Several days ago we learned.

Army Refers Charges Against Lakin To Court Martial
Military Judge Appointed
Arraignment Set for Hearing on August 6, 2010
Washington, D.C., August 2, 2010. The Army has now referred charges against LTC Terrence Lakin for a General Court Martial. This action triggered the appointment of a Military Judge to preside over the trial, which will likely be scheduled before October, and held in Washington, D.C. at Ft. McNair.
On August 6, 2010 at Ft. McNair in Washington, D.C., the court will convene for the purpose of Judge Lind taking Lakin’s plea to the charges which consist of “missing movement” and of refusing to obey orders.”
The military officers oath of office.
“I, _________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
Under the Uniform Code of Military Justice, UCMJ, it is a crime to disobey a lawful order. Ultimately all orders flow from the commander in chief, the office of the president of the US. Here is an example of an order that should be challenged. Let’s suppose that a coup was taking place in the US. Let’s suppose that a rogue Speaker of the House was keeping the the president and vice president captive in a secret place and announced that they had been killed. Let’s further suppose that the Speaker gets sworn in rapidly and then begins issuing orders to the military. Let’s further suppose that an order is issued for an invasion of a country. Should military officers blindly follow this order?
The answer is obvious. The orders and the Speaker taking the presidency should be questioned, more information obtained.
We have a very similar situation now with Barack Obama illegally occupying the White House with no proof whatsoever that he is eligible. Terry Lakin has every right and duty to question this. Obama continues to use government attorneys to avoid presenting a legitimate birth certificate and other records. We have a usurper in the White House and thus every military order is subject to question.
LTC Lakin has a duty to defend the US Constitution and disobey illegal orders. It is Lakin’s superiors who should be court martialed.
Notice the emphasis placed on eligibility in the presidential line of succession.
US Code
TITLE 3 > CHAPTER 1 > § 19
§ 19. Vacancy in offices of both President and Vice President; officers eligible to act
(a)
(1) If, by reason of death, resignation, removal from office, inability, or failure to qualify, there is neither a President nor Vice President to discharge the powers and duties of the office of President, then the Speaker of the House of Representatives shall, upon his resignation as Speaker and as Representative in Congress, act as President.
(2) The same rule shall apply in the case of the death, resignation, removal from office, or inability of an individual acting as President under this subsection.
(b) If, at the time when under subsection (a) of this section a Speaker is to begin the discharge of the powers and duties of the office of President, there is no Speaker, or the Speaker fails to qualify as Acting President, then the President pro tempore of the Senate shall, upon his resignation as President pro tempore and as Senator, act as President.
(c) An individual acting as President under subsection (a) or subsection (b) of this section shall continue to act until the expiration of the then current Presidential term, except that—
(1) if his discharge of the powers and duties of the office is founded in whole or in part on the failure of both the President-elect and the Vice-President-elect to qualify, then he shall act only until a President or Vice President qualifies; and
(2) if his discharge of the powers and duties of the office is founded in whole or in part on the inability of the President or Vice President, then he shall act only until the removal of the disability of one of such individuals.
(d)
(1) If, by reason of death, resignation, removal from office, inability, or failure to qualify, there is no President pro tempore to act as President under subsection (b) of this section, then the officer of the United States who is highest on the following list, and who is not under disability to discharge the powers and duties of the office of President shall act as President: Secretary of State, Secretary of the Treasury, Secretary of Defense, Attorney General, Secretary of the Interior, Secretary of Agriculture, Secretary of Commerce, Secretary of Labor, Secretary of Health and Human Services, Secretary of Housing and Urban Development, Secretary of Transportation, Secretary of Energy, Secretary of Education, Secretary of Veterans Affairs, Secretary of Homeland Security.
(2) An individual acting as President under this subsection shall continue so to do until the expiration of the then current Presidential term, but not after a qualified and prior-entitled individual is able to act, except that the removal of the disability of an individual higher on the list contained in paragraph (1) of this subsection or the ability to qualify on the part of an individual higher on such list shall not terminate his service.
(3) The taking of the oath of office by an individual specified in the list in paragraph (1) of this subsection shall be held to constitute his resignation from the office by virtue of the holding of which he qualifies to act as President.
(e) Subsections (a), (b), and (d) of this section shall apply only to such officers as are eligible to the office of President under the Constitution. Subsection (d) of this section shall apply only to officers appointed, by and with the advice and consent of the Senate, prior to the time of the death, resignation, removal from office, inability, or failure to qualify, of the President pro tempore, and only to officers not under impeachment by the House of Representatives at the time the powers and duties of the office of President devolve upon them.
(f) During the period that any individual acts as President under this section, his compensation shall be at the rate then provided by law in the case of the President.

Thanks Citizen Wells for bringing this up. LTC Lakin needs all the support he can muster. Was a time Bloggers posting here would do whatever it took to build support for a cause like this. The Top Kill process continued overnight. They pumped enough mud down the well to achieve static equilibrium – i.e. the weight of the mud offsets the pressure. After review by the government officials, BP has been given the go ahead to pump cement in on top of the mud. When the cement sets up it will provide a “rock” plug some hundreds of feet long.
The operations with the relief well (whose purpose is to ultimately put a similar cement plug at the bottom of the well) are moving slowly along on schedule. That activity should become exciting and newsworthy in about a week.

This an arraignment to formally enter Terry’s plea. The hearing will last no longer than 30 minutes. This hearing precedes the formal courts martial which has not yet been scheduled. This is a pubic hearing. However, there are established protocols and standards for behavior. Please read the following paragraphs carefully if you are planning to attend the hearing:
Courts martial are public hearings, and by law and custom all are welcomed to attend any proceeding. However, the rules for courts martial require strict formality during all proceedings, and prohibit among other things, reading, gum chewing, making any kind of noise, contacting the judge in any way and generally preclude any disruption or demonstration of any kind, either of support or of opposition to the court’s rulings. We encourage LTC Lakin’s supporters to attend the hearing August 6th as well as all future hearings. While LTC Lakin would be pleased to meet and greet supporters afterwards, it is of the utmost importance that spectators show respect for the process and the court itself. The judge in this case is his superior officer, and if you attend the hearing you will see LTC Lakin accord her the deference and courtesy that all good soldiers show their superiors. The best way to demonstrate support for LTC Lakin if you are attending is to pray for him, and after the hearing to speak with him. Demonstrations of any other kind are inappropriate, and will not be tolerated by the court. LTC Lakin’s reputation in the Army is of a good, even exemplary, soldier who has always shown his superior officers the respect and courtesy their rank and position demand. Please follow his example in the court room Friday and strictly observe the rules of decorum.

With all due respect, I find the video hard to follow seriously, because it is a mixture of various commentary, pictures, and narration which seem somewhat disjointed. Most importantly, I find that so many videos of this type don’t adequately confirm dates or producer.
This particular one is old – from the middle of May, or so, as I could ascertain from the date on news report. So this is really an OLD report, and I strongly doubt its relevance to today.

Agreed!! I abhor what is happening in AZ! In your opinion this would be a good place to have a citizens’ grand jury? Probably no better state, but I do have a taunting problem with how one would go about assembling a grand jury of people who would be considered unbiased here in AZ. And that is one of the criteria for a valid grand jury, the way I read it.
Secondly, going after “BoTerrorists invading AZ” would be an excellent idea, but it is rather a vague concept which I see as being difficult to pin down to any certain people. Also trying to make a case of the connection between these invaders and Bo would be time-consuming and, perhaps, impossible.
Thirdly, if the two above were achievable then to whom would the presentments be made? Here is where there is a huge quantum leap. Supposing that a county or state court could be found that would accept the presentments, then what? If AZ cannot even get a law passed against illegals without being knocked down by the feds, what chance would a local court have?
I know you believe that it could be taken directly to SCOTUS. That I will have to see in order to have any confidence in.

Although conspiracies and corruption dog the situation at every level, I think in the end the unwillingness of the PTB to address the Soetoro eligibility issues is just another dramatic instance of this phenomenon.

I know I will botch up this explanation but at certain times of the year, the sand gets dragged out to sea-tides, currents etc., so this will all be re-exposed. I think that this action happens in about January through-March (???). That is why they do beach renourishment down in Palm Beach County. Condos built too close to the ocean occasionally fall in due to erosion.

I hope you either missed my point or that maybe I chose a poor title. Surely you cannot disagree that leaders seem to have this attitude.
Maybe my title should have been “An Explanatory Tale”. I was not in any way promoting that keeping the people in the dark was a good thing. I am just continually searching for explanations for our current situation.
I am not quite ready to buy into the premise that there is a global conspiracy. Neither do I believe that every last one of our congress and judges are corrupt. So that leaves me with big open questions: Why? How?
Being a skeptic I was slower than some to believe that Zero is a fraud and a hoax. The “con” is just too big. It would be the biggest con in the history of the world. It is just “not possible”.
But once the evidence became irrefutable, I then had another dilemma from which I have not yet fully extricated myself: Why? How?

What Kagan said is clearly true. In some unfortunate and rare circumstances, it can be predicted with near certainty that a woman will die either giving birth, or shortly afterwards.
As I understand it, Kagan didn’t ‘falsify an expert medical report …by ACOG’, she suggested the wording of the report be changed to reflect the truth of the matter., that in some cases, late stage abortion is the only way to preserve the life of the woman.
Tragic, and horrific, but true.
The re-wording Kagan proposed *was accepted* by ACOG, and ended up in the final version of their report. She didn’t sneak it in while their backs were turned.
Who said this about the Gulf:

Kagen is easily the most radical left nomination ever. One can even argue that overall she is the worst nomination ever. Well, look it up. Meyers has way better credentials and bonafides than Kagen and is also more centrist.
At some point – in order to not cripple the government – the Republicans would have to hold their nose and vote for somebody they would not prefer. But this is ridiculous. They could have exercised their legitimate right to vote down one, or two, or even several candidates to get someone more to the center. There is no reason whatsoever for any Republican to have voted for Kagen. None.

I agree that the evidence is slowly mounting that this was probably not just an accident.
But you are a lawyer – you must understand the burden of proof! How do you get over the hurdle of “probably”. As much as you like Alex Jones or Matt Simmons, they would be worthless in court. Even an amateur defense counsel could tear them apart.
Then you are left with the really hard part. How do you tie this to Commander Zero? As much as I would like that to happen, I just don’t see it. At most you might get yet another expendable Flying Minkey thrown under the bus.
The situation is so complex that any trial would go on for months if not years. They may eventually find one or two scape goats and that would be it. (Remember Lee Harvey Oswald, and Jack Ruby? – the truth about this will never be known).
In the meantime, things are winding to a close and the situation is being reported as getting better and not as bad as expected. Whether this is the truth or just MSM lies, is unimportant. The point is the perception.

……………………..and now,another tentacle has reached out for a second time. It slithered across the floor into the SCOTUS. Now the deck is stacked, and it will remain “stacked” for many years to come. The scotus will become a court that will allow only deviate issues to come in front of it. I think that the Missouri vote will never see the clerk’s desk. The honchos in the state will be bought off, and McCaskill will see to it, and will be at the head of the line.

One thing to remember about FL, certain areas are considered “madatory evacuation” in Hurricanes, that is messy enough. I cannot imagine what the whole state would be like.

Oh, I agree as I’ve commented here to Oldsalt many times…their worst enemy will be those who lost their jobs, houses, living in cars or depots, can’t get food for having no resident address–those with no 401K, stocks, bonds, savings, pensions—those living from paycheck to paycheck and not having that??
CONgress, lawyers, CEOs, Wall Street tycoons, upper echelon of big business…find another nation because this one will become hazardous to your health.

I checked the Old Farmers Almanac-it says watch for a Major Hurricane late Aug, early Sept. but FL has a big coast line so you never know where it is going to go. We had three bad years, back to back-the one when we ran the Alphabet and into the Greek alphabet, that was a doozy. Everybody learned a lot. The trees down was unmerciful-huge ficus trees that the roots were taller than you. It’s a wonder we are not all crazy. When the Region got hit so bad, was it Katerina in New Orleans and MS, AL who all suffered terribly too? after a while they all blend in your mind. We were without power for a week, some people months-you learn to rough it real quick. One think that sticks in my mind-other states. Thank you for sending your power people to help, we appreciated the help so much. One guy said as we were walking through the neighborhood-I have been to FL 4 times this year and have yet to see the ocean. I think he was from New Hampshire. Bless those guys and their families for coming. One of my girlfriends threw a big cookout for the guys, she said they had a ball. Food does not keep so you have to get rid of it as quick as you can.
