four lawful orders from superiors. Lakin has said he refused to deploy to Afghanistan until he sees proof that President Obama was born in the U.S.
In a YouTube explanation posted before he was charged, Lakin said he had no choice but the “distasteful one of inviting my own court-martial.”
“If [Obama] is ineligible, then indeed, all orders are illegal because all orders have the origin with the commander in chief,” he said.
The Uniform Code of Military Justice says the maximum punishment for both offenses — missing his plane and disobeying lawful orders — is a dishonorable discharge and up to two years in confinement. A guilty verdict could also result in forfeiture of his pay, which totals $7,959 a month, according to a charge sheet provided by a group sponsoring his defense.
Lakin is among 27 percent of Americans who doubt or deny that Obama is American-born, according to a recent CNN/Opinion Research Corp. poll. They compose the birther movement, which demands that Obama present a birth certificate signed by the doctor who delivered him in 1961.
Obama has made public an unsigned “certification of live birth,” which birthers claim is not the same as a birth certificate. However, two Honolulu, Hawaii, newspapers have presented birth announcements for Obama, and the state’s Republican governor has confirmed that the president was born in the Aloha State.”

Poll indicates that nearly 60% have doubts re: place of birth. “Probably” born in US does not indicate certainty.
Nearly 6 of 10 Americans uncertain about the president’s birth. Only 42 percent of the respondents stated bo definitely born in the United States.

If this trial were to take place in a civilian court the judge as well as the jury made up of military would have to recuse themselves due to their own positions for being compromised since their careers could very much be on the line with a positive judgment for LTC Lakin – as they witness this man’s career being ruined right before them in reality.

The Water In The Gulf Of Mexico Is Now Highly Toxic
Lab tests have confirmed that water throughout the Gulf of Mexico is now very highly toxic. A couple of “independent journalists” were able to obtain water samples from the Gulf and send them out to a scientific laboratory for testing. The samples sent in were from along the shore in Louisiana and also from 20 miles out. The results were absolutely shocking. The tests found concentrations of propylene glycol at between 360 and 440 parts per million. Needless to say, that is extremely alarming. Propylene glycol at just 25 parts per million will kill most fish. So what in the world is going to happen to fish that encounter this kind of toxic soup? It is going to be a complete and total nightmare for them. So where is all of this propylene glycol coming from? Well, propylene glycol is one of the key ingredients found in the various Corexit brand dispersants that BP has been using in the Gulf of Mexico. Up to this point, BP has dumped over a million gallons of such dispersants into the Gulf. So instead of actually saving the environment of the Gulf of Mexico, BP is rapidly poisoning it. The destruction of sea life is going to be on a scale that is absolutely unimaginable.

The military justice system provides for broader discovery than required by practice in federal civilian criminal trials. See e.g., United States v. Williams, 50 M.J. 436, 439-40 (C.A.A.F. 1999). But depositions are not the normal avenue for discovery outside the Article 32, UCMJ, process.

A proper construction of the defense discovery request is to obtain the official Hawaii record of the president’s birth. It would be a certified true copy of a public record admissible into evidence under Mil. R. Evid. 806(8).
Yes, you get the COLB. That’s all the prosecution is required to do. That is sufficient evidence in a court-martial of the birth and citizenship of the individual for the purposes of discovery obligation.
That’s all he’s entitled to. As noted, anything else received should be sealed by order of the court.
LTC Lakin won’t like it, but that’s everything he’s entitled to. I’ve been dissatisfied with discovery any number of times. You make your record and then have it for appeal. That’s it, you have to move on from there.
I doubt Lind is going to give them any more than that BECAUSE IT’S NOT RELEVANT to the lawfulness of the orders.

Gulf Oil Spill Released Toxic, Tough-to-track Chemicals
(USA Today/WLTX) — Out of sight, out of mind? With surface oil slicks fading from view in the Gulf of Mexico, courtesy of the capped Macondo well, we’d be out of our minds to think that the oil still isn’t there, warn forensic toxicologists.
Under the water is where the oil is, say environmental chemists such as Jeffrey Short of the conservation group, Oceana, and not just in deep sea clouds of oil reported by National Oceanic and Atmospheric Administration (NOAA) scientists. “Oil tends to congeal and where you saw a broad slick, you now have a lot of droplets and tarballs,” he says. Whether floating as tarballs, buried under Mississippi River mud or carried off in currents to the Atlantic, much of the spilled oil remains in the water, Short says.
“A chemical spill in the ocean is what this (Gulf of Mexico) leak is, really,” says chemist Kim Anderson of Oregon State University in Corvallis. “The crude oil contains diesel, it contains gasoline, it contains kerosene, it contains methane and it contains chemicals that are unfortunately, carcinogenic. Literally there are hundreds of chemicals in crude oil.”
“Very hazardous groups of chemicals are released in any spill,” adds chemist Trevor Penning of the University of Pennsylvania. The exact amount varies with the exact nature of the crude, he adds, with heavier oil containing more toxic stuff. The 2002 Prestige oil tanker spill in the Mediterranean, which released heavy bunker oil – literally the gloppy “bottom of the barrel” oil burned in ship’s engines – was particularly toxic, while the lighter crude of the Gulf should contain less-heavy concentrations of the worst toxins, the chemists suggest.

I thought during summer of 08, that no American should have any doubt re: eligibilty-Americans have far too much to worry about, this government lends new meaning to the phrase FUBAR.
Something about the Gulf Oil Spill re: cover-up(s). The turtles-here in Palm Beach when it is turtle nesting time-lights out-and everyone complies because they love the turtles. They found the lights were confusing the turtles and the little wrong way Corrigans that they were went in the wrong direction and got squished on the highway. I don’t remember which state LA, AL but volunteers carefully dug up the turtle eggs and to give turtles a fighting chance reburied the eggs in FL. The problem is the turtles will go back to the original place they were nested-instinct-so I don’t know what will happen with that oil that they buried instead of removed. It is correct to keep investigating this, something not kosher going on. Burying any problem does not fix a problem, in the end it just makes things worse.

SAN FRANCISCO (KGO) — As more water samples from the Gulf of Mexico arrived at the Lawrence Berkeley national lab for testing, the Center for Biological Diversity filed its second legal action of the week in response to the Gulf oil spill. Today it formally notified BP of its intent to file suit under the Clean Water Act.
“BP has shown that it lacks the capability to stop this massive leak, and the federal government is waiting and watching” said Miyoko Sakashita, oceans director for the Center for Biological Diversity in San Francisco. “The Clean Water Act provides for citizen enforcement when the polluter and government fail to act, and we intend to seek the maximum penalty possible against BP.”
It is “rather rare” for someone of Lakin’s stature (lieutenant colonel is two ranks below general) to be court-martialed, said Jonathan Tracy, assistant director of the National Institute of Military Justice at American University in Washington.
Though Lakin has repeatedly stated he is not beholden to any orders because he believes Obama’s presidency is illegitimate, Tracy said it’s unlikely the court will address the matter.
The prosecutors have to prove only that he missed his plane intentionally or through neglect and that he disobeyed lawful orders from superiors, said Tracy, a former Army judge advocate who served in Iraq.
“He’ll have to prove he didn’t violate these things,” Tracy said. As for the issue of Obama’s birthplace, the “bottom line is, that’s obviously going to be his defense, but I don’t know that it’s going to go anywhere in the court-martial.”

Lt. Col. Lakin spent a long and honorable career in our military-all of his records-school, employment are out there for the world to see. He is going up against Obama-a person who came out of nowhere (Chicago’s South Side-cesspool of corruption) whose few records that he provided are now sealed and the less than few are fraudulent documents. Here’s what happened in Court yesterday:
Fort Belvoir, Virginia (CNN) — Charges against the Army officer who refused deployment to Afghanistan because he says … Barack Obama doesn’t have the authority to send him, should be thrown out says his attorney, Paul Jensen.
Lt. Col. Terrence Lakin went before a military judge — and a standing-room-only courtroom — in Virginia on Friday to face three charges of disobeying a lawful order, one count of missing movement (not deploying with his unit) and one count of dereliction of duty.
He did not enter a plea at the arraignment hearing, and Jensen asked to defer any plea until after the court could consider a motion to dismiss the case.
Judge Denise Lind, an Army colonel who was wearing basic camouflage fatigues under her black robes, agreed to the request and gave Lakin’s attorneys until August 20 to file a motion to dismiss. Both the prosecution and the defense will then have until August 27 to formulate and send written responses to the motion. Hearings on the motion will follow on September 2 and September 14. Future hearings in the case will be at Fort Meade, Maryland.
If the charges are not dismissed, court martial proceedings will begin on October 13.
Lakin and his legal team — Jensen, Jensen’s assistant and Lakin’s free-of-cost military attorney — arrived 15 minutes late, then the lawyers went into a meeting with Lind. The colonel remained in the 34-seat courtroom, which was full of soldiers, primarily officers, all wearing basic camouflage fatigues.
In addition to pushing back his plea, Lakin waived the opportunity to choose whether a judge or jury would decide his fate.

The best defense is a good offense. Unfortunately, bo has Col Lakin on the defense. Of course, conviction can be overturned by SCOTUS, but not before 2011 at the earliest. Meanwhile, bo will achieve his goal of intimidating other Military Officers by getting Col Lakin convicted.

There also now are several hearings scheduled in the case, starting with an Aug. 20 event that will deal with evidence in the dispute.
According to the court, a second hearing on Aug. 27 would be for government “objections” to the evidence, and Jensen said he expects opposition from the White House at that point.
That’s because the strategy in the case will include requests for evidence that Obama is, in fact, eligible to be commander-in-chief, evidence that could come through depositions with Hawaii state records holders – who presumably have access to Obama’s original birth documentation if he was born there as he has written.
Two other hearings are set Sept. 2 and Sept. 14 in the case before the trial date of Oct. 13.
Judge Lind noted that Lakin has the choice of supplying either his own counsel at his own expense or be provided military counsel at the government’s expense. Lakin actually took a third option, which was retaining both military and civilian counsel, which he is entitled to do.
Lakin also has the choice of being tried by a jury of five military officers, who would vote by secret ballot on his guilt or innocence. Alternatively, he could choose to be tried by the trial judge alone, who would determine the result.
After Judge Lind requested that Lakin submit his plea of guilty or not guilty, Lakin’s attorney said “No plea.

That was a good one too, my family in suburbs of Chicago was a construction family-so I grew up on many construction sites. If I ever talked to the guys like that lady did to Billy I would be in the foundation hole upside down. The guys that work in these marshes, waters know that area like the back of their hands-they know what to do, and when to do it and modify if necessary.
No one sitting at a desk in DC would have a clue, you have to be on site with a plan. One thing I learned is mud or cement when the guys had to wear their heavy boots/galoshes-walking around in that stuff-it is so heavy and it pulls (almost like suction) your legs get so tired so fast. It is heavy, hard, dirty work but you have to do it, prep work is important too. What idiot does not listen to the experts, that video was from day 65, it was day 107 when they announced it was “clean” or buried take your pick.
bo is obviously engaging in stall tactics in the BC litigation in the hope that he can stack SCOTUS with radical judges like kagan before a legitimate action on the BC issue gets before SCOTUS.

Since when is a COLB adequate to prove Natural Born Citizenship? That is the standard, NOT, citizenship. Natural Born Citizenship via the SCOTUS:
"The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their [88 U.S. 162, 168] parents. As to this class there have been doubts, but never as to the first."
That means if your not born on US soil of US parents, your NBC status is IN DOUBT. Obama clearly is in DOUBT, as he has claimed that he lived under the jourisdiction of a foriegn government at birth, and his father was a british subject.
I must also add, that if the defense is entitled to the copy of the COLB, including by Hawaii State Law any NOTIFICATIONS OF CHANGES or AMENDMENTS. Thus, IN THE PUBLIC RECORD, we all get to see a certified copy of the COLB, by the State of Hawaii. We all get to compare it to what was released by the Obama Campaign website before the 2008 election. Should the Internet COLB have been 'altered' in any way, Obama committed Election Fraud.
Let me be perfectly clear here, if Obama's COLB that is released has ANY INFORMATION THAT IS DIFFERENT THAN THAT RELEASED BY THE OBAMA WEB SITE, HE HAS COMMITTED ELECTION FRAUD, IMHO. The document was altered, and thus was invalid, and was sent to the public as such, a forgery. The state of Hawaii, never affirmed the internet COLB, but the stain of not informing the public of the forgery will be enourmous.
Obama likely has a COLB with Hawaii, they have said so. The question is what is ON THE ORIGINAL FORM, WHAT HAS BEEN AMENDED? BTW, an AMENDED COLB WILL BE INSUFFIENCT EVIDENCE TO CONVICT LARKIN. YOU CANNOT LEGISLATE NBC, YOU EITHER ARE OR ARE NOT AT BIRTH. This means you cannot be an ADOPTED NBC.
Obama was adopted, he is NOT NBC. Obama was adopted then re-adopted, then he is NOT NBC. Obama was not a witness birth by a physician, he was late registered and his birthplace is in question, it's going to get ugly. Obama changed any information on the original 'birth record' his certificate will have to have the AMENDED MARKS or he committed election fraud.
I'm just betting, that the original information on race filed with the State of Hawaii for race did not read "african" as this was not an acceptable option for filing race in 1961. That means what he has shown the public is altered; 1)because what he demonstrated to the public didn't have the appropriate codes for altered 2) The whole thing was forged.
I fully expect the State of Hawaii and the DOH to 'fake it' because of the consequences of revealing the truth. How will they fake it, they will remove the mandated marks for 'amended' COLB from the final print. Make no mistake, the information released on the original COLB could NOT have been the original information filed–they didn't have a race option for 'african' in 1961.
I have no doubt that LTC Lakin will be found guilty, and I firmly believe that the Hawaii DOH will do whatever is necessary to 'cover the lie' and the press will help with the newest 'Journolist'. Treason is the new 'fad' in America it seems. Personally, I want to return to the old fad and just start hanging them.
Perhaps the saddest thing of all is that the Marine Corp., whom so many have sacrificed and fought so bravely for, will do the easy and politically correct thing of 'wasting' LTC Larkin to prevent a real investigation. Can you have a Marine Corp without Honor? Perhaps Congress already answered that by confirmation of Kagan–a SCOTUS Judge whom doesn't respect the Constitution.

There also now are several hearings scheduled in the case, starting with an Aug. 20 event that will deal with evidence in the dispute.
According to the court, a second hearing on Aug. 27 would be for government “objections” to the evidence, and Jensen said he expects opposition from the White House at that point.
That’s because the strategy in the case will include requests for evidence that Obama is, in fact, eligible to be commander-in-chief, evidence that could come through depositions with Hawaii state records holders – who presumably have access to Obama’s original birth documentation if he was born there as he has written.

There is an ongoing attempt to change attitudes in our country. You can see it in the MSM through many who talk openly trying to sway feelings. This extends beyond trying to get rid of God, to completely shred the basic principles we follow such as the Consitutition. Having arrived back from our mini vaction safe and sound, I have been able to keep up slightly over the last 6 days. It would be short handed to say that a lot has happened in such brief period.
Nevertheless, FreeSpeech, I agree with your statement whereby Col. Lakins Attorneys should have been better prepaired. I was in shock that his Attorney allowed himself to be Flanked in a simple manouver that he should have learned in trial procedual strategy 101.
Having said that, I also believe that Col. Lakins made an ill choice by having the Trial Judge rule on the case alone, rather than Military Officers acting on behalf of a jury. But that is my opinion. Maybe there is a deeper strategy I don’t see as of yet.
For now, it appears to me that Col. Lakins is down 2 scores in the first quarter and only 1 min. In the game. Not a good start and this seriously saddens me.

The Democratic pollster points out some pretty stunning poll numbers which show just out of touch the Administration is with the American people. Only 39% of Americans think that Obama’s policies “saved the country from the brink.” Just saying “I won” is not enough to sell your policies to the American people.

I think many of us come from mixed family/friends. I never saw the “divinity” of Obama and I thought the fawning media was SICK, even Kings with courtiers didn’t get that much action, but they were always counterbalanced by one of the most necessary items on the Kings staff which would have been THE FOOL, who always would remind the King that he was a mere mortal man, subject to error (s). In the wonderful world of what goes on in Obama’s head (which isn’t much) I think he considers WE THE PEOPLE and all those he can manipulate THE FOOLS. I think this is one sick giant game to him. Let’s see how much I can get away with, then go for more. When the bough breaks the cradle will fall, wonder how many want to go along for the ride? Now that Larry Sinclair has moved to Washington, DC to defend the frivolous lawsuit brought by Dan Parisi, all hell is starting to break loose again. Sinclair was pulled over by Secret Service simply because he was driving down Pennsylvania Avenue looking for a parking space. And his apperance at the National Press Club on August 4, 2010 was interesting as well, as there was a uniformed security guard there for the entire three hours, and he was escorted away by that security guard.

Part of the problem since summer of 08 was there was so much evidence-I watched the Polarik videos, I was left wondering who would have the skill level to do this? The reason I ask is that I used to work for a company that was involved with engravers. We would get visits from the Dept of Treasury who check up on the guys as to behavior-they were looking for anyone who might have gone dirty. After watching the video’s I know I couldn’t do it. Also it seemed every time a copier/scanner repairman came in, they always said the copiers are a “little off” on purpose so people can’t go printing off counterfeit money.

Michelle, BHO is guilty of all sorts of heinous crimes – that we can agree on; however, because of the sheer volume of crimes and the length of time it takes to choose those that are the most easily proved (and gather evidence) wisdom must be applied. After all, it takes months to build a case that will stand up in court. That is why the COLB forgery could be the shortest route.
IMO, our best hope at this point is for a change in control of House and Senate. Impeachment requires much less time to accomplish removal, and then BHO can be later tried for crimes.

I would think that the court would have enough smarts to require the Hawaii Departmwnt of Health to supply a CERTIFIED COPY of Soetoro’s BC. Paxson, you believe that we can’t find evidence of fraud by POTUS in procuring a CT SS# and then using it on his draft registration application, or alleged inconsistencies between the numbers on the draft registration and Selective Service data system?
I am also curious to know if there is evidence of POTUS violating federal elections law by voting in presidential elections beginning in 1978 (first vote and what were the applicable eligibility conditions for legal voting?) and again in 2008? If you look at Section 611, Voting by Aliens ( c), it states that either both parents must be natural born citizens or naturalized citizens for the alleged alien to be exempt from prosecution for violation of federal voting statutes. In other words, even if Barry was covered by a COLB (regardless of whether it was obtained by filing within one year of his birth and immigration to HI, or fraudulently), under federal election law he does not meet the bar as a legal voter in federal elections since both of his alleged parents, and/or adoptive parents were not natural born or naturalized at the time of his birth.
Add to this his application for a CT SS# and the use of said SS# for Selective Service Draft Registration and we have evidence of his prior knowledge of his status at birth, and his own subsequent fraudulent assertions to authorities to obtain his CT SS#, his draft card, his voting rights and even his current office.
Barry has never had two citizen parents of legal record (either natural born or naturalized) at any time aeb his COLB(s). Even his alleged adoption in the Spring of 2008 could not have been legal since he’s still signing his presidential authorizations as BHO. Then, the Crow Tribe adoption cannot be his legal name, nor could it have cured a potential violation of federal election voting laws. Thus, his last amended bc/COLB document from HI will not state any other name than Barack H. Obama. We know he did vote in the 2008 presidential election because there is videotape of him entering the voting booth and exiting.
Could it be this simple? Federal election voting fraud? Or, violation of Selective Service Draft Registration laws by forging or falsifying statements or a fraudulently obtained CT SS# on his Armed Services registration? Or, have these ideas already been investigated?
