“There is enough corruption in Illinois so that all it takes is someone who is serious about finding it to uncover it. If a U.S. attorney is not finding corruption in Illinois, they’re not seriously looking for it.”…Northwestern Law Professor James Lindgren

Diversions Diversions Diversions.

Is it any wonder that we have the Obama camp protesting Wall Street and a probable manufactured Iranian assassination plot? Despite the best efforts of Patrick Fitzgerald and the US Justice Department to protect him, Obama still has a Rezko problem.

Daniel Frawley has not been sentenced.

From Citizen Wells August 20, 2011.

“Daniel T. Frawley once teamed with Tony Rezko — the political fixer
who’s now in jail — in what turned out to be a doomed effort to open a
training school for Iraqi security forces in western Illinois. Now,
Frawley faces a federal prison stretch of his own.”

“Still, federal prosecutors are seeking a reduced sentence for Frawley
— of a year and a half in prison, rather than the 35 years he could
face — apparently because Frawley has been secretly cooperating since
at least 2006 in their investigation of Rezko, who was found guilty in
June 2008 of having used his clout with the Blagojevich administration
to enrich himself and his business associates.

Details about Frawley’s cooperation with the U.S. attorney’s office,
the FBI and the Illinois attorney general’s office can be gleaned from
a 65-page court deposition he gave seven months ago…”

“Frawley: “Yes, I had a conversation with Mr. Weaver where he
instructed me not to cooperate.”
Frawley: “I was on the phone, making a phone call to Tony Rezko. I had
a luncheon engagement with him.”

“George was outside of the room where I was making the telephone call,
and the purpose of the call was for me to keep my luncheon engagement
with Tony Rezko and to go over and to record Tony Rezko.”

“George saw and heard me on the phone, came running in and went like
this [demonstrating]: Cut it,”

Franklin: “For the record, the deponent is crossing his hands across
his throat.”

Konicek: “And Tony Rezko was where when you were speaking to him?”

Frawley: “He was on the other end of the phone. I don’t recall where he was.”
Konicek: “I’m assuming the information is about the payments made by
Rezko to Obama, so we know we’re talking about the right conversation,
right?”

Konicek: “Am I correct it was about Obama being paid by Rezko?”

Frawley: “I’m not answering that question, based upon my attorney’s
instructions.”

Konicek: “But on March 13, 2006, you’ve already indentified for me
being at 219 South Dearborn. You’re talking to Tony rezko on the
phone, and Mr. Weaver makes this gesture to you, right?”

Frawley: “Mr. Weaver made the gesture and told me to get off the
phone, to end the phone call.”
Konicek: “Okay. And then where were you instructed not to cooperate?”

Frawley: “In the same building, at 219 South Dearborn….in a different room.”
Konicek: “Did you bring to Mr. Weaver in Hinsdale a statement showing
payment to Tony Rezko in the amount of $ 1.5 million?”
Konicek: “Are you going to answer?”

Frawley: “No.”

Konicek: “Are you asserting your Fifth Amendment privilege?”

Frawley: “Yes.””

The William Cellini Indictment is loaded with Rezko references.

“It was further part of the conspiracy that CELLINI later told Levine that Rezko and Co-Conspirator A had agreed to the proposal to use their influence with high-ranking State of Illinois officials to oppose the pension consolidation plan in exchange for CELLINI’s agreement to use his influence at TRS and Levine’s position at TRS to ensure that TRS invested money with and hired firms chosen by Rezko and Co-Conspirator A. CELLINI and Levine understood that Rezko and Co-Conspirator A were going to expect under the agreement that CELLINI would use his influence at TRS and Levine would use his position at TRS to help firms that made contributions for the benefit of Public Official A.”

Stuart Levine mentioned Rezko in testimony yesterday.

As reported by Natasha Korecki of the Chicago SunTimes.

“Levine says he’s ripped off a dead man’s estate, charities, schools, taken bribes. Says he and Tony Rezko agreed to split bribes.”
“Levine says both he and Cellini went to Tony Rezko to ask he make sure Levine was reappointed.”

“Stuart Levine says Tony Rezko was “delighted” when Levine said he would ask Tom Rosenberg for a $2 million kickback for state work.”

Stuart Levine testimony, William Cellini trial, Star witness tells of deals made with Cellini, Where is Tony Rezko?

“Why was Tony Rezko’s sentencing delayed?”…Citizen Wells

Tony Rezko is mentioned throughout the William Cellini indictment.

Where is Tony Rezko?

From the Chicago Tribune October 12, 2011.

“Insider turned star witness tells of deals made with Cellini”

“Stuart Levine, a flawed political insider whose cooperation helped take down the Blagojevich administration, returned to the Dirksen U.S. Courthouse on Wednesday to tell of more backroom criminal deals.

Levine is the star witness againstSpringfield power broker William Cellini, on trial on charges of plotting to squeeze a campaign contribution from a Hollywood producer whose investment firm had substantial business with the state of Illinois.

Levine last testified in 2008 against Antoin “Tony” Rezko, a top adviser to former Gov. Rod Blagojevich who was convicted of using his political clout to orchestrate a multimillion-dollar kickback scheme.

On Wednesday, Levine, 65, who once made millions of dollars, strode into the courtroom and explained how the scandal cost him his home and livelihood. He said he now sells electronic cigarettes at a shopping mall.

He also told the jury of his extensive drug abuse — including crystal meth and ketamine binges — that started in the early 1970s and went on for decades.

Under questioning by Assistant U.S. Attorney Christopher Niewoehner, Levine gave mostly monotone “yes” or “no” answers about malfeasance at the Illinois Teachers’ Retirement System, or TRS, where he sat on the board of trustees.

At one point on the stand, Levine became flustered when his cellphone rang and he struggled tosilence it. Unable to turn the phone off entirely, Levine finally handed it over to Niewoehner.

Still, Levine’s answers were clear on Cellini’s deep influence at TRS and how they used that to broker an illegal deal with Rezko and Christopher Kelly, another top Blagojevich adviser.

Levine told the jury that Cellini, a close ally, had come to him with concerns about the leadership at TRS and whether enough money was being invested in real estate. Cellini, a longtime lobbyist and fundraiser, owned Commonwealth Realty Advisors, a real estate investment company that was making millions of dollars from TRS investments .

Protecting that kind of power is central to the charges against Cellini, prosecutors have alleged.

Levine said he and Cellini worked to engineer a series of moves to ensure they continued to control a voting block on TRS. Among the moves was putting a friend of Cellini’s on the board, Levine said.

At one point Levine was asked if he was generally willing to do what Cellini wanted when it came to TRS. “Yes,” he responded. And when asked how much influence Cellini had at TRS, Levine quickly replied, “Considerable.””

“The two agreed that Cellini would use his relationship with Rezko and Kelly to convince them to block the pension plan, Levine said. In return, Cellini would promise that he and Levine would use their influence at TRS to steer contracts to companies based on political contributions to Blagojevich, Levine said.

Cellini later told Levine that Rezko and Kelly agreed to go to Blagojevich to try and kill the consolidation.

Levine is expected to be on the stand the rest of the week.”

Stuart Levine next William Cellini trial witness, October 12, 2011, Levine corrupted Planning Board with help of Rezko and Obama

“Why did the Illinois Senate Health & Human Services Committee, with Obama as chairman, create and push Bill 1332, “Illinois Health Facilities Planning Act,” early in 2003, which reduced the number of members on the Board from 15 to 9, just prior to rigging by Tony Rezko and Rod Blagojevich?”…Citizen Wells

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

Stuart Levine, the key witness in the Tony Rezko trial, is about to be called as the next witness in the William Cellini trial. Levine did the the dirty work for Rezko, the long time associate of Obama.

From the Stuart Levine Plea Agreement.

“In about August 2003, Defendant was re-appointed to the
Planning Board. Prior to that point, Defendant discussed his
possible re-appointment with Individual A and, separately, with
Individual B. Individual A said he’d get back to Defendant about
his request and later called Defendant and said that it would
happen. A short time later, Defendant was at a meeting in Rezko’s
office with Individual B and Individual B said that the board seat
Defendant wanted had been taken care of. Defendant understood from
these conversations that he would be re-appointed to the Planning
Board.

About the time Defendant was re-appointed, Rezko and Defendant
discussed Defendant’s appointment and Rezko said that he had
suggested that Defendant be made the vice-chairman of the Planning
Board and that Rezko expected to influence a certain number of
votes on the Planning Board. In February 2004, the Planning Board
elected Defendant as vice-chairman.

In or about the spring of 2004, Rezko and Defendant agreed
that Defendant, whose term on the TRS Board was due to expire in
May 2004, needed to be reappointed to the TRS Board and that
additional TRS Board members needed to be appointed who would
cooperate with Rezko and Defendant. Rezko agreed to use his
relationships and influence with high-ranking State of Illinois
officials to facilitate these efforts. Rezko subsequently
indicated to Defendant that Rezko had arranged for Defendant to be
re-appointed to the TRS Board, and Defendant was re-appointed on
about May 14, 2004.”

“Shortly before the Planning Board meeting on April 21, 2004,
Defendant had several telephone conversations with another Planning
Board member about Mercy and its application for a CON. That
Planning Board member said he had his “marching orders” from Rezko
and that Rezko wanted to help on Mercy’s application. In another
telephone conversation with the same Planning Board member,
Defendant said that it was important that Rezko’s direction on the
vote be communicated to the other Planning Board members that Rezko
influenced on the Planning Board.

At its meeting on April 21, 2004, the Planning Board
considered Mercy’s application for a CON. At this meeting,
Defendant and a majority of the Planning Board voted in favor of
Mercy’s application. Defendant intentionally concealed from and
failed to disclose to the Planning Board material facts relating to
its consideration of Mercy’s application, including his
arrangements with Rezko and Kiferbaum. After the meeting
concluded, another Planning Board member and Defendant met with
Rezko and discussed the Mercy vote.

After the April 21, 2004, Planning Board meeting, Defendant
directed Kiferbaum to pay the kickback relating to Mercy to
Individual E pursuant to a sham consulting contract. Steve Loren
drafted the contract. Defendant, Kiferbaum, and Individual E
agreed that the purpose of the contract was to make Kiferbaum’s
payments to Individual E look legitimate; that Individual E would
not, in fact, to do any work for Kiferbaum; and that Individual E
would share the Mercy kickback with Defendant.”

There is only one way that the Planning Board could be rigged with 5 member’s votes. The board had to be changed from 15 to 9 members.

Obama’s connection to the rigging of the Planning Board is apparent from this timeline.

“Jan. – Aug. 2003:  Obama was Chairman of the IL Senate Health and Human Service Committee.
Feb. 20, 2003: Senate Bill 1332 “Illinois Health Facilities Planning Act” filed. Reduced members of IL Health Planning and Facilities Board from 15 to 9.

(Rezko Trial March 13, 2008; 3:09 p.m.)

“Almanaseer was appointed to the planning board in 2003 on Rezko’s recommendation. Prosecutors contend he became part of a five-member voting bloc on the board that followed Rezko’s wishes. Almanaseer said board Chairman Thomas Beck tried to steer his voting.

“He said, ‘If you just don’t know which way to vote, vote the way Mr. Levine votes because that’s the way Tony would want the vote to go,” Almanaseer recalled, referring to Stuart Levine.”

Spring 2003 – Nov 2003: (Rezko trial March 11, 2008; 10:58 a.m.)

“Jennifer Thomas, a former aide to Gov. Rod Blagojevich’s patronage chief Joe Cini, continued on the stand Tuesday morning and gave a few more insights into those regular Monday morning meetings she and Cini held in 2003 with Antoin “Tony” Rezko at his office.”

“Thomas said Rezko floated the names of several people to sit on the Illinois Health Facilities Planning Board, which the government claims Rezko corrupted with the help of board member Stuart Levine. And Thomas said Rezko at one point made it clear that he wanted to see Levine reappointed to the panel, which was being overhauled by the governor in 2003.”
May 21, 2003: Senate Bill 1332 passed by House and Senate.
June 27, 2003: Blagojevich made this the effective date of Senate Bill 1332.
June 2003: (Rezko trial March 10, 2008; 4:16 p.m.)

“Ziegelmueller asked Hayden about a 2003 e-mail exchange with Lichtenstein, then the governor’s top lawyer, in which Wilhelm made recommendations for the Illinois Health Facilities Planning Board.
The name of Barack Obama, the Democratic front-runner for the presidential nomination, also appears in the e-mail as a member of a strategic team reviewing hospital board matters with the governor’s staff when he was a state senator. The hospital board was scheduled to be revamped in the summer of 2003.
Obama was then chairman of the Senate Committee on Health & Human Services.”
June 30, 2003: Obama gets the following donations.

$5000 Ali Ata was appointed as Director at IFA
$6000 Alison Davis gets appointment on Investment Board
$15,000 Dr. Michael Malek gets appointment on Hospital Facility Board
$5000  Abdelhamid Chaib’s wife gets appointment on Employee Security Board

“I believe I’m more pristine on Rezko than him.”…Rod Blagojevich

From the Chicago Tribune October 11, 2011.
“Former Teachers’ Retirement System lawyer testifies to power broker’s
role in Blagojevich-TRS corruption axis, misconduct of implicated
board member Levine”

“A small but key group of people involved in the Illinois Teachers’
Retirement System had gathered for a meeting in a Chicago office
building in February 2004.

TRS Executive Director Jon Bauman and board member Stuart Levine were
already there, but longtime Springfield power broker William Cellini,
who had made millions of dollars from investing funds for the pension
system, was running late.

When Cellini arrived, he had warm welcomes — and a hug and a kiss on
the cheek for both Bauman and Levine — as well as a story to tell,
according to testimony Tuesday during the third day of Cellini’s
federal trial on charges of fraud and attempted extortion.

Testifying for the government, Steven Loren said Cellini indicated he
had met with top advisers to then-Gov. Rod Blagojevich to warn them
they were “moving too fast” and were “going to get themselves in
trouble.” Cellini said he went on to tell the advisers, Antoin “Tony”
Rezko and Christopher Kelly, that they should use “Bill Cellini as an
example,” according to Loren, who was a lawyer for TRS at the time.
Cellini then related to them how in his 30 years in politics he had
stayed “above the fray” and “out of the limelight.”

Cellini is now defending himself on charges that he worked with
Levine, Rezko and Kelly to try to squeeze a campaign contribution for
Blagojevich’s campaign from a Hollywood producer whose investment firm
had substantial TRS business.

Loren testified for about five hours about how Levine and Cellini
plotted with Rezko and Kelly to protect their influence with TRS.

Prosecutors hope Loren’s testimony will be important corroboration for
Levine, the government’s key witness, whose credibility is a central
issue for the defense. Levine — who like Loren has pleaded guilty in
the scandal — could take the witness stand as soon as Wednesday.

Loren testified that Levine had asked him to help defeat a proposal to
merge several state pension boards, a move that would have diluted the
power Cellini and Levine held at TRS. Loren said Levine told him he
showed Cellini a rough draft of some talking points on the issue
prepared by Loren. Cellini thought the ideas looked good but for one
minor tweak — the font should be changed, Loren said.

Loren also talked about how during a car ride with Levine in October
2003 — the last Friday of the month, he repeatedly recalled — he
agreed to help Levine prepare a sham finder’s fee for a man who did
business with the state.

In that same conversation, Levine explained to Loren that Cellini,
Kelly and Rezko had talked about how they would use these sham
finder’s fees to reward Blagojevich campaign contributors and that in
return, Rezko and Kelly would not interfere with the selection of
investment companies for TRS.

Loren endured a lengthy cross-examination by Cellini’s attorney, Dan
Webb, who prodded him about his role in the scandal, what other “acts
of dishonesty” he committed and his friendship with Levine, who in
testimony in Rezko’s 2008 trial admitted to drug binges.

Loren testified that he considered him a close friend but realizes
that Levine kept secrets from him. Webb asked Loren whether Levine
shared details about “his all-night drug parties.”

His head down, Loren said no.

While U.S. District Judge James Zagel blocked some of Webb’s
questions, Loren admitted he had fudged billing records in an
unrelated case.”

How is Obama connected to Steven Loren?

From the Rod Blagojevich Complaint. (Note bold wording)

“35. As described more fully in the following paragraphs, Mercy
Hospital, which sought permission from the Planning Board to build a
hospital in Illinois, received that permission through Rezko’s
exercise of his influence at the Planning Board after Rezko was
promised that Mercy Hospital would make a substantial campaign
contribution to ROD BLAGOJEVICH. Rezko later told a member of the
Planning Board that Mercy Hospital received the permit because ROD
BLAGOJEVICH wanted the organization to receive the permit.

36. Levine’s criminal activities included his abuse of his position on
the Planning Board to enrich both himself and Friends of Blagojevich.
The Planning Board was a commission of the State of Illinois,
established by statute, whose members were appointed by the Governor
of the State of Illinois. At the relevant time period, the Planning
Board consisted of nine individuals. State law required an entity
seeking to build a hospital, medical office building, or other medical
facility in Illinois to obtain a permit, known as a “Certificate of
Need” (“CON”), from the Planning Board prior to beginning
construction.

37. Levine, as well as Planning Board members Thomas Beck and Imad
Almanaseer, testified under oath at the Rezko Trial.9 Beck testified
that he asked Rezko to reappoint him to the Planning Board and that
Beck thereafter followed Rezko’s directions regarding which CON
applications Rezko wanted approved. Beck testified that it was his job
to communicate Rezko’s interest in particular CONs to other members of
the Planning Board, including Almanaseer, who were loyal to Rezko.
Beck testified that he understood that Rezko spoke for the Blagojevich
administration when Rezko spoke to Beck about particular CONs.
Almanaseer testified that Beck instructed him that Rezko wanted
Almanaseer to vote a particular way and that Almanaseer should follow
Levine’s lead in voting on CONs. Almanaseer testified that before
certain Planning Board meetings, he received notecards from Beck
indicating how to vote on certain CON applications. Beck testified he
provided these notecards to Almanaseer and certain other members of
the Planning Board to communicate Rezko’s directions about certain CON
applications.

38. During his testimony, Levine described a plan to manipulate the
Planning Board to enrich himself and Friends of Blagojevich. The plan
centered on an entity commonly known as Mercy Hospital (“Mercy”) that
was attempting to obtain a CON to build a new hospital in Illinois.
Levine knew the contractor hired to help build the hospital. In
approximately November 2003, on behalf of the contractor, Levine
checked with Rezko to determine whether Rezko wanted Mercy to obtain
its CON. Rezko informed Levine that Mercy was not going to receive its
CON. According to Levine, he asked Rezko whether it would matter to
Rezko if Mercy’s construction contractor paid a bribe to Rezko and
Levine and, in addition, made a contribution to ROD BLAGOJEVICH.
Levine testified that Rezko indicated that such an arrangement would
change his view on the Mercy CON.

39. Levine’s testimony regarding Rezko’s actions to change the
Planning Board decision concerning Mercy’s application for a CON based
on contributions for ROD BLAGOJEVICH is confirmed by attorney Steven
Loren. Loren testified at Rezko’s criminal
trial and, before that, in the grand jury.11 According to Loren, in
approximately December 2003, Levine informed Loren that Rezko was
against the Mercy CON. According to Loren, Levine relayed to Loren a
conversation between Rezko and Levine during which Levine asked Rezko
whether a political contribution to ROD BLAGOJEVICH would make a
difference for Mercy’s CON, and Rezko responded to Levine that such a
contribution might make a difference.”

William Cellini trial update October 11, 2011, Cellini trial coverage from Natasha Korecki of Chicago SunTimes

From the Chicago Tribune October 11, 2011.

“An Illinois powerbroker on trial for attempted extortion complained that then-Gov. Rod Blagojevich’s confidants were too overt about seeking benefits from state decisions and should follow the example he set during his decades close to the reins of power, a witness told jurors Tuesday.

The testimony came as prosecutors laid out their case in the week-old trial of millionaire businessman William Cellini. He is accused of conspiring with Blagojevich insiders Tony Rezko and Chris Kelly to shake down the Oscar-winning producer of “Million Dollar Baby” for a $1.5 million campaign contribution to Blagojevich.

Cellini, now 76, arrived late at one meeting in Chicago in February 2004, visibly agitated as he described a recent encounter with Rezko and Kelly, according to witness Steven Loren. Loren is a former attorney for the $30 billion Teachers’ Retirement System, which is central to the case against Cellini.

Cellini grumbled that the Blagojevich confidants “were moving too fast, they were going to get themselves in trouble,” Loren told jurors.

Once known as the King of Clout for the influence he wielded in Illinois politics going back to the 1960s, Cellini said Rezko and Kelly should follow the example he set over a 30-year span close to top-tier Illinois decision makers, and “stay out of the limelight” and “above the fray,” Loren testified.

Cellini, whose trial entered a second week on Tuesday, allegedly plotted with Rezko and Kelly to squeeze Hollywood producer Thomas Rosenberg by threatening to yank $220 million in Teachers’ Retirement System funds from Rosenberg’s investment company unless he came up with the donation.”
“Much of Loren’s testimony Tuesday drew on his interactions with Stuart Levine, a TRS board member at the time and another figure in the alleged conspiracy who is expected to take the stand later.

During cross examination, defense attorney Dan Webb sought to hit at the trustworthiness of Levine, who admitted on the stand at another trial that he abused cocaine and other drugs — sometimes at marathon parties.

“You do know that he had a habit of lying to you, is that correct?” Webb asked Loren about Levine, pacing across the courtroom floor and raising his voice slightly. The judge sustained a prosecution objection before Loren could respond.”

Obama past surfaces again, Health Facilities Planning Board rigging, Pam Davis listening device

“Why was Obama in constant contact with Tony Rezko in 2004 when Rezko was conspiring with William Cellini to use TRS, Teacher Retirement Fund, assets for political gain and personal enrichment?”…Citizen Wells

Obama’s past corruption ties have surfaced again. This will continue to happen.

From Citizen Wells JUly 15, 2011.

“Obama and the US Justice Department must believe that they have done a masterful job of protecting Obama while aggressively prosecuting his corruption buddies. But the ghosts of Christmast past keep appearing.

Tony Rezko and Stuart Levine are awaiting sentencing. Rod Blagojevich will certainly appeal his convictions. William Cellini is awaiting trial in October 2011. And Daniel Frawley mentioned Rezko and Obama and $ 1.5 million dollars as well as Rezko’s old partner Daniel Mahru in a deposition December 1, 2010.”

I was pleased and amazed to see a reference to the Health Facilities Planning Board and Pam Davis in a Chicago Tribune article dated July 26, 2011.

“As the 18 jurors stood in a cramped freight elevator and left
theChicago federal building for the first time as a group, the woman
whom they later chose to be their leader said the sobering importance
of their task could be read on each face.

“There was a lot of stunned silence,” said Connie Wilson, a retired
Naperville church choral director who served as forewoman in the
recent retrial of former Illinois Gov. Rod Blagojevich. “There was a
lot of nerves, shocked expressions and even some tears.”

Wilson offered another glimpse Monday into the inner workings of the
federal jury that last month convicted Blagojevich on 17 of 20 counts
of fraud, corruption and attempted extortion.”

“Two members in the audience played an early but crucial role in the
FBI investigation that uncovered widespread corruption in
Blagojevich’s administration.

Pam Davis, CEO of Edward Hospital in Naperville, and William Kottmann,
CEO of Edward Medical Group, both secretly wore a listening device for
the FBI for eight months in 2003 after raising extortion complaints in
their bid to build a $218 million hospital inPlainfield.

Davis said they were told that If they hired builder Jacob Kiferbaum’s
firm, , the then-Illinois Health Facilities Planning Board would
support their plans. Later, Kiferbaum and health board member Stuart
Levine and Tony Rezko, a top Blagojevich fundraiser, either pleaded
guilty or were convicted on federal charges.

Listening to Wilson speak, Davis said she felt vindicated.

“There was fallout,” Davis said. “But I felt this man (Blagojevich)
was corrupt and his corruption was widespread. It was worth the effort
that he was finally convicted.””

From Citizen Wells March 14, 2011.

“Jan.

Blagojevich motion for retrial, July 26, 2011, Judicial bias by Judge James Zagel, Wiretaps should be played

“There is enough corruption in Illinois so that all it takes is someone who is serious about finding it to uncover it. If a U.S. attorney is not finding corruption in Illinois, they’re not seriously looking for it.”…Northwestern Law Professor James Lindgren

From the Chicago Tribune July 26, 2011.

“Blagojevich asks for new trial, cites judicial bias”

“Former Gov. Rod Blagojevich, convicted last month of wire fraud, bribery, attempted extortion and conspiracy in his second federal public corruption trial, filed a motion late Monday for another retrial, citing numerous instances of alleged judicial bias and error that helped the prosecution “strip away the effective aspects of the defense case.”

“Virtually every error in this trial stemmed from the fact that this Court deprived Blagojevich of the presumption of innocence and exhibited bias against the defense,” the motion asserted. “The Court formed a closed mind to the evidence and made findings of fact.”

The motion said that “the government did not only benefit from the first trial, it used every opportunity to strip away the effective aspects of the defense case. … The Court rubber-stamped the government’s requests.”

The litany of criticisms in the 158-page document touched on everything from jury selection to Blagojevich’s attorneys’ long-held argument that more of the secretly-recorded phone calls that were at the heart of the government case should be played.

The motion also noted that U.S. District Judge James Zagel ruled against Blagojevich at nearly every turn.

His attorneys also zeroed in on Blagojevich’s decision to testify at the second trial — arguing that while Zagel had assured Blagojevich’s defense team that taking the stand would allow Blagojevich the chance to explain his behavior, his rulings during the testimony prevented that.

Blagojevich did not testify during his first trial last year in which a jury convicted him of one of 24 counts against him — that he lied to the FBI. The jury deadlocked on the rest of the charges, leading to the second trial and his sweeping conviction last month on an additional 17 counts.”

I have researched, analyzed and lived with Operation Board Games and the Chicago corruption involving Tony Rezko, Stuart Levine, Rod Blagojevich, Barack Obama, et al for over 3 years. I am sticking with the following conclusion I came to.

The fix was in in 2006. Blagojevich, who had been the presumptive presidential candidate until then was exposed. Barack Obama would replace him and he had to be protected. That is why the prosecution of Blagojevich was delayed and dragged out. There is more to this saga.

We are awaiting news of the Blagojevich appeal. Was this a setup too or was Blagojevich designated as the sacrificial lamb?

From the Chicago Tribune June 28, 2011.

“Blagojevich appeal likely to revisit complaint about tapes”

“Rod Blagojevich and his lawyers have long complained that prosecutors and the judge in his two trials were fundamentally unfair, but after his sweeping corruption conviction Monday, only a successful appeal built on that belief stands between the former governor and a possible double-digit prison sentence.

From early denials of Blagojevich’s demands to “play all the tapes” in his case, to U.S. District Judge James Zagel’s limiting of the former governor’s defense at his retrial, Blagojevich has always felt handcuffed, said one of his lawyers, Sam Adam Jr.

“If you look at the whole process, he was condemned from the moment he was arrested,” contended Adam, who took part in the first trial, which ended largely deadlocked.

Blagojevich was convicted on 17 corruption charges, including all 11 counts alleging he sought something of value for himself to fill the U.S. Senate seat vacated by Barack Obama after his 2008 election as president.

Blagojevich, who has been found indigent by the court, will likely seek to have a lawyer appointed in the coming weeks to represent him in the appeal, Adam said. Taxpayer money would be used to pay for that attorney.

The appeal will likely argue that in both trials, the judge unfairly barred the defense from playing many undercover recordings critical to its case, severely limited cross-examination of government witnesses and allowed too many jurors who professed bias onto the panel, Adam said.

The government was allowed to play at trial more than 90 of the secretly made recordings of Blagojevich, Adam said, while the defense was allowed just four.

“The jury only got to hear one side of the tapes,” Adam said. “If you do that, you’re going to guarantee a conviction.”

In a mistrial motion filed June 9 as closing arguments were under way, the team of defense lawyers at the retrial accused Zagel of bias and having a “closed mind” on the evidence.”

The Federal rules on discovery are crystal clear.

“Federal Rules of Criminal Procedure”

“IV. ARRAIGNMENT AND PREPARATION FOR TRIAL > Rule 16.

Rule 16. Discovery and Inspection

(a) Government’s Disclosure.

(1) Information Subject to Disclosure.”

“(B) Defendant’s Written or Recorded Statement.

Upon a defendant’s request, the government must disclose to the defendant, and make available for inspection, copying, or photographing, all of the following:

(i) any relevant written or recorded statement by the defendant if:

•the statement is within the government’s possession, custody, or control; and
•the attorney for the government knows — or through due diligence could know — that the statement exists;”

From the Chicago Tribune July 11, 2011.

“No, corruption isn’t ‘just politics’
Jurors and judges aren’t buying that defense mantra”

“June 27, 2011: Jurors convict Rod Blagojevich on 17 counts of public
corruption. In essence, those jurors reject the defrocked governor’s
suggestion that, during conversations recorded by the FBI, he was
engaging in routine politics rather than a self-serving crime spree.
The trial outcome leaves Blagojevich likely to serve many years in
federal prison.”

“During much of Patrick Fitzgerald’s decade as U.S. attorney in
Chicago, some Illinois pols have waged a plaintive whispering campaign
with journalists and anyone else who would listen:

Fitzgerald’s office is criminalizing politics! Public officials trade
favors! Always have, always will!

This self-exculpatory rationale for politicians’ illicit behavior has,
over time, become the defense of choice in Illinois public corruption
cases. The Blagojevich and Ryan trials, the federal convictions of
Ryan sidekick Scott Fawell and Mayor Richard M. Daley acolyte Robert
Sorich — defense attorneys in these and other prosecutions have tried
to aw-pshaw their way past the damning evidence by peddling versions
of a soothing mantra:

This defendant is guilty of nothing more than politics as usual. All
public officials help people who help them. This is just the game —
not the serious crimes these prosecutors would have you believe.

But the mantra isn’t working. Jurors and judges are having no trouble
distinguishing between genuine exercises in political activity and
blatant violations of federal laws. “I was one where I felt he was not
guilty on several counts,” juror Maribel DeLeon of West Dundee said
after helping to convict Blagojevich. “But, lo and behold, we would go
back through the tapes and there it was. I’d say, ‘Ah, Rod.’ It hurt
me. How could I say not guilty when the evidence was there?”

No agonizing there about whether Blagojevich was Mr. Just-Politics.

Fitzgerald, in comments after the verdicts, crisply synthesized what
DeLeon and 11 other jurors had just decided: “There is legitimate
politics. There are gray areas. Selling a Senate seat, shaking down a
children’s hospital and squeezing a person to give money before you
sign a bill that benefits them is not a gray area. It’s a crime.””

Patrick Fitzgerald stated: “There is legitimate
politics. There are gray areas.”

Obama’s part in the rigging of the IL Health Planning Board, lying about his contact with Tony Rezko and the shady House and land puchase with Rezko are not gray either. Using US Justice Department attorneys to keep his records hidden is not looking too gray either.

In case you have forgotten or not seen this, here are some exerpts from the subpoena of Barack Obama issued by the Blagojevich defense team in 2010.

“Case 1:08-cr-00888 Document 327 Filed 04/22/10 Page 1 of 11
IN THE UNITED STATES DISTRICT COURT
FOR THE NORTHERN DISTRICT OF ILLINOIS
EASTERN DIVISION
UNITED STATES OF AMERICA )

v.                       ) 08CR888
                         )
                         ) Judge James B. Zagel
ROD BLAGOJEVICH          )

MOTION FOR THE COURT TO ISSUE A TRIAL SUBPOENA TO PRESIDENT BARACK OBAMA

Now Comes Defendant Rod Blagojevich, by and through his counsels and hereby requests this court issue a subpoena ad testificandum for President Barack Obama.”

“21. Tony Rezko is one of the government’s main witnesses.8 Mr. Rezko’s credibility is extremely relevant in this trial. In many instances, Mr. Rezko is the government’s crucial witness to prove up their allegations.9 Mr. Rezko wrote a letter to a federal judge stating “the prosecutors have been overzealous in pursuing a crime that never happened. They are pressuring me to tell them the “wrong” things that I supposedly know about Governor Blagojevich and Senator Obama. I have never been a party to any wrongdoing that involved the Governor or the Senator. I will never fabricate lies about anyone else for selfish purposes.” (Exhibit A)
22. However, the defense has a good faith belief that Mr. Rezko, President Obama’s former friend, fund-raiser, and neighbor told the FBI and the United States Attorneys a different story about President Obama. In a recent in camera proceeding, the government tendered a three paragraph letter indicating that Rezko “has stated in interviews with the government that he engaged in election law violations by personally contributing a large sum of cash to the campaign of a public official who is not Rod Blagojevich. … Further, the public official denies being aware of cash contributions to his campaign by Rezko or others and denies having conversations with Rezko related to cash contributions. … Rezko has also stated in interviews with the government that he believed he transmitted a quid pro quo offer from a lobbyist to the public official, whereby the lobbyist would hold a fundraiser for the official in exchange for favorable official action, but that the public official rejected the offer. The public official denies any such
conversation. In addition, Rezko has stated to the government that he and the
public official had certain conversations about gaming legislation and
administration, which the public official denies having had.”10

23. President Obama is the only one who can testify as to the veracity of Mr. Rezko’s allegations above.

24. President Obama has pertinent information as to the character of Mr. Rezko. President Obama can testify to Mr. Rezko’s reputation for truthfulness as well as his own opinion of Mr. Rezko’s character. See, Fed. R. Evid. 405(a) and 608. Mr. Rezko and President Obama became friends in 1990. According to President Obama, Mr. Rezko raised as much as $60,000 in campaign contributions for Obama.11

25. Based on the relationship that President Obama and Mr. Rezko had, President Obama can provide important information as to Mr. Rezko’s plan, intent, opportunity, habit and modus operandi. See, Fed. R. Evid. 404(b) and 406. For example, in June 2005, President Obama purchased a house for $1.65 million, $300,000 below the asking price. On the same day Tony Rezko’s wife, Rita, paid full price — $625,000 — for the adjoining land. In January 2006, Obama paid Mr. Rezko $104,500 for a strip of the adjoining land. The transaction took place when it was widely known that Mr. Rezko was under investigation.12 President Obama’s relationship with Tony Rezko is
relevant and necessary Fed. R. Evid. 404(b) and 406 evidence.”

“10 The defense has a good faith belief that this public official is Barack Obama. See, “Obama on Rezko deal: It was a mistake”, Dave McKinney, Chris Fusco, and Mark Brown, Chicago Sun Times, November 5, 2006. Senator Barack Obama was asked: “Did Rezko or his companies ever solicit your support on any matter involving state or federal government? Did Al Johnson, who was trying to get a casino license along with Tony Rezko, or Rezko himself ever discuss casino matters with you?” Senator Obama answered: “No, I have never been asked to do anything to advance his business interest. In 1999, when I was a State Senator, I opposed legislation to bring a casino to Rosemont and allow casino gambling at docked riverboats which news reports said Al Johnson and Tony
Rezko were interested in being part of. I never discussed a casino license with either of them. I was a vocal opponent of the legislation.” Obama’s involvement with Tony Rezko and this legislation coincides with the three paragraph summary the government has provided to the defense referenced above.”

Where is Tony Rezko?

“21. Tony Rezko is one of the government’s main witnesses.8 Mr. Rezko’s credibility is extremely relevant in this trial. In many instances, Mr. Rezko is the government’s crucial witness to prove up their allegations.”

Tony Rezko’s name is prominent in the William Cellini indictment.
CELLINI and Levine understood that Rezko and Co-Conspirator A were going to expect under the agreement that CELLINI would use his influence at TRS and Levine would use his position at TRS to help firms that made contributions for the benefit of Public Official A.”

http://www.justice.gov/usao/iln/pr/chicago/2008/pr1030_01a.pdf

I am certain that the US Justice Department will continue to protect Obama leading up to and during the William Cellini trial. However, if you think that Obama’s name could not come up during the trial, think again.
