JBJD, interesting discussion over at your site. I believe some real legal breaktroughs may be forthcoming, especially on the issue of using the COLB as a statement of presumed truth via Fight the Smears and other public websites which now makes that action available to average citizens to, in effect, “take a look for themselves” since they (OBama and his group) offered it up in that spirit. No wonder they pulled the website off the web. They probably realized, too late, that they screwed up and left open legal avenues to explore that they know in hinsight was a mistake.

A relative who has been very critical of Obama on the internet was notified that she is being audited by the IRS. Surely there is no connection!
Several years ago I wrote a Letter to the Editor criticizing my Representative, Richard Gephardt. The newspaper printed the letter and several months later my husband’s business was audited by the State. Surely there is no connection!
Why is the Social Security number fraud not being investigated? I thought SS# fraud was serious . . . maybe, I’m wrong.

TRANSMIT LETTERS ROGATORY PURSUANT to
28 U.S.C. §§1781(a)(2)-(b)(2)
The undersigned counsel for Plaintiffs has acquired possession of a color copy of one certain document (attached as Exhibit A to this motion), regarding which there are no ready means of authentication except by recovery of the original document. As should be apparent from the nature and content of the document, if authenticated, and shown to be genuine, the contents of this document will significantly narrow and shorten the discovery and pre-trial litigation period necessary in this case, and might lead to an early resolution by settlement or transfer of these proceedings to the United States House of Representatives and Senate according the procedures outlined in the Constitution.
It is also apparent (and hearsay evidence available to Plaintiffs’ counsel aggravates her concerns) that political pressure may be brought to bear to destroy all relevant evidence, whether such evidence exists within or outside the borders of the United States of America.
It would appear to the undersigned counsel that either 28 U.S.C. §1781(a)(2) or 28 U.S.C. §1782(b)(2) or some combination of these statutory authorizations outlines the procedures by which to transmit letters rogatory and other requests to the proper authorities abroad in Kenya and the United Kingdom of Great Britain and Ireland.
For two classes of evidence at issue here, namely all requests for relevant passport materials and other documents existing within the United States of America, as well as all requests to be made through diplomatic channels to foreign tribunals, Defendant HILLARY RODHAM CLINTON is the Secretary of State of the United States of America, and accordingly, Secretary Clinton is the first and primary proper target of letters rogatory to be submitted pursuant to 28 U.S.C. §1781(a)(2).
FIRST, Plaintiffs pray that this court authorize Plaintiffs to issue a special subpoena for deposition duces tecum to Secretary HILLARY RODHAM CLINTON be cited to appear within 21 days pursuant to (or in the letter and spirit of) Rule 27 of the Federal Rules of Civil Procedure (even though this action has been filed and served, many months will pass before the Rule 26(f) Conference can be held to plan for discovery among the parties). The purpose of Rule 27, even though designed for pre-filing discovery, is fulfilled and relevant here, in that some (above-noted) hearsay evidence exists that an individual involved in the examination of passport files at the United States Department of State relating to and involving certain 2008 Presidential candidates may have been killed in relation to such inquiry. Last year it was announced by former secretary of State Candoleeza Rice that there was tampering with the passport records of three major presidential candidates and it was investigated by the inspector general. Lt. Querl Harris was one of the suspects in passport tampering scandal. Washington post has announced that he was cooperating with the FBI and shortly thereafter he was found dead, shot in the head, sitting in his parked car. This case remains open and unresolved. Under such circumstances, “perpetuation of evidence” becomes a more and more significant and time-sensitive issue.
SECOND, Plaintiffs pray that this court will send a request for letters rogatory pursuant to 28 U.S.C.§1781(a)(2) to Defendant HILLARY RODHAM CLINTON and other relevant officers in the United States Department of State to issue and transmit letters rogatory through proper diplomatic channels to the following foreign offices of public record and vital statistics:

SPECIAL MOTION FOR LEAVE TO CONDUCT PRE-RULE 26(f) DISCOVERY
TO DEFENDANT HILLARY RODHAM CLINTON and
CERTAIN NON-PARTY WITNESSES
TO PERPETUATE TESTIMONY, PRESERVE EVIDENCE, and to
TRANSMIT LETTERS ROGATORY PURSUANT to
28 U.S.C. §§1781(a)(2)-(b)(2)
The undersigned counsel for Plaintiffs has acquired possession of a color copy of one certain document (attached as Exhibit A to this motion), regarding which there are no ready means of authentication except by recovery of the original document. As should be apparent from the nature and content of the document, if authenticated, and shown to be genuine, the contents of this document will significantly narrow and shorten the discovery and pre-trial litigation period necessary in this case, and might lead to an early resolution by settlement or transfer of these proceedings to the United States House of Representatives and Senate according the procedures outlined in the Constitution.
It is also apparent (and hearsay evidence available to Plaintiffs’ counsel aggravates her concerns) that political pressure may be brought to bear to destroy all relevant evidence, whether such evidence exists within or outside the borders of the United States of America.
It would appear to the undersigned counsel that either 28 U.S.C. §1781(a)(2) or 28 U.S.C. §1782(b)(2) or some combination of these statutory authorizations outlines the procedures by which to transmit letters rogatory and other requests to the proper authorities abroad in Kenya and the United Kingdom of Great Britain and Ireland.
For two classes of evidence at issue here, namely all requests for relevant passport materials and other documents existing within the United States of America, as well as all requests to be made through diplomatic channels to foreign tribunals, Defendant HILLARY RODHAM CLINTON is the Secretary of State of the United States of America, and accordingly, Secretary Clinton is the first and primary proper target of letters rogatory to be submitted pursuant to 28 U.S.C. §1781(a)(2).
FIRST, Plaintiffs pray that this court authorize Plaintiffs to issue a special subpoena for deposition duces tecum to Secretary HILLARY RODHAM CLINTON be cited to appear within 21 days pursuant to (or in the letter and spirit of) Rule 27 of the Federal Rules of Civil Procedure (even though this action has been filed and served, many months will pass before the Rule 26(f) Conference can be held to plan for discovery among the parties). The purpose of Rule 27, even though designed for pre-filing discovery, is fulfilled and relevant here, in that some (above-noted) hearsay evidence exists that an individual involved in the examination of passport files at the United States Department of State relating to and involving certain 2008 Presidential candidates may have been killed in relation to such inquiry. Last year it was announced by former secretary of State Candoleeza Rice that there was tampering with the passport records of three major presidential candidates and it was investigated by the inspector general. Lt. Querl Harris was one of the suspects in passport tampering scandal. Washington post has announced that he was cooperating with the FBI and shortly thereafter he was found dead, shot in the head, sitting in his parked car. This case remains open and unresolved. Under such circumstances, “perpetuation of evidence” becomes a more and more significant and time-sensitive issue.
SECOND, Plaintiffs pray that this court will send a request for letters rogatory pursuant to 28 U.S.C.§1781(a)(2) to Defendant HILLARY RODHAM CLINTON and other relevant officers in the United States Department of State to issue and transmit letters rogatory through proper diplomatic channels to the following foreign offices of public record and vital statistics:

OT: (a little); after reading comments here from you guys with the legal-smarts, it jogged my memory of how, as a kid, my favorite shows on tv were ones like “Judd For The Defense”, The Defenders”…those two jumped out…probably there were others. I was always interested in hearing the court battles, back and forth. I also recall that I watched nearly all of the court stuff on tv of the cops in the Rodney King case…I had a little tv in my office…and I found myself glued to watching the proceedings. Looks like this BC was requested in Feb, to prove paternity.. the divorce was filed on Jan 24, 1964. So court probably wanted original BC.
At this point either Obama or Dunham was not denying he was born in Kenya.
Looks like Dunham, upon going to the American Consolate in Kenya found out that she could not give Barry citizenship, because she had not been a resident long enough in USA: so after returning to Hi, probably filed a perjurious birth at home, to conceal the fact, and get him citizenship.

In an attempt to get back on topic. I have been receiving Google email alerts for sometime now. One of my alerts is a comprehensive search of “Obama Birth Certificate” You can imagine how many alerts I now receive a day. Which is why I had the Orly thing early this morning. But something has changed. When I would post about BO BC my blog would show up in my alerts almost instantaneously. Now it does show at all. Just popping on for a second to answer your question.
We don’t know if this is the same BC Lucas Smith was trying to sell on eBay.
From all indications in Orly’s posting it appears that Alan Keyes was instrumental in obtaining this document somehow.
We believe that Smith is a con man, albeit a persistent one. Does he have something? Who knows, but to my knowledge, he never did meet with Joe Farah (as he said he would) and seemingly has disappeared until now. In light of Orly’s document this timing seems a bit coincidental, does it not?
Kittycat will verify that on Smith’s web site he now promises a video this month. We shall see. He didn’t produce the video in June as he said he would.
EBay pulled that auction 7 times. We never knew what Smith had as he refused to post a photo of the BC or a portion thereof to prove that he at least had a document. The final auction that was pulled was for a photo of himself, some guy named Andylenny, and Dawnella Wilson, the supposed financier of the trip to Kenya to get the BC.
So, that was a longwinded reply to your comment. We just don’t know.
I truly fear for Orly now more that ever because we see what happens to people when they get too close. Larry Sinclair has again been threatened on August 4, The One’s birthday, and we know what Young and Quarles’ fates were. I’m praying for her. I’ve never seen anyone with the intestinal fortitude of this woman.

In February 1964 the official name of the country was “Dominion of Kenya”. “Republic of Kenya” came only later.

Kenya “officially” became a republic on the anniversary of her independence which was Dec.1963.
The question then becomes, when did it “unofficially” start to act like one with it’s paperwork?

The status of Kenya as a country has no baring on the Citizenship of Obama. Al Obots keep saying is he was born in Hawaii, which doesn’t matter anyway, but now it seems to be clear he was not[.]

Just opened My Brother’s birth Certificate Recieved from Hawaii. Just Like Obama’s, it is a Certificate of Live Birth with the Request Date and Vital Statictics Director Rubber Stamped on the back. They sent the Same Short Form to him for $15.65. Maybe it true that Hawaii doesn’t have the Long Form to give to people. That still doesn’t make Obama Kenyan Registration any less.
I Believe Both Forms are Real. He was Born in Kenya, and then his mother Registered him Hawaii to get on Welfare after the 1964 divorce. Remember, Sun Yat Sen also has a Hawaiian Birth Certifate.
I started noticing the web censorship yesterday in the early am. I had written an article overthe weekend that linked to the site http://impeachbarackobama.org
which was up and aok on sunday. I signed a petition they had online. The next morning the site was gone.
My advice to patriot bloggers is to keep offline backups on CD of all your conent – if you wake up one morning and your blog is gone, ou will just have to sit down and re-post it on another one.
