Barack Obama is spending the night in Greensboro, NC during his con job tour on jobs. While Obama was traveling in NC today Stuart Levine was on the witness stand today in Chicago for the William Cellini trial. Obama’s buddies in the US Justice Department have tried their best to protect him and keep Tony Rezko away from the witness stand. Levine did a pretty good job today of connecting Obama to all of the corruption that has been taking place in Chicago. You had to really be paying attention to notice it. I have been.

So Obama, I wouldn’t get too cozy in that Proximity Hotel bed tonight. There is no telling what Levine might reveal tomorrow.

“Railing against Republicans, President Barack Obama on Monday pushed for a jobs package that Congress is splintering into pieces, as the White House predicted the Senate would start taking votes soon. Obama pressed lawmakers to act first on his idea of funneling aid to states to hire teachers and other workers.

Noting that Republicans in Senate rejected consideration of his whole $447 billion plan, Obama sought anew to turn that vote against them.

“Maybe they just couldn’t understand the whole thing at once, so we’re going to break it up into bite-size pieces,” Obama said in western North Carolina, back on the road to campaign for his agenda and, in turn, his own re-election.”

“Obama’s pitch came in the first stop of a three-day bus tour through North Carolina and Virginia. His goal is to keep pressure on Congress to act on individual pieces of his bill following last week’s Senate vote to shelve the plan.

A supportive crowed in broke into a chant of “four more years” for Obama. Said the president in response: “I appreciate the four more years, but right now I’m thinking about the next thirteen months.”

Republicans denounced the bus trip as nothing more than a taxpayer-funded campaign trip through two must-win states to try to bolster his standing for the 2012 election.”

Occupy protesters look for new campsite

“The neophyte Occupy Greensboro movement has a secure downtown campsite through Friday and is hunting another location to continue its protest for the long haul.

A day after staging a 600-person march through town protesting financial inequities, about 200 campers and part-time demonstrators agreed by unanimous consent Sunday evening to pursue other tactics, including the possible picketing of the Proximity Hotel where they expect President Barack Obama to stay tonight during his two-day visit to North Carolina and Virginia.

The group voted to ask Obama to meet tonight with some members — a delegation bearing letters of “individual grievances.”

“We wished to invite you to visit with our assembly and hear why the people gathered here are upset with our government,” the letter said.”

1. Why did the IL committee you were chairman of in 2003 reduce the members of the IL Health Planning Board from 15 to 9 just before it was rigged by Tony Rezko and Rod Blagojevich?

3. Why have you used numerous US Justice department attorneys and personnel, at taxpayer expense, to avoid presenting a legitimate birth certificate and college records?

4. Why did your administration push through federal loan guarantees for Solyndra?

Illinois Pay To Play has produced some hard hitting no nonsense articles recently about Obama and his Chicago corruption buddies and dubious actions by US Attorney Patrick Fitzgerald.

“Patrick Fitzgerald: Intrepid Crime Fighter? Or, Politically-Driven Leaker? Series Summary (Part 10)”

“The first sentence in Part 1 of this series asked this:

“Is the United States Attorney for the Northeastern District of Illinois an intrepid crime fighter, as he’s typically portrayed by most of the Chicago and national media? Or, is the legend of a modern day Untouchable Elliott Ness largely a media-created myth?”

What followed made a case that the Untouchable image of U.S. Attorney Patrick Fitzgerald​ is largely a myth.

As to circumstantial evidence:

“It means that existence of principal facts is only inferred from circumstances. Twin City Fire Ins. Co. v. Lonas, 225 Ky. 717, 75 S W.2d 348, 350.

When the existence of the principal fact is deduced from evidentiary by a process of probably reasoning, the evidence and proof as said to be presumptive. Best, Pres. 246; Id. 12. All presumptive evidence is circumstantial because necessarily derived from or made up of circumstances, but all circumstantial evidence is not presumptive. Burrill.

The proof of various facts or circumstances which usually attend the main fact in dispute, and therefore tend to prove its existence, or to sustain, by their consistency, the hypothesis claimed.  Or as otherwise defined, it consists in reasoning from facts which are known or proved to establish such as are conjectured to exist.”  (p. 309, Black’s Law Dictionary, Fourth Edition)

So, what are the facts and circumstances that we know that collectively tend to prove, or sustain by their consistency, the existence of the hypothesis that Patrick Fitzgerald is a politically-driven, not jurisprudence-driven, prosecutor whose image as an intrepid, unbiased crime fighter is a media-created fabrication?”

“The arrest of Blago was timed, not to stop a crime spree, or the selling of a Senate seat – since the latter notion is built on the myth that, once Blago got paid for appointing someone, the act was immediate and irrevocable.  The arrest was timed to save Congressmen Jesse Jackson, Jr., from criminal prosecution for bribing a governor in order to receive a Senate appointment. Connect the dots. It was about saving J.J., Junior.

The Mole was planted by the DoJ to contribute to building a case against Tony Rezko in order to (a) help scuttle Blago – who has his own self-destructive gene – and, (b)protect the image of Barack Obama​ as a Chicago politician untarnished by association with the likes of a Tony Rezko.

Getting Tony out of the way was necessary to hiding his relationship to Barack. And, keeping him sequestered at an undisclosed location was necessary to remove him from access to the media. But perhaps even more importantly, Rezko was never called as a witness in either Blago trial, yet he was among Dead Meat’s leading extortionists.  All part of concealing Barack Obama’s involvement in Illinois Play to Play.

By its general passivity, the Chicago media have been complicit in hiding of Rezko. After all, Obama was their guy, too.

In the end, Tony will be sentenced to time voluntarily served – wherever that was – and eventually be pardoned by his longtime friend and financial benefactor, Barack.  (Remember, Eric Holder facilitated the pardoning of Marc Rich.)

The Mole was a big winner in all this. He never appeared in court to testify against Rezko, since his appearance might have led to testimony as to Rezko’s long financial support of the young Illinois, and then U.S., Senator. The Mole is on record as having witnessed the two together in a much closer relationship than Obama has ever admitted.  For his work, the Mole made out like a bandit. New name. New career. New wealth. In a New Town.

In a second Obama administration, Fitzgerald will be rewarded by being appointed the next FBI Director. Or, maybe even soon, he’ll get Holder’s job, if Eric’s connections to Fast & Furious sink him.

This is a circumstantial case.  But remember Fitz’s words:  “I think people need to understand we won’t be afraid to take strong circumstantial cases into court.”

To conclude: Three public entities head the list of those responsible for putting Barack Obama in the White House.

1.The Chicago Tribune, the Sun Times, and the entire Chicago TV media,, for selectively withholding information concerning Obama’s past in Chicago.
2.Former Tribune political reporter and consultant to Blago during his Congressional campaigns – David Axelrod​.  And, the…
3.U.S. Attorney for the Northern District of Illinois, Patrick J. Fitzgerald.

“When it came his time late Friday afternoon to begin cross-examining the government’s star witness, Springfield power broker William Cellini’s lawyer wasted no time going after Stuart Levine, a deeply flawed man with decades of wrongdoing in his past.

“Let me start by asking you about your credibility as a witness,” said Dan Webb, Cellini’s lawyer. “Is that OK with you?”

Webb then hit Levine with a barrage of questions about how much money he stole, how many institutions he cheated and how he felt about it all.

Levine paused long and often in his answers.

He had no answer when Webb asked how many “acts of dishonesty” he had engaged in.

“I’ll take an estimate,” Webb shot back, asking whether it was a number “over 500.”

Levine answered that he didn’t know how to “quantify it.”

“Is it fair to say there has been so many you can’t give an estimate of a total?” Webb then asked.

Webb’s cross-examination lasted about an hour before court adjourned for the weekend and will continue next week.

Earlier Friday, prosecutors wrapped up their questioning of Levine while playing for the jury some of the most potentially damaging undercover recordings involving Cellini.

Cellini is charged with trying to extort from a Hollywood producer who did substantial business with the state a $1.5 million contribution to then-Gov. Rod Blagojevich’s campaign.

Cellini, whose investment company had made millions of dollars from the Illinois Teachers’ Retirement System, is alleged to have agreed to work with Levine, a board member at TRS, and Blagojevich advisers Antoin “Tony” Rezko and Christopher Kelly as a way to protect his access at the pension board.

In recordings played Friday, Levine and Cellini discussed how to deal with the failing plot to extort producer Thomas Rosenberg, who threatened to go to law enforcement. The conversations revealed a separate problem for Cellini — his concern that Rezko and Kelly were too obvious in their corruption and already under investigation.

In a recorded telephone call with Levine on May 8, 2004, Cellini recounted advice he had given Kelly after finding him “beside himself sittin’ on the couch.”

“If somebody comes in with badges and flashes them at you and in the course of the conversation says do you know Bill Cellini, just know before they ask that question that they have already checked all your phone logs and they know that we have talked on the phone,” Cellini said.

Some jurors’ eyes widened and one turned her gaze directly on Cellini at that moment.”

Diversions Diversions Diversions.

Is it any wonder that we have the Obama camp protesting Wall Street and a probable manufactured Iranian assassination plot? Despite the best efforts of Patrick Fitzgerald and the US Justice Department to protect him, Obama still has a Rezko problem.

Daniel Frawley has not been sentenced.

“Daniel T. Frawley once teamed with Tony Rezko — the political fixer
who’s now in jail — in what turned out to be a doomed effort to open a
training school for Iraqi security forces in western Illinois. Now,
Frawley faces a federal prison stretch of his own.”

“Still, federal prosecutors are seeking a reduced sentence for Frawley
— of a year and a half in prison, rather than the 35 years he could
face — apparently because Frawley has been secretly cooperating since
at least 2006 in their investigation of Rezko, who was found guilty in
June 2008 of having used his clout with the Blagojevich administration
to enrich himself and his business associates.

Details about Frawley’s cooperation with the U.S. attorney’s office,
the FBI and the Illinois attorney general’s office can be gleaned from
a 65-page court deposition he gave seven months ago…”

“Frawley: “Yes, I had a conversation with Mr. Weaver where he
instructed me not to cooperate.”
Frawley: “I was on the phone, making a phone call to Tony Rezko. I had
a luncheon engagement with him.”

“George was outside of the room where I was making the telephone call,
and the purpose of the call was for me to keep my luncheon engagement
with Tony Rezko and to go over and to record Tony Rezko.”

“George saw and heard me on the phone, came running in and went like
this [demonstrating]: Cut it,”

Franklin: “For the record, the deponent is crossing his hands across
his throat.”

Konicek: “And Tony Rezko was where when you were speaking to him?”

Frawley: “He was on the other end of the phone. I don’t recall where he was.”
Konicek: “I’m assuming the information is about the payments made by
Rezko to Obama, so we know we’re talking about the right conversation,
right?”

Konicek: “Am I correct it was about Obama being paid by Rezko?”

Frawley: “I’m not answering that question, based upon my attorney’s
instructions.”

Konicek: “But on March 13, 2006, you’ve already indentified for me
being at 219 South Dearborn. You’re talking to Tony rezko on the
phone, and Mr. Weaver makes this gesture to you, right?”

Frawley: “Mr. Weaver made the gesture and told me to get off the
phone, to end the phone call.”
Konicek: “Okay. And then where were you instructed not to cooperate?”

Frawley: “In the same building, at 219 South Dearborn….in a different room.”
Konicek: “Did you bring to Mr. Weaver in Hinsdale a statement showing
payment to Tony Rezko in the amount of $ 1.5 million?”
Konicek: “Are you going to answer?”

Frawley: “No.”

Konicek: “Are you asserting your Fifth Amendment privilege?”

Frawley: “Yes.””

“Stuart Levine, a flawed political insider whose cooperation helped take down the Blagojevich administration, returned to the Dirksen U.S. Courthouse on Wednesday to tell of more backroom criminal deals.

Levine is the star witness againstSpringfield power broker William Cellini, on trial on charges of plotting to squeeze a campaign contribution from a Hollywood producer whose investment firm had substantial business with the state of Illinois.

Levine last testified in 2008 against Antoin “Tony” Rezko, a top adviser to former Gov. Rod Blagojevich who was convicted of using his political clout to orchestrate a multimillion-dollar kickback scheme.

On Wednesday, Levine, 65, who once made millions of dollars, strode into the courtroom and explained how the scandal cost him his home and livelihood. He said he now sells electronic cigarettes at a shopping mall.

He also told the jury of his extensive drug abuse — including crystal meth and ketamine binges — that started in the early 1970s and went on for decades.

Under questioning by Assistant U.S. Attorney Christopher Niewoehner, Levine gave mostly monotone “yes” or “no” answers about malfeasance at the Illinois Teachers’ Retirement System, or TRS, where he sat on the board of trustees.

At one point on the stand, Levine became flustered when his cellphone rang and he struggled tosilence it. Unable to turn the phone off entirely, Levine finally handed it over to Niewoehner.

Still, Levine’s answers were clear on Cellini’s deep influence at TRS and how they used that to broker an illegal deal with Rezko and Christopher Kelly, another top Blagojevich adviser.

Levine told the jury that Cellini, a close ally, had come to him with concerns about the leadership at TRS and whether enough money was being invested in real estate. Cellini, a longtime lobbyist and fundraiser, owned Commonwealth Realty Advisors, a real estate investment company that was making millions of dollars from TRS investments .

Protecting that kind of power is central to the charges against Cellini, prosecutors have alleged.

Levine said he and Cellini worked to engineer a series of moves to ensure they continued to control a voting block on TRS. Among the moves was putting a friend of Cellini’s on the board, Levine said.

At one point Levine was asked if he was generally willing to do what Cellini wanted when it came to TRS. “Yes,” he responded. And when asked how much influence Cellini had at TRS, Levine quickly replied, “Considerable.””

“The two agreed that Cellini would use his relationship with Rezko and Kelly to convince them to block the pension plan, Levine said. In return, Cellini would promise that he and Levine would use their influence at TRS to steer contracts to companies based on political contributions to Blagojevich, Levine said.

Cellini later told Levine that Rezko and Kelly agreed to go to Blagojevich to try and kill the consolidation.

Levine is expected to be on the stand the rest of the week.”

Stuart Levine, the key witness in the Tony Rezko trial, is about to be called as the next witness in the William Cellini trial. Levine did the the dirty work for Rezko, the long time associate of Obama.

From the Stuart Levine Plea Agreement.

“In about August 2003, Defendant was re-appointed to the
Planning Board. Prior to that point, Defendant discussed his
possible re-appointment with Individual A and, separately, with
Individual B. Individual A said he’d get back to Defendant about
his request and later called Defendant and said that it would
happen. A short time later, Defendant was at a meeting in Rezko’s
office with Individual B and Individual B said that the board seat
Defendant wanted had been taken care of. Defendant understood from
these conversations that he would be re-appointed to the Planning
Board.

About the time Defendant was re-appointed, Rezko and Defendant
discussed Defendant’s appointment and Rezko said that he had
suggested that Defendant be made the vice-chairman of the Planning
Board and that Rezko expected to influence a certain number of
votes on the Planning Board. In February 2004, the Planning Board
elected Defendant as vice-chairman.

In or about the spring of 2004, Rezko and Defendant agreed
that Defendant, whose term on the TRS Board was due to expire in
May 2004, needed to be reappointed to the TRS Board and that
additional TRS Board members needed to be appointed who would
cooperate with Rezko and Defendant. Rezko agreed to use his
relationships and influence with high-ranking State of Illinois
officials to facilitate these efforts. Rezko subsequently
indicated to Defendant that Rezko had arranged for Defendant to be
re-appointed to the TRS Board, and Defendant was re-appointed on
about May 14, 2004.”

“Shortly before the Planning Board meeting on April 21, 2004,
Defendant had several telephone conversations with another Planning
Board member about Mercy and its application for a CON. That
Planning Board member said he had his “marching orders” from Rezko
and that Rezko wanted to help on Mercy’s application. In another
telephone conversation with the same Planning Board member,
Defendant said that it was important that Rezko’s direction on the
vote be communicated to the other Planning Board members that Rezko
influenced on the Planning Board.

At its meeting on April 21, 2004, the Planning Board
considered Mercy’s application for a CON. At this meeting,
Defendant and a majority of the Planning Board voted in favor of
Mercy’s application. Defendant intentionally concealed from and
failed to disclose to the Planning Board material facts relating to
its consideration of Mercy’s application, including his
arrangements with Rezko and Kiferbaum. After the meeting
concluded, another Planning Board member and Defendant met with

After the April 21, 2004, Planning Board meeting, Defendant
directed Kiferbaum to pay the kickback relating to Mercy to
Individual E pursuant to a sham consulting contract. Steve Loren
drafted the contract. Defendant, Kiferbaum, and Individual E
agreed that the purpose of the contract was to make Kiferbaum’s
payments to Individual E look legitimate; that Individual E would
not, in fact, to do any work for Kiferbaum; and that Individual E
would share the Mercy kickback with Defendant.”

“Former Teachers’ Retirement System lawyer testifies to power broker’s
role in Blagojevich-TRS corruption axis, misconduct of implicated
board member Levine”

“A small but key group of people involved in the Illinois Teachers’
Retirement System had gathered for a meeting in a Chicago office
building in February 2004.

TRS Executive Director Jon Bauman and board member Stuart Levine were
already there, but longtime Springfield power broker William Cellini,
who had made millions of dollars from investing funds for the pension
system, was running late.

When Cellini arrived, he had warm welcomes — and a hug and a kiss on
the cheek for both Bauman and Levine — as well as a story to tell,
according to testimony Tuesday during the third day of Cellini’s
federal trial on charges of fraud and attempted extortion.

Testifying for the government, Steven Loren said Cellini indicated he
had met with top advisers to then-Gov. Rod Blagojevich to warn them
they were “moving too fast” and were “going to get themselves in
trouble.” Cellini said he went on to tell the advisers, Antoin “Tony”
Rezko and Christopher Kelly, that they should use “Bill Cellini as an
example,” according to Loren, who was a lawyer for TRS at the time.
Cellini then related to them how in his 30 years in politics he had
stayed “above the fray” and “out of the limelight.”

Cellini is now defending himself on charges that he worked with
Levine, Rezko and Kelly to try to squeeze a campaign contribution for
Blagojevich’s campaign from a Hollywood producer whose investment firm
had substantial TRS business.

Loren testified for about five hours about how Levine and Cellini
plotted with Rezko and Kelly to protect their influence with TRS.

Prosecutors hope Loren’s testimony will be important corroboration for
Levine, the government’s key witness, whose credibility is a central
issue for the defense. Levine — who like Loren has pleaded guilty in
the scandal — could take the witness stand as soon as Wednesday.

Loren testified that Levine had asked him to help defeat a proposal to
merge several state pension boards, a move that would have diluted the
power Cellini and Levine held at TRS. Loren said Levine told him he
showed Cellini a rough draft of some talking points on the issue
prepared by Loren. Cellini thought the ideas looked good but for one
minor tweak — the font should be changed, Loren said.

Loren also talked about how during a car ride with Levine in October
2003 — the last Friday of the month, he repeatedly recalled — he
agreed to help Levine prepare a sham finder’s fee for a man who did
business with the state.

In that same conversation, Levine explained to Loren that Cellini,
Kelly and Rezko had talked about how they would use these sham
finder’s fees to reward Blagojevich campaign contributors and that in
return, Rezko and Kelly would not interfere with the selection of
investment companies for TRS.

Loren endured a lengthy cross-examination by Cellini’s attorney, Dan
Webb, who prodded him about his role in the scandal, what other “acts
of dishonesty” he committed and his friendship with Levine, who in
testimony in Rezko’s 2008 trial admitted to drug binges.

Loren testified that he considered him a close friend but realizes
that Levine kept secrets from him. Webb asked Loren whether Levine
shared details about “his all-night drug parties.”

His head down, Loren said no.

While U.S. District Judge James Zagel blocked some of Webb’s
questions, Loren admitted he had fudged billing records in an
unrelated case.”

“35. As described more fully in the following paragraphs, Mercy
Hospital, which sought permission from the Planning Board to build a
hospital in Illinois, received that permission through Rezko’s
exercise of his influence at the Planning Board after Rezko was
promised that Mercy Hospital would make a substantial campaign
contribution to ROD BLAGOJEVICH. Rezko later told a member of the
Planning Board that Mercy Hospital received the permit because ROD
BLAGOJEVICH wanted the organization to receive the permit.

36. Levine’s criminal activities included his abuse of his position on
the Planning Board to enrich both himself and Friends of Blagojevich.
The Planning Board was a commission of the State of Illinois,
established by statute, whose members were appointed by the Governor
of the State of Illinois. At the relevant time period, the Planning
Board consisted of nine individuals. State law required an entity
seeking to build a hospital, medical office building, or other medical
facility in Illinois to obtain a permit, known as a “Certificate of
Need” (“CON”), from the Planning Board prior to beginning
construction.

37. Levine, as well as Planning Board members Thomas Beck and Imad
Almanaseer, testified under oath at the Rezko Trial.9 Beck testified
that he asked Rezko to reappoint him to the Planning Board and that
Beck thereafter followed Rezko’s directions regarding which CON
applications Rezko wanted approved. Beck testified that it was his job
to communicate Rezko’s interest in particular CONs to other members of
the Planning Board, including Almanaseer, who were loyal to Rezko.
Beck testified that he understood that Rezko spoke for the Blagojevich
administration when Rezko spoke to Beck about particular CONs.
Almanaseer testified that Beck instructed him that Rezko wanted
Almanaseer to vote a particular way and that Almanaseer should follow
Levine’s lead in voting on CONs. Almanaseer testified that before
certain Planning Board meetings, he received notecards from Beck
indicating how to vote on certain CON applications. Beck testified he
provided these notecards to Almanaseer and certain other members of
the Planning Board to communicate Rezko’s directions about certain CON
applications.

38. During his testimony, Levine described a plan to manipulate the
Planning Board to enrich himself and Friends of Blagojevich. The plan
centered on an entity commonly known as Mercy Hospital (“Mercy”) that
was attempting to obtain a CON to build a new hospital in Illinois.
Levine knew the contractor hired to help build the hospital. In
approximately November 2003, on behalf of the contractor, Levine
checked with Rezko to determine whether Rezko wanted Mercy to obtain
its CON. Rezko informed Levine that Mercy was not going to receive its
CON. According to Levine, he asked Rezko whether it would matter to
Rezko if Mercy’s construction contractor paid a bribe to Rezko and
Levine and, in addition, made a contribution to ROD BLAGOJEVICH.
Levine testified that Rezko indicated that such an arrangement would
change his view on the Mercy CON.

39. Levine’s testimony regarding Rezko’s actions to change the
Planning Board decision concerning Mercy’s application for a CON based
on contributions for ROD BLAGOJEVICH is confirmed by attorney Steven
Loren. Loren testified at Rezko’s criminal
trial and, before that, in the grand jury.11 According to Loren, in
approximately December 2003, Levine informed Loren that Rezko was
against the Mercy CON. According to Loren, Levine relayed to Loren a
conversation between Rezko and Levine during which Levine asked Rezko
whether a political contribution to ROD BLAGOJEVICH would make a
difference for Mercy’s CON, and Rezko responded to Levine that such a
contribution might make a difference.”

“An Illinois powerbroker on trial for attempted extortion complained that then-Gov. Rod Blagojevich’s confidants were too overt about seeking benefits from state decisions and should follow the example he set during his decades close to the reins of power, a witness told jurors Tuesday.

The testimony came as prosecutors laid out their case in the week-old trial of millionaire businessman William Cellini. He is accused of conspiring with Blagojevich insiders Tony Rezko and Chris Kelly to shake down the Oscar-winning producer of “Million Dollar Baby” for a $1.5 million campaign contribution to Blagojevich.

Cellini, now 76, arrived late at one meeting in Chicago in February 2004, visibly agitated as he described a recent encounter with Rezko and Kelly, according to witness Steven Loren. Loren is a former attorney for the $30 billion Teachers’ Retirement System, which is central to the case against Cellini.

Cellini grumbled that the Blagojevich confidants “were moving too fast, they were going to get themselves in trouble,” Loren told jurors.

Once known as the King of Clout for the influence he wielded in Illinois politics going back to the 1960s, Cellini said Rezko and Kelly should follow the example he set over a 30-year span close to top-tier Illinois decision makers, and “stay out of the limelight” and “above the fray,” Loren testified.

Cellini, whose trial entered a second week on Tuesday, allegedly plotted with Rezko and Kelly to squeeze Hollywood producer Thomas Rosenberg by threatening to yank $220 million in Teachers’ Retirement System funds from Rosenberg’s investment company unless he came up with the donation.”
“Much of Loren’s testimony Tuesday drew on his interactions with Stuart Levine, a TRS board member at the time and another figure in the alleged conspiracy who is expected to take the stand later.

During cross examination, defense attorney Dan Webb sought to hit at the trustworthiness of Levine, who admitted on the stand at another trial that he abused cocaine and other drugs — sometimes at marathon parties.

“You do know that he had a habit of lying to you, is that correct?” Webb asked Loren about Levine, pacing across the courtroom floor and raising his voice slightly. The judge sustained a prosecution objection before Loren could respond.”

The Obama administration is now being rocked by two scandals — “Operation Fast and Furious” and the awarding of a half billion dollar loan guarantee to Solyndra, a solar panel company that went bankrupt.

Our first guest is at the center of both investigation, Darrell Issa, chairman of the House Oversight and Government Reform Committee.

Congressman, welcome back to “Fox News Sunday.”

REP. DARRELL ISSA, R-CALIF.: Well, thanks for having me on and covering two of the issues that are causing Americans to lose confidence in their government.

WALLACE: OK. Let’s start with “Fast and Furious” in which ATF agents allowed more than 2,000 weapons to be sold illegally to cross the border. They were going to try to track them to catch drug traffickers. They lost track of a number of them. Hundreds ended up with the Mexican drug cartel and two of them ended up at the murder scene of a U.S. border patrol agent.

I want to take you back to May when you had this now famous exchange with Attorney General Eric Holder. Here it is.

ISSA: When did you first know about the program officially, I believe, called “Fast and Furious”? To the best of your knowledge, what date?

ERIC HOLDER, U.S. ATTORNEY GENERAL: I am not sure about the exact date. But I probably heard about “Fast and Furious” for the first time over the last few weeks.
WALLACE: Congressman, I understand that you are going to issue a new set of subpoenas to the attorney general this week. About what?

ISSA: About “Fast and Furious” and basically, at this point, about why are they denying knowing about something that they were briefed on? Exactly when the American people want to know how did it happen? Understand, we didn’t start off going after the attorney general or Lanny Breuer or anyone else in justice. We started off knowing that Brian Terry was dead, that a lot of —

WALLACE: The U.S. border patrol agent.

ISSA: The U.S. border patrol agent. And that a lot of weapons have been let to walk.

After that, we started being told things like by the Justice Department designated official that we never let weapons walk.

Now, we have literally e-mails in which they are concerned about so many walking and you said something and I don’t mean to correct you — but to expand. We didn’t just have a few not be tracked. The whole program was about not tracking them until they were found in the scene of crimes. And they didn’t just allow. They facilitated just one guy buy, one straw buy, over 700 weapons.

WALLACE: So, specifically, what are your subpoenas about?

ISSA: We want to know what and when they knew it. But more importantly, we have to understand — at what level of the authorization really come? It wasn’t an ATF operation. They were part of that. It was a joint operation in which DEA knew more than ATF.

WALLACE: Drug Enforcement Administration. ATF, Alcohol, Tobacco and Firearms.

ISSA: And, of course, these are all parts of the Department of Justice. And as we are beginning to see, and we’re not talking about Eric Holder at this moment, but the people in the top of justice were well-briefed, knew about it, and seemed to be the command and control and funding for this program. And any law enforcement person who’s ever been asked under oath or not under oath comes back and says this wasn’t the right way to do it.

Well, when did they know it wasn’t the right way to do it and why do they keep doing it?

WALLACE: Are you going to subpoena the attorney general to testify again?

ISSA: The Judiciary Committee in which I also served, that’s where that actual question got asked, is — has invited him to come and clear the record, because, clearly, he knew when he said he didn’t. Now, the question is, what did he know and how is he explaining why he gave that answer?

WALLACE: OK. The attorney general sent you a letter Friday afternoon, along with other top officials in both the House and the Senate.

I want to go through some of this push back. He acknowledges that several memos, and here you can see them heavily redacted —

ISSA: This is the way we usually get this, Chris.

WALLACE: — on these dates were sent to his office as much as 10 months earlier, not the few weeks before he testified in May of 2011. But he says — and I want to put up his comments from his letter, “I do not and cannot read them cover to cover. Here, no issues concerning ‘Fast and Furious’ were brought to my attention because the information presented in the report did not suggest a problem.

He’s saying I didn’t know about this program and I certainly didn’t know that we were letting guns walk.

ISSA: Well, I’ll take him at his word, but let’s go back. He answered before Judiciary Committee, myself, Jason Chaffetz, and others, that he didn’t know about it until two weeks earlier. That’s just disingenuous on its face.

Very clearly, he had to know when Brian Terry was killed and everyone realized these were “Fast and Furious” weapons, he had to know something serious had happened and that’s months before he says he knew. Now, if we assume for a moment he didn’t know, the question is, is he competent? If, in fact, a border patrol agent has been murdered, 2,000 weapons have gone, this program has completely gone off of the rails, why didn’t he know? And that’s probably a more important question for the chief law enforcement. If Lanny Breuer knew, why didn’t Eric Holder?

WALLACE: And Larry Breuer, one of his top —
ISSA: One of this top aides who is very involved much earlier on and works in the same office.

WALLACE: OK, Holder points out that top officials briefed you in April of 2010, just around the time that he was first hearing of all of this. He writes and let’s put it up, “I’m aware that Chairman Issa has said that he was not briefed on the unacceptable details of ‘Fast and Furious.'” In other words, the fact they were letting the guns walked.
Two questions, one: is that true? Were you brief and not told? And second, if it is true, how do you know that he was also not told?

ISSA: The interesting thing is he’s quoting a story that he planted, that justice shopped around to the newspaper. But having said that, I’ll answer it.

We were looking into the drug problems, we asked for a briefing. We got a briefing, including Kenneth Melson. We —

WALLACE: Of ATF?

ISSA: Of ATF, one of the people that knew about the program but didn’t all the other things that he ultimately read in a still sealed wiretap. That when he read the wiretap and understood how much they knew that this was deliberately letting bad guns go to the drug cartel, he became sick to his stomach. So yes.

WALLACE: But my question is — all right. So, you are saying you were not told about “Fast and Furious” and the gun walking. So, how do you know that he wasn’t told?

ISSA: Well, first of all, it was concealed from us by the Justice Department. That briefing, they were not allowed to know what Kenneth Melson later knew and made him sick to his stomach. Let’s understand, ATF is running an operation. They’re being told guns aren’t getting to the bad guys. Ultimately, the whistleblower came forward, when he realized, of course, guns are getting to the bad guys.

This investigation is not about an operation that was supposed to trace guns. This is about Justice Department knowing and this is where the American people have a right to know more, knowing that these guns were deliberately intended to end up in the hands of the drug cartels without any kind of traceability except if you find a gun in the scene of the crime. That is the reason that it is felony and stupid — and I use the word “felony” deliberately — program.

This should be criminal to let criminals have thousands of deadly weapons.

WALLACE: I have to point out, because Holder does in his letter, the Bush administration had a similar operation called “Operation Wide Receiver” that also, he says, let guns walk?

ISSA: Well, first of all, Eric Holder came in wanting to indict people from that administration. So, I think his standard of the — well, other administration did it, too, is not so good.

But understand, from what we discover from “Wide Receiver” and those, by the way, we have subpoenas for those and those documents have not been delivered. Very few weapons, very, very well-traced — overhead, observation and so on.

What you would think would happen if you let a weapon start to move, you trace it at every step. This was one where they let the weapons go and never looked until they showed up in the scene of Brian Terry’s murder.

WALLACE: Some of your Republican colleagues have called for a special prosecutor to look into Holder’s involvement. Some have called on Holder to resign.

Do you join either of those?

ISSA: Well, I’ve always taken the tack that the president picks the people he has full confidence, and the president still seems to have full confidence in Eric Holder — something I don’t share. When it comes to a special prosecutor, Eric Holder cannot investigate himself. Congress is well along the way of investigating this operation to find out what went wrong, who knew it and what we have to do in the future to make sure it can’t happen again.

If there’s a special prosecutor to look at the narrow issue of top officials who — and they beat political appointees, that’s a separate issue. Our investigation, along with Senator Grassley has to get to the bottom of this sooner, not later, because the American people and people in Mexico don’t trust their government right now.

WALLACE: Let’s turn to the other scandal, Solyndra. The Obama administration had a document dump late Friday, hundreds of pages of e-mails late in Friday afternoon.

ISSA: I don’t know what is about Fridays.

WALLACE: I mean, it’s — all administrations do it, to be fair.

ISSA: Fair.

WALLACE: Overview, before we get into a couple of specifics. What’s your take away from the document dump?

ISSA: Well, they are trying to bury it into the weekend. But just as the document dump a week earlier gave us the Eric Holder situation, what we are finding it is not just Solyndra. It’s a pattern of these sorts of investments. You know, understand, in the last day that the law was there, $4.75 billion was thrown into loans. And one of the questions we have for Secretary Chu is, tell us why that last day, somehow, you had everything you needed and you didn’t have it over a period of time before?

The American people have a right to know on the rare occasions in which their money is used to invest in private operations, if you will, take bets on capitalism, that is very well vetted, very well thought out and without political interference.

Solyndra is a story of political interference, picking winners and losers. It’s salacious because, quite frankly, there were a lot of people giving to President Obama’s campaign.”
