Petition for Writ of Certiorari filed with the U.S. Supreme Court for Kerchner et al vs. Obama/Congress/Pelosi et al Lawsuit.

JAMESBURG, NJ – (Sept. 30, 2010) – Attorney Mario Apuzzo of Jamesburg, NJ, today filed a Petition for a Writ of Certiorari with the U.S. Supreme Court in Washington DC, on behalf of plaintiffs, Charles F. Kerchner, Jr., Lehigh County, PA; Lowell  T. Patterson, Burlington County, NJ; Darrell J. LeNormand, Middlesex County, NJ; and Donald H. Nelsen, Jr., Middlesex County, NJ.  Plaintiffs are challenging the recent decision of the Third Circuit Court of Appeals in Philadelphia, PA, which affirmed the dismissal by District Judge, Jerome  Simandle, sitting in the Federal District Court, Camden, NJ,  of plaintiffs’ lawsuit in which they charge that Barack Hussein Obama, aka Barry Soetoro, has NOT conclusively proven to any controlling legal authority that he is Article II,  Section 1, Clause 5 “natural born Citizen of the United States” and thus constitutionally eligible to serve as the President and Commander-in-Chief of our military, and that he has hidden all his early life records including his original long-form birth certificate, early school records, college records, travel and passport records needed to prove he is even a born Citizen of the United States 

Obama was born a British Subject/Citizen to a British Subject/Citizen father and a U.S. citizen mother.  Obama’s father was not a U.S. Citizen and never intended to be one. Obama’s father was never even an immigrant to the USA nor was he even a permanent legal resident. Obama’s father was a foreign national sojourning in the USA to attend college. Obama is still a British Subject/Citizen to this day because he has never renounced that citizenship. According to this lawsuit, Obama was born a dual-citizen with dual allegiance and loyalty and is therefore  not constitutionally eligible to be the President and Commander-in-Chief of our military. The founders of our country and framers of our Constitution required the President to have unity of citizenship and sole natural allegiance to the USA from the moment of birth, which Obama does not and cannot have. This was a national security issue to the founders and framers.
Obama has multiple foreign allegiance claims on him because of his British citizenship which also converted to Kenyan citizenship at age 2.  Obama was also an Indonesian citizen as a youth when he was adopted or acknowledged by his Indonesian step-father when he married his mother, Stanley Ann Dunham.   
The lawsuit seeks a trial on the merits to determine the true facts of Obama’s legal identity and exact citizenship status and to require Obama to prove to the courts that he is eligible for the federal office he sits in per our Constitution, Article II, Section 1, Clause 5, which states:  No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

The legal term of art, natural born citizen, is defined by the world renowned legal scholar, Emer de Vattel, in his pre-eminent legal treatise and enlightenment to the world of jurisprudence in the revolutionary period, The Law of Nations or Principles of Natural Law, published in 1758, and which was used by the founders by the Continental Congress during the formation of our country and by the framers of our U.S. Constitution, and whose definition of natural born Citizen is incorporated in several U.S. Supreme Court decisions. Vattel and U.S. Supreme Court decisions agree that a natural born citizen is a person born in the country to two parents who are both citizens of the country.  Obama’s father was not a U.S. citizen, nor even an immigrant to the USA. Thus Obama is not a natural born citizen of the USA, and that is the reason for the lawsuit.

The original lawsuit was filed early in the morning of January 20, 2009, before Obama was sworn in.  The case was dragged out by delays by the government in addressing the case and deciding on whether the case would proceed to a fact finding trial on the merits or not. The courts have decided that it will not go to the merits and have dismissed the case using technical and procedural tactics to keep the Plaintiffs from getting to the merits of the charges.

By the lower Courts finding that plaintiffs do not have standing and that their claims present a political question, the lower Courts were able to avoid having to address the underlying merits of the Kerchner case. With such a decision, the American People unfortunately still do not know conclusively where Obama was born and whether he is an Article II “natural born Citizen” and therefore constitutionally eligible to be President and Commander in Chief. Being a born “Citizen of the United States” is a necessary part but is NOT sufficient to be an Article II “natural born Citizen of the United States”.  We have asked the relevant questions and provided for the U.S. Supreme Court in our Petition various reasons why it should accept this case and promptly resolves this constitutional crisis.

  1. I think Obama might be a target for blackmail because of his citizenship status. He should be required to show those records to allay fears. How can we have confidence in a President who may have serious problems regarding citizenship, etc. If someone finds evidence to challenge Obama, they may use it nefariously and we shouldn’t have to worry about that. There is no legal or legitimate reason to withhold vital info like that. It should have standing. And Pelosi should be worried.

  2. Well written writ. It is encouraging to read the issues so clearly presented by Attorney Apuzzo. It seems to me the most difficult issue for our side remains standing. I agree with the writ’s view on standing, but it seems several Justices can still use this issue to defer action. The question is, are there four who will let it go forward?

    It is much more likely for criminal cases and civil cases brought by the States to be accepted by SCOTUS.

    According to sources who watch the inner workings of the federal government, a smackdown of Barack Obama by the U.S. Supreme Court may be inevitable.

    Ever since Obama assumed the office of President, critics have hammered him on a number of Constitutional issues. Critics have complained that much if not all of Obama’s major initiatives run headlong into Constitutional roadblocks on the power of the federal government.

    Obama certainly did not help himself in the eyes of the Court when he used the venue of the State of the Union address early in the year to publicly flog the Court over its ruling that the First Amendment grants the right to various organizations to run political ads during the time of an election.

    The tongue-lashing clearly did not sit well with the Court, as demonstrated by Justice Sam Alito, who publicly shook his head and stated under his breath, ‘That’s not true,’ when Obama told a flat-out lie concerning the Court’s ruling.

    As it has turned out, this was a watershed moment in the relationship between the executive and the judicial branches of the federal government. Obama publicly declared war on the court, even as he blatantly continued to propose legislation that flies in the face of every known Constitutional principle upon which this nation has stood for over 200 years.

    Obama has even identified Chief Justice John Roberts as his number one enemy, that is, apart from Fox News and Rush Limbaugh. And it is no accident that the one swing-vote on the court, Justice Anthony Kennedy, stated recently that he has no intention of retiring until ‘Obama is gone.’

    Apparently, the Court has had enough.

    The Roberts Court has signaled, in a very subtle manner, of course, that it intends to address the issues about which Obama critics have been screaming to high heaven. A ruling against Obama on any one of these important issues could potentially cripple the Administration.

    Such a thing would be long overdue.

    First, there is ObamaCare, which violates the Constitutional principle barring the federal government from forcing citizens to purchase something. And no, this is not the same thing as states requiring drivers to purchase car insurance, as some of the intellectually-impaired claim. The Constitution limits FEDERAL government, not state governments, from such things, and further, not everyone has to drive, and thus, a citizen could opt not to purchase car insurance by simply deciding not to drive a vehicle.

    In the ObamaCare world, however, no citizen can ‘opt out.’

    Second, sources state that the Roberts court has quietly accepted information concerning discrepancies in Obama’s history that raise serious questions about his eligibility for the office of President. The charge goes far beyond the birth certificate issue. This information involves possible fraudulent use of a Social Security number in Connecticut , while Obama was a high school student in Hawaii. And that is only the tip of the iceberg.

    Third, several cases involving possible criminal activity, conflicts of interest, and pay-for-play cronyism could potentially land many Administration officials, if not the President himself, in hot water with the Court. Frankly, in the years this writer has observed politics, nothing comes close to comparing with the rampant corruption of this Administration, not even during the Nixon years.     In addition, the Court will eventually be forced to rule on the dreadful decision of the Obama DOJ to sue the state of Arizona . That, too, could send the Obama doctrine of open borders to an early grave, given that the Administration refuses to enforce federal law on illegal aliens.

    And finally, the biggie that could potentially send the entire house of cards tumbling in a free-fall is the latest revelation concerning the Obama-Holder Department of Justice and its refusal to pursue the New Black Panther Party. The group is caught on tape committing felonies by attempting to intimidate Caucasian voters into staying away from the polls.

    A whistle-blower who resigned from the DOJ is now charging Holder with the deliberate refusal to pursue cases against Blacks, particularly those who are involved in radical hate-groups, such as the New Black Panthers, who have been caught on tape calling for the murder of white people and their babies.

    This one is a biggie that could send the entire Administration crumbling–that is, if the Justices have the guts to draw a line in the sand at the Constitution and the Bill of Rights.

    The only way that ‘we’ are going to get rid of the obama monstrosity is to elect people who will stand for the constitution and limited gov’t.

    Sarah Palin has proven that she won’t stand for the constitution by not using the standing she has to force obama to release his records. She is the ONLY PERSON IN THE US, other than Mccain, who could do it. And she refuses.

    I would be very interested to hear people’s clear, well-reasoned, and precise opinions on how this is going to play out.

    The one key element – in my opinion – that has to be taken into consideration is as follows:

    Contrary to appellate courts which have to resolve appeals (not necessarily judge them on merits, but possibly rejecting based on standing or jurisdiction), the supreme court has no such rules or even guidelines. They do not even have to explain what they do.

    I don’t remember the exact number – but our legal friends can supply the number – only the TINIEST OF FRACTIONS of such Writs are granted. The vast VAST majority are simply “not granted”. Period. No explanation.

    And I fear it is a poorly kept secret that the Clerks are extremely efficient and industrious gatekeepers. One can make one’s own estimate of how many such grants of certs are decided by the Clerks and rubber stamped by the justices. Given the workload, the tremendous number of Writs submitted, the huge number denied, and our inside knowledge of clowns like Danny Bickel, the number of such rubber stamp jobs must be enormous.

    Now – somebody tell me some good news!

In order to avoid prosecution for blackmail/treason and lots of other charges, I wonder how they could reveal this information, presuming they have “milked” enough value out of their nefarious information.

When he was a Senator, Obama introduces Pigford Bill 2, to suck more money out of the American People. The Original Case was 33,000 complaints that jumped up to 98,000 and $120 million before it was resolved. Obama rewrites the bill to include Women Farmers, American Indian Farmers, and Muslim Farmers. The Bill got shot down by both the House and the Senate. Obama Backdoor’d the bill and the Money Paid Out is hovering around the $2 Billion Dollar mark. How Much Treason and Fraud has to occur around Obama and his Cohorts before a single Congressman/Congresswoman, Judge, Lawyer, CIA, FBI, NSA, Police Officer or Anyone in Authority will arrest him? Maybe the Next Congress if we don’t get put under Martial Law.

    As you know, I swore off the Rev. Dr. JDM when he publicly embraced the Truther Nonsense. But due to no fault of my own, I happened to hear this. It is very important for two reasons. First, if you listen for the whole 9 minutes you will find the following “prophecy”:

    Two weeks before the election, Zero will announce that he is extending the entire package of Bush Tax Cuts – across the board – forever. This, in turn, according to JDM will take most of the wind out of the R’s sails, and will totally explode the TP and it will cease to exist. The D’s will then definitely keep the Senate and maybe the House.

    His reason for saying this is not to discourage us, but to alert us. He is mounting a campaign to prevent this from happening in exactly this way. At least trying to make sure Zero will not get credit for it, and therefore maybe the Great Game Changer can be avoided.

    You will have to listen to him to see if I have accidentally misrepresented anything, and to find out more of what he wants to do about it.

    As a secondary bonus, and pertinent to our heated discussion of yesterday, he discusses the racism of the election. Listening to only the first 2 minutes will inform you of his major points on this. Here is a summary interlaced with my own expansions.

    White-on-black racism is defined as excluding a black from something they are qualified for – especially something they are VERY qualified for.

    He uses some well-known sports figures as examples – Jackie Robinson, Arthur Ashe, and others. The key thing is that once the discrimination against these people was removed, they BELONGED. But not only that, they EXCELLED. Their sports were ENRICHED by them. It would have been a grave INJUSTICE to have excluded them.

    These people were true HISTORICAL FIGURES. These people truly BROKE BARRIERS. These people are HEROES to blacks and whites equally. We ALL love them.

    The Obama Situation fails miserably on ALL these criteria. Therefore the elevation of Obama was purely a racial maneuver. Pure and simple. Facts. Proof.

    I don’t know, I can always hope. Maybe this can help put a stake through the heart – permanently – of the silliness that the Obama Situation is not all about race. As I said yesterday, I was flabbergasted to learn that there was ANYBODY in the entire USofA that did not KNOW this.

    The actual self-initiated unsupervised CGJ’s are just NOT on anybody’s radar. There are no procedures for handling them. I have been unable to find even a single example of a CGJ anywhere (despite my requesting help from FS – his response typically being some form of Go F— Yourself, rather than actually providing any examples), that has done anything more than deal with some extremely local nuisance situation.

    Further, if FS bothers to respond at all – he will point you to some success with a Regular Grand Jury, thereby trying to mislead you into believing it was a CGJ.

    So, OK, let’s look at what I will call RGJ’s.

    These are under strict control of your local judiciary. Most specifically the district attorney. If you have a VERY knowledgeable Foreman, he MAY know that he has some latitude to “runaway” into not-approved areas. The DA, of course will frown on that and put roadblocks in the way because it undermines his authority and control. Further, RGJ’s are precious resources. Most are bottled up with more than they can handle with normal workload.

    Then, you will find, that ALL available legal advisors – i.e. anybody the mere civilians might ask about being “runaway” – they will provide some answer in the range of “uh, I don’t know” to some cockamamie excuse as to why it would be a bad idea.

    Then, since you went “runaway”, you can’t produce an indictment, but only a presentment. That get’s handed to a judge and you again run afoul of there being no procedures to handle it. 1000:1 they won’t even have a Presentment form or example for you to use.

    Federal Grand Juries don’t work this way – and even though constitutionally allowed and perhaps even encouraged – there has been no procedures and no activity in this area (CGJ’s and persentments) since about 1946. They are listed as “obsolete” or some such in the Federal Procedures.

    For Local Regular Grand Juries, they have indeed indicted local officials. That is part of the job of the DA, part of the normal workload of a RGJ, and everything works smoothly. This is no surprise, no secret, and no big deal – it is just business as usual.

    For a RGJ to go after ANYBODY with a higher office, they will want VERY PARTICULAR and VERY SPECIFIC harm done to the residents of the particular jurisdiction by the said official.

    FS is absolutely right – and, more importantly, practical – about one thing. Gulf residents who were harmed should have sufficient particularization and sufficient specificity to use the standard RGJ process to go after said officials. So far so good.

    But the trick there is identifying an individual in a high government office who committed a focused crime. “Failure to respond fast enough” won’t work. “Spraying corexit all over everything will not work”. “Blowing up the drilling platform”, would probably work. “Deploying toxic chemicals for the express purpose of murder or genocide” would probably work.

    So far, no such crimes or no such officials have been identified. Even so, the most likely focus of such a thing would be minor officials. Who would in-turn be given leniency in regards working with the best data they had under a difficult circumstance, or simply thrown under the bus.

    All of this is EXTREMELY AWKWARD, VERY LOW PROBABILITY, and an almost incomprehensible way to go around and around Robin Hood’s barn to get the job done you wish. Besides, with starting at such a low level – local RGJ’s – the “slow wheels of justice”, along with fiddling with procedure, and appeals, and all that would take decades.

    Finally, if anybody is going to swamp the Gulf courts with any lawsuits, it is going to be directly related to the local economy and jobs and contests between the various contractors. This alone will completely tie up the relevant courts for decades.

    Other than that – it is a pretty good idea – go for it –

    But don’t believe either me or FS. Most of his theory is right as far as I can tell – I am no legal expert, but I will yield to him on that. The issue is one of practicality. In that regard I can read regulations, I can search for examples, I have been involved in enough court cases to think my way through how this might work. But don’t rely on me. Go talk to ANY legal official you want. Maybe you have a friend, a friend of a friend, or a corporate attorney where you work. Just poke around and see what you find. That is what I did and found out what I currently know. But maybe you will find someone more daring.

    I can predict that FS’s response will be some sort of name calling. So that being a useless avenue for actual information, you are on your own. Or maybe you can frame some questions he will actually answer. Good luck.

    I am unsure of this. Polling seems to show that a slim majority do not like Obamacare. But I think a majority likes the other bills shoved through. And there are a lot of D’s (and yes, a huge number of B’s) who think it is a clever way to work around the “idiot, neandethal, redneck, bible thumping, knuckle dragging”, “just say no, obstructionist” R’s. Remember that one of their favorite mantra’s is “the end justifies the means”.

    Like I said – it is unclear to me, overall, if this type of legislative process is a plus or a minus for a “can do”, “hope and change”, and “how dare they block or repeal the progress made by ‘the ones we have been waiting for'” kind of guy.

I believe it was one of the panelists on the Bret Baier Report, but I could well be wrong.

    I agree that something will be “in the works” probably before the election; although it could be too little, too late. Campaigns all over the country ARE getting very ugly and defamatory as the Dems are desperate to save face, or least to destroy their opponents.

    It is interesting to hear about your TN happenings. I bet you are very glad to have the temp more in the moderate range, with a real touch of fall in the air. When I lived in Ohio we always looked forward to what was called “indian summer”, usually in October – leaves had turned and there would be one last fling of warmer weather before winter.

    As you know, in my neck of the woods now there is not a whole lot of difference in the seasons, but it is still detectable. Higher in the canyon the leaves do turn colors, but mostly yellow and orange. We do not have the vivid reds as back East. We do get snow sometimes, but most often it melts by noon the next day. You probably don’t get much in your area?

At one point, Beck looks right at the audience and says, “Obama was born in the United States.” He was dogmatic and self-assured, as though he knew something that we don’t. It is very obvious that he is NOT going to get into the eligibility issue ever. My personal aggravation with Beck is that he is way too cocky about this birth issue. If he is SO certain, then why won’t he have a reasoned, public discussion about it, explaining what he knows?

    In an unusually bold public request, families of three antigovernment protesters who died after beatings at Iran’s notorious Kahrizak prison have demanded the prosecution of high-ranking officials responsible for running the extralegal detention center.

    The families, in a letter to Iran’s judiciary published widely in Iranian media, stated that they were prepared to spare the lives of two prison officers who were convicted of murder, under the Islamic legal provision of ghesas, which grants the families of murder victims the right to either request or forgo the death penalty for the killers. Instead, the families called for the punishment of the officers’ supervisors.

    “We do not gain pleasure from revenge nor spilling the blood of the puppets of those who have broken the law,” the letter of the three families reads, referring to the two unnamed individuals sentenced to death in closed-door trials for beating detainees to death.

    Let me inform you of something.
    The only way that ‘we’ are going to get rid of the obama monstrosity is to elect people who will stand for the constitution and limited gov’t.

    If citizens fail to enact laws that will ensure 1) access to ballots is restricted to candidates eligible for office; and 2) Electors may only vote for a President who is Constitutionally eligible for the job; and if we do not block the NPVI from passing in our state (or, where passed, work to repeal); and if we cannot compel state officials to enforce these laws we pass then, whom we elect may not be in compliance with the Constitution. But we won’t know, will we.

    We keep looking for shortcuts. But anyone reading this comment who does not understand that states can enact laws to mandate how Electors vote (after all, most states require their Electors to vote for the party nominee, even though the Constitution says nothing about political parties!); or that states with ballot eligibility laws can insist the SoS set up a process to vet for eligibility; or that the NPVI could require Electors in one state to vote for the candidate who won the popular vote in another state with lax ballot eligibility laws and enforcement of those laws; is part of the problem.

    The ‘easy’ fix is to vote for a particular candidate. (Of course, if we continue using electronic voting machines that are easily rigged, nothing else we do matters, anyway!)

    No; we must not only vote more carefully but we must also participate in government. This means, monitoring statehouse calendars to see what legislation is pending; testifying at public hearings or submitting written testimony on such legislation; meeting with our elected officials; and researching the issues, until we know as much about our electoral process as all those people who, having a head start and superior knowledge, stole our power from under our noses.

But in reality, they decided the attenuation (academia’s fancy term for “doing nothing” and hoping Nature would gradually breakdown the oil) would be the cheapest route. It is interesting that the millions of dollars used for studies at universities on how to remove oil from marshes resulted in the technique of doing nothing. I could have done that study for free. So the next time your University asks you for research money, keep this in mind. Sickening!

    I saw how Meg Whitman treated people. I can contrast Meg Whitman’s behavior and spirit with other big shots we had in the offices all the time (including Martha Stewart), and I can say that Meg Whitman is a good woman, smart as all get-out, and is who California needs to fix its problems
    Kara moved to California from Europe as a little girl, and her family had to go through the process of getting their visas, their green cards, and then filing for citizenship. Her parents were both professionals when they left Europe, but her dad had to get work in a restaurant when they first moved to California until he could follow all the procedures properly to get a better job. They did everything they were supposed to do, and are immigrants to this country with absolutely no sympathy for Mexicans who lie, cheat, steal identities, forge paperwork, and do all the other illegal things they get up to to scam the system.
    Whitman really needs to hit hard with this, and tie Allred to Jerry Brown, because people do no take kindly to the scam artists like Nicky who lie on those employment documents and provide fake materials like this.
    This, we have a feeling, can blowback BIG on Democrats if Whitman hits it back properly…because it makes people angry that Allred is using a criminal who falsified documents to attack Whitman.

    I am not trying to be critical in regards saying you are wrong. I hope to be “critical” in the good sense of “evaluating and analyzing”. I know that something mysterious, and yet to be fully explained, HAS happened. I believe that at least a part of that continues. We clearly need more information – more CREDIBLE and PROVABLE information.

    1. Anecdotal stories don’t help much. We need some serious epidemiology and statistics like the Public Health people do. Do we know of any such sampling and analysis and statistics? Is the CDC involved? Do we believe them if they are? Or do we think they are maybe also part of some coverup?

    2. Is any spraying of Corexit still going on? Why? Where?

    3. Was Corexit ever sprayed over land? I mean purposefully, as opposed to accidental wind drift from ocean spraying? Why would anybody ever do that? It would seem to have no purpose. If it were proved that such land spraying was/is conducted, that in itself may be a criminal act. Unless I am misunderstanding something.

    4. Are there credible reports that Oil in any quantities to be dangerous have been picked up by winds and deposited inland via rain? I don’t care so much right now about “gunk and gack” that simply needs to be cleaned up. I want to know about health concerns.

    5. Are there credible reports that Corexit has been detected anywhere inland? How much and how far inland?

    6. Are there credible reports that even the slightest amounts of “spillage” have reached the Florida Keys? Let alone around up to the Eastern seaboard.

    These are the kinds of questions we need definitive answers for. How can we get this information? Who do we trust?

    I encourage all of us to hunt for data and post here things that we find – especially if they come from a source that has not already been repudiated. I only know of one source I trust pretty much – and that is Billy Nungesser and his crew. That does not mean there aren’t others – I just don’t know of them. I also worry that no matter how square and level is BG and friends, he might not be in a position to know the answers to a lot of the questions.

    I also don’t like to see stuff from Alexander Higgins or Alex Jones (or anybody even remotely associated with Matt Simmons). These sources have been thoroughly repudiated. Not to say that a blind squirrel can happen upon a nut once in a while – it’s just that you can’t trust what they say. They remind me of UFO clowns. 1 or 2% fact mixed with boatloads of hysteria and insanity. How is a mere mortal supposed to learn anything from that?

    After the University Scientists totally eviscerated their own credibility by supporting outrageous AGW theories, I no longer trust them either. They are just chasing research dollars.

    I think some regional newspapers have hope of being credible. But we need to beware – because they would have a natural tendency to exagerate stuff to obtain more “economic stimulus”.

    It’s a really nasty problem – everybody seems to have a “legitimate” reason to lie. I honestly and sincerely seek advice on a credible way forward. And, no, the above questions are not loaded or trick. They are legitimate questions that need answers.

    “Truthers” is what happens if you don’t thoroughly, deeply, and continually vet your sources. That is why I am being so nasty about insisting on using ONLY extremely credible data. I am scared spitless that in our enthusiasm to uncover the actual truth we will accidentally create yet another lunatic fringe – maybe “Oilers”? That, in turn, will cloak our honest efforts to find truth in an inpenetrable cloud of insanity. That will then backfire and prevent us from ever reaching our objective.

    Think! Do you really believe “Truthers” are helping find out what really happened on 9/11? Or did they just do a giant belly flop on the whole thing and drive the real truth farther undercover. I know MY answer. Do YOU know the right answer?

    Gloria Allred shills for the D Party. Period. She has established in the past, when the conduct at issue is arguably unlawful, she will align herself with the party – alleged victim or perpetrator – who is less likely to harm the Party. Even if this means, biting the bullet, herself, such as was the case with the D Party during the 2008 primary campaign, when Obama’s minions violated CA’s vote binding laws by harassing Clinton pledged delegates to switch to Obama BEFORE the nominating convention. They perpetrated such illegal conduct in all vote binding states. In GA, AG Baker (D) received complaints from citizens there, Obama was breaking the law. But evidencing his loyalty to the law and not the Party, AG Baker reminded pledged delegates they were bound by GA law to stick to the candidate voters elected them to represent, when they got to the convention. Ms. Allred appears to have been unaware she was similarly bound in CA until she arrived in Denver. There, she announced to the press that at the request of fellow Clinton pledged delegates from that state, she had researched the law and determined they were bound to vote for Clinton. She complained convention organizers were stifling her from informing these delegates, they had to carry out their legal obligations.

    But did she complain to AG Brown the Party was violating the laws in that state? Did his office investigate and then punish the wrongdoers? Obviously not because 1) there has been no word of this in the press; and 2) I watched Ms. Allred on FOX News recently complaining again that she was ‘gagged’ at the convention from discussing this issue but not revealing that she had filed a complaint with AG Brown. On the contrary, she falsely claimed, the DNC “Call” (their rulebook) even instructs pledged delegates to vote for the candidate they were elected to represent. So she didn’t understand why she was prevented from dispensing such legal advice, too.

    Only, DNC rules say no such thing. That’s why most Clinton pledged delegates from vote binding states didn’t even know about these state-specific laws until they reached the convention and received the news from volunteers handing out flyers.

  171. My theory on why fox news, rush limbaugh, sean hannity, and all the rest stay away from this issue:

    It’s for the same reason they are gung ho on co-opting the tea party into the republican party. Right now, these people I mentioned are serving half the country. With the resulting revenue stream from half the country. If they were to talk up the tea party as being independent, it would quite possibly cut their revenue streams to one third of the country, from it’s previous one half. That is something they don’t want to happen.

    That’s my theory and I’m sticking to it. (at least for the time being) 🙂

    Extremely good point. The Lunatic Left has agitated to take children away from parents – under the guise of Child Protective Services – for far less. Would a presidential candidate who had a similar relationship with KKK or any modern White Supremacists have been allowed to simply walk away and shrug his shoulders?

    And, then, as I recently discovered, there are actually people so imploded and insular that they vehemently claim that the 2008 “historical”, “leg tingling” election was not “all about race”.

    CC I agree with all of your points and questions here. However, there is something that is niggling (nothing to do with your questions). It is about Agent Orange in Vietnam.

    The U.S. soldiers in Vietnam were exposed to the aerial spraying of Agent Orange. Many veterans (Australians as well) have been plagued with skin complaints as well as other more serious complaints due to their Vietnam service. My cousin was rendered sterile.

    This niggles at me because this was something done in the name of the US govt. It is the same with the aerial spraying of corexit over the GoM. There are lots of reports surfacing. I do not know how many of them are associated with corexit, and how many are associated with the actual oil spill. However, the reports cannot be dismissed lightly.

    Perhaps what needs to happen is for these reports to be brought together in some way. It needs someone to collate them and to check the demographics. There needs to be analysis to see if there is a pattern to these reports – e.g. area, vulnerable people etc. etc.

    It is like when we discover that there is a link between say brain tumors and some other factor e.g. the pollution from a medical company. Here in Australia, in Sydney we look for a pattern to the cancers and brain tumors discovered, and then look to see if there is a common link. I know of one case, a little girl who died at less than 3 years of age, a real little angel (intelligent and a delight) because she had a brain tumor. It turned out that she was not the only child in the area to get a cancer. It seems that there was a possible link to a medical company in that area.

    All of this discovery might take time… I just hope someone is plotting these reports to see if there is a trend.

    You, of course, are absolutely right in all respects. And yes Agent Orange is a good and relevant example. That is another area in which Ground Truth has yet to appear. Like everybody else, I don’t like coverups, in general. But let me lay out a serious problem.

    Much, if not most, military coverups are a direct result of Lunatic Liberal insanity. With any coverup you have to ask the reason why. I have written on this before.

    Ruse de Guerre is an internationally recognized type of coverup. I have discussed that before.

    Deceiving the United Nations or other “overseeing bodies” is of course not sanctioned by international authorities. However as a Patriotic American despising the UN and its blatant Anti-American agenda, I wholeheartedly support ANY and ALL deception aimed at poking the UN in the eye or keeping their snotty noses out of our business.

    These I have stated before. But now venturing into new territory.

    Do you know about Pat Tilman and that brouhaha? The very short description is that he was a famous footballer that (I think) volunteered to go to Iraq “for the cause” and got killed by friendly fire. There was a resultant coverup and much angst.

    I do not know the details of the actual death – as regards accident, negligence, or malfeasance. Others may explain that. But like with Helen’s Pigford explanations, focusing on the original event and cause is unproductive. We need to look at what happened next.

    First you need to understand “the fog of war”. There is unimaginable chaos and people get killed. In the old days there was literally no way to tell what happened. You just patrolled the battlefield after the conflict and tried to identify and bury what you could. In many cases the only “clue” that somebody was killed, was they did not come home.

    Later, we began to collect the dead and send them home in airplanes. Then, of course, in the name of progress, we began doing autopsies and forensics on everybody. Now from a war-fighting perspective, anything and everything we learn is helpful. We even need to know about enemy fire and friendly fire and take appropriate military action via doctrine, training, or punishment to reduce friendly fire.

    But here is the money quote:

    These things are of no legitimate interest to the general public and in fact very counterproductive to the general public. There is NO NEED TO KNOW (even under the pure Constutionalist “We The People”).

    A brave soldier gets “killed in the war”. His body is shipped home, he gets buried with military honors, he is idolized by the community, schools and streets are named after him, period. Pat Tilman went to war, gave his life for freedom. Period. No other information is needed.

    Now – where the Lunatic Left comes in is that they want to use every tiny bit of information to undermine everything. If a soldier gets killed, they want to blame his leader for something. If a soldier gets killed by friendly fire that becomes a national event of some kind and much hand wringing and gnashing of teeth. And, OMG, should there be collateral damage of any kind whatsoever, then we go into WAR CRIMES mode.

    So, is it any wonder that officials would fudge the truth and want to make sure that a nationally prominent situation (i.e. famous athlete) did not get turned into an excuse to March On Washington.

    Agent Orange is similar – as are depleted uranium rounds. These things are poisonous and dangerous. But they have great purpose. Warriors make decisions all the time like, we are going to charge this hill and we believe that 100s of our own will die, but it is a strategic objective worth that price. We even know that some percentage of those are going to accidentally be shot in the back by their buddies. War is just that confusing. So now we have a strategic decision – we are going to spray this forest with Agent Orange to kill a very intractable enemy. This will accomplish a strategic objective and prevent the death of 1000s of our own troops and friends. But we also suspect (know?) that there will be some collateral effects. Is that so different? To a Lunatic Liberal it is.

    What about the Huge Artillery used in Europe before and during WWI, before commonplace use of airplanes for pounding objects at a distance. Especially the early steel artillery (as compared with previous bronze) were especially fragile and brittle. Many of them blew up. Almost always at least 10% of them, sometimes way over 50% of them. What would the Lunatic Liberals have thought about the officers commanding their troops to “man the guns” under such circumstances. If such Lunatic Liberals existed then, do you think the decision makers might have been tempted to downplay the danger of these big guns?

    WAR IS HELL

    Trying to micromanage it or dissect it is a fools errand. People die in wars. People are maimed in wars and are disabled for life. People receive injuries that later sneak up on them and kill them – from wars.

    WAR IS HELL

    I don’t know the right balance between fighting wars and armchair commentators of wars. Certainly some of each is required and a balance must be achieved. But I do know that the current balance is wrong. I also know that whenever anyone tries to watch sausage being made, no good comes of it.

    CC that is all very well-stated. What we must never forget is that if the State sends people to war then there is some obligation to tend to the wounds of those who return. Like I pointed out though, Agent Orange caused harm to the soldiers who returned. However, that was not why I brought up its use… it was as I stated, that the way in which it was used – aerial spraying – caused harm to those soldiers. This is the harm that I see for Corexit, and why that is one point that bothers me with regard to GoM. How much harm? How long before we know.

    To add to my point about Agent Orange, but going back further in time, to the testing of nuclear materials here in Australia. British and Australian military who were part of the Maralinga tests were left exposed to radiation. For the most part the unexplained illnesses of these men were ignored by the government. In my mind this is quite shameful. I can remember meeting some of those men and how they were combing records to try and prove the link between their cancer and Maralinga… very sad that they were neglected and ignored.

    Now going back as you did to WW1, I have a personal connection to the way in which warfare was conducted in the countryside of France. My grandfather was one of the men who was wounded in action. His leg was amputated. Yet it is really what took place at Gallipoli that is so very stark for most Australians. The British were really crappy commanders, and the Australian troops became fodder for them. Bad decisions ended up causing a massive loss of life.
