Is it a  coincidence that this story, praising Patrick Fitzgerald for being apolitical, came out the same day that Colin Powell blasted Dick Cheney and his book that reveals the truth about what Powell knew about the Valerie Plame outing and the involvement of Patrick Fitzgerald?

Those are interesting statements by Fitzgerald.

The question is, why did Patrick Fitzgerald and the US Justice Department wait until December 2008 to arrest Rod Blagojevich?

The prosecution in the Rod Blagojevich trial rested their case Tuesday, July 13, 2010.

Tony Rezko has not been called to the witness stand. Nor has Stuart Levine. Nor have a host of others with corruption ties to Blagojevich and Obama.

The US Justice Department had plenty of evidence indicting Rod Blagojevich by 2006. Why did the US Justice Department wait until December 2008, after the election, to arrest Blagojevich?

Who made the decision to wait to indict Blagojevich?

Was Patrick Fitzgerald involved in this decision?

I think that would be irresponsible.” Yes, Fitzgerald, I agree.

“Pamela Meyer Davis had been trying to win approval from a state health planning board for an expansion of Edward Hospital, the facility she runs in a Chicago suburb, but she realized that the only way to prevail was to retain a politically connected construction company and a specific investment house.

Instead of succumbing to those demands, she went to the FBI and U.S. Attorney Patrick J. Fitzgerald in late 2003 and agreed to secretly record conversations about the project.”

June 7, 2004: Stuart Levine, a longtime Republican reappointed to the powerful Illinois Health Facilities Planning Board, abruptly resigns on the eve of several important hospital expansion votes. The revelation is the first indication that the Blagojevich administration is under federal criminal investigation.

June 27, 2004: The Tribune discloses that an official for one hospital seeking permission to expand was wearing a federal bug during meetings in an effort to expose extortion attempts by Levine and others for contributions to Blagojevich.

July 2, 2004: Levine resigns from his seat on the board of the state Teachers’ Retirement System. It remains undisclosed that federal authorities had secretly taped Levine’s conversations.

May 9, 2005: Levine is indicted on corruption charges. Federal subpoenas are issued to numerous administration sources, including top Blagojevich fundraiser Antoin “Tony” Rezko

May 20, 2005: The governor’s office acknowledges to the Tribune that Rezko has an ongoing eight-year professional relationship with Patricia Blagojevich’s home-based real estate brokerage, River Realty Inc.

Sept 15, 2005: Prominent Democratic fundraiser Joseph Cari and a former lawyer for the state’s teacher’s pension board pleads guilty in an extortion scheme that steered state pension business to favored companies in exchange for campaign contributions to a high-ranking public official described in court documents only as “Public official A.”

Oct. 25, 2005: The Tribune discloses a federal grand jury investigation into the alleged political hiring practices of the Blagojevich administration, including the governor’s top hiring aide, Joseph Cini.

Sept. 10, 2006: The Tribune reveals that the FBI is investigating allegations by a one-time Blagojevich family friend that she had concerns her state job may have come in return for a $1,500 personal check her husband wrote to one of Blagojevich’s children.

Sept. 17, 2006: The Tribune reports that the Blagojevich administration skirted state hiring rules to give jobs to at least 360 people whose applications were sent through back channels by the governor’s offices and politically connected officials.

Before the Tony Rezko trial began in March 2008, the USDOJ and the FBI had more than enough to arrest Blagojevich and plenty on Obama. Stuart Levine had already provided the information revealed in the trial and more.
Patrick Fitzgerald obtains more details of Obama’s ties to Rezko and corruption in 2007.

Kenneth J Conner was a whistleblower in the Rezko Obama lot sale transaction. Conner was interviewed by the FBI in 2007.

“A former Illinois real estate specialist says FBI agents have questioned him about a Chicago property that had been bought by convicted felon Tony Rezko’s wife and later sold to the couple’s next-door neighbor, Sen. Barack Obama.

The real estate specialist, Kenneth J. Conner, said bank officials replaced an appraisal review he prepared on the property and FBI agents were investigating in late 2007 whether the Rezko-Obama deal was proper.

“Agents and I talked about payoff, bribe, kickback for a long time, though it took them only a short number of minutes of talking with me while looking at the appraisal to acknowledge what they already seemed to know: The Rezko lot was grossly overvalued,” Mr. Conner told The Washington Times Monday.

“Rezko paid the asking price on the same day Obama paid $300,000 less than the asking price to the same seller for his adjacent mansion,” he said. “This begs the question of payoff, bribe, kickback.””

I have had many conversations with Mr. Conner, on and off the record.
By delaying the arrest of Blagojevich, two important things occurred.

More harm was done to the citizens of Illinois.

Obama was spared prosecution and association with crime figures. This allowed Obama to win the election.

Before the Rezko trial ended, the Illinois senate attempted a recall against Blagojevich.

Why wasn’t Blagojevich arrested by then?

Here are just a few bits of testimony from the Rezko trial. The government had this information many months before.

March 21, 2008

“Stuart Levine thought he had hit the jackpot when he teamed up with Antoin “Tony” Rezko, the fundraiser for Gov. Rod Blagojevich who seemed to be able to get the administration to do anything he wanted. Levine’s third day on the stand at Rezko’s corruption trial was a sometimes wandering exploration of how Levine and Rezko exploited that immense clout in a variety of schemes to allegedly line their pockets.

“I have never been in a better position than I am right now,” Levine was heard bragging on a government wiretap. “Part of the reason is because there’s never been such tight control of the central apparatus. This guy is making decisions ? and can get anything done that he wants done.””

“But Blagojevich’s name has been mentioned often. It was brought up at least 30 times Wednesday morning by Stuart Levine, the government’s star witness against Rezko.

At one point, Levine described a flight from New York that he shared with Blagojevich Oct. 29, 2003. Levine had chartered the plane to ferry Blagojevich and others to a series of fundraisers.

On the return to Chicago, Levine said he took the opportunity to thank Blagojevich for re-appointing him to a seat on a state hospital regulatory board that prosecutors now say he and Rezko had corrupted to extort kickbacks from firms seeking regulatory approval.

Levine said the governor responded, “Never discuss any state board with me, discuss them with either Tony Rezko or Chris Kelly.” Kelly, along with Rezko, was a top fundraiser for Blagojevich as well as a close friend.

Then Levine said Blagojevich added: “But you stick with us and you’ll do very well for yourself.”

Asked by a prosecutor to elaborate, Levine said, “I took that to mean you have an opportunity to make a lot of money.””

This is important!

Even if the USDOJ was waiting for the Rezko trial to end. It ended in June 2008, well before the election.

Obviously they did not need Rezko’s testimony.
It is obvious from the above that the feds had plenty on Blagojevich.

“Mr. Fitzgerald announced that he was prosecuting former Gov. George Ryan, a Republican, in a scandal that had been swirling around long before Mr. Fitzgerald got here and that many people thought would never touch the most powerful politicians in Illinois. But there Mr. Fitzgerald was, a week before Christmas, ticking off the details of a 91-page indictment against Mr. Ryan, seemingly from memory.”
Through a spokeswoman, Mr. Fitzgerald declined to be interviewed for this article. Instead, the office issued the four-sentence release. ”Mr. Fitzgerald will become engaged on the matter immediately,” the release said. ”Consistent with the usual practice concerning investigations, Mr. Fitzgerald does not intend to comment any further.”

Fitzgerald did not wait years to go after Libby and Rove.

It became clear to Rove that Fitzgerald wasn’t looking for a violation of law in the Plame case but to set a perjury trap and carve another notch on his belt by bagging a top White House honcho.”

It is apparent to me that a deal was struck with the US Justice Department and that Patrick Fitzgerald was involved in the decision or minimally, was aware of it. The Justice Dept. had more than enough evidence to indict Blagojevich at the latest by the time Stuart Levine agreed to cooperate by August 5, 2006. They actually had enough wiretap evidence without Levine cooperating. Once Blagojevich was too tainted by investigation and Obama was being groomed for the presidency, Obama had to be protected.

Let me make this perfectly clear. I am accusing the US Justice Department of corruption, of being complicit in delaying the arrest of Rod Blagojevich until after the 2008 elections. Furthermore, the Justice Department has purposefully reworded the Indictment and refrained from calling witnesses and revealing testimony that would be further damning for Blagojevich and Obama. This is a criminal act which must be prosecuted.

I am calling for a congressional investigation.

I am also calling for more whistleblowers to come forward. Your identity will be protected.

    I noted that Issa called F & F “reckless” in his questioning of holder who committed perjury before congress when he lied about “what he knew and when he knew it.” holder had a shocked look on his face. holder knows that Issa’s use of the word “reckless” was tantamount to accusing him of the crimes of Reckless Endangerment and Criminally Negligent Homicide.

    I wouldn’t believe the Tribune if my parakeets read it to me from the bottom of their cage. Their words are meaningless gibberish.

    In Mr. Fitzgerald’s comments at the December 9th, 2008 press conference:

    I will say this. As you guys know — you guys are in the information business, of getting it and publishing it, and we’re in the information business of getting it and using it. About eight weeks ago, before we had the bug installed and before we had the wiretap up, we were contacted by the Tribune to comment, or confirm or deny, the story that they were going to run. Had they ran that story, we thought we’d never have the opportunity to install the bug or place the telephone tap.

    The Tribune knew of the sale of the Senate seat a month before the election.

    So I asked the Tribune whether they knew of the wiretaps before the election an who made the decision to withhold that information from the voters. They responded:

    “Thanks for your inquiry but it is our practice not to discuss further details, beyond what has already been reported.”

    In the Tribune’s “Statement of Principles” of 2007, the Tribune declared:

    “The Tribune places great emphasis on the integrity of government and of the private institutions and individuals who serve and lead society. It acts as a watchdog on government, protecting citizen interests in quarters where citizens themselves might not otherwise be represented. The newspaper does this in the belief that the people cannot consent to be governed unless they have knowledge of, and faith in, the leaders and operations of government. Always, the people are sovereign.”

    “The editorial page has four essential roles: to serve as a check on the power of government, to set an agenda for the Chicago region and the nation, to make persuasive arguments for the enactment of that agenda, and to inform and guide its readers so they can make better decisions.“

    The Tribune can open the sealed divorce decree of Jack Ryan but refuses to look into the school records of the President of the United States. The Tribune ran a story on Sarah Palin’s 24,000 e-mails. Its sister paper, The L.A. Times, asked readers to help find corruption in those e-mails. But the L.A. Times refuses to this day to release the video of President Obama and Rashid Khalidi.

    How can the Tribune, and the Times, for that matter, claim to inform and guide its readers so they can make better decisions, if they withhold information from voters?

    Standards are good; Double standards are not twice as good.

    After pointing out to the Tribune their policy statement and asking for a name of a person that could answer my questions, I received this reply today:

    Dear Sir:

    As I have told you in an earlier response, the Tribune does not disclose reporting practices beyond what already has been discussed in its news reporting.

    It’s not that I’m not authorized to respond to your question. The people who do make such decisions and have that authority asked me to respond on their behalf.

    The idea that a president of the United States has it in for a particular state simply because it has displeased him is a bizarre notion, to say the least. It displays a certain pettiness and worse that is inconsistent with the qualities that a person occupying the Oval Office needs to embody. A president must be a president of all the United States, not just the ones which political support him.

    There is a saying in Texas, first coined for an anti-littering campaign, but often used more broadly. “Don’t mess with Texas.” One of the results of Obama’s apparent ignoring of that rule is that the state’s governor is now the severest threat to his having a second term, when only proves that Texans can make bad enemies indeed.

    A few weeks ago it was possible to believe that Mitt Romney would win the New Hampshire primary and cruise easily to the Republican nomination. It’s harder to see that now.

    There have been a slew of polls showing Gov. Rick Perry of Texas surging to double-digit national leads. He leads across demographic groups — among educated Republicans and less-educated ones, among upscale and downscale. Most impressive, he’s winning over the Republican activists who pay the closest attention and wield disproportionate influence with primary voters.

    A poll by the conservative political websites The Daily Caller/ConservativeHome surveys these activists. When asked this week which candidate was most electable, 46 percent named Perry, while only 20 percent named Romney. When asked who would do the best job on the economy, 27 percent said Perry, and 14 percent said Romney. When asked who would do the best job controlling Washington spending, 20 percent chose Perry, 17 percent said Rep. Paul Ryan (who isn’t running), and only 8 percent chose Romney.

    The evidence suggests that Perry’s appeal will not be just a summer fad. He’s benefiting from several of the trends that have fundamentally altered the Republican electorate. If the 2008 electorate were going to vote in the 2012 primaries, then Romney could handle Perry. But that electorate no longer exists.

    The events of 2009 and 2010 — bailouts, health care reform, the stimulus package — substantially shifted voter attitudes, and nothing that has happened in 2011 has altered that shift.

    The goal of Obama and Holder is not armed rebellion against the US. It is to DISARM the US citizenry.

    Gun laws and regulations were in place to prevent these weapons being bought by straw purchasers and then smuggled across the border. However, as typical with community organizers, they need to exacerbate an issue in order to have grievences addressed. What is Obama and Holder’s grievence? The 2nd Amendment.

    So they needed to create the conditions where these weapons were “somehow” falling into the hands of organized crime in Mexico. The increased mayhem and spillover of violence into the US would give the progressive/marxists the ability to claim that our “gun laws have failed”. The solution, repeal the 2nd Amendment.

    And then Obama is no longer afraid of acting like a tyrant against the US citizenry because the government will have weapons but the people will not.

    This is a diabolical but necessary step on the path towards a permanent Obamanation…

    Since 2008, I have been posting only 1 proposed mechanism for petitioning the court to obtain Obama’s birth records from the DoH has any merit, notwithstanding (as we all agree) access to these records is restricted by law: use the common law ‘estoppel’ argument. That is, given the fact Obama derived a benefit by publicly posting on “Fight the Smears” what he claimed was his HI BC in June 2008, explicitly stating his purpose was to ‘offset concerns whether he was Constitutionally eligible to be POTUS’; he should not also benefit by the confidentiality afforded by HI statute, when someone seeks to obtain those (same) documents so as to test his credibility.

    I first proposed to Andy Martin that he raise this legal argument back in August 2008, when he announced he would try to obtain these records by arguing to the court, Obama might be President and, therefore, a “public” figure. I have posted this same argument several times throughout the blogosphere in the past 3 years. Maybe this application of the well-known principle of common law known as “estoppel” was what “Pete” had in mind. Only, not having originated the idea, as usual, he got it wrong.

    Chichester, New Hampshire (CNN) – Texas Gov. Rick Perry focused blame for the economic slump squarely on President Barack Obama in a pair of speeches Saturday, as his stump speech continues to take shape.

    Reading from notes, the folksy leader launched a blistering assault on the president for failing to turn around the country’s fiscal struggles, and offered his record in Texas as his recipe for success.

    “It’s time for a change,” he told a group of largely undecided Republican voters in Manchester, New Hampshire. “And I’m not talking about the rhetoric of change, I’m talking about a record of change.”

    Perry said he had created jobs in Texas, while the president had expanded the role of the federal government without creating long-term jobs, and had taken the country in the wrong direction, he said.

    He also had some advice for the president as he prepares to announce a jobs plan next week.

    “If the president wants to make a good jobs speech, he needs to stand up in front of the American people and say we’re going to repeal ‘Obamacare,’ ” Perry told an audience in Chichester, to thunderous applause.

    Perry – who pledged to do away with Obama’s health care plan on his first day in office – did appear to take a veiled swipe at GOP competitor Mitt Romney.

    “As we consider the economic misery that’s spread across this country by the Obama administration, we don’t need a nominee who’s going to blur the differences between themselves and President Obama,” Perry said. “We’re going to have a nominee who draws a clear contrast.”

    The former Massachusetts governor’s health care plan was used as a model for the national plan, a fact Perry has sought to underline in recent appearances.

    At the house party in Chichester, Perry spoke emotionally about service members fighting in foreign wars. He said the country should spend more money caring for its veterans. On the subject of the wars in Iraq and Afghanistan, Perry said there should be a “national conversation” over the next year before the election, but said he did not favor setting timetables for withdrawal.

    Perry was asked at each crowded event about preventing illegal immigration, and said it was the federal government’s responsibility to aid in border protection by sending National Guard troops.

    Gerald Easson, of Farmington, said he was impressed by the governor’s candor.

    “Talk is cheap. I’m going by facts. What they’ve accomplished, what they can do,” he said. “Everything he’s tackled, he’s accomplished it.”

    State Rep. Al Baldasaro, who has yet to endorse a candidate, had a similar response.

    “He looks you in the eye and he tells you how it is,” Baldasaro said. “He’s not looking over my shoulder. He’s talking to me when I ask him a question.”

    Their biggest complaint is the Massachusetts health care plan Romney helped pass as governor of that state — the program included a requirement to buy health insurance, well before the same mechanism showed up in the Democrats’ national health care overhaul. Romney repeatedly has said he opposes President Obama’s health care overhaul, and that he understands what works in Massachusetts might not work in other states.

    Kibbe, though, called the state plan “anathema to Tea Party values.” The groups also say Romney has rebuffed prior attempts to meet with him.

    “We have requested you meet and talk with New Hampshire’s liberty groups many times since you announced, and heard nothing,” Jerry DeLemus, chairman of the Granite State Patriots Liberty PAC, said in a statement. “Taking pictures in front of a Tea Party bus is nothing more than a photo opportunity and we refuse to be used as anyone’s political prop.”

    Beware posters claiming a “law” says this or that; but who fail to cite to the actual law, so that you can determine for yourself. In my experience, it is safer to assume under such circumstances, there is no such law.

    Since 2008, I have been posting only 1 proposed mechanism for petitioning the court to obtain Obama’s birth records from the DoH has any merit, notwithstanding (as we all agree) access to these records is restricted by law: use the common law ‘estoppel’ argument. That is, given the fact Obama derived a benefit by publicly posting on “Fight the Smears” what he claimed was his HI BC in June 2008, explicitly stating his purpose was to ‘offset concerns whether he was Constitutionally eligible to be POTUS’; he should not also benefit by the confidentiality afforded by HI statute, when someone seeks to obtain those (same) documents so as to test his credibility.

    I first proposed to Andy Martin that he raise this legal argument back in August 2008, when he announced he would try to obtain these records by arguing to the court, Obama might be President and, therefore, a “public” figure. I have posted this same argument several times throughout the blogosphere in the past 3 years. Maybe this application of the well-known principle of common law known as “estoppel” was what “Pete” had in mind. Only, not having originated the idea, as usual, he got it wrong.

He has tried to use everything from humor to a serious demeanor in his opportunities for dialogue with President Obama and his administration to convince them of the problems that can happen when the federal government oversteps, overreaches, and over spends.

    He has refused federal monies for programs his state did not need. Even when Texas was experiencing massive wildfires his behavior was counter-intuitive for most politicians.

    He did not immediately turn to Washington with his hand out. Yet when his state’s resources had been depleted he did come forward and ask for federal disaster aid in fighting the blazes. He’s still waiting for an answer to his multiple requests for help from the administration.

    As an aside, let me say that the administration’s silence on the Texas wildfires looks like pure politics.

    Recently Governor Perry allowed his Labrador Retriever to accompany him on his daily six mile jog. While on his run, he and his pet were accosted by a menacing coyote. After remaining still and waiting to see what the wild coyote would do, the governor pulled out a .380 Ruger and shot the coyote dead when it become apparent the coyote was after his pup.

    When he returned to the governor’s office he was queried about his “heartless” actions towards “innocent” animals. After answering more than one question on the matter, and in a mildly exasperated manner he replied, “Don’t go after my dog!” In other words while the press was confused about his value system, he saw it in very simple terms.

    Gov. Perry’s commonsense approach to problems and his core convictions resonate with the average American voter. There is such a thing as right and wrong. Not everything or everyone needs a presidential Blue Ribbon Commission to determine what’s wrong and what’s right.

    5. He Appeals to All Three Categories of Conservatives

    Ronald Wilson Reagan was the first Republican candidate to bring together the conservatives across the economic, social values, and strong military spectrums. Governor Rick Perry has already demonstrated his ability to do the same.

    His economic abilities have already been cited. But he also supported the “loser pays” tort-reform bill in Texas. Trivial lawsuits will automatically diminish in the future because those bringing them will have little incentive to try to shake down an organization by merely attempting to wear them out.

    He also supported the sonogram law, pleasing pro-family advocates, which allows a legal abortion in Texas only after the mother of the unborn child is able to see her child with her own eyes first.

    He also pushed for passage of a voter ID law which will go a long way to insure the integrity of the voting process in future Texas elections.

    His shared values of faith, his belief in the decency of America, and his lack of apology for sticking to his beliefs contrast very well with a current president who is best described as “ruthlessly pragmatic.”

    Obviously there is much ground yet to cover before the elections of 2012. But Governor Rick Perry of Texas appears to this New Yorker to have the moxie, the methods, and material success in office to challenge President Obama on his rather lackluster “credentials” over the last two years–which is all he had to begin with.

    I also love the fact that Gov. Perry wasn’t even interested in the 2012 presidential race until recently. Maybe it’s a good thing not to have people who lust for power live only to achieve it.

    He’s not even in the race yet, and this column is not an endorsement, it’s a prediction.     bob strauss, based on all of the court pleadings I have read, I have to tell you, no one has presented any complaint to a HI state court, let alone a well-pleaded complaint, based on an estoppel argument. Orly filed her first HI state case just weeks ago, in August 2011. And it is a mandamus case, not an estoppel case, notwithstanding she does mention, Obama released his ‘record’ and so, cannot now claim privacy. In other words, she is arguing, the head of the HI DoH has a ministerial (as opposed to discretionary) duty to release the BC and so, she is asking the judicial branch to order the executive branch to carry out that duty. However, as Leo Donofrio learned in his NJ case, mandamus cannot be used to compel a state official to act when no provision in the law explicitly requires such action. The courts will not pierce governmental separation of powers without unambiguous authority to do so. And Orly’s case hasn’t even been heard yet, so it would seem premature to blame her (anticipated) failure on the court’s ‘corruption.’

    In sum, as of today, no one has yet brought an estoppel case in a HI state court to obtain Obama’s birth records.

    The agents testified that Assistant U.S. Attorney Emory Hurley, a Phoenix-based appointee of President Obama, “orchestrated” Operation Fast and Furious. ATF Phoenix field office supervisor Peter Forcelli, for example, told the committee: “I have read documents that indicate that his boss, U.S. Attorney Dennis Burke, also agreed with the direction of the case.” That direction was established sometime after Obama was inaugurated in 2009 when Phoenix ATF agents, breaking with long-established agency practice, were ordered to monitor, but not stop, gun sales to suspected gun traffickers. The agents testified that Phoenix ATF supervisor David Voth “was jovial, if not, not giddy, but just delighted” when Fast and Furious guns were subsequently recovered at multiple Mexican drug busts. And emails released Thursday by Rep. Darrell Issa,R-Calif., revealed that acting director Kenneth Melson even arranged to watch live feeds from ATF cameras in gun stores being used by the program while sitting at his desk.

    But delight turned to devastation on Dec. 14, 2010 when two Fast and Furious rifles were found at the scene of Border Agent Brian Terry’s murder approximately 18 miles inside the U.S. border with Mexico in the Arizona desert. The program ended the next day. Special Agent Larry Alt told the committee that Terry’s death was the entirely foreseeable result of Operation Fast and Furious: “You can’t allow thousands of guns to go south of the border without an expectation that they are going to be recovered eventually in crimes and people are going to die.”

  115. Of all the criminal investigations of bo and his cohorts, the most legally problematic is Fast and Furious. There is already enough evidence for bo appointees in the “justice” department to be charged with Reckless Endangerment and Criminally Negligent Homicide in Arizona State Courts and Issa’s investigation has just begun. Issa has stated that he was not going to allow bo to shift all the blame to a “few” individuals. Issa clearly is targeting bo and holder.     Maybe. But if liberal New York Times columnist Paul Krugman is right (which is about as often as a stopped clock has the correct time), this “blatherskite” performed a valuable service.
