My name is XXXXX XXXXXX.
I called into to Ed’s show on Feb 13 asking for residents of
WV who are interesting in doing something in their state to
question Barack Obama’s eligibility for the office of president.
I am preparing to file an Election Complaint with the WV Secretary
of State concerning Barack Obama.  WV has some unique laws in this
regard and there may be an opening to get this issue out in the
open.
I am looking for WV residents who would consider participating
in this.  I will email you information to educate you on the issue,
possibly speak with you on the phone, and we will go from there. 
At this point, this is not a suit.  WV allows ‘ANY PERSON’ to file
an election complaint with the secretary of state.

  1. The excuse will be “Jurisdiction” like the case in Texas.The rest will be “standing”.The reason is that we lost the Consitution many decades ago.Judges are under the rule of “judicial silence”.

  2. Please advise under what WV law you intend to launch your challenge. The states whose laws I have researched, which allow ballot/election challenges intended to alter voting results, have deadlines that have long since passed. (This in no way limits the filing of complaints related to charges that the D Party committed voting or ballot fraud.)

    There is no law for vetting, but there is a law for ensuring the president meets qualifications.

    Therefore, under Amendment X, We the People have the authority vested in us by the U.S. Constitution to ensure candidates are eligible. We can create a Federal Grand Jury tomorrow.

    All it takes is one Federal District Attorney and it’s over for the usurper. Time to start calling every Federal DA in the nation. This is the fastest, easiest way to remove Soetoro and every other goon in Congress legally.

    If that doesn’t work, time to move to plan B (protest). If that doesn’t work time to move to plan C (forcible defense against a tyrannical government).

  10. JeffM, perhaps you misunderstood my question to the WV voter claiming in her state, she has the right to pursue a “unique” legal strategy. I was only asking her to provide the legal cite. I was not asking her – or you – to explain the law to me.

    The state codes are over the place.
    I read quite a few of them several months ago.
    Some do, in fact, have provisions for ensuring that presidential candidates
    are qualified. However, it appears that most state officials have been brainwashed
    to believe it is either not their duty or within their powers. It clearly is within
    their power.

  12. Everyone, no provision of any federal or state law requires any government official to vet the candidate from the major political party as to Constititutional eligibility for POTUS. I wrote extensively on this subject in a memo posted on my blog at the beginning of November. (And, in August, I was posting comments on other people’s blogs to inform them of this lapse in state laws and to recommend that, to keep BO off the ballot, people could only file challenges with their elections officials who, in most cases, were not legally required to investigate, anyway.) I am not asking anyone to explain the law to me; I already understand the law. Some states require that, the candidate submitted by the party “shall” be eligible for the office sought. Note, this is different from requiring that, the state must check. And some states, like HI, require the party to swear the candidate is eligible.

    WV specifically indicated there was something different about the laws in that state that would enable a viable legal challenge to BO’s ‘election’ to be entered at this late date. I merely asked her to cite that law allowing this challenge at this time. (Please note, challenging the results of the election is different from filing a complaint with state authorities, including both the S of S and the AG, that, the D Party committed election fraud! This can and should be done, as a consumer as well as voter issue.)
