“The brief for Meroni V 32 Candidates and the Illinois State Board of Elections  was entered for the appellant on March 8th, 2011.  The Attorney General in Illinois has 35 days to respond, and the appellant, Sharon Meroni, represented by attorney, Stephen Boulton from McCarthy Duffy, will have 14 days to respond.  Oral arguments will be requested and likely granted.
 
I ask you to take the time to read this brief.  Mr. Boulton and I are discussing secondary legal steps we would like to take to pave the way for successful litigation of the constitutional issues involved in this case.  The 4th Appellate Court is tasked to determine if it will address the procedural errors of the previous rulings and/or the constitutional issues involved.
 
It is our contention that the Illinois State Board of Elections, procedurally, could have addressed our objections through their subpoena power.  In addition, our court action contends current Illinois Code violates US and Illinois Constitutional rights. These are separate and interrelated legal issues.
 
Keep in mind, this appeal does not discuss Natural Born Citizen directly in the argument.  The core argument is that no one in Illinois must prove they are legally qualified (constitutionally eligible as US citizens) to run for any office in the state. It is our contention that the nomination papers should provide the proof to substantiate the candidate’s affirmation that they are legally qualified to hold that office.  This is true for all offices. Ultimately, definations for legally qualified will be specific to the office sought.”

    The US Congress has not declared war against a foreign nation since WWII. But when George W. Bush sent troops into Afghanistan and Iraq following the September 11, 2001 attacks on US soil, he not only consulted congress in advance, he sought and received specific statutory authorization from congress before ordering troops into combat. Bush complied with the constitution and War Powers Act under conditions (2) and (3). He also had a broad coalition of UN partners backed by years of Iraqi broken UN resolutions.

    In the case of Obama and Libya, none of these conditions exist.

    1) Congress did not declare war.
    2) Congress was not consulted and did not give specific statutory authorization.
    3) The US was not attacked in any way by Libya which presented no threat to the US or US assets.

    As a result, Barack Obama had NO constitutional authority to attack Libya with over $70 million worth of US taxpayer Tomahawks, placing American soldiers in harm’s way in yet another war which cannot even be justified by the pursuit of oil.

    Obama touched down in Brazil as American soldiers launched a military assault on Libya at Obama’s command. Obama stands alone in this decision and order, without the support of the American people, without constitutional authority and in direct violation of his Oath of Office and the War Powers Act.

    Over the past couple of days, dozens of internet sites with a political bent decidedly to the right have erupted with a collective ‘whoa is us (read, U.S.)’ cry that the interplay between the courts, and Alternative Dispute Resolution (“ADR”) practice carried out according to principles enshrined in religion; signals we are allowing religious fanatics to take over our Republic. And they are up in arms at that American prospect.

    The focus of their ire is a case in FL involving a business deal (contract) gone bad. Evidently, the parties had agreed in advance to resolve any disputes that might arise under their contract, in some type of ADR which would be conducted according to Sharia law. Seems one of the parties now refused to live by the terms of that agreement, denying the other the benefit of their bargain. The aggrieved party asked the court to memorialize the terms of the contractual agreement to arbitrate in an Order to Enforce the Arbitrator’s Award. (I have been unable to find the original contract between the parties, or any documents other than the court order compelling the parties to abide by the terms of that contract.)     There is a catch: The Security Council is powerless to “authorize” the U.S. military to do a damned thing. The validity of American combat operations is a matter of American law, and that means Congress must authorize them.

    Our Constitution vests Congress with the power to declare war. That authority cannot be delegated to an international tribunal that lacks political accountability to the American people. The decision to go to war is the most significant one a body politic can make. Thus the Framers designed our system to make certain that the responsible officials are answerable to the people whose lives are at stake and who are expected to foot the bills.

    But this is not a blank check for the president. At a certain point in time — which may vary with the peculiar circumstances of different armed conflicts — Congress must weigh in and either endorse or put a stop to presidential war-making. It may do the latter by refusing to support the president’s actions and calling for military operations to cease. If the president refuses to honor this expression of disfavor by the people’s representatives, Congress may use its power of the purse to defund military operations. If the president tries to persist, Congress may even impeach him. The central point is that the commander-in-chief’s brute power is not a limitless authority. To be valid, combat operations must at some early, practical point be blessed by Congress, even if the president has righteously ordered them in response to an attack on our country.

Later they would claim that they had been misled into supporting the war (Sen. John Kerry) or that they had assumed that Bush would not make use of the authority they had granted (then-Sen. Hillary Clinton).

    Obama, meanwhile, offered only a perfunctory conference call for Congressional leaders after committing U.S. forces to a coalition strike.

    And in weekend remarks during his family’s five-day tour of Latin America, Obama did little to clarify what the goals were in Libya.

Privately he must admit he is over his head and no one — not in the legislature, in the labor unions, in the deep pockets of George Soros nor the salons of liberal media apologists and sympathetic academics — can save his doomed presidency.

    Obama is in full retreat. Disengaged and decoupled. A pathetic creature, soon to be deserving of mercy rather than scorn, if only his hubris were in lockstep full retreat. Is he guilty of desertion or mere dereliction? Desertion would be a harsh claim, but dereliction not so far fetched.

    A president who voluntary withdraws — or at least sidesteps — from the duties of the office, is derelict, period. Even his own party faithful anxiously look for any sign of leadership coming from Obama, only to be turned away empty handed, yet again. Bereft of personal responsibility towards his fellow Americans, Obama has neither resigned nor renounced his citizenship. Yet through his apology tours has made us wonder whether renouncing his affinity for America and the leadership imperatives due the office would only be a public formality.

    Why would you be receiving a letter from some one like me?

    Though you do not plan to announce your presidential candidacy until June, I believe you will choose to run. Chances are very good you will get the Republican nomination and you will be running against Obama in 2012. Honestly, in my humble opinion, I believe your chances of winning are very good.     Efforts to bring this controversy to court have met with dismissal after dismissal based upon “lack of standing” and not the merits of the facts. Yet from time to time a person shows up who in spite of having little or no training in AA gunnery has the ability to translate the necessary LEAD of the target into the exact amount and scores a hit. Perhaps such a person was operating the AA battery that brought down the Mig 23. If the rag tag army is ever to accomplish anything meaningful they need one hell of a BUNCH of such people, because it is they who will out gun Mr.Qs mercenaries.     This is Absolute Truth. You know, if you stuck with sane and defensible points such as this, people would not hate you as much nor call for your being banned. (just something to think about – if you have any wits for self-reflection).

    Now, for our friend Aussie: We agree that the Libyan situation may be dramatically different than some of the other places. And that there are actually respectable and deserving protestors. HOWEVER – any chaos at all is a strong chance for Al Qaeda or Musbros to stick their nose into the situation and stir things up. In the end, some of us worry more about this than we do Qadaffi. In Mubarak’s case, it is open and shut that, with all his faults, he is/was better than what will follow. Mark our words. The musbros (who were partially contained and controlled by Mubarak) will come out on top in Egypt. Israel will suffer greatly. While admitting that Libya is different, we are concerned that it is a crap shoot. We believe that the chances are near 50/50 for something better than Qadaffi. That means that is also 50/50 for same or worse.

    Our theory is that you never get into the middle of a civil war or “nation building” unless you KNOW the outcome and can CONTROL it. Just stirring things up and then letting things try to resettle does not strike us as Good Strategy. We say that one must almost always choose the devil we know over the devil we don’t.

    The election of Obamessiah, The Won, is a prime example. “Bush is SO bad that we have to have change”. That is a BAD REASON to ever do anything.

    The NEOCONS are primarily at fault. They are the ones that like to stir things up without having control of the outcome. That is what they did in Iraq. We agree that Iraq war was necessary and disagree with all the revisionist poppycock. But we did it wrong. Things needed to be done with Prussian Efficiency until we had restored order and installed a proper outcome. Only then, to withdraw. But that is another long story.

    I have been watching the Libya situation since it began. From everything that I have read, I have seen no evidence that the Freedom Fighters are associated with Al Qaeda. They would be just as unwelcome as the foreign military.

    You may not be aware that the British sent in the SAS, MI6 and a diplomat to make contact. They were quite naturally captured and taken to the leaders of the Freedom Fighters (they did spend a night or two in prison as a safety precaution). The Freedom Fighters verified their identities (had to because they had multiple passports and that did not make them happy) and after they had spoken to the leadership they were allowed to leave. Is that how Al Qaeda would have treated them?

    As for any MB connection, think of this: The MB is set up by the Shia and is backed by Iran. The Libyans are Sunni. Once again there appears to be no MB involvement.

    Now that leaves the make up of these people: they belong to several tribes and they have a common goal which means that they have been able to work together.

    In order to understand how all this happened you have to go back to the small protest that started the chain reaction. Daffy’s people killed protestors during that first protest in Benghazi. I do not know if those original people were Al Qaeda or MB (I have doubts about that)… there was a funeral procession, and Daffy’s people fired upon the procession maybe due to the throwing of rocks at the fort. Yep, that was their sophisticated weapons. More people were killed. The crowd got bigger. The protests got bigger… a new procession, more rock throwing and the men at the head of the procession were mowed down (these were the relatives of those already killed). Then the people started to find other weapons – gunpowder in empty bottles of 7 up make great molotov cocktails and the gunpwder is normally used for their fishing!! Then there were their fishing guns… and one man at the back of the next funeral procession who had packed his car with cooking gas bottles. He sacrificed his life and breeched the wall of the fort… thus the people defeated Daffy’s thugs that day.

    The next move was astounding because the interior minister turned up with an army unit…. all of them had defected. Yes the army had begun to defect.

    Daffy sent his aircraft to bombard Benghazi and fire upon the people. Two of the pilots flew to Cyprus (I think that is where it was) and they defected, refusing to fire upon their own people. Then in another instance, the pilots of an aircraft ejected and let the plane crash, rather than fire upon the people.

    Many of the armed services were killed because they refused to go into action against their own.

    When the people of Benghazi captured the fort in the town they also gained possession of the weapons dump. They no longer needed their bbq skewers and their scimitars and other world war 1 and 2 weapons. The former army generals signed up the volunteers and then drilled them in preparation for the fight ahead. All Libyan men have 6 months military training so they all know how to use weapons anyway. The weapons being used come from the military dump.

    This was repeated in other cities… Brega, Adjadyab (sp) Ras Lanuf, Zawiya and elsewhere. There were defections in Zawiyah and the people held the town for a few weeks… and then Daffy slaughtered them… men women and children were killed and injured in that town.

    Note that I have not dealt with the Al Qaeda rumours spread about by Daffy and his sons, and now I will get to that….

    At the beginning of the protests, Daffy released some people from prison who had been members of Al Qaeda. It was a ruse so that he could blame them for the uprising.

    The people in Zawiyah have insisted that they are not members of Al Qaeda, and you will hear the same in Benghazi. It is the same in those other towns. This is not a fight with Al Qaeda.

    Now some people are using the guilt by association because:

    1. The leadership of Al Qaeda have supported this rebellion. Why should anyone be surprised because Al Qaeda is dedicated to the overthrow of these dictatorships. (although Saudi Arabia is their main target)

    2. In the early days of the protests Qadawri (sp) the MB imam who had returned to Egypt put out a Fatwah on the head of Daffy, meaning that Muslims are free to kill him. The Fatwah does not of itself prove that MB is behind the uprising, because all it does is give permission to kill a real bad person.

    So there you have the guilt by association which is now being picked up by a number of people who are running with the story that these people are either MB or Al Qaeda, which is not the case.

    Another guilt by association is that the people when an aircraft (their own) was shot down in error, they shouted Allah Akbar. Heck they are Muslims, and that is what they do in the case of what they think is a victory. It was not a case of shouting it prior to a suicide bombing.

    Other than the one man who killed himself via a car bomb for the sake of his people, I have not heard of any other suicide bombing. I read most reports and the suicide bombing is a trait of both MB and Al Qaeda. It is simply not happening to day.

    FOS I hear what you are saying on the possibility of MB and Al Qaeda sticking their noses in, but I doubt that the Libyans would appreciate such interference.

    I suggest looking at the timeline of events, and the defection of the army units. Also that the leadership is in the hands of the former interior minister.

    If there is no splintering between the tribes after they get rid of Daffy then such fears will be allayed.

    Of course it is a big risk, but with regard to MB, they are usually present where there are Shiites. this is why they are involved in Syria, Bahrain, Egypt, Qatar, Yemen etc. In fact Al Qaeda is likely involved with Yemen as well. Those countries have a large Shiite population and MB plus Iran had been busy stirring the pot.

    The Libyans have more in common with the Iranians in that they do not seem to be connected to either of these groups and that the protests have come from the people responding to the killing of their own, rather than from those outside influences. To this I add that there was an outside influence… they were spurred on and encouraged by the events in Tunisia and Egypt and I think that they expected the west to take their side a lot earlier.

    In the middle weeks they were not only asking for the no-fly zone, they were asking for Bush!! The recognized that with a Bush you get action, but with Østupid, not so much…

    Another telling factor about their loyalties was the production of the old Libyan flag, prior to the coup against king Idriss. That is significant because it shows their more nationalist tendencies in the situation.

    The women wear a scarf like the hijab, but they do not wear the niquab or full burka. If they were either MB or AQ they would be more likely to be in the full dress.

    On top of that, at least in Benghazi, there is a strong affiliation with the west, because many of them have been educated in the UK and the kinda like the western way of life.

    So, I would say hold off for now and see what develops, but I still see no real signs of either MB or AQ, rather this is a real people uprising.

    The Arab League is not against the action. That has been resolved and the man who expressed some misgiving appeared at a conference with Ban Ki Moon, fully accepting the action.

    It is also possible that his original Arabic comments were distorted in the interpretation, and on top of that he was probably reacting to the Daffy Duck lies about civilians being killed.
    Some sources from the UK have shown pictures at gravesites where the men were waiting for the bodies of alleged victims that did not arrive!! Go figure… because they just put paid to Daffy’s lies.

    There are some very contrary opinions, and I note that even the Iranian students are wary about the action.

    However, what I note is the wariness about the possibility of another Iraq or Afghanistan, but truly the circumstances are different.

    yes, it is the big picture. Honestly on this issue I can only hope that my analysis and instinct is correct.

    I punted on the people of Iran when they were so p’ed off over being cheated with their elections. I was really hoping that they could get rid of the Grand Poohbah and Ahmahnutjob, but when Østupid ignored their plight until Neda was murdered in cold blood, (and then it was only giving them 5 minutes of his time), they had no hope of having outside support.

    One of the things that Libya and Iran have in common is the use of mercenaries to be brutal to the people. Iran did it first, when Ahmanutjob brought in Hamas and Hezbollah to do most of the killing and the torture.

    I think that the Iranian experience is probably clouding my judgement, yet I cannot see any true link to either MB or AQ. After all, Libyans are Sunni, and not Shia, and MB are Shia not Sunni, but AQ is a mixture of both Shia and Sunni (more likely Wahibbi type Sunni). Even if some Libyans have been involved with AQ in the past it does not mean that this revolution is the work of AQ – it is a people uprising, just like in Iran.
