“You are poorly informed on the constitutional issue involved with Obama’s eligibility to be President. The primary issue is whether Obama is an Article II “natural born Citizen,” not whether he was born in the U.S. When drafting the eligibility requirements for the President, the Founding Fathers distinguished between “Citizen” and “natural born Citizen” in Article II, sec. 1, cl. 5 and in Articles I, III, and IV of the Constitution. Per the Founders, while Senators and Representatives can be just “citizens,” after 1789 the President must be a “natural born Citizen.” The Founders wanted to assure that the Office of President and Commander in Chief of the Military, a non-collegial and unique and powerful civil and military position, was free of all foreign influence and that its holder have sole and absolute allegiance, loyalty, and attachment to the U.S. The “natural born Citizen” clause was the best way for them to assure this.
The distinction between “citizen” and “natural born Citizen” is based on the law of nations which became part of our national common law. According to that law as explained by Vattel in his, The Law of Nations, a “citizen” is simply a member of the civil society. To become a “citizen” is to enter into society as a member thereof. On the other hand, a “natural born Citizen” is a child born in the country of two citizen parents who have already entered into and become members of the society. Vattel also tells us that it is the “natural born Citizen” who will best preserve and perpetuate the society. This definition of the two distinct terms has been adopted by many United States Supreme Court decisions. Neither the 14th Amendment (which covers only “citizens” who are permitted to gain membership in and enter American society by either birth on U.S. soil or by naturalization and being subject to the jurisdiction of the United States), nor Congressional Acts, nor any case law has ever changed the original common law definition of a “natural born Citizen.” Congressional Acts and case law, like the 14th Amendment, have all dealt with the sole question of whether a particular person was going to be allowed to enter into and be a member of American society and thereby be declared a “citizen.” Never having been changed, the original constitutional meaning of a “natural born Citizen” prevails today. It is this definition of “natural born Citizen” which gives the Constitutional Republic the best chance of having a President and Commander in Chief of the Military who has sole and absolute allegiance, loyalty, and attachment to the United States. By satisfying all conditions of this definition, all other avenues of acquiring other citizenships and allegiances (jus soli or by the soil and jus sanguinis or by descent) are cut off. I call this state of having all other means of acquiring other citizenships or allegiances cut off unity of citizenship which is what the President must have at the time of birth.
Obama’s father was born in Kenya when it was a British colony. When he came to America, he was probably here on a student visa and he never became a legal resident of the U.S. or an immigrant. He had no attachment to the U.S. other than to study in its prestigious educational institutions which he did for the sole purpose of returning to Kenya and applying his learning there for the best interests of that nation. In fact, when he completed his studies, he did return to Kenya and worked for its government.”

Who says that a Natural Born Citizen requires two citizen parents and birth in the country?
The constitution does not define Natural Born, but Natural Born was commonly used in the laws of the US Colonies before the Revolution, and it meant that someone became a citizen of the colony and a subject of Britain merely by being born in the colony. This was regardless of the number of parents who were subjects or citizens.
This is what Natural Born refers to. It refers to the laws of citizenship at the time.
It does not refer to the theories of Vattel, a Swiss philosopher, who was considered an expert in international law, but not an expert on citizenship or government. The writers of the Constitution did not follow Vattel on many things. For example, Vattel recommended that each nation establish its own religion and force people to convert to it.
So where does Native Born come from? From the law, and not from Vattel. It comes from the laws in the American Colonies before the Revolution, in which anyone born in the colony was considered a Natural Born Subject of Britain AND a Natural Born Citizen of the colony. Being Natural Born simply meant being born in the colony regardless of the number of parents who were citizens.
This was very commonly known among the writers of the Constitution. This is what Blackstone said (and he was very popular reading among the writers of the Constitution, who were mainly lawyers):
“The children of aliens, born here in England, are, generally speaking, natural-born subjects and entitled to all the privileges of such. In which the constitution of France differs from ours; for there, by their jus albinatus, if a child be born of foreign parents, it is alien.” http://www.lonang.com/exlibris/blackstone/
(And the minor exceptions referred to in “generally speaking” refers to the children of foreign diplomats.) To be clear, Blackstone says that Natural Born subjects (and in the USA, Natural Born Citizens) are those that are born in the country regardless of the number of citizen parents.
And this is why such prominent conservative Senators who are also lawyers as Orren Hatch and Lindsay Graham say that a Natural Born Citizen is simply one who was born in the USA:
Senator Lindsey Graham (R-SC), said:
“Every child born in the United States is a natural-born United States citizen except for the children of diplomats.” (December 11, 2008 letter to constituent)
Senator Orrin G. Hatch (R-UT), said:
“What is a natural born citizen? Clearly, someone born within the United States or one of its territories is a natural born citizen.” (Senate Judiciary Committee hearing hearing on OCTOBER 5, 2004)

Speaking of Glenn Beck, I posted the following over at Leo’s place: (still in moderation)
“Leo, are you ready to appear on the “Glenn Beck Show?” (radio, TV, or both) I DVR Glenn’s show on Fox everyday. Eventually, someone will put this on youtube. I do not have the means to do that. On today’s show, Beck announced a feature on his website. The feature is entitled: “U.S. Constitution Watchdog.” This allows anyone to alert Glenn to any concern they may have about violations of the Constitution.
I believe it is about time for Glenn Beck to be educated on Article II, Section I, Clause V, and what the significance of a natural born citizen is, and more importantly why the founders believe that it was essential to ensure the national security of the United States. I can think of no one better than you to be his tutor. (Possibly even you teaming up with Apuzzo) I believe that many here, and also at “Citizen Wells,” (and possibly elsewhere) will be more than happy to lay the “groundwork.” My question to you, dear Sir, is are you “game” to close the deal? I hate to say this, but Beck won’t cover it. I’ve come to the unfortunate realization that Beck will give us as much as he can or as much as we need (I do think that he’s very well intentioned) so that ratings will spike, but there’s a line at which his leash pulls. He won’t cover it, either because he and/or Fox are afraid of losing credibility, or he’s just protecting his job. Ultimately, there’s not one in the mainstream media – with the POSSIBLE exception of Lou Dobbs – who are willing to put their careers on the line for the people.

Nancy, keep posting. I have been watching the CSPAN hearings on the Bank of America purchase of Merrill Lynch. Fascinating! So, we donated $20b to Merrill Lynch; and $45b to BoA; and purchase price for ML was $50b. One of the Reps – a woman from CA – said, WE bought ML and gave it to BoA! I decided to learn all I could about finance and fiscal policy. I watched a great video on the Federal Reserve (I’ll find the link) and I bought a book on the stock market. In the olden days, we could – or thought we could – trust our elected officials to do the right thing. Now, we know better. Each of us needs to get up to speed on these issues (or find someone we really trust to advise us). So, keep posting. An informed citizenry is tyranny’s greatest enemy.
I disagree John Feeny. I don’t think you have been watching Beck lately. He is vowing to stop Obama/Soetoro via any means (legal) possible. That CARS.GOV thing that he featured with Jonah Goldberg, freaked him out to no end.
He realizes now that we have an “usurper” in office, and at least one of his “czars” is an avowed Marxist. He has conceded that this does not happen merely by accident, and is all be design. He doesn’t want to say the word “conspiracy” on national TV, but he doesn’t have to. He has well implied that many times over. Give Beck the benefit of the doubt here, especially with Judge Napolitano at his side.
If someone will just present him with a “reasoned” argument for the proper understanding of Article II, Section I, Clause V, I believe his is willing to hear it. He is adamant that Obama/Soetoro is an enemy “inside the gate.” And, he must be stopped. Anyone’s fatalistic notions on the matter are NOT constructive to this end…

I’m not fatalistic; believe me, I’m fighting as hard as I can. I can’t help but feeling, however, that where the media is concerned, ‘both ends might be being played against the middle’, which, if true, is a frightening concept. I’d rather take care of myself with the help of people I trust; I’m not going to put blind faith in the media to protect me. Maybe Beck will come through, and I truly hope that he does, because like I said, I think he’s extraordinarily well-intentioned and a good man. I’m just not going to put myself in a position where I’m depending on someone else to protect me at a critical time.

Glad for your encouragement. I was close to giving up on adding my input (which, like you I am sure, have spent many hours of research on). I am concerned that too many people in America are caught up in issues which will not produce the results which we are seeking. That is the reason I posted such things as I did, as I believe, through understanding all the injustice done for years, and standing up to establishments (if ya’ want to call it that) the Federal Reserve, etc., I truly believe we can overcome.

Here’s what I mean – it’s so plainly obvious that that this government has been hijacked…I mean, my dog can tell – at what point will SOMEONE high-ranking in the military simply refuse to follow the Messiah’s orders, or even REMOVE HIM FROM OFFICE? “Mr. Obama, you have been placed under suspicion of Impersonating an Officer per Article 124, Paragraph 160 of the Uniform Code of Military Justice. That should sum things up in one nice neat little package for our usurper. I would expect a resignation from him within 48 hours if the military demanded this.

Congrats on your quality command of grammer! Regarding Beck it is doubtful that he will EVER align himself wifh either camp. He has too many more important irons in the fire. Where he is concerned the dominant force is FOX. His restraint thus far seems to show that Beck’s main interest is Beck, and he isn’t likely to “rattle the wrong cages” if you will.
Fox is to a degree following the fairness doctrine which is where the “Fair and Balanced” propaganda has it’s foundation. The radical liberal left would really enjoy seeing the “Fairness Act”imposed upon ALL broadcasters. I have a feeling that such behavior would highly incense a whole lot of the broadcasting community, and we would see a resultant evaporation of a large number of our talk shows. With respect to Beck I agree that he is on a leash, and it will only extend as far as FOX has set for.

I was having a discussion earlier tonight with my adult daughter and her boyfriend – both of whom understand the issues at stake to save the country.
I was telling them that I spend my days online looking for blogs and other places to educate those that do not know – and for the record I consider my visits here a respite from idiots.
They wanted to know if I found any approach that works.
I told them there were two things that seem to be effective.
First, I ask folks to imagine that if Obama is constitutionally eligible, so would the spawn of Osama bin Laden born by an American woman in New York City. They nodded and approved.
Second, I ask them how they would feel if Obama’s father were still alive and prominent in the politics of Kenya.
My daughter instantly asks, “And what happens if Osama bin Laden kidnaps Obama’s father?”
I laughed – she gets it – and I will be adding that to my online posts in liberal enemy territory.

Beck is trying, I agree. But his job is still dependent on the powers over him at Fox. How much will they let him do? Good question. One minute I think Murdoch is for OB and then I hear him say things that make me think he isn’t so in love with him. He also hasn’t been interviewed in awhile to my knowledge so who knows what he is thinking. He is one of the elite, wealthy possible nwo advocates, so who can trust he says anyway. To me, Rush is the most independent, but he is very careful to maintain his status, so I don’t know how far he will really go either. He also may owe favors to someone or have skeletons in his past that are being held over his head. At least they are willing to bring up some things about OB that the msm isn’t touching because they are in bed with the OB admin.
Also, if Judge Napoitano is helping out at Fox, he should know all about the Constitution and how to interpret it. That’s his specialty. I would think he has educated them all about what is going on with any violations of the Constitution. Why he hasn’t been allowed to voice his nbc/eligibility concerns more forcefully is a guess. He is also paid by Fox so maybe his leash is short too. One day maybe some of them will fund an independent news channel that will tell all to the American people. If they can get FCC approval that is or go underground some how. Until then, we have to be happy some of this stuff is getting out. As long as the ratings are high at Fox and Murdoch is making money, he will allow them to go on just so far. It’s all about the money in the end. We shall see.

( BTW – Thank you JeanieJo for providing the video on the last thread. ) I think the letter that he sent to the TOTUS was spot on. He came out and said that he was being caled an Uncle Tom and that he believes thet Professor Gates caused such racial problems that they may not be able to correct later. I don’t have the exact words, but for those who haven’t read what he wrote to the Professor and what he said to Sgt Crowley – you should. What a very brave man.
I think we should bombard him with support in any way we can. If anyone has any info on how to reach him by the Cambridge Police Web site or the Police Dept address … he needs our support. He is saying that Gates started this racial problem and we all know how the TOTUS continued the problem. This man needs our support. We is being called names and he said it is only because “he spoke the truth” about Gates. I give so much respect to him and he needs us. He had the ball$ to write a letter to BO and tell him how it really went down.

You misunderstand me, my friend. I’m far from a radical, and I’d like to think that I’m actually a pretty nice guy. I’m sure that you and I are of the same ilk. The one point on which we disagree seems to be this: If I’m anything, I’m a law-abiding citizen; however, if something so radical and obvious is being perpetrated upon the foundation of our laws and our natural rights and freedoms, how long are we supposed to sit in obedient acquiescence? As long as the Constitution says so? Thomas Jefferson himself said, and I’m paraphrasing here, that there comes a time when people must by right dissolve the political bands that have joined them to their government. I’m not even suggesting that we do that. It’s just that given the intentional speed at which this maniac is moving – and let’s be honest here – there’s not going to be much of the Constitution left to defend if something of common sense isn’t done. Personally, I love the suggestion from JeffM at 11:31 – that makes perfect sense. The question remains – WHY isn’t ANYONE confronting the obvious?

I asked Leo Donofrio to look it over and give me an opinion. He thinks I made my case well.
Please read it carefully, I cite rules that have NO EXCEPTION for VITAL Records. Other rules make exception for VITAL RECORDS, but not the TWO I cite.
Birth Date and Ethnicity are the only significant rights to privacy per my request. I could live without seeing those if they decide to withhold them.
Again, read it carefully. I think I have made a case to disclose in the public’s interest.

smrstruss I totally agree with you. For all of you who believe that the Constitution’s version of Natural Born Citizen was based on Vattel’s Law of Nation then explain smrstruss’s point. You can’t. Here is what Vattel said about religion.
Unless Barack Obama’s father was a head of state, or a diplomat, he is born under the jurisdiction of the United States. You guys are arguing that Vattel BullS_it. He said that natural born means to be born to both parents. He also said that each nation should have their own religion and force it’s citizen be part of it.
Vattel refuses to take Pufendorf’s Prussian tolerationist path of separating state and religion, which would be tantamount to separating state from nation and society. Instead, he opts for the Swiss solution to religious conflict, in which each nation (canton) must establish its own public religion, leaving dissenters with the option of emigrating to their own national religious territory (I.xii.129-31, pp. 157-59).
So if the framers of the Constitution was listening to Vattel on Natural Born Citizen then why does the very First Amendment of the Constitution reads “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” ?
