Rod Blagojevich, Tony Rezko, Stuart Levine and Barack Obama are once again being visited by the Ghost of Christmas Past.

“Centegra Health System’s plan to build a hospital in Huntley was subjected for the first time Wednesday to public reaction, and it generally was split between other hospitals saying the proposal would drive up health costs and local people believing it was needed and wanted.

The public hearing at Huntley Village Hall was moderated by two officials of the Illinois Health Facilities and Service Board, which must approve any new medical proposal. The board later will hold a hearing on a competing plan by Mercy Health System to build a hospital in nearby Crystal Lake.”

“Mercy Health System is proposing to build in Crystal Lake at Route 31 and Three Oaks Road. Its hospital would include 100 acute-care medical and surgery beds, 20 obstetric and eight intensive care units, an emergency department and a focus on geriatrics. Mercy also is touting its proposed multi-specialty clinic of 45 physicians that would be attached to the hospital.

Mercy’s project would cost $200 million and be paid for with $176 million in bonds and $20 million in cash and securities. The hospital has a planned opening of early 2014.

This isn’t the first time Mercy officials have sought a certificate of need for a hospital in Crystal Lake.

A proposal for 70 beds was shot down by the state board in 2003. Mercy tried again in April 2004 and was awarded the certificate as board members became the target of a federal corruption investigation.

A few months later, former Gov. Rod Blagojevich and state lawmakers revamped the board. The Tribune reported in June 2005 that then-board Vice Chairman Stuart Levine planned to split a $1.5 million kickback with former Blagojevich fundraiser Antoin “Tony” Rezko from contractor Jacob Kiferbaum, who was to build the hospital.

Judge Maureen McIntyre revoked Mercy’s permit for the proposed hospital in May 2005. Mercy officials, never charged with any wrongdoing, did not appeal.

The state health facilities board tentatively plans to vote on both proposals May 10.”

“Lawyers for Rod Blagojevich asked a federal judge Monday to let them play more than 100 undercover recordings at the former governor’s retrial, maintaining they disprove the heart of the government’s charges that he was trying to sell a U.S. Senate seat.

Within a few hours, the prosecution fired back, calling the request a “redux” of arguments from the first trial and questioning Blagojevich’s intentions.

“It is unclear what purpose the defendant’s motion serves other than to potentially influence prospective jurors,” the government wrote.

Blagojevich’s legal team also accused the government in its filing of trying to sway public opinion, calling prosecution assertions at the time of his arrest that Blagojevich was selling the Senate seat vacated by President Barack Obama a “sensationalized false narrative” that “tainted the jury pool.”
Jurors deadlocked on 23 of the 24 counts against Blagojevich in his first corruption trial last summer, finding him guilty on one count of lying to federal investigators. He faces a retrial on April 20 on the 23 counts on which the jury deadlocked.

The defense team contends the 115 undercover recordings would show jurors that Blagojevich was not trying to sell the Senate seat but rather was negotiating a political deal to name Attorney General Lisa Madigan to the spot.”

I agree with the following statement:

“Blagojevich’s legal team also accused the government in its filing of trying to sway public opinion, calling prosecution assertions at the time of his arrest that Blagojevich was selling the Senate seat vacated by President Barack Obama a “sensationalized false narrative” that “tainted the jury pool.””

The Citizen Wells blog has consistently stated that the alleged selling of the senate seat was a clever diversion from the many years of corruption that Blagojevich, Rezko, Levine and Obama were involved in.

Do you suppose that the defense team is ready to throw Obama under the bus?

William Cellini trial, Chicago Tribune article removed?, Blagojevich Cellini Rezko Levine Obama, Chicago Pay to play politics

I was doing some followup research on William Cellini, who was a codefendant in the original Blagojevich indictment and later indicted separately, and referencing Citizen Wells and Chicago Tribune articles. I noticed two interesting things when I searched the internet and Tribune site for articles on Cellini. There seemed to be a lack of articles from 2010 and when I clicked on a Citizen Wells article link to the Tribune, the article was missing. This is what I discovered.

Cellini is accused of helping shake down a Hollywood producer and politically connected Chicago investor Thomas Rosenberg for $1.5 million in campaign cash for Gov. Rod Blagojevich. Cellini also is accused as a point man in a plot to remove U.S. Atty. Patrick Fitzgerald as federal prosecutor.”

Cellini really began to pile up the cash when then-Gov. Thompson gave him a state gaming license. Webb and Zagel were young prosecutors under then-U.S. Atty. Thompson. Later, Zagel was director of the state’s Department of Revenue under Thompson. Webb ran the State Police.
Everybody knows somebody. So, no, Illinois politics isn’t a Robert Ludlum novel.

“The Combine wants Fitzgerald promoted out of town. But President-elect Barack Obama has promised newspaper editorial boards he would keep Fitzgerald in Chicago to fight political corruption.

That’s the same President-elect Obama with Mayor Daley’s guy Rahm Emanuel as his chief of staff, and another Daley guy, David Axelrod, as Obama’s chief strategist. The mayor’s brother Billy is one of Obama’s chief economic advisers. Whew!

Some political analysts become quite upset when “Daley machine” and “Obama” are mentioned in my column. They feel compelled to give me a vigorous corrective. But this same Flat Earth society denied the existence of a Combine for years, then shut up for a while when Obama’s real estate fairy Tony Rezko was convicted in the federal government’s Operation Board Games probe.”

Obama was chairman of the Senate Health & Human Services Committee in January 2003. A few articles in the media have mentioned that Obama sat on a committee that reviewed matters related to the Planning Board in conjunction with the Governor’s staff but none have discussed his integral part in getting the bill passed.

A review of senate records from January 2003 to August 2003, shows Obama played a major role as chairman of that committee, in pushing through Senate Bill 1332, that led to the “Illinois Health Facilities Planning Act,” which reduced the number of members on the Board from 15 to 9, making the votes much easier to rig.”

“The bill was filed with the senate secretary on February 20, 2003, and assigned to Human Services Committee for review on February 27. Less than a month later, as chairman, Obama sent word that the bill should be passed on March 13, 2003.

On May 31, 2003, the House and Senate passed the bill and the only senator listed in the “yes” votes mentioned in the Board Games indictments is Obama.

Blagojevich made the effective date June 27, 2003, and the co-schemers already had the people lined up to stack the Board and rig the votes with full approval from Obama.”

“During the trial, Stuart Levine testified that when he sought reappointment to the Planning Board, he told Republican co-schemer, Bill Cellini, to tell the Blagojevich administration he would vote however they wanted when approving projects.”

“A June 2003 email exchange produced in the trial shows Obama was one of eight officials who received the names of the nominees for the new Board ahead of time, from the office of David Wilhelm, who headed Blagojevich’s 2002 campaign for governor.”

“A few weeks later, Beck said, Rezko called to say he would be reappointed along with a Republican holdover Levine. Beck also testified that Rezko told him Blagojevich was set to appoint Rezko’s three doctor friends to complete the rigged voting bloc. He said he met the doctors in August 2003, at the first meeting of the new Board.

Dr Michel Malek gave Obama $10,000 a little over a month before the first meeting on June 30, 2003. He also donated $25,000 to Blagojevich three weeks later on July 25, 2003, and gave Obama another $500 in September 2003. Malek was an investor in Riverside Park.

Dr Fortunee Massuda donated $25,000 to Blagojevich on July 25, 2003, and gave a total of $2,000 to Obama on different dates. Massuda’s husband, Charles Hannon, is a co-schemer in the pension fund case and testified against Rezko in the trial.

Dr Imad Almanaseer contributed a total of $3,000 to Obama after he landed the appointment. On March 13, 2008, Almanaseer testified against Rezko and told the jury he was an investor in Rezko’s fast-food businesses.”

With the agreement of lawyers on both sides, a federal judge on Thursday indefinitely postponed the sentencing of Antoin “Tony” Rezko, keeping open the possibility that the government could call the former top fundraiser for Rod Blagojevich at the former governor’s retrial.

Prosecutors didn’t call Rezko at Blagojevich’s trial last year, but the government could be re-evaluating that since the jury deadlocked on all but one count against the former governor. He was convicted of lying to the FBI.

Rezko began to cooperate with investigators after a federal jury convicted him in 2008 of extorting millions of dollars from firms seeking state business. He was scheduled to be sentenced Jan. 28. He also faces sentencing for a separate conviction stemming from a fraudulent loan scheme.”

“Illinois Health Facilities Planning Board Kickback
The Illinois Health Facilities Planning Board (the “Planning Board”) is a commission of the State of Illinois, established by statute, whose members are appointed by the Governor of the State of Illinois. During the relevant time period, the Planning Board consisted of nine individuals. State
law required an entity seeking to build a hospital, medical office building, or other medical facility in Illinois to obtain a permit, known as a “Certificate of Need” (“CON”), from the Planning Board prior to beginning construction.

Rezko was able to obtain significant influence over the affairs of the Planning Board by arranging for Blagojevich to appoint five of Rezko’s associates and/or friends, including Levine, as members of the Planning Board in 2003. Rezko and Levine subsequently agreed to use their influence over the Planning Board to obtain a kickback of at least $1 million from a contractor, Jacob Kiferbaum, who wanted the Planning Board to award Mercy Hospital a CON to build a new
hospital. Rezko and Levine were able to arrange for Mercy Hospital to receive its CON at the April 2004 Planning Board meeting, but their scheme was interrupted by the FBI before any kickback was paid

Control over the Planning Board

Levine was on the Planning Board when Blagojevich became governor, but his term was due to expire in 2003. Levine sent a message to the Blagojevich administration through Cellini that he wanted to be re-appointed. Levine later heard from both Kelly and Cellini that he would be reappointed, and Levine was re-appointed to the Planning Board in the Fall of 2003.

After Levine was reappointed, he shared a private plane ride from New York to Chicago with Blagojevich and Kelly. Levine, Blagojevich, and Kelly were the only passengers on the flight. At the beginning of the flight, Levine thanked Blagojevich for reappointing him to the Planning Board.
Blagojevich responded (in Kelly’s presence) that Levine should only talk with “Tony” [Rezko] or “Chris” [Kelly] about the board, “but you stick with us and you will do very well for yourself.”
Levine understood from Blagojevich’s manner of speaking and words that Blagojevich did not want Levine to talk to Blagojevich directly about anything to do with the boards, but that Levine should talk to Rezko or Kelly. Levine also understood that Blagojevich meant that Levine could make a lot of money working with Blagojevich’s administration. Blagojevich did not seem to expect a
response from Levine, and Kelly then shifted the conversation to something else.

Around the time that Levine was reappointed, Rezko told Levine that he expected to control the Planning Board. Rezko said that he had discussed the makeup of the Planning Board with Thomas Beck, who was the Chairman of the Planning Board. Before one of the Planning Board meetings, Beck talked to Levine about how there were five members of the Planning Board who
were Rezko’s people, including Levine and Beck. The other three individuals who would vote as Rezko wished were Fortune Massuda, Imad Almanaseer, and Michel Malek. Documents and testimony from individuals in Illinois state government who helped select candidates for boards and commissions positions, including the Planning Board, confirm that Rezko was the individual
responsible for selecting those five individuals to be appointed to the Planning Board. Since it took five votes to approve any CON, Rezko’s people effectively controlled what the Planning Board did.
Beck typically indicated to Levine and the other three members of Rezko’s voting bloc the items on the Planning Board agenda that Rezko cared about and how Rezko wanted them to vote.”

The name of Barack Obama, the Democratic front-runner for the presidential nomination, also appears in the e-mail as a member of a strategic team reviewing hospital board matters with the governor’s staff when he was a state senator. The hospital board was scheduled to be revamped in the summer of 2003.

Obama was then chairman of the Senate Committee on Health & Human Services. Other legislative leaders, including Madigan, were part of that review panel as well, according to the e-mail.”

“Fast forward to July 15, 2003, when Gov. Rod Blagojevich was revamping the hospital board on which Beck held a seat for several years. Beck said he wanted to stay on the panel so he called on Rezko at his North Side office. He came armed with a $1,000 check for Blagojevich’s campaign fund. Beck said he asked Rezko to put in a good word for him and Rezko said he would see what he could do.

A few weeks later, Beck said Rezko called him with the good news that he would be reappointed to the board along with Stuart Levine and another holdover member. Rezko also said three doctor friends of his were going to be put on the revamped panel by Blagojevich, Beck testified.”
“Key to the government case are dozens of recorded wiretap conversations on three phone lines into the home of Stuart Levine, the former member of two state boards whom prosecutors say worked with Antoin “Tony” Rezko to rig decisions of those panels.

FBI Special Agent Daniel Cain, the primary case agent on the investigation into Levine and Rezko, is on the stand now in testimony that is laying the foundation for entering the wiretaps into evidence.

Cain said the investigation, dubbed Operation Board Games by the federal agents, began in December 2003 and was prompted by information gleaned from an informant whom he did not identify. That witness, he said, took part in meetings with two other individuals who were in contact with Levine by phone at his home.

Cain said Levine had three phone lines in his North Shore home. Federal agents recorded conversations on those lines April 8-May 21, 2004. Those dates span the time when Levine, Rezko and others allegedly were working to rig the hospital board vote on a Mercy Health System hospital proposal for Crystal Lake and other kickback schemes prosecutors claim they were engaged in.”

Just as Rod Blagojevich’s involvement in Chicago, IL corruption was revealed during the Tony Rezko trial, Obama’s involvement should be revealed in the Blagojevich trial.

“In the media, Obama always made it sound like he rarely saw Rezko, saying they met for breakfast or lunch once or twice a year. However, the FBI mole John Thomas helped investigators “build a record of repeat visits to the old offices of Rezko and former business partner Daniel Mahru’s Rezmar Corp., at 853 N. Elston, by Blagojevich and Obama during 2004 and 2005,“ according to the February 10, 2008 Sun-Times.

During his March 14, 2008 interview, the Times told Obama, Thomas is an FBI mole and he “recently told us that he saw you coming and going from Rezko’s office a lot.”

“In addition, the contributions extorted through the Planning Board scheme were for the intended presidential candidate, Blagojevich. Obama’s US senate war chest was already funded and by the time these kickbacks were paid that campaign would be over.

But Obama did end up with $20,000 from the very first kickback paid in the pension fund scheme set up through the Board of the Teacher’s Retirement System.

Elie Maloof and Joseph Aramanda, the straw donors used to funnel the contributions to Obama, also made $1,000 contributions of their own for his failed run for Congress in 2000, on the same day March 17, 2000.

In addition, Aramanda gave $500 to Obama’s senate campaign on June 30, 2003. In the summer of 2005, Aramanda’s teenage son landed a coveted intern position in Obama’s senate office in Washington.

Obama also received contributions directly from the persons appointed to the pension board for the express purpose of rigging the votes. On June 30, 2003, appointee, Jack Carriglio contributed $1,000.

The other appointee, Anthony Abboud, donated $500 to Obama on June 30, 2003, $250 on March 5, 2004, and $1,000 on June 25, 2004.

Michael Winter, who prosecutors say agreed to serve as a funnel for kickbacks paid through an investment firm in one scheme donated $3,000 to Obama on June 30, 2003.”

Dr Michel Malek gave Obama $10,000 a little over a month before the first meeting on June 30, 2003. He also donated $25,000 to Blagojevich three weeks later on July 25, 2003, and gave Obama another $500 in September 2003. Malek was an investor in Riverside Park.

Dr Fortunee Massuda donated $25,000 to Blagojevich on July 25, 2003, and gave a total of $2,000 to Obama on different dates. Massuda’s husband, Charles Hannon, is a co-schemer in the pension fund case and testified against Rezko in the trial.

Dr Imad Almanaseer contributed a total of $3,000 to Obama after he landed the appointment. On March 13, 2008, Almanaseer testified against Rezko and told the jury he was an investor in Rezko’s fast-food businesses.”

“Tony Rezko, longtime corruption crony of Rod Blagojevich and Barack Obama, who was convicted of multiple counts of corruption in 2008, will be sentenced on January 28, 2011, prior to the Blagojevich trial.”

“Rezko has agreed to cooperate against Blagojevich but wasn’t called to testify at the former governor’s trial last summer. With Blagojevich’s retrial set to begin in April, Rezko’s sentencing months before could signal he is unlikely to be called again. Defendants usually aren’t sentencing until after their cooperation has been completed.

A sentencing date was not set today for Rezko’s co-defendants, Stuart Levine, Joseph Cari and Steven Loren, who will next return to federal court for a status hearing in March.”

“Cellini, 75, a Republican boss, was once Democrat Blagojevich’s co-defendant in the corruption case known as Operation Board Games. And who says the bipartisan Illinois Combine doesn’t exist?

Cellini has been a hobby of mine for years. And although Sun-Times reporter Tim Novak has done excellent work on Cellini’s deals, Cellini has mostly flown under the media radar.

In 2008, Cellini was indicted on federal charges that he conspired with convicted influence peddler Tony Rezko and others to shake down Hollywood movie producer Thomas Rosenberg for $1.5 million in campaign cash for Blagojevich.

Since Blagojevich was arrested, Cellini’s volcano has been dormant. A trial date has not been set. If Blagojevich ends up with a hung jury and the case is retried and drags out for years, Cellini might turn 80 by the time of his trial, if ever.”

“Whether there will actually be a Cellini trial is an open question. If the Blagojevich case withers and dies, the Combine will ask its mouthpieces to call for the head of U.S. Attorney Patrick Fitzgerald. It’s been alleged that they already tried to get rid of Fitzgerald during the Bush administration.

Cellini made friends in all the high places. Yet federal tape recordings previously introduced in court show that he’s a guy who likes to lie low.

In a phone call recorded by the FBI on May 7, 2004, Cellini was reporting back to a fellow Republican, the since-convicted Stuart Levine. They were talking about the alleged shakedown of Rosenberg, who was threatening to go to the feds.”

Democratic Senator Susan Garrett sponsored the bill in the senate, and the chief co-sponsor was Republican Senator Dale Righter. These two senators were also on the Human Services Committee with Obama.

The bill was filed with the senate secretary on February 20, 2003, and assigned to Human Services Committee for review on February 27. Less than a month later, as chairman, Obama sent word that the bill should be passed on March 13, 2003.

On May 31, 2003, the House and Senate passed the bill and the only senator listed in the “yes” votes mentioned in the Board Games indictments is Obama.

Blagojevich made the effective date June 27, 2003, and the co-schemers already had the people lined up to stack the Board and rig the votes with full approval from Obama.

As discussed fully in Curtain Time for Obama Part 1, the Republicans and Democrats worked together in setting up the Planning Board scheme because the Combine as a whole would profit.

During the trial, Stuart Levine testified that when he sought reappointment to the Planning Board, he told Republican co-schemer, Bill Cellini, to tell the Blagojevich administration he would vote however they wanted when approving projects.

He told the jury he had the same understanding with the two prior Republican governors, Jim Edgar, and George Ryan, who is now sitting in prison due to Fitzgerald’s successful prosecution of a corruption case against him.

A June 2003 email exchange produced in the trial shows Obama was one of eight officials who received the names of the nominees for the new Board ahead of time, from the office of David Wilhelm, who headed Blagojevich’s 2002 campaign for governor.

Tony Rezko’s name does not appear in the email. In fact, his attorney made the point to the jury that the exchange was from Blagojevich’s general counsel, Susan Lichtenstein, and Wilhelm’s office, and indicated the appointees were recommended by Wilhelm and supported by those who received the memo.

The memo said, “we worked closely over the past six months” with eight officials including three state senators.

Jennifer Thomas, a former aide in Blagojevich’s patronage office, testified that she attended regular weekly meetings at Rezko’s office between the spring of 2003 and November 2004, and Rezko floated names and specifically said Levine should be reappointed to the new Board.

The Senate bill said, the “Board shall be appointed by the Governor, with the advice and consent of the Senate.” But the Senate Confirmation Hearings were a joke. For instance, the Feds recorded Levine talking to co-schemer, Jon Bauman, the day Levine learned he was approved by the Senate from the executive secretary of the Board.

Levine told Bauman he ran into Jeffrey Marks, who said “congratulations on your appointment,” and Levine asked for what. Marks said, “well the Senate Confirmation Hearings on Health Facility Plan Board members.”

He told Levine Senate President, Emil Jones, only allowed 2 members to be approved and “that was you and the other person he just put in.”

“Isn’t that hysterical ’cause you know they had this big battle going on,” Levine told Bauman.

Laughing away, Levine said, “don’t you just love it.”

“I’m one of those independents and not part of the block.”

“Well, good, you know it’s good to be just a true independent civil servant,” Bauman said laughing along with Levine.

“Is, is that a good thing,” Levine replied, “I’ve never been that.”

Corrupt appointees fund Obama and Blagojevich campaigns

The corrupt new appointees were all contributors to the presidential hopeful, Blagojevich, and the US senate hopeful Obama.

The previous Act allowed the Board itself to select a “Chairman and other officers as deemed necessary.” But the new law stated: “The Governor shall designate one of the members to serve as Chairman and shall name as full-time Executive Secretary.”

The Board’s then sitting-chairman, Thomas Beck, who was originally appointed by a Republican governor, testified under a grant of immunity that he brought a $1,000 check to Rezko on July 15, 2003, to make sure Blagojevich reappointed him.

A few weeks later, Beck said, Rezko called to say he would be reappointed along with a Republican holdover Levine. Beck also testified that Rezko told him Blagojevich was set to appoint Rezko’s three doctor friends to complete the rigged voting bloc. He said he met the doctors in August 2003, at the first meeting of the new Board.

However, Alexi Giannoulias, has enough baggage of his own, enough associations with criminals like Tony Rezko and Michael Durango, to alarm concerned citizens.

Giannoulias Rezko Obama. Another of many examples of politicians tied to corruption and crime in Chicago and IL and pay to play politics. Obama has been endorsing Giannoulias for years and both had money ties to rezko.

““A new headache for Giannoulias? Another Rezko loan”

“By February 2006, businessman and political fixer Tony Rezko was already politically radioactive, caught up in a federal investigation that would see him criminally charged by the end of that year.

News reports had linked Rezko, a key adviser and campaign fund-raiser for then-Gov. Rod Blagojevich, to shady deals involving state pension funds — among the crimes that ultimately would send him to prison.

This was the Tony Rezko who, looking for millions of dollars for a massive South Loop development, turned to Broadway Bank, owned by the family of Alexi Giannoulias. Giannoulias, the Democrat now running for U.S. Senate, had left his post as a senior loan officer at the Chicago bank in late 2005 to mount a successful campaign for Illinois state treasurer, though he still held an ownership stake in the bank.

Rezko’s company asked. And Broadway Bank came through.

On Feb. 14, 2006, newly obtained records show, the bank made a $22.75 million loan to a company called Riverside District Development LLC, whose owners, it turns out, included Rezko.”

“Giannoulias, who touted his experience at Broadway Bank in his campaign to win election as state treasurer, has said its failure was the result of the national economic slowdown and the pullback in the real estate market, in which it invested heavily.”

“Broadway Bank made the loan even though another Rezko company, Chicago Hudson LLC, had fallen behind on a $10.9 million loan it got from the bank four years earlier. That loan — for a proposed high-rise condo building at 750 N. Hudson on the Near North Side that never got built — ended up in Bankruptcy Court. The property ended up being sold to another developer. Broadway Bank received $11.5 million from the sale, which took place July 31, 2006.

Following Rezko’s indictment in October 2006, he and his lawyers met in January 2007 with U.S. District Judge Amy St. Eve to discuss his assets. During that closed-door hearing, Rezko disclosed his ownership stake in Riverside District Development, the company that got the $22.75 million loan from Broadway Bank. Rezko’s lawyers said his main partner in Riverside was General Mediterranean Holding, a Luxembourg company controlled by Iraq-born billionaire Nadhmi Auchi.”

“According to Giannoulias and Auchi, Riverside District Development paid off the Broadway Bank loan with money it obtained from a $27 million loan from another financial institution: Mutual Bank.

Like Broadway Bank, Mutual also ended up getting shut down by federal regulators — though the loan was paid off, records show. Like Rezko, Mutual’s president, Amrish Mahajan, had been a top fund-raiser for Blagojevich.”

Edward Vrdolyak, Fast Eddie, a crony of Obama, Blagojevich, Rezko, Levine, et al, is back in the news.

“Former alderman and Cook County Democratic chair, convicted of fraud, has tapped high-powered connections to benefit charity — and work off his sentence”
“Some felons sentenced to community service work end up doling out soup at homeless shelters. Legendary political insider “Fast Eddie” Vrdolyak worked off many of his court-ordered hours by organizing a star-studded fundraiser at Gibsons steakhouse and driving around in his car while recruiting friends by cell phone to aid a charity.

Handwritten log sheets released Wednesday by his lawyers show that Vrdolyak has logged 1,750 hours on behalf of a DuPage County charity that works with law enforcement to help needy children and veterans, mostly by making phone calls and holding “skull sessions” with donors.

In a controversial sentence last year, Vrdolyak eluded prison for a fraud conviction, but after prosecutors complained, an appeals court ordered he be resentenced. Prosecutors are seeking 31/2 years in prison for him Friday.”
“U.S. District Judge Matthew Kennelly, who will impose the new sentence, will have dozens of character reference letters to read from Vrdolyak supporters — and he can get an earful about Fast Eddie’s virtues from Elsner as well.

“I know I’m going to be crucified for saying this, but Ed Vrdolyak is the finest man I’ve ever met,” Elsner said. “You just come away from talking to him feeling better about things.””

March 18, 2008; 5:16 p.m.
“In his first 20 minutes on the witness stand, Stuart Levine admitted that he had passed numerous bribes to win private and government business for several firms with which he was connected.

Levine said former Chicago Ald. Edward Vrdolyak acted as a middleman in two bribe schemes, including one to secure a contract with the city Board of Education. On both occasions, Vrdolyak was to pass the bribes onto others, he said.

Levine said he also paid a $500,000 bribe to an undisclosed city official to obtain a tire contract from the Department of Streets and Sanitation. Levine also said he passed on bribes of hundreds of thousands of dollars to win a contract to supply school buses to the Board of Education.

Levine also admitted that he had used hard drugs and distributed drugs to others since the 1970s.

“I experimented with LSD, marijuana, cocaine, quaaludes, Ecstasy, crystal methamphetamine and ketamine,” he said.

Levine, who faces up to life imprisonment, said he hopes to be sentenced to 67 months in prison in return for his cooperation with the government.

“If I lie, the plea agreement is null and void,” he said.

He admitted that after he agreed to cooperate with the government in early 2006, he lied once about Vrdolyak. “I tried to protect him,” he said.

Asked why he decided to allegedly tell the truth about Vrdolyak, Levine said, “I realized that the government realized that I was lying.””

March 18, 2008; 6:06 p.m.
“Stuart Levine also told the jury that at the request of former Chicago Ald. Edward Vrdolyak, he funneled money to Democratic candidates through straw contributors.

Asked by Assistant U.S. Atty. Christopher Niewoehner if he expected to get anything in return, Levine said: “Access.”

Levine testified that from 2000 to 2004, he made a combined $9 million to $10 million. Now, he works as a messenger for a delivery service at $800 a week, he said.

Levine walked through his history of serving on state boards, which, in addition to the Health Facilities Planning Board and the Teachers’ Retirement System board, also included a three-year stint on the Gaming Board. Levine said he eventually resigned.

“I didn’t enjoy the pressure I was getting,” Levine said in a poised manner that seemed well-practiced.

Levine then related how he first met Antoin “Tony” Rezko at a dinner party at the home of Fortunee Massuda, a podiatrist who was also a Rezko business partner.

The dinner took place Nov. 2, 2002, just days before the gubernatorial election. Levine had served as the finance chairman for Republican Jim Ryan. Rezko was an important fundraiser for Rod Blagojevich, Ryan’s opponent.

Levine said he was invited to the dinner by Ruth Rothstein, the head of the Cook County Health Services Department and a friend of Levine’s business partner Robert Weinstein.

Rothstein told Levine that Massuda invited him because she wanted to thank him for speaking up for her proposal before the hospital board to establish a free-standing surgical center on the South Side.

Levine said he had done so as a favor to Rothstein.

In addition to Massuda and her husband, Charles Hannon, others at the dinner included Rothstein, Rezko and his wife, as well as Orlando Jones, the godson of the late Cook County Board President John Stroger.

At the party, Levine said, he and Rezko began talking about their opposite roles in the campaign for governor. Rezko then told Levine that they had mutual friends in Republican power brokers Bill Cellini and Robert Kjellander.

The talk at the dinner then turned to a valuable piece of Gold Coast property that had once been home to the Scholl School of Podiatry at Oak and Dearborn Streets.

The school was in the process of being sold to a North Chicago medical school, now know as Rosalind Franklin University.

Levine served on that school’s board of directors, as did his partner Weinstein. In his capacity at the medical school, Levine was also in charge of selling the Scholl building, and he testified that he had a buyer lined up who was going to pay $15 million. Some $1.5 million was going to be paid as a finder’s fee to Vrdolyak, Levine said.

Levine said Vrdolyak was going to share half of that money with Weinstein and him, even though as board members at the school, such an arrangement would be illegal.

At the party, Levine said, he mentioned that he was having problems closing the sale, and at that point, Massuda chimed in that she had a clinic in the building and would like to buy it.

Levine said he then asked her if she had any role in holding up the sale. Levine said that simultaneously Massuda said, “No,” but Rezko said, “Yes.”

Massuda and Rezko had a short talk, which ended with Massuda saying, “I didn’t want it to come out this way,” and Rezko saying, “Why not just tell him?”

Levine said Rezko then told him that if he already had a buyer lined up for the building, he would no longer stand in his way. Levine did not specify what Rezko was doing to block the sale.

By Election Day, the following Tuesday, Rezko was true to his word, and the sale’s obstacle was resolved, Levine said.”

April 1, 2008; 6:17 p.m.

“But the jury did hear a long call between Levine and his longtime business partner, Dr. Robert Weinstein, about Rosenberg and his larger TRS plans. Rosenberg would be given the choice to raise the campaign cash or to pay a finder’s fee on the $220 million allocation through former Chicago Ald. Edward Vrdolyak, whom Levine said he had used before to pass bribes.”

April 3, 2008; 5:56 p.m.

“Levine still had not agreed to cooperate, and Levine told Duffy that he did not believe the government was aware of the “secret part of his life,” meaning his drug abuse and hotel parties with male friends.

In August 2005, Levine was indicted again, and he still had not agreed to flip. Duffy asked again whether the fact that Levine thought his secret life was still concealed from his family and others was a factor in his decision not to help the government.

“I don’t have a recollection of even thinking about the government knowing about my drug use or not,” Levine answered.

In fall 2005, Levine said, he became aware that one of his drug friends had been interviewed, and Duffy said he wanted to know what role that played in Levine’s cooperation.

“Now you learn that the government is on to this–isn’t that right?” Duffy asked.

“I don’t believe I focused on that aspect whatsoever in that period of time,” Levine answered. “There were many things on my mind, Mr. Duffy.”

Levine said he eventually decided to cooperate a few months later after his lawyer reviewed with him what the results could mean for him if he were convicted.

“They were terrible,” Levine said of the consequences he faced.

To avoid a long jail term, Levine said, he knew he had to cooperate and be completely honest, but still, Duffy pointed out, Levine was not truthful. He lied despite knowing “the sword of Damocles” would come down on him, Duffy said, and Levine agreed.

“You knew the only way you could hurt yourself in this process was by lying?” Duffy asked.

“Yes, sir,” Levine answered.

Levine lied by not telling the government about his dealings with former Chicago alderman Edward Vrdolyak, a man Levine said he often worked bribes through.

Vrdolyak allegedly was to bring in a $1.5 million kickback from the sale of the Scholl School of Podiatry in Chicago to Rosalind Franklin University, and Levine was supposed to get half of it.

He would like to have seen the money even while he was cooperating, Levine admitted, but he insisted he was not truthful about Vrdolyak because he was trying to keep him out of trouble.”

April 4, 2008; 10:55 a.m.
“More tales of the Purple Hotel kicked off this morning’s session of the Antoin “Tony” Rezko corruption trial.

On Thursday, Rezko’s lawyer Joseph Duffy grilled prosecution star witness Stuart Levine about a $761 transaction on his credit card statement for Saturday, Nov. 2, 2002, at the garish purple-painted Lincolnwood hotel that at the time was part of the Radisson chain. Levine has testified that he and a regular group of “drug buddies” often went to the hotel for daylong binges of crystal meth, cocaine, animal tranquilizers and other drugs.

The significance of that date is that it was the same that Rezko and Levine first met. The occasion was a dinner party, and during the chitchat Levine has said the two men came to realize they had been on opposite sides of a shady real estate deal.

As Duffy tries to chip away at Levine’s credibility, the lawyer used the credit-card statement to suggest that Levine’s memory of that first meeting was suspect because he showed up at the party after leaving a drug binge.

Levine acknowledged that the charge on his credit card was likely legitimate, but repeatedly insisted that he did not remember being at the hotel on that day and considered it unlikely. Credit-card transactions are not always recorded on the same day a charge is actually made.

This morning, Duffy questioned Levine about more charges he incurred at the Radisson. On Saturday, Oct. 26, exactly one week before the dinner party, Levine’s credit-card statement reflected a $1,077 charge at the Radisson, and exactly a week before that there was another $1021 charge there.

Duffy appears to be trying to suggest that Levine had a regular Saturday thing at the Radisson with his drug buddies. In earlier testimony, Levine said the group would get together and party once or twice a month at the Lincolnwood hotel, and always on weekdays. Levine said he tried to hide his secret drug life from his family and wanted to be home and clear-headed on the weekends.”
