On January 19, 2009 I posted the following article regarding the constitutional requirements to be sworn in as President of the United states, POTUS. There is much confusion about this among citizens, congressmen and most scarily, judges. The key phrase below is:

According to the US Constitution, the supreme law of the
land, Barack Obama will not be President of the United
States at 12:00 noon on January 20, 2009. No Chief
Justice administering the oath of office, no oath sworn
by a “president elect” makes one president. There are 3
mandatory requirements to achieve a legal inauguration.

A qualified president elect.

Sufficient votes by the Electoral College.

Certification and count of Electoral College votes by
Congress.
At noon on January 20, 2009, Joe Biden will be president
until a president shall be deemed qualified. This comes
direct from the 20th Amendment to the US Constitution.
“or if the President elect shall have failed to qualify,
then the Vice President elect shall act as President until
a President shall have qualified;”
Further reading of the 20th Amendment reveals that Congress
may also determine if the vice-president is qualified. This
is part of the scenario of a constitutional crisis that
Philip J Berg and others have warned of. The language of
the 25th amendment includes options that may further heighten
the crisis level.
Amendment XX
Section 1. The terms of the President and Vice President shall
end at noon on the 20th day of January, and the terms of Senators
and Representatives at noon on the 3d day of January,
of the years in which such terms would have ended if this article
had not been ratified; and the terms of their successors shall
then begin.
Section 2. The Congress shall assemble at least once in every
year, and such meeting shall begin at noon on the 3d day of
January, unless they shall by law appoint a different day.
Section 3. If, at the time fixed for the beginning of the term of
the President, the President elect shall have died, the Vice
President elect shall become President. If a President shall not
have been chosen before the time fixed for the beginning of his
term, or if the President elect shall have failed to qualify, then
the Vice President elect shall act as President until a President
shall have qualified; and the Congress may by law provide for the
case wherein neither a President elect nor a Vice President elect
shall have qualified, declaring who shall then act as President,
or the manner in which one who is to act shall be selected, and
such person shall act accordingly until a President or Vice
President shall have qualified.
Amendment XXV
Section 1. In case of the removal of the President from office or
of his death or resignation, the Vice President shall become
President.
Section 2. Whenever there is a vacancy in the office of the Vice
President, the President shall nominate a Vice President who shall
take office upon confirmation by a majority vote of both Houses of
Congress.
Section 3. Whenever the President transmits to the President pro
tempore of the Senate and the Speaker of the House of
Representatives his written declaration that he is unable to
discharge the powers and duties of his office, and until he
transmits to them a written declaration to the contrary, such
powers and duties shall be discharged by the Vice President as
Acting President.
Section 4. Whenever the Vice President and a majority of either
the principal officers of the executive departments or of such
other body as Congress may by law provide, transmit to the
President pro tempore of the Senate and the Speaker of the House
of Representatives their written declaration that the President is
unable to discharge the powers and duties of his office, the Vice
President shall immediately assume the powers and duties of the
office as Acting President.
Thereafter, when the President transmits to the President pro
tempore of the Senate and the Speaker of the House of
Representatives his written declaration that no inability exists,
he shall resume the powers and duties of his office unless the
Vice President and a majority of either the principal officers of
the executive department or of such other body as Congress may by
law provide, transmit within four days to the President pro tempore
of the Senate and the Speaker of the House of Representatives their
written declaration that the President is unable to discharge the
powers and duties of his office. Thereupon Congress shall decide
the issue, assembling within forty-eight hours for that purpose if
not in session. If the Congress, within twenty-one days after
receipt of the latter written declaration, or, if Congress is not
in session, within twenty-one days after Congress is required to
assemble, determines by two-thirds vote of both Houses that the
President is unable to discharge the powers and duties of his
office, the Vice President shall continue to discharge the same as
Acting President; otherwise, the President shall resume the powers
and duties of his office.

Magna Carta, I think you’re right. The angle of holding Hawaii DoH accountable to their own rules is a crucial strategy which will likely work in the long run. Perhaps they will try to call an emergency session of the Hawaii legislature to close the hole that has been opened by Leo D. and others regarding making statements–formal or informal–and then attempting to close of access to the underlying evidence backing those statements. Right now they are picking and choosing the parts of the law that they are willing to defend, the others they are trampling. This will soon catch up with them. Watch. They are wounded, and know they are in a corner. I bet there will be an emergency legislative session to close this off. But it won’t work. Law does not reach back in time once a new law has been passed. The horse is already out of the barn, and they can’t use a new law retroactively to cover their ass. They will try, but they will lose. This is an extraordinarily fertile area to force the disclosure of Obama’s records. Keep it up.

It should be understood that 14 of the 18 returned bodies from Afghanistan were the bodies of those recently killed in two helicopter crashes, and the crash of a U12. Once again they lie about even the dead. Yes they are all deaths of military people, but 12 of them died because a helicopter pilot made a mistake in judgement and collided eith another. In actuality only 6 died as a result of enemy action.

Regarding this article, Dr. Rosenbloom is spot on and I agree totally with what he says. I know you’re following all this, but if you noticed, anytime someone posts that they’ve taken their child to a doctor, I always ask if they’ve been tested.
This is the problem: Many have stopped testing and are just calling it H1N1 with no real confirmation. Most of the cases tested are *not* H1N1; not even a flu at all.

Before bashing Judge Carter for his October 29 Order, consider that he gave Dr. Taitz three openings wide enough through which to drive a Mack truck.
First, Judge Carter misstates Orly’s argument as follows: “Plaintiffs argue that despite the fact that President Obama has produced a birth certificate from the state of Hawaii, there is evidence to show that the President was actually born in Kenya, thus making him ineligible to be President.” This sentence could have two applications and meanings, each of which is flatly wrong and grounds for error. If it means that Orly ARGUED that Obama produced the Hawaii birth certificate, that is clearly wrong. She did not argue that. On the other hand, if it means that despite the fact that President Obama has produced a birth certificate, Orly ARGUED there is evidence to show Obama was actually born in Kenya, that is judicial error premised on a fact — “Obama produced a birth certificate from the state of Hawaii” — still in dispute and to be tried.
Judge Carter then compounds the above with a misstatement of Orly’s case in the very next sentence as follows: “Plaintiffs also argue that, even if the president was a natural born citizen, he abandoned his citizenship while living in Indonesia and has not gone through the proper immigration procedures to regain his United States citizenship.” First, Orly’s argument of “natural born citizen” is not premised on whether or not Obama was born in Hawaii rather than Kenya, but on Obama’s father being a Kenyan/British citizen on baby Obama’s birth. Second, Judge Carter applies the two terms, “citizenship” and “natural born citizen” in a context as if they are the same. To the contrary, only “citizenship” could be lost through Obama’s intervening Indonesian status, that intervening status would have no bearing on “natural born citizen” — entailing the two citizen parent requirement attached only at birth. (Judge Carter may have announced what was Attorney Gary Kreep’s argument, but it was not Orly’s, leaving us to contemplate Judge Carter retaining Kreep’s and Orly’s cases together over Orly’s strenuous objections.)
And finally, Judge Carter cites Plaintiffs’ failure “to bring their claims in this Court until after President Obama was sworn into office” as meaning that Orly lost the right to ask the Court to interpret the candidate’s qualifications to run for office (we’ll leave consideration of Gary Kreep’s role in delay of Orly filing for another day) insisting that Orly’s sole relief claimed is removal from office. At least with respect to Candidate Keyes who bases his claim on tortious fraud against “Candidate” Obama, not ‘President’ Obama, that removal is not the sole relief sought. First of all, whether or not Orly’s case was filed at a time of day on January 20, 2009 before or after Obama was sworn in, the Court would be faced with same actual problem at the present time of addressing a “current President” rather than “political candidate” in terms of relief, hence the distinction is a red herring. On the other hand, IF the “before-or-after Oath” IS crucial vis a vis Orly’s filing as Judge Carter maintains, the time and date of Obama’s Oath is, at the very least, a fact to be tried and a fact in dispute considering that the Chief Justice was called upon to administer the Oath at the Whitehouse, the following day, January 21, 2009 — the day after Orly filed the case.
Since federal statute affords grounds for Recusal of Judge Carter by reason of the appearances of, if not real, conflict of interest, there is certainly basis for Orly’s Motion for Recusal by reason of Judge Carter’s hiring as his clerk a lawyer from the very same firm whose senior partner represents Obama in his eligibility cases during the pendency of this case. Coupling that with Judge Carter’s blatant errors, above, yet exhaustive (very well written) legal analyses as well as concluding harsh rebuke of Orly in “hamper[ing] the efforts of her co-counsel Gary Kreep” (one could only wonder at the possible intrigue there), one is left to wonder about Judge Carter’s actual judicial motive, that is, ala Judge Land proceeding. We may never know.

Gotcha. Sorry for the delay (working!).
First of all, please don’t panic. Your son is sick and can be helped with what Nature has given us.
One tablespoon of apple cider vinegar and a few of honey mixed in warm water. You can also try the one tablespoon of the vinegar with a couple tablespoons of honey mixed in a cup. Stir and take it with a spoon. This tastes pretty good, and I think he may take it. Do this every few hours for the best results.
Sambucol: If you have the liquid, the directions are on the bottle for ‘intensive use’-2 teaspoons 4X daily.
I don’t know too much about the zinc dosage, but please don’t overdo that-it can cause an upset stomach. If his stomach is upset, maybe you wanna skip the zinc, for now.
If you have Vitamin D3, I’d start giving him that, too. While there’s no set dosage, I’d give him several thousand I.U’s of it, and increase the dosage from there. If you don’t have any on hand, any pharmacy chain (CVS, Walgreen’s, Rite Aid, etc.) will have it; it comes either in gelcaps or tablets and you can get it in a 1,000 I.U. per-pill dose.
And by all means, Kidmon, keep giving him fluids-tea, water, Gatorade, anything he’ll take. Gotta keep him hydrated-that’s important!
If he wants to sleep, let him. He needs rest to battle this bug.
If he’s no better after all this, do consider getting him to the doc, or the E.D.

Actually, this all is a compilation of info gathered from the many very bright folks here on CW (huge hat tip to Kittycat!) and some personal experience thrown in.
Just remember apple cider vinegar, honey (organic and local if you can get it), lotsa Vitamin D3, Sambucol (elderberry extract) and zinc. ‘Zicam’ the cold remedy is zinc gluconate and their throat sprays and lozenges come in a variety of tasty flavors as straight zinc is rather bitter.
We should all be healthy as horses this coming winter season :).

OK on the D3, and I like the gelcaps, too. I’d want to get him up to at least 5,000 I.U. or more. I know that some docs recommend megadoses (200,000 I.U. or more!) but I think it’s best to start off conservatively, and add as you go along. There should be no bad reaction, so you can increase the dosage 1,000 I.U.s at a time. Maybe he can take two at a time several times per day to get the D3 levels in his system up?
Yes, I have the Sambucol tablets, too, as well as the syrup. My label directions say 2 tablets 3X daily for ‘intensive use,’ but whatever brand you have, please do follow the directions for ‘intensive use.’
Please keep an eye on him!

I was there with my 3 just a couple weeks ago, much younger than yours. Don’t worry, it’s all tv hype. My youngest had the roughest time with a high fever that lasted 5 days. I was pretty freaked out about all this swine stuff, but these CW MD’s know there stuff. Unless there are other medical conditions that make him high risk, let him eat popcicles and watch ESPN all day- after the ACV.

Gianni…I agree. I call this the second ring strategy where citizens do not need to get nailed to the cross of standing,jurisdiction,etc…I believe counsel must be exceptional to pull this off. I believe this case was lacking in skill to really move this Judge…he was open. I read the transcripts. This reveals alot.I do love the passion and persistance though. Federal courts are a tricky business.I think second tier actions gauged to discredit him and illustrate the lies are to me the most important. If he gets removed somehow then its a bonus. Please consider scooting over to CNN from link at top and posting there your insight on DoH criminal activity. The arrogance really begs for it….

Notice how they’ve also ‘pumped up the numbers’ telling you that over 1,000 have died from H1N1 in the U.S. thus far? JJ (our stats guru-ette) and I will tell you that the actual number is less than half that.
This is all part of creating the panic, or, diversion, I should say.
And because there *is* a shortage of vaccine (that’s the truth), why not stretch the number of shots by adding our old enemy Squalene to the batches?
It all comes down to dollars, a phony diversionary crisis, and incapacitating the population, if you ask me.
A false crisis, created panic, a vaccine that’s potentially harmful, and lotsa bucks for big pharma.

I think I mentioned this before but it bears repeating: My parents’ families were all immigrants from other lands and what they ate was incredible by today’s standards: heavily salted fish, carbs to beat the band, *lard,* bacon, etc. They all lived into their 90s. Why didn’t they die earlier from eating all that stuff?
No preservatives!
Everything was natural back in their day..no MSG or anything artificial. No processed foods.
These days, we really have to be careful what we eat-it’s killing us and the obesity rate in the U.S. is through the roof.
There’s certainly something to be said for eating natural foods!

He said that he still takes his D3, and you want to take at least 5,000 I.U. per day for like 3 months to build up to a certain level. If you go it lower, you could have that cytokine storm thing, which can kill you. He states for kids there’s a different amount. I take 6,000 I.U. per day. I know that I’m low just on the fact that I can’t drink milk and I don’t get sun, which I wish was out now.

I am putting my pennies on the AG cases and the appeals. We will get the “Supremes” to hear some case on its merits some day IMHO. One of these initiatives will “break through.” My intuition tells me we have overlooked something so obvious, we cannot see it just yet. So many great minds are working on this; it will all come together when we least expect it. Maybe, it will be a combination of all of the above.

Oh, Kidmon, I wish I were a doc…I’d be making a heck of a lot more money than I am now!
Hypothyroid can cause a bunch of symptoms, some pretty distressing. There are some things you can try, but please run it by your doc to make sure it’s OK for you.
First of all, you might want to eat foods that are naturally high in B vitamins and iodine, like whole grains, nuts, seeds, seaweed, fish and root vegetables.
Omega-3 fish oil may help if you’re not a huge fish fan. You can buy the odorless kind and it’s inexpensive. It’s a large gelcap, but it’s not a problem to swallow.
Exercise is important, even when you’re tired. If you can, 30 minutes per day 4-5 days a week might help with the fatigue.
Please ask your doc if he/she can recommend other natural remedies that wouldn’t be as tough on your system as hormones. While that is the standard treatment for this condition, there may be something natural you can take, especially since you’re ‘borderline.’ I’m sure your doc wants to monitor this, so I’d ask about the natural remedies before taking any drugs.

I think, however, that the apathy is starting to subside and now that this is starting to weave its way into our collective psyches, more folks are talking about it; there is *no* bad publicity, even when the tide seems to be turning against us.
What you said about the ‘obvious’ is something I posted over the summer-it’ll be some little thing that’ll nail him. I never felt that it’d be a court decision with all the bells and whistles and publicity rather, something small that’s right there. Remember that an elephant can easily trip over a pebble on the ground.

Lots of folks in these parts are sick, too. I think we just need to keep in mind that something’s out there, and do everything we can to keep our immune system running in peak form.
Now, this is a personal taste but I’m finding that the ACV with enough honey to dilute the bitterness works for me. I did try it in water, but just the honey/ACV mixture seems more soothing.

Fish is fine as long as it’s a *young* fish! The longer they swim around, the more mercury they take in. If you’re still on the fence, an Omega-3 supplement will fill the gap. Gee, I didn’t know all these judges could amend the Constitution by not ruling? But that is what they have done. They have essentially allowed the Constitution to be amended without ratification of 3/4 of the States, hence making Article 2 Section 1 null and void.
Judge Carter by dismissing this case in reality supported the unratified new amendment, which is that The President doesn’t have to be Natural Born anymore.
I thought the Constitution couldn’t be changed without 3/4ths of the States?

Actually he was pretty good about it! I used warm water and added a tad more honey. He didn’t seem to mind sipping on it. I thought he would barf on the dissolvable tablets, but so far so good. Judge Carter deserves to be called a coward. But Lucas Smith deserves to go to jail if his document is a forgery. Of course, that is assuming he has not received guarantees from Attorney General Holder. Interesting he calls himself a Republican. I guess Holder needs some cover for the dozens of corrupt Democrats he is letting off the hook.
