“Largest Batch to Date of Hillary Clinton Emails Released by State Department”

“The largest batch of Mrs. Clinton’s emails to date—some 7,000 pages—was released by the State Department Monday night, offering a glimpse into her small circle of advisers and gatekeepers at the State Department.

The department has now deemed about 125 emails in the latest release classified. The classified material appears in redacted form, occasionally in emails discussing internal operations and personnel.

State Department spokesman Mark Toner said that all the emails weren’t classified when sent but have since been retroactively made classified.”

“The latest set of emails is the fourth release of documents from Mrs. Clinton’s time in office from 2009 until 2013. Previously, the State Department released records pertaining to the 2012 terrorist attack in Benghazi, Libya, as well as thousands of pages of emails on a range of personal and professional topics.

The release of Mrs. Clinton’s records has been delayed by a controversy about the presence of classified information on her server—with multiple government agencies seemingly at odds about what should be considered classified.

Two inspectors general concluded that Mrs. Clinton’s inbox contained material that was classified when it was sent. The Clinton campaign and the State Department acknowledge that much of the material has been retroactively classified but contend that Mrs. Clinton didn’t send or receive anything with classification markings.

Many of the most sensitive and controversial of her emails are being reviewed as part of a multiagency process. State Department officials have noted that such referrals and consultations with other agencies don’t mean the emails ultimately will be deemed classified.

More than 60 emails containing redacted classified information have been released so far—with additional examples of classification expected in the future.

Separately, another 305 emails have been flagged for further review by the five intelligence agencies clearing Mrs. Clinton’s emails for public release.”

“Former State Department security officials don’t buy Hillary Clinton’s latest alibi that she couldn’t tell that government e-mails — which she improperly, if not illegally, kept for several years on an unsecured home server — contained top-secret information because they lacked official markings and weren’t classified until later.

Such messages contain sensitive “keywords” distinguishing them from unclassified information, even if the material didn’t bear a classified heading as she claims.

The secretary would have known better, the department ­officials say, because she was trained to understand the difference when she was “read in” on procedures to ID and handle classified information by diplomatic-security officials in 2009.
Clinton also went through a so-called “read-off” when she left ­office in 2013. In that debriefing, security officials reminded her of her duty to return all classified documents, including ones in which the classification status is “uncertain,” which would have included the e-mails stored on her private server — which she only this month turned over to authorities. The read-off would have included her signing a nondisclosure agreement.

“Once she resigned as secretary, she needed to return classified documents and other government-owned documents, which in this case would have included the server,” veteran Diplomatic Security Service Special Agent Raymond Fournier said.”

““I did not receive any material marked or designated classified, which is the way you know whether something is [classified],” she said last week, revising an earlier claim that “there is no classified material.”

“That’s total BS,” said retired Army Col. Larry Mrozinski, who served almost four years as a ­senior military adviser and security manager in the State Department under both Clinton and Condoleezza Rice.

He says Clinton easily would have ID’d the material as classified based on “keywords and phrases” and the fact that the information came from foreign sources.

“TS/SCI is very serious and specific information that jumps out at you and screams ‘classified,’ ” Mrozinski said. “The sources [of the information] also drive and signal sensitivity.””

“For months, the U.S. State Department has stood behind its former boss Hillary Clinton as she has repeatedly said she did not send or receive classified information on her unsecured, private email account, a practice the government forbids.

While the department is now stamping a few dozen of the publicly released emails as “Classified,” it stresses this is not evidence of rule-breaking. Those stamps are new, it says, and do not mean the information was classified when Clinton, the Democratic frontrunner in the 2016 presidential election, first sent or received it.

But the details included in those “Classified” stamps — which include a string of dates, letters and numbers describing the nature of the classification — appear to undermine this account, a Reuters examination of the emails and the relevant regulations has found.

The new stamps indicate that some of Clinton’s emails from her time as the nation’s most senior diplomat are filled with a type of information the U.S. government and the department’s own regulations automatically deems classified from the get-go — regardless of whether it is already marked that way or not.

In the small fraction of emails made public so far, Reuters has found at least 30 email threads from 2009, representing scores of individual emails, that include what the State Department’s own “Classified” stamps now identify as so-called ‘foreign government information.’ The U.S. government defines this as any information, written or spoken, provided in confidence to U.S. officials by their foreign counterparts.

This sort of information, which the department says Clinton both sent and received in her emails, is the only kind that must be “presumed” classified, in part to protect national security and the integrity of diplomatic interactions, according to U.S. regulations examined by Reuters.

“It’s born classified,” said J. William Leonard, a former director of the U.S. government’s Information Security Oversight Office (ISOO). Leonard was director of ISOO, part of the White House’s National Archives and Records Administration, from 2002 until 2008, and worked for both the Bill Clinton and George W. Bush administrations.”

More damning evidence against Hillary Clinton to be found?

“A federal judge on Thursday said that Hillary Rodham Clinton did not comply with government policies in her exclusive use of a personal email account while she was secretary of state, challenging her longstanding position that she abided by the rules.

At a hearing for a Freedom of Information Act lawsuit against the State Department, the judge, Emmet G. Sullivan of Federal District Court for the District of Columbia, said that “we wouldn’t be here today if the employee had followed government policy.”

Judge Sullivan also opened the door for the F.B.I., which is investigating whether there was classified information on Mrs. Clinton’s account, to expand its inquiry to pursue emails that she may have deleted. The judge ordered the State Department to ask the F.B.I. to give it any emails recovered from Mrs. Clinton’s private server that were not already in the State Department’s possession or that may be related to the lawsuit.

The Justice Department, which oversees the F.B.I., has argued that Freedom of Information Act searches do not typically involve a government employee’s personal email account.

Mrs. Clinton has said she gave the State Department more than 30,000 emails related to her work in office. She deleted about the same number of emails that she said were personal. Her lawyer has said the server was then wiped clean. Mrs. Clinton has also said that she had no classified information on her account.

In a statement, a spokesman for Mrs. Clinton defended her use of the account. “Hillary Clinton’s use of a personal email account was consistent with the practice of other secretaries of state, and permissible under the department’s policy at the time,” said the spokesman, Brian Fallon.

When Mrs. Clinton became secretary in February 2009, the State Department’s general policy was “that normal day-to-day operations be conducted on an authorized” government computer. Nine months later, federal regulations were toughened to say that government agencies that allow employees to use nongovernment email accounts must “ensure that federal records sent or received on such systems are preserved in the appropriate agency record-keeping system.””

“Unsecured Hillary Emails, Hackers Worry Senate Homeland Security Chairman”

“Federal officials and Hillary Clinton’s lawyers may not be the only ones with copies of the former secretary of state’s official emails, according to Senate Committee on Homeland Security and Governmental Affairs Chairman Ron Johnson.

Johnson, a Wisconsin Republican, told FBI Director James Comey in an August 17 letter that he is “deeply concerned by recent reports that classified information in Secretary Clinton’s email may exist outside of the federal government’s possession.”

The homeland committee chairman wants Comey to explain “whether additional unsecured copies of classified information currently exists.”

Johnson also said he is worried that hackers, foreign governments or other unauthorized persons may have hacked Clinton’s emails. He asked Comey for answers by August 31.

“The very nature of this kind of material is that it’s transferable,” a congressional source familiar with the Senate investigation told the Daily Caller News Foundation Tuesday.

“There are a lot questions out there about whether additional copies or even hard copies were made elsewhere,” the source said.

The DCNF reported Tuesday that the State Department has yet to provide the House Select Committee on Benghazi information on the chain of custody of Clinton’s email even though that material was first requested months ago.

The chain of custody is essential to determining whether Clinton, any of her government or campaign aides or other State Department officials violated federal law concerning the handling of classified documents in connection with her use of a email private server at her New York residence. between 2009 and 2013.

Clinton surrendered the server to the FBI on August 11, as well as three thumbnail flash drivers possessed by her attorney, David Kendall, who held them in a secure room at his law office of Williams & Connolly in Washington, D.C.

During the same time, another “backup server” was picked up by the FBI from a “third party” IT company in New Jersey that was under contract to Platte River Networks, a small Colorado IT company that signed a contract to upgrade and maintain her personal server system in 2013. The DCNF reported Friday that Platte River is not certified by the Department of Defense to handle classified material.”
