“Early ballot recount ordered in Allen West race”

“A county canvassing board on Friday ordered a recount of early-voting ballots in the race between U.S. Rep. Allen West and Democrat Patrick Murphy, hours after a judge declined to do the same.

The St. Lucie County Canvassing Board voted 2-to-1 late Friday in favor of the move in the 18th Congressional District contest, in which Murphy is the unofficial victor. A series of tabulation errors by the county has raised suspicion among West’s campaign and its supporters and appeared to motivate the board’s favorable vote.

It was a victory for West, delivered just after a defeat for the Republican congressman and conservative firebrand in the courtroom. But whether it will change the result in the race, in which Murphy has a lead of 1,907 votes, remained to be seen.

“There really wasn’t any basis in the law for the decision they made,” said Murphy attorney Sean Domnick. “It really doesn’t change anything. He is the representative for District 18 and he will continue to be.”

The canvassing board declined to order a recount of absentee ballots, which West’s campaign had sought. The recount — technically being referred to as a retabulation — was set for Saturday.

Earlier Friday, St. Lucie Circuit Judge Dan Vaughn sided with attorneys for Murphy, as well as those representing the county supervisor of elections and canvassing board. He agreed with arguments that he had no authority to order a recount and that West’s campaign could contest the election if they are unsatisfied with its results.

Murphy has a 50.3 percent share of the ballots, a margin of six-tenths of a percentage point that is just above the half-percentage point threshold to order a full recount. The Democrat is the winner in the eyes of the state and was in Washington this week attending House orientation.

“Their objective is not to ensure a fair and accurate accounting of all votes but simply to ensure that Mr. Murphy can continue pretending to be a congressman,” said West campaign manager Tim Edson.

West’s attorneys allege all kinds of possible malfeasance at the polls, including discrepancies between the number of people signed in at precincts and the ultimate number of votes counted. Should Murphy still hold the vote lead after the recount, it was unclear if West might offer a concession.

Counties must file certified election results with the state by noon Sunday. West can formally contest the election after that.

The race was one of the country’s most expensive House contests and one of the most closely watched.

West, 51, is a first-term tea party favorite who has made a string of headline-grabbing statements, from calling scores of congressional Democrats communists to saying President Barack Obama, Rep. Nancy Pelosi and others should “get the hell out of the United States.” Murphy, 29, is a political newcomer who portrayed West as an extremist who has done little else in Washington than stoke partisan fires.”

“Allen West – Patrick Murphy duel continues in court Friday”

“With no love lost in Florida’s District 18 Congressional race, Allen West’s lawyers will duel with Patrick Murphy’s lawyers in a St. Lucie County courtroom tomorrow fighting a recount of votes cast in the general election on November 6, 2012. What is most in contention is many early ballots were being fed into tabulating machines twice by St. Lucie Supervisor of Elections staff. A partial recount of 16,275 ballots was conducted last week which netted West a closer margin toward victory to the stated victory of Murphy. Murphy went to Washington, D.C. this week to participate in his orientation to be the next U.S. Representative for District 18. District 18 spans St. Lucie, Martin and Palm Beach County.

West lawyers are expected to argue for a full recount of votes cast in the District 18 race by the St. Lucie County Supervisor of Elections because of irregularities found in different precincts. There would be 37,379 St. Lucie County ballots that would need to be recounted on or before Sunday because that is when the election results are slated to be certified to the state election’s office.

Gertrude Walker, St. Lucie County’s Supervisor of Elections, made a statement on her website regarding the irregularities, “Turnout percentages will show over 100% due to a two page ballot. the tabulation system (GEMS) provides voter turnout as equal to the total cards cast in the election divided by the number of registered voters. also note that some voters chose not to return by mail the second card containing the amendments.”

West’s legal team was in Palm Beach County court last week trying to lock up the ballots and machines used in he District 18 race in case a recount is needed, however Circuit Judge Crow shot down the argument. The main reason was that Crow felt if any action was going to be necessary, West’s hearing was occurring too soon.

Both campaign teams continue to email supporters almost daily requesting more money for an expected legal battle between the two candidates.”

““I’m not perfect,” St. Lucie County Elections Supervisor Gertrude Walker said Tuesday. “Neither is my staff.” Given the events of the past week, it’s hard to disagree. Because of her office’s flawed handling of last week’s election, uncertainty hangs needlessly over Patrick Murphy’s stunning defeat of Rep. Allen West.

Ms. Walker was stating the obvious when she admitted fallibility at a news conference, as reported by TCPalm.com. But when you’re overseeing a congressional election whose margin of victory is less than 1 percent, there isn’t much room for error.

And Ms. Walker has admitted to a big error: double-counting some ballots cast during early voting and ignoring others. After partially recounting some of the early voting results on Sunday, her office discovered that it had double-counted the equivalent of 799 votes in the Murphy-West race and named the wrong winner in Fort Pierce’s mayoral race. The mayor’s race is now undergoing an automatic recount because the margin of victory was less than 0.5 percent. But the U.S. House District 18 race is in a sort of limbo, with Rep. West clamoring in court for all early votes to be recounted and Mr. Murphy calling for him to concede.

So troubling was the county’s performance that the state Division of Elections this week sent officials to inspect the results. A spokesman told TCPalm.com: “We are not aware of any counties experiencing the same issues as St. Lucie.” We endorsed Mr. Murphy, and few things would please us more than to see Rep. West’s two years in Congress fade like a bad dream. But he says he will not concede until St. Lucie County recounts all early votes, and we can see his point.

After Rep. West first raised questions about the handling of St. Lucie’s early vote, Ms. Walker and the county’s canvassing board agreed to recount all 37,000 ballots from the eight-day early voting period. But on Sunday, they changed, deciding instead to recount only about 16,000 ballots cast during the last three days. The reason: The problems that affected the West-Murphy race seemed confined only to those days. Sure enough, her office found problems. The discovery that some ballots were counted twice, and others not at all, narrowed Mr. Murphy’s lead by 535, to 1,907 — a 0.58 percent edge. Only a 0.50 percent margin can trigger an automatic recount.

After admitting such an egregious error, Ms. Walker wants the public to trust her when she says the problems were limited to those last three days of early voting. But she has given voters little reason for confidence. In an abundance of caution, St. Lucie County needs to recount all 37,000 early votes, not just the ones that Ms. Walker believes were problematic.

Although Ms. Walker is claiming in court that she can’t legally do a full recount, state law allows a county to double-check its tally if it thinks that the initial results might contain an error. Had the canvassing board gone ahead and done this Sunday for all the early voting ballots, everything might have been resolved. As it is, more than a week has passed since Election Day, and uncertainty hangs over the District 18 race. Only a full recounting of all early voting ballots can end the doubts that St. Lucie’s botched vote-tallying has raised.”

And in Florida, where voter fraud, irregularities and floating vote counts are documented, almost 1,000 ballots were found in a warehouse in Broward County.

“Nearly a thousand ballots that were not included in Florida’s final count have been found in a warehouse in Broward County.

Tuesday morning and into the night, there was a buzz of activity at the Voting Equipment Center in Lauderhill, a week after the general election. There was a recount going on for two commission seats that were too close to call, one in Hallandale Beach and another in Dania Beach. Workers had to count those votes manually.

Also keeping elections officials busy is the fact that 963 filled ballots were found in a warehouse. The supervisor of elections, Dr. Brenda Snipes, said this happens all the time, especially when dealing with paper ballots. Her department is not the only one to have seen more ballots added to the final number after the election, and they have until Nov. 18 to certify all the votes.

Snipes noted that it is a routine thing to look for these kind of mishaps after election night and she is just glad that they are now being tallied into that final count.

Last Tuesday, close to 800,000 people voted in Broward County, some waited in lines for four to five and sometimes six hours. Many have said the news of these ballots add to their uneasiness about how the election was run. Florida was the last state to officially announce its election results, long after President Obama was officially announced as re-elected.

Snipes said there is no reason for alarm. “I’ve run several elections here, and this election was run no different than any other,” she said. “I think the difference with this election is that there was a close race between the two presidential candidates, and there was pressure put on everyone, including our office, to get all of the votes, count, count, count, so you don’t have an opportunity to check every box that comes back because you got to get what you got in hand and get it out of there, so if the voters would rather that we kind of sit back and relax and then clean up and find ballots. Then I think they would really be very upset.”

She said that further complicating this election was a very long ballot filled with proposed amendments. Snipes has promised that her department will meet their deadline by Sunday.”

“A Chicago voting-machine tech is sounding the alarm, claiming he witnessed multiple error messages on the voting touch-screens this election – but only in cases where people voted for Mitt Romney.

Steve Pickrum said he worked for Chicago’s election system during the early voting and Election Day voting for the 2012 race.

As an equipment manager for the system, Pickrum said, he responded whenever there was a glitch with a voting machine.

“On early voting, when I did work on the floor when voters needed help using the equipment, I was able to see the preference of the voter, and every time that I saw [a] voter voted for Romney a ‘voter save failure’ message came up on the screen,’” he reported.

Then when he went on Election Day to cast his own vote, he picked Romney and experienced the same error message.

Pickrum said he worked at both the Matteson voting area as well as in Precinct 70, and although he discussed the anomalies with his boss, had not yet filed a formal report.

He said when he voted, he was told by a precinct worker to just go ahead and assume that his vote had been tabulated, despite the error message. But since he knew the operations of the machines, he asked the poll workers to check the vote report, and they found his vote had not been counted.

He insisted on completing his ballot on another machine, he told WND.

Curiously, he reported he never saw the error message when the voter was choosing Barack Obama.

Another poll worker, this one assigned at the University of Michigan, reported a list of irregularities, including that the precinct captain told her at one point, “You go sit down, you are bothering me,” when she was trying to observe the proceedings.

“I was only standing there and looking at voter documents,” she told WND. “It was clear that what bothered him was my very presence.”

She said a short time later a young man arrived and identified himself as a Democrat poll challenger.

“The first time he said anything was to object to my challenge of a voter. He tried to anger the voter by telling her, ‘She does not believe you are who you say you are.’ He was trying to create a scene. It then happened again, and I told him, ‘You are not here to challenge me!’ His reply was a very loud, ‘Yes I am! You are a Republican, and you are here to prevent people from voting. You are holding up the line and creating obstructions,’” she reported.

She told WND, in fact, no one waited more than about 15 minutes to vote the entire day, and there were no obstructions.

The balloting is unofficial until the Electoral College electors designated by each state meet Dec. 17 to cast their ballots.

Other reports of questionable vote tabulations include:

  • Byron York of the Washington Examiner reports that some 200,000 fewer white voters were recorded in Ohio’s election this year than in 2008. “There are several theories about those missing white voters, but the most plausible is that the ones who were undecideds or weak Republicans were deeply influenced by Obama’s relentless attacks on Romney.”
  • And in Florida, the Sun Sentinel reported that election workers a week after the election said they found 963 unaccounted-for ballots – in a warehouse. “How can you lose them? This is terrible,” candidate Chickie Brandimarte told officials. Election supervisor Brenda Snipes, however, said it’s routine for various vote totals to be adjusted up until the Nov. 18 final certification.
  • Also in Florida, residents began demanding changes in the electoral system that handed voters chaos, frustration and delays at polling stations. The Florida League of Women Voters and other groups are demanding from Gov. Rick Scott a plan to draft reforms for the state’s elections.

WND reported just a day ago about an observer who noted up to 10 percent of the ballots cast at a polling station in Pennsylvania reverted to a default, which gave Barack Obama a vote no matter who the voter had selected.

The poll watcher reported the incident took place in the state where officials claimed Obama got a total of 19,605 votes in 59 voting divisions to zero for Mitt Romney and not far from the 100 precincts in Ohio where Obama got 99 percent of the vote, a feat not even achieved by Third-World dictators, according to Market Daily News.

With evidence mounting that the vote tabulation did not reflect the true choices of voters, talk-radio icon Rush Limbaugh echoed the Daily News, saying Monday: “Third-world, tin-horn dictators don’t get [these percentages]. I mean, the last guy that got this percentage of the vote was Saddam Hussein, and the people that didn’t vote for him got shot. This just doesn’t happen. Even Hugo Chavez [of Venezuela] doesn’t get 100 percent or 99 percent of the vote.”

It was in Upper Macungie Township, near Allentown, Pa., where an auditor, Robert Ashcroft, was dispatched by Republicans to monitor the vote on Election Day. He said the software he observed would “change the selection back to default – to Obama.”

He said that happened in about 5 percent to 10 percent of the votes.

He said the changes appeared to have been made by a software program.

Ashcroft said the format for computer programming has a default status, and in this case it appeared to be designating a vote for Obama each time it went to default.

He found it suspicious that Romney and Obama were in a virtual tie in most polls, but Obama then suddenly surged ahead by a number of points on election night.

“How the heck does that happen?” he wondered.

He said as a poll watcher, he was not allowed to communicate with officials there, so his concerns were submitted later to the state GOP.

Officials with the Republican Committee in Harrisburg did not respond to a WND request for comment.

WND previously reported Obama’s success was nominal in states where authorities required voter identification, while he was very successful in states that did not require it.

WND also reported prior to Election Day that officials in Virginia were asked to investigate after a video caught the field director for Democratic U.S. Rep. Jim Moran’s campaign in an apparent conspiracy to commit election fraud.

No official recount has taken place in the race between Allen West and Patrick Murphy. West is currently down by about 1900 votes, but every time the votes have been counted or processed the numbers change. Clearly there is a problem in his district and apparently in Florida. With all of the documented problems in Florida including known voter fraud and the closeness of the races, it is imperative that the votes throughout Florida be recounted.

Obama currently leads Romney by 73, 189 in FL. An automatic recount is triggered by a difference of less than .5 percent. That is 42,296 votes. With an honest, accurate tally, that threshold could have already been reached.

All the passion lay on the right while the left was discouraged with a promised messiah who proved merely a politician. And the prediction was that, in contrast to 2008, Republican turnout would dwarf the tuned-out and carry the day. Hence the shock November 6 eve. How could Romney lose, especially by such a wide electoral margin?

Maybe he didn’t

At least not legitimately.

When I predicted Obama’s re-election, I stated that, despite our country’s inexorable leftist slide, Romney would still win on Election Day were it not for vote fraud. I explained that the Democrats could steal more than enough votes in crucial swing states to turn the election. And I still believe what I did then: electoral criminality put Obama over the top.

At the time, we heard stories about electronic-machine “glitches” switching Romney votes to Obama ones. And Patrick Moran, son of Congressman Jim Moran (D-VA), was caught on tape facilitating vote fraud while Bridgeport, CT mayor Bill Finch essentially promised to commit same for a political partner in crime.

Since then, the indications of electoral criminality have been overwhelming. First there are the anecdotes, such as the court-appointed Republican poll watchers illegally expelled from 13 Philadelphia polling places in wards that, in most cases, went 99 percent for Obama; the poll observers who noted what they considered vote fraud but were powerless to stop; and the Democrats who actually bragged about voting more than once.

Then there are the statistics, such as this staggering fact: in 59 Philadelphia districts, Romney failed to get even one vote. Final Obama-Romney tally: 19,605 to 0.

Huh? Not even one person voted GOP accidentally? I mean, there even was a Washington, D.C. councilman who inadvertently voted to approve faux marriage, saying that he didn’t know what he was voting for (that would be Marion Barry).

Next, consider this report from The Columbus Dispatch:

More than one out of every five registered Ohio voters is probably ineligible to vote.

In two counties, the number of registered voters actually exceeds the voting-age population: Northwestern Ohio’s Wood County shows 109 registered voters for every 100 eligible, while in Lawrence County along the Ohio River it’s a mere 104 registered per 100 eligible.

Another 31 counties show registrations at more than 90 percent of those eligible, a rate regarded as unrealistic by most voting experts. The national average is a little more than 70 percent.

[…]Of the Buckeye State’s 7.8 million registered voters, nearly 1.6 million are regarded as “inactive.”

Understand the significance. Years ago I was contacted by a Washington, D.C. community leader (who’ll remain anonymous) who told me that he had “done some computer work for several candidates over the years in DC” and had conducted his own study of urban vote fraud. He said that inner cities’ great transiency ensures that any given large metropolis will have a great number of voters who no longer live in their precinct of registration. These areas also have Democrat operatives known by the get-out-the-vote term “block captains” or “apartment captains,” people who know the lay of the land and thus what registered voters have left town. So all they need do then is vote for these people or have others do so. This is very easy, too, with few voter-ID laws. And this is why Democrats oppose these laws so vehemently.

Now consider that Obama “won” Ohio by 100,000 votes. This means that to flip the state, Democrat surrogates had to illegally “activate” only 6.25 percent of its 1.6 million inactive voters.

Note also that Ohio secretary of state Jon Husted did ask Eric Holder’s DOJ for help negotiating conflicting federal laws pertaining to the purging ineligible voters from the rolls. The DOJ’s ultimate response? “No comment.”

Yet a voter doesn’t even have to be inactive, just disengaged. For example, when the aforementioned Patrick Moran offered advice on surrogate voting, he told an undercover reporter to masquerade as a pollster and call a targeted individual to make sure he wasn’t planning to vote. And this is nothing new. In fact, liberal leg-thriller Chris Matthews himself admitted that it has been going on for years.

Then there is the case of the missing military ballots. As Rachel Alexander at Town Hall reported:

The conservative-leaning military vote has decreased drastically since 2010 due to the so-called Military Voter Protection Act that was enacted into law the year before. It has made it so difficult for overseas military personnel to obtain absentee ballots that in Virginia and Ohio there has been a 70% decrease in requests for ballots since 2008. In Virginia, almost 30,000 fewer overseas military voters requested ballots than in 2008. In Ohio, more than 20,000 fewer overseas military voters requested ballots. This is significant considering Obama won in both states by a little over 100,000 votes.

Frankly, it is inconceivable that military interest in voting could’ve dropped so drastically given conservatives’ passion this election season. The damning conclusion? The Obama machine wants our soldiers to shed blood while it sheds their votes.

Striking as all this is, however, it’s likely just a partial picture. As with all crime, it’s a given that the discovered vote fraudsters represent only a tiny percentage of the total. And what about vote-fraud methods we haven’t even thought of yet? Remember, the Democrats have been honing this act for many, many years.

And vote fraud is Democrat domain. Liberals are the situational-values set, people who for years insisted that right and wrong is relative and that if it feels good, do it. And what feels good to them at election time is stealing votes to win – and they do it. They relish it, in fact. Like the liberal who addressed Bill Clinton’s it-depends-on-what-is-is infidelity and adamantly told me, “He did the right thing,” leftists love the con. To pull a fast one like private eye Jim Rockford, fool everyone, and get away with it is like winning the Nobel Prize in Prevarication in their world. Thus, it’s assured that there’s no small number of liberals who are currently brimming with pride at having negated the votes of countless knuckle-dragging conservatives.

Having said this, we can’t be sure about the exact magnitude of the vote fraud. But my judgment is this:

The election was likely stolen.

And whatever Barack Obama is presently, I don’t believe he will be a legitimate president come January 20.

This is why Congressman Allen West was right not to concede his Florida race. And, frankly, if Romney believes that the election may have been stolen nationally, he should withdraw his concession.

Radical?

Unprecedented?

Yes, but so is vote fraud on the scale perpetrated by Obama’s minions. And people needn’t fear creating a national crisis – we are already in a national crisis. The only question is whether good Americans will stand and be counted or allow 2012 to mark our official descent into banana-republic status.”

“Mainstream media reports notwithstanding, the Allen West-Patrick Murphy race is far from over, according to a volunteer lawyer with the campaign. Voting irregularities abound in what has shaped up to be one of the most hotly contested congressional races of the 2012 campaign.

On Sunday, the West campaign saw a net gain of 535 votes for Congressman West in a re-feed of early ballots in St. Lucie County, roughly 43.5% of the total ballots cast in the conservative Florida county.

“That’s only two votes shy of the number of votes that President George W. Bush won the American presidency with in 2000,” said Jeffrey Scott Shapiro, a volunteer lawyer for the West campaign. Over 800 votes went “missing” in Sunday’s count and of those 800, eighty percent of them had previously gone to West’s challenger, Patrick Murphy. The West campaign likes those odds.

On Saturday, Florida had released an unofficial result showing Murphy with a lead of 2,442 votes, or 50.4 percent—a narrow lead which makes his count just beyond the half-percent margin mandated for an automatic recount.

“We only need another 249 votes to trigger a statutory recount of the total of hundreds of thousands of votes cast in this race,” Shapiro explained. “For the media to suggest Allen West has already lost this race is not only irresponsible, it’s untrue. The media needs to stop projecting what it wants to happen and start reporting the facts of what is actually happening.”
“I wouldn’t be surprised if a statutory recount shifted the final numbers,” he added. “We only recounted the early vote portion for three days in one county today, which was about five percent of the total votes cast in this race. The numbers shifted in the hundreds when we’re only about 1,800 votes behind to win. More important than victory however, is democracy. Everyone deserves to have their voice heard and their vote counted. Something is fundamentally flawed with the media when it creates the impression that recounting the votes is unnecessary.”

Shapiro doubts that the canvassing board in St. Lucie County is doing its due diligence.

“The Canvassing Board in St. Lucie County misled the public,” he said. “They said they would recount all 37,379 early votes, but instead they only recounted 16,275 early votes from November 1, 2 and 3rd. Still, out of the 43.5 percent of early votes they recounted we picked up a net gain 535 votes. If they recounted the remaining 56.5 percent, there’s very little question we’d pick up the 249 we need to trigger a statutory recount.”

“I never experienced these kind of obstructionist tactics and hostility when I was serving on John Kerry’s presidential election team in 2004,” Shapiro added. “I was impressed with the system despite its flaws, but I’m starting to realize that there’s a big difference when you’re a member of the same party as the supervisor of elections than when you’re with the opposition. What I’ve seen these past few days has caused me to lose some faith and confidence in the integrity of the democratic process.”

The race was the country’s most expensive House contest, with over $21 million raised. West is among the most prolific fundraisers in Congress.”

Did Obama lose in California?

Something is definitely rotten in the state of CA.

The following 2012 CA counts were captured at approximately 9:00 AM today.

In 2008,  13,474,082 votes for president were cast.

As of 2:45 today 10,065,357 votes for president were cast.

That is a difference of 3,408,725 votes.

In 2008 Obama received 8,274,473 votes.

So far in 2012 Obama has received 5,958,059 votes.

That is a difference of 2,316,414 votes.

Obviously some of those votes Obama didn’t get went to Romney.

However

In 2008 John McCain received 5,011,781 votes.

So far in 2012 Romney has received 3,870,455 votes.

Does any rational person believe that Romney received that much less than McCain?

Especially with Obama’s drop in votes.

Let’s assume for a moment that 1 million fewer people voted in 2012.

Where’s the rest of the votes?

Consider the following.

A record number of Californians have registered to vote.

Field Poll estimated there would likely be a million fewer voters than in 2008.
Field poll predicted nearly thirteen million Californians or about seventy percent of registered voters would cast ballots.
Fifty one percent of voters will vote by mail.

People have been questioning how Mitt Romney could get fewer votes than John McCain. CA is part of the answer. How many mail in ballots remain to be counted and what controls are in place to insure security and accuracy?

Remember, California had one of the highest unemployment rates in the country. It is plausible that this race could be much closer.

Murphy is leading West 50.4 percent to 49.6 percent with 100 percent of the votes counted, according to HuffPost Pollster — with 160,328 votes to 157,862. The district is the only House race in Florida that has yet to be called.”

“Republican Congressman Allen West appears to have lost his bid for re-election in District 18 to Democrat Patrick Murphy. But West isn’t going down without a fight.
Wednesday, West filed a motion to have paper ballots counted and to impound voting machines and all paper ballots cast. The motion was filed against the Palm Beach County Election Board.
West’s attorney’s also asked that any “voting machines and any associated equipment or documentary or record evidence, used in connection with the Election in this Election District be impounded to prevent further voting and/or to declare the intent of voters for votes cast on the Voting Machines.”
In the filing, West attorney’s said they “pray” that the court would grant the motion.
Murphy is clinging to a small lead in his quest to oust West and West’s campaign manager said Wednesday they want a recount in St. Lucie County.
Murphy, the political newcomer, put out a statement early Wednesday declaring victory in the race. West’s campaign hasn’t conceded and released this comment Wednesday.
“This race is far from decided and there is no rush to declare an outcome.  Ensuring a fair and accurate counting of all ballots is of the utmost importance.  There are still tens of thousands of absentee ballots to be counted in Palm Beach County and potential provisional ballots across the district,” according to West’s campaign manager Tim Edson.
The Associated Press has not yet called the race because it remains incredibly close.
With 100-percent of precincts reporting, Murphy had 160,328 votes, or 50.4 percent, to West’s 157,782 votes, or 49.6 percent. The two candidates were separated by about 2,400 ballots.
Edson’s statement went on, “Late last night Congressman West maintained a district-wide lead of nearly 2000 votes until the St. Lucie County Supervisor of Elections “recounted” thousands of early ballots.  Following that “recount” Congressman West trailed by 2,400 votes.   In addition, there were numerous other disturbing irregularities reported at polls across St. Lucie County including the doors to polling places being locked when the polls closed, in direct violation of Florida law, thereby preventing the public from witnessing the procedures used to tabulate results. “
West said he will not comment further until after the court case is decided, according to CBS4′s Carey Codd.
Murphy’s slight lead is outside the margin that would require a recount in the Sunshine State.
“If the percentage does not fit within the statutory criteria for recounts, there exists no statutory mechanism for a candidate, group, or anyone else to have a recount done by the state or any supervisor of elections,” Florida elections spokesman Chris Cate told CBS4 news partner the Miami Herald.
Cate continued, “Also, we will not know if a recount is within the required percentage until we receive the first set of unofficial returns from each of the counties involved. They are not due until noon, Saturday.”
The Palm Beach Post reports provisional and absentee ballots in Democratic-leaning Palm Beach County still need to be counted. Murphy’s campaign manager told the newspaper the outstanding ballots weren’t enough to overturn the results.
Representative West is a freshman Republican known across the country for his fiery tea party rhetoric. He has been one of the most outspoken conservatives in Washington, famously saying he knew dozens of Communists in the government.
Democrats had been targeting West’s office to flip. West had raised much more money than Murphy, roughly a 4-1 margin, throughout the campaign capitalizing on his national name recognition.
Twenty-nine-year-old Murphy is a construction executive making his first run for office.”

“FBI launches investigation into fraudulent Florida voter letters”
“The FBI confirmed Wednesday it is investigating fraudulent letters that falsely tell eligible Florida voters they may no longer be U.S. citizens and that they could go to prison if they cast a ballot in the Nov. 6 election.
The Florida Department of Law Enforcement, which launched an investigation Tuesday, the Department of State, local supervisors of elections and the U.S. Postal Service will assist the FBI, said agency spokesman David Couvertier.
“We’re trying to figure out what the trend is, if a specific group of voters was targeted or if it was random,” Couvertier said. “What was the motive? Was it a statement or something done to influence the election?”
Beginning Friday, voters throughout the state started receiving letters in envelopes with a Seattle postmark. The letters all have the same type of letterhead, with the American flag as a backdrop to a silhouette of a bald eagle in the upper left corner. The sender swapped out the name of the supervisor of elections depending on which county they were received. As of Wednesday, the letters were sent to at least 28 counties, according to Division of Elections spokesman Chris Cate.
The letters inform recipients they have 15 days to fill out a voter eligibility form and return it to the elections office. If they don’t, they’ll be removed from the voter rolls, the letter warns.
State officials have interpreted the letters to be a voter intimidation tactic, a third-degree felony punishable by up to five years in jail for each offense, or each letter sent. The FBI would examine federal offenses, including mail fraud.
“We don’t know the extent of the activity yet,” Couvertier said. “We’re looking at everything from civil rights violations to potentially voter fraud and everything in between.”
Couvertier said the Tampa FBI office is working in concert with the other agencies. It covers 18 counties, including Hillsborough, Pasco and Pinellas, all of which got the letters.
Cate said the best estimate of the number of letters sent are “dozens.” The recipients so far tend to be Republican, frequent voters, who may even contribute to campaigns. Ion Sancho, Leon County’s supervisor of elections, has speculated that the names may have been lifted from a donor list. Jacksonville City Council president Bill Bishop, former U.S. Ambassador John Rood, and Lenny Curry, the chairman of the Republican Party of Florida, all got one.
But there are exceptions. Of the eight people to receive the letters in Pinellas, half are Republican.
The hoax is a puzzling one. If the letters were meant to intimidate people from voting, why were they sent to leaders of the Republican Party, where they’re easier to detect?
“There are a lot of theories out there,” Couvertier said. “We’ll be going through them one by one.”

I spoke with a NC GOP official a short while ago. I asked if the federal judge ruling in NC from 2010 is still applicable. He stated that it was. He had the understanding that the local elections board was aware of the ruling. I told him of my experience that the precinct workers were unaware of the federal judge ruling. I do not recall seeing the proper sign & no poll worker brought the issue to my attention, even after I asked.

My concern elevated when I discovered that the problems are still occurring in 2012 after happening in 2008 and 2010.

“North Carolina counties which use touch-screen voting systems will now have to post a “Voter Alert” at precincts warning voters about potential problems with the machines following a complaint [PDF] filed in federal court by the state’s Republican Party on Friday. The lawsuit, heard today on an expedited basis, was filed after voters in several counties hadreported to party officials that their attempts to vote for straight-ticket Republican ballots were flipping on the screen to straight-ticket Democratic ballots.

Those reports of vote-flipping led to the NC GOP issuing a threat late this week to sue the State Board of Elections (BoE) if their demands were not met to order certain precautions be taken at polling places which used the 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting systems. After the Executive Director for the BoE sent a letter in response to the GOP’s demands, downplaying the reported incidents as “isolated” and “no different than ones that must be addressed in every election,” the Republican complaint was filed in federal court on Friday afternoon. (The sharp letters back and forth between the state GOP and BoE can be read in our previous report on the NC situation.)

Judge Malcolm Howard tonight also ordered that pollworkers must tell voters to read the printed alert, and that memory cards and other programming materials, records and audit logs from the oft-failed ES&S iVotronic touch-screen DREs must be preserved for examination after the election. Late today, the BoE Executive Director Gary O. Bartlett sent a notice [PDF] to the County Boards of Elections detailing the changes ordered by the federal judge.

The remedies sought, and gained, by the Republicans, however, fail to address the fact that no matter how “carefully” a voter reviews their on-screen ballot to ensure their “vote is accurately cast”, there is still no way to know that the voting system will record those votes as intended. Moreover, there is no way to know after the election whether the results actually reflect the will of the electorate, as we recently discussed in this article at Slate detailing some of the closest and most-watched races in the nation which will likely be determined on identical or similar 100% unverifiable DRE systems next Tuesday.

Removing systems from service once they are reported to be failing would be the safest way to deal with such problems, but long time North Carolina Election Integrity advocate Joyce McCloy, Director of NC Coalition for Verified Voting and editor of Voting News, explained to The BRAD BLOG tonight that many of the state’s counties wouldn’t have enough machines or back-up paper ballots to handle the election if failing machines were removed from service.

In past elections, most notably in both 2006 and 2008, it has been largely Democratic voters who have complained that their attempted touch-screen votes were seen flipping to Republican (or other party’s) candidates. Little action was taken on their behalf by either elections officials or the Democratic Party. Many of those who complained were tarred as being being “conspiracy theorists” or “sore losers” by Republicans, and both elections officials and voting machine company representatives generally marginalized the complaints as either non-existent or “human error” on the part of the voter.

According to the NC GOP’s attorney Tom Farr, similar arguments were made by the BoE in this morning’s proceedings. “What I heard in the argument today was, the problem with the touchscreen voting machines are the fault of the voters, not the State Board and we have to preserve the integrity of the State Board and its reputation. And that’s more important than making sure that voters had their ballots counted accurately, and that’s what I thought was outrageous,” Farr told the media after the court hearing.

Another report of votes flipping from Republican to the Green Party on a straight-ticket ballot, as caught on cellphone video, occurred last week in Texas (along with a report of another voter who saw his vote flip from Democratic to Republican in a different TX county.) In Nevada a Republican voter claimed her touch-screen vote was pre-selected on screen for Sen. Harry Reid in his tight race against Republican Sharron Angle. In both instances, local election officials downplayed the incidents by blaming the voters.

Such occurrences have marred virtually every election since the proliferation of unverifiable touch-screen voting was enabled by the federal Help America Vote Act (HAVA) of 2002. While many jurisdictions have decertified the systems in favor of paper ballot-based optical-scan systems, some 20 to 30% of the nation’s voters still use DREs at the polling place.

McCloy told The BRAD BLOG this evening that the state had been set to ban DRE systems all together some time ago, until the legislation was scotched after apparent lobbying by election officials in counties who use, and very much like, the systems. Afterwords, the legislation was reportedly modified to allow the touch-screen systems to stay in place.

ES&S voting systems have a storied history of failure. In 2006, the iVotronics were found to have inexplicably failed to record some 18,000 votes in a special election for the U.S. House in Florida (in which the Republican candidate was declared the “winner” by just 369 votes). That incident led to the state getting rid of virtually all of their touch-screen systems. ES&S iVotronics were also used at the polling place for South Carolina’s primary where Alvin Greene, the unemployed South Carolina veteran who failed to campaign or even have a campaign web site, inexplicably defeated four-term state Senator and former Circuit Court Judge Vic Rawl for the Democratic U.S. Senate nomination.”

The attitude of boards of elections in NC seem to best be summed up by the following quote:
