APPELLANTS, members of the American Independent Party, bring this
appeal from the District Court’s October 29, 2010, ruling granting the defendants’
Motion to Dismiss (ER 1). APPELLANTS seek a determination by the Court as to
whether Respondent Barack Obama (hereinafter referred to as “OBAMA”) met all
the constitutional requirements for eligibility for the office of the President of the
United States.”

A. The Parties
APPELLANTS are members of the American Independent Party. Drake was
the Vice-Presidential nominee for the American Independent Party in the 2008
Presidential Election on the California Ballot. Robinson was a pledged Presidential
Elector for the American Independent Party in the 2008 Presidential Election for
the California ballot and was at the time the Chairman of the American
Independent Party.
OBAMA is a former United States Senator from Illinois and currently sits as
President of the United States. Respondent Michelle Obama is the wife of Mr.
Obama. Respondent Joseph R. Biden currently sits as Vice-President of the United
States and as President of the United States Senate. Respondent Robert M. Gates is
the Secretary of Defense for the United States. Respondent Hillary R. Clinton is
the Secretary of State for the United States.”

When you watched the video did you notice the appreoximate age of the female? She fits the profile of the young college grad who is just getting started in the REAL world. Having once been involved in the atmospheric H tests at Eniwetok in 1954, I believe that I can talk intelligently with respect to ionising radiation from a nuclear detonation. First of all with respect to closing an oil well with a nuclear device probably would be a viable consideration. However it would seem to me that this would only be thought about as a LAST option. There are some aspects of using any form of explosives that is outright HYPER DANGEROUS.. The level of methane that SEEMS to be present could become a bomb of a magnitude that NO MAN has ever built to date. While this is only speculation it remains completely possible. If the entire methane deposit were to explode the consequences would be a disaster of unimagineable proportions. I watched 7 megaton,and 15 megaton devices detonated from approx.40 miles distance over water. The first 15 megaton device was an ACCIDENTAL yeild of OVER TWICE THE PLANNED YEILD. The detonation was the INFAMOUS BRAVO test. Many of us inadvertently inhaled CESIUM 137 dust fallout and were not even aware of it. Because the accidental high yeild the ships were NOT at a SAFE distance .Particularly those that were DOWN WIND TO BEGIN WITH. Some were heavily coated by fallout. The CVE 115 finally had it’s crew removed, was put in cold iron status, and towed back to Bremerton. It took total sandblasting of the entire ship to bring the level of radiation down to a level that was safe for humans to be around. The BRAVO test contaminated over 7000 sq. miles of the Eniwetok test area,in the Marshall Islands. Many native tribes on adjacent islands had to be replanted on islands much further out. The US government is still paying the tab for the mistake.
If a nuclear device was to be used I really don’t think that it would needs to be of THERMO nuclear design,nor would it really have to be out of the KILOTON size. Kiloton is a hell of a lot safer than MEGATON. If it was correctly placed and a safe distance under the sea floor, I personally think that using a nuclear device would be a viable option. There would be little chance of any radiation ever reaching the atmosphere. As I stated earlier the only chance of radiation entering the atmosphere would be as a result of a catastrophic explosion of methane. I think that even the use of conventional explosives poses a SUBSTANTIAL risk. If something goes wrong it could easily turn into something that could kill a hell of a lot of people. INSTANTLY!. Fortunately making that assessment is above my pay grade.

The video tells a story, but I am not sure that it is the story that you want to hear. There are literally a thousand reasons why fish kills occur. Sometimes it is the result of mankind’s ignorance,and sometimes it is the result of either a gelogical, or biological change in natural ambients of the sea. At the outset of WW2 there was a very substantial number of fully loaded ships that were sunk by Nazi U BOAT action just off our shores. These ships were carrying EVERYTHING, and ANYTHING. including POISONS, and extremely dangerous chemicals,and elements. I believe personally that over a period well into the next century we will see GIGANTIC die offs of our marine life in general,which will be easily traceable to the leaking sunken wrecks. From what NOAA indicated to congressional staffers, we’re not going to know for a while what the final report actually looks like or how accurate that first one even was. So is the government operating under the assumption that “most” of the oil is gone? And what does that mean for how they’re handling the response–everything from cleaning up the oil itself to evaluating the safety of seafood?
Perhaps even more concerning, did members of the Obama administration, in their effort to declare “mission accomplished” and finally get some good news out of the Gulf, create more problems than they solved? I mean, they got their New York Times headline, so at least we can say their PR mission was accomplished. But the rush to put out a report they still can’t substantiate should raise red flags galore.

In addition to efforts to convince us that the oil is all gone in the Gulf (it’s not), the government has been promoting the idea that seafood from the region is totally safe. Obama himself has been banging this drum, noshing on plenty of seafood during his trip to the region last week, serving it up at his birthday bash, and of course, taking a dip in the Gulf with his daughter.
But how safe is it really? A study published this week in the Journal of the American Medical Association suggests that there may be good reason to be concerned about the long-term impacts, even if the seafood is safe for most people to eat right now. The biggest issue, the authors write, is with shrimp, oysters, crabs and other invertebrates that have a harder time clearing out polycyclic aromatic hydrocarbons (PAHs), which are carcenogenic chemical compounds found in oil and other fossil fuels, from their systems. “Although vertebrate marine life can clear PAHs from their system, these chemicals accumulate for years in invertebrates,” they write.
There are also longer-term worries for larger fish like tuna, swordfish and mackerel, which over time may accumulate dangerous levels of heavy metals found in crude oil, like cadmium, mercury, and lead, “potentially increasing future health hazards from consumption,” the report concludes. It was authored by Gina Solomon, a senior scientist with the Natural Resources Defense Council and a medical doctor who teaches in the Department of Medicine at University of California-San Francisco, and Sarah Janssen, also an MD and public health expert with NRDC.

What’s So Special About Barry?
Here is a good discussion and debate topic. It might elicit a variety of opinions, but I don’t think anyone will dig in and become an annoyance. That is because I really don’t think anybody knows. Yet it may be very enlightening and invigorating to discuss.
1. Suppose Barry were “chosen” when he was very young? Why? Why him? Out of millions of other potential “sleeper agents”, why this particular little kid? To me, the only possible answer is that he had special parent(s). Yet the advertised parents are no way special. If anything, they are less than special. This scenario would almost require that at least one of his parents was somebody other than the official narrative.
2. Suppose Barry were “discovered” when he was a teen? Already he had demonstrated a troubled and confused youth. Already he had starting developing an attitude. Why would “they” pick him when they could have picked somebody with a better background and attitude? And if he was special in some way, how come nobody but “them” noticed?
3. Suppose Barry were “selected” when he was in college? Again, why? What caught their eye? What confluence of special or unusual circumstances identified him as The One?
4. Suppose they decided to jump on his horse after he was already in politics? What an awful lot of baggage he had by then! He had criminal background. He had suspicious birth and ancestry circumstances. All of these things would have to be undone or worked around for him to succeed. Who thought he was so special that even with these impairments he was selected? And why?
None of this makes any sense. Nobody has put forward an explanation that passes the sanity test. Why him? Why now? Who is “they”. What is their purpose? Their agenda? Their goal?
Obama’s close friend advises that the best way for young people to get ahead in Obama’s America is to leave the country, learn a foreign language, adopt a foreign culture, and study Islam. Is there a more perfect portrait of this administration?

Fish and other wildlife are fleeing the oil out in the Gulf and clustering in cleaner waters along the coast. But that is not the hopeful sign it might appear to be, researchers say.
The animals’ presence close to shore means their usual habitat is badly polluted, and the crowding could result in mass die-offs as fish run out of oxygen. Also, the animals could easily get devoured by predators.
“A parallel would be: Why are the wildlife running to the edge of a forest on fire? There will be a lot of fish, sharks, turtles trying to get out of this water they detect is not suitable,” said Larry Crowder, a Duke University marine biologist.

… The erratic decision making, lack of consistent direction, and unclear chain of command has confused the media and the public, and caused this story to drag on far longer than it should have. I believed then, and continue to believe, that if they had simply kept the first relief well working, this story would have been over a month ago. But it’s not. The relief well, again, the only solution to killing the blowout well, has been delayed for the capping stack procedure, then the “well integrity test”, the “static kill” and cement job, the “near ambient test, the “ambient test”, now the fishing job to get drill pipe extracted before actually trying to change out the BOP, which I believe is unwise.
Much of what has gone on this last month has been confusing to every industry insider I’ve talked to. Delaying the relief well, especially with John Wright, the best relief well driller on the planet, in charge, is unconscionable. Had Wright been left alone, this would have been over weeks ago, in my view. And safely. With the revelation of the US government’s active management of this crisis, much of my confusion is now cleared up. The reasons for all the course changing, halting press briefings, the completely opaque and lukewarm “technical briefings” are now explained. It looks like BP has been happy to take the backseat to the government. The reasons are simple; BP was off the hook from the moment the government actually took over, and would be more than happy to point the finger at the government if the whole thing blew up

The only way to assure this well is dead is the relief well. Since the BP/US government team has now blinded themselves from being able to see what’s going on with all this business from the top of the well, it is now most assuredly so. Now their attempt to fish the drill pipe, which is likely held in place by collapsed casing, the casing hanger, or the BOP (maybe all three), is ill advised and risky. Likewise, pulling the BOP stack right now is risky. Their concern for components on the stack is about 5 weeks too late after already putting far more pressure on it than for which it was designed, something I don’t believe BP made clear to Chu’s team when they decided to shut it in. The static kill/cement job made killing this well harder, putting into question the weaknesses of the very BOP stack components we pointed to over a month ago.

On Thursday, Dr. Ian MacDonald and and Dr. Lisa Suatoni testified to a Congressional subcommittee that the oil will stay toxic, and will not degrade much further, for decades. MacDonald is an expert in deep-ocean extreme communities including natural hydrocarbon seeps, gas hydrates, and mud volcano systems, a former long-time NOAA scientist, and a professor of Biological Oceanography at Florida State University. Suatoni has a PhD in Ecology and Evolutionary Biology from Yale, and is Senior Scientist at the Natural Resources Defense Council’s Oceans Program.
Dr. MacDonald told Congress that the oil has already degraded, emulsified and evaporated about as much as its going to, and it is going to very resistant for further biodegradation. The oil will be in the environment for a long-time, he said, and the imprint of the BP discharge will be detectable “for the rest of my life” (he’s 58, and the average lifespan for American men is about 76; so that’s some 18 years).
Dr. Suatoni told Congress that oil which goes into low-oxygen zones will remain in a full toxic form for decades. (VIDEO).

As National Georgraphic noted Thursday:
The oil plume’s stability is “a little unexpected,” study leader Richard Camilli, of WHOI’s Applied Ocean Physics and Engineering Department, said at a Thursday press briefing in Washington, D.C.
“We don’t have any clear indication as to why it set up at that depth.”
It’s unclear why the Gulf’s microbes aren’t eating the oil plume, but the organisms are infamous for being unpredictable, said study co-author Christopher Reddy, a marine chemist at WHOI.

If “they” were interested in grooming and pushing a candidate, Barry was very unlikely. What was so special about him? Why not pick someone without all the baggage? BTW – I watched Fox News Sunday this morning. They agonized over Obama quite a lot. They talked about the Muslim thing and other failures to execute. It is clear they do not like him and think his policies are a disaster.
But, oddly, they continue to defend the MAN. They treat him as just another President who some like and some don’t. They don’t seem to grasp the fact that this one is different.
Even weirder, they could just let it lie there and not make a comment. But they go out of their way (more than would be required, for any reason I can think of) to defend the MAN. They also continue to imply it is only the extreme right who are suspicious of the MAN. And that the “mainstream” either marginally agree with him or marginally disagree with him, but no well-meaning righteous person has a problem with the MAN.
Given all his ties to corruption, Islamophilia, proven socialism, etc., it is remarkable that they refuse to address these issues. And they never mentioned Racism and did not even remotely imply anything was about that. They just want to gratuitously insist that he is a Regular Guy.

Citizen Carlyle, when you first raised the issue earlier today, various thoughts entered my noggin, and then Old Salt weighed in. There is one factor that was important, IMHO, and that was the race card. Another thing, multitudes were cast under that charismatic “presence”. And remember all of the hype about what a wonderful orator he is? The so-called charisma and oration turned many of us “off” right from the get-go,
but the audiences were enamored! Do you remember how they could just not get enough of him, while the rest of us were “gagging”?

He is a good teleprompter reader. That is not a skill you just pick up. Somebody trained him, and drilled him hard. 1. The Dunham’s were swingers, explaining her accidental pregnancy at her older age.
2. Madelyn had a passport at the alleged time of BHO’s birth.
3. She had reason to hide her pregnancy and go to Mombasa to birth BHO and possibly leave him with Barack, Sr. When Barack, Sr. didn’t take BHO, Jr, Madelyn brought him back to Hawaii, registered his birth and quickly passed him along to her daughter who was conveniently leaving for school in Seattle. Stanley Ann Dunham had not been issued a passport at the alleged time of BHO’s birth in Mombasa and could not have traveled outside the country. Maybe Madelyn even used her daughter’s name at the hospital in Mombasa to cover her tracks.
4. A farce of a marriage tied the two together (Stanley Ann and Barack, Sr.) and made the whole story plausible, but there was never any expectation on either side for a real marriage and they never lived at the same address.
5. Stanley Ann raises BHO, Jr as her son until he becomes a nuisance and bother to her. This occurs at some point during her marriage to the Indonesian. The adoption of BHO was an attempt to make it work. When it didn’t work, little Barry gets sent back to his real mom, Madelyn, for good!
6. This is BHO’s big secret and it looks like Madelyn took it to her grave.
I bet there are family members still alive that know about this secret. Time for a real reporter to start doing a little digging and asking the right questions.

Some of the events you list are plausible, but there is one big problem with the theory that Madelyn Dunham is Obama’s mother. Have you ever observed the facial features of Obama as compared with Stanley Ann Dunham and also her father (Obama’s grandfather)? The three of them have the exact shape of face, including length and size of chin. Therefore, some have felt that the grandfather might actually be Obama’s real father, simply because of the strong resemblance between the two. However, Ann also bears the same characteristics (inherited from her father). To me, that rules out Madelyn completely, because she does not have anything similar to pass onto a child of hers who would have a different unknown father.

I have often asked,and still ask”How can anyone attend 4 years at Harvard and not be aware that there are only 50 states”? Soetoro clearly made a major and perhaps THE major slip that will ultimately be instrumental in doing him in when he said”I have been in 57 states.” Anyone who had lived in the US or gone to school in this country would also have known from the first grade on there are only 50 states. This gives rise to a justified suspicion that Soetoro isn’t even a citizen of the US. For the DNC to have even CONSIDERED him as a candidate suggests that a state of absolute panic must have existed within the DNC..in regard to getting a candidate on the ballot. Because the DNC was in such a state of disarray they turned a blind eye to a large percentage of the qualifications necessary. When the little switcheroo was pulled on Hillarya lot of suspicion was raised regarding Soetoro. People began to DIG for info. This is when the very first suspicions were confirmed ,and believe it or not by SNOPES. They even initially suggested the Kenya connection. It is clear that somebody at SNOPES was DOING THEIR HOMEWORK. That connection would probably not been unearthed had they not done the necessary research. As far as I can determine SNOPES WAS the first to talk about the Kenya connection. I done my own research on the question, and inquired at several newspapers who were supporting McCain. They were willing to expend energy to ascertain facts. Most already knew about the Kenya connection from 1994 research. Maybe SNOPES got the info from the newspapers as well. Apparently there was substantial suspicion about his qualifications to even hold the office of Senator. As it has finally been determined he lied about a number of things even then. Or rather,the DNC LIED FOR HIM. I am quite doubtful that he knew enough about politics to be able to lie successfully. That is why I believe that the DNC done most ,if not ALL of the lying. He doesn’t know the English language well enough to successfully lie off the top of his head. Everything he says publically is read from a teleprompter. He does not know how to be spontaneous, like people who have lived in the US for all of their lives. Given the length of time that he was allegedly in the US school system he too would have known a lot more……..even only 50 states existed. Taken as a whole there is a great deal of knowledge to be gained about Soetoro. You only need to examine the things that he DOESN’t know that he should,and would if he was FOR REAL.

You make a good point about the autobiography (in fact, two books at a young age) and, yes, it had to be written for him. Don’t some feel that it was Bill Ayers? And I agree that there was some type of conspiracy in the normal sense of the word. (Not the type we see overly flaunted so much these days).

I think Crystal was trying to make the case that Obama’s grandmother was actually his mother , in which case the grandmother, Madelyn, would have had to have gotten tangled up with a black to produce Obama. For the reasons I gave earlier that seems remote because of the great similarity in facial features (Ann Dunham, Stanley Dunham and Obama).
There was an interesting article written awhile back that suggested that Stanley, Ann’s father, is actually Obama’s real father. One of the reasons given was the strong resemblance between Obama and Stanley. Of course, that would have required Stanley to have gotten mixed up with a black, which some have suggested as a possibility, considering his lifestyle.
Oh, what an absolute mess! You’ve got to admit that this kind of background would be enough to run any normal mind into insanity.

While I completely respect your notion regarding Stanley ann’s mother, I have to say that I believe that Stanley Ann did have a passport. If she didn’t she xcould easily have used her mother’s passport, and got away with it. Women can easily make themselves look much older than they actually are. If somebody waited until the last minute to show the passport,an already overburdened agent couls easily have waved her through. She would have been by herself, and protruding eponentially. in her pregnancy. It would seem that if somebody would not let her fly FROM Mombassa, why the hell did they allow her to fly TOO Mombassa to begin with.

I have diabetic neuropathy in my feet and sometimes it gets all stirred up. You feel as though your feet are freezing, and at the same time have about 110 volts passing thru your feet at. That is hard to imagine, but I can guarantee you that when you have it you know it. I try new medications from time to time, but I know that there is no cure,and eventually you lose the foot,and sometimes the lower leg with it. I don’t let this possibility ruffle my feathers, after all I made it to 79. That in itself in my family is a big accomplishment. Sometimes it takes a little while to settle back down,and I end up burning the midnight oil as such.

One of my animals jumped on my desk, and somehow the little animal was playing & knocked the laptop off the desk and the laptop hit the floor hard….Oh dear, now the laptop I am using actually posts things before I even click send and submit!! OldSalt — I’m so sorry to hear about your problems with neuropathy. I understand how tough it is to deal with. My mother is also diabetic, and has had great results with nutritional supplements. Specifically, the B vitamins and ALA (alpha-lipoic acid) can be very effective with peripheral neuropathy. Both cod liver oil and olive oil contain high amounts of ALA. She also takes a multi-vitamin specifically formulated for diabetics called Nature’s Way Completia® Diabetic Multivitamin that has ALA in addition to the B vitamins. Her doctor has approved both the vitamins and the cod liver oil supplements. Maybe this would help you also. We get my mom’s sups from vitacost.com (best prices I’ve found, and they auto-ship too). OldSalt – Hi to You, I’m sorry to hear about your diabetes related nerve problems. I understand the small nerve fibers are impacted more than the large nerve fibers, but in addition to Mia’s suggestions about vitamins, I would also recommend getting a prescription from your M.D. for B12 injections. I would recommend 3,000 micrograms (equivalent to 3 milligrams) of cyanocobalamin or methylcobalamin to be injected with a 30 gage (one of the smallest thinnest needles) needle to your arm or butt. Maybe once per week would be good. If you don’t want to get that aggressive, then find a sublingual B12 supplement of around 1,000 micrograms and add that to Mia’s recommendations. Again, sorry and best to you.

Don’t remember where the information came from (one of Zero’s bio’s probably), but Zero said his mother would tell him he was going to be president. She was involved with the Ford Foundation and micro finance in Indonesia. Considering what the FF did at the time, and the people involved, I wouldn’t be surprised if she, at the very least, had contacts with people who could get her son into the right places, and used them. Her connections created connections for him. Not so much intentional at first, just a slow and steady building of connections until he hit the jackpot with people like Auchi, Brzezinski, Ayers, etc. I think it’s likely that sometime during his college years “someone” thought there might be “value” in using Zero to achieve a certain goal. And here we are today……….

“The latest news out of Afghanistan is the brutal murder of missionaries who were part of a Christian medical team. Among the many excuses for Islamic barbarism is that the West is at war with Islam. No, Islam is at war with civilization.
In early August, after having hiked for more than ten hours to bring medical aid to isolated Afghan villagers, a team composed of six Americans, two Afghans, one German and a Briton, doctors, nurses, and logistical personnel, were gunned down by Taliban in the remote Parun valley of Nuristan province about 160 miles north of Kabul.
Their crime, according to Zabiullah Mujahid, a Taliban spokesman, was that they were “spying for the Americans” and “preaching Christianity.” They were members of International Assistance Mission (IAM), one of the longest serving non-governmental organizations operating in Afghanistan.
The team leader was Tom Little, an optometrist from Delmar, New York. He and his family had been in Afghanistan for thirty years with a break during the Afghan-Soviet conflict. He and his wife had raised their three daughters there. AIM receives private donations.
None of this made any difference to the Taliban that killed him and the others. Elsewhere in Afghanistan that day, a child was murdered by Sunni bombers and a bomb hidden in a wheelbarrow left five others dead. In Pattani, Thailand, a Buddhist husband and wife were murdered by Muslim gunmen in their bicycle shop and their 4-year-old nephew was wounded. In Kirkuk, Iraq Muslims shot a woman to death and in Baghdad two civilians were blown to bits by bombers.
Islam is an equal opportunity “religion of peace.” It kills Muslims, Christians, Buddhists and anyone else in the name of Allah. All this killing is rooted in the Koran, justified by the view that unbelievers have no right to life unless they convert. Even then, the schism between Sunni and Shiite Muslims is sufficient reason to kill each other.
There are well over a billion Muslims in a world of some six billion people and, while most undoubtedly want peace, their religion requires that the world be divided between Dar al Islam and Dar al Harb, the world of Islam and the world of war.
It can be argued that Christianity has blood on its hands and, historically, that is true, but what is most true about Islam in the last century and this one is that it represents a war on civilization itself.
In a Europe that has seen an influx of Muslims, nations there are struggling with them wherever they have gained large enough numbers to demand submission to Sharia law and other imported customs inconsistent with modernity.
Americans paid little attention to Islam until 9/11 destroyed the Twin Towers and a portion of the Pentagon. Up to then, Islam seemed far away despite a series of embassy bombings and other events.
Now Americans struggle with an Islam that wants to build a mosque within steps of Ground Zero in New York City. This has come as a shock to many, but Islam has a long tradition of building mosques over the sacred ground of others.
The Al-Aqsa Mosque in Jerusalem was built over the site of the Jewish Temple on the Temple Mount, sacred to Jews. In Constantinople, now Istanbul, the Hagia Sophia Cathedral was converted to a mosque. Throughout India, an estimated 2,000 mosques were built on the sites of Hindu temples.
Wherever Islam gained a foothold and became the state religion—in Islam there is no separation between church and state—the backwardness, the oppression of women, the refusal to accept another religion unless its practitioners accept a second-class position in society, are all endemic to Islam.
Islam is mired in the seventh century mentality of its founder and charged with a hostility, not just to other faiths, but to modernity itself, to the advances of civilization that seeks to reduce tensions between nations and peoples.
We are not dealing with people devoid of contact with modern civilization. Al Qaeda recruits via the Internet. They show how they behead “infidels” and urge more attacks everywhere against them.
For those who leave Islam, the punishment prescribed in the Koran is death. For those who “insult” Islam, the punishment prescribed is death. And for those who bring free medical care to villagers is death.
The proposed New York mosque should be built only when a synagogue or church can be built anywhere in Saudi Arabia where Islam began and where the harshest form of Islam, Wahhabi, is practiced.
If Islam calls the world of unbelievers Dar al Harb, the world of war, why can’t the world understand that Islam is at war with it?

There was always Christ’s rule to fall back on and correct the behavior of these sinners. Sinners, outside and inside the Church.
