The Third Circuit Court of Appeals Finds Attorney Apuzzo Not Liable for Obama’s/Congress’ Damages and Costs Incurred by Them in Defending the Kerchner Appeal
On July 2, 2010, the Third Circuit Court of Appeals issued its decision affirming the New Jersey Federal District Court’s dismissal of the Kerchner et al v. Obama/Congress et al case for lack of Article III standing. The Court ordered that I show cause in 14 days why the Court should not find me liable for just damages and costs suffered by the defendants, not in having to defend against the merits of plaintiffs’ underlying claims that Putative President Obama is not an Article II “natural born Citizen,” that he has yet to conclusively prove that he was born in Hawaii, that Congress failed to exercise its constitutional duty to properly vet and investigate Obama’s “natural born Citizen” status, and that former Vice President and President of the Senate, Dick Cheney, and current Speaker of the House, Nancy Pelosi, were complicit in that Congressional failure, but rather in having to defendant against what the court considers to be a frivolous appeal of the District Court’s dismissal of their claims on the ground of Article III standing. On Monday, July 19, 2010, I filed my response. This afternoon, on July 22, 2010, the Third Circuit Court of Appeals issued its decision on whether it should impose the damages and costs upon me. The Court has decided not to impose any damages and costs upon me and has discharged its order to show cause. This means that the matter of damages and costs is closed. Here is the Court’s decision:

“ORDER (SLOVITER, BARRY and HARDIMAN, Circuit Judges) On July 2, 2010, this Court filed an Order to Show Cause directing Appellants’ counsel to show cause in writing why he should not be subject to an Order pursuant to F.R.A.P. 38 for pursuing a frivolous appeal. In response, Mario Apuzzo filed a 95-page statement that contains, inter alia, numerous statements directed to the merits of this Court’s opinion, which the Court finds unpersuasive. His request that the Court reconsider its opinion is denied, as the appropriate procedure for that issue is through a Petition for Rehearing. However, based on Mr. Apuzzo’s explanation of his efforts to research the applicable law on standing, we hereby discharge the Order to Show Cause, filed. Sloviter, Authoring Judge. (PDB).”

I want to thank everyone who supported and encouraged me in this battle. This includes everyone who expressed their feelings on this matter through blog posts, articles, and comments, and emails.

  2. Kudos to Mario on an important victory. Now it’s on to the Supremes, if they will hear the case. If they do, Sotomayor and Kagan (assuming she is seated) should recuse themselves, since Obama appointed them, and that might just make it possible to get a fair hearing. Sotomayor and Kagan should not even vote on whether to take the case.

  4. Excellent news. It is truly gratifying to see the court that proffered such an unsound opinion realize its error within a 2 day period and say “oops, our bad” in response to having their error come back to bite them.

    Sotomayor and Kagen ( if approved) could possibly loose their life – long appointment to the SC if Obama is NOT a natural born citizen. Wouldn’t it be considered a conflict of interest for them to decide on the case?

    GOM Oil Gusher Update

    This is what is known to be happening. There is rampant speculation about a number of other items that range from lunatic fringe (conspiracy theory) to credible questions and concerns that need to be checked out. More on these things as they come better into focus.

    The situation is relatively static and maybe slowly improving over the last week. Except for some seemingly small dribbles in the plumbing the new cap is holding. But it is a day by day decision with careful measurements and committee decisions.

    The relief well is progressing as planned with no reported problems. They are trying to put in some lining and casing preparatory to actually tapping into the primary well. That was planned for a week or so from now, but will be delayed by weather.

    The overarching issue and problem area is the gunk and gack already on the water and in the water. Cleanup is slow and the Government is inept or stonewalling at every possible opportunity. At this point, the ‘best truth’ is coming from Billy Nungesser, President of Plaquemines Parish.

    This good ol’ Cajun boy has no fear and says what needs to be said. If you see him on the news, stop and listen. Or look him up on the Internet (youtube, in particular).

    The “aw chit” of the moment is a couple of storms. A minor one down by the Yucatan peninsula will not slow down drilling operations but will make waves, affecting the cleanup. By far the bigger impact is an incoming Tropical Storm. It is now a Tropical Depression coming over the Bahamas, skirting Cuba and the Florida Keys and then turning dead aim for Louisiana. The eye of the storm will hit the Macando well site in three or four days. Therefore, the drilling operations will have to be suspended, and the ships and other support moved out of the area. This will probably delay everything approximately a week.

    Fortunately, the storm is not expected to get ‘worse’ than a Tropical Storm and they have decided (keep fingers crossed) to leave the well cap in-place, even without the careful monitoring and watching. The rainstorms will help clean out the estuaries and islands, but the wave action will be pushing any gunk and gack hovering offshore inshore on to the eastern Louisiana, Alabama, Mississippi, and Florida coasts. And, finally, don’t forget all the toxic chemicals. We need to watch carefully for what the storm sucks up and deposits inland.

    I read the whole thing carefully. In plain English, it seems to me he made a broad argument (or more specifically, a number of pointed arguments) that the Theory of Standing is nebulous and unsettled. Therefore:

    1. He could not rightly be accused of filing a frivolous lawsuit into the teeth of solid theory and practice.

    2. The court has plenty of latitude to hear this case and should indeed get to the merits, rather than tossing it out.

    The court agreed with conclusion #1 and disagreed with conclusion #2.

  13. Mario may have lost this skirmish, but he will win the war. We had nearly three years of losses with the Army of the Potomac, until Grant took over and prevailed over Lee. We lost most battles over seven years in the war for American Independence, but we won the last and most significant encounter. God is in control and will not abandon this beacon of Liberty, if we will have faith, and do not abandon God. Obama’s history is yet to be written, but he will be held to account, as will his enablers, and this matter will eventually be considered as one of the greatest wars in America’s brief history.

    Yeah, that’s a tough one. While there is some merit to the theory that legislative branch, not judicial branch, is supposed to deal with ‘presidential issues’ – Who is supposed to deal with constitutional errors and violations of rules and procedures by the congress itself?

    That is why Mario’s case was interesting and different. It included all of the above.

    It seems to me that a good outcome from a court hearing this case is twofold:

    1. Define NBC very specifically.

    2. Require congress to investigate and take appropriate action.

    That way everybody stays cleanly in their sphere and justice gets done. Everybody wins.

    Surely you understand Conflict Of Interest. Without even arguing the science, Simmons has taken himself out of the game. It is that simple.

    That doesn’t prove him to be wrong. It just proves that he cannot be trusted. He is biased. I marvel you fail to grasp this common and obvious situation.

    So, I aggregate and sift credible sources. If I listed references, my simple informative reports would be as long as Mario Appuzzo’s 95 page legal brief.

    Some people respect and enjoy my reports. I write for them. Take pot shots at me as I zoom by you, but it makes no difference. I won’t even argue with you on your opinions. Even though it is not your area of expertise and you have no reason to have the requisite technical or critical skills. I only react to your blind support of Simmons because it is so blind.

    You can do what you want. I just want to make sure that others who read my work understand that Simmons is unreliable – at least on this topic. On day one, he shorted the bejesus out of BP and now he is pedaling as hard as he can to protect his bet.

    As long as everybody understands that, then I have done my job.

    I am glad we agree about Hofmeister. Simmons is believeable and NOAA & U. of South Florida agree with him. U ccfubo have not shown me any proof that the leak has been stopped. Even Allen had to admit that the bo/bp well is still leaking. He did of course try to deceive by using a new term seepage, but seeping is the same thing as leaking and I am not fooled by the bo/bp con game. The well is still leaking and as we agree bo has failed to clean up the mess.

    That’s not correct. He didn’t “sue Congress” but rather requested the court to mandate that Congress do as required by the Constitution for specific Constitutionally-required actions; a Constitutional matter rather than any sort of political matter. And the Judiciary DOES have jurisdiction over Constitutional interpretations.

    In Cohens v. Virginia (1821), CJ Marshall pointed out that the Judiciary even had an OBLIGATION to do so (even if they didn’t wish to do so) since ignoring that obligation would be “… treason to the Constitution …” ( from Marshalls opinion).

    It is a Constitutional rather than a political matter.

    Orly Taitz is having a hard time verifying justice Thomas ever saw her application she filed at the SCOTUS to hear her case and stop the $20,000.00 sanction against her in the Barnett v McDonald case.

    The SCOTUS clerks are playing games against her, in the minds of many. I suggested she try to get her case to Ginny Thomas, at the TEA party and have Ginny relay the case to her husband.

    If anyone knows Ginny Thomas or how to get in touch with her at the TEA party she is involved with, let her know she is needed, to verify that her husband is aware of Orly’s request for a stay of the sanctions, and the problems with the clerks at SCOTUS hiding these cases from the justices.

    Covering for the usurper will not be tolerated!

    However, if U had read my articles you would know that a constitutional contract lawsuit is the best way to proceed civilly; but as Sam Sewell astutely stated earlier, Grand Jury Indictment is the quickest way to legally remove bo.

    The well is not gushing. It was belching between 25,000-80,000 bbls/day. There is now a miniscule DRIP in the new plumbing. It does not appear to be even a gallon per day.

    That indicates that they have been very successful. But, yes, the cap is only temporary, and the well is not fully stopped. That success cannot be claimed until the relief well is completed. Probably mid Aug at earliest. But in the meantime, things are holding.

    Finally, it is yet far from clear to what extent BP is the culprit in this. The most prominant ones accusing BP are the same ecco-terrorists who wish to use the crisis to put a stop to ALL drilling. Also playing the blame game is Halo Head and his crew – trying to deflect everything away from them.

    Then another thing everybody needs to consider is how, when, and how much to punish BP. They have certain legal responsibilities (written in their contracts) which they must and they will comply with. (Giving Halo Head $20B slush fund was not one of them, they were bullied into doing that). Many folks have retirement accounts and life savings tied up in BP stock. How much collateral damage are we willing to inflict just to punish ‘evil BP’?

    Many things to think about and work through. Life is not as simple as just yelling ‘witch’ every time we see a shadow. Or, even worse, crybaby Halo Head: “Wahhhh, Bush did it!”

    He didn’t just ‘sell’ his stock. He shorted a lot of stock he did not have. Then BP did not tank as he expected (at least not yet). So now he is in dire financial straits.

    As far as his theories (specifically, big lake, flying BOPs, wrong well, and all that), I am thoroughly aware of them. I report nothing unless it is corroborated by multiple independent reliable sources, complete with pictures, references, diagrams, etc etc.

    None of that has been forthcoming. Like I said in my report – as soon as any of this comes into focus, I will report on it. I recognize that the entire truth is not known. That means you don’t know it either. The actual truth may be different than what we know now or different from what Simmons says. So there is no point in reporting on this particular hysteria.

    As the truth is revealed, I will report it. If you insist on following Simmons, I would charitably say his theories are “pre truth”. Sometimes such pre-truth turns out to actually be THE truth. But usually not.

    For those who like analogies and examples. The 911 Truther stuff is similarly “pre truth”. There is yet much of THAT story untold as well. But at this point it is pretty pointless guessing at THE truth.

  39. Loose lips sink ships, with the way they drink in Chicago it should not be hard for enterprising reporters to get the remainder of the stories. Chicago may be a big town, but it can be very small too-people tend to stay in the neighborhoods unless they come in from the suburbs.

    It was interesting to see Ben Smith, from Politico.com, listed as a member of Journolist — the committed Obama operatives in the Media who banded together to make sure negative stories about their Lightbringer were quashed while attacks were coordinated to label anyone opposing Obama “RAAACIST” during the 2008 campaign.

    We had a brief encounter with Smith during September and October of 2008, where he repeatedly refused to run a story we were involved in that would have damaged Obama and drawn closer attention to his continued and longstanding ties to terrorist bomber William Ayers.
    Here in Chicago, we’re friends with a woman who used to give the Obama girls swimming lessons. She, and others who worked in the Obama/Rezko Mansion for various projects and assignments, was a source for a lot of what we know about The Lightbringer personally (his affinity for men, his Parkinson’s disease, his chain-smoking and continued drug use, etc.). Between people who’d worked for the City with Michelle, people who attended Trinity United with the Obamas, and people who lived and worked in Hyde Park near the Obama/Rezko Mansion, we collected many anecdotes that raised a lot of questions about the man the Media was pushing to be our next president…if any journalist wanted to follow any of these leads.
    It was impossible to prod the Media into doing any sort of investigative story on Obama, in any way, shape, or form. Ben Smith was not the only reporter we went to with this story. But, he’s the most memorable because he kept playing games with us. ”Get me someone else, someone more important, someone who is not a Republican, and I’ll do the story,” he said. Which made us waste a great deal of time running through contacts and leads trying to do the work of actual reporters, trying to flesh out this story.

I asked him if it would be alright to send him what I’m reading in the blogosphere, and he promised to read and review. I live on the Chesapeake and fear the underwater oil plumes lying on the bottom of the ocean due to the dispersants will make its way up the coast and damage the Bay.

    If you come across alternative, not inside, but alternative reliable and credible sources tracking the plumes, I’d be most grateful if you’d pass it on. Right now, it appears SC coasts are going to be hit possibly going up into the Outer Banks – the National Seashore which is a gem.

    Let’s also remember that it’s really not about land anymore. It’s about religious jihadism. Jews, Christians and Muslims all lived in the lands that are now called Palestine for centuries. The second city most holy to Jews was Hebron after Jerusalem. But Muslims did their best over the centuries to kill and throw out most Palestinian Jews and Christians from Hebron and the West Bank. The greatest danger to Palestinian Christians right now are Palestinian Muslims which is why the Christians are leaving Palestine in droves. The real question should be why Palestine should be reserved only for the Muslims? Isn’t that what we call ethnic cleansing which is suppose to be a war crime? Arabs live in Israel. Jews and Christians should be allowed to live on the West Bank free of violence. Land swaps have been suggested for decades between Jewish settlements on the West Bank and land that is now in Israel that will be needed to connect Gaza to the West Bank. So the issue with the settlements is really a non-issue except for that the Muslims in Palestine don’t want peace at all and anything proposed thus far short of them throwing the Jews (and Christians) into the sea has not been accepted by them.

    Kagan and Shariah Amendments to Constitutions

    Two months after giving Feldman his Bemis chair, from November 12-14, 2008, Kagan spoke at and presided over a conference titled The Constitutional Judiciary in the Muslim World: Its Influence on the Interpretation of Constitutional and Legislative Texts 1970 to 2008 . To a large extent, the “Constitutional Judiciary” discussed in this conference was in fact the Shariah Judiciary, which was (and is, thanks in part to Feldman) being written into national constitutions in Muslim countries as a guiding principle. The Conference program is here including abstracts, with a summary report here.

    Like Feldman’s book, this Conference was upbeat on the prospects of introducing Shariah law into Constitutions. Feldman was said to have been the advisor in Iraq who insisted on putting a clause in the Iraqi constitution requiring legislation comply with Shariah law. In the main, the conference participants appear to have treated the introduction of Shariah amendments into national constitutions as progress – a good thing. The Rise of the Islamic State…

    That theme of Kagan’s conference was captured by Baber Johansen, acting Director of the Islamic Legal Studies Program, in his opening presentation on “The introduction of the ‘principles of the Islamic Shari’a’ as a source of the national legislation in the constitutions of major Muslim countries (1970-2008).” Johansen’s abstract states:

    “The introduction of constitutional amendments in the 1970s and 1980 that made “the principles of the Islamic Shari’a” a major or even the major source of national legislation has, on the one hand, given a new Islamic dimension to constitutional law, it has, on the other, raised the question of the relation between this amendment and the other articles of the constitution.

    Is the Islamizing amendment an article above or in the constitution? Do all other articles of the constitution have to be interpreted in its light or is the constitution one body in which the new amendment has to be interpreted in a way that guarantees the rights and freedoms protected by the constitution? In the last instance the question is how, if the Islamizing amendment is above the rest of the constitution, the constitution can guarantee its [ie the amendment’s] status as being above the positive law and the constitution.”

    No mention of the Shariah laws against civil liberties, the lack of rights for women and non-muslims and apostates and gays, the requirement for violent jihad and so on. Just a technical discussion of the mechanics of making Constitutions comply with Shariah law.

    After Johansen’s presentation, Kagan spoke – but no record exists of what she said. She is listed on the program, and a photo of her at the conference was published in the June 2009 Islamic Legal Studies Program newsletter.

    That same newsletter, on the last page (”Objectives and Principles”) states that Kagan’s Islamic Legal Studies Program seeks “to promote a deep appreciation of Islamic law as one of the world’s major legal systems.”

    And that’s the problem. We know that Elena Kagan has a “deep appreciation” of Islamic law and international law. Americans are increasingly skeptical that she has a similarly deep appreciation for the US Constitution.

    According to Gallup polls, 44% of Americans support her nomination, 34% oppose her, and 22% don’t know. The only other nominees whose public support was less than 50% at this time were never confirmed: Harriet Miers and Robert Bork. Bork had 1% more of the public opposing him than Kagan; Miers had 2% less of the public supporting her than Kagan. It’s that close.

    Americans can still raise their voices on this, if they’ll raise them loud. The Senate Judiciary Committee will vote on Kagan’s nomination this week, with the full Senate voting later this summer.”
