It was clear to experts and novices alike that Tony Rezko and/or Stuart Levine had to be called as witnesses in the Rod Blagojevich trial. Tony Rezko’s name was mentioned approx. 288 times in the Evidentiary Proffer. When Judge James Zagel stated that Rezko was a bad witness, our collective jaws dropped. Stuart Levine, the key witness in the Rezko trial was not only enmeshed in corruption, he was a long time drug user.

“A day later, all that was clear was that Blagojevich would have another day in court. What was less certain was what changes could be made to the prosecution case next time around, who would represent the governor at his retrial and how that defense would be paid for.
Experts differed on what the government might do as it makes another attempt at proving Blagojevich tried to leverage the powers of his office — including the appointment of a U.S. senator to fill the seat once held by President Barack Obama — to enrich himself and his campaign fund.
Some predicted that prosecutors would just slightly adjust their case or possibly leave it the same, while others suggested the next go-round could be much more drawn out.
Former federal prosecutor Dean Polales said he thinks the pr
osecution’s case will only be tweaked, especially since jurors reported an 11-1 split in favor of conviction on many of the major counts in the indictment.
“You’ve got an outlier juror,” Polales said. “That’s hard (for the defense) to duplicate in a future trial.”
But Leonard Cavise, a DePaul University professor, suggested the government will need to do more at the retrial, possibly leading to a longer presentation of evidence. He said he believes the government may try to avoid another deadlocked jury by using fundraiser Antoin “Tony” Rezko and political fixer Stuart Levine as witnesses.
Both men have agreed to cooperate, but prosecutors chose not to call them this summer in part because of the baggage both bring.
“If the prosecution insists on going forward, I have two words for them: Rezko and Levine,” Cavise said. “They know where all the bodies are buried.””

Yet the unwillingness of one or more jurors to convict Mr. Blagojevich of anything but bare-faced lying makes some sense. I suspect the jury’s indecision might have been a reaction at some level to the hypocritical mess our campaign financing system has become, especially in light of recent Supreme Court jurisprudence about political donations.

The only thing that makes sense is that the blago case was rigged from day one to get a conviction on one or two minor counts. Why else would the lone juror only hang the jury on one count. If she had reasonable doubt about all the other charges and thought blago’s acts were just politics as usual why vote to convict him on the lying to FBI charge which was one of the weakest of all the charges and it does not involve bo in any way.
This one count conviction has all the earmarks of coercion of blago to plead guilty for a light sentence which will shut him up like rezko but not involve bo in the scandal any further.

Federal prosecutors’ decision to “protect” Obama administration officials by not calling them to testify against former Illinois Gov. Rod Blagojevich is “absolutely” responsible for the prosecution’s stunning failure to get convictions on 23 of 24 counts, a Fox News legal analyst who closely followed the trial tells Newsmax.
“I think that this is a very interesting issue, because I think that [White House Chief of Staff Rahm] Emanuel was not called [to testify], Axelrod, whomever else, Obama himself, in an effort to protect the administration,” Holder says. “You know once you open the door and you put these guys on the stand, well, the cat’s out of the bag and you open them to cross-examination and whatnot.”
According to Holder’s sources, the case had a witness list of between 600 and 800 people, including several top Obama officials such as White House Chief of Staff Rahm Emanuel, White House adviser David Axelrod, and White House adviser Valerie Jarrett.
Prosecutors only called 35 witnesses during the trial, however. None were from the administration.
“I think the Obama administration really escaped a lot of scrutiny because Emanuel wasn’t called. A few union reps [testified]. Other than that, nothing was revealed,” Holder says.
Asked if she believed not calling the administration officials hurt the prosecution’s case, Holder replied: “Absolutely. That’s exactly what this is. It was a gamble: If we protect the administration, and we don’t call the key people, then can we still get a win without calling them? I think that the jury’s failure to reach a decision on those counts was proof that we needed the people within the administration to tell the story: Was that seat for sale?”
When questions arose in late 2008 over what discussions took place between Obama, his advisers, and then-Gov. Blagojevich, Greg Craig, the soon-to-be White House counsel, conducted an inquiry and wrote a memo for public consumption stating there was no indication of “inappropriate discussions” occurring between the governor’s office.
Obama stated he had “never spoken to the governor” about the vacant seat and had “no contact” with his office.
Craig’s memo, released Dec. 23, 2008, acknowledged that in the days leading up to the election Emanuel had “one or two” conversations with Blagojevich.
During the trial, however, former Blagojevich chief of staff John Harris testified that Emanuel called and told him then-Sen. Obama wanted a “close friend” of his appointed to the Senate seat.
Harris testified that he understood that person to be Valerie Jarrett, Obama’s close friend and fund-raiser who now serves as one of his senior advisers.
Harris testified: “[Emanuel] asked whether it would be helpful if Sen. Obama called the governor to advocate for this individual.” Harris replied “sure.”
“He said, ‘I’ll let you know,” Harris added. “He wanted to say that [Obama] had a preference.”
Holder tells Newsmax that to retry the case successfully prosecutors will have to be more aggressive about presenting witnesses. She believes they will have to call Emanuel to the stand.
“Now, this is a very, very interesting situation because if the prosecution is going to retry this case, they are going to have to put Emanuel [on the stand to testify], [and] maybe Obama,” Holder says.

“Every charge related to the Senate seat became 11-1,” Sarnello said. “I think she wanted clear-cut evidence, and not everything was clear-cut.”
In fact, according to Schindler, the group came close to being hung on all counts. He said a male juror changed his mind at the last minute to not guilty on count 24 — lying to the FBI. Schindler said he turned to the man and said: “Are you sure you don’t think he did this? That he was lying when he said that?”
Schindler said the juror replied, “You’re right, change it back. He’s guilty.”
“And so we had one,” Schindler said.
Grover, a former Marine, said he was outraged during the trial when he heard Blagojevich on an undercover recording telling Obama to “go (expletive) himself.”
“I swear to God I thought I saw stars,” Grover said. “I was going to go through the prosecution table right to him. I’ve never heard anything like that in my life. Tell the president of the United States to go ‘F’ himself. Where I come from, that doesn’t happen.”
On his feelings now that the trial is over, Grover said: “I hate politics. I hate it even worse now.”

Now you will tell me, “Wait a minute, Spencer, that’s in the Hebrew Scriptures, too.” So often I hear that the Bible and the Qur’an are equivalent in their messages — something that only someone who hasn’t read either one could say. But in any case, it’s true: “an eye for an eye” appears in Exodus 21:22-25, Leviticus 24:19-21, and Deuteronomy 19:21. However, this phrase has always been understood in Judaism as limiting excessive vengeance, not encouraging it, and has never been taken in Jewish tradition as being a warrant for maiming anyone. It is likewise limited in Christianity by Jesus’ statement: “You have heard that it was said, ‘An eye for an eye and a tooth for a tooth.’ But I say to you, do not resist an evildoer. A court in Saudi Arabia is seeking medical advice on whether it is possible to cut the spinal cord of a man as a punishment after he was indicted of causing paralysis to another man during a fight, a local daily reported on Thursday.
The court in the northwestern province of Tabuk has sent letters to hospitals in the kingdom asking them whether the punishment to cripple the defendant by severing his spine is medically possible, the Arabic language daily Okaz said.
The unidentified defendant hit Abdul Aziz Al Mutairi, another Saudi, with a cleaver during a fight more than two years ago and the trial has been delayed because Mutairi is insisting that his attacker suffer the same injury.
“The General Court in Tabuk has sent several letters to hospitals in and outside the region asking doctors about the possibility of cutting the spinal cord of the defendant after he was indicted of causing paralysis to another man,” it said.
The paper quoted the 22-year-old Mutairi as saying the defendant had confessed in court to hitting him with the cleaver during their fight in Tabuk.
“King Khaled Hospital is of the opinion that it is possible to cut the spinal cord and cause paralysis medically through specialist centres,” he said.
According to the paper, the verdict is pending responses from hospitals to the court’s letters.
So there’s no discussion of whether it is cruel and unusual punishment. After all, it’s in the Qur’an.

I know that many don’t watch TV news, but tonight there was a discussion as to why Obama would deliberately take a position on the mosque that is so overwhelmingly opposed by the people. The gist was that he seems to not care as to whether his unpopular decisions politically hurt him or not. The question was raised whether it is from arrogance or incompetence.
My answer would be “both”, but there is another angle to be explored IMHO.
The more Obama acts out on the public stage, the more we see another phenomenon. Think about it. Just about everything he does causes division in our country. Look at the legal action against AZ over the illegal issue and the decision to try terrorists in NYC (is that on hold for now?). Now we have this mosque issue, which could well result in non-muslims being pitted against muslims over time.
There are many more examples of resulting polarization, which doesn’t bother him one bit. In fact, I believe he thrives on it. He is one evil being who is not only trying to bring down America by his terrible policies, but by his efforts to destabilize and divide our people. Is his motto, “Divide and Conquer”? I believe so.

At least one juror in the Blago trial sniffed out the truth of what was going on, and good for her. The judge in the trial engaged in gross malfeasance, because he side with the prosecution nearly 100 percent. The worst thing he did was buy into the prosecution’s argument to limit only those tapes which were “pertinent” to their case. The defense team argued unsuccessfully that limiting the tapes in this way damaged their client’s right to a fair trial. In effect, the judge allowed only those tapes to be admitted into evidence which put Blago in the worst light. This is grossly unfair and should not have been allowed to stand. A competent judge would never have allowed such selectivity concerning this recorded evidence.
Because of this, Blago win win on appeal. The one conviction will not stick. Blago’s attorneys should have been allowed to play tapes exculpatory to their client. The playing of the full array of the tapes would have shown that everyone in Chicago–from Obama on down–were playing the game the exact same way. It is just old-fashioned big city machine politics. If he defense is on the ball the second time around, they will argue that Blago’s right to equal protection under the law has been violated by the government. This is the way to argue, the Fourteenth Amendment argument. Setting aside Blago for special prosecution, given the evidence that everyone was playing the game the same–which playing of key parts of the tape not allowed into evidence would have shown–is what happened in this trial. Blago will prevail on appeal.

Are there any more Judicial scandals coming down the road? The judges who weathered the storm of Greylord and Gambat are much more aware of their vulnerability. It is unlikely that they would risk their professional careers and reputations pocketing $50 bribes as in the days of old.
The Circuit Court of Cook County’s Criminal Division randomly assigns cases, and the “let’s make a deal” army of attorneys comprising the “Hustlers Club” at Traffic Court have been weeded out and removed for the most part. Wisconsin has enacted a law which makes political free speech subject to fees or jail time.
If you think this can’t happen in America… well… it just did. This law affects liberals, conservatives and those of every political persuasion. It affects every American, both inside and outside of WI, who communicate in any manner about candidates running for office in WI.
Whether you are supporting or opposing a candidate, gathering to demonstrate for or against a candidate, or even if you are using email or the Internet to express your opinion about a candidate, you are subject to fees or jail time.
In the dark of night, behind closed doors, WI enacted the new Government Accountability Board – G.A.B. 128 Rule which silences political free speech 60 days prior to the election. Conveniently, this law goes into effect on August 15, 2010 with little to no time for successful legal challenges prior to the November 2010 election.
Under this new law, individuals and groups must pay a $100 registration fee to the state of WI if they want permission to use political speech that totals at least $25 “cumulatively in a calendar year.” But it doesn’t stop there…
Individuals and groups must set up a separate depository account and file a report with the Accountability Board and Secretary of State. They then need to provide periodic reports of every communication – explaining the type of communication/action for each and every episode of political free speech.
What WI did by adding G.A.B. 1.28 to the G.A.B. 1 Rule is to define political communication and actions in order to give the government the legal ability to regulate and monitor everything you say and do.

The federal government has jumped up to join the defense in a lawsuit in California that challenges the eligibility of a Republican candidate in the race for secretary of state, filing a demand that the dispute be moved from state court to U.S. District Court.
The case, filed pro se by Pamela Barnett, was launched to challenge the eligibility of Damon Dunn as a candidate in the Republican primary for the state office that oversees all elections.

The lawsuit, however, also cited the U.S. Election Assistance Commission, and because of that, U.S. Attorney Benjamin Wagner explains, the case is being moved to the federal court system, where dozens of challenges involving Obama’s eligibility have been shut down over the issue of “standing” – or the damages suffered by the plaintiff.
While the case was filed before the primary election, the primary results left Dunn opposing Bowen in the general election.
“Please take notice that the United States of America, through its undersigned counsel, removes the civil action reflected in the attached pleading from the court of the State of California where it was pending, [so] that the proceedings be governed by the applicable federal rules and statutes,” the federal document explains.

The case alleges Dunn did not have a valid or current California drivers license as required on the state’s voter registration form to affiliate with the GOP and be qualified to vote. It also alleges irregularities including missed deadlines, an alleged previous affiliation with the Democratic Party and other concerns.
The complaint alleges Dunn was posing as a Republican and that state officials refused to investigate his bona fides, just as they refused to investigate Obama’s prior to the 2008 election.

You know, there is wisdom in your statement. Truly, sit back and think about were Obama came from, and the hate that his teachers and reverend spewed forth. Then consider the 'angry' middle aged 60's burnouts that manipulated everything to hide his past and get him elected. When did these people ever appreciate freedom or the constitution? As Woody Allen said "I just wish Obama could be a dictator for a few years".
Obama as POTUS is a slap in the face of the hard working americans whom cling to the Constitution, Christ, and self-protection and self-determination. He is not a 'robin hood' just another Mao, Hitler, or Stalin…whom seeks power to serve himself, not his country.

The superintendent of the Arizona Department of Public Education says his agency will consider a refusal by the school district in Tucson to videotape its “Raza studies” classes as evidence the district is “deliberately” concealing its agenda.
The state had asked Tucson, in view of a new state law that takes effect at the end of this year that bans promoting to students “the overthrow of the United States government” and other issues, to record its “Raza” classes this fall to document what is being taught.

Hey FS and PP – here is a cookie for you. In this case, I agree 100%. WH and others have indeed been misrepresenting the situation. Here is more specifically what I’ve been saying and what is still true:
True, the well has been stopped – unless they dick it up trying to tie up loose ends and put a permanent plug in it. But it is not true that the worst is past. Nor is it time to celebrate and move on to more interesting topics. Most of the oil is still out there somewhere, and there are lots of toxic dispersant chemicals. Nobody knows the long term impact to the current crop of sea creatures, nor to the reproduction cycles.
The winds and waves could further disperse things or could push things back toward shore. A good hurricane or series of tropical storms could stir things up, suck things up, and deposit nasty crud at least 100 mi inland. I don’t know much about this particular person or what or when he said what. But if the article is accurate, what was said before is false and what he is saying now is more nearly true.
Here is a Community Project you can all help with. I have a number of email correspondents who rely on me to send them a SYNOPSIS (talking points, sound bites, whatever) on various hot topics. I have drafted something about the Blago mess and present it here for your review. Please feel free to add, subtract, or correct. And if you have similar correspondents, you are free to pass this along without attribution. I just want to get the information into a wide circulation. Not everybody takes time to wade through a well-reasoned, liberally foot-noted, report.
