“Blagojevich’s lawyers to ask full court to rule on appeal

Lawyers for former Gov. Rod Blagojevich plan to ask the full 7th U.S. Circuit Court of Appeals to decide his appeal after a three-judge panel of the court recently upheld 13 of the 18 counts on which he was convicted.

Blagojevich’s appellate lawyer, Leonard Goodman, said he would file for the en banc hearing by the deadline Tuesday.

In its July 21 decision, the three-judge panel threw out five counts and ordered his 14-year sentence vacated, but tempered the small legal victory by calling the evidence against Blagojevich “overwhelming” and making it clear he will likely remain locked up for years to come.

The same judge who imposed the original sentence — a frequent target of the defense for his alleged unfairness — will decide Blagojevich’s punishment.”

At the news conference, Goodman said he was stunned that the court didn’t address many of the alleged evidentiary errors that the former governor’s appeal raised.

“And the ones it does address, it gets it wrong,” said Goodman, referring in particular to the trial judge’s decision to exclude testimony from Blagojevich that he believed his actions were lawful. “So it’s shocking to me that after a year and a half this could be the result of the court’s work.””

Three months ago, just as the last Census Homeownership and residential vacancy report hit, Gallup released its latest survey which confirmed just how dead the American Dream has become for tens if not hundreds of millions of Americans.

According to the poll, the number of Americans who did not currently own a home and say they do not think they will buy a home in “the foreseeable future,” had risen by one third to 41%, vs. “only” 31% two years ago. Non-homeowners’ expectations of buying a house in the next year or five years were unchanged, suggesting little change in the short-term housing market.

As Gallup wryly puts it, “what may have been a longer-term goal for many may now not be a goal at all, and this could have an effect on the longer-term housing market.””

“Earlier today, the US Census released its latest homeownership data, which confirmed that for what is left of America’s middle class, owning a home has become virtually impossible, with the homeownership rate plunging from the lowest level since 1986, or 63.7%, to just 63.4% the lowest reading since the first quarter of 1967.

Three months ago, when compiling this data we said that “at this rate, by the end of the 2015 and certainly by the end of Obama’s second term, the US homeownership rate will drop to the lowest in modern US history.” That moment, as shown on the chart below, came far sooner than ever we had expected. The only question is whether the lowest homeownership print on record reported in 1965 and standing at 62.9% will be taken out in the next 2 quarters or in early 2016.”

Still, the ongoing death of the middle class is not bad news to everyone: landlords, of which private equity firm Blackstone recently became the biggest in the US, are reaping unseen profits courtesy of runaway inflation in at least one item: rent.

Because as homeownership falls, demand for rental housing is booming. The vacancy rate for rented homes in the U.S. fell to 6.8% in the first quarter from 7.5% a year earlier. It was the lowest first-quarter rate since 1986.

And the punchline, which should come as no surprise to anyone: the median monthly asking rent just rose to a record $803 across the US.”

“An appeals court vacated five convictions and threw out the sentence of former Ill. Gov. Rod Blagojevich on Tuesday afternoon. The rest of Blagojevich’s convictions were affirmed by the 7th U.S. Circuit Court of Appeals in Chicago.”

“”My advice to the governor is he should fight on,” said Leonard Goodman, Blagojevich appellate attorney.

If Blagojevich chooses to appeal, he must tell the court within the next two weeks. But with five counts thrown out, the former governor will at some point be re-sentenced, and his attorneys will argue that his 14 years be dramatically reduced.

“Most people would look at this and say ‘Wow, if a quarter of his counts were reversed, and so a quarter of his sentence should be taken off’ – but that’s not the way that it works,” said Lauren Kaeseberg, Blagojevich attorney.

Trial Judge James Zagel could reduce the sentence, but guidelines also would permit him to leave it unchanged. The Blagojevich family hopes the former is the case.”

“If the prosecutor elects to drop the vacated charges, the district court could proceed directly to re-sentencing on the remaining 13 convictions only, according to the court document USA v. Rod Blagojevich.”

“Prosecutors have not said if they will retry Blagojevich, who is currently serving time in a Colorado prison. However, experts say it’s unlikely.

“They have two choices. They can retry the counts or just go to sentencing. And when you look at the three prosecutors that led this charge: two of them have already left the office… the last one just got appointed a state judge the other day. So it’s safe to say they’re not going to retry those counts,” former prosecutor Jeff Cramer said.

Resentencing Blagojevich, who has maintained he was engaged in legal, run-of-the-mill politics, will fall to Judge James Zagel. In the appeal, Blagojevich blamed Judge Zagel for a litany or errors.”

“”Time has passed. And Judge Zagel is a fair man. And I would expect that having those counts thrown out will cause the judge to reconsider the sentence,” Goodman said.”

Goodman said his advice to Blagojevich will be to continue to fight the case.

“The evidence that would have acquitted him was excluded at trial, and my advice to the governor is that he should fight on,” Goodman said.

Goodman said he had not yet spoken to his client so he wasn’t sure about the next course of action, but he said he has options, including trying to get the case heard by the U.S. Supreme Court.

“Exactly the order of the proceedings will be up to the governor,” Goodman said.

Goodman took issue with the court, saying it made serious errors in its decision. He said the court was wrong when it supported the trial judge’s decision to exclude testimony from Blagojevich that he believed his actions were lawful.
“That is not the law. The Supreme Court just ruled this term that guilty knowledge is an element of proof for any criminal offense and this is no exception,” Goodman said. “This is pure politics. What he did was try to raise campaign cash, which is his job as governor.””

Forget the impact of an influx of Iranian oil on market prices.

The price of oil is artificially low now and will shoot back up eventually.

Russia stands to gain much when sanctions are lifted on Iran as it lost much when they were imposed.

And don’t forget, any of the theoretical new sanctions or punishments that could  be imposed on Iran can be vetoed by Russia.

“On January 20, Russian Defense Minister Sergei Shoigu and his Iranian counterpart, Defense Minister Hossein Dehghan, signed an intergovernmental agreement on “long term and multifaceted” military cooperation in Tehran, Iran. It is the first time in 15 years that a Russian defense minister has visited Iran and underlines the growing military and diplomatic ties between both countries united by their joint opposition to U.S. foreign policy in the Middle Eastern region and beyond.

According to Sputnik News, defense minister Hossein Dehghan is quoted as saying that during bilateral discussions, “the importance of the need to develop Russia and Iran’s cooperation in the joint struggle against meddling in the affairs of the region by external forces that are not part of it was framed.” Dehghan noted that they singled out the U.S. policy that “meddles in the domestic affairs of other countries” as a major reason for the deteriorating security situation in the Middle East and the rest of the world today.

According to the Associated Press, Dehghan furthermore emphasized that, “Iran and Russia are able to confront the expansionist intervention and greed of the United States through cooperation, synergy and activating strategic potential capacities. … As two neighbors, Iran and Russia have common viewpoints toward political, regional and global issues.”

For example, Russia and Iran are both continuing their support of the Assad regime in Syria.”

“Second, full-fledged military cooperation between Iran and Russia can only happen once UN sanctions have been lifted. This largely depends on Tehran’s willingness to reach a mutually acceptable agreement in the P5+1 negotiations over Iran’s nuclear program.  Only then can full-fledged arms sales resume. In October 2011, Russia made its last and so far only public arms sale to Iran in the form of a radar-jamming station. Back in the year 2000, Iran was the fourth largest importer of Russian military equipment placing right after China, India, and the United Arab Emirates, buying 6.1 percent of Russia’s total arms exports. Sputnik News quotes the Center for the Analysis of World Arms Trade in Moscow, which estimated that the Russian defense industry has lost around $13 billion in arms sales due to UN sanctions against Iran.”

The deal reopens the door for lucrative contracts to expand Iran’s civilian nuclear energy program, which Russia has been looking forward to for years. And it may neutralize a major reason the United States has offered for developing a missile defense system in Europe, a project that President Vladimir V. Putin and other Kremlin officials have said was a threat to Russian security.”

“Mr. Putin himself issued a statement on Tuesday welcoming the deal, underlining Russia’s role and noting that his government would move ahead with its nuclear power agreements and with strengthening bilateral ties.

He described the accord as “important for the implementation of large-scale plans of peaceful nuclear cooperation between Russia and Iran that got support in the documents approved today.”

Russia possesses some of the world’s foremost expertise in atomic energy, and has helped build and operate atomic reactors in Iran for many years. Rosatom, the Russian state nuclear energy company, helped build and expand the Bushehr nuclear plant and already has contracts to build two more reactors there.

Mr. Lavrov said Russia and Iran have “very ambitious plans for the development of Iranian nuclear power.” He also said Russia expected to have a major role in putting the accord with Iran into effect, including two areas specified in the agreement: the shipment of low-enriched uranium from Iran to Russia in exchange for supplies of natural uranium, and the modification of the Fordo enrichment processing plant to produce stable isotopes for medical and industrial purposes instead of bomb fuel.

Beyond the energy sector, Russia expects to make substantial sales of conventional weapons to Iran. In the late stages of negotiations, Mr. Lavrov made a hard, dramatic push for an immediate and complete lifting of an international arms embargo against Iran, apparently helping set the stage for a deal.

In the end, a compromise was reached that will continue the embargo for five to eight years. Still, Mr. Lavrov suggested that Russia stood to benefit even sooner from renewed arms deals with Tehran because exceptions would be allowed under new notification and United Nations approval procedures.”

“While the rest of the world was paying attention to the sad conclusion of the Greek tragedy now in its third bailout season, the US was focused on a another tragedy playing out in the nation’s heartland when in the latest mass shooting on US soil, 4 marines were killed when a gunman, since identified at Mohammod Youssuf Abdulazeez, 24, a naturalized citizen born in Kuwait, opened fire first at a military recruiting center and then at a Naval Reserve Center in Chattanooga, Tennessee in what officials have called a “brazen, brutal act of domestic terrorism.””

“According to Reuters, the suspect, seen driving an open-top Ford Mustang, is believed to have first gone to a joint military recruiting center in a strip mall and sprayed it with gunfire, riddling the glass facade with bullet holes.

“Everybody was at a standstill and as soon as he pulled away everyone scrambled trying to make sure everyone was OK,” said Erica Wright, who works two doors down from the center.

The gunman then drove off to a Naval Reserve Center about 6 miles away, when around 10:45 am local time, he shot four Marines before being shot and killed in a firefight with police about half an hour later. Three others were wounded in the attacks, including a police officer reported in stable condition and a Marine.””

“The FBI said it was too early to speculate on the motive for the rampage although in a follow up report we learned that the 24 year old had blogged as recently as Monday that “life is short and bitter” and Muslims should not miss an opportunity to “submit to Allah,” according to an organization that tracks extremist groups.

The SITE Intelligence Group said a July 13 post written by suspected gunman Mohammod Youssuf Abdulazeez stressed the sacrifice of the Sahaba (companions of the Prophet) “fought Jihad for the sake of Allah.” Reuters could not independently verify the blog postings. Tangentially, Site Intelligence which has been most famous recently for being the first to track down and release most of ISIS’ barbaric if Hollywood-style produced YouTube clips, was founded by Rita Katz who prior to her intelligence career served in the Israeli Defense Forces.

Further ties linking the shooting to terrorist Islamist elements emerged when the NYT reported that the father of a suspected gunman who killed four Marines in Chattanooga, Tennessee, on Thursday was investigated several years ago for “possible ties to a foreign terrorist organization.”

Citing unnamed law enforcement officials, the paper said the gunman’s father was at one point on a terrorist watch list and was questioned while on a trip overseas.

The paper quoted an official as cautioning that the investigation was several years old and had not generated any information on the son. The father was eventually removed from the watch list, the paper quoted the official as saying.

According to another, unconfirmed report, an Islamic State affiliated Twitter account tweeted about the Chattanooga military reserve center shootings by Muhammad Youssef Abdulazeez just as they began.”

Unemployment rate

Even Factcheck.org, clearly a pro Obama  site, lends credence to Donald Trump’s claims about the real unemployment number.

“Real” Unemployment: Trump said, “[O]ur real unemployment [rate] is anywhere from 18 to 20 percent. Don’t believe the 5.6. Don’t believe it. … The real number is anywhere from 18 to 19 and maybe even 21 percent.”

We see no factual basis for this claim. Trump is going well beyond the exaggeration that Mitt Romney made during the 2012 campaign that the “real” unemployment rate was 15 percent. And back then, the official rate was 8.3 percent, compared with the current rate — which is actually 5.5 percent, not the 5.6 percent Trump cited.

Romney was referring to an alternative measure that is meant as the broadest measure ofunder-employment. That measure — called “U-6″ — adds in people who have part-time jobs but are looking for full-time work, “discouraged workers” who aren’t looking for work because they don’t believe jobs are available, and all others “marginally attached” to the workforce, meaning those who say they want to work and would work if offered a job, and who have looked for work sometime within the past year but not within the last four weeks. (Only those who say they have looked for work in the last four weeks are officially counted as unemployed.)

Currently, that U-6 rate stands at 10.8 percent, well below where it was in 2012, though still not down to the 8.4 percent rate of November 2007, the month before the Great Recession of 2007-2009 began.

So where does Trump get his 18 percent to 21 percent range? The highest number we found from any economist comes from Peter Morici, an economist at the University of Maryland, who has argued that the “real” rate is “at least 18 percent.” In addition to categories included in the U-6 measure, Morici counts what he calls “the effects of immigration.” And he also adds in the “many” students who are being “duped” into applying for “useless programs” at universities and for-profit schools.

“They would likely be in the labor force now but for easy access to federally sponsored loans,” Morici wrote. “Adding in these students, the real unemployment rate among U.S. citizens and permanent residents is at least 18 percent.”

But even that 18 percent estimate is a bit out of date. The U-6 rate has dropped another 1.4 percentage points since his article was published on July 31, 2014. Morici, in a telephone interview, said that if he were to run his calculations again, the “real” rate would likely be “in the range of 15 percent now.”

Rezko was sentenced to 10 1/2 years for extorting millions of dollars from firms seeking state business or regulatory approval while he was a top fundraiser and adviser to then-Gov. Rod Blagojevich.

He was furloughed Tuesday morning, according to Ed Ross, a spokesman for the Federal Bureau of Prisons.”

“Rezko, an immigrant with an American rags-to-riches story, also pleaded guilty in October 2010 to a separate federal fraud charge over the bogus sale of his pizza restaurants.

Over the years, Rezko raised money for scores of local politicians, including Mayor Harold Washington and President Barack Obama.

Recently Obama, the liar in chief, boasted to students at the University of Wisconsin that he created 12.8 million jobs.

The following comes straight from the US Labor Department website.

White Americans employed.

January 2009: 116,863,000 .

June 2015: 117,942,000.

That’s just over a million.

December 2007: 120,003,000.

We are not even close to pre recession levels.

Nor have we provided for population growth.

The media reports continue to claim that we are adding jobs every month.

What they are not telling you, the truth, is that white Americans and young native born Americans are being decimated in the job market.

One of the reasons for this is the influx of illegal aliens who are in fact taking jobs from native born Americans.

And yes, Donald Trump is correct.

They are bringing crime and using our resources at taxpayer expense.

Data from the US Labor Department reveals the impact on white Americans.

There were 106,000 fewer white Americans employed in June.

There were 339,000 more not in the labor force.

Since Obama took control in January 2009, the labor force participation rate for whites has dropped 3.3 percent.
