Blagojevich trial wiretap evidence, June 23, 2010, Taped November 8 2008
More wiretap evidence was released yesterday, June 23, 2010, in the Rod Blagojevich trial. I picked one of the wiretaps because it is full of damning evidence and insight into Chicago corruption and the involvement of Barack and Michelle Obama.
From this one wiretap we learn:
- Blagojevich is clearly involved in selling of senate seat.
- Blagojevich has inside info on Obama’s senate seat resignation.
- Tom Balanoff, President of local SEIU IL State Councils, is a go between Blagojevich and the Obamas.
- Obama’s resignation is synchronized for Blagojevich’s benefit.
- Obama follows Michelle’s lead.
- Obama is trying to distance himself from Rezko.

An example is a conversation he held with chief of staff John Harris on Nov. 7, 2008, in which the two were still discussing Blagojevich’s plans to swap a Senate appointment for a post in the Obama administration or some high-paying job in the private sector The two were reviewing talks with union officials they perceived to be emissaries of Obama.
Blagojevich said the emissaries didn’t seem to know exactly what to make of his swap request.“Barack really wants to get away from Illinois politics,” said Blagojevich, laughing. While presidential candidate John McCain’s Article II ‘natural born citizenship’ eligibility was challenged, Barack Hussein Obama’s was not.
Why?
Because Obama’s claim of native-born U.S. citizenship resulted in an easy presumption of eligibility, while McCain’s Panamanian birth immediately raised questions.
In SR511, McCain’s birth to two U.S. citizens while on foreign active military duty proved natural born citizen status, but no-one questioned Obama’s parentage; especially his father being an alien visitor with no intention of naturalization.
The lack of due diligence of Obama’s constitutional eligibility arose out of a false assumption that native-birth defines natural born status. However, his refusal to submit a long form birth certificate raised questions, and started the ‘birther’ movement. Attorney Phil Berg’s pre-election filing of Berg vs. Obama went so far as to deny Obama being a U.S. citizen at all. Further research accepts statutory definitions making Obama a U.S. citizen at birth . . . but statutory provisions fall short of natural born citizenship.

jbjd, In the past, the SOS of CA removed a candidate from the list of candidates to be printed on the ballot, and that case was appealed to the SCOTUS, where Cleaver, I believe was his name, lost his appeal and was not on the ballot.
It seems to be up to the individual SOS if they want to challenge a candidates eligibility. That I believe was the purpose of the “Secretary of State Project” begun by George Soros. Place his SOS in every state in the union, and make sure Obama’s eligibility is not challenged and his name goes on the ballot.
Have you considered the consequences of crooked SOS s, “on the take” for Soros?

I lay this directly at the feet of the judges and congress. For something this HUGE and this URGENT – immediate action should have been taken to sort this out – before it was too late.
Secondarily, the media should have been crying foul – but of course they were too busy licking dark gooey muck from his azz.

You may have a point regarding the various state SOS people. It seems that ALL of them have been openly DEFIANT to even any suggestion that they should expend any effort to do a serious job of vetting a candidate. Bruning of Ohio is one who immediately comes to mind. She made a statement not long after the election that she will run her office as she sees fit, and she will vet a candidate if she sees fit. She stated that it really isn’t her job to vet any candidate for office. She is a typical Democrat. Do nothing,and expect everything.

I was under the impression that Phil Berg made all of his concerns known to the DOJ long before the election. The DNC and ALL the OBOTS jumped on his case with all the strength they could muster, which ended with being thrown out allegedly because of “Standing”. It is PLAIN to see that the COURTS were ALREADY corrupted,and prepared to say or do anything necessary to cover Soetoro’s ass. You don’t need to be a rocket scientist to see that. While Berg might have made some procedural mistakes,I have a difficult ime believing that an error of small words could end any chance of a successful civil suit. After all look at the LATITUDE that was given to SIMPSON’S lawyers.

I have explained this before; but even if I hadn’t, educated citizens can use common sense. They enacted laws requiring their elected officials to perform certain acts on the job; these are called ministerial functions. They also included in these laws, discretionary functions. Courts can be asked to order officials to perform ministerial duties. (This is called Mandamus.) But as long as elected officials exercise discretionary authority in a way that is neither capricious and arbitrary; or contrary to law; the courts will uphold their conduct.
No SoS has a ministerial duty to vet the candidate for POTUS from the major political party as to Constitutional eligibility. However, this does not mean, these same officials cannot exercise their discretionary authority to kick off the ballot someone they know to be Constitutionally ineligible for the job.
Nearly 2 (two) years after the fact, and so many people still so ignorant about their government. We have a lot of work to do to catch up to those people who used their superior knowledge of how our political system works, to steal our power.

When did we make an explicit felony, swearing someone was eligible to get onto the ballot, before ascertaining s/he is? Never. Yeah you’re right. We may see nothing come of it in the Judicial System, but the damage is being done piece by piece, brick by brick. The flood gates are starting to open. The chess pieces are lining up and we have the white side and the black side with a small amount of breathing room in between. Constitutionalists on one side and the Blind on the other.

MY point is – That never in a million years did we believe that each and every citizen (individually!, let alone in groups) didn’t have obvious and immediate standing to question a key constitutional provision like eligibility. All this legal maneuvering on technicalities is literally and truly criminal.
In a constitutional republic, any person ought to be able to engage any elected official sworn to uphold the constitution and legitimately request relief. It’s not like this is even complicated. Simple question simple answer. It does not require an extended process. Nothing has to be manufactured or organized. 24 hours to collect your papers and a couple hour trial or hearing.
EASY PEASY.
None of us knew to what depths our supposedly constitutional republic had sunk. None of us knew that our entire pool of elected officials would abandon us.
You keep writing like the process is good and it is WE who were too stupid to understand it or follow it. WRONG! The PROCESS is BROKEN! There is no conceivable way a sovereign state or a sovereign citizen (remember: “We The People”) can be denied standing.

Mayor Daley endorsed Obama immediately after he announced he was running for president and in return, Obama endorsed Daley’s reelection for Mayor right smack in the middle of major federal investigations of corruption in the Daley Administration.
Obama’s ties to the corrupt Daley machine began when he was dating his wife Michelle and she brought him into the fold. Valerie Jarrett, the deputy chief of staff to Mayor Daley, hired Michelle as her assistant in 1991. Daley made Jarrett the chairman of the Chicago Department of Planning and Development and Michelle worked as her assistant in that Department during 1992-93.
From there Michelle moved up the political tiers to the University of Chicago and ultimately got an overnight pay raise from about $121,000 to close to $317,000, after Obama became a US Senator, as a vice president at the University of Chicago.

This is good news that the Dems in AZ are standing up to BHO, even if their motive is staying in the good graces of AZ voters.
I was just going to speak my mind about this subject before your comment appeared. Here’s the deal: BHO has been so saturated with the Chicago way of pay-to-play, that he applies it in varying ways to legislation of all types, too, as well as bribes to officials, etc. For example, the Dems (with approval of BHO) bought off the NRA to accept the Disclose Act. “You support this Act, NRAers, and we will exclude you from the requirement of disclosing your members,” say the Dems. Now when it comes to border enforcement in AZ, this is the deal: BHO says he will see to it that the border in secured IF Repubs in Congress will go along with comprehensive immigration reform (call it what it is – AMNESTY.) This is ROTTEN!!! The laws are already on the books to secure the border. BHO is violating the federal law, and to use some sort of bait to do what he should be doing anyway has to be criminal! Why can’t someone somewhere file a suit against the U.S. government. The State of Arizona would surely have standing. Something is going to have to give and soon.

Cabby-all I can tell you is there are some real strange power plays going on behind the scenes. Unfortunately the citizens of AZ are caught in one of the struggles, does anyone in government care about the legal, law-abiding, tax paying citizens of AZ except for Gov Brewer and a few others? We’ve already reached a near-dictator status in this country. The Dems, who have been sold out to the far-left wing, control everything. I pulled some of my old comments from the summer of 2008. Basically, I said 1) the COLB cannot be taken as meaning anything as it is on a web site BO paid for; 2) no provision of any law requires any public official to verify BO’s Constitutional eligibility for POTUS; and 3) if you want to keep BO out of the WH (assuming he becomes the D Nominee), file challenges to keep him off the ballot.
Of course, you can’t file challenges unless you know whether your state laws require candidates appearing on the ballot, to be eligible for the job.
(CC, lewd remarks about the press are inappropriate. The press has absolutely no cognizable obligation to tell us anything; we just expect them to. That’s on us too, isn’t it?)

Thanks for the link. It just goes to show that states are lining up to defend themselves and the federal regime is showing its full colors regardless of partisanship. Arizona will be first to pass tough immigration laws. Then Texas, and then dozens more will follow suit and we will start to see a shift in power to more state-centric control like it is supposed to be.
CONgrass will attempt to rewrite immigration law, but it will be too late. We’ll be knee deep in conflict by that point, possibly armed as Soetoro will try to pull the Executive Order card immediately after Arizona passes the law. When he does, it will subject him to impeachment as he would usurping power to harbor illegal criminals. Now, we all know he’s not POTUS legally anyway but the damage will be done.

In a constitutional republic I have an obligation to live with the choice of the electorate – even if I vehemently disagree with ideology. But I don’t have an obligation to live with an illegal democratic choice. I have a basic and core human right to not be ruled by a usurper.
That is so fundamental that it overshadows and overwhelms any fine points or technicalities of law. Your protestations notwithstanding, I GUARANTEE you that if any of the founding fathers were alive today, they would have no trouble finding a way to fix it. Executive Summary – Rap is in action mode. This is not a RAP sanctioned document, comes from us. A word to all you doubting people. When you run around saying oh RAP will never work, Obama and the gang are too strong, etc. you are helping Obama. That is what he wants you and others to believe. This is psychological warfare. Getting people to believe they can never be removed from office is their strongest weapon. They try to control your mind and thought processes.
The truth is Obama and the gang are scared to death of “we the people”. That is why he tries to get your guns every day of the month since he took office. Lieberman tries to pass every sort of fascist type law he can draft. Wish you would realize how terrified they are of “we the people”. Say things like RAP is the best thing for Obama and the gang because it is not violent. If there was no Rap then their plight would be far worse. Rap is a “coup de grace” (sort of) for them. I would think (me talking) the Obama gang can depart and go live in exile anytime now.
In my opinion RAP would let them go in peace and be done with the scoundrels. Suggest they do that and save themselves the ordeal of trials for treason, sedition, election fraud etc. Tell them to read of the French Revolution and the guillotine. The Royals and their families were locked up in the palace where cages were built indoors. There were daily trials for months. After the trial they were led outside to the waiting guillotine. RAP is a better option. Get them afraid of their crimes, very afraid.
Don’t go thinking they are unbeatable. Increase their fear level. They are idiots. Name one thing Obama ever did right? See. Idiots the lot of them. Texas Coordinator for Rap Update – This week the Texas Rap coordinator said it looks like the Obama gang is not going to just go away. They are going to hang on hard. This I completely expected. The analogy he used was a cornered rat standing on its hind legs fighting for its life. The rat will fight with everything it has and never give up. My thought is if it sees a chance to run away and get out of the corner it will take it. Obama and the gang have not yet realized fully they are cornered. They will soon get it. News Blackout – The government run Media has a blackout on RAP. They do not want this getting out. The orders and declarations given to the governors were just way too threatening. They are too scared. If the people get the idea that the IRS, the courts, the foreclosures, etc are operating illegally they will storm Washington DC with pitchforks like the farmers hit Dracula’s castle in the movie. Blood sucking dead people is a good analogy.
When the Government and the People Fear Each Other – It is over. It cannot continue. It only works when the government fears and respects the people. The government is actually the people in a Republic. The only people who like the Obama administration are those who get a check from the government for working for a government agency, getting some sort of government support or being a government contractor. Everyone else disrespects them and wishes they were not in office. The oil spill made their plight far worse. They are at an all time weak point now. Remind the people of the damage this Kenyan caused to the environment on a global scale. Keep the pressure on. It is very likely that the oil spill was a going away present Obama gave to the USA for rejecting him. He knows it is over and his time is short. Be encouraged. The end of the evil empire is in sight.
If You Need Some Proof – Imagine what the Obama gang would do to people serving the Governors with orders, seating Grand Juries (1300 people worth approximately), putting a maritime lien on BP and the British Crown saying Obama and party have vacated their offices by doing nothing, ordering the Louisiana Governor to declare a state of Emergency and attach BP assets etc. None of RAP ever got arrested. No de facto court restraining orders against them. Mind you they are saying they have arrested the fed bonds and messed up their finances making it difficult for them to operate. They also say they have the support of the military. RAP holds conferences, does press releases, says they have support of 69 countries and are raising trillions of dollars to run the country and have recovered stolen assets that government officials took. I even heard them say they caught $100,000,000 Biden was taking. RAP is still free, all of them.
So why do you think this is? Because of the military support. Get it. Any of you seen how bad Obama, Biden, Hillary and Pelosi look these days? The other day Biden did not have all his pretty boy makeup and looked 8 years older. Obama often looks bad. Sometimes it looks like his hair is grey and then appears dyed. See how that brave Governor from Arizona is wiping her feet on the kenyan? Go Jan, go. See many states passing defiant legislation against the feds? So we see Obama shooting hoops and playing golf? He doesn’t know what else to do, not so hard to understand. Remember RAP is going to go softly and quietly so the regular politically and constitutionally uninformed folks don’t really know what is going on to avoid panic.
Mainstream Media – Forget the mainstream media, do not look there. They have heard about RAP and will not carry the story at all!!! RAP is an action plan answer and solutions are not what the mainstream media is about. They are all part of the government, every last one of them with no exceptions. They want you to play the Republican versus Democrat game, maybe throw in a little tea party as well. Real return to being a Republic is nothing they will every help with. They tell you problems but offer no solutions or methodologies. They want you to think it is hopeless and to know you will get the short end of the stick from the democrats or republicans and there is nothing you can do about it.
Same psychological warfare we talked about earlier. They want you to think it is hopeless and the government is there forever. They describe all the evils and problems and do not offer any advice as to how to fix things. They leave you in despair thinking it is best to obey and hope for the best. The actual talking heads are actors, that just follow orders and do what they are told. They are not the thinkers. They can waste your energy be careful of them.
Summary – Spread the word RAP is in play with the military behind it. Time is short for the de facto government and the Republic is on the way again. Tell others the change is around the corner. Don’t think it is hopeless, let Obama and his gang think it is hopeless so they throw in the towel and go away. Don’t help them with with talk of how futile it is to unseat them. Try talking about how good it will be without them. Be encouraged.

Wow!! This was a good lesson about gold. The amount remains fairly constant in the world, according to the reference. It just changes hands. The outstanding point is that there is just about 161,000 ton in the world at an approximate value of $5.2 trillion. Now, 2 million ton, as alleged, would be approximately 12 times the amount that has ever been mined.
We could conclude that the 2 million ton figure is a figment of imagination. Agree?
Now if we take the dollar value for 161,000 ton –
$5.2 trillion and multiply it times 12, we get a value of approximately $62 trillion on that imaginary 2 million ton. Fantastic!! And this is just supposed to be one of several caches.
It is possible to want something so strongly that all reason is laid aside. Sigh.

The Law of Nations is a subsection of International Law. It revolves around sovereignty and an overall code of conduct for all nations in the world, i.e. common law (jus gentium).
There are two additional parts of International Law. One is Treaty and Convention Law (jus inter gentes). The other is Private International Law which covers private “contractual” disputes and which jurisdiction they fall into.

The first thing we need to do is kill the pernicious concept that the law guarantees equal results or even equal application. This is the major fallacy that runs through jbjd’s work. It is the major fallacy that leads to ridiculous concepts like “racial profiling” – and the fact that you have to process everybody at the airport because it would not be fair otherwise – or that you cannot ask a Mexican for papers to see if they are an illegal Mexican. The law cannot work this way. It is like saddling a donkey with a bulldozer and expecting it to walk.
The key (and only valid) concepts are:
1. Equal Access – nobody is turned away.
2. Equal Process – nobody is judged differently.
Equal Treatment, Equal Results, Equal Experience, are all bogus.

jbjd keeps conflating “commanded to do”, “ministerial functions”, etc. with “allowed to do”. The SOS’s are ALLOWED to do whatever they are not specifically regulated not to do. And if any of them – or any other elected official – swore to uphold the constitution – the are certainly and especially allowed to, duh, “uphold the constitution”!
Further – given the ability to do it – and even a minor suspicion or even one citizen politely asking them to do it – it is malfeasance to not do it. They are servants of “We The People”, not some slaves to some misguided notion of political correctness.
Political correctness is funny when it happens in routine everyday life – far from funny when it sticks it’s nose into the LAW! Remember we are a nation of LAWS, not someone’s ever changing ideas of what is FAIR!

“Support and uphold the constitution” pre-empts such state regulations – which are so filled with assumptions you could drive a truck through.
All we needed was one SOS to demand eligibility certification. Due to your research, they may have eventually been found out for an “oops”. The penalty of which would be to put the candidate on the ballot anyway.
But in the meantime, news would have been made and the public made aware. Under those circumstances, the SOS could be said to have done their best to uphold the constitution. In which case people like me could not succesfully sue them for malfeasance.
You see, jbjd, you are a naysayer and a do nothing. We need POSITIVE ACTION! I have never heard of a lawyer who refused to file a case because they think they might lose. Instead they take a positive attitude and hope to win – even at long odds.

NEW ORLEANS (AP) – A federal judge who overturned a six-month moratorium on deepwater drilling imposed after Gulf oil spill refused Thursday to delay his ruling while the government appeals.
The Justice Department had asked U.S. District Judge Martin Feldman to stay his ruling until the 5th U.S. Circuit Court of Appeals in New Orleans can review it. Feldman rejected that request Thursday.
On Tuesday, he struck down the Interior Department’s moratorium that halted approval of new permits for deepwater projects and suspended drilling on 33 exploratory wells. Feldman concluded the government simply assumed that because one deep-water rig exploded, others were dangerous too….

Citizens never enact laws. Only elected officials are entitled to do so. As the U.S. Constitution is the Supreme Law of the land, any and all federal, state, or local laws that allow the requirements of presidential eligibility to be circumvented are against the Constitution and therefore illegal.
Furthermore, any state that has enacted laws that circumvent any other portion of the Constitution are illegal. The Secretary of State must uphold the Constitution. There simply are no exceptions. If a candidate is found to be Unconstitutional using everyday “common sense”, he or she is required to remove that candidate or demand the candidate to provide suitable proof of eligibility. It is the duty of every SoS to understand Constitutional Law; there is no ignorance nor “passing the buck” because the states told them they did or did not have to act upon preserving it. There is no excuse for neglegence, and there doesn’t have to be a set process in place for a government official to be removed from office for not using the Captain Obvious approach in their every day duties.
All elected officials at every level of government and every citizen of the United States must uphold the Constitution. The duty of a Secretary of State is to ensure qualified candidates are placed on any and all ballots. The qualifications are clear. If they are not, then it’s up to the courts to decide and the SoS is ultimately in the hot seat in any case. If we as citizens can clearly understand the objectives of preserving loyalty to the United States, it should be clear to those in office. Otherwise a low level clerk would be allowed to complete the ballot process instead of a high-level elected state official.
I really am tired of seeing people defend elected officials because the law is not written to spell out simple common sense. When we get to this point, government employees can use every excuse not to follow the law just because there is no “written crib notes” for them to do their jobs correctly and Constitutionally.
Alas, we have reached this point: no accountability for being ignorant, lazy, and ultimately unethical. Graft and corruption set in and our laws become un-enforceable because simple concepts in the law are overlooked because of missing “protocol”.
And I will also add that the common practice of being “better safe than sorry” in the government world has disappeared.
If the secretaries of states actually ensured their candidates on the ballots were eligible, we wouldn’t be having this discussion. Any candidate bumped from the ballot but is eligible can take the Constitutional route and challenge the SoS in court where this challenge clearly belongs.
But instead they all have done great harm to the nation by allowing a biased private organization tell them their candidates are qualified instead of using tools provided to them by their own employer, the state Government, to make good decisions that are appropriate and necessary for the state and the nation we live in.

I would rather adhere to the simple premise that ours is a country of laws and not of men.

There is no case. I don’t mean there is no ‘winning’ case; I mean, there is no case! Name a cause of action. There is none. Against whom? For what? So that you feel less impotent about screwing up your government through inaction?
I took my licks and learned from my complacency. If that makes me negative in your eyes, well, ’tis a consummation devoutly to be wished.’ The rest of us, having taken the time and energy to learn how things work, have felt more positive and empowered. We are not off put by losing our shield of complacency. We are the champions!
Now, our biggest obstacle is teaching others (after we persuade them to stop with the temper tantrums that things don’t work the way they want them to work; and instead to direct their energies to fixing what is broken in a system that relies for its smooth functioning on the willingness of the people to take an active role in that system).

And I will also add that the common practice of being “better safe than sorry” in the government world has disappeared.
If the secretaries of states actually ensured their candidates on the ballots were eligible, we wouldn’t be having this discussion. Any candidate bumped from the ballot but is eligible can take the Constitutional route and challenge the SoS in court where this challenge clearly belongs.
But instead they all have done great harm to the nation by allowing a biased private organization tell them their candidates are qualified instead of using tools provided to them by their own employer, the state Government, to make good decisions that are appropriate and necessary for the state and the nation we live in.

You are not listening to the laws in the states. Several states “entitle” the nominee of the major political party to be printed on the ballot. The SoS, by law, has no right not to print that name on the ballot. And citizens in several states passed these entitlement laws in their states! Plus, most states have no laws even requiring the candidates to be eligible to appear on the ballot! Perhaps this makes sense when it comes to the President because, we don’t elect the President, anyway!
Don’t you understand anything about the laws on the books in your state?
(Next time you scream about S’s oS determining eligibility, please, spell out how this would be done, anyway, assuming, that is, no law currently on the books entitles the Nominee from the party to automatically get on the ballot.)

I haven’t a clue what this means. My comment said, a SoS cannot disobey a law (that says party nominees are entitled to get on the ballot; just because s/he would prefer a different outcome. Is that wrong? Are you one of those citizens who rejects laws with which you disagree; and who marginalizes the majority of citizens who passed those laws? Are you saying, while you believe BO broke the law in order to get onto the ballot; nevertheless, if you were the SoS, it would be okay for you to break the law?

Of course, I assume you filed such ballot challenges, because you already knew by August 2008 how the ballot process worked, right? Perhaps you can post a copy of that challenge.
CC, will you please post a copy of the challenge you filed with the SoS in August 2008 to prevent BO’s name from appearing on the ballot? And, since obviously such challenge was unsuccessful, would you please post a copy of the court filing that followed the refusal of the SoS to grant the relief you requested?

I am fully aware of the election laws of all 50 states and the District of Columbia. Again, the Constitution overrides all state laws, regardless of what’s “on the books”. This is especially true as this is not a state elected official position; it’s a Federal one. I don’t care what the states say is legal when the Constitution is clear.
Most states don’t have any laws on the books for candidates to be “eligible” or “qualified” nor any set process to do so because the Constitution already covers the issue of eligibility for qualified candidates. There is no hole. It is clear. It is concise. It is printed for all to see.
This means:
1. No state has the authority to override these eligibility requirements nor allow the ignorance of them.
2. No state can allow candidates who are not eligible for these requirements to even be a part of the election process as a candidate because they are not allowed to become President.
3. No state can allow electors to vote for any candidate who is not eligible.
It’s clear. No unqualified people allowed. Period. The only interpretation required is when the law isn’t clear and a candidate was actually bumped from the ballot illegally. But we all know this didn’t happen because there was plenty of doubt prior to the election to which these states were more than aware of and nothing was done.
Here’s the problem with the way this is being approached in our broken government. Eligibility means EXCLUSIVE. That means it is assumed nobody is allowed to run for the position of president because they are not qualified first.
What you’re inferring (along with all the folks in the Federal Regime) is that the Constitutional requirements for candidates are all INCLUSIVE and therefore it is assumed everyone is allowed to run for the position of president because they are immediately qualified until proven otherwise.
This is the flaw in what you and the states are saying is “valid” because we must assume all candidates are ineligible first. Then, beyond a shadow of a doubt through proof of eligibility these candidates are found qualified last.
This is a very simple game of logic dating back to the Greeks.
This brings the question of who’s responsible for vetting a candidate? It’s quite simple really. The answer is… the Secretary of State of each state in the Union. Start on the ground floor. Where does the process begin? Answer: the ballot. Who’s putting names on the ballot? Answer: the Secretary of State. Who’s making sure the electoral votes are tallied and counted properly? Anser: the Secretary of State.
It is historical fact that many ineligible candidates have been removed from many ballots in many states by their respective states’ SoS’ due to age, residency, and citizenship status issues. You can literally find 100’s of these in the past 100 years. The states cannot allow a 3rd party to ensure a candidate is qualified because the Constitution only grants the federal and state governments this power during the election process. Nowhere does it say “everyday citizens have the power over the election process”.
There is no ignorance hole these secretaries can hide under. Sorry but you’re the first in line people. If you allow an unqualified person on the ballot, you are setting the stage. You are saying to the state “I accept this person to be qualified”. They can ask for proof of any citizenship, age, or residency they see fit because the Constitution grants them this power. If they don’t, they are libel.
We need to stop pacifying the “not my job” dingalings in office. Sorry, but it is your job, and every court in the federal government will deliberate as such. This fiasco should have never occurred because there were plenty of doubts surrounding it day one, especially with McCain and a foreigner on the ballot. It’s a proverbial “RED FLAG” and courts should see it as such. If they don’t they’re jaded and should be removed from the bench.

jbjd has a very narrow and a very black and white view of the law. This is highly unusual for anybody trained in law. It is well known – even to ‘civilians’ – that the law is complex and inconsistent. You cannot take a single cite and make a case out of it. You have to explore many angles and “push the envelope”. Sometimes an otherwise law abiding citizen – seeking to do what is right – must pick the law (or the interpretation) that supports what they need to do. If that fails, there is even a long-standing tradition of Civil Disobedience.

Here are some examples:
“The Senate is responsible for vetting candidates.”
That’s wrong. Why? Because the election is already over. It would be pretty STUPID if the framers intended this because who wants to re-do national elections???
“The electors are responsible for vetting candidates.”
That’s wrong. Why? Because the primaries are already over. Again, pretty STUPID if the framing fathers wanted to re-do the elections over qualifications.
“The courts are responsible for vetting candidates.”
That’s obviously wrong. Why? Because the judicial branch is not part the election process.
“The parties are responsible for vetting candidates.”
That’s really wrong. Why? Because they do not fall under the jurisdiction of the federal government nor belong to any part of the election process.
Obviously the framing fathers knew that the qualifications had to be enforced. There is only one place to look: the states. And it is very clear the one person who’s ultimately responsible for candidates is the Secretary of State because every state has institutionalized it as such.
Sorry. Game, set, and match. Law of deductive reasoning owns all. SoS… you’re responsible and you are held accountable. And you should raise the issue with the state if you are not empowered to do your job effectively. Otherwise, pack your bags and get out.

For example, what if the desired and chosen nominee that a political party wanted to run in an election happened to be a 3 year old child?
Do you think any SoS in the 50 states MUST print that 3 year old child’s name on the ballot simply because the major political party said “Here is our nominee. This is who we want to be our major political party’s candidate to run in this election!,” and, are you saying there are certain states SoS that have no ability to legally check, validate, verify, and vette a 3 year old, or any person’s legal eligibility, because (1) Their state prevents the SoS from donig this, and (2) An insane politial party decided they wanted a three year old to be placed on a ballot as their major political party candidate?
As far as I know, (please correct me if I am wrong here, but I do not think I am in this case), so I make my case: The political parties DO NOT have legal laws written they MUST verify their party’s candidates as “eligible candidates,” because these snakes all know verifying a candidates legal eligibility is written specifically in the legal job performance duties for a SoS’s to legally perform and maintain as part of their legal job service for their states and for the “safety” of USA American citizens.
That is why Poisonous Viper Nancy Pelosi heinously signed 50 DNC form’s (with the Hawaii form being worded different, on purpose, because she KNOWS that there is NO Long-Form Hawaii hospital generated birth certificate on file at the DoH or anywhere in Hawaii for Barack Obama, because Poisonous Viper Nancy Pelosi absolutel 100% completely knows Barack Obama was born in Mombasa in Kenya, Africa, definitely, and she is covering up for him for the One World Government/NWO and Soros. Trust me I know this.) so Poinsonous Viper Nancy Pelosi signed & stated arrogantly that Barack Obama was in the 50 states legally eligible to be a candidate for USA president since Viper Nancy Pelosi was going to use (if challenged by a lawsuit) that she “trusted and relied” on the legal job performance of the 50 states SoS’s to legally verify, validate, check, and vette the candidates for legal eligibility. That is the Poisonous Viper Pelosi’s legal viewpoint & argument, so that is why she went on a criminal lying spree signing the 50 notarized DNC forms.
Secretary of States have as their legal fiduciary job performance duties to be legally maintain the legal integrity of the ballot, candidate eligibility, voting process, vote counting, candidates illegal campaign donations and other frauds, legality of the votimg machines, the election process, and especially performing the legal duty as SoS’s to verify, validate, check, vette all of the candidates before they are placed on a ballot.
The SoS’s MUST maintain the legality and integrity of the ballot. I know this is where you disagree and this is where your argument is in error. Parts of your legal argument are true. If you can get this into your mind, you see where your idea bifurcates and is legally in error.
Also, your idea that Pelosi can be found guilty for signing notarized forms saying Obama is eligible to be a candidate for the 2008 POTUS is accurate, because by signing those DNC forms Viper Pelosi is guilty of perjuries, massive frauds, aiding and abetting treasons, and obstruction of justice, misprision of felonies, and a multitude of other felonies.
However, I know that Pelosi is planning if sued to use as her defense in her crimes she committed in signing those notarized forms, “The individual 50 states SoS’s have the legal job performance duty to verify, validate, check, and vette all candidates legal eligibility qualifications, and to DEMAND in their discretion to see the candidates in their states legal eligibility qualifications before they are placed on the ballot, so I trusted and relied on the 50 state SoS’s job performances to maintain the integrity of the ballot to verify, check, validate, and legally vette Barack Obama,” and in good faith, I signed the DNC forms relying on such,” washing her hands (she thinks) of her premediated fraud, misprision of felonies, and a multitude of major high crimes and treasons against the American people.
SoS’s must obey the USA Constitution,

duties. SoS’s are the sole LEGAL entity who are held accountable by state laws for assuring and maintaining the integrity and the legality of the ballot, checking, validating, checking, and vetting the
eligibility of a candidate, and maintaining the integrity, and legality of the voting, vote counting, ballot collection, ballot machines, and election process, etc.
Does this make sense to you: An M.D. doesn’t have the legal duty and responsibility to be sure the surgical instrument she/he uses are sterile, and that the patient is stable during the surgery, because it is someone elses duty to do this: It is the anesthesiologist’s responsibility to keep the patient stable during surgery, and it is the ORRN, or the
surgical technician’s duty to maintain the sterility of the instruments?
When the surgeon is working it is the surgeon who is responsibile for maintaining the sterility of the surgical field of the surgical theatre, and for

legally charged by law to be legally responsible for directly overseeing and directly maintaining that American citizens have a safe, stable, legal, ballot with eligible candidates, a legal voting process with legal voting machine, legal ballot counting, legal campaign donations for candidates, and a legal election process.
Saying that in some states that some SoS’s are not charged to maintain legal standards and protocols, is akin to saying an M.D. can come and perform surgery, ignore medical safe standards and protocols and be protected by laws for doing so. Thank God, this is not legally true.
The SoS’s are not limited by their job postition in any way to maintain and protect We The People from ballot fraud, candidate ineligibility, voter fraud, candidate’s illegal campaign donation frauds, illegal rigged ballot machines, illegal ballot counting, illegal ballot stuffing, throwing away, misplacing or losing absentee ballots and not counting them, and other election frauds.
Are you saying some of all state SoS’s laws are corrupt and must be changed to protect We The People from ballot fraud, ineligible candidate frauds, voter fraud, and election frauds, etc.? Do these idiots actually think the people of the U.S. are seeing any sort of recovery? Our nearby city is actually bankrupt. Our roads are crumbling. Jobless rates continue to climb upwards of 22%.
Recovery?? Yeah, right. The grandstanding is coming to a close here soon. People simply won’t stand for it much longer before things start to really boil over.

No one here is advocating anarchy. The Declaration of Independence states that We The People can legally abolish our government when our government becomes a tyrannical anarchy.

Somehow I don’t think our free expression is doing much of anything at this point. Harsh reprimands of the existing corrupt government has gone unheard and nobody seems to care.
That’s the sign we don’t have any representation at the federal level. It’s a good thing our state governments are in the same boat as we are. Otherwise things would be a lot more ugly as they are now. I’m seeing massive movement at many state levels. One merely has to visit one’s state legislative web site to see all the interesting bills that are being presented and passed to protect themselves from the tyranny.

Financial conditions appear to have worsened substantially in recent quarters based on our update of the broad index of US financial variables presented earlier this year at the US Monetary Policy Forum. In the wake of recent developments in Europe, increased stress in financial markets has pushed that index halfway back to its immediate post- Lehman crisis lows.

We’ve been in an all-out depression since late 2007 which will continue until at least 2017 at this pace, perhaps longer if we don’t do something drastic by January 2011, like kick everyone out of the federal country club swimming pool.

Hang in there Starla. You are on the right track. You have to REASON through these things.
JeffM posted a couple of good examples of that today. He starts at the beginning, walks systematically through the points, and arrives at a conclusion.
And, well reasoned or not, none of us will ever agree with jbjd as long as she bases everything on the doctrine of “If it is not explicitly spelled out in a regulation you cannot do it” – also seasoned with a dose of the Political Correct nonsense of “equal application” and “equal results”.
I strongly believe that the US will be experiencing economic problems as long as Soetoro is occupying the WH,and in all probability even after he is gone . It could require u 10 years or more for the US to regain a viable economic base. Whether it was George Bushe’s fault or Soetoro’s fault, I personally believe that we will be plagued with economic stalemate for many years to come. I think that unemployment will remain at about 10% or greater for years,as well. Until small business has some sort of positive outlook,it is doubtful that anyone will attempt to expand their businesses. It would not surprise me to learn that at least half of American small business are leaving the country.
