“Federal prosecutors called Rod Blagojevich’s a ‘liar’ on Monday, and a judge warned the ousted Illinois governor to watch what he says to the media because some of his comments could be used against him at his upcoming corruption retrial.
Looking down sternly from his bench, Judge James Zagel cautioned Blagojevich’s lawyers during a status hearing in Chicago held two days before the ex-governor’s retrial is scheduled to start Wednesday.
“You can consider my remarks a red flag,” Zagel said.
His admonishment came after lead prosecutor Reid Schar complained about Blagojevich accusations in recent media appearances that federal attorneys had tried to hide evidence that might clear the ex-governor.”
“Schar singled out alleged comments Blagojevich made on television, in which the ex-governor claimed the government had the power to publicly release more FBI wiretap recordings. That power lies with the judge, Schar noted.”

In the first “trial” approximately 2% of the wiretaps were released and neither Tony Rezko or Stuart Levine, who were heavily enmeshed in the corruption Blagojevich was involved in, and tie Obama to it, were called as witnesses.

“A federal judge this morning officially postponed the sentencing of political fund-raiser Tony Rezko as he continues his discussions with the government.
U.S. District Judge Amy St. Eve indefinitely delayed Rezko’s Oct. 28 sentencing date and told the parties to meet again for a status in the case in December.
The sentencing, originally scheduled for Oct. 28, just before the election, was likely to bring unfavorable publicity to Rezko’s onetime friend Democratic Presidential nominee Barack Obama.
Prosecutors and Rezko lawyers said this morning they did not want to set a future date for sentencing.
Rezko lawyer William Ziegelmueller said they sought the delay to “work together to agree to otherwise narrow differences at sentencing.”
The agreement comes as Rezko is talking to federal prosecutors. The Sun-Times first reported Rezko’s meetings with the feds in August and sources close to the investigation later confirmed the talks last month.”

Rezko was such an enthusiastic customer of Giannoulias’ failing Broadway Bank that he wrote $450,000 in bad checks against his account to pay off gambling debts.
Alderman Eddie Burke
Rezko hired Burke’s law firm to get a 77 percent reduction in the real estate taxes of a 62-acre property along the Chicago River he planned to develop using $140 million in city subsidies. After assuring the Chicago Board of Ethics that he would abstain from any Council votes on Rezko’s project, Burke voted for it anyway, blaming his conflict of interest on “an error.” The project was later abandoned.

Rezko was the president’s “real estate fairy,” as one Chicago columnist likes to put it. Remember how they bought a house together in Chicago? Rezko was one of Obama’s earliest and biggest fundraisers and donors. Obama was one of his go-to guys for housing legislation in the Illinois state Senate.

It is understandable why the Blagojevich defense team does not want Rezko on the stand. Judge Zagel’s comment about Rezko being a bad witness is at least horsecrap and reeks of conspiracy. Convicted felons of all categories are regularly used as witnesses. Stuart Levine, the key witness in the Rezko trial was not only enmeshed in corruption but was a long time drug user.
Here are the approximate number of times that “Rezko” is mentioned in US Justice Department documents.
Indictment: 100 times.
Criminal complaint: 170 times.
Evidentiary Proffer: 288 times.
Even if a strong argument is made against using Rezko as a witness, and good luck with that argument, Stuart Levine was used extensively as a witness in the Rezko trial, and his name was mentioned approx. 146 times in the Blagojevich Criminal Complaint. And don’t forget, Blagojevich’s name was mentioned at least 30 times on one day of the Rezko trial.

Brewer has decided to step away to allow the “Get the Frig Out You Illegals” (GTFOYI) bill to subside before battling this one.
Trump is stirring up support to get these bills passed. He knows the states know what he knows. So he’s banking on the states for support. And he will get it. Watch. Trump will endorse these bills in the near future. Once passed, he has a “mutual arrangement” with these passing states, and this will lock in the presidency for him in every one.

I haven’t paid attention to who’s who, and who’s an obot, but I do know the same 5 or 6 people are the ones disrupting the site with their incessant arguing. But honestly, today’s vile name calling by FS/Leo/Pat/Plains Girl – whoever it is, is about the final straw for me. I’ve been a regular on this blog since Dec. of ’08, and for the life of me can’t understand why CW tolerates it. Can a Blog Be Sued for Defamation; Isn’t It All Free Speech?
This is a knotty issue, but a short answer would be, generally, that a blog owner whose blog has published obnoxious materials can be held harmless while a blogger using the site can be liable. The Communications Decency Act of 1996 is a protector of blog owners. It states, in section 230, that it “precludes courts from entertaining claims that would place a computer service provider in a publisher’s role.” As to how the court sees blogs, in general, overall, the US Supreme Court has ruled that blogs are similar to news groups, saying “in the context of defamation law, the rights of the institutional media are no greater and no less than those enjoyed by other individuals and organizations engaged in the same activities.”
For bloggers, all Defamation legal rules apply to their posts. But there are many complications in applying them. First, many people who post online comments, and probably those tending to make the most inflammatory and false statements, will do so anonymously, for obvious reasons. So the first threshold is identifying the blogger making Defamatory claims. Several things make this difficult, as well. Since the blogger probably will not identify themselves when the issue comes to light, there needs to be a legal process that allows identification. They can be traced by high-tech means, but a court must agree via summary judgment that all the elements of Defamation have been met. This technology does have some limits, as well, as it can be stymied through use of “Proxies,” which mask the true origin of the blogger. Also, the website owner may not cooperate in the search, as well.

The Virginia case is trying to get the Obamacare issues to the Supreme Court, saving time and energy involved in lower courts. I hope they take it because maybe a decision will be had before more damage is done and the result will be known for the 2012 Election season.

What Governor Jan Brewer Should Do With the Arizona Vetting and Eligibility Bill She Just Vetoed

We all know by now that Governor Jan Brewer on April 18, 2011, vetoed Arizona’s historic vetting and eligibility bill that passed both Houses of government. But I have not heard the Governor offer any solution to the problem of assuring the integrity of the state and federal electoral process.
Governor Brewer should simply advise the Arizona legislature what her problems are, e.g., she says they are circumcision documentation (just one of the listed documents) in place of a birth certificate should the latter document not be available and the role of the Secretary of State to make sure the candidate meets the eligibility requirements, and ask them to modify the language or take it out of the law. The legislature can then resubmit the bill. That is how simple it is.
Governor Brewer also needs to understand that the federal government has not legislated in this area of vetting and confirming eligibility of presidential and vice-presidential candidates for state electoral ballot placement. Hence, at present, someone unknown person is de facto fulfilling the role which would be legally given to the states’ Secretary of States.
She also needs to understand that the Constitution and case law give the states appropriate powers over the state election process which also necessarily impact on presidential and vice-presidential candidates, ability to be placed on state election ballots.
Hence, the federal government has left it up to the states to address the ballot vetting issue and would expect them to do so, provided their vetting means are reasonably in keeping with constitutional eligibility ends which are “natural born Citizen,” age 35 years old, and U.S. resident for 14 years.
Governor Brewer also needs to understand how important the Arizona legislation is not only to Arizona but to the rest of the nation. History has shown that when one acts others will follow. Here vetoing this bill without offering a solution has caused great damage to the efforts of others to bring integrity to the electoral process involving the president and vice-president.
The lack of federal law in this area has caused the national constitutional crisis involving putative President, Barack Obama II. It is totally irresponsible and contrary to her oath to preserve, protect, and defend the Constitution for Governor Brewer to simply veto this legislation without offering a solution. Governor Brewer and the Arizona Legislature need to get together and iron out the impediments, whether real or imagined, to this much needed legislation.

Fact Number One
Congress is REQUIRED to ensure that the President elect is eligibile for the office or they must name a replacement if the Vice President elect is also ineligible. (Twentieth Amendment, section three)
”3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.”
Fact Number Two
The burden of proof is on the President elect to prove eligibility. The sequence of words from section three stating “if the President elect shall have failed” is describing an action by the “President elect” that he failed at.
Fact Number Three
The eligibility requirements in Article Two, section one clearly state that NO PERSON who fails to meet the eligibility requirements can serve as President. “No Person” leaves absolutely no wiggle room for anyone who might possibly fool his way into being sworn in through fraudulent representation or Congressional neglect in enforcing section three of the Twentieth amendment.
” No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”
Fact Number Four
Since Congress must act if the President elect fails to qualify, Congress must be made aware of whether they must act or not. This means that a legal “qualification” is fully known by Congress and that there is no mystery whether someone was eligible to serve or not. That is, if that “qualification” was made.
Fact Number Five
We have mystery about the eligibility of the person currently calling himself “President”. Nothing but mystery.
Fact Number Six
Since we have “mystery” this means that a “qualification” was NOT made and thus the President elect has “failed to qualify” and cannot be serving legally as President.
Fact Number Seven
“We have no birth certificate” EQUALS “We have a usurper”.
Fact Number Eight
It is the duty of Congress to immediately address this issue as per section three of the Twentieth amendment or they are breaking their oath of office from Article Six to “support this Constitution”.
