Reid and Senate Democrats announced they will file cloture today on the motion to proceed regarding ObamaCare. He will go to the floor for cloture on the motion to proceed to a House-passed tax bill, to begin the Senate debate on ObamaCare.
This vote will require 60 votes and will likely occur on Saturday.
Several Democrats have said they will not vote for the bill. Remember cloture is a three day process – file on day one, day two is an intervening day and the vote occurs on day three. Reid is using a House-passed tax bill as a “shell” allowing him to offer up the language he released tonight as a substitute amendment if he gets cloture on the motion to proceed.
Reid’s Senate version of ObamaCare calls for:

- Major reductions in Medicare befits to seniors.

Reid filed a motion to introduce the bill yesterday, Monday, Nov. 16. Anticipating a Republican objection, the bill would be pushed onto the Senate calendar.
BUT… Reid’s action last Tuesday sets up a critical vote this week on a motion to proceed to the bill. Such a motion would require 60 votes to succeed — and there’s a GOOD CHANCE that Reid does NOT have those 60 votes!
Reid needs a majority (51) to pass the motion to proceed so the Senate can begin debating and amending the bill. If Republicans filibuster this motion, he will need 60 votes to invoke cloture and shut off debate.
THIS IS IT — one of our BEST chances to kill this bill, before it even gets off the ground!”
“Remember, this bill is the worst of all possible bills. It’s chock full of every far-left special interest socialistic dream imaginable. Here’s some of what’s in its TWO THOUSAND PAGES:
- The CBO estimates that H.R. 3962, the health bill that the House passed, would cost $1.2 TRILLION over 10 years, including the cost to states for mandated Medicaid expansion ($34 billion), the “Doc Fix” ($245 billion), and authorized discretionary spending for grants, public programs, changes and funding for a variety of agencies that would be responsible for implementing H.R. 3962.
- The bill protects trial lawyers. The bill gives money (authorized at “such sums”) to states that enact “certificate of merit” (a document signed by a medical professional that says there is a probability that the standard of care was violated) and / or a certificate of “early offer” (an early, confidential apology) laws, as long as the states don’t limit attorneys’ fees or impose caps on damages.
- The current version will give billions of dollars of taxpayer healthcare benefits to ILLEGAL ALIENS in America. It would allow illegal aliens to use the new healthcare “exchange” and would not require verification to keep illegal aliens out of the other parts of the proposed federal healthcare system. Members of the Congressional Hispanic Caucus fought back against reports that leaders would add Senate language to block illegal immigrants from participating in the insurance exchange.
- It will create a nationwide federal government program, the “public option,” which will pay for abortion on demand — with federal funds, of course, because that is what federal agencies spend.
Liberals in the House AND the Senate ignored us when the majority said, “NO BAILOUT.” They ignored us when the majority said, “NO FAKE STIMULUS.” Now, they’re trying to ignore us when the majority demands with a clear voice, “NO GOVERNMENT TAKEOVER OF HEALTH CARE!””

Marines, corpsman to be removed in Iraqi death

SAN DIEGO — Three Marines and a Navy man convicted of aiding the kidnapping and murder of an Iraqi man have been ordered removed from the military, the Navy said Wednesday.
Navy Secretary Ray Mabus issued the ruling more than two years after the accusations were aired in a Camp Pendleton courtroom.
The men had been allowed to stay on active duty after serving short jail terms for charges linked to the death in the village of Hamdania.
“To allow these individuals to remain on active duty after planning and participating in kidnapping and murder sends absolutely the wrong message as to how the nation and Department of the Navy view this incident,” Mabus said in a statement.
“It degrades the actions of thousands of Marines and sailors who, under the stress of combat in Iraq, performed honorably,” he said.
Capt. Beci Brenton, a spokeswoman for Mabus, said he was unavailable for further comment.
The secretary found the killing was deliberately planned and not conceived in the heat of battle or the stress of war, Brenton said.
Mabus also ordered the Marines to explain why the lieutenant who oversaw the Camp Pendleton unit, 1st Lt. Nathan Phan, should be allowed to remain in the service. Phan was not charged in the case.
The secretary denied clemency for Pvt. Lawrence G. Hutchins III, who is serving an 11-year prison sentence for unpremeditated murder and other offenses.
Seven Marines and a Navy corpsman from the 3rd Battalion, 5th Marine Regiment were charged in June 2006 with kidnapping and murdering Hashim Ibrahim Awad, 52, two months earlier. They were accused of taking him from his home, marching him to a ditch and shooting him to death.
Hutchins, of Plymouth, Mass., was the only defendant convicted of murder and the only one currently in prison.
Navy corpsman Petty Officer 3rd Class Melson J. Bacos of Franklin, Wis., pleaded guilty to kidnapping, conspiracy to kidnap and making false official statements. Marine Lance Cpl. John J. Jodka III, of Encinitas, Calif., pleaded guilty to aggravated assault and conspiracy to obstruct justice.
Marine Lance Cpl. Tyler A. Jackson, of Tracy, Calif., pleaded guilty to aggravated assault and conspiracy to obstruct justice. Marine Lance Cpl. Jerry E. Shumate Jr., of Matlock, Wash., pleaded guilty to aggravated assault and conspiracy to obstruct justice.
All will get either an honorable or general discharge, Brenton said. They have no recourse to appeal.
Three other defendants left the military after their prison terms ended.
Mabus launched his review at the request of members of Congress, including Rep. Bill Delahunt, D-Mass., who were seeking clemency for Hutchins.
Attorneys for two of the four men ordered removed from the military said the decision amounted to second-guessing officials who considered the case.
“The political process should play no part in the court-martial system,” said Joseph Casas, who represents Jodka. “The fact that it did weakens the confidence in our military justice system.”
Jeremiah Sullivan, who represents Bacos, said his client was promoted to petty officer 3rd class after pleading guilty and was recently awarded a Good Conduct Medal.
“The secretary of the Navy can legally make this decision, but it’s the wrong moral decision,” Sullivan said. “I’m seething about this.”
Richard Brannon, an attorney for Hutchins, said he will continue to ask members of Congress to pursue clemency. “I haven’t given up,” he said.

As long as BO is POTUS, he has the power to veto any legislation. So, even if conservatives take back Congress, they would need a 2/3 majority vote in both houses of Congress (House and Senate) to overcome a presidential veto. The taxes in the legislation will go into effect almost immediately after the bill is signed into law, even though no benefits until 2013 or 2014.
Things are looking fairly good for Republicans to take back the House next year, but it’s almost numerically impossible for Republicans to take back the Senate in just one election.
It is much better to stop the bill now before it ever gets enacted, because it is so difficult to repeal entitlement programs under any circumstances.

As a US Navy Veteran of the Korean war it is my conviction that IF these individuals did in fact perpetrate a deliberate cold blooded murder of a civilian,no matter what country he /she is from they probably deserve what they received. There is NO justification for such behavior. Further I personally believe that had this occurred during the Korean War they ALL would have received a far worse penalty. Again if these persons murdered someone in cold blood they deserve far worse than they received.
Just so you all know…..I finally got through to a staffer in the Udall office….Colorado’s Dem Senator….funny….Yeah….I was calling Nelson…..he said the phone system is all messed up and it is hard to get through to the correct person…..does this not sound like someone planning to stop people from getting their voice heard….I went ahead and left a message there anyway to give to Udall…..we the people have spoken and don’t want this immoral bill…..nearly 60% oppose it last I saw….could be more now….I also said that I and several of my friends believe this is totally an “unconstitutional” bill and we will sue all members who vote for it!!! What does it take to get a wavering senator to vote for health care reform?
Here’s a case study.
On page 432 of the Reid bill, there is a section increasing federal Medicaid subsidies for “certain states recovering from a major disaster.”
The section spends two pages defining which “states” would qualify, saying, among other things, that it would be states that “during the preceding 7 fiscal years” have been declared a “major disaster area.”
I am told the section applies to exactly one state: Louisiana, the home of moderate Democrat Mary Landrieu, who has been playing hard to get on the health care bill.
In other words, the bill spends two pages describing would could be written with a single world: Louisiana. (This may also help explain why the bill is long.)
Senator Harry Reid, who drafted the bill, cannot pass it without the support of Louisiana’s Mary Landrieu.
How much does it cost? According to the Congressional Budget Office: $100 million.

Along these lines, did you ever consider that the reason we’re not tapping into our oil at the mountains and other places is that they’ve been turned over to China as collateral or payment to appease;thus, the talk of China drilling, etc.

EXACTLY – it is the only thing that makes sense of the ban on any and all attempts to get our own gas/oil. Heck, even to get wind power the blades are made in China. I’m not sure about the solar panels but I would not doubt that they are foreign made as well.

LEBANON, Ore. — One week, Rhonda Rebmann’s niece had the flu.
The next, her 10-year-old tabby cat started showing respiratory symptoms. Buddy Lou died four days after she brought the cat to the family’s veterinarian, the first feline H1N1 death in the United States.
“It’s crazy,” said Rhonda Rebmann. “I would never have thought, never have thought a cat would have gotten this from a human.”
Emilio DeBess, State Public Health Veterinarian, says it’s a human passing a disease to a cat is an interesting scientific development, but a rare one. He adds, cat owners should not panic about giving their pets the flu.
However, pet owners should take care handling their pets if they are sick.
DeBess recommends washing your hands before touching your pet or their food and water. Also, avoid touching your pet’s nose, mouth and eyes.
our ferrets in Oregon have gotten sick with H1N1 and recovered. A ferret in Nebraska died.
Birds and pigs can also get H1N1.
So far, dogs have no contracted H1N1 but state health experts say they are not sure if dogs are immune or have just not contracted this strain of flu.

NELSON: NEBRASKANS’ VIEWS MUST BE HEARD IN HEALTH CARE DEBATE
November 20, 2009 – Today, Nebraska’s Senator Ben Nelson announced that he will vote for the motion to proceed to debate health care reform on the Senate floor and issued this statement:
“For more than a year, Nebraskans and all Americans have debated health care reform in their homes, at work, and with friends at hundreds of town hall meetings.
“This weekend, I will vote for the motion to proceed to bring that debate onto the Senate floor. The Senate should start trying to fix a health care system that costs too much and delivers too little for Nebraskans.
“Throughout my Senate career I have consistently rejected efforts to obstruct. That’s what the vote on the motion to proceed is all about.
“It is not for or against the new Senate health care bill released Wednesday.
“It is only to begin debate and an opportunity to make improvements. If you don’t like a bill why block your own opportunity to amend it?
“As we have seen before, obstructionists are inviting a move toward reconciliation by opposing this first procedural vote. Let’s be clear. That route shrinks debate and amendments, eliminates bipartisanship and needs only 50 votes to pass a bill.
“In the end, far more Washington-run health care policies win, but Nebraskans lose.
“In my first reading, I support parts of the bill and oppose others I will work to fix. If that’s not possible, I will oppose the second cloture motion—needing 60 votes—to end debate, and oppose the final bill.
“But I won’t slam the doors of the Senate in the face of Nebraskans now. They want the health care system fixed. The Senate owes them a full and open debate to try to do so.”

One Important Congressional Effort to Amend the “Natural Born Citizen” Clause
Members of Congress have over the years made various attempts to change the meaning of “natural born Citizen” as it is found in Article II. One of these attempts is most noteworthy because it pertains to children born in the United States. After H.J. Res. 88 failed to make it out of committee, Sen. Nickles (OK) along with Landrieu (LA) and Inhofe (OK) brought forward S. 2128 in February 25, 2004, the Natural Born Citizen Act, a bill to define the term “natural born Citizen” as used in Article II of the Constitution of the United States to establish eligibility for the Office of President. http://www.govtrack.us/congress/bill.xpd?bill=s108-2128. This bill provided as follows:
“A BILL
To define the term ‘‘natural born Citizen’’ as used in the Constitution of the United States to establish eligibility for the Office of President.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ‘‘Natural Born Citizen Act’’.
SEC. 2. DEFINITION OF ‘‘NATURAL BORN CITIZEN’’.
(a) IN GENERAL.—Congress finds and declares that the term ‘‘natural born Citizen’’ in Article II, Section 1, Clause 5 [sic] of the Constitution of the United States means—
(1) any person born in the United States andsubject to the jurisdiction thereof; and
(2) any person born outside the United States– (A) who derives citizenship at birth from a United States citizen parent or parents pursuant to an Act of Congress . . .”
Paragraph (1) repeats the same language that we find in the Fourteenth Amendment. But if a Fourteenth Amendment born citizen is automatically an Article II “natural born Citizen,” why would such a bill be needed? This attempt at amending the “natural born Citizen” clause shows that there are members of Congress who understand that just being a Fourteenth Amendment born citizen does not make one an Article II “natural born Citizen.” Congress also tried such changes with S. 2678 (2008); H. J. RES. 15 (2005); H. J. RES. 104 (2004); H. J. RES. 47 (2001), and approx. 25 other times since the 1870s. If a Fourteenth Amendment born “citizen” was the same as an Article II “natural born citizen,” why would members of Congress see a need for this bill? Hence, it can be seen that just being born in the United States and being declared a “citizen” under the Fourteenth Amendment does not automatically make one an Article II “natural born Citizen.”
It is also noteworthy to examine the Natural Born Citizen Act Summary that accompanied the bill which states in pertinent part: “The bill is intended to clarify the term and end uncertainty about the eligibility requirements to run for the Office of the Presidency. The definition of this term is an issue that has been debated in legal circles for years and has never been ruled on by the courts. Clarification is needed before this becomes a real issue. Congress should be the institution that defines this term, not the courts.” http://www.jcics.org/natural%20born%20summary%20(word).doc. The same information was expressed by Senator Nickles of February 25, 2004 when he addressed the Senate on the bill and which statements are contained in the Congressional Record. Sen. Nickles, in his speech when introducing the S. 2128, announced that: “There is obviously a need for clarification. In the absence of judicial interpretation, Congress can express a legislative interpretation of Constitutional terms. We should not wait for an election to be challenged and the courts to decide what ‘natural born’ means.” Sen. Inhofe referred to the repealed Naturalization Act of 1790 and used it to argue that in the absence of any judicial interpretation, Congress has the authority to define what a “natural born Citizen” is. Among other things, the bill provided that “any person born in the United States and subject to the jurisdiction thereof” is an Article II “natural born Citizen.” Hence, the Senator recognized that simply being born in the United States and being subject to the jurisdiction thereof does not necessarily make on an Article II “natural born Citizen.” The bill did not advance and met the same fate as other similar Congressional proposals to amend Article II’s “natural born Citizen” clause.
What is important is that this “natural born Citizen” issue as it pertains to children born in the United States existed in Congress as far back as February 2004 and has yet to be resolved. What is also important is that this bill would have directly impacted Obama’s eligibility to run for President of the United States. Whether or not this bill if enacted into law would have been Constitutional is another question.

An “additional income tax to the upper brackets, folks earning more than $200,000 or $250,000,” could fund more troops, Levin, a Michigan Democrat, said in an interview for Bloomberg Television’s “Political Capital With Al Hunt,” airing this weekend. White House Budget Director Peter Orszag has estimated that each additional soldier in Afghanistan could cost $1 million, for a total that could reach $40 billion if 40,000 more troops are added.

The small group pushing this dictate through do not CARE one iota about what the people want. They only care about getting the thing through in a way that makes Americans think we have to abide by the outcome.

I believe that the citizens are not required to oben any law that is unConstitutional. The only problem is convincing a judge (considering the fools sitting on the benches now) that the law “is” UnConstitutional. I’m not sure what the solution is.

Also, Reid cannot legally and constitutionally call for a vote on this monstrosity until the electorate has had an opportunity to read it and give their input about it to their representatives.
THAT’S the way it’s meant to be done. Any erosion of the process highlights the criminal intent of the players to hijack our system in order to impose their own agenda on our nation rather than to affirm the will of the people.
The huge number of infractions in the process leaves the bill open for much future litigation, at least.
Here’s hoping for every possible legal motion and injunction against the implementation of the thing to be applied asap, in every possible venue.

The Senate can largely do what they want. Even such rules as exist can be set aside by a vote.
To the point at hand – the vote tomorrow for cloture. The ONLY requirement is that 60 misguided fools vote for it, without reading it.
That may not be the way the Senate was ‘intended’ to work, that that is the way it legally and procedurally works.
The only recourse you have is to not vote for Senatorial candidates that are this foolish. That is the role We The People play. If we vote wrong, we get wrong.

IMPORTANT CONCEPT:
You may need this weapon in your arsenal when you call fence-sitting Senators.
The Lunatic Left has managed to position this as a battle between those who are FOR healthcare reform and those AGAINST reform. This is dead wrong.
The more important concept is the NATURE of the reform. Like for any complex business, “continuous process improvement” is a good and necessary thing. Nobody says the current system is perfect – or even the best it can be.
The issues is when and how. The current House and Senate bills are doing it all wrong. They are using the wrong processes and concepts and the bills are far too complex and expensive.
We need to reset. The following process must be used: Identify the several things that are the most in need of fixing. Jointly (republicans and democrats) develop cost effective solutions for these. Implement these right away (not years downstream). Evaluate efficacy of the solutions. Adjust as necessary.
But to reiterate – the most important idea is that we are not against reform, just THIS reform.

I disagree. I believe the Declaration of Independence and the Constitution trump erosive “rules” that have slipped in to deprive the people of our rights.
Of course, I am speaking more ideally than practically, I do admit.
From my standpoint, however, those 60 really have no power, if the people refuse to follow their dictates.
We just have to stop believing that their shennigans trump our rights.
Of course we have a right to read and discuss potential legislation. Our founders set up the whole government to function from that basis.
They had just rid themselves of this very yoke: 1 or 20 or 60 people enforcing their will upon thousands and thousands.
The last thing they would have established for governance is the absurdities we are witnessing today.
The LAST thing they would have condoned is the idea of passing a bill that has not been read or debated on all points.
The LAST thing they would have condoned is the implementation of a law the people had not heard, nor had the time to respond to. The government they established was ALL about the people.
(The LAST thing they would have condoned is a 2,000 page bill!)
The people were the ones who decided the legislation at grass roots levels, and the representatives enacted their decisions, as best as can be done, by the authority given to them by the people.
What we see occurring in Congress at the moment, imo, is the working out of a type of governance that is not really our American form of government at all. Just the forms, but not the substance.

ANYONE who votes or acts in ANY way to bring to vote a 2,000 page bill without allowing the electorate to read and discuss the document and without allowing debate on every point on the Senate floor is OBVIOUSLY up to something utterly different than representing the American people and/or acting in accordance with our established governance. In short, he, she, or they are OBVIOUSLY up to something crooked.
That fact is self-evident. NO ONE, constitutionally representing ME, the citizen, “cheats” me of my rights in such a blatant way.
“They” can pretend that their actions mean that I have “consented” to this farce. I don’t buy the sham one little bit.
And, no, I do not hold the outcome to be legally binding upon me at all. Just speaking for myself.

Disagree all you want, but the way the process is SUPPOSED to work is that you elect trustworthy Congress people and then trust them to do their job. It is not practical for them to keep checking with their constituents about everything. The Congress people are supposed to REPRESENT you, not necessarily let you hold their hand. That is the PURPOSE of ‘representative government’ – so that trusted officials can do all the sausage making and We The People don’t have to watch the gruesome details or take too much time from our daily lives.
