NC voting machine errors update November 6, 2012, 2010 federal judge ruling, SBOE memo, Precincts following rules?, Explicit warning signs and procedures

I spoke with a NC GOP official a short while ago. I asked if the federal judge ruling in NC from 2010 is still applicable. He stated that it was. He had the understanding that the local elections board was aware of the ruling. I told him of my experience that the precinct workers were unaware of the federal judge ruling. I do not recall seeing the proper sign & no poll worker brought the issue to my attention, even after I asked.

My concern elevated when I discovered that the problems are still occurring in 2012 after happening in 2008 and 2010.

Orders ‘voter alert’ posted at polls, programming materials, records retained…”

“North Carolina counties which use touch-screen voting systems will now have to post a “Voter Alert” at precincts warning voters about potential problems with the machines following a complaint [PDF] filed in federal court by the state’s Republican Party on Friday. The lawsuit, heard today on an expedited basis, was filed after voters in several counties hadreported to party officials that their attempts to vote for straight-ticket Republican ballots were flipping on the screen to straight-ticket Democratic ballots.

Those reports of vote-flipping led to the NC GOP issuing a threat late this week to sue the State Board of Elections (BoE) if their demands were not met to order certain precautions be taken at polling places which used the 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting systems. After the Executive Director for the BoE sent a letter in response to the GOP’s demands, downplaying the reported incidents as “isolated” and “no different than ones that must be addressed in every election,” the Republican complaint was filed in federal court on Friday afternoon. Judge Malcolm Howard tonight also ordered that pollworkers must tell voters to read the printed alert, and that memory cards and other programming materials, records and audit logs from the oft-failed ES&S iVotronic touch-screen DREs must be preserved for examination after the election. Late today, the BoE Executive Director Gary O. Bartlett sent a notice [PDF] to the County Boards of Elections detailing the changes ordered by the federal judge.

The remedies sought, and gained, by the Republicans, however, fail to address the fact that no matter how “carefully” a voter reviews their on-screen ballot to ensure their “vote is accurately cast”, there is still no way to know that the voting system will record those votes as intended. Moreover, there is no way to know after the election whether the results actually reflect the will of the electorate, as we recently discussed in this article at Slate detailing some of the closest and most-watched races in the nation which will likely be determined on identical or similar 100% unverifiable DRE systems next Tuesday.

Removing systems from service once they are reported to be failing would be the safest way to deal with such problems, but long time North Carolina Election Integrity advocate Joyce McCloy, Director of NC Coalition for Verified Voting and editor of Voting News, explained to The BRAD BLOG tonight that many of the state’s counties wouldn’t have enough machines or back-up paper ballots to handle the election if failing machines were removed from service.

In past elections, most notably in both 2006 and 2008, it has been largely Democratic voters who have complained that their attempted touch-screen votes were seen flipping to Republican (or other party’s) candidates. Little action was taken on their behalf by either elections officials or the Democratic Party. Many of those who complained were tarred as being being “conspiracy theorists” or “sore losers” by Republicans, and both elections officials and voting machine company representatives generally marginalized the complaints as either non-existent or “human error” on the part of the voter.

According to the NC GOP’s attorney Tom Farr, similar arguments were made by the BoE in this morning’s proceedings. “What I heard in the argument today was, the problem with the touchscreen voting machines are the fault of the voters, not the State Board and we have to preserve the integrity of the State Board and its reputation. And that’s more important than making sure that voters had their ballots counted accurately, and that’s what I thought was outrageous,” Farr told the media after the court hearing.

Another report of votes flipping from Republican to the Green Party on a straight-ticket ballot, as caught on cellphone video, occurred last week in Texas (along with a report of another voter who saw his vote flip from Democratic to Republican in a different TX county.) In Nevada a Republican voter claimed her touch-screen vote was pre-selected on screen for Sen. Harry Reid in his tight race against Republican Sharron Angle. In both instances, local election officials downplayed the incidents by blaming the voters.

Such occurrences have marred virtually every election since the proliferation of unverifiable touch-screen voting was enabled by the federal Help America Vote Act (HAVA) of 2002. While many jurisdictions have decertified the systems in favor of paper ballot-based optical-scan systems, some 20 to 30% of the nation’s voters still use DREs at the polling place.

McCloy told The BRAD BLOG this evening that the state had been set to ban DRE systems all together some time ago, until the legislation was scotched after apparent lobbying by election officials in counties who use, and very much like, the systems. Afterwords, the legislation was reportedly modified to allow the touch-screen systems to stay in place.

ES&S voting systems have a storied history of failure. In 2006, the iVotronics were found to have inexplicably failed to record some 18,000 votes in a special election for the U.S. House in Florida (in which the Republican candidate was declared the “winner” by just 369 votes). That incident led to the state getting rid of virtually all of their touch-screen systems. ES&S iVotronics were also used at the polling place for South Carolina’s primary where Alvin Greene, the unemployed South Carolina veteran who failed to campaign or even have a campaign web site, inexplicably defeated four-term state Senator and former Circuit Court Judge Vic Rawl for the Democratic U.S. Senate nomination.”

The attitude of boards of elections in NC seem to best be summed up by the following quote:

  11. Election 2012: How The Winner Will Destroy America

    Of all the hollow and uninspired elections that this country has suffered through over the past several decades, one might think that at some point long ago the American public would have finally struck a plateau of disenfranchisement; that we could sink no further into despondency, that there is a saturation limit to the corruption of our voting process. Unfortunately, there has been no such luck. I have to say that in all honesty I have never seen more people gut jumbled and disgusted with our electoral system than I have in 2012. Sure, there is still a hyper-gullible segment of the populous that continues to play the game, but even those idiots are beginning to admit that the choices offered are dismal at best, catastrophic at worst. The fog of the false Left/Right paradigm is starting to lift, and all that lay in its wake is a hoard of lost wide-eyed flabbergasted followers without a coattail or a talking point to cling to. Sudanese refugees have a better chance of survival than these people do…

    Even in the more obvious of fraudulent past elections there was at least an attempt by the establishment to present a pageant of conflicting ideologies (George W. Bush vs. John Kerry comes to mind). There has always been the Democrat who pretends to be anti-war, or the Republican who pretends to be small government, or the Democrat who pretends to defend our right to privacy, and the Republican who pretends to be pro-2nd Amendment. But in 2012, even the theater of rhetoric has disappeared. Both primary party candidates seem to be sharing the same intestinal tract and the same teleprompter, and now, the average American is asking a new set of questions. They do not wonder how these men will change things for the better. Not at all. Instead, they wonder which one will do LESS DAMAGE while in office. This is the terrible reality we have come to understand in our society today. It is a sad awakening, but a necessary one.

    As you read this now, the new President of the United States is being “chosen” or has been chosen. Whoever the “winner” happens to be is ultimately irrelevant. They do not count. They are mascots. Middle management cronies running through the motions to distract the masses while enacting the policies of their superiors. They are fry cooks serving greasy overpriced democracy with no real sustenance. What does matter, though, is what comes next. I’m sorry to say that the idea that one man will do less damage than the other is a naïve sentiment. Democrat? Republican? Obama? Romney? The crimes and calamities wrought will be exactly the same. Take a look into my crystal ball and see the future. Here is how the winner will destroy America…

    1) He Will Continue The Policy Of Dollar Devaluation

    Neither candidate has expressed any interest through the election or even before it to protect the value of our currency, and both candidates have supported steps towards quantitative easing and fiat printing in order to delay an inevitable national debt crisis. Both Romney and Obama have sung the praises of Ben Bernanke (Romney changed his tune just in time for his campaign, but who’s buying that?) and the private Federal Reserve despite the consistent failures of that despotic institution to produce any tangible economic results with their Keynesian methods.

    The dollar will see a vast devaluation during the term of this candidate and a loss of world reserve status, leading to stagflation (a combination of the worst elements of deflationary and inflationary crises in the same event). Skyrocketing prices and crumbling unemployment will be the highlights of his presidency, because he will never take measures to reign in or dismantle the primary root cause of the problem; the Federal Reserve itself.

    2) He Will Continue Extreme Government Debt Spending

    Neither candidate has offered a practical or operable solution to the $16 trillion official national debt problem we now face, let alone the tens of trillions of dollars in entitlement obligations that the Treasury Department never talks about. A nation can only live off food stamps and credit for so long before it implodes like a wet paper sack. And this is exactly what we have become; an entire culture of debt addicts and money hounds searching for our next fix of foreign or central bank cash. The fact is, both Obama and Romney would INCREASE spending while using fiat injections to buttress an ever weakening economy in the name of “stability”. The new president will claim that if spending cuts are initiated, it will send the U.S. financial system into a tailspin and a “return” to recession conditions. This will of course be a lie. We have not left recession/depression conditions since 2008.

    3) He Will Support And Expand On Wars In The Middle East

    There is no such thing as a mainstream “anti-war candidate” in 2012. Not even a fake one. Obama’s measures of state violence and complete lack of respect for the sovereign internal matters of foreign nations surpass the madness of George Bush Jr. He has even gone so far as to assert that his office has the right to assassinate American citizens without trial, evidence, or due process of the law. Not only has he asserted the right to this power, he has used it! Romney’s position, hilariously, is that Obama has not gone far enough! Either way, the winner in 2012 is going to leap like a vile locust into new countries and unleash a plague of laser guided death. The next president WILL be a war hungry president.

    4) He Will Lock Down The Web And Limit Internet Speech

    Both Romney and Obama have expressed a desire to establish cybersecurity measures which include vast new governmental authority over the functions and operations of the internet. The ultimate goal? To gain legal precedence for the right to dictate web content, up to and including the ability to label any website a subversive threat to national security or a recruitment tool for “extremists”.

    With the establishment spreading completely baseless accusation of cyberthreats coming from every corner of the globe (but mostly from Iran) it would seem that they are conditioning the public for a future encounter with a cyber event, and telling them who to blame when it occurs. The problem is, the most prominent cyber security threats to the internet in the past few years have come not from the Middle East, or Russia, or China, but the U.S. and Israel (Stuxnet anyone?). Keep this in mind when our new president blames the next cyber attack on a convenient political target and then uses the event as an excuse to regulate the web.

    5) He Will Erase American Civil Liberties

    This president will find a reason, or he will create a reason to diminish Constitutional protections including our right to trial and due process. Both candidates have offered unflinching support for the National Defense Authorization Act and its provisions for indefinite detainment. Neither man has ventured any sincere concerns over the broad nature of the language involved in the labeling of “terrorists” and “extremists”. Literally anyone can now be categorized as an enemy combatant and a threat to national security for almost any reason, and this appears to be the way Obama and Romney like it. That is to say, they both want totalitarian powers, or at the very least, they have made no effort to turn them down.

    It is important to note that there has never been a government in history that sought out such powers and did not actually use them. Only a fool would assume his favorite elitist candidate in 2012 will not utilize the extreme authorities now amassed for the executive branch over the past decade.

    6) He Will Embrace A Globalist Dynamic And Abandon American Sovereignty

    Both Barack Obama and Mitt Romney are surrounded by “advisers” who are also members of the Council On Foreign Relations, an institution which openly calls for the dissolution of American sovereignty on a regular basis and the creation of a centralized global system dominating the financial, social, and political life of every nation in the world. With the economic stability of the U.S. on the verge of oblivion, it is very likely that a historic crisis will ensue during the first term of the next president, and that he will in response suggest a new global system as the solution.

    This system has already been created, in part, by the IMF and World Bank in concert with member governments and revolves around the issuance of a new world reserve currency (Special Drawing Rights) as the centerpiece. I can guarantee with absolute certainty that the next president, regardless of who he happens to be, will promote an IMF rescue package coupling the dollar to the SDR and turning over full economic control of America to an international body. He will make it sound rational, reasonable, and even advantageous, but in the end, he will be selling the globalist snakeoil he was conscripted to sell before his election campaign ever started.
    In 2012, it will not be about voting. It will not be about “winning”. It will not even be about getting to the next election. It will be about survival. As big a joke as the 2012 elections have become even to the generally unaware, I am not laughing. I do not need to look at the promises of either candidate. I do not need to weigh their half-assed quick fix policies. All I have to do is look at the current downward trend and understand that the president, whoever he may be, will continue it. If anything is to truly change, it will be because we as Americans finally walk away from the game, enacting our own solutions and our own opposition instead of handing over our power to sniveling errand boys wrapped in flags and expensive suits and self-rightousness every four years. 2012 is going to be the beginning of upheaval and renewal, for better or for worse, and it is certain that the guy in the White House into 2013, Republican or Democrat, is going to be a part of the problem, nothing more…

Upon landing here in Pittsburgh, Romney’s aides appeared shock as they crowded around the windows to check out the crowd.

    And Romney was visibly moved at the site of the crowd, hundreds of supporters crammed into a parking structure just outside the airport.

    Romney deplaned and walked toward a fence that separated him from the crowd, packed onto two levels of the garage.

    He waved to the group with his left hand and placed his right hand over his heart for several minutes as they cheered.

    Asked by ABC News how it felt to receive such a welcome, Romney turned and responded, “That’s when you know you’re gonna win.”

The problem is that, based upon existing circumstances (hard, as opposed to political or theoretical), it is quite unrealistic…at least in the near term…maybe one day when the stakes are not so high…sigh! . I hope it is within their (him/her) lifetime…In the meantime , we have no viable choice but to play the absolute best we can with the cards we’ve been dealt…

There has been so much fraud, machines flipping votes, intimidation, Somalians bussed to vote, people bragging they’ve voted five times. It is a sad commentary. I will continue to pray for R& R .     Our work here is far from finished no matter who wins this election…As I stated earlier, Romney is a moderate, so forget him going after Obama, or anyone else for that matter…It is even questionable that he will defer to Congress on any of these issues either. besides, Romney will have more than enough on his plate going in, should he win.
    We the people will remain tasked with those responsibilities, as we have been on our own for a long time now anyway. We’ll still be in a mess, but the plan is coming together…patience is a virtue…

    You are exactly right about our work being far from finished. If Romney becomes our next President he is very unlikely to personally pursue criminal action against Obama or any of his minions.

    As you say, he will have enough work ahead of him, and I suspect that he would feel that such pursuit would be nonconstructive and divisive. His motto will be to move on and encourage cooperation between the parties. If that is his choice, I will personally trust his judgment as long as he abides by the Constitution.

    Some time ago, on this very blog, I warned those visiting here that what we are experiencing is a communist takeover. Not many want to use such a severe-sounding assessment, as they prefer not to think about it in those stark terms.
    Not only is it a communist takeover, but it is essentially… a by-the-numbers communist takeover, which is the only way communists are able to function. They are, after all, quite predictable.. Based upon what I have seen this election cycle, this country no longer, as a majority, identifies with the essential priciples, which for so many years, have kept us safe from such an event.
    I also mentioned that the internet and the vote were the only tools available to us to push back against the tremendous momentum which has been built up by the left over the years now. If we cannot break this thing now, then I’m afraid we are witness to the early years of the Bolscheviks as they so unceremoniously trashed the Russian establishment. Who would have thought that the next victim could possibly be the US.
    Control of information is paramount to the success of the communist movement, therefore I recommend we get cracking. I see an electorate that is so much more informed than it was in ’08, but there is so much more to be done. A simple majority will never be enough, as their numbers will now grow exponentially.

  97. Friends, the election is not over. The Electorial College doesn’t meet until December 17. And the Electors are yet to be chosen. For what it may be worth, the Bible Code strongly indicates to me Joe Biden as 45th US President and Mitt as 46th. I correctly predicted George W. Bush as the 43rd US President before he was elected based on encryptions in the Torah. Somehow, I speculate from the Torah Code, Obama will be removed from office before the Electors meet. Biden will then be sworn in as the 45th. The Electors will then decide on Romney rather than Biden.

    I am a long time student of the Torah Code. The Code is a very amazing aspect to the Torah. G-d is in charge. I could be wrong, but I believe my interpretation of the encryptions on this matter is correct.

    A couple days ago, the Blaze reported that approximately 1.6 Million Christians would be by writing in Jesus Christ for President on Tuesday. I saw yard signs for this endeavor in Virginia.

    I also heard Amish and Mennonites which have large communities in PA and OH did not vote.

    The race may have gone a different way, had these folks not wasted their vote and others not voted at all.

    Those who did not vote should not complain when the rest of their religious liberties are taken away.

    I did not expect Obama’s base to turn out like it did but I heard two days ago that folks with Obama phones and free Internet were sent messages to vote or loose their phone/Internet. Apparently, they got the message loud and clear.

    And with this news will also come, I predict, more grave natural disasters upon this country….God is not mocked….and these will actually be a sign of His Mercy of not abandoning us, but to call us back to repentance.

    A rep from Jarrett office was in today. She gave us a finish line pep talk and then afterwards, heard her saying how Jarrett is very excited about a 2nd term agenda and a big part of that agenda is to punish everyone who opposed them during the first term and the campaign…The part that really stuck out to me was when I overheard the rep say that Jarrett told them, “After we win this election, it’s our turn…The part that really stuck out to me was when I overheard the rep say that Jarrett told them, “After we win this election, it’s our turn. Payback time. Everyone not with us is against us and they better be ready because we don’t forget. The ones who helped us will be rewarded, the ones who opposed us will get what they deserve. There is going to be hell to pay. Congress won’t be a problem for us this time. No election to worry about after this is over and we have two judges ready to go.”
