“Chief Justice of the United States Supreme Court John Roberts threw everybody for a loop last week.

Both Fox and CNN reported on the Supreme Court ruling on Obamacare wrong the first time around. Which is understandable because days later pundits are still trying to make sense of what happened.

One of my favorite pieces so far is by Thomas Friedman of The New York Times, who, of course, praises Roberts for putting his country above partisan politics by using creativity and “finding a way to greenlight Obama’s Affordable Care Act.”

Friedman credits Roberts with putting partisan politics aside and doing what was best for the country. It is such an arrogant, closed-minded liberal world view it would be funny if it weren’t such a serious issue. Shoot, it is funny. According to Friedman the liberal view is what is best for the country. This is a fact. So Roberts is to be congratulated for putting his conservative ideals, which are by definition bad for the country, aside and figuring out a way to twist the law into a pretzel that says Obamacare is constitutional. To believe Friedman you have to accept his premise that what conservatives believe is not and cannot be good for the country, and when conservatives can put aside their own beliefs they can sometimes manage to work for the good of the country. You either have to laugh or cry. I choose laughing.

Here’s an explanation I haven’t read anywhere, but it seems possible. The problem is that Roberts has spent too much time in Washington. People talk about getting inside-the-Beltway syndrome, and maybe Roberts has been in Washington for so long he believes that the extreme left-wing views that dominate Washington are the norm for the nation. Or he doesn’t believe it, but like living in a town with a paper mill, after a while you think stench is normal. It’s tough for conservatives living in Washington because it doesn’t matter how big a majority the Republicans have in Congress, in Washington conservatives are a tiny minority of the population that usually dash to Capital Hill and then back to Reagan National Airport and somewhere more normal.

Maybe Roberts has been in Washington so long, he believes that the opinions you hear in restaurants, coffee shops and on the metro are the norm. Of course, it’s hard to imagine Roberts in a coffee shop or on the metro, but it could happen.

Look at President George Walker Bush. He was convinced that people wouldn’t be that upset about a tax increase. It’s hard for a president to get out and mingle, but he should have been told that the rest of the country didn’t like the idea of a tax increase from a president who had been in every corner of the country saying, “read my lips, no new taxes.” In Washington, it was considered par for the course. There are politicians everywhere in Washington and nobody except someone straight in from the countryside believes anything they say. The voters in Washington elected Marion Barry after he had been convicted of possession of cocaine. It’s a different world.

On the good side of the Roberts’ judicial reasoning is that it has now been established without a doubt that Obamacare is being paid for with a tax. It is also definitely a tax on the middle class, and President Barack Hussein Obama has promised over and over he would not raise taxes on the middle class. According to some estimates this represents by far the largest tax increase in history and will result in over $1 trillion in new taxes.

Imagine how much more power it gives to the federal government to take an additional $1 trillion out of the private economy and decide where and how it will be spent.

The other parts of the ruling really are good news. Finally there is some check on the federal government forcing the states to do whatever it wants by withholding funds. The federal government might have to use reason or compromise in the future. One state legislator has told me that North Carolina won’t be able to afford the new Medicaid provisions, and North Carolina is not alone.

One of the most interesting articles to come out of the Supreme Court decision is by Jan Crawford of CBS News, who evidently has great sources inside the Supreme Court. She reports that Justice Anthony Kennedy was relentless in his pursuit of Roberts, attempting to get Roberts back in the conservative fold.

Those on the outside had figured that Kennedy would be the conservative judge to vote with the liberals, but according to this report, which seems to be generally accepted as true, Kennedy was the one who wouldn’t accept the fact that Roberts had changed sides.

Here is another theory about Roberts. This was his one attempt at being a wild and crazy guy. Some men have a midlife crisis and go after younger women and some buy a red convertible. Perhaps some very conservative chief justices of the Supreme Court who, from reading their bios, never really did anything fun in their lives, decide to try something “Crazy, man, crazy” and vote with the liberals on a big case.

    The Roberts Opinion

    Interestingly, Fred Thompson was asked in 2005 by the Bush administration to assist Judge John Roberts during the Senate confirmation process for the nomination as chief justice of the Supreme Court. He got to know him fairly well and has written a good analysis of his impression of Roberts the man and also of the ruling.

    Thompson does not agree with the decision. He also points out some flaws with the gems that have been selected by conservatives, such as issues involving the Commerce Clause and also the 7-2 decision seemingly protecting states’ rights.

    In all seriousness, I am not being morbid or cowardly but realize that we may eventually see civil war in our country. Resisters who are unable to prevail against captors could end up as prisoners That is reality.     Good article by Fred. I thought the best part of the article was when he wrote this about how Roberts may have have done “us” a favor by ruling in favor of the bill because of Government’s “taxing authority”:

    Now if I can go on a bit about something that is really concerning to me, and CW has covered.

    I am sick and tired of hearing about how these voter ID laws disproportionately affect minorities and blah blah blah. Get a piece of ID for FREE down at the license branch. Can’t afford a ride? No family available to take you down there (my question to this is how do you intend to get to the polling station? How about calling THEM for a ride to get some ID?)?

    This is all stupid rhetoric so that voter fraud is allowed. A restriction on voters? Oh my goodness, it USED to be that only PROPERTY owners were allowed to vote.

    This whole thing about arguing that it disproportionately affects minorities is probably true. THAT’s because it’s MINORITIES who don’t, by their own CHOICE, have a valid identification. But I’d bet they could produce one for smokes, or liquor, or to get on an airplane, or a whole bunch of other stuff you have to produce identification for.

    But an election is such a trivial thing, why do you need to prove you are who you say you are?

    And another thing that gets me (sorry, I feel like I’m on a roll here).

    I heard O’Reilly say during his email section tonight that the Government DOES have a place in healthcare under the “promote the general Welfare” words being in the Constitution.

    In my opinion “promote the general Welfare” is NOT about HEALTH. It is about the “welfare” of the COUNTRY and not about helping those citizens who are sick.

    He went on about what happens if your insurance company dumps you if you get sick. I have a novel idea, and it’s a compromise, how about putting in your CONTRACT with the insurance company that they CAN’T dump you if you get sick, UNLESS your health care costs reach a certain amount? THAT would promote competition, because you would have differing caps. Like when you’re a healthy “twentysomething”, you could get an amout of say 100,000, and as you grow older you would increase that amount. Seems to me that an insurance company would even offer a plan that increased on it’s OWN each decade. But you don’t need Congress to make this happen, you need FREE MARKET, and that died a long, long time ago.

    O’Reilly’s interpretation of the “general welfare” “clause” in the Constitution is absurd.

    Just like the “commerce clause” has been twisted in to a pretzel.

    It’s easy to get people to believe this crap, when it’s drilled in to your brain 24/7, but come on people.

    I have encounter several links to this information. Here are only 2 of them. Both note the information I noted at 7:45pm above. Seems now that a flag waving, patriotic, God fearing, legal citizen is now considered to be a terrorist suspect in his own land.

    I believe that IF the MSM would educate the Country hour after hour that the definition as meant by the Founders was “someone born on US soil to citizen parentS”, then maybe the people would take another look at the “natural born citizen” issue.

    But it’s not even mentioned.

    There should be a concerted effort by ALL so called conservative radio talk show hosts to bring this up on the same day. That way the television media would have to ridicule ALL of them.

    Dean, I’m in your camp partially and do not doubt Roberts’ conservatism or moral integrity; however, whatever his intentions were in the way his decision was crafted (I’ll give him the benefit of the doubt that he purposely did it in such a way to benefit Repubs and fool Dems), it was somewhat bungled in several areas.     As much credit as we want to give Roberts for being clever and wise, we must also admit that there are serious LEGAL flaws in the conclusions for his opinion.
    He may have achieved his goals in one respect – placating the media and putting a Trojan horse in the enemy’s camp – but in so doing he also committed some serious legal no-no’s, to put it in today’s vernacular.

    Those flaws may come back to bite him in the future. This is not the end of the story, by any means.

    Sorry to make a pest out of myself, but the analytical part of my brain works in a progressive fashion.
    It seems that there are three issues that loom out with respect to the technicalities of the Roberts decision. These are inconsistencies in his written opinion:

    1) Roberts does NOT call the mandate “penalty” a tax when it comes to application of the Anti-Injunction Law (requiring no suit be filed until 2014 after the tax becomes effective). Then he turns around and calls it a tax for purposes of declaring the mandate constitutional. Why? How can it remain a penalty for one purpose and not for another in the same bill?

    2) In declaring the mandate a TAX, when Congress passed it as a PENALTY, he is actually rendering a decision on a bill that was never passed by Congress or signed by the President. Isn’t this a case of real judicial activism? Isn’t this really setting a terrible precedent? Isn’t this bad law?

    3) I have only a background in tax law, so maybe something is missing in my judgment on this point. If the mandate is unconstitutional under the Commerce Clause, as the Court declared, then how can a tax levied on the required activity under the mandate be constitutional? Or stated another way: If the mandate is dead under the Commerce Clause, then how can a tax, penalty, fine, or whatever you want to call it, then bring it alive? What twisted rationale?!?1

In fact Michael Medved was a classmate with hers in college and has some nice things to say about her in his book RIGHT TURNS, if I recall correctly. Or maybe it was something I heard him say on the radio.

    Not to give away my age, but since I’m a Vietnam Vet, I guess that can’t be helped. In High School I campaigned for Goldwater with Young Americans for Freedom (YAF) to which I belonged. Goldwater was our hero. My dad looked alot like Goldwater and was sometimes mistaken for him in a crowd. “No, I’m not Sentor Goldwater,” he would say. I went door to door, sold Goldwater soda and soap–really worked overtime and burned myself out. His defeat was such a let-down I got really sick afterwards and missed three weeks of school.

    I knew Vietnam was going to explode if he were not elected–and somehow I would end up over there–which turned out to be the truth.

  53. I see Roberts as simply another example of the Peter Principle….placed in a position far above his experience, abilities, and most important in this position, judgement. Scalia’s mind is of far greater depth and substance. Roberts would do well to respect Scalia’s opinion before advertising his own shallowness and willingness to falsify the means to get to an end which, when all is said and done, will live on to make him a joke within judicial history. I see nothing of any surreptitious planning for any benefit to the future. There is so much lasting harm within this flawed decision that it will be extremely difficult to destroy it….and while even attempting to do so, it’s such a complicated mess with the regulations already written that it will be a long time before business will feel confident about the future enough to do any hiring.

    As I understand it, for the Anti-Injunction law to apply, the tax has first to be in effect. If it is not in effect, it can’t apply. It is not in effect until Obamacare is in effect. Make sense?

    Lincoln said, “A horse by any other name is still a horse.” When Obama’s lawyers finally used 50 words to argue that the mandate penalty was valid due to the power of Congress to tax, they were admitting the penalty was a tax. Call it what you want, a tax by any other name is still a tax.

    When they made that argument they cut their own throats. They kept it as brief as possible (50 words) and dropped it like a hot potato afterwords, But they gave Roberts what he needed to show what Obamacare really is. In truth it is a massive, massive tax. And Congress did this. It is the court’s duty to interpret the law, not write it. Roberts interpreted the penalty as a tax based on the Obama Administration’s own lawyers’ arguments. Congress wrote “penalty” but Roberts interpreted penalty as meaning “tax” because of Obama’s lawyer and because that is what it really is.

    Once the penalty is admitted to be a tax, the Anti-Injunction law can be used to challenge Obamacare. Not only that, the House can act on it and Obamacare can be challenged due to the “tax (penalty)” having originated in the Senate. It was not in the bill sent to the Senate by the House. Only the House can originate tax law.

    As to the Commerce Clause, Roberts says the Commerce Clause applies to a preexisting commercial activity. This was not such an activity. So it could not be used to enforce a federal mandate of any kind.

    Hope that is helpful. The reason Roberts may have been late in his decision, if he was, is it took awhile to see how all the parts fit together. Also, I think it took the whole court, even the liberal justices: Four to argue for and four to argue against, with Roberts as Chief Justice making the final decision. To me it was an inspired decision, giving me hope that God is still looking out for us. We just have to do our part.

    Dean M., Thank you so much for your input. I will agree wholeheartedly about hope in God and that we have to do our part. Recognizing that we cannot expect the Supreme Court to “fix” all of Congress’ messes and sensing that Roberts had that in mind, I still have qualms about the integrity of the decision itself.

    You say correctly, I believe, that the law has to be first in effect for the Anti-Injunction Act to apply. Here is my point: How then can the Supreme Court even be adjudicating this IF the taxing provisions of the mandate are not in effect and won’t be until 2014? That is a point made by some legal scholars, and I tend to agree. To me it is sort of like, “Which comes first, the chicken or the egg?”

    The Anti-Injunction Act forbids suits to be heard before the tax takes effect. Therefore, the Supreme Court shouldn’t have even taken the case yet, from a technical point of view, if it was a tax all along. In fact, there was a time when I thought that possibly they would decline to rule on it because of that issue.

    However, there is always the issue of “intent”. What was the intention of Congress when this monster was passed? Intent is very important in determining the outcome of cases. Congress never intended it to be a tax.
    If they had, it NEVER would have passed. Therefore, I believe there was judicial error on that point alone. There are times when intention becomes more important than the actual word(s) in adjudicating cases.

    Just because at the last moment Obama’s lawyers argued the “tax” issue – sort of like making a last ditch effort in the hopes that something might stick – it was insufficient to negate the intent of Congress, imho. Roberts seized upon the Obama’s brief court argument to back up his conclusion, but Obama himself repeatedly said it was not a tax.

    Just my thoughts, and I really like hearing from you. You always challenge me and encourage critical thinking. That is a real pleasure!

I think Justice Kennedy said it all when he originally judged this bill, if permitted as Congress intended it….a mandate (or passed in any other way which at the time Kennedy didn’t imagine)….it would be a radical change in the relationship between citizens and their government. We are already seeing this. Citizens are fearing their government even more with this judgement than before which was already on the chart just due to Obama being the cause.

    Well, I”m referring to the real fear of retribution for sooo many within the justice system; small business; media, etc. if they dare step out of the group think. I think a lot of these people within the justice system and media are terrorized of each other if they even dare to do anything out of the assumed PC orders from the powers that control their positions. And I think that underlying fear is what keeps them from standing on any personal principle that might still be living within. And I think this pronouncement by SCOTUS has put a huge stamp upon just what was feared re: future health/death panels/ordered penalties or incarceration against people of faith/bankruptcy due to mandates of purchasing and even over the top taxing AFTER the elimination of Bush tax cuts in Dec. So that underlying fear about what COULD possibly happen, with this pronouncement opening pandora’s box, is solidifying that fear of the ordinary citizen into panic in real time. Now we’ll see how people will react to this illicit cause for their fear. Will those so accustomed to compromise and obedience be willing to fight back against the thug approach or will the mob mentality of the food stamp crowd overwhelm the good? I mean….look at Greece/Spain….when asked to cut back and “austerity” measures were tried.

According to Wiki answers, Soetoro DID NOT appear on Meet the Press, on the above date, rather it was Joe Biden, and Walter Freidman.   92. We who are not juris enlightened admittedly do not have the legal rescources to utilise for the purpose of determining the legality of anything. We do however have maturity, and most of us possess various levels of formal educations. Some of us are SENIORS, some of us are VETERANS, and some of us are retired from small businesses. I for one have never aspired to,or actually pursued a political,or legal career. All of this said we DO however possess COMMON SENSE,and have tha ability to reason and use logic, in the process of rendering a personal judgement of anything. While I think it is probably meant to help us understand the complexities, and true nature of certain Constitutional,and respective state laws, I reject having such legal INSTRUCTION rammed down my throat by somebody from whom I have not solicited such INSTRUCTION. I will not speak for anybody else except myself, but when I have a question regarding a legal position I ask a retired Superior Court judge, who by the way graduated at the TOP of his class from law school. I attended high school with him from the late forties through the early 50s. He was a practicing attorney for many years, and later became a judge within the Superior Court. I am of the belief that he is in a far better position to advise us about the laws of our country, than are SELF PROCLAIMED legal experts who constantly spout laws,and interpretations of them, over the internet then try to tell us we are not paying attention. Anyone can research laws, simply by going to a public library which has legal archives for researchers. Those who can ,SHOULD research a legal question for themselves. If you do not know how all you have to do is talk with a legal research advocate group. They can get a person pointed in the right direction,and generally help us understand what a specific law implies. A few Legal Reform organisations even provide a wide variety of self help information relating to a range of legal questions. But you MUST understand that COMPLEX situations, or questions are best handled by an established lawyer,who specialises in the area of your question. When you are BUYING his/her expertise it is very unlikely that you will be misled,or misrepresented. But this is why there are lawyer disciplinary bodies in almost every state supreme court. If you are misrepresented,or misled you have the right to file a complaint against your lawyer.

    However, one sure thing, while our school children were reciting the Pledge of Allegiance every morning during 1967 and 1971, Barack Hussein Obama was in Indonesia reciting the Islamic call to prayer in perfect Arabic. Patriotism was not instilled in his heart as a child like American children, but instead devotion to Allah was imposed upon him……….

    Mr. Obama recalled the opening lines of the Arabic call to prayer, reciting them with a first-rate accent. In a remark that seemed delightfully uncalculated (it’ll give Alabama voters heart attacks), Mr. Obama described the call to prayer as “one of the prettiest sounds on Earth at sunset.”

    I have avoided the weight loss issue for Obama for a long time. He looks ill, and is loosing more weight. Please try to follow my logic here because my writing skills usually do not allow me to express myself well.

    I always joke that when middle age men loose weight they are “looking for a new girlfriend/wife or they got cancer”. I am absolutely certain that Obama doesn’t feel remorse for his actions (karma), his words demonstrate that. I am absolutely certain that Obama hasn’t put his efforts into fixing the economy, or he wouldn’t be partying and playing golf all the time, so no remorse possible. I do believe that Obama is dumbfounded that his ‘policies’ haven’t helped (actually they have made a bad situation much worse), but that wouldn’t cause weight loss either. BTW, there has been no mention of cancer either. He may be missing a ‘lover’ that he no longer plays basketball with, but I doubt that it would be still getting worse. That leaves the other two big causes of weight loss: chronic infectious diseases (like HIV, TB, ect) or chronic stimulating Drug use.

    The white house insider mentioned that his now deceased colleague had died mysteriously. This person had witnessed an Obama, re-invigorated, after a chanting episode in a tent before a speech. He might have been killed for the knowledge that he learned about Obama’s sudden ability to go from motionless exhaustion to bouncing off the walls ready. The White House insider suggested that possibility.

    I don’t think Obama is suffering from Karma. Then again, I don’t believe in Karma because I see good people suffer and bad people get ahead all of the time. Don’t get me wrong, doing the right thing as many times as possible should be done but for internal rewards. Frequently I am forced to the understanding that “no good deed, or attempted good deed, goes unpunished”. I believe that we will be judged after we exit this world, and I suspect Obama is waiting for his virgins in the afterlife.

    The aforementioned beliefs and experiences certainly cloud my judgement, but if I were betting it would be on drug use. Perhaps the POTUS and his government employed staff should be subjected to testing since they receive funding from we the people?

    In regard to the Meet the Press segment where Obama was asked to explain why he doesn’t follow protocol when the National Anthem is played, someone needs to come up with the video to verify that this actually occurred.

    However, one sure thing, while our school children were reciting the Pledge of Allegiance every morning during 1967 and 1971, Barack Hussein Obama was in Indonesia reciting the Islamic call to prayer in perfect Arabic. Patriotism was not instilled in his heart as a child like American children, but instead devotion to Allah was imposed upon him……….

    Mr. Obama recalled the opening lines of the Arabic call to prayer, reciting them with a first-rate accent. In a remark that seemed delightfully uncalculated (it’ll give Alabama voters heart attacks), Mr. Obama described the call to prayer as “one of the prettiest sounds on Earth at sunset.”

It turns out that there are allegations that this was all a satire which was put by somebody into emails which literally went everywhere. This was one of the statements I found at Wiki Answers. I also saw the Snopes name being mentioned in the same breath,so it would be plausible to think that it might have originated at that website. Snopes has gained a certain notoriety, yet it was they who originally brought the Soetoro birthplace dilemma to light. Somewhere along the line they turned about 180 degrees and became a place that is easy to DISLIKE.

    I’ve never quite thought of it like that, but there is no question that the group referred to (especially the recent RP devotees) is made up of a lot of young folks with tremendous energy and zeal. They are looking for somewhere to go – someone to get behind – and many times we’ve heard by Repubs that they need to be redirected so that they can be a viable force in Nov. and beyond. They way things are going now, some of them could easily fall into the wrong hands, if you sense the thought.

    About Romney’s campaign so far – You are right on the money. It is hard to believe how his staff – and he – could be bungling things the way they are. Last night I heard a Repub strategist (they’re a dime a dozen) say that Romney is not a fighter but he believed that he would run a good campaign. Hmmm……..

    This would be an extremely hard election period for ANY Repub candidate, because the opponent doesn’t “play by the rules.” Imagine going up against a wrestler or boxer that cheated repeatedly and violated all of the rules of conduct.
    In our case there is no referee to call Obama and team on it. Personally some of my worst fears seem to be coming true, i.e., that Romney is too nice and gentle to be able to handle his opponent. It is going to take the wisdom of a Solomon and the bravery of a David, going up against Goliath.
    Does Romney have what it takes?

    I assume the Roosevelt to whom Sen. Obama referred is Franklin D. Roosevelt. Our enemies in World War II were Nazi Germany, headed by Adolf Hitler; fascist Italy , headed by Benito Mussolini, and militarist Japan , headed by Hideki Tojo. FDR talked directly with none of them before the outbreak of hostilities, and his policy once war began was unconditional surrender.

    FDR died before victory was achieved, and was succeeded by Harry Truman. Truman did not modify the policy of unconditional surrender. He ended that war not with negotiation, but with the atomic bomb.

    Harry Truman also was president when North Korea invaded South Korea in June, 1950. President Truman‘s response was not to call up North Korean dictator Kim Il Sung for a chat. It was to send troops.

    Perhaps Sen. Obama is thinking of the meeting FDR and Churchill had with Soviet dictator Josef Stalin in Tehran in December, 1943, and the meetings Truman and Roosevelt had with Stalin at Yalta and Potsdam in February and July, 1945. But Stalin was then a U.S. ally, though one of whom we should have been more wary than FDR and Truman were.

    Few historians think the agreements reached at Yalta and Potsdam, which in effect consigned Eastern Europe to slavery, are diplomatic models we ought to follow. Even fewer Eastern Europeans think so.

    When Stalin’s designs became unmistakably clear, President Truman‘s response wasn’t to seek a summit meeting. He sent military aid to Greece, ordered the Berlin airlift and the Marshall Plan, and sent troops to South Korea .

    Sen. Obama is on both sounder and softer ground with regard to John F. Kennedy. The new president held a summit meeting with Soviet leader Nikita Khruschev in Vienna in June, 1961.

    Elie Abel, who wrote a history of the Cuban missile crisis (The Missiles of October), said the crisis had its genesis in that summit.

    “There is reason to believe that Khrushchev took Kennedy’s measure in June 1961 and decided this was a young man who would shrink from hard decisions,” Mr. Abel wrote. “There is no evidence to support the belief that Khrushchev ever questioned America‘s power. He questioned only the president’s readiness to use it. As he once told Robert Frost, he came to believe that Americans are ‘too liberal to fight.’”

    That view was supported by New York Times columnist James Reston, who traveled to Vienna with President Kennedy: “Khrushchev had studied the events of the Bay of Pigs,” Mr. Reston wrote. “He would have understood if Kennedy had left Castro alone or destroyed him, but when Kennedy was rash enough to strike at Cuba but not bold enough to finish the job, Khrushchev decided he was dealing with an inexperienced young leader who could be intimidated and blackmailed.”

    It’s worth noting that Kennedy then was vastly more experienced than Sen. Obama is now. A combat veteran of World War II, Jack Kennedy served 14 years in Congress before becoming president. Sen. Obama has no military and little work experience, and has been in Congress for less than four years.

    The closest historical analogue to Sen. Obama’s expressed desire to meet with no preconditions with anti-American dictators such as Iranian president Mahmoud Ahmadinejad is the trip British Prime Minister Neville Chamberlain and French premier Eduoard Daladier took to Munich in September of 1938 to negotiate “peace in our time” with Adolf Hitler. That didn’t work out so well.

    History is an elective few liberals choose to take these days, noted a poster on the Web log “Hot Air.” The lack of historical knowledge among journalists is merely appalling. But in a presidential candidate it’s dangerous. As Sir Winston Churchill said:

    Ronald Reagan spoke these words some forty-six years ago in his famous “A Time for Choosing” speech. Tragically, today in America it appears the time for choosing is fast passing. As each day goes by our debt grows more untenable; our security more imperiled; our economy more shackled; our government more tyrannical.

    These are symptoms of an America that has chosen the wrong path. We lost our way on the road to civilization, veering onto the road to serfdom. Our plight is the result of a hundred-plus year campaign by the socialist sophists to slowly but surely undermine the bedrock principles on which we had built our strength.

    While the ends of a nation are peace, prosperity and culture, from our founding there was a dichotomy of opinion as to how best to achieve these ends. It was not merely a matter of state versus federal or small versus big government. Rather, at its core the split rested and continues to rest upon embracing liberty or embracing tyranny.

    As the underappreciated French Political Economist Frédéric Bastiat argued, “The state is the great fictitious entity by which everyone seeks to live at the expense of everyone else.”

All these plans as a whole — with their common aim of legal plunder — constitute socialism.

    If only this message had resonated.

    We lovers of liberty allowed for the planting of these seeds of our destruction. We have always had the better ideas, but too often failed to adequately defend them.     “Ironically enough, the medicine applied by our state as the antidote for our ills has proven to be poison. The welfare state is killing our nation. Today entitlement spending makes up nearly half of our budget. Long term, we know that there will be no way to pay off our unfunded obligations — we will go bankrupt. There will be three options ultimately, though ultimately can come quite suddenly: default, hyperinflation or abolition of the welfare state.

    Default is considered by many to be an impossible option as it would likely lead to mass chaos given the necessary suspension of many government services, not to mention the practical reality that WE are the collateral in the event of default. To default is to be honest, and to be honest is anathema to the state.

    Hyperinflation in my view is the most likely outcome given the massive increase in the money supply, which is good for politicians until it hits because it allows them to kick problems down the road and impose a stealth tax. Currently, government is toeing the line between monetizing debt and intervening to keep its borrowing rates down, while incentivizing banks to keep money in their vaults or pump it into the stock market.

    I believe that as the downturn goes on the government will blame the banks for the lack of economic growth and force them to allocate credit to chosen political entrepreneurs and other bad credit risks, leading to massive inflation in prices which they will likely blame on evil speculators and greedy price gouging companies. Hyperinflation would allow the government to pay for the welfare state – by writing entitlement checks in worthless dollars and lead to economic paralysis as constantly rising prices would make economic calculation and thus commerce impossible.

    The final option would lead to the crucifixion of politicians. Of course, this might not be such a bad thing. All joking aside, there is a reason that entitlement spending is categorized as “mandatory” spending in our budget. It is wrongfully viewed as an essential function of a civilized western nation, and its end would be met with a serious backlash from all of the welfare state’s recipients.

    (The screaming will be loud and hysterical when Social Security and Medicare are cut! Look what happens when there is even a hint that Medicare may be cut just a speck which the $500,000 really is. The elderly have grown accustomed to being care for by the nanny state and they feel they have a right because of being bad mannered enough to get old entitles them to special treatment. And they feel no concern for the young who are trying to pay the bills or the future children who will pay their bills! BB)

    Yet while default is the most honest option, hyperinflation the most likely and abolition the most untenable, in my view it is the third option which is the inevitable end, regardless of the path we choose, with the only question being whether we take our lumps now or at some unknown and jarring point in the future.

    But it never had to be this way. Back in February of 1887, Texan farmers were struggling as a severe drought was killing their crops. Congress was looking to pass an appropriations bill to bail out the ailing farmers. President Grover Cleveland had the following to say on the matter:”

Of course there is a huge significant difference in their private personal lives, I don’t argue that.     “When the unelected government officials on this board submit a legislative proposal to Congress, it automatically becomes law: PPACA (Patient Protection and Affordable Care Act of 2010, a.k.a. ObamaCare.) requires the Secretary of Health and Human Services to implement it.

    Blocking an IPAB (Independent Payment Advisory Board) “proposal” requires at a minimum that the House and the Senate and the president to agree on a substitute.

    The Board’s edicts therefore can become law without congressional action, congressional approval, meaningful congressional oversight, or being subject to a presidential veto.

    Citizens will have no power to challenge IPAB’s edicts in court.

    Worse, PPACA forbids Congress from repealing IPAB outside of a seven-month window in the year 2017, and even then requires a three-fifths majority in both chambers…

    IPAB’s unelected members will have effectively unfettered power to impose taxes and ration care for all Americans, whether the government pays their medical bills or not.

    In some circumstances, just one political party or even one individual would have full command of IPAB’s lawmaking powers.

    IPAB truly is independent, but in the worst sense of the word. It wields power independent of Congress, independent of the president, independent of the judiciary, and independent of the will of the people.

    The creation of IPAB is an admission that the federal government’s efforts to plan America’s health care sector have failed. It is proof of the axiom that government control of the economy threatens democracy.

    Importantly, this study reveals a heretofore unreported feature that makes this super-legislature even more authoritarian and unconstitutional:

    [I]f Congress misses that repeal window, PPACA prohibits Congress from ever altering an IPAB “proposal.”

    You read that right.

    The Congressional Research Service and others have reported that even if Congress fails to repeal this super-legislature in 2017, Congress will still be able to use the weak tools that ObamaCare allows for restraining IPAB.

    Unfortunately, that interpretation rests on a misreading of a crucial part of the law. These experts thought they saw the word “or” where the statute actually says “and.”

I mean, suddenly, we would see a video of bin Laden today and then out of nowhere, they said oh it was sent to us anonymously, meaning that someone in the government, our government, was trying to keep up the morale on our side and say oh we still have to chase this guy when, in fact, he’s been dead for months,” added Pieczenik.
