Whether the good citizens of Louisiana are successful or not at removing Senator Mary Landrieu from office, it is good to know that concerned citizens are attempting this and that statutes exist to permit it. And yes, I do believe that the 10th Amendment is pertinent.

Well, you’re probably already hearing from the “conservative” nay-sayers already. You may be hearing all kinds of reasons that you should not participate in this effort. I’ve already had a coulple of conversations with “Conservative activists” trying to dissuade me from participationg in this effort. This morning, one gentleman who is a self declared “leader” in the Tea Party movement expressed to me his own reasons why I should give this up already. Some of these I’d like to share with you now.
1) “It can’t be done!”
Sorry, but that defeatest attitude isn’t one of my core attitudes.
2) “It’s never been done before.”
Well, he was correct. Of course, it will never ever be done until someone really tries to get it done.
3) “State law only provides for the recall of State and Local Officials”
When I asked him if he could give me the actual Louisiana Statute he was talking about, he told me that it would take a couple of week to get it to me. But, of course, he did know the statute. Until he gets that information to me, I’ll have to fall back on Louisiana RS 18:1300.1 §1300 (Link). This statute, specifically addressing the recall of elected officials, states, “Any public officer, excepting judges of the courts of record, may be recalled”. Nowhere, could I find in that statute an exception to Federal officials nor anything that would describe a U.S. Senator as something different that a “Public Officer”.
4) “The Supreme Court has already held that States cannot recall U.S. Representatives or Senators.”
Well, again, when I asked for this case to be cited, it couldn’t be. Neither the U.S. nor the Louisiana Supreme Court has ever heard or made a decision concerning the recall of U.S. Represntatives or Senators.
5) “The Constitution doesn’t provide a means to recall U.S. Representatives or Senators”.
True. There are lots of issues that the U.S. Constitution does not address. That’s why our founding fathers later included the 10th Amendment (link). It states simply, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” In simplest terns, since the U.S. Constitution has NOT provided a means for the citizens to remove Representatives or Senators and has NOT forbidden the States or the people from doing so, then it is reserved to the States or the people. Fortunately, Louisiana is one of the 18 states that have passed laws providing for the recalling of “Any public officer” other than judges. U.S. Representatives and Senators or NOT judges, so can be recalled.
6) “The 10th Amendment forbid it.”

7) “Constitution experts have …..”
Sorry, but Constitutional experts are simply people like you and I, who have opinions. Some have the opinion that it can be done, some have the opinion that it can’t be done.
Thoughout the internet, in the social networking groups, in the blogs, etc., there have been many who have made a lot of noise about recalling Mary Landrieu. Up until now, I’m sure it has been an amusement to her ilk. On December 29, 2009, Someone finally did something about it and filed the petition with the Secretary of Sate’s office. I for one am enthusiastically joining in the effort and will never look back.
Legally, we CAN recall Mary Landrieu. Ethically and morally, we CAN recall Mary Landrieu. Ethically and morally, we SHOULD recall Mary Landrieu. I can promise, if we accomplish this daunting task, it will have a snowball effect in Baton Rouge AND Washington, Nay-sayers notwithstanding. One thing is a fact, however, as long as we continue to roll over and play victim, we will continue to be made fools out of by the likes of Mary Landrieu. Attending meetings and rallies, waving banners and placards and making a lot of noise changes NOTHING … if we do nothing else to change things. Louisiana voters are blessed with the statutes allowing us to recall public officials who are derelict in their duty, and we should take advantage of those laws. Yes, laws do mean something … as long as we use those laws.

These were the only three types of citizens at the signing of the Constitution:

I was talking to Leo once and confirming it, it has to be two parents who are US Citizens, plus the child born to them in the US, or even like at a military base, if born from two US parents, they are natural born citizens. It has to do with the second generation. For example, the parents could have come from another country, then then because US citizens. They’re not natural born, although the parents are citizens, but if their child is born after they became citizens, then the child is a natural born citizen.
Even if BO became a citizen through marriage, he’s still not a natural born citizen. Actually, nothing can ever make him an NBC if his daddy was not a U.S. citizen. BO could have been born on the WH steps and if his father wasn’t a US citizen, then BO can never be an NBC.

You guys might have to wait your turn. Here in New Jersey, a similar recall movement has begun against Senator Robert Menendez (D-NJ), head of the Democratic Senate Campaign Committee. Our SecState (or rather her Division of Elections director) put out the same balderdash as yours did–but both officials have since been replaced, and their “final determination” is on appeal as I write this.
And one more thing: your read of the Constitution is spot-on. There is, however, a Supreme Court case that might be relevant: US Term Limits v. Thornton. My read of that case is that you have to persuade Justice Anthony Kennedy to change his vote on that case from “nay” to “yea” on the obvious States’-rights question.

Don, you may be correct. I know that it does with the children too. But it wouldn’t matter if he became a citizen since he was married because he still wasn’t born a US citizen and never can be NBC.
Also, a US citizen made some other way has the same rights as a natural born citizen. The only difference is that one can be president and one can’t. It all has to do with allegiance. An NBC will usually have only allegiance for the country of his/her birth. It’s for our protection.
While everything about o is a mystery, why does he use II instead of jr. Below is the proper use of jr. vs II from Wiki. May be nothing more than vanity, may be a clue he is not Obama Sr.’s son.

I too WAS skeptical when it was first mentioned simply b/c it was unthinkable BUT I’ve now arrived at the place that all of the terrorist attacks and supposed natural disasters (minus Katrina) may very well have been perpetrated on us and others across the globe.

If there was someplace better to live I would be out of this state in a heartbeat. Sadly there doesn’t seem to be anyplace in the entire country that isn’t experiencing some sort of disaster,or heavy criminal activity. So here I sit in a place that I hate,but unable to go anywhere else because it is just as bad there. Fort Wayne has really never been my idea of a decent place to live. The only thing that kept me here was the fact that I operated a profitable business…….then. My oldest son now operates what remains of the family business. He was forced to liquidate a large portion of the non profitable part of it. In so doing he took a serious financial blow, but certainly not a knockout. He has reduced the size of the business to VERY SMALL. He retained certain customers who are still willing to use his services. He expects to turn a profit in the second quarter.
I have been thru Kimmel a few times in my life. This was usually while en route to a fishing spot in the area.

Regarding citizenship, my parents both immigrated here from Holland. My brothers, sister and I were all then born as possible dual citizens. Holland & US, none of us took on our Dutch citizen status, though, my sister said we would have to renounce our US citizenship. When I married my husband, an American citizenship I lost any ability to claim Dutch citizenship. My brother married a Dutch girl, took a long time for her to get her paperwork to move here legally. Now their kids would possibly be able to claim dual citizenship. Long story short I’ve known since elementary school that we wouldn’t be considered natural born citizens.
If pelosi tries to pole vault, maybe the pole will think it is a broom and fly off with her.

I can’t believe I wasn’t aware of this sooner. My crappy local newspaper has not been reporting. Now I’m getting angry reading more about it!! They are saying that we CAN’T RECALL MENENDEZ BECAUSE IT WOULD BE UNCONSTITUTIONAL.
“It has been determined that the qualifications and election of a Member of the United States Senate is a matter of exclusive jurisdiction of federal authority and that neither the United States Constitution nor federal statute provide for a recall proceeding for a federally-elected official. Therefore, in my capacity as the Chief Election Official of the State of New Jersey, I hereby determine that neither the Notice of Intention to Recall nor the proposed Petition can be accepted for filing or review.”
The response comes nearly four months after the Notice of Intent to Recall was initially filed.

RestoreOurColorado.org received a response today, to Petitions of RECALL for Mark Udall and Michael Bennett presented to the Elections Division on Tuesday, January 26, 2010. The letter dated January 28, 2010 from Rose A. Sanchez (Title not specified) of the Elections Division of the Secretary of States Office described an opinion, without statutory identification, and the conclusion that United States Senators are not subject to the citizen electorate once seated.
Reasoning from Secretary of State:
“The office of the United States Senate is a federal office governed by the provisions of the United States Constitution. While Colorado state law provides for the recall of state offices, these provisions are not applicable to federal offices such as United States Senator. Additionally, the U.S. Constitution makes no reference to the ability to recall federal offices. As a result, United States Senators are not subject to recall and your petition formats cannot be approved.

Here is a thought………PELOSI in near earth orbit. All that is needed is for sombody to steal her pole vault, and pack it full of solid rocket fuel. When she tries to vault the fence then the rocket fuel is ignited. She would be treated to a mach 3 ride through our upper atmosphere, and perhaps into earth orbit.

US President Barack Obama will make what will be an emotional trip with his family to his childhood home of Indonesia in March, and will also visit Australia, the White House announced on Monday.
Obama, who was known as “Little Barry” when he lived in Jakarta with his mother in the 1960s, said last year in Singapore that he was looking forward to visiting his old haunts in Indonesia.
He was invited to make the trip by Indonesian President Susilo Bambang Yudhoyono, and both sides have said they plan to use Obama’s childhood ties to the country to further tighten a crucial pan-Pacific relationship.
“This trip is an important part of the president’s continuing effort to broaden and strengthen the partnerships that are necessary to advance our security and prosperity,” White House spokesman Robert Gibbs said.
Gibbs said that Obama would inaugurate the US-Indonesia Comprehensive Partnership during the visit, which is intended to further deepen ties between the two countries.
It is possible he will introduce his wife Michelle and their daughters Malia and Sasha to neighborhoods he knew as a boy and also to some old school friends.
Obama’s visit will be greeted with massive expectations in Indonesia, and a comprehensive security operation in the world’s most populous Muslim nation.
Washington took steps last year to dampen speculation and reports in Indonesia, that Obama would visit the country during his first year in office, but made a promise he would make the trip this year.
Obama spent part of his childhood in Indonesia after his divorced mother married an Indonesian and attended a primary school in Jakarta between 1967 and 1971.
The childhood connection and his knowledge of a few words of the Indonesian language have made him hugely popular in the country of 234 million people, 90 percent of whom are Muslim.
Gibbs said that Obama looked forward to discussing issues including green energy, climate change, economic recovery and non-proliferation with Australian Prime Minister Kevin Rudd.
En route to Asia, Obama will meet US troops stationed in Guam, Gibbs said.
Rudd and Obama have met a number of times since Obama became president last year, including in the United States, and have forged a close, and mutually admiring diplomatic relationship, especially on climate change.

The south – this was a piece of legislation the Tea Party’s advanced here in Virginia. We held a 10th Amendment Rally on MLK day too, although I was unable to attend, I heard it was the largest rally ever held on the capitol. Speaks volumes.
Since it passed the Senate where the D’s hold a slight majority, it will easily pass the House where the R’s rule. And, of course, the Governor will be happy to sign it. So, it’s pretty much a done deal.

Rassmussen poll is not looking very good. They have bo at -4 now. All of a sudden people are liking him again even after that total failure of a speech he gave last week. What the heck is wrong with people? Are they that stupid and easily swayed by his lies? He fires people up with all his lies. These liberals must like being lied to or something. I think they have been talking to some of his stronger supporters who like him no matter how bad he is.

Regarding citizenship, my parents both immigrated here from Holland. My brothers, sister and I were all then born as possible dual citizens. Holland & US, none of us took on our Dutch citizen status, though, my sister said we would have to renounce our US citizenship. When I married my husband, an American citizenship I lost any ability to claim Dutch citizenship. My brother married a Dutch girl, took a long time for her to get her paperwork to move here legally. Now their kids would possibly be able to claim dual citizenship. Long story short I’ve known since elementary school that we wouldn’t be considered natural born citizens.
