“A federal appeals court Thursday dismissed one of the highest-profile challenges to President Obama’s healthcare reform law.
The 4th Circuit Court of Appeals said Virginia Attorney General Ken Cuccinelli (R) does not have a legal right to sue over the law’s requirement that most people buy insurance. The court vacated a lower court’s ruling in the case and instructed the lower court to dismiss the suit.
The Supreme Court is almost certain to have the final say on whether the coverage mandate is constitutional. Most legal observers expect the court to hear arguments during the term that begins in October and rule in the summer of 2012.
The 4th Circuit’s long-awaited decision isn’t a huge surprise: People who attended oral arguments in the suits said the judges seemed skeptical of the mandate’s critics, especially Cuccinelli. All three of the judges who heard the case were appointed by Democratic presidents, and two were appointed by Obama.
The mandate has a mixed record in federal appeals courts. The 6th Circuit upheld the requirement in a June decision. The 11th Circuit — which heard the high-profile challenge filed by 26 state attorneys general — ruled that the mandate is unconstitutional.
Unlike those 26 states, Cuccinelli sued on the grounds that enforcing the mandate would violate Virginia law. As Congress moved closer to passing healthcare reform, Virginia enacted a law that says state residents can’t be forced to purchase insurance.
But the 4th Circuit panel said Virginia does not have standing to sue over the mandate because it lacks a “personal stake” in the issue.
The judges seemed concerned during oral arguments that allowing his suit to proceed would essentially allow the states to exempt themselves from whatever federal laws they might choose.”
That decision against Cuccinelli was easy to see coming. The judges are on Soetoro’s payroll. Until he is no longer their boss it will be the same thing no matter who sues. The entire Federal Court system is in Soetoro’s hip pocket,and it is high time people looked around and realised this. This will CONTINUE until Soetoro is either removed from office,or beaten at the ballot box.

Mr. Perry showed that he not only has a strong argument in touting Texas’ job-creation record, but that he can frame the argument powerfully. In a battle of job statistics with former governors Mitt Romney of Massachusetts and Jon Huntsman of Utah, Mr. Perry seemed to get both the upper hand and the last word.

The entire DOJ is in need of a THOROUGH house cleaning. It should start with Eric Holder,and extend clear to and include the SCOTUS. Everybody thinks that permanent means forever. If a citizenry becomes IRATE enough then they are very likely to tell anybody who tries to intervene to GO STRAIGHT TO HELL. If MMMMMSSSSS.Important of the BLACK CAUCAS can use these terms,then it is ok for the Citizenry to tell the DOJ to cram their LAWS UP THEIR A$$. Such a scenario could indeed occur. Nothing on earth is permament,including the SCOTUS. If push comes to shove at the level of the SCOTUS all bets on the outcome are OFF. If the so called JUSTICES have a large enough footprint on their backsides they are not likely to return for another ,even bigger footprint,and perhaps even a little vacation in prison for treason. If even one justice becomes a weak link the entire raft of manure will sink,and Soetoro will soon be out the right behind the judges. It has to start at the DOJ. They are the common thread.

Rick Perry, who’s currently getting bracketed by Mitt Romney on the topic of immigration and asked about it on the trail in New Hampshire today, apparently chatted by phone this afternoon with nationally-known Arizona immigration hard-liner Sheriff Joe Arpaio.

After reviewing the debates again, IMHO Rick Perry won and both Romney and Huntsman scored some points. It will be interesting to see what happens with Romney and Huntsman’s poll numbers since they are vying for the same moderate voters. Gingrich was very good but I don’t think he can win. The rest of the also-rans either treaded water or sunk even lower in the single digits than they already are.

I personally am beginning to think that out of all of the (alleged) candidates there seems at this point to be clear leaders emerging. At this point I place Perry at the lead,with Romney close behind. But there are some faces moving up through the pack. One of them is Gingrich. He hit a couple of homeruns last night. Bachmann just doesn’t seem to emit the same level of body language as the others. Although I do NOT allow a diminished body language to get in front of good reasoning. That is why NONE of them have yet made it to the “DEAN’S” list. Perry ALMOST stumbled,and at one point could only say a couple of words…..think…….say a couple of words…think again…… He was obviously stressed which suggests he is unsure.

I disagree, I think his answer was very strong that the scientists disagree on the cause so much so that we shouldn’t put huge costs yet on our economy to fight global warming, but they have taken measures in Texas to reduce pollution and improve clean air overall. Asking Perry to name scientists is just a stupid gotcha question that I think he dealt with very well.
I also loved Romney’s answer that Obama is a nice guy, but doesn’t have a clue on the economy, and I thought Newt always does well with every answer he gives, but his wanting to fire the Fed Chairman tomorrow will be a classic.

FYI …….There is a very strong possibility of a war within the Teamsters Union itself. I know several independent truckers who are members of the Teamsters Union,……….but they have wives and family members who are active in the TEA PARTY. Hi Old Salt and Tina….I agree with both your comments. I like Perry’s strength of convictions, not backing down. I do agree he needs to improve on body language….I hate how he raises up on his toes and bounces. Never noticed that before, but have seen it several times lately.
Also, I have always admired Newt’s historical knowledge of this great country and how he expresses himself. He always manages to say provocative things and usually hits a homerun when he speaks. I did come to the conclusion after last night’s debate, that he has seen the writing on the wall. He appeared to take the side of a team player rather than the all-star. He stood up for all on the podium, and spoke in terms of defending the conservative movement rather than his own personal campaign. I have always considered him a great statesman and a wonderful representative for this country. Seeing his polling numbers in the lower tiers, I would believe he is hoping now for a post in the 2012 administration. Secretary of State would suit him fine. Romney stood his ground, would make a good president as well as any (other than Paul)
