DISTRICT COURT ISSUES OPINION IN HASSAN v. FEC

WASHINGTON – The United States District Court for the District of Columbia on Friday issued its Memorandum Opinion and Order in Hassan v. FEC (Case 1:11-cv-02189-EGS). The text of the Memorandum Opinion may be found here (http://www.fec.gov/law/litigation/hassan_dc_memo_opinion.pdf) and the text of the Order may be found here (http://www.fec.gov/law/litigation/hassan_dc_order2.pdf).

The Federal Election Commission (FEC) is an independent regulatory agency that administers and enforces federal campaign finance laws. The FEC has jurisdiction over the financing of campaigns for the U.S. House of Representatives, the U.S. Senate, the Presidency and the Vice Presidency. Established in 1975, the FEC is composed of six Commissioners who are nominated by the President and confirmed by the U.S. Senate.

Exerpts:
“Hassan’s challenge to the Fund Act rests on his contention
that the natural born citizen requirement has been implicitly
repealed by the Fifth and Fourteenth Amendments. The Court need
not repeat the thorough and persuasive opinions issued by its
colleagues in at least five other jurisdictions, all of whom
determined that the natural born citizen requirement has not
been implicitly repealed by the Fifth and Fourteenth Amendments.”

“Moreover, the Supreme Court has consistently held that the distinction between natural born citizens and naturalized citizens in the context of
Presidential eligibility remains valid.”

“Because the natural born citizen requirement has not been explicitly or implicitly repealed, Hassan’s challenge to that provision, and the Fund Act’s incorporation thereof, must fail.””

“The district court correctly determined that appellant
lacks standing to challenge the constitutionality of the Presidential Election Campaign Fund Act, 26 U.S.C. §§ 9001 et seq., (“Fund Act”), to the extent it renders naturalized citizens ineligible for campaign funding.”

  2. citizenwells

“Appellant cites no authority to support his contention that a constitutional provision can
be implicitly repealed, nor has he shown the natural-born citizen requirement is in
irreconcilable conflict with the Fifth and Fourteenth Amendments, or that those
amendments “cover[ ] the whole subject” of the requirement and are “clearly intended
    as a substitute.” Branch v. Smith, 538 U.S. 254, 273 (2003).”

    Hi GORDO,

    Thanks for posting that….I think.

It’s scary that these people actually vote, and scarier that people like the last woman (‘I voted for him because he’s black) came out in record numbers.

I don’t think that ‘Low Information Voters’ (‘LOFOs) quite describes this.

“If democracy requires an informed citizenry to function well, the United States is in serious trouble. Many Americans are political ignoramuses.”

  6. Some perspective from an email:

    The Afghan Quarterback

The coach had put together the perfect team for the Chicago Bears. The only thing that was missing was a good quarterback. He had scouted all the colleges and even the Canadian and European Leagues, but he couldn’t find a ringer who could ensure a Super Bowl win.

Then one night while watching CNN he saw a war-zone scene in Afghanistan . In one corner of the background, he spotted a young Afghan Muslim soldier with a truly incredible arm. He threw a hand- grenade straight into a 15th story window 100 yards away.

    KABOOM!

He threw another hand-grenade 75 yards away, right into a chimney.

    KA-BLOOEY!

Then he threw another at a passing car going 90 mph.

    BULLS-EYE!

“I’ve got to get this guy!” Coach said to himself. “He has the perfect arm!”

So, he brings him to the States and teaches him the great game of football. And the Bears go on to win the Super Bowl.

The young Afghan is hailed as the great hero of football, and when the coach asks him what he wants, all the young man wants is to call his mother.

“Mom,” he says into the phone, “I just won the Super Bowl!”

“I don’t want to talk to you, the old Muslim woman says. “You are not my son!”

“I don’t think you understand, Mother,” the young man pleads. “I’ve won the greatest sporting event in the world. I’m here among thousands of my adoring fans.”

“No! Let me tell you!” his mother retorts. “At this very moment, there are gunshots all around us. The neighborhood is a pile of rubble. Your two brothers were beaten within an inch of their lives last week, and I have to keep your sister in the house so she doesn’t get raped!” The old lady pauses, and then tearfully says,

“I will never forgive you for making us move to Chicago !!!!

Outrageous… The far left Southern Poverty Law Center has once again put the “Singing Nuns” on its hate group map.
Here the Singing Nuns from Spokane sing “Ave Maria.”

    A typical hate group, huh?

  8. Hassan was making the wrong argument. It shouldn’t have been that the NBC requirement was repealed but that through the equal protection requirement, naturalized citizens should have ALL the same rights as al citizens by birth. Obama’s argument that he was an NBC via the 14th amendment would mean that naturalized citizens have the same right to be eligible for president. Naturalized citizens cannot be denied the same rights as birth citizens UNLESS there is a separate class of birth citizen defined outside of the 14th amendment. This could have forced the court to recognize (as was already recognized in Minor, Ark and Lurai) that 14th amendment birth citizenship is NOT the same as natural-born citizenship.

  9. OBSERVER…..

That’s a good one….KUDO’s to you and the quarterback !

  10. What i find funny about all of these people who incorrectly state NBC being the same as citizen at birth is that they say that if you are born in the US you are a natural born citizen (how two German citizens can create a US citizen NATURALLY is beyond me but i digress). AND if you are born in Canada with one US citizen parent you are also a NBC….Now my question is why wouldn’t the person be a NBC of Canada?
Got in this discussion with my father-in-law couple weeks ago. I try to tell him that if a person is a Citizen at birth due to a law or amendment then the person is NOT NBC. Boy did he get frustrated! As did i

Did he ever figure out what you were trying to tell him. That is one of the biggest impediments we face in our alleged society. In reality NOBODY even GIVES a damn anyway, and the absolute last thing they want to hear is the truth, right, wrong or indifferent. Gordo has it nailed big time it is largely the American people who are the REAL problem. Like your uncle, until he is ready to sit down and educate himself regarding the NBC requirement he will probably continue on his errant track.

  13. far far far left lib nut job

ok this guy was a naturalized citizen, so what is his connection to obama’s situation? connect the dots. Oh , it’s back to the birth certificate, that doesn’t exist? Is that it?

in other words what is the same about his situation to obama’s
    and
    what is different?

note that the obots will emphasize the differences.

i see you all talking it up, but no one is connecting the dots here
