Here is the latest update December 7, 2009, from Lt. Col. Donald Sullivan, plaintiff in a lawsuit against North Carolina Board of Elections, and Elaine F. Marshall, Secretary of State For North Carolina. Following the update is a copy of the lawsuit.

RE: Obama Eligibility

12-4-09: Hearing on Plaintiff’s motion to amend, alter or vacate Judge Cobb’s order of October 10, 2008, dismissing subject lawsuit with prejudice.

Judge Cobb called the case for hearing at 11:00 AM. Present were myself and Brandon Truman, Special Deputy Attorney General, for the Defendant. I made my statement in support of my motion to delete the words “with prejudice” from the order dismissing the case. I wanted this done because my filing of the second complaint against Obama’s eligibility included as defendants both the secretary of state and the board of elections. The “with prejudice” made any future complaint against the secretary of state filed by me, including mine, moot “res judicata”.

I argued that the case had been dismissed, not on its merits, but on procedural arguments from the State. I argued that the order had been drafted by the State’s attorney at the request of the judge, and that the term “with prejudice” had not been the subject of any discussion during the hearing on the complaint. Further, the Rule governing dismissals makes it clear that dismissals for procedure in first complaints typically are considered to be without prejudice unless otherwise noted. Such a dismissal on a second complaint in the same matter is typically “with prejudice”. This was my first case in the series. I had no way of knowing whether or not the attorney put those words into the order or if the judge had done that himself; since I was not given the privilege of reviewing the proposed order prior to its being given to the judge. I also made a “point of order” on the court’s not being properly set, since, upon information and belief, the State’s attorney did not have a proper oath of office. I did this without argument, just for the record.

The State’s attorney responded that he did not recollect adding that language to his order, but he might have. He just couldn’t be sure. He argued that the case was not only dismissed on procedural errors, but also due to the fact that the Secretary of State has no statutory duty to do that which I requested the court to order her to do. He also introduced the dismissal order from my second Obama case showing its mootness since Obama had already been inaugurated. I objected to that order as being irrelevant to the instant case, but the judge allowed it.

I responded that I agreed there was no statutory duty of the Secretary to do as I requested, but that there was a higher, constitutional authority to do so.

Judge Cobb denied the motion, telling me in no uncertain terms that it was he who put the words “with prejudice” into the order. I had told the State’s attorney I would not appeal this ruling prior to the hearing. I will put all my effort into Obama II. The denial in this case means the second case will lose the Secretary of State as a defendant, leaving only the Board of Elections to carry the ball. Again, the only argument in that case is the constitutional duty also. I have a hearing being scheduled for later this month or early in January to hear a similar motion to amend, alter or vacate the dismissal order from last March, 2009. It will be heard by Judge Osmond Smith III out of Caswell County.”

NOTICE AND DEMAND

Now come I, Lt. Colonel Donald Sullivan, Plaintiff, on behalf of myself and all others similarly situated, pursuant to Rule 59(a)(7), (8) and (e) and Rule 60 (b)(2), et seq., to notice and demand this court vacate, amend or alter its final order “signed” March 16, 2009, but dated October 2, 2009, and received by me on October 6, 2009, dismissing this action. This demand is based upon the newly discovered evidence infra, and upon the sworn duty of this court to “support and maintain the Constitution and laws of the United States” (Art. VI, Section 7, NC Const.).

STATEMENT OF THE CASE

On November 7, 2008, and on behalf of all those similarly situated, I filed a class action complaint in this instant matter with the Pender County Clerk of Court demanding injunctive relief in the matter of the citizenship of Barack Hussein Obama, Jr., his eligibility to have been a candidate on the North Carolina ballot for the office of President of the United States of America, and his eligibility to hold the office of President of the United States of America. Defendants moved for a change of venue to Wake County; Motion was granted December 1, 2008. I filed in this action a Notice and Demand for a TRO on November 26, 2008, to prevent the NC Board of Elections from certifying the vote for the offices of President and Vice-President of the United States until the defendants had certified the eligibility of Barack Hussein Obama to hold the office of President of the United States under Article II, Section 1. The Honorable R. Allen Baddour, Jr., presiding Superior Court Judge, denied said motion for TRO on December 15, 2008. On December 19, 2008, Defendants filed a Motion to Dismiss my complaint in its entirety pursuant to Rule 12(b)(1) for lack of subject matter jurisdiction due to mootness, res judicata, and lack of standing; and pursuant to Rule 12(b)(6) for failure to state a claim upon which relief could be granted. I filed by mail a Motion to Amend my Notice and Demand for Injunctive Relief on December 19, 2008, seeking to add as defendants the Governor and the General Assembly, delete Para. 8.7, and delete the attachment of the claims for relief to the timing of the inauguration of the President, since the unreasonable and calculated court delays in this matter had rendered that element moot (A demand for injunctive relief being an extraordinary remedy which is normally heard immediately rather than being handled routinely as in the instant matter). On January 19, 2009, I filed a Notice and Demand for Class Certification seeking to represent all voters of North Carolina. Hearing was held on March 16, 2009, on the defendantÕs Motion to Dismiss and my Motion to Amend. On September 16, 2009, the attorney for the defendant e-mailed for my review a copy of the proposed order dismissing my case and denying my Demand. On September 21, 2009, I submitted my Objections to the Proposed Order by return e-mail. The subject order dismissing this action was issued by the Honorable W. Osmond Smith, Jr., on October 2, 2009, and dated March 16, 2009, for lack of subject matter jurisdiction and failure to state a claim upon which relief could be granted. The final order contained no changes from that originally proposed.

PRESENTATION OF NEW EVIDENCE

The following is a statement of newly discovered evidence which was not available to me prior to the hearing on the defendants’ Motion to Dismiss and which was unknown and unavailable to me at that time:

1. A syndicated report by the Associated Press, published Sunday, June 27, 2004, by the Kenyan Standard Times and available in their electronic edition for that date at http://thepostnemail.wordpress.com/2009/10/14/ap-declares-obama-kenyan-born/ . The article, though well concealed by Google, may also be found posted at http://web.archive.org/web/20040627142700/eastandard.net/headlines/news26060403.htm The AP reporter stated the following:

“Kenyan-born US Senate hopeful, Barrack Obama, appeared set to take over the Illinois Senate seat…” (Emphasis added).

One would expect that an AP reporter is too professional to submit a story which was not based on confirmed sources (ostensibly the Obama campaign in this case), the inference seems inescapable: Obama himself was putting out in 2004 that he was born in Kenya. This article was not refuted by the Obama camp. Further, during that same campaign in 2004, Mr. Obama, for the record and in response to Mr. Alan Keyes’ statement that Obama was not a Ònatural born citizenÓ, stated in quick retort, “So what? I am running for Illinois Senator, not the presidency”.

2. On September 4, 2009, an Affidavit was filed as evidence in a federal case with the United States District Court in Santa Ana, California, by Mr. Lucas Smith. In this affidavit, he certified the legitimacy of a certified copy of a Kenyan birth certificate for Barack Hussein Obama, Jr., which he had personally obtained from Kenyan records. A copy of this birth certificate was filed concurrently with the affidavit, including a baby footprint, for the man who is currently referred to as President Barack Hussein Obama. The document is a legal affidavit that declares Lucas Smith to be of sound mind and judgment. Lucas Smith could go to jail if he lied on this affidavit.

3. On November 24, 2008, the following excerpts from an article by Chelsea Schilling appeared in the World Net Daily:

“A radio interview with Kenyan Ambassador Peter N.R.O. Ogego has been widely publicized since the ambassador called President-elect Barack Obama’s Kenyan birthplace a ‘well-known’ attraction – but the embassy is now telling WND the hosts misunderstood his comments.

“On Nov. 6, only two days after the election, Detroit radio talk-show hosts Mike Clark, Trudi Daniels and Marc Fellhauer on WRIF’s ‘Mike In The Morning’ called the Embassy of Kenya in Washington, D.C., to speak with Ambassador Ogego.

“The radio hosts were surprised when their light-hearted interview with Ogego reignited suspicions that Obama may have been born in Kenya.

“An assistant to the ambassador, referring to herself only as ‘Trudy,’ confirmed today that Ogego had indeed participated in the radio interview. But she said the show made leading statements and took the following comments out of context:

‘Clark: “We want to congratulate you on Barack Obama, our new president, and you must be very proud.”

‘Ogego: “We are. We are. We are also proud of the U.S. for having made history as well.”

‘Fellhauer: “One more quick question, President-elect Obama’s birthplace over in Kenya, is that going to be a national spot to go visit, where he was born?”

‘Ogego: “It’s already an attraction. His paternal grandmother is still alive.”

‘Fellhauer: “His birthplace, they’ll put up a marker there?”

‘Ogego: “It would depend on the government. It’s already well known.'”

…”‘If you listen to the call in its entirety, you will find it was very obvious we were all talking about President-elect Barack Obama and not his father,’ Clark said.”

4. Here’s what it says at Obama’s web portal, Fight The Smears:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United KingdomÕs dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.’s children.”

(Emphasis and italics added.)Obama is telling us himself that his status was “governed” by a foreign jurisdiction. This is no theory. This is a fact. Like it or not, rich or poor, great or strong, Democrat or Republican, Obama was born under the jurisdiction of Great Britain via Kenya. There is nothing conspiratorial about saying that. Obama has it posted on his own web site. So, even if we accept that Mr Obama was born in Hawaii of a black Kenyan father and a 17-year-old white American mother, his citizenship is and constitutional eligibility for the presidency is still in question, since he is either a Brtish or Kenyan by birth, not an American. His American citizenship has never been confirmed or reinstated.

5. A letter dated 2 Februrary, 2009, from Michael Angelus to US Senator Maria Cantwell (D., VA) submitted four attachments including the following:

A. The actual text of the THIRD CONGRESS in 1795;

B. The actual text of the FIRST CONGRESS in 1790;

C. The actual text of the Constitution from the Continental Congress and the Constitutional Convention, 1774-1789;

D. The actual text in a January 26, 2009 letter issued by United States Senator, Mark R. Warner.

Mr. Angelus also went on to include, Òand we also witness the apparent denial in the current United States Congress to address the phrase “natural born citizen.”

The purpose of the letter is to define what the Congress has concluded “natural born citizenship” to mean. Mr. Obama fails each of these tests for being natural born as required by Article 2, Section 1.

6. Upon information and belief, as one of his first acts as the newly installed “President”, Mr. Obama issued an executive order which sealed his personal papers, documents, records, transcripts, etc. from public scrutiny.

CONCLUSION

Therefore, because of the sworn duty of this court “to support and maintain the Constitution and laws of the United States”, and pursuant to the provisions of Rule 59 and Rule 60, supra, this court has the subject matter jurisdiction and the authority to grant the relief I am requesting based upon the new evidence herein provided, to vacate or alter the order of the court dismissing my complaint for injunctive relief and force the State of North Carolina, in the form of its elected and appointed officials, to properly and adequately protect the combined citizens of this State from an unconstitutionally elected chief executive of the United States; or, in the alternative, to confirm that Mr. Barack Hussein Obama, Jr., is indeed eligible to hold that office. Each of these elected and appointed officials, including this Honorable Court, has taken a solemn oath to do no less.

Any act repugnant to the Constitution is void ab initio. It carries no authority and creates no law. We learn this the first week of law school. Ignorance of the law, therefore, does not apply in this matter. I demand this court do its duty to the People, to this country and to themselves and confirm the constitutionality of the Obama “Presidency”. We have seen already the unintended consequences of enthroning an apparent imposter. There will be more unless we all do our duty. Honor requires no less.

I think what Obama is doing, not only tinkering around with but trying to change so many fundamental areas of our society, such as Cap and Trade and Health Care for starters, is like some mindless person tinkering around in their computer’s registry without really knowing what they’re doing. One little slip up, and the computer is history. I believe Obama is in a similar situation. If he pushes this system too far, and tries to tinker with parts and go where we’ve never gone before, well, I believe that there will be a cascading effect of disaster. It may take years, maybe decades to undo the damage. This is the scariest time I’ve ever lived it. We’ve got to move toward some time of sanity on this. Obama and the Dems are plain crazy and dangerous to boot.

Maybe I am just old and a little undereducated, but something I do not understand is, with the economy the way it is, WHY is congress doing everything they can to cause us (the citizens) to have less to live on or with? Why can’t most of this crap wait until the economy improves and then we “might” be able to support some of it.

As long as Barry Sotoero remains in office, I don’t believe there is a single judge with the strength of character to hear the case on merit and demand Barry produce his documents. When all this first came forward with Phil Berg’s case August 21, 2008, I was so naive. I whole heartedly believed in the American jucicial system–especially the holiest of holy–the Supreme Court. I am now convinced they are all corrupt.

If and when Barry is no longer in office–providing he doesn’t simply declare a dictatorhip and plant himself permanently in the WH(which I fear this is where they are heading), then we might find an honest judge willing to hear the case. Yes, even after he leaves office–if the issue of his eligibility based upon citizenship is not resolved–it is imperative we continue pursuing it. Some time between now and the future,, Barry Sotoero must be held accountable and produce his documents.

All the dismissed law suits, the pending ones, and the future ones are not in vain. These law suits challenging Barry Sotoero’s credentials–on any level are among the most necessary patriotic processes going in America today. They are documented public records for all of history to know. These documents are recorded witnesses to America’s suspician and efforts to demand the president of the United States to stand up or step down. They are precious documents filled with proof regarding the lack of integrity of our current judicial system. They are part of our history that will tell the other side of the story.

As it stands now–America–the America we used to know when we exclaimed–“This is America. It can’t happen here!” has been stolen from us right before our knowing eyes. We still do not have a grasp upon the “new America.” You can be certain it is not one that will make Barry Sotoero legally accountable for his usurpation.

I find it incredibly difficult to believe that ALL our judges are “bad”. It would even be hard to imagine that half of them are bad. In which cas – just by the law of averages – one of them should have taken on one of these cases by now.

Or even where jurisdiction or standing were real issues, they could give better assistance to moving up the chain. SIGH.

I also thought our Constitution in all its implications was sacred. We elected people that we entrusted with our Constitution for all our citizens.
Now my questions are: In the media, who can we trust? Is all news managed?, adjusted?, twisted, manipulated?, corrupted?
Is there anyone in government who took an oath to defend the Constitution capable of respecting their oath?
When those who were bought/sold out right purchased, did they forsake their country cheaply or did they hold out for big bucks?
Obama may have not done much, which is all he capable of doing, but if his intention was to sew seeds of doubt in every aspect of our government, he has succeed far more than anyone can imagine.

The country is bankrupt, unemployment is 58%
Senior citizens are dying by the thousands everyday, and the 100 million of us that know he’s not eligible show up to enforce the law ourselves….with force if necessary.

Then finally, when the country is a third world nation, ate up with H1N1, Bubonic Plague, etc. they will listen.

In yesterday’s New York Times, there was an article about White House social secretary Desirée Rogers. In it, reporter Sheryl Gay Stolberg wrote: “When former social secretaries gave a luncheon to welcome Ms. Rogers earlier this year, one participant said, she surprised them by suggesting the Obamas were planning a ‘non-religious Christmas….’”

This same participant said that “the Obamas did not intend to put the manger scene on display” (this was confirmed by the White House). Indeed, as Stolberg wrote, “there had been internal discussions about making Christmas more inclusive and whether to display the crèche.”

Catholic League president Bill Donohue addressed this issue today:

Unlike almost all Americans—including atheists—the Obamas do not give their children Christmas gifts. We know this because Barack bragged about this last year to People magazine. So it should come as no big surprise that he and his wife would like to neuter Christmas in the White House. That’s their natural step—to ban the public display of Christian symbols. Have any doubts? Last April, Georgetown University was ordered to put a drape over the name of Jesus as a condition of the president speaking there.

If the Obamas want to deprive their children of celebrating Christmas, that is their business. It is the business of the public to hold them accountable for the way they celebrate Christmas in the White House. We know one thing for sure: no other administration ever entertained internal discussions on whether to display a nativity scene in the White House.

under the ever-increasing pressure of the ObamaCare debate…
This is music to my ears!

As our countdown clock winds down to our Thursday morning petition
delivery–when EVERY senator will receive our petitions urging
opposition to ObamaCare, I fully expect the pressure Harry Reid
is feeling to reach a near boiling point…

especially considering that we have already SHATTERED our petition
delivery goal of 750,000!

I must admit there was a moment of celebration in our Grassfire
offices when we learned today that 779,489 citizens are standing
with us in opposition of ObamaCare–with hundreds more still
rushing to sign.

I’m absolutely humbled by your amazing efforts to rally and
mobilize citizens to take action. In fact, since November 30–
less than a week ago, more than 100,000 citizens have joined
our cause!

But one question remains…

Can we rally an additional 70,000 citizens by midnight Wednesday
pushing our total to 850,000?

Numbers that significant could cause Harry Reid to jump on his
mule and head back to the Nevada desert!

Seriously speaking, we have an opportunity to
drive a stake into the heart of this ill-conceived ObamaCare
plan later this week, and I’m calling on our incredible team
to help me push our petition totals to 850,000.

The White House confirmed to the Times that there had been internal discussions about making Christmas more inclusive – but in the end – tradition won out – and the Nativity scene is once again in its traditional East Room spot.

But, it occurred to us how marvelously the Left’s online tricks can be used against them — but with a twist.
Currently, we are seeing Independents abandoning Democrats in droves on a national level. They are doing this because Dr. Utopia promised to be a centrist Democrat in the campaign (even though none of us believed him) but ran to the far Left the day after the election. Independents left the Clintons in 1992 during their first term as well, because they felt the Clinton adminstration was too far to the Left (and boy, in comparison to what’s going on today, doesn’t that make people shudder).
What needs to happen is this:
(1) We need to concern troll the concern trolls; go on their sites, pretend to agree with everything Dr. Utopia stood for in the campaign, and just put it out there how disappointed we are that he’s not being Liberal enough. Propel the meme that “this is not what we were promised!”
(2) Lunatic fringe groups like Code Pink and Moveon.org need to be revved up — make them go after Democrats they don’t think are Liberal enough…get them to force every bad Democrat out there into being MORE Liberal than they are now. Have these nuts drive people like Barney Frank, Harry Reid, Nancy Pelosi, Pat Murphy, John Murtha, and other BONKERS.
(3) Do everything possible to encourage the far Left to throw all their chips in, right here right now. Make the biggest push to the Left this country has ever seen…and make sure Independents see what is going on.
If Independents are driven away by too much Liberalism, and if we can stoke the Left into being as Liberal as possible, then 2010 will be an epic disaster for Democrats — who, after the way they behaved in 2008 and are behaving now, deserve to lose big.
Instead of concern trolling to dampen their spirits, which is what they did to Hillary and McCain supporters last year, we should troll to pump up their most Liberal firebrands…so those nuts can kamikaze the entire DNC with their zealotry.

The expedited trial has been set for Jan. 26, 2010!

Many concerned veterans and citizens attended
the hearing in Federal Court in Santa Ana in the lawsuit against Barack Obama to determine his eligibility to be President and Commander in
Chief. About 150 people showed up, almost all in support of the lawsuit to demand that Obama release his birth certificate and other records that he has hidden from the American people.

Judge David Carter refused to hear Obama’s
request for dismissal. He indicated there was almost no chance that this case would be dismissed. Obama is arguing this lawsuit was filed in the wrong court if you can believe that. Obama would prefer a “kangaroo court” instead of a Federal court! Assuming Judge Carter
denies Obama’s motion for dismissal, he will likely then order expedited discovery which will force Obama to release his birth certificate in a
timely manner (if he has one).

The judge, WHO IS A FORMER U.S. MARINE, repeated several times that this is A VERY SERIOUS CASE which must be resolved
quickly so that the troops know that their Commander in Chief is eligible to hold that position and issue lawful orders to our military
in this time of war. He basically said OBAMA MUST PROVE HIS ELIGIBILITY to the court! He said Americans deserve to know the truth about their President!

The two U.S. Attorneys representing Barack Obama tried everything they could to sway the judge that this case was frivolous, but Carter would have none of it and cut them off several
times. Obama’s attorneys left the courtroom after about the 90 minute hearing looking defeated and nervous.

Great day in America for the U.S. Constitution! The truth about Barack Obama’s eligibility will be known fairly soon – Judge Carter practically guaranteed it!

Those responsible for “arraigning” our SEALS for apprehending and halting a terrorist have indicted themselves of gross misconduct, if not treason. They have rightly earned the contempt of our entire country.

Again, o. is flaunting his power over our military in front of the entire world. Now America is on trial . . . . for crimes against his brothers, the poor terrorist “freedom fighters.”

Does anyone know the names of the judges who did the arraigning of the SEALS?

I’m glad a fund has been set-up to offset legal fees. Hopefully, America will express our outrage – loudly and long — over this injustice.

I have read her book Going Rogue. In this book she comes across as someone who is possibly seeing the world thru rose colored glasses. Believe me I never expected her to show a shaded view of the world. While I admire her candor, and her obvious strength of character it is the primary reason why I say that she needs to be exposed to the REAL ways of government. Much of our government’s true color is STILL hidden from the public. I know that if she sees it FIRSTHAND she will know exactly how to handle it. But nonetheless she needs to see it firsthand,and get involved to really have her feet on the ground,and know what is really going on. This is why I think that she needs to be POTUS via the US Senate. Coming from the Senate will double her clout with regard to her public following. There is still an extremely torrid Liberal base that she will be up against. While her state level experience is fine, she needs to acquire an “upper classman”polish that she lacks at present. If you are to verbally take on the English majors of the Senate you must be articulate enough yourself to handle the best of them,and verbally force them to recognise that they are dealing with someone who is as polished as they are,and can put them in their place anytime she chooses. That is what I believe she needs to be able to do. At present I simply think that she has yet to demonstrate that she can handle the likes of the “upper classmen”if you will. When she can handle them she will also possess the ability to handle the people from around the world who say one thing, but mean something else. These are some of the most devious people of all. Anyone who talks to these people needs to have an extra set of eyes inside of them, and sees the truth of their statements. Some of the alleged foreign leaders are also some of the world’s worst liars. Anyone who they are talking to must be able to see through them instantaneously. Browbeating someone is an artform,and I think that Sarah needs to learn this art. If she can handle the world’s best liars, she will be ready to become POTUS.
Please consider what I have said as my own personal view point. Over a lot of years I have witnessed people who failed simply because they were not articulate enough to get their point across to people who live in a domain which is dominated by “language arts”,and who are unwilling to relinquish even one inch of ground to accomodate others. These are the sort of people who Sarah will be up against,and I think it is vital that she get her feet wet in the US Senate befor moving on to pursuing the POTUS. I think that her constituents will feel the same way. Like me they don’t want to see her lose an election just because she wasn’t articulate enough to verbally beat up a political foe. That was a McCain failure as well. He simply could not think fast enough on his feet. If we are to ever reinstate truth,and honesty back into Government it must begin in the Heart. This is why I believe that Sarah would win in a landslide. Most Americans are astute enough to see her virtues. She is a very unusual person. I truly stand behind her.

Obama Signed Resolution Describing Him As Ineligible

This is an oldie, but it needs to be revisited, since the Obots still argue that Obama is eligible to serve as Commander-in-Chief.

On April 10, 2008, Sens. Patrick Leahy (D-VT) and Claire McCaskill (D-MO) introduced a resolution expressing the sense of the U.S. Senate that presidential candidate Sen. John McCain (R-AZ) was a ‘natural born Citizen,’ as specified in the Constitution and eligible to run for president. Sen. McCaskill knew Obama was not a U.S. Citizen, that’s why she introduced this bill — dressing it up to look like it was in Sen. John McCain’s cause.

It was during the bill’s hearing that Sen. Patrick Leahy, Chairman of the Senate Judiciary Committee, made the following statement:

“Because he was born to American citizens, there is no doubt in my mind that Senator McCain is a natural born citizen,” said Leahy. “I expect that this will be a unanimous resolution of the Senate.”

At a Judiciary Committee hearing on April 3, Leahy asked Homeland Security Secretary Michael Chertoff, himself a former Federal judge, if he had doubts that McCain was eligible to serve as President.

“My assumption and my understanding is that if you are born of American parents, you are naturally a natural-born American citizen,” Chertoff replied.

“That is mine, too,” said Leahy.

What’s interesting here is that Sen. Leahy, the Chairman of the Senate Judiciary, confirms that a “natural born” citizen is the child of American citizen parents.

Parents — that’s two. That’s BOTH parents.

Every time the words, “citizen” and “parent,” are used by Sen. Leahy and Sec. Chertoff, the plural case, “citizens” and “parents,” is used. The plural case is the operative case.

It is Sen. Leahy’s opinion — his own recorded words, in a formal Senate Resolution and on his U. S. Senate website — that Barack Obama is not a “natural born” citizen, and therefore not eligible to serve as Commander-in-Chief, regardless of his birthplace.

Obama had one American parent –singular — his mother. His father was a citizen of Kenya, and a subject of Great Britain.

Obama, himself, “at birth,” was a citizen of Kenya, and a subject of Great Britain — he says so on his own campaign website. This fact introduces the concept of “divided loyalties,” — the reason the founders created the eligibility requirement in the first place — a fact that further underlines Obama’s ineligibility.

The source of this information is Sen. Leahy’s own website. The webpage contains a statement about the resolution; the resolution, itself; the Statement Of Senator Patrick Leahy (D-Vt.); and an excerpt of Sec. Chertoff’s testimony.

The plural word “parents” is used four times. When used to identify the parents, the word “citizens” is used five times. That’s nine times that Sen. Leahy, on his own website describes the eligibility requirement. There is NO PLACE in any of these four documents where the singular case of “parent” or “citizen” is used.

The real purpose of this bill was to change article II, section 1, clause 5 of the Constitution of the United States with reference to the requirements of being a “natural born citizen” by the Democratic Party leadership — paving the way for an Obama run.

Both Leahy and Chertoff avoid addressing the “in the US mainland” (jus solis) element of the eligibility requirement and focus solely on parentage (jus sanguinis) in making their arguments and by doing so bring focus to the fundamental reason Obama is not qualified. He had one American parent and one foreign parent. Barack Obama is not a natural born citizen — no matter where he was born.

Obama is a co-signer of this resolution. So, I guess he too agrees that one needs two American parents to be eligible for POTUS — except he doesn’t care — after all, he’s the Obamamessiah. Rules don’t apply to him.

Below is Chertoff’s present information and contact…..I just got off the phone with his secretary…..she says he is out of town today but I told her I wished to get his take on “natural born” citizen seeing as his discussion with Senator Leahy points to his belief that you must be born to two citizens of the US to qualify for POTUS….as a former Federal Judge this is significant because it means the definition of “natural born” at least by some judge’s means ……born on US soil to 2 US citizens…..she is going to give him my phone number when he returns and we’ll see if he calls me….if not I will call him again in the near future….until then I will be on Leahy’s case about the conversation he had with Chertoff concerning the eligibility of McCain!!!

In my neck of the woods (AZ) I know MANY folks who voted for Obama. I knew something was up when they all stopped talking about him—cold turkey–within the first couple of months of Obama’s inauguration. Before the election, these folks wouldn’t shut up about his wonderfulness. But after the election, they stopped talking, but they are silent no longer. They cannot believe what is happening. And they are being extremely vocal about their disgust about what this man is doing to our country. I know that hate is a strong word, but most of these Obama voters now use the word in association with their feelings about Obama.
I also visit Los Angeles quiet frequently. Before the election, and for a few months afterward, it seemed as if every other car on the road had an Obama/Biden bumper sticker on it. No longer. The last time we were there (over Thanksgiving) my husband and I drove miles and miles on the freeways before we came across a single car displaying support for Obama.
Americans are waking up and they don’t like what they are seeing. 2010 cannot come soon enough.

Morning, Linda,

I do vote in primary elections and I will be at the polls after work tonight with my **birth certificate in hand** to vote in this special election.

I am ‘Unenrolled’ so I can request either the Repub or Dem ballot as I choose.

Whenever I request a Repub ballot, the old-time poll workers always give me the stink eye, so when they do it tonight, I’ll be MORE THAN GLAD to present my birth certificate.

I’ll probably make the local paper for doing that because not much happens in this little border town and this will be NEWS!

Just had a conversation with a staffer in the Judiciary committee dept……they are all morons….didn’t even know what the 511 resolution is….Unbelievable…..and you can’t talk to Leahy because he is too busy trying to pass health care……I let her know it will be NULL and VOID and they are not only wasting their time but our tax money as we….!! Our illustrious ‘Governor’ changed the rules so that he could *appoint* Paul Kirk temporarily; Kirk is a Kennedy clone and the stipulation was that he *cound not* run for the permanent seat in the January special election.

Today is the primary to narrow down the field to two.

All indications are that the candidates will be Martha Coakley (D) and Scott Brown (R) facing off on January 19.

Linda….I’m not afraid of these fools….I have knowledge on my side….the MORON I spoke with didn’t even know the FRAUD spent millions keeping his documents hidden….she argued that several people have seen his BC….I asked who….of course she couldn’t answer that one because the answer is NO ONE has!!! I am listening to BECK now….he is talking about Creamer….the convicted felon who works in the White House now and was at the State Dinner of the Gate crashers…..he wrote a book in prison which Axelrod declares is the blueprint for passing the death care bill…..Glenn says the 10 points he discusses in the book have already been realized by the progressives and they are using this to cram through the immoral and corrupt bill!!!

Governor Cadillac Deval Patrick wanted Kirk in in the Senate (albeit, temporarily) to vote for this pig of a bill, which he did.

If the sheeples in this state can see their way clear to defeat the Progressive Attorney General Coakley and vote in the Conservative Brown, we may have a shot at turning this pathetic state around on January 19.

One of my girlfriends sisters had a baby out of wedlock, and she was so mad at the guy-see you bye at the announcement of the pregnancy, when it was time to do the birth certificate he was listed as father unknown. They both knew they were the parents, years later they developed a better relationship for the sake of the child.

Jacqlyn Smith @12:01 baby all grown up now. He was a guy from the neighborhood so the news travelled fast. When the boys father heard what he did he got so mad he called his son “the scum of the earth” for abandoning this child. The baby was raised by her at her mothers house with much support from the family. She did not want the childs father bugging her in any way shape or form. When the baby got to be 9-10 naturally the question came up, why do all the other kids have fathers and I don’t? Not long after that-the father started showing an interest in his son, but he knew not to interfere. Worked out in a fashion.

I have read her book Going Rogue. In this book she comes across as someone who is possibly seeing the world thru rose colored glasses.
