A US Army Reserve, Major Stefan Frederick Cook, scheduled for deployment to Afghanistan, refused to serve claiming that the order was illegal because the American President was not legitimate. First of all CW THANK YOU for all you have done and will continue to do. I started my blog a little over a year ago I am sure I speak for many when I say that year has flown by. But what has happened has taken a great deal of effort. I have family, including my lovely bride, that have asked me more than once to give this up. I have email list that was once less than 12 people that now have many hundreds. I have watched this thing grow exponentially over the past three or four months. This wave is in full arc and about to come crashing down. I have never felt so close to seeing our cause come to fruition than I have over the last few days.

But in order for this scenario to be pulled off there would have to be too many people involved in this “conspiracy”. IE Dr Alvin Onaka for instance would know that no one released the long form. Gerald Walpin, who was the inspector general for the Corporation for National and Community Service until President Obama removed him, argues in the lawsuit that the firing broke a 2008 law governing how watchdogs can be dismissed.
The government watchdog President Obama fired last month for allegedly being “confused” and “disoriented” filed a lawsuit Friday to reclaim his job, the Washington Times reported.
Gerald Walpin, who was the inspector general for the Corporation for National and Community Service until President Obama removed him, argues in the lawsuit that the firing was politically motivated and broke a 2008 law governing how watchdogs can be dismissed, the newspaper said.

250.481 Reserve components; employment discrimination prohibited.–Any person who seeks or holds an employment position may not be denied employment or retention in employment, or any promotion or advantage of employment, because of any obligation as a member of a reserve component of the Armed Forces.

Surely, Maj. Cook had an obligation to question the legality of his deployment orders. And, for this reason, he was terminated from employment.
However, because Cook’s termination was a direct result of him questioning the legality of his deployment orders. (Cook took a military oath to question all orders if he believes those orders might be unlawful) and actually questioned those orders, the DOJ and DSS threatened Cook’s employer to fire him which is a crime.
The threats that the DSS made to Cook’s employer to force his employer to terminate Cook, rise to the level of extortion. I’m sure the DSS told Cook’s employer that if he didn’t fire Cook, his status as a government contractor might be in jeopardy. Florida state statutes are clear that threats and extortion are unlawful.
CHAPTER 836 – DEFAMATION; LIBEL; THREATENING LETTERS AND SIMILAR OFFENSES
836.05 Threats; extortion.–Whoever, either verbally or by a written or printed communication, maliciously threatens to accuse another of any crime or offense, or by such communication maliciously threatens an injury to the person, property or reputation of another, or maliciously threatens to expose another to disgrace, or to expose any secret affecting another, or to impute any deformity or lack of chastity to another, with intent thereby to extort money or any pecuniary advantage whatsoever, or with intent to compel the person so threatened, or any other person, to do any act or refrain from doing any act against his or her will, shall be guilty of a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Florida state statutes are also clear that individuals can not solicit each other or conspire with others to commit a crime, which is exactly what occurred when the DSS called Cook’s employer and Cook was retaliated against and terminated for attempting to discharge his Military Oath.

2) A person who solicits another to commit an offense prohibited by law and in the course of such solicitation commands, encourages, hires, or requests another person to engage in specific conduct which would constitute such offense or an attempt to commit such offense commits the offense of criminal solicitation, ranked for purposes of sentencing as provided in subsection (4).
(3) A person who agrees, conspires, combines, or confederates with another person or persons to commit any offense commits the offense of criminal conspiracy, ranked for purposes of sentencing as provided in subsection (4).

Without obtaining verification that his military deployment orders were lawful, Cook in “good faith” believed that he might be violating his military oath and other state and federal laws.
One can not be forced to take action which he or she in “good faith” believes may be a crime. This is unconstitutional and reprehensible and is a violation of the US Constitution and the State Constitution of Florida. Even if it can be proved that Cook used his military deployment to make a political statement, he has that right under the Florida state constitution.
CONSTITUTION OF THE STATE OF FLORIDA-AS REVISED IN 1968 AND SUBSEQUENTLY AMENDED
SECTION 1. Political power.–All political power is inherent in the people. The enunciation herein of certain rights shall not be construed to deny or impair others retained by the people.
Furthermore, Cook has a basic and inalienable right to defend liberty, and as an soldier and officer who would be required to do just that, especially in a time of war, Cook has a constitutional right to question the legality of his orders as protected by the US Constitution and the Constitution of the state of Florida.
SECTION 2. Basic rights.–All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness, to be rewarded for industry, and to acquire, possess and protect property; except that the ownership, inheritance, disposition and possession of real property by aliens ineligible for citizenship may be regulated or prohibited by law. No person shall be deprived of any right because of race, religion, national origin, or physical disability.

In addition, the Florida state constitution states that No administrative agency can impose any penalty against a person except provided by law. Clearly, one could argue that the DSS calling Cook’s employer and telling that employer to terminate Cook was an “unlawful” penalty imposed by the DSS.
SECTION 18. Administrative penalties.–No administrative agency, except the Department of Military Affairs in an appropriately convened court-martial action as provided by law, shall impose a sentence of imprisonment, nor shall it impose any other penalty except as provided by law.

As you can see, this section specifically outlines that only the Department of Military Affairs can impose a lawful penalty on Cook, and that such a penalty could only be appropriately administered under court-martial proceedings. To my knowledge, no court-martial proceedings have been initiated against Cook.
One must be very careful on the legal tactics used to sue the government, as many legal theories fail.

On Larry Sinclair’s web site he has a video clip of Lou Dobbs and one of the guys talking on there claims to be an “expert” on natural born citizenship. He is relying on that forged document. He has no proof of BO being born in Hawaii. It looks like he just assumes that BO was born there. Then BO can’t make up his mind which hospital he was born in. That guy who claims to be such an expert better do his homework and see that BO is not a natural born citizen simply being born in Hawaii because of his father not being a citizen.
Wouldn’t that be great if someday BO does have a conference on TV and does the right thing and step down. No such a chance though. He has to be forced out. I hope more keep the pressure on him to produce the goods or step down.

The correct passage is Article II, Section 1, Clause 5 of the U.S. Constitution states
“No Person except a NATURAL BORN CITIZEN, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the U.S.”
To be President of the United States you have to meet all 3 requirements:
[1] Be Natural Born Citizen of the U.S. OR Citizen of the U.S. at the time of the Adoption of the U.S. Constitution in 1787
[2] At least 35 years old
[3] 14 Year resident within the U.S.
The issue for BHO or even John McCain for that matter is whether they are considered a Natural Born Citizen.
John Jay sent a letter to George Washington in 1787 to insert the natural born citizen clause to ensure that Commander in Chief of the U.S. armed forces would not have dual allegience/citizenship to foreign countries.
Natural Born Citizen is derived from English Common Law and the U.S. Supreme Court has corroborated its application and meaning in two supreme court cases: U.S. v. Wong Kim Ark,
169 U.S. 649 (1898) and Perkins v. Elg,
307 U.S. 325 (1939).
Also, what is most peculiar is that in the Senate Resolution 511 co-sponsored by Obama as a Junior Senator states as follows:
Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936: Now, therefore, be it
Resolved, That John Sidney McCain, III, is a ‘‘natural born Citizen’’ under Article II, Section 1, of the Constitution of the United States.
So the question remains is Obama a natural born citizen under the U.S. Constitution when his father was a Kenyan National (subject to British rule) at his birth in August 4, 1961 and was not a U.S. citizen at the time of Obama’s birth?
The answer is undeniably no. Therefore, Obama is not eligible to be President of the U.S. under Article II, Section 1, Clause 5 and is operating as a Usurper.

Did you hear that stinking wimp’s answer–“The president is a United States citizen.” We all should send this idiot two letters. The first one listing all the facts that concern us aboutabout Obama’s eligibility to be president. The second a termination letter. If that idiot is so demeaning as to think the people are so dumb as to believe him–then he is unfit to hold his job. He should be fired for incompetence.

Come to think of it I wrote Senator Diane Fienseitn a letter asking her to challenge Obama’s eligibility. She sent me back a gobbily goop boiler plate letter she sent to all the people who wrote to her on the issue telling me Obama is a citizen. Then I sent a letter which included all the arguments of Orly, Berg, and Donofrio and asked to not underestimate the intelligence of her constituants. She never responded to that one.
Along with Obama the entire Congress, Senate, Supreme court, msm, every judge who refused to order Obama to produce his documents need to be removed from their positions, arrested, tried,, found guilty–there’s no way they can be found innocent, and sentenced to jail for the rest of their corrupt lives.
There is a tiny crack in the damn with no one to put his finger in it. Major Cook, Walpin, Fitzpatrick (one pissed off sailor), Lou Dobbs, and the rapidly growing numbers of us are putting pressure on that crack which is quickly expanding. Obama’s machine– as big as it it is–is not big enough against all of us simultaneously.

I was a contractor to DOD for a number of years, and I would like to point out that ALL contractors are provided with a complete printed copy of the Federal Labor law as it applies to them. It is often referenced in the original contract language as well. It is quite specific. NO contractor can say that he was NEVER INFORMED. Had he read the contract that he signed he would know that he is bound to following,and applying all Federal labor laws. The specific part of the Florida law that was shown is a close approximation of it’s Federal counterpart. Again……EVERY DOD contractor receives a copy of Federal Labor Law. Contracts that are rebid annually require the successful bidder to sign all parts of the agreement which includes compliance to Federal labor law. It appears that the CEO of Simtech now has his neck on the chopping block. I would think that he has recourse. If he is smart he will file a lawsuit against the DOD for Federal harrassment, and coercing him into firing an employee, in contradiction of Federal law. This is extortion. I would guess that this order came from Gibbs, or Soetoro himself. I hope that both Cook, and Walpin file criminal complaints against Soetoro before the same judge who sat in Cook’s first action. It is possible that any, or all actions will get stonewalled or thrown out. When this occurs you will know exactly the degree of the involvement of our Federal court justices with the anti Constitutional activity of the present occupant of the Whitehouse. I believe that the entire Federal Court system is corrupted. It seems really unusual that one Federal Judge would buck the orders from the Whitehouse. I personally believe that certain people who are in high places are at work, and we may soon see Soetoro under arrest. His problems are mounting, and it is only a matter of time until sombody decides to jump ship. When they do Soetoro is history. If you read Childers’ consent form, it’s dated February, 2009. I believe he was consenting to be a Plaintiff in another of Orly’s cases.

Any United States Citizen or Attorney can file a friend of the court brief on any legal subject, and there is nothing more pertinent than a Citizen petitioning the court over authority of the federal government operating in their state or using their Citizens for violent measures.
Attacking the two core issues of federal government control under any executive in the military and tax revenues are the most certain way in an injunction to pit the Judicial against the Executive which checks and balances the Office of the President.
Accomplishing the above would send the Bunker Hill shock wave to the federal district as it would no longer be sustained by guns and taxes, the 50 states would then have control and by the courts appoint guardianship in former Presidents on defense and the states Sec. of State and Treasury in overseeing in escrow moneys collected by the federal government.
It is a guarantee that major revenue states as California, Texas and Florida, if they held federal taxes by court action from the federal government, that Barack Obama would be checked.
It is a guarantee that major military operational states as Georgia, Texas to those providing necessary National Guard operations as transport as Ohio and South Dakota, if their troops were by the court ordered to stand down and the security of America was placed in the former Presidents oversight, that Barack Obama would be checked.
This then would force the Axelrod Inc. group to actually provide legal documentation or a Constitutional crisis would ensue and Mr. Obama would be removed from office and all of his appointees and staff.
This is the way the proceed if the tea dunkers are serious and to stop waiting around for people throwing fish to the seals on these court cases which keep being thrown out. All it requires is a court hearing, no trials, just a filing and a judge to sign it, then the military and the tax structure immediately comes under the control of guardians and the 50 states.

The idea that I liked the most was the one in which we orgainze as many people across as many eastern states as possible (for expediency’s sake) and all drive down to the Capitol mall, park all our cars in a zig-zag fashion across the mall and blockade it. If we had thousands of cars, they wouldn’t be able to arrest us all, and they wouldn’t be able to tow everyone; their only alternative would most likely be to try to ‘plow and destry’ the vehicles, for lack of a more effective idea, at which point they’d be courting physical revolution.
We stay until we get the BC.
It’s time that we turn the Alinsky playbook on them and ‘overwhelm the system’.
But that’s just me.

The consent form signed by Childers says that he agrees to be represented by Orly in the matter at hand, then in his letter he states “actions” taken by Orly, and thus explains, that he is agree to be represented in all actions wherein the military seek such a determination.
There is nothing to suggest that he signed a consent regarding one specific action.
There is nothing yet to suggest that he has even complained.
There is nothing yet to suggest that he has even written a letter or email of complaint.
The Ledger needs to stop printing the story, or cough up the confirmation that the email is from Childers. Seeing that Childers could email anyone else, why has he not done this IF it is really him.
I really do not think a Maj. Gen. would email the paper and not contact Orly or Cook…

Also if you read Childers letter, you cannot construe from it that he would oppose such an action as Orly was going to file.

You’re probably right, but I read that date…I would hope that Orly and her team would dot every “i” and cross every ‘t’ as these cases are critical.
No doubt there are Obots about-they remind me of mold, spreading everywhere.
I’m sure Maj. General Childers is in it for the duration and I don’t think Orly would’ve published it if it weren’t so.

On YouTube on the right side below the video sender and description there is an embeded Code. Clik on it once and it will Highlight then either do CONTROL C to Copy or right click and click Copy now you are ready to paste by right clicking where you want tp paste it and then either CONTROL V to Paste or right click where you want to place it and click Paste.

Portugal got taken over by Spain for 60 yrs 1580-1640. This was done with the help of many traitors in Portugal, because they were promised position and riches, etc. In 1640, finally enough patriots organized and rose up to start the Restoration Revolution (A Restauracao). One of those traitors, who was the invading country’s leader, was on an upper floor in a gov’t building when the Revolutionaries charged in. He was told you “MUST GO, door or window?” He got thrown out the window to his death. He didn’t choose quick enough. Indecision Kills!
Luckily Portugal has been Independent ever since.
Time to Act so America can be Independent Again. I hope it won’t take 60 yrs, 6 yrs or even 6 months, Life is too hard and too short to live sans Freedom under Tyranny.
Look, I am against strikes in the present crisis.
Because even if you strike for a good cause, it hurts others who have jobs in companies which sell or do business with those struck against.
The comman man needs his job. A Strike will hit him hard, but wont touch the critters who caused the problem, lest of all Obama.
It is much more direct to refiled your witholding taxes form, so that it is your duty to pay quarterly filings rather than let the IRS take it directly out of your paycheck on a weekly basis. This will help you manage your own money better, and hit the US treasury where it hurts. This is perfectly legal, as far as I understand it; though it may freek out your payroll clerk at work.
But in general as for not paying taxes.
If even 10% of Americans stopped paying taxes, the dollar would begin to crumble and everyone with paper money assets would loose big time. And that is mostly the little people.
So, like in any war, you have to choose a tactic that maximizes enemy loseses and minimizes friendly loses or collateral damage.
The most direct way is NOT OBEYING ANY LAW SIGNED BY THE USURPER, because he is the usurper. Going to protests with signs saying, “He is a usurper, I refuse to obey this fake!” and the such.
If the powers that be see that with Zero they cannot control the situation, they will remove Zero and his cronies.
Also, when picketing, don’t just name Zero or politicos, go after Soros, Gates and the other rich soliciasts who want us to cow tow under and become their serfs. This country was against the vicious exploitation of the common man which prevailed in absolutionist monarchies of Europe; and in the name of socialism these folk was us to return to that subjection.
No Way folks! I am free, and I am not going to let anyone take freedom from me or my kids!
JB: I get your point, and it certainly seems to present a signifcant dilemma. IMHO the Repubs have done too much damage to the name, and doubters will likely respond to calls of reform with “yeah…we’ve heard that one before”. And so I think that, since our VOTE is what counts (hopefully)…people will put their trust in the person, not “the party”. While the name has is used for identity purposes, it will matter most who the PERSON is that REPRESENTS what we the people want our America to be.
A true leader will truly lead. A truthful leader will rally the truth-loving people. I think past third party efforts have been “losers” as you say, because the leadership was weak…not the name of the party. Independence and Liberty monikers sound very good and certainly “American” in their values. But if there’s no one is strong enough to ‘lead’…then ‘loser’ is all you get. Make sense?
There have been people who have become great leaders, even for causes against their own people, who succeeded regardless of the identity of their party or cause. An history will look upon those party names with distain…much like many do today with Dems and Repubs. To fix that would take one “Extreme Makeover”.
