Obama and the DNC have responded to Philip J Berg’s emergency motion in the Third Circuit Court of Appeals. Here is a report from Jeff Schreiber:
“1. Obama and the DNC have filed a response to the Emergency Motion filed by Philip Berg in the Third Circuit Court of Appeals, saying that Berg’s Emergency Motion should be denied (1) because the motion is “effectively a new original case,” (2) because Berg “failed to comply with Rule 8(a) … requiring that he move first in the district court for any order granting an injunction while and appeal is pending,” and (3) because “there is no possibility that Berg will prevail on the merits,” citing Berg’s “patently false” claims and lack of standing.
2. It looks as though the FEC will be responding for the Respondents in the United States Supreme Court.
3. An Ohio case, filed by Mr. David Neal, was dismissed by Warren County Magistrate Andrew Hasselbach. Another news article HERE. I’ve been in contact with Mr. Neal, and will address this in more detail later.”

Ohio Secretary of State Jennifer Brunner won’t have to prove Barack Obama’s citizenship or throw him off the ballot.
A Warren County magistrate didn’t buy David M. Neal’s argument that Brunner had a duty to verify whether Obama qualified to be president. Neal relied too much on what he read on the Web, Magistrate Andrew Hasselbach said.
“The onus is upon one who challenges such public officer to demonstrate an abuse of discretion by admissible evidence – not hearsay, conclusory allegations or pure speculation,” Hasselbach wrote in his decision issued shortly before noon today.
“It is abundantly clear that the allegations in Plaintiff’s complaint concerning ‘questions’ about Senator Obama’s status as a ‘natural born citizen’ are derived from Internet sources, the accuracy of which has not been demonstrated to either Defendant Brunner or this magistrate.”
Neal, of Turtlecreek Township, filed suit last week seeking to force Brunner to demand documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and possibly Obama himself to verify that the candidate was born in Hawaii. Neal asserted that the short-form birth certificate posted on Obama’s Web site was not an original document.
The U.S. Constitution requires presidents to be natural-born citizens who are at least 35 years old.
Yet this controversy has lingered even though various fact-checking groups and journalists have concluded that Obama’s Hawaiian birth certificate appears to be authentic.
“When I enrolled my son in Knothole, I had to show his birth certificate … This guy is running for president of the United States,” said Neal, who runs a political Web site and claims to be part of a nationwide grass-roots movement questioning Obama’s qualifications.
Brunner’s legal team, two assistants from the Ohio Attorney General’s Office, said little at the hearing. Their arguments to have the lawsuit thrown out of court were filed just before the hearing.
Brunner’s legal team had argued against Neal’s request for several reasons, including the lateness of the filing. They noted that Ohio is a dead-heat state where turnout could run as high as 6.5 million voters.
“One can conservatively estimate that more than 3 million Ohioans intend to vote for Senator Obama. Mr. Neal asks this Court to disenfranchise those 3 million voters based solely on rumor and innuendo,” Mike Schuler, an assistant attorney general wrote.
Hundreds of thousands of voters who already have cast absentee ballots for Obama would also have been affected.

Now pay attention to the quote:

If Mr. Neal is asking that Ms. Brunner simply verify if Obama is eligible to be POTUS by requesting Obama’s long-form birth certificate and he does, how would that disenfranchise 3 million voters?
If by disenfranchise, Brunner’s lawyer means that intended votes would not be counted and the only way intended votes would not be counted is if Obama is not constitutionally qualified, then the Lawyer (himself) is contending that Obama is not qualified.

If some judge in some court don’t stand up for the US constitutional then ALL judges, Congressment, Senators, elected officials, both state and federal, that take an oath to DEFEND and PROTECT the constitution will be guild to derilecton of duty at the least and/or treason at the worse.
To willfully know that Obama does not meet the requirements as outlined in our Constitution and ignore that fact is unbelievable!
If he is elected on November 4 and a Constitution crisis is presented to the courts across America, who do we blame?

This is sad news, but predictable.
I foresee that the other actions will also fail unless the plaintiffs are able to show conclusive proof that Obama is not a natural born citizen.
I agree that Obama has not yet proved that the is a natural born citizen, unfortunately if we are to prevail in a court of law it is simply not enough to demand proof – we need to prevent concrete evidence of Obama’s malfeasance.

Happy Halloween, everyone. Be patient, if you can, and I’ll be back with some more information, and will try my best to find out about those Sarah Obama tapes. Berg needs to fish or cut bait on those.
By the way — yes, I mean SARAH Obama. The so-called Michelle Obama tapes were from African Press International and, in my opinion, were a hoax from the get-go. Sarah Obama is Barack Obama’s grandmother. Berg has a tape, in Swahili, of a conversation between Barack’s Kenyan grandmother and someone over there (name withheld because of apparent security concerns) on the night of the last election, during which Sarah says that, yes, her famous grandson was born in Kenya.
He told Michael Savage, about a week ago, that he would release the Sarah Obama tape “in the next day or two.” At the time, I think he intended to, but has not yet–as far as I know–received the affidavit from the Kenyan source. When I speak with him, I’ll ask him.

I know the link isn’t from Berg’s site. I’m just saying that it appears to be a harmless link. Also, what’s weird is when you go to the video site, there’s a WM icon in front of the address. If you google the address with the WM in front, the only thing that comes up is:

The law is an ass, but that’s the way it is my friends. We gotta come up with something stronger otherwise we are doomed to repeat our mistakes.
Suppose we filed in every state and they were all thrown out, obama would surely use that to his advantage: What could be a stronger endorsement to the mainstream media than having more than 50 cases thrown out?
My advice: End this now… get evidence… file when we are 100% sure that we can win.
